Get it in writing

and have your lawyer review your agreement

B

uying a brand-new home offers you an opportunity to customize it to your liking. It can be a dream come true and an investment for the future – but don’t forget, it’s also legal transaction. The term “get it in writing” has never been more important than in the case of the new-home purchase since such a document outlines everything your home will have in it, on it and around it. Otherwise known as the Agreement of Purchase and Sale, the contract spells out the terms and conditions between you and your builder. Without it, if there is a misunderstanding or disagreement, it’s impossible to prove what was agreed upon. Since building a home is much more complicated than a resale transaction where the unit and/or property likely already exists, there is no set Agreement of Purchase and Sale or standard contract for buying a new home. In some provinces, builders may have standard contracts prepared by the local home builders’ association or their new-home warranty program. Builders often prepare their own agreements so contracts can vary from one builder/developer to another and from province to province. Before you sign a contract, review it carefully with the builder and ask questions to make sure you fully understand what it contains. Your next step is to then take it to a real estate lawyer and have it reviewed. Once it is signed, it becomes a legal document and an agreed-upon contract, so seeking the services of an experienced real estate lawyer is an important step toward ensuring that your dream home becomes a reality.

Why transit is crucial to housing

As we tackle transportation and infrastructure challenges, proximity to transit is increasingly key

I

f you’ve been following the debate over transit and infrastructure expansion in the Greater Toronto and Hamilton area, you’re likely well aware of just how important a topic this. These issues are critical to the future of the region. This is why various home building associations and other organizations see some promise with the latest federal budget tabled on March 21, in which Finance Minister Jim Flaherty promised increased funding for infrastructure improvement. Proximity and access to transit and amenities – from health care to schools to shopping to recreation – are critical for builders and buyers alike. Development charges for developers to build new communities, and help fund infrastructure growth, need to be reasonable, so as to deliver new-home prices to buyers that are affordable. It will take months, if not years, for new funding to reach municipalities, and that’s assuming cities such as Toronto, Hamilton and elsewhere can agree on expansion plans. In the meantime, prospective homebuyers would be wise to pay careful attention to these matters, and to make honest assessments of how well equipped your potential newhome communities are in this regard.

hen these two renowned builders get together, remarkable things happen! Their first Hamilton area collaboration was the launch of Lake Pointe in Stoney Creek, where their joint efforts resulted in a community so spectacular it was awarded the Grand SAM at the Hamilton Halton Home Builders’ Association awards show. Then Tiffany Hill, in Ancaster, set sales records and established a new level of luxury and community design. And now, Rosehaven and Homes by DeSantis are coming together again to bring On The Ridge to Stoney Creek, a remarkable new neighbourhood with inspired home designs in a breathtaking setting. The neighbourhood will be opening later this year, but you can register right now to attend the Preview at liveontheridge.ca It’s a real estate truism that Rules No. 1, 2 and 3 in property value are location, location and of course, location. ROSEHAVEN HOMES & HOMES BY DESANTIS

On the Ridge

Rosehaven and Homes by DeSantis are coming together again to bring On The Ridge to Stoney Creek, a remarkable new neighbourhood with inspired home designs in a breathtaking setting. The name says it all! On The Ridge is literally on the escarpment just off Upper Centennial north of Highland Road West and south of Mud Street West for one of the most coveted settings in the entire Hamilton area. Poised high on the Niagara Escarpment where Nature is spectacular, fortunate families who live On The Ridge will enjoy a higher state of mind and a lifestyle that’s a step above. You will be able to choose from elegant townhomes, spacious semis, and beautiful detached homes on 35- and 40-ft. lots – most with extra-deep backyards, designed for growing families or couples who just want space to spread out. And you will be paying prices that are up to $150,000 below what you would expect to pay in the Toronto area! This will be a neighbourhood that is elevated above the rest, in more ways than one! Homes at On the Ridge will come with standard features that are often considered luxury upgrades in other communities. These include nine-ft. ceilings, imported ceramic tile in main floor foyer, kitchen and powder room, oak stairs, stone and brick exteriors and quality upgraded trim, among others. There will even be the practicality and potential of separate side and garage entrances that make your basement so accessible. You can also choose finished basement options as well.

This is an established neighbourhood in an already successful community where there’s an abundance of shopping and new Power Centres nearby, including the RioCan Mall. Also there are lots of schools and parks nearby – some right in the community. On the Ridge will be nestled next to a new elementary school and the existing Saltfleet Secondary School, right by an existing neighbourhood park and a brand new park. There will be great highway access as the community is close to the Red Hill Parkway, the LINC (Lincoln Alexander Parkway) and the QEW. The proposed new GO Train Station at Centennial is only eight kms away. On The Ridge will be a great family community designed for people who love the outdoors with parks, golf courses and a whole world of recreation so close at hand. You’re just minutes away from Satellite Golf Centre and Pro’s Golf Centre as well as Glendale Golf and Country Club and King’s Forest Golf Course. You’re so close to the Maplewood Park, Devil’s Punchbowl Conservation area, Dofasco recreation park and Battlefield Park. So, if you’re interested in a neighbourhood that will help elevate your family above the rest, then register now at liveontheridge.ca Rosehaven Homes and Homes by DeSantis are coming to the escarpment in Stoney Creek. Just imagine what life will be like when you live On the Ridge.

GARDENING IDEAS FOR

spring

TOP

FOR

MANY

YEARS,

SHERIDAN

Nurseries (sheridannurseries.com) has been Geranium Homes’ supplier of choice for beautiful outdoor planters as well as seasonal decor for our model homes and sales centres. As we approach the season for warm weather, I spoke with Brenda Luckhardt, business-to-business marketing and development manager for Sheridan about making plans for spring. To get you in the mood for gardening season, bring some of the outdoors inside. Luckhardt says that outdoor plants are now transitioning out of dormancy and it is possible to force blooms ahead of their normal period if brought indoors. Good choices include pussy willow, forsythia, flowering cherry and crab apples. Cut branches are often found in Gardening Centres. Luckhardt also suggests “Fresh herbs provide a taste of summer all winter. When kept in a sunny window, they can be transferred to the garden once the threat of frost is gone.” Novice gardeners will discover many gardening websites, blogs and videos to fuel their inner green thumb. Luckhardt recommends you also visit your local nursery for information about product and care tips suited specifically for our own hardiness zone. I asked Luckhardt about new plants making an appearance this year. “People are always excited about adding something new to their collections. Sheridan is celebrating its 100th anniversary and has introduced many namesakes to mark the occasion: delicately fragrant floribunda rose Sheridan’s Anniversary Blush; a floriferous ninebark Mahogany Magic; Hosta Flash Forward; and a re-blooming Dwarf Lilac Purple Be Dazzled,” she says. Many of these plants were featured at Canada Blooms in mid-March. Popular colours in gardens often follow the pantone colour of the year. This year is Emerald Green, which works with any flower hue. You only have to walk through a shopping mall to see the return of bright and bold colours in clothing and accessories. Luckhardt explains that this also translates into gardens, with more people favouring strong colour over pastels. White is always a garden staple and looks especially striking in shade. She adds that in an online survey, Proven Winners – a developer of new annuals, perennials and flowering shrubs –

Dwarf Lilac Purple Be Dazzled LEFT

Ninebark Mahogany Magic

learned that purple annuals won over traditional red and ever popular pink. Expect to see some new purple plants in the next few years. As Geranium is a new-home builder, I was keen to ask what landscape planning suggestions Luckhardt would offer to the fi rst residents of a house. She responds, “Any time of year is a good time to start to plan a garden. New-home owners are fortunate to have a blank slate to work with. Creating a landscape plan can save both money and time in the long run, as plants purchased will be chosen to thrive in a specific location. The garden can be phased as your budget permits. Of course, a design should ensure the garden will look good in all seasons.” If you’ve never owned a home with a garden before, you might not have the tools you’ll need to get you started. Luckhardt recommends investing in tools of the highest quality, even if it means buying fewer at fi rst. “At a minimum, a new gardener should start out with a sharp digging spade, a fan rake, a garden fork, a hand trowel and a pair of bypass secateurs,” says Luckhardt. And, don’t forget a couple of good pairs of gloves! This is part of a series of articles on topics of interest to new-home buyers, authored by Sue Webb Smith, marketing director for Geranium Homes.

BAYVIEW-WELLINGTON HOMES Niagara-on-the-Green

Plans for the mall, along with this newest phase of construction that includes the towns, and a new collection of semis and corner quads, are on view at the award-winning Niagara-On-The-Green site office. With many homes offering golf course locations and green space as their only neighbour, prime locations are selling quickly. With each sale of a new home in this newest phase, BW Homes will be making a $100 donation to Habitat for Humanity Niagara. The living space of these towns with Victorian and Colonial facades ranges from 1,320 to 1,620 sq. ft. You’ll find gracious features such as a double-doored entrance into a sunken vestibule, semi-circular staircase, gas fireplace, kitchens with breakfast bars and side windows within the corner units. Corner quads of 1,400 to 1,700 sq. ft. are equally appealing for their style and low maintenance nature. Built in blocks of four, each is a corner location with a side yard and filled with luxury features. Plans offer a wrap-around porch while inside a “parlour” offers the opportunity for a dining room with enough space to add a sitting area for after-dinner aperitifs. It faces out to an open-air courtyard bordered by brick walls for total seclusion. Luxury semis have already made a name for themselves in this quiet community alongside the Royal

Niagara Golf Course where several models stand open for viewing. Twenty-five feet in width, they include open-concept design, decorative columns that eliminate long expanses of walls, cathedral and vaulted ceilings, upper walkout terraces and curving staircases – yes – within a semi! Niagara-on-the-Green is the award-winning community by Bayview-Wellington Homes, where more than 400 families already make their homes. Elegant stone gateways and historic street lamps accent heritage-style residences within this quiet community. This is where you’ll discover a taste of luxury, lifestyle and leisure within each home.

HAMILTON HOUSING MARKET –

healthy and worthy of investing by MATHIEU LANGELIER

TD’S CHIEF ECONOMIST, CRAIG ALEXANDER, ADDRESSED 90

members of the Hamilton-Halton Home Builders’ Association recently at the TD Economic Outlook Breakfast in Hamilton. Alexander highlighted the global economic slowdown and described a changing of the tides in 2013 and even greater momentum in 2014. Worries remain about the U.S. fiscal drag, but U.S. housing prices have fi nally turned a corner. Business confidence is the key to U.S. economic growth and this also applies to Canada. Interest rates are forecasted to remain unchanged until the third quarter of 2014 and they should only increase by half a percent point before 2015. This will support moderate economic growth across the country for the next two years. On the subject of the housing market, Alexander explained that there are still some fears of home price over evaluation in parts of the Canadian housing market, particularly Vancouver. As well, the condo supply in the GTA is a concern for TD because of the high level of supply of new units and slowing demand. However, these concerns do not impact Hamilton. Alexander forecasted that average home prices will increase by two to three per cent per year over the next two years in the Hamilton-Halton market. As well, there are no major signs of a price correction in our housing market. “The market should stabilize by spring 2013 and gain some momentum

later in the year,” Alexander said. The Hamilton housing market is in good condition and looking stable. The HHHBA is delighted to hear TD’s chief economist confi rm what we have been saying for months, which is that the Hamilton housing market is healthy and it is a great time to invest in Hamilton. Federal budget: a hit and miss austerity style budget

The HHHBA welcomes Finance Minister Jim Flaherty’s budget measures that increase federal support for national infrastructure and improve the supply of skilled tradespeople. This is a prudent budget aimed mostly at cutting expenses and focussing on the reduction of the deficit. There are many good intentions in this budget such as the reduction of red tape for businesses, the support for affordable housing, and the investments in research. However, we’ll see how they turn out in reality. The attempt to increase revenues from cracking down on international fiscal evasion is also a step in the right direction, but the Minister failed to put importance on a much more specific domestic issue: the underground cash economy. It is disappointing to see the federal government focussing its attention on international tax evasion when a simple renovation tax credit would increase the amount of legal renovations and as a direct result reduce tax evasion here at home. Every household will need to renovate/ update their home eventually, versus very few wealthy people benefitting from tax havens. This represents a large missed opportunity for our industry.

top 100 employers by industry include companies from the automotive, manufacturing, pharmaceutical, professional service and construction industries. Companies here have access to a high quality local work force, with 56 per cent of residents holding a post-secondary education – about 12 per cent higher than the provincial average. While manufacturing industries account for 15 per cent of employment, managerial, business and administrative categories make up 36 per cent of occupations. Some of Oakville’s major employers have performed well over the last few years, with firms such as Goodrich Landing Gear and Javelin Technologies increasing employment. In September 2011, Ford announced a $2.5-million investment in a research initiative for new powertrain systems for hybrid vehicles. In December of that year, Goodrich Landing Gear received a $3.3-million investment from the provincial government to assist the company’s R&D. Sheridan College also officially opened its new Applied Research and Collaboration Centre, for use by the faculty, students and external partners specifically involved 51

in research projects administered through Sheridan’s office of Applied Research and Innovation. A number of new businesses have also made their way to Oakville, bringing more than 650 new jobs and absorbing more than 411,000 sq. ft. of commercial and industrial facilities. An historic town with a thriving waterfront, Oakville has preserved its rich heritage, with many 19th Century buildings in the downtown core. Downtown also boasts one of two local harbours on Lake Ontario, featuring more than 1,000 slips and moorings for sail and powerboats. Bronte is the location of Oakville’s second harbour, and has an abundance of fine shops and restaurants. Transportation *Supporting all this development is a strong and further improving transportation infrastructure. Prime location at the centre of major transportation routes – the QEW and Hwys. 403 and 407 – facilitates access to major markets in Canada and the US. The network includes toll and toll-free expressways, commuter and urban public transit, by rail and bus, national and international rail service for people and goods, global passenger and cargo aviation services, and extensive inland and international marine shipping facilities. Illustrating how important transportation is to the city, the Town of Oakville is currently surveying residents to help identify community priorities from now until 2031. The “Switching Gears” Transportation Master Plan is intended to deliver an exceptionally detailed level of integration between land use and transportation planning, to help identify Oakville’s transportation needs and consider a diverse range of options to satisfy future travel demands.

Says Mayor Burton: “Our goal is to offer more balanced, efficient and sustainable transportation choices for people, goods and services to move around Oakville. Public input is key to helping us focus on transportation priorities that matter most to our community.” Switching Gears is one of several master plans that together with other key planning initiatives will create a path to a more livable and sustainable Oakville into the future, the Town says. Developers see the growth potential in Oakville, and a number of projects are underway from companies such as Fernbrook Homes and Menkes Developments. And in nearby Hamilton, DiCenzo Homes, Multi Area Developments and New Horizon Homes have new openings, while in Burlington, Davies Smith Developments is also building. This means plenty of new-home shopping options for prospective buyers. Culture *Oakville also boasts abundant natural attractions and culture, with more than 2,400 acres of parkland, theatres and galleries, Glen Abbey Golf Club, and the annual Waterfront Festival and Jazz Festival. Culture in the city, in fact, received a big boost on March 24, 2012 with the grand opening of the new Queen Elizabeth Park Community and Cultural Centre (QEPCCC). Located at 2302 Bridge Road, QEPCCC offers more than 144,000 sq. ft. of active living space, making it one of the largest venues in Canada to house such a diverse collection of recreation, arts and cultural opportunities. It offers classes, workshops, camps, drop-in activities and events for all ages and abilities. The facility boasts an aquatics centre, two gymnasia, a youth centre, an older adult centre, dance studios, a recording studio, fine arts studios, a rehearsal hall, black box theatre, gallery and museum space. “This new facility symbolizes our goal to be the most livable town in Canada, and its opening clearly demonstrates our continued progress towards that goal,” says Burton.

LOSANI HOMES LAUNCHES ‘THE GREAT GARAGE REVOLUTION’ with its flexible new townhomes THERE IS A REVOLUTION BREW ING IN

downtown Kitchener – an entirely new way to look at townhome design and the way we live. With the tremendous success of its launch in February, the award-winning builder Losani Homes has just introduced an innovative new collection of townhomes at Victoria Common in Kitchener, the largest master-planned urban community ever launched in Waterloo Region. Among the townhomes’ many appeals is what the builder calls the “FlexSpace Advantage” – a measure of exceptional design flexibility which all the floorplans demonstrate. Those who have already comparisonshopped know that the vast majority of townhomes offer only single-car garages. But at Victoria Common, Losani’s designers have provided the garage space for two cars – parked in tandem or side-by-side – plus space for a third vehicle in the driveway. Yet Losani is giving its homebuyers unprecedented flexibility and choice. Because if homeowners are happy with just one parking space in the garage, they can convert the second space into a room tailored to their lifestyle, with an unlimited range of options. It can be a functional space like a private office, a gym, a work room or a mud room. Or it can be an entertainment area – with a home theatre, a games room, a hobby room or a den with a bar ideal for hanging with friends. “Flexspace is a real ‘plus’ for our homebuyers,” says Fred Losani, president of the company. “We offer 14 mo del s but t ho s e blue pr i nt s a r e ju st t he beginning. Because each offers a half dozen different options to customizing what would otherwise be a lonely and unglamorous area of the home. ”At Victoria Common, Losani is offering a collection of affordable and customizable two- and three-level townhomes with prices starting from $249,900. Ranging in size from approximately 1,060 to 1,985 sq. ft., each of the 101 towns in Phase I will be luxuriously appointed throughout with hardwood flooring, stone countertops, nine-ft. ceilings, keyless entry, premium lighting and plumbing fi xtures and custom Barzotti cabinetry.

A brownfields redevelopment, Victoria Common will quickly evolve into a dynamic new cosmopolitan centre in downtown Kitchener, a pedestrian-friendly place where life’s essentials are within easy walking distance, and incorporating one of the most advanced green energy systems in Canada.

The Pinehurst is family living and entertaining at its finest as you’ll discover once you enter the front door. Half walls define the living room at the entrance. FOLLOW THESE STEPS TO SEE IF YOU’LL QUALIFY for a MortGaGe oN YOUR DREAM HOME

01

05

Calculate the combined monthly before-tax income of you and your spouse.

Multiply this figure by the amount you need to borrow. Divide by 1,000.

02

06

Divide by three. This figure is the monthly payment you can afford to make on your home.

Add to this your estimated monthly heating costs and monthly property taxes.

03

07

Take the total price of the home and subtract the amount of money you expect to make as a down payment. This is the money you will have to borrow.

04

Refer to the chart on the opposite page. Look down the left column and locate the interest rate you expect to pay. Line this up with the amortization period of your choice. (Most first-time buyers take the 25-year amortization.)

If this figure is equal to or less than one-third of your gross monthly income (calculated in Step 2), you’ll qualify for a mortgage on your dream home. Bear in mind that this is a rough estimate. If you have several other large loans already, you may qualify for less. Also, banks and trust companies vary in their policies. The best way to know what you can afford is to go to the lending institution of your choice and get pre-qualified.
