The Human Rights Code protects renters against discrimination. You can’t be refused an apartment based on family status, race, religion, gender, and more – but in Alberta and Manitoba a landlord can turn down an applicant based on age. It’s a bit contentious, because some provinces allow “Adult” rental buildings, where the 50+ crowd can be assured they won’t be getting any young neighbours. Why some provinces and not all or none? Why should the 50+ crowd be given the right to live free of youthful residents? Does being 49-and-under
equate to a noise level or a lifestyle incompatability with that of a person aged 50+? While creating an “Adult” community makes sense on some level – wanting a like-minded community that trends towards a quiet and conservative setting, and I’m sure there are buildings in every province that “just happen to have” only adult residents, it is strange that age isn’t universally protected. Ignat “Iggy” Kaneff honoured with Lifetime Achievement Award A STRONG BELIEVER in building
communities and a generous philanthropist, Ignat “Iggy” Kaneff has helped to improve the lives of many around the world over the last 65 years. For this and much more, Mr. Kaneff received the Building Industry and Land Development Association’s (BILD) highest honour this year — the Lifetime Achievement Award. Builder and land developer, Mr. Kaneff received the accolade at the 36th annual BILD Awards surrounded by his family, friends and more than 1,100 industry colleagues. “It is my privilege to present Mr. Kaneff with this award recognizing his lifetime of achievement,” said BILD President and CEO Bryan Tuckey. “He has made an immense contribution to the lives of people in the GTA and in his hometown in Bulgaria by building places where people can live, work and play.” Born in Gorno Ablanovo, Bulgaria in 1926, Mr. Kaneff came to Canada in 1951 and founded Kaneff Properties Limited in 1956. He has been a BILD member since 1959 and is currently CEO and chairman of the Kanefff Group of Companies. He has built thousands of family homes, highrise residential apartment units, as well as retail commercial plazas and office buildings in the GTA. An avid golfer, Mr. Kaneff has also created six golf course properties, including the first-class Lionhead, Royal Ontario and Royal Niagara golf clubs. For 45 years, he has hosted an annual golf tournament that has raised more than $1.5 million for Community Living, an organization supporting children with intellectual disabilities in Peel Region. 24

SHOULD YOU GET INSURANCE WHEN YOU MOVE INTO A PROPERTY? When many renters move into their first property, there are many things that go through their mind. Meeting their roommates, finding their way around a new part of town or newfound independence. The thing that is usually forgotten is insurance for the Unit. It is usually not a priority when moving into a new place and many renters feel insurance is something they can do without. According to the Insurance Bureau of Canada, about half of all renters do not have insurance. This is even

more prevalent amongst young people. However, insurance can save you a lot of headache and heartbreaks when moving into a new property. Tenant insurance can be broken down into two main areas: 1. Contents insurance 2. Liability insurance CONTENTS INSURANCE Contents insurance protects your personal belongings,
such as your clothing, furniture or digital devices. This type of insurance usually costs a few hundred dollars and covers your belongings in cases of theft, fires, flooding, freezing or windstorms. It may even bail you out of a simple mistake. For example, you could go on a trip and decide to turn off the heat for a few days. However, while you are away, the temperature drops and the pipes freeze, causing flood damage to all your clothing, furniture and electronic or digital devices. Contents insurance could really ease the cost of replacing your valuables. Be careful, however, as you need to understand the exclusions and limitations in any policy you obtain. LIABILITY INSURANCE Liability insurance can be even more important than contents insurance. For example, in our flood example above, the flood could leak through the floor and damage the unit and its contents beside or under yours. Even if the landlord has insurance, the insurance company, tenant below, or landlord could go after you for the cost of the damages. Here is another possible scenario: standing on your balcony overlooking the park, sipping a glass of wine, your phone rings; startled you reach for it, dropping the glass, it bounces on the balcony railing and sails into the night. Below a father of eight is walking his dog when the glass smashes him in the head, killing him instantly. The dog runs onto the street and is hit by a car. You face potential litigation of impossible magnitude… Liability insurance will protect you to the extent of the insurance, should these issues occur. Do not believe that the landlord’s insurance will cover your damages. First, the landlord’s insurance only protects the landlord’s own property and personal liability. Your possessions will never be covered by the landlord’s insurance unless the damage was caused by the landlord. Second, if your neighbour’s property is damaged due to a fire or flood originating from your unit, the landlord could sue you for the damages caused to the neighbouring property. This is evidenced in the case Taylor v Allard , where the tenant was 50 per cent liable for the damages caused to the neighbouring property. Third, landlords are not responsible for providing alternative accommodation should your unit be involved in some accident. Therefore, having a Tenants Insurance policy that will ease the financial burden of moving and staying in a new place while repairs are being made on
the rental property (provided you bought that coverage). Lastly, there is case law which shows a landlord can demand that their tenant has insurance. In the 2005 case of Stanbar Properties Limited v. Brooke, the Ontario Superior Court of Justice upheld that tenant insurance coverage, if required in the lease, is enforceable and can be grounds for eviction. Make sure to read the lease to see if the requirement for having tenant insurance is written in the contract. Insurance may or may not be required when signing a lease, however, it is always a good thing to have. Perhaps the most difficult part of writing these articles relates not the actual writing, but thinking of a topic to address. So help us!!! MY APARTMENT IS A nonstop question zone. I have very limited space, yet still enough space to constantly be asking myself “Why did I buy this? And this? And that!” I’ll admit, when I moved into my first apartment I got a little excited and, despite budget restraintes (zero budget), I went a little crazy with what I considered investments. It’s not that all the items in my apartment are totally useless. It just took me some time to figure out they don’t all fit with my kind of lifestyle. Still, I like to think I’m not the only one to blame. Seriously, no one could have warned me not to buy any of these seven ridiculous items? SOUND SYSTEM: Besides the fact I would actually like to be on good terms with my neighbours, a sound system is just not at all necessary for my tiny apartment. Let’s face it, the sound from my iPhone speakers reach from the kitchen to my bathroom just fine. ELEPTICAL: Everyone who owns a piece of exercise equipment knows they don’t use it half as much as they should. Then there’s the fact I’m constantly bumping into it when I get out of bed in the morning. KING SIZE BED: About 2/3 of the furniture I assembled from IKEA seemed a lot smaller online then in my actual rental. Now my bedroom looks like it could belong to Shrek. LUXURY KITCHEN APPLIANCES: Kitchen appliances like a blender, Vitamix, and KitchenAid, I consider a luxury because you have to have the luxury of having a decent amount of counter and cupboard space to be able to use and store any of these items. Do you know how many different produces go into a Martha Stewart smoothie? DECORATIVE PILLOWS: How many pillows can you fit onto one sofa? The answer is a lot! The pillows look great. The only thing is I’m constantly looking for space to place all these pillows when it comes the time to sit on the only couch in my apartment. If you haven’t guessed yet - it happens a lot. LOUNGE CHAIR: Summertime is so short. You better believe I invested in a state-of-the-art lounge chair to make the most of my balcony. The only thing is, the lounge chair is now the only thing that fits on my balcony. Any suggestions on where to store a lounge chair now that it’s winter? VACCUM CLEANER: I really had the best intentions to keep my rental as clean as possible when I moved in. Of course, that meant I had to invest in the right cleaning appliances. The thing is when you have a small space, ends up your cutting edge vaccum cleaner doesn’t fit under any of the funiture and appliances which take up like 90 percent of your space. Just one more 12 pound item for me to store. Now, I wonder how much I can sell these items on Kijiji for... Want to share the scoop on your bad purchases? why are you getting passed over? Apartment building property management want to be discerning, and privately owned rental condo owners are even more concerned about guarding their investment, so you may be surprised to find out why you’re getting passed over.
First off, vacancy rates across the country are near record lows. It’s supply and demand, and without supply to meet the high demand, it’s a competitive market. Very, very competitive. Where a decade ago landlords were offering move-in incentives like a flatscreen TV or a free month of rent just to tip the scales in their favour because vacancy rates were so high, now they hold all the cards and prospective tenants are experiencing everything from bidding wars to bribery just to find a new apartment.
LIVING AT HOME: You’re ready to move out. You’re financially stable, lots of savings (thanks mom and dad for not charging rent!), great job. First-time renters aren’t exactly the ideal. While you look fine on paper, and you may think you know how to live on your own, first-time renters have a pretty steep learning curve. You’ve never paid rent, so do you really know what you can afford? You really have no experience paying this exorbitant expense every month and still budgeting for hydro, gas, TV, cable, Internet, food, clothes, etc. You can’t be prepared for the massive expense until you’ve experienced it, and landlords are wary of taking the chance. Plus, first-time renters are often annoying. They don’t know the rules and regs yet, and will often have unrealistic expectations – like having the landlord pay for and change the light bulbs.
You may think that you’re a prime candidate good job, good credit, lots of savings – but with a large pool of applications for every apartment, 64

TALKING TOO MUCH: You want to paint a picture of why you should get the apartment and it may serve you well to plead your case, but be careful of what you divulge. Telling horror stories about how you need to move because of your current crazy landlord probably won’t help you. Explaining sagas about your ex probably won’t bode well either. A new landlord doesn’t want to be involved in your drama. While you feel your new home is very personal, this is actually very much a business transaction, so behave like you mean business. TALKING TOO LITTLE: You go in and look around, trying to hold your cards close. You don’t want to let on how much you like the place because you don’t want the landlord to have the upper hand in negotiations. Guess what? The landlord has the upper hand, regardless, and there’s nothing you can do about it. Show them you like the place (without getting silly) because landlords are more comfortable with tenants who, they feel, will love and respect the place. They want you to like their home, and appreciate that you want to be there. So show it. SHOWING UP UNPREPARED: Don’t waste a landlord’s time. They’ve got a lot of people interested and you’ve got one chance to make a good first impression. Show up prepared. Have your cheque book and your references if you’re serious about renting. You know the application is going to require the names, phone numbers/email addresses of your current and past landlords, your employer and your personal references, and you know you’re going to have to give a deposit of at least last month’s rent. This is no surprise, so don’t come unprepared, or you’re just wasting time. Want to stand out as a better candidate? Show up with a copy of your credit report, a letter of employment or your last three pays stubs, your bank statement, letters of reference from your current or past landlord and from those you’d expect to vouch for you. Having all of these in a nice neat package to leave with the landlord will really impress and up your chances. LOOKING THE PART: Sometimes viewings are
not at convenient times – you’re racing over after work, or can just pop by before your soccer tournament. Landlords understand that you’re busy and that you’re not going to get your hair done just for the viewing. That being said, you will be judged, harshly, if you show up looking like you couldn’t be bothered to change your shirt for three days or shower in the last five. You need to be presentable. If you’re a mechanic and you’re still in some grease-stained jeans, that likely won’t set you back, but if you show up looking like you barely care about your own appearance, most landlords will assume that, if you can’t even take care of yourself, how will you ever take care of their property. This doesn’t mean you need to conform – a well-put-together goth or a clean, presentable hipster aren’t the same as a hung over slob. STARTING OFF WITH REQUESTS: Want to know what a landlord wants? A low-maintenance tenant. Someone who wants the place as-is and isn’t going to create issues where none exist. Even if you think you’re being helpful or bringing something to the table with your personal skills and contacts, if you make yourself a prospective tenant that sounds like they’ll be a hassle, you’re likely being moved straight into the ‘no’ pile. So don’t ask if you can change all of the light fixtures or if you can have your buddy come in and replace the vanity and toilet because you prefer a different look. That’s something that may or may not be negotiated when you move in, but isn’t something meant for the first meeting. You’re just hurting your chances. SMILE: Bad day? Fighting with your girlfriend? Didn’t get that promotion? Don’t care. Business is business. Wherever your mind is, get it back into the right place before you go to the viewing. Nobody wants to deal with a teary mess or a grouchy grump. And if you’re in the middle of a love tiff, can it when you get there and make sure you and your partner present a united front. Nobody wants to envision late-night calls from the neighbours over your domestic disputes. THE WRONG WAY TO ASK A QUESTION: Wrong: I have a band, will that bother the neighbours? Right: Is this a quiet place? Is there much of an issue with noise? Wrong: Do you mind if I paint the walls black? Right: Do you permit painting the walls? Make sure you’re not presenting anything the landlord may find questionable. You have to follow the rules when you take an apartment, but highlighting potential issues unnecessarily will certainly not do you any good. So, being the perfect tenant you are, now do you see any reasons why you may not be getting the apartment time after time?
