花轉讓是將你向發展商購入柏文單位 時所簽訂的原來買賣合約轉讓到新買 家手上。手續一經辦妥，新買家便會承擔原 來買賣合約中跟發展商訂立的契約和責任， 這比一般二手樓宇轉售過程較為複雜。

預計到2014年，多倫多 市會有接近20,000個柏文單 位落成。相信這批業主當中 有不少屬投資者，打算在柏 文正式交割業權前，出售轉 讓單位，俗稱“炒樓”。而轉 讓樓花過程當中，有不少事 宜需要留意。
獲得發展商的同意對柏文樓花轉讓最是 重 要 。 如果沒有發展商的允許，原來的柏 文買家無法以轉讓樓花形式賣出單位。所 有我見過的發展商買賣合約當中，都包含 同一條項，列明發展商無需提供理由便可 拒絕單位於樓花期間轉手。但很多發展商會 透過在原來的買賣合約中作修正附加條款， 同意單位於樓花期間轉讓，這有條件的同意 條款，是發展商用以吸引更多買家，特別是 打算在業權交割前轉售的投資者。最常見 的是發展商會於柏文單位銷售數目達至某 一數量時(例如是最少已售出70%，80% 或90%)，或開始建築後，才會有條件的同 意樓花轉讓，避免投資者太快將單位於樓花 期轉手，這亦是發展商控制價格和推廣單位 的市場策略。而無論轉讓的樓花是賺或蝕， 發展商都會收取界乎$2,500 to $5,000(另加 HST)的劃一費用，通常由出讓單位的投資 者支付。 樓花轉讓可以發生在建築開始前，亦可於單位 入伙但未正式辦理業權交割手續期間進行。發 展商不但決定柏文樓花何時可轉讓，部分發 展商會限制買家於他們發出業權交割最少 30天前的通知書後轉讓樓花；但也有些發 展商較為寬鬆，容許樓花轉讓和業權交割同 日進行。買家需要查詢發展商，確定樓花轉 讓期限。 於業權交割日同時進行的樓花轉讓，亦包括 了發展費、水電等的接駁費、參加Tarion新 屋保障計劃費用和發展商部分律師費。有時 候發展費已鎖定於某一數額，最好先查問 清楚。買家應把這些費用列入樓宇需要貸 款的一部分。 樓花轉讓過程中，應清楚列明第一手買家交 給發展商的柏文訂金數目，以及轉讓過程中 的利潤(或是差價)，為免混淆，需定立支付 這些款項的日期表。例如是買家先支付賣家 已繳交給發展商的訂金，再於業權交割時再

付賣家的利潤金額。安省地產協會所制定的柏文樓花轉讓 買賣合約條文中Schedule “B”便明確闡定付款日期。 只要買家不是投資者，所有新屋單位都符合HST退稅。假 如買家打算做房東，將單位出租，便失去得到HST退稅資格， 只能申請於擁有居住權期間的另一些退稅。假如因樓花轉 讓而失去HST退稅，最後的買家將會承受這損失。 多倫多市政府會於入伙期一至兩年後寄出物業稅附加賬單。 一般發展商都會向買家收取比重估物業稅較高的費用，買 家可於收到最終的物業稅單據後，自行決定是否向發 展商，甚至是原先買家討回差價。 柏文樓花轉讓有大量細節事項要注意和妥善處理，因此委 託有專業知識的地產經紀和律師更形重要。
