You are ready to close on your home when during your final walk through of the property you discover the stove does not work. What are our options? When purchasing a property any number of issues can arise. An appliance that was meant to be in “good working order” does not function, the property zoning is not as promised, or the vendor refuses to complete the transaction on the set closing date. You must now determine whether the breach in the contract, the Agreement of Purchase and Sale (the APS) results in your being entitled to damages, an abatement (or reduction) in the purchase price, or is the breach so bad it results in the deal not closing as a result. There are a number of different elements that arise from contract law. We must determine if the problem is a “condition” a “warranty” or a “representation” because what we can do going forward depends on figuring this out. CONDITION OR WARRANTY

In every APS there are a number of terms—everything from price, closing date, what is included, etc. When a term becomes breached we need to figure out whether it is a warranty or a condition. Part of 6 NextHome.ca

doing this means we look to the intentions of the parties. A warranty is a representation that the thing being sold is as promised or represented. Usually a breach of warranty results in damages or an abatement. A condition is such that the person receiving the benefit of the condition would not have entered into the contract unless he/she had been promised strict performance of the condition, and that this ought to have been apparent to the person making the promise. A condition is a term that means a failure by the parties amounts to a failure of a contract. In this case, a non-functioning stove is a warranty issue, and in order to bring an action for a breach of warranty, the purchaser would have to complete the purchase and claim damages for the vendor’s failure to satisfy that particular term. REPRESENTATIONS

Remedies may also be available if the vendor, before or at the time of the APS, held out a representation. The representation must induce the purchaser to purchase the property and the representation would have to be false and relied on. There are two main types of representations: fraudulent and innocent. Fraudulent is untrue and made with the intent to deceive. Fraudulent misrepresentation permits the wronged party to cancel the contract and to sue for damages based on his or her out-of-pocket losses, including any damages that

flow directly or indirectly from the breach of the APS. An innocent representation may be purely innocent. If that is the case, the mistaken party is entitled to cancel the contract and get back their deposit, but not damages. Sometimes the representation is made in a way that it is negligent. This means that the person making the representation did so in a way that he or she failed to take proper care in making the representation. An example of a negligent representation would be a situation where the person selling had a deck. The deck was built by the owner before him. You ask for a representation that the deck was built properly with a permit and without checking the vendor says without ever having checked, “yes it was built perfectly, with a permit.” During our search we discover this is untrue. This would be a negligent misrepresentation. It is important to discuss your APS with your lawyer or real estate professional. If your transaction is turning south, you must know your rights. Speak to your lawyer early and often to help you determine your rights and remedies. Find out if they are anti-development, and why. do they know the long-term impacts of niMBY-ism? do you? it’s not about over-building, it’s about building smart and building for the future. it’s as simple as that. My advice is for you to do some research — find out what your local candidates think about building affordable housing and what their vision is for improving transit and creating an infrastructure that will make your municipality a terrific one to live in. there are many organizations, including the Ontario Home Builders’ association (OHBa) and the Building industry and land development association (Bild), who have been trying to put housing affordability front and centre with all levels of government for years, if not decades. Cost of housing is among top election issues for gtA residents

When you live in a region with a high cost of housing, it affects more than just your mortgage payments or the rent deducted from your account every month. Being stretched thin financially can prevent you from pursuing goals such as saving for retirement, making a major purchase or going on vacation. In the GTA, this challenge is common. A recent Ipsos poll of 1,503 residents, conducted on behalf of BILD and the Toronto Real Estate Board (TREB), found that 68 per cent of the respondents had been prevented from doing something they wanted to do because of the cost of housing. For the largest proportion of the respondents, 40 per cent, managing the costs of housing came at the expense of their retirement savings, while 34 per cent indicated they had held off making a major purchase or going on vacation. Almost a quarter of respondents had postponed buying a home. Those are some significant goals to have to put on the back burner. No wonder 38 per cent of respondents said that the cost of housing is among their top three issues in the upcoming municipal election, tied with crime and infrastructure, and only behind municipal taxes. Millennials, women, renters and those living 12 NextHome.ca

with relatives or parents were more likely to choose the cost of housing as an important election issue. A majority of respondents—82 per cent— said that their new municipal government should prioritize addressing the cost of home ownership once elected, with one third saying this should be a top priority. At BILD, we are not surprised to see that housing affordability is foremost in people’s minds in the GTA as the municipal election nears. In any market, when demand far outpaces supply, prices rise. This is the case with the housing market in the GTA. Prices of new homes are further increased by the fees, taxes and charges added by all levels of government. The good news is, there are simple, straightforward steps municipal governments can take to increase supply. In our pre-election campaign, Build for Growth, we highlight some of these solutions, including making sure government charges on new

development are fair, funding and building critical infrastructure, cutting red tape and adopting a standard of service excellence to speed up building permits and inspections. Should you Buy What Foreign inveStorS Buy?

Despite the introduction of a non-resident speculators tax in Toronto last year, people still talk about the effect foreign investors have on our market. I had long contended that offshore buyers made up 5 to 10 per cent of new pre-construction condominium sales, and recent data showed that to be accurate — with the exception of the downtown core, which was slightly higher. Most people don’t realize that investors, either domestic or foreign, have been very positive for the new GTA high-rise market, as they bridge the long gap between launch and occupancy in the market, and help bring on new rental supply. A couple years back I took a course on Global Real Estate Trends at MIT’s Centre for Real Estate in Boston, Massachusetts as I’m always looking for new information, trends, and expert analysis to apply to my examination and understanding of the Canadian and Toronto residential markets. One of the lectures by my professor (who has a PhD in economics from Harvard), mentioned tips for understanding real estate markets, two that stuck out were: markets tend to misprice assets in marginal locations (leading to overpricing and over-construction), and the best bet are core assets with a high location premium. many foreign investors look at the Toronto condominium market, and perhaps it’s a good way for you to look at the market too. Forget cheaper marginal locations, buy core assets. Great locations remain great locations. There is no guarantee that a good location will become a great location so many foreign investors stick with great locations because they know they’ll retain their values. These areas are often the quickest to recover when a market does experience a correction (see the New York and San Francisco downtown condo markets), too. For years I’ve had to listen to people tell me that too many condos are being built, young folks don’t really want to live in high-rise buildings, and that investors would “run for the hills” as soon as the market showed even the smallest sign of a price correction. None of these dire predictions have even come close to occurring. In fact, investors remain bullish on the Toronto condominium market despite the recent correction in resale housing values. With recent changes to the mortgage qualifying rules, and higher interest rates, rental demand for privately held condos has never been higher. Institutions and pension funds want to build new rental apartments in the GTA due to the spike in demand and rental rates. September data from Rentals.ca showed that rental rates for the average two-bedroom unit for lease in Toronto increased by 7 per cent over August, a massive jump.

Many foreign and domestic investors have made a fortune betting on the urbanization of Toronto, and the desire for people live in dense communities with ample amenities. Buying real estate in great locations is a very long-standing investment strategy for many wealthy individuals and corporations across the globe. So, should you buy condominiums like foreign investors? I would say yes, but only if you can afford to, and only if you have a diversified investment portfolio. Downtown mixeduse high-rise projects within walking distance of transit and employment will continue to be the most desirable places to live, and as crazy as it sounds, a $1,000 per-square-foot condo will seem like a ridiculously low price 15 years from now. I always recommend you do your own research and surround yourself with an experienced team. Good luck.

THE FEMININE FORCE IN THE CONDO MARKETPLACE

As the condominium scene across the Greater Toronto Area has evolved over the past three decades, numerous market segments have emerged that were previously absent. One is single women who are divorced, widowed or never married. These women are independent. They have careers and social lives, and they understand the wisdom in owning real estate and building equity for their future. When you look at the big picture, new condominiums are logical choices for them. First, most condos offer 24/7 concierge service, which instills confidence in single women. Those “eyes on the street” really put a human face on the main point of entry for the building. Other security features in most condominiums include well-lit and monitored underground parking, and many addresses have in-suite security systems as well. Along this line of thinking, condos are essentially vertical communities, and there is a level of safety in neighbours getting to know each other in the building’s common areas. There is always someone around to call on for help. Of course, price is driving a lot of women to consider condominiums, as owning a lowrise home is becoming increasingly

financially unfeasible. Occasionally, we see women purchasing a condo together to share the costs and expenses. Now, they could do that with a low-rise home, but then they would have to worry about exterior upkeep such as snow-shoveling, lawn-mowing and gardening. A condominium eliminates that worry, especially when owners travel for work or pleasure. They can simply lock the door and leave. There is a wonderful aura of freedom that comes along with this nicety. As for upkeep, building amenities are a huge draw for all condo purchasers. Women enjoy having swimming pools, workout facilities, party rooms and the like right in their building. They also appreciate the fact that these amenities are cleaned, maintained and repaired for them. Even in new condos that are not marketed as “luxury,” the standard level of finishes is outstanding today, both in the suites and the common areas. Among female buyers today are savvy investors. These women know that their financial outlay for a condo will reap benefits in the future as the GTA vacancy rate continues to be low, and the population grows every year. People have to live somewhere, and condos are becoming the solution for a growing number of immigrants relocating here. I cannot say enough about businesswomen who are every bit as capable and wise as their male counterparts – and this includes real estate investors. When you look at couples purchasing new homes, women

are usually the primary decisionmakers anyway. They are more involved in choosing finishes and deciding on the look and feel of buildings that meet their needs. For many women, buying on their own is a natural. For females who purchase new condominium suites, arriving at their condominium is truly coming “home.” I expect we will see a rise in women buyers as Toronto and the GTA grow, and the obvious return-on-investment continues to attract people of all ages and life circumstances. Geranium Generously Contributes to Whitchurch-Stouffville Food bank On September 28, 2018, Geranium generously donated $5,050 to the WhitchurchStouffville Food Bank. This year, contributions from SCS Consulting Group Ltd., Griffith Property Services Ltd., PACE Credit Union, Peak Flow Water Consulting Services Ltd., and Eye-View Drain Services were incorporated in the donation. Representatives from Geranium and PACE Credit Union were on-hand to present Anand Daté, Chair of the WhitchurchStouffville Food Bank, with the donation. Geranium’s long-standing commitment to the town of

Whitchurch-Stouffville began in 2008 with the awardwinning, master-planned The Neighbourhoods of Cardinal Point community. This development spans 100 acres north of Main St. between Highway 48 and Ninth Line. “Giving back to communities in which we build is very important to us and remains one of our core principals,” said Boaz Feiner, President of Geranium. In 2016, Geranium was a supporting sponsor of the Main St. Habitat for Humanity home build project and employees helped to build a house for a working, low-income Whitchurch-Stouffville family.

In addition to the financial contribution, throughout the month of September, Geranium collected food donations from residents of The Neighbourhoods of Cardinal Point, which were delivered to the food bank. Food Bank volunteers distributed the non-perishable food items and used funds to purchase fresh meat, fruit, vegetables, bread and dairy for the Thanksgiving Holiday, and this will continue yearround.
