THE TERM OF YOUR LEASE IS ENDING

BUT YOU DON’T WANT TO GO ELISA KROVBLIT KEAY It was almost a year ago when you signed that lease, and you are happily settled into your home. But as the days pass and it starts to get closer to the end of that year term in your lease, do you know what happens next?

The short answer is: Nothing.

The problem is, some renters – and even some landlords – don’t know that. Some believe that when the term is over, the tenant has to move out. But that’s not true in Ontario.

Typically, with few exceptions, a lease doesn’t have an expiration date. The term stated in the lease has nothing to do with when it ends. A lease doesn’t have to stipulate a year. It can stipulate six months, two years, a duration of weeks if the rental is weekly, or it can have no time period at all.

The time frame in the lease is simply one expectation that is contractually binding, just like the rental price and other expectations and inclusions.

The reason for a time period in a lease is to state the landlord’s expectation of a minimum rental period, and the tenant’s commitment and right to rent through to the end of that rental period – as a minimum. If it is a one-year lease, the tenant is obligated and permitted to remain as a tenant for a minimum of one year. If it is a six-month lease, the 12 RentersGuide.ca

tenant is obligated and permitted to stay a minimum of six months.

At the end of that time period, the landlord and tenant have satisfied that time commitment.

The day after the term ends, the same rules apply to the tenancy, week-to-week for weekly rentals, and month-to-month for monthly rentals.

As the days pass and it starts to get closer to the end of that year term in your lease, do you actually know what happens next?

The short answer is: Nothing.

THE DIFFERENCE

The only thing that does change after the term has been satisfied is the right to leave or to evict.

As an example, for a one-year lease, if a tenant wants to move once they’ve lived in the apartment 12 months, they can give proper notice (in Ontario it’s 60 days for monthly, 28 days for weekly).

A tenant can leave at the one year mark and not stay for a 13th month. Or they can continue to stay for as many more months and years as suits them.

The landlord can evict a tenant

at any time – even during the first year when the lease term is still active – but only for cause, like non-payment of rent or violations of the lease. They cannot evict a tenant on grounds of personal use, as a vacant possession condition for a sale of the property or to perform extensive renovations.

After the year period, a landlord does have these additional eviction grounds.

A lease term is protection for both the landlord and the tenant. It offers both stability and commitment. Some landlords and some tenants choose to re-sign leases annually – but this isn’t obligatory. The terms of the original lease, except for the term length, and the price of rent (rent is allowed to be increased annually as per provincial regulations) continue for as long as the tenant remains.

Some people choose to re-sign a lease term for the security of continued tenancy that it offers, but it isn’t necessary. And it certainly isn’t necessary to move!

Beautifully cosy and historically significant, the Hespeler Village area of Cambridge is bounded

While housing is affordable, and big box stores and outlet malls are less than a kilometre away, the Queen Street strip readies itself for an influx of new residents in the next few years, with a more upscale feel and price scale. Restaurants are slightly pricier than those along Hespeler Road, but considering the quality and diversity of the dishes, they’re still a bargain compared to bigger city prices.

PICK A LOCATION. Choose a low-traffic area away from fireplaces and heaters and secure your tree in place. Try placing your tree in a planter box for a more modern look or add a tree skirt for a traditional feel.

PRUNE TO PREP. If you’re using a live tree, study it from a distance. Prune any small growths that jut out from the top and bottom of the branches.

FLUFF TO PERFECTION. With a faux tree, fluff and shape the branches to hide the trunk and make the tree look fuller. Be sure to check the branches from different angles to spot any neglected areas. Wear gloves to protect your hands.

ILLUMINATE. When selecting lights, choose a strand colour that matches your tree so the wire will be easily hidden. Start at the base of the tree and work your way up, wrapping lights around every branch from trunk to tip and back.

ADD A GARLAND. Start at the top of the tree, and slowly increase the amount of garland between each row, as you work your way down. Plan to use two strands of garland for every vertical foot.

PICK A THEME. Stay true to your personal style by decorating your tree to reflect the style of your home. Ornaments don’t have to match perfectly to look flawless, just remember to repeat and have fun with it.

PREP THE AREA. Place towels or blankets under the tree to protect fragile items in case any accidents occur. Hang antique or delicate ornaments near the top of the tree, where they will be less likely to get knocked off.

SHOWCASE YOUR FAVOURITES. Start by placing ornaments with sentimental value in prime positions and follow up with more dominant pieces to establish a rhythm. Next, hang large ornaments, spacing them evenly around the tree and fill in with any medium- and small-size decorations.

EVALUATE. Always take a step back when decorating to see which areas need filling. Hang a few ornaments closer to the trunk to create depth and interest and don’t forget the back of the tree. Finish dressing your tree by adding any specialty items, such as clip-on ornaments, faux flowers or icicles.

PLACE YOUR TOPPER. Whether it’s an angel, a star or an oversized bow remember to use a topper that complements the profile of your Christmas tree. For a tree with a traditional full silhouette opt for a more brilliant topper such as a star or an angel. For narrow or slim trees, try an elongated topper to enhance its slender form.

VACATION PREP FOR RENTERS

by JENNIFER BRAUN The thought of a vacation always sounds relaxing, until you actually have to plan for it. That’s when you realize you have about five thousand different things to worry about before your feet hit the sand and that mojito finally makes it into your hands. I’m talking about those little details you worry about that can ruing a trip. Like the possibility of losing your passport at the last possible moment, wondering if you actually locked the back door of your home and the thought of forgetting to ask your parents to feed the cat.

Then there’s the anxiety that comes with actually leaving your home behind. Those four walls hold all your worldly positions so it’s kind of normal that it’s totally a big deal.

Still, the holidays are almost here and you’re taking off for a bit. Don’t let fear stand between you and the perfect sun tan or trip back home.

Just follow these simple steps to rest assured and have your rental still standing for your homecoming.

LEAVE YOUR HOME KEY WITH SOMEONE YOU TRUST This is one of those moments where you realize how valuable a good friendship with your neighbours can be. If you’re living in a secure building, you shouldn’t really be letting your friends come 30 RentersGuide.ca

and go while you are away and it’s just easier to have someone as close as next door to check on your place. If you’re comfortable with it, tell your neighbour the details of your trip and give them access to your home in case of any emergencies. In fact, your insurance may require your home to be checked in on with some regularity to keep your policy valid.

You don’t want to come home after three weeks and find that you left the water running the whole time, having turned your den into a swamp.

TELL YOUR LANDLORD In your lease agreement there may be information about vacation procedure (check it!). Either way, let your landlord know if you will be away in case they may try to get in touch with you to plan repairs or any other emergencies. In fact, if there is a need for repairs or maintenance that would otherwise interrupt your happy lifestyle, this would be a perfect time for management to perform the work.

CLEAN YOUR RENTAL Cleaning your rental seems pretty obvious, but it requires a bit more attention before you leave on vacation. Don’t fool yourself in believing that leaving a couple of dirty dishes on the counter won’t

make a difference. It will!

Do a thorough cleaning such as clean out your fridge of any perishables that wont be good once you come back home. Most importantly, make sure you take out the trash. You don’t want to come home to any surprising odours.

DON’T FORGET ABOUT YOUR DOG/CAT If you’re not bringing your furry companion with you, plan to have someone take care of them. It’s a big responsibility and you wouldn’t leave them with just anyone. Don’t leave this important detail to the last second.

DOUBLE CHECK EVERYTHING To really ensure you won’t be worrying about your home while on vacay, double check everything!

Make a list if you have to and cross things off once you checked them to make sure you did in fact get them all done.

Let’s face it – your electronic devices make the world go round, and in the moving business, we realize how important those items are to families.

One of the most common questions we get is regarding how to transport electronics safely, especially big-screen TVs. During a move, whether it’s across town or across Canada, it is important to give these items special treatment so they arrive in one piece and in good working order. The best advice we have for accomplishing this goal requires some forethought: to keep the original boxes and foam spacers the electronic items came in.

That is truly the safest method for moving them.

Of course, people rarely keep these boxes, so at Two Men and a Truck - Canada, we have specialty boxes and crates designed specifically to move big-screen TVs safely. People who do their own packing and moving should be aware of how easy it is to damage one of these units. Spending a few dollars extra to purchase or rent one of these special boxes can make all the difference. They can accommodate any size TV, so there is a solution for every unit.

Another thing to remember is that most of these television sets are mounted on wall brackets – and moving companies are reluctant to disassemble the wall mounts or assemble them at the other end.

Usually, if something is going to go wrong, that’s when it will happen – and again, people rarely keep the installation instructions for the brackets. It’s far too chaotic on moving day to be trying to find any instruction manuals. The best plan when preparing for your move is to

take the TVs off the walls yourself, ahead of time, and have them ready to be packaged properly.

Here’s a tip for anyone disassembling electronics for a move.

Get your digital camera or phone and take photos of the wiring connections on the backs of the TVs, cable boxes, DVD players and the like. When it comes time to reassemble them, it will be much easier to reference how they were set up originally, saving time, stress and frustration.

The same goes for stereos and gaming systems. Many teenagers leave their entire gaming systems hooked up until moving day. It’s up to them to disassemble their systems and hopefully place them into the packing they arrived in. If not, the best thing to do is wrap consoles in anti-static bubble wrap and place them into appropriately sized boxes so they won’t move around during the trip. In fact, this is the best way to treat most electronics items. That includes computers – especially desktop units. We have specialty boxes designed specifically for them that can be bought separately. If you choose not to go that route, then

surround the unit with anti-static bubble wrap, and again, place it into an appropriate sized box.

And one last handy tip: pack the associated hardware with your electronics. When packing computers, place the mouse, keyboard, power cord, scanner, printer cables, etc. all into the same box. When these cartons arrive at your new digs, you’ll be very glad you did!
