Wish list What’s on your wish list when searching for a home to lease?

I did an informal survey with a small group of past and present renters to see what people look for, and the results are in. In the top spot – without a doubt – are actually two key items that go hand-in-hand: clean and quiet.

A building with reliable security system was also near the top of the list in many cases, as was a property manager that responded quickly to issues, and a laundry room that was

readily available and fully functional.

New appliances and new paint were also in demand and in one case, a home that offered lots of natural light was a request.

While your “Top 10” list may read differently, make sure you do in fact have a list handy so that you can compare apples with apples when shopping for a space to lease.

I know some people look at having lots of space as a luxury – but not me. I dislike living in more space than I need. It just becomes a place store stuff and more rooms to clean.

I’ve always been like this. It’s not a matter of budget, it’s a matter of lifestyle. I like to have the right amount of space.

Some people need to upsize for various reasons. Working from home?

Sure, that home office is absolutely a need. Growing family? I can see the point of more rooms here quite easily.

But when the nest is empty or the opportunity avails itself, downsizing

can be a really good idea. A home should be a place you live, not just a place to accommodate all of the stuff you accumulate. You shouldn’t need to upsize because your stuff doesn’t fit – not that can’t! If you love shopping and collecting, by all means, find the right sized place for you and your things. But often it’s a matter of the right storage, not needing more space. It’s a great way to budget better – and clean less!

LOCATED ALONG Bloor Street from

Bathurst to Spadina, The Annex sprawls north to Dupont and south to Harbord. Side streets are residential, but there are quite a few popular pubs, coffee houses and bars tucked away in seemingly residential spots. These hidden gems give the neighbourhood a personal feeling that makes it truly unique.

The lifestyle is surprisingly relaxed for such a key downtown location.

While traffic may build and congest as this stretch of Bloor Street is an integral route to the downtown core, the people in the neighbourhood simply maintain a relaxed pace. As

much as it is an academic’s paradise, being so close to UofT, there’s also a strong arts and culture community.

The Annex is fun, funky and fashionable. The vibe is easy and indie. Suits are outnumbered by colourful prints and flowy fashion.

Big trees, some gorgeous Victorian architecture and lots of tall trees mingle with some spectacular backalley graffiti. In fact, walking behind the buildings is as much fun as walking down the main strip.

There’s a great mix of people, from students to seniors, dog lovers in the dog parks, some Zen that spans the generations from hippie to hipster in

the form of Yoga studios, East Indian craft stores, grassroots eco-shopping and independent stores. This neighbourhood isn’t one of big brand chains and franchises, the community embraces numerous long-time community businesses – and prides itself on these.

There are some rental mid- and highrises, mostly to the east side of The Annex, and rents tend to be just above average.

IT CAN BE painful to pay two months of rent at the same time, but when you take on a new apartment, the landlord usually wants first and last. In Ontario, the landlord is not permitted to take a damage deposit or demand a pet deposit, but they are allowed to take a last month’s rent deposit, which is equal to the cost of one month’s rent.

Some landlords will allow you to pay the last month’s rent deposit when you sign the lease and then the first month’s rent on your first day of tenancy, but they do not have to do this. The landlord may ask for first and last in full when you sign the lease.

If you budget properly, hading over two months of rent is not as much of a hardship as it may sound.

During your last month of tenancy, you are using this last month’s rent deposit so you do not pay your current landlord that month, instead you are paying it to your new landlord. Look at it as always having to pay, each and every month - it’s just the person you’re paying it to that changes.

If you are required to pay first and last, you’ll have to have the next month’s rent available just a bit early. If you’re not one to live with some savings, you’ll have to figure out how to buffer yourself to pay it ahead of time – it may mean getting creative, it may mean a temporary loan, but showing your landlord you can’t pay rent when you’re not yet living there is never a good way to start off, so figure it out ahead of time. You know it’s coming.

Last month’s rent is exactly as it sounds. It is the payment for the final month of your residency at your apartment. Your landlord must hold this amount for you, and cannot use it for any other reason than last month’s rent. If your rent is late, the last month’s rent isn’t a replacement. If you are short for your rent you cannot borrow from the last month’s rent deposit.

This must coincide with your rental cycle. If you pay rent on the first of every month, you must give your notice for the first. You cannot decide to leave mid-month and give 60 days notice to leave on the 18th of the month, you must pay for full rental cycles.

Your final rent payment will be handed over to the landord with your notice. That payment covers the first 30-day period, and your last month’s rent covers the final 30-day period (actually, 28, 29 or 31 as per the number of days in the month). Many people are under the wrong impression that, because the landlord only has one month of rent as a deposit, you only need to give one month of notice before leaving. Except for week-to-week tenancies, which are different and have a short notice period of two weeks, you’re always obligated to provide the 60 days’ notice. If you try giving your landlord less, you could find yourself in court without a defense. And once in court you’ll be hit with the cost of bringing the action to court, including the landlord’s legal fees.

Once you’ve given notice, finished up your stay and move out, your landlord must give you interest on your last month’s rent deposit. Each year this is calculated by the same percentage as the provincially stipulated rent increase.

Each year is different. In 2015 the amount was 1.6 per cent, for 2014 it was .8 per cent, for 2013 it was 2.5 per cent. However, if your rent went up between the time you moved in and the time you moved out and you didn’t give your landlord money to top up the last month’s rent deposit, this interest fee is first applied to the difference, with the balance returned to you – otherwise, you need to top up the balance owed if your last month’s rent deposit is actually less than the cost of a moth of rent.

If you damage something and need to pay for repairs, the landlord must come to you to collect that money, they cannot use your last month rent against any expenses they may incur because of you. They can not hold it against cleaning or repairs, and they can’t use it to offset any other expenses that are related to your tennancy that may arise.

When you give notice that you are going to move out, your landlord cannot subtract any expenses from your last month’s rent. In a month-to-month tenancy, you are required to give 60 days’ notice that you’ll be leaving.

A NOISY TENANT CAN BE A PAIN in your otherwise perfect rental lifestyle.

It can be excessive noise from music, vacuuming or through the ceiling because the Tenant above removed the carpet. This can adversely affect your sleep, your job performance and your health and emotional well-being.

For a Landlord, a noisy Tenant might drive away quality Tenants and give the building a bad reputation, impacting future rentals and income.

DO NOT DESPAIR THERE ARE WAYS THIS ISSUE CAN BE RESOLVED. Generally, Tenants are allowed to make reasonable noise during reasonable hours of the day. Check your local “quiet hours”, by calling City Hall or checking online. There are usually city ordinances or by-laws that prohibit excessive, unnecessary and unreasonable levels of noise. For example, in Calgary, hours between 10pm and 7am Monday to Saturday are considered quiet hours.

If your neighbours or Tenants are making noises outside these by-laws, police can be called.

For noise outside of these quiet hours you can make an application to your local Landlord and Tenant Board. In order to do so, the noise must be deemed unreasonable.

WHAT DOES ‘UNREASONABLE’ MEAN? Generally, take into consideration the level of noise, the frequency and whether steps can be taken to reduce the noise. Another factor will be demonstrating how the excessive noise impacts you – and the effect this has.

For example, in a case called The Owners, Strata Plan LMS 4555 v. Chan (L040727 BCSC), (It is a condominium case, but applicable) loud piano playing was considered an excessive and unreasonable noise; however, once sleepers were installed into the piano to minimize the noise, the Court decided that it was a reasonable noise level even though the noise had not been completely eliminated. Another example could be loud footsteps from neighbours above you due to wood flooring. In a situation like this, the noise could be brought down to a reasonable level by the purchase of a rug by the noisy tenant. Quite often there are rules for the building ensuring wood floors are covered. Check this before you rent.

keep a log of the time and dates of the noise and make it as detailed as possible. You can record the noise and have witnesses available to substantiate the situation at the Board, if necessary. You could also report excessive noise to your Landlord and find out if other Tenants are also impacted in order to bolster your case. In all probability, if the noise is too loud for you, other people in your building may be experiencing the same problems.

You may be tempted to bring an application right away, after establishing that the noise is unreasonable, but the first step should be to talk to your noisy neighbour or if the Landlord, to the Tenant first. This is often the simplest way and sometimes it is all that is required. Your neighbour or Tenant may not even realize the amount of noise they are making.

The remedy, if the noise persists even after several requests – and make them in writing after the first – should be an application to your local Landlord and Tenant Board, or go and see a lawyer to determine the best way to proceed. Often a small investment in getting legal advice at the beginning yields a great reward.

Only a Landlord can take noisy neighbours to the Landlord and Tenant Board. Tenants need to bring an application against the Landlord if the Landlord does not take steps to stop the offending Tenant. It is always in the Landlord’s best interest to ensure buildings operate properly and to control obstreperous, unruly and inconsiderate Tenants. Landlords and Tenants working together to maintain healthy and happy living environments lead to long and fruitful relationships for both parties.

How to prepare for the unexpected when moving

MOVING YOUR WORLDLY possessions involves a lot of organization, and if there’s one thing professional movers understand, it’s to expect the unexpected. In fact, that’s a major reason why many people choose to hand over the task of moving to companies that do this every day. Some do-it-yourself moves go well; others end up unnecessarily stressful because those completing the work don’t anticipate potential glitches.

Checklists are great, but every single move is different – and nothing beats experience for transferring household goods quickly, safely and efficiently.

For example, if you move in the winter and it’s a snowy, slushy day, how do you protect the floors from water/salt damage at both ends? What about getting large items around hard-to-maneuver corners without marking walls? What if someone gets hurt? Do you know how to pack delicate items like lamp shades and glassware to eliminate shifting and potential breakage during a long haul? What if the truck breaks down or gets into an accident halfway to your new home?

Professional movers have resources to draw upon to anticipate and handle any number of unexpected happenings. Training is a great preventative measure – when you shop for a mover, find out if and how the drivers and moving people are trained. Ask whether they have a “Plan B” in case of vehicle problems, and what you can do to be as prepared as possible when the packing/moving begins.

As tempting as a DIY move may be, think through the consequences. Are you prepared to deal with the possibility of friends or family members not showing up on moving day due to illness or hurting themselves trying to move heavy items? Do you have a back-up plan for extra items in case you misjudge the size of moving vehicle you need? What about plants?

Hazardous liquids?

Of course, there are specialty items that require an unusual level of care – pianos, pool tables, grandfather clocks, artwork, antiques and the like. The money you

think you’ll save by not hiring a professional mover may end up being spent on repairs if these large and valuable pieces are not handled correctly. Worse yet, irreplaceable items may be lost forever.

And have you thought through unpacking at the other end? On your first night there, you will need bedding, toiletries, towels and some kitchen items. Do you have a plan that includes being able to find those things easily and quickly?

IT’S JUST TIME FOR A CHANGE for change. We’ve done the spring cleaning, pared down our posessions, spung forward on the clock, gotten rid of bad boyfriend and now we’re ready to start apartment hunting to coincide with a summer move.

No matter whether you’re a first time apartment hunter or a seasoned one, this period of your life is filled with excitement. The only difference is that a seasoned apartment hunter knows that excitement can quickly turn into disbelief and frustration. Only someone who has never apartment hunted will ‘ooh’ and ‘ahh’ with joy when you tell them that you’re looking for a new place. A new rental is easy to come by, but finding the right rental – not so much.

Spending Sunday after Sunday hunched over your computer or your smart phone rummaging through home-finding websites and apps can turn painful very quickly. Then at some point you will have to leave your home (terrible, I know) and get the real apartment hunting done.

Before you set foot in your potential home, consider these ‘dos and don’ts’ of apartment hunting. These rules might just earn you a new place or cost you your dream rental: DO BRING A FRIEND // DON’T FORGET THE TREATS It’s always great to have a second opinion while apartment hunting or just to have someone around for emotional support. Just be aware of how moody you are during your apartment search. You might need therapy once it’s all over, but your friend doesn’t. Make sure you take them out for food and perhaps even a glass of wine once the daily search is over. You’ll probably need a glass as well.

The landlord isn’t going to flat out tell you the previous tenants left because of a crazy neighbour – you have to be the one to ask. Make a list and ask away!

DO EXAMINE EVERYTHING // DON’T GET CARRIED AWAY Is there enough closet space? Does the stove actually work? Having a toilet that flushes properly would be nice…

There are a lot of details to consider when apartment hunting, and you definitely should take the time to check everything out. Check out the closet to ensure you have enough room for your belongings, see that the toilet flushes, check shower pressure and make sure light switches work. Peek under the sink to check for mold or pests. Ask questions about how old the appliances are and do a quick test to ensure stove burners actually warm and the oven lights turn on. Just don’t get too comfortable and whip up some fried eggs or expect to get your laundry done during your apartment visit. Also testing the toilet does not mean you have to take care of your business in said bathroom – wait until you actually signed the lease.

DO BE AGGRESSIVE // DON’T GET AGGRESSIVE Did you finally find a winner? Stay calm, but make it clear that you’re interested and be persistent. Make sure you have your money and references in order and make yourself the best candidate they’ll see – it’s a competitive market. As long as you keep your cool, you’ll be sipping summer spritzers in your new pad in no time. Be aggressive – just don’t get aggressive.

Elevator Etiquette: The 10 Commandments

THERE’S A CERTAIN AMOUNT of common sense when it comes to elevator etiquette. If you live in a highrise, the elevator is the main way in and out of your home; a confined space in which you briefly encounter your neighbours several times daily. The natural instinct is to be absorbed in your own headspace, preoccupied with where you’re headed, and keeping strangers at a distance. And yet, the other elevator occupants, unfamiliar as they may be, deserve a modicum of courtesy. Unfortunately, most people have forgotten their elevator etiquette.

10 Rules of Elevator Etiquette: 1. Out first, then in. It only makes sense. Allow passengers to exit before attempting to board the elevator.

2. Take the stairs if you are only going one or two floors, except if the elevator is empty or you have a cart, stroller, large packages or are disabled.

3. Hold the door for others who are running to catch the elevator — especially your neighbours coming from down the hall. A plague on anyone who watches the door slide shut in someone’s face!

4. If you’re sick, wait for an empty elevator. If that is impossible, don’t cough and sneeze for the duration of the ride. And if that is impossible, never put your germ-infested hands on the floor buttons.

5. If you are first on the elevator or closest to the control panel, ask other riders what floor they would like. On the other hand, it’s somewhat rude to call out your floor to the person standing nearest the buttons as if that person is the elevator operator.

6. When other passengers board, move a little to give everyone some personal space.

7. Avoid carrying out interpersonal conversations, be they face-to-face or — particularly — talking on your cellphone. The elevator is not a phone booth.

8. Likewise, if you’re listening to your iPod, turn down the volume so you don’t disturb other riders.

9. If you’re carrying a backpack, make sure it doesn’t land in someone’s face when you turn around.

10. Never drop litter or deface the walls of the elevator.

Vandalism hurts everyone.

Riding in an elevator can bring out the best — or worst — in people. Think of the elevator as an extension of the building’s lobby, and of other riders as your guests. Remember, a little elevator etiquette goes a long way. Now, enjoy the ride!
