Whether you’re buying or renting a condominium, pools are often high on a house hunter’s list of desired amenities. But as a developer, landlord, condominium board or purchaser, before you dive into the deep end, it’s important to be aware of the rules and regulations that govern public pools. The Health Protection and Promotion Act Regulation 565 Public Pools came into force on July 1, 2018. The regulation did not provide for any transitional time, so all organizations have to be in full compliance. This new regulation governs public pools and their maintenance. The regulation applies to all pools in a condominium or apartment building, with more than six units. This new regulation sets out clear rules and procedures for the maintenance of public pools. While the regulation aims to protect public health, it means stricter rules when it comes to the operators of public pools. These revised requirements aim to eliminate inconsistencies and improve clarity and public safety, through testing and recording frequencies, general facility maintenance, first aid box contents and operator training. OVERARCHING REQUIREMENTS

changes is the notification requirement. Pool operators are now required to notify the medical officer of health or public health inspector of their intent to operate a pool in writing at least 14 days before the pool is put into use after construction or after any closure that lasts for more than four weeks. Rules with regard to on-site posting have also been revised. The regulation stipulates that the results of any inspections conducted by a public health inspector are to be posted. This requirement aims to provide more open and transparent information to the public and support compliance efforts. The regulation has also introduced strict rules on operator training. Each pool operator needs to trained in its operation and maintenance, filtration systems, water chemistry and all relevant safety and emergency procedures. NEW SAFETY REQUIREMENTS

The Ontario Building Code currently requires that pools with a slope of greater than 8 per cent be equipped with the fittings for a safety buoy line. This was following a recommendation that all unsupervised pools, i.e. those without a lifeguard, require a buoy line. The regulation also stipulates that ground fault circuit interrupters must be tested the more frequently and first aid kits are required to have sufficient quantities of supplies.

NON-COMPLIANCE LEADS TO PENALTIES

Now under the Provincial Offences Act (POA), public health inspectors are authorized to issue provincial offence notices (tickets) for infractions. The fine amounts vary depending on the severity of the infraction. WHAT DOES THIS MEAN TO ME?

So how does this affect you, the prospective purchaser of a condominium or renter of an apartment? It means that the pool should be a safer, healthier place. That’s the good news. The downside is that the maintenance costs of a condominium unit will probably need to be increased to take into consideration the cost of implementing the new changes and the maintenance requirements that go along with it. For a renter it means that a new rental in a building with a pool may have a rent increase. So before you get into too deep, make sure you are familiar with all of the changes and what the impact will be on you personally. As we go to press, voters across Ontario are casting their ballots to elect their next municipal government. During the campaign there was an incredible amount of focus on the issue of housing affordability, transit and infrastructure and what the candidates plan to do about it. As Building Industry and Land Development Association President and CEO Dave Wilkes talks about in his column on page 12, there can be innovative partnerships between the development industry and municipalities, and “as our region continues to grow, we will need more of this kind of collaboration to create thriving complete communities where people can live, work and enjoy their leisure time,” he says. It’s no secret that the population of Toronto is booming. It’s projected that the city will increase in size by 33.5 per cent by 2041 according to figures published by the province. The population of areas such as Milton, King, Whitchurch Stouffville, Brampton and Caledon are growing too. All five regions experienced significant growth from 2011 to 2016 according to census data – in the case of Milton, it grew by 30 per cent – so yes, more housing is clearly needed. Voters, take note. Now that election day is over, track the progress of your elected officials and remind them of the campaign promises they made to you and your community about these important issues.

As development in our region intensifies, public art is flourishing in our communities. Besides beautifying the places where we live and work, these sculptures, murals and LED installations create a sense of community, evoke civic pride and invite tourism. Many of these works are the result of creative partnerships between our industry, municipalities and artists. In the City of Toronto, a large proportion of public art is funded through the ‘Percent for Public Art Program’, which has developers contribute one per cent of the gross construction cost of projects to public art. In return, the city may allow them to increase the height of a building or build a denser development, an exchange permitted by Section 37 of the Ontario Planning Act. Depending on the size of the contribution, it may be used to commission an art installation on site, pooled in the city’s Public Art Reserve Fund, or a combination of the two options. In the last five years alone, the program has seen the completion of approximately $25 million in public art installations, with additional funding secured that has not yet been spent. Since its inception, the Percent for Public Art Program has enriched Toronto with more than 150 pieces of public art. Many are part of condominium developments 12 NextHome+CondoGuide | Oct. 27–Nov. 10, 2018

and enjoyed by residents and passers-by alike. An example is a work titled We Are All Animals, in a public plaza in front of a condo near High Park. The installation, commissioned by the developer from a Toronto-based art studio, consists of a long bronze bench, a trio of coyote sculptures and an LED screen showing an everchanging digital rendering of High Park’s landscape. Another remarkable piece is Guard with Balloon Dog, a stencil attributed to the anonymous graffiti artist Banksy, which is on display in the PATH system near 1 York Street. It was found on the wall of a former office building in the Harbourfront area. Before the building was demolished, the developer salvaged the panels, had them professionally restored and eventually had them installed, along with a commissioned companion piece, as a public art contribution accompanying its major mixed-use project in the area.

Other municipalities in the GTA are also building their public art collections thanks to partnerships with our industry, despite the fact that public art contributions are voluntary. For example, in Mississauga, a two-part metal and glass sculpture called Migration, depicting birds in flight, forms a gateway over Duke of York Boulevard where it meets Burnhamthorpe Road. The work was jointly funded by developers behind two nearby condo projects and the City of Mississauga.

Land Prices couLd drive the cost of a new condo up to $1,000 per-square-foot or More in toronto

It was reported recently that approximately $165,000 in government-related fees are paid by a developer and/or buyer for the average new condominium in Toronto. This accounts for about 22 per cent of the overall price. For comparison purposes, I bought a new condo 13 years ago for $215,000! Later this year, development charges in Toronto are going to go up, so even more fees will be collected by the government. BILD, the industry association for homebuilders, correctly points out that these fees always get passed on to the purchasers, driving up the cost of new homes. When new home prices go up, affordability often worsens, and investor buyers are forced to charge higher rents. Economists will argue that the higher fees force developers to reevaluate all of their costs, resulting in developers paying less for land. However, the theory rarely holds true in reality. Many of the land owners in downtown Toronto have owned their property for 20 or 30 years. They are in no rush to sell their lands, and are willing to hold off selling until they get their price. When developers bring up the rising fees or increasing construction costs with the land vendors, their rationale for paying less falls on deaf ears. business, they have to pay top dollar for land. Bullpen Consulting and Batory Management put together a report on what condominium and rental apartment developers are paying for land. Based on our sample of nearly 100 transactions during the first nine months of 2018, the average site sold for $17.4 million dollars. If we consider the former City of Toronto only, that number jumps to $20.8 million. Developers like to look at land on a per-buildable-square-foot basis. They want to know land prices for every square foot of space they can build in their proposed towers. In Toronto, the average price has been about $140 per-buildablesquare-foot over the past year, which is based on the share that land typically makes up in a new project and means the average condo in Toronto will be selling at above $1,000 per-square-foot! Some properties in downtown Toronto are selling for upwards of $200 per-buildable-square-foot, so on a 750-square foot unit, that’s

$150,000. Add the $165,000 in fees to the government, and the price is already $315,000 — and we haven’t even added in the construction costs yet. With all of this said, you’re probably getting the picture here. A lot of factors will continue to put upward pressure on new condo prices. If you’re looking to buy, do your own research, hire a broker with a lot of experience with preconstruction sales and buy what you can afford. Good luck. I wanted high contrast in the cabinetry, so I chose white modern shaker cabinets on the perimeter of the room, and dark drawer fronts on this generous island that allows my kids ample room to spread out and get messy. I used laminate for its durability as well as its accessible price point. To add a bit of sparkle to the space, I added handmade, rustic pulls by Shayne Fox Hardware (shaynefoxhardware.com). KEEP THE BLACK MATTE

I chose to put a sink in this space, as it’s so practical with my seven little kids. In keeping with my monochromatic colour scheme, I chose Delta’s (deltafaucet.ca) new Esque faucet. And, I continued the matte black with the wall paint colour. I don’t think I would have been as bold to do this if I did not have so much natural light in this space – but I’m so pleased with how this Wrought Iron colour by Benjamin Moore (benjaminmoore.ca) turned out. Whenever I use dark shades, I like using it with a matte finish, as opposed to eggshell or satin. It’s rich and lush and I love its modern look. USE LARGE-SCALE ART FOR A GRAPHIC ELEMENT

We had large individual portraits of my children blown up to fit these inexpensive frames. This might be my favourite element in my basement. We hung them around our TV about three inches apart, and it creates a graphic element that makes me smile every time I enter the room. Keeping things black and white helps the TV blend in. CREATE A SPACE FOR THE GROWN-UPS

Sometimes mom and dad need a moment, but still need to keep an eye on the little ones, so we created a home office in the basement. I put in an electric fireplace media unit by Dimplex (dimplex.com) in this space, and I love how it creates instant cosiness with the press of a button. You can put an electric fireplace virtually anywhere you can run the correct power, and the results are fast, stylish, cozy and so comfortable. Like many personal finance matters, the decision to pay down your mortgage versus investing the money is a very individual choice. If you run the numbers, a lot of the time it would seem you’d be better off investing rather than paying down your mortgage. But according to Sean Cooper, a mortgage broker and the bestselling author of Burn Your Mortgage, that’s only part of the story. “One thing that investing doesn’t provide is peace of mind,” said Cooper. “When you pay down your mortgage, you get a guaranteed rate of return (your mortgage rate). But when you invest, in many cases you don’t know what your rate of return will be.” Jason Heath, a fee-only certified financial planner and a managing director with Objective Financial Partners Inc. points to a couple of other factors you need to think about when making this kind of decision. One consideration is whether you have an employer matching your contribution on your investment account – like a group RRSP or defined contribution pension plan that your employer also contributes to when you contribute. “That company match is free money and can make investing a good choice 28 NextHome+CondoGuide | Oct. 27–Nov. 10, 2018

If you were to run into a financial emergency – you lost

your job or became disabled – it’s important to have emergency savings. That’s when your TFSA can come in handy. It can be a great place to park your savings for a rainy day.” If you’re still unsure, consider seeking out the advice of a certified financial planner and an independent mortgage broker who can help you crunch the numbers and determine which scenario is right for you. a new wave of Canadian minimalism defined After unveiling plans for a Studio Gang-designed tower at Yonge and St. Clair earlier in the summer, Slate Asset Management enters the fall market with a new mid-rise condo offering in the Junction. Designed by acclaimed Canadian architects, superkül, and emerging local interior design firm, Dialogue 38, Junction House further solidifies Slate’s approach of leading with design and city building when it comes to residential development. “We invest in designers because we believe in design innovation,” says Brandon Donnelly, VP of Development for Slate Asset Management. “For us, good design moves beyond aesthetics and actually solves problems and creates value for people. beyond our individual projects and consider the broader community.” Sited at 2720 Dundas St W, just as the road begins to bend, Junction House is conceived as a new gateway into one of Toronto’s most vibrant neighbourhoods. The ambitious design brief challenged superkül and Dialogue 38 to define a Canadian brand of minimalism that at the same time reflects the historic material palette and creative energy of the Junction community. “One of our inspirations was picking up on Scandinavian and Japanese approaches to minimalism, but through the lens of the Junction. What would that look like? How could we make sure our homegrown brand of minimalism is seen as approachable and in keeping with the neighbourhood?” said Donnelly. “We also really wanted

to look at multi-storey suites – which eventually became The House Collection – and explore how we could replicate the singlefamily experience in a boutique mid-rise format,” he said, citing the influx of families into the Junction and the need for new residential options in the city more broadly. “The building was designed from the inside out,” said Andre D’Elia, Principal at superkül. “We focused on the suites because, ultimately, that is where people are going to live and spend most of their time. We didn’t just design a nine-storey building, we designed 144 homes that occupy the same built form.” When it came to the exterior cladding, D’Elia says the focus was on reflecting the immediate context, while elaborating on the details. “We immediately thought of red brick, which is prevalent in the neighbourhood, and ended

up cladding the first five storeys of the building with it. In order to add a sense of movement we staggered and angled the brick columns to play with light and shadow. We’re also introducing some old-world brick-coursing to add visual interest and mirror the local context.” Dialogue 38 was tapped for the interiors after Donnelly visited a café designed by the firm in the east end of downtown. “Their work is what motivated us to reach out, because it seemed to get the Canadian minimalist sensibility we were after,” said Donnelly. Bennett Lo, Founder of Dialogue 38, says his approach was to focus on delivering design that would last. “We’re all influenced by trends and lifestyle, but our designs need to stand up against time. How do you produce something that is going to have immediate appeal and provide its own kind of interest, without feeling dated in a few years? The idea was to strip the design back and focus on the essentials, while at the same time incorporating aspects of the area.

The suites and common areas will have smooth concrete ceilings and warm touches of wood throughout — and the lines are clean and open.” The nine-storey building will also feature an expansive lobby that doubles as a co-working space, as well as a gym that draws on the warm materials of the suites and common areas. Lo says the design of the amenity space is optimized to encourage active use. “We focused on the amenities that we know people use, and spent our energy crafting spaces that embody the spirit of the building. The benefit of a boutique midrise is the opportunity to extend your living space in to the amenity spaces, and provide moments of social engagement in the building.” “We’re a short walk to the UP Express station at Bloor, which can take you downtown in less than 10 minutes. That proximity gives us an opportunity to have a dialogue between the Junction and the rest of the city. The proposed sign marks the Junction’s location and lets you know where you’re going,

Documentary and panel event highlight opportunities for Downsview park ULI Toronto and mixed-use developer TAS recently brought community members and industry leaders together for an evening that combined a documentary screening of Accidental Parkland, and an expert-led panel about placemaking opportunities in Downsview Park. The event took place on the future site of The Keeley, a new mid-rise development by TAS located at 3100 Keele Street, across the street from Downsview Park. Plans for The Keeley include a new public park that will visibly connect two very significant urban greenspaces, Downsview Park on the east and Black Creek Ravine on the West. Almost 300 acres in size, over the last several years Downsview Park has undergone major landscape improvements including: a pond that has attracted all sorts of wildlife, a local food movement including an apple orchard and several urban farms, a three-kilometre circuit path, a tall grass project and an urban forest. The new Downsview Park subway and GO Station, revitalization of the hangar buildings, upcoming opening of Centennial College and the sale of adjacent sale of the Bombardier Lands is also turning new attention to Downsview Park. Moderated by Jane Farrow, public engagement specialist, Dept of Works and Deeds, the panel included two spokespeople from the documentary – Christopher Glaisek, Vice President for Planning and Design, Waterfront

Toronto, and Chandra Sharma, Director, Watershed Strategies at Toronto and Region Conservation Authority (TRCA), as well as Mazyar Mortazavi, CEO of TAS. “Downsview Park sits in the middle of two very important water courses,” said Sharma. “On the east is the Don River on the West is Humber Valley and Black Creek. So the role this whole area plays is as a vital east-west connection.” Known for developing projects in up-and-coming neighborhoods, Mortazavi stressed the opportunity he saw for The Keeley with Downsview Park across the street, and more importantly, the ravine system as a vital piece of community infrastructure. When you get into the ravine “you are in a very lush environment,” he said. But the ravine also “acts as a fundamental connector. You can get on a bike from behind this property and bike all the way York University. The bike network there connects to 12 km of bike

trails that are being built.”You are then connected to Downsview, the largest urban park in Canada,” he said. Farrow unexpectedly shook things up by throwing some questions out to key stakeholders and city building influencers who were in the audience including, Al Rezoski, Manager of Community Planning for North York, James Cox, Sr. Director of Real Estate from Canada Lands and Julian Sleath CEO of the Bentway. One of the points discussed was the value of parks as huge benefit to society to improve mental health. Sleath expressed how other cities are channeling health care money to large projects, like parklands and rejuvenation of public space, and seeing health care programs diminish.
