CIBC Expert tax tips to you avoid penalties and interest charges As Canadians prepare to file their 2013 tax returns this spring, a little attention up front can go a long way to saving time, money and undue complications down the road, says Jamie Golombek, managing director, tax and estate planning at CIBC.

Canadians had to pay more than $1 billion in additional taxes in fiscal 2012 alone, primarily because what they reported on their tax returns didn’t match the dollar amounts provided by employers, financial institutions and other sources, according to the most recent data from the Canada Revenue Agency (CRA). As well, CRA rejected almost one in every five tax credit and deduction claims the previous fiscal year.

“Each year, the CRA identifies costly, common errors in personal tax returns that can easily be avoided if you take the time to do it right and seek advice if your situation is complicated,” says Golombek. “If you under-report income or if deductions are disallowed, taxpayers may find that they unexpectedly owe more money to the CRA.” In addition to collecting additional taxes from you, the CRA will charge interest, currently at a rate of five per cent, on any overdue tax amounts, he points out. And, if you fail to file your return by the deadline or under-report income repeatedly, penalties may also apply, he adds.

Managing infill housing – challenging times for city building As recent events can attest, city building can often be a complicated, confusing and messy affair.

The City of Ottawa’s Planning Committee recently directed the Planning Department to take more time and to work with the infill home building community on the infill zoning bylaw.

This comes after two years of work by the Planning Department.

One day later, City Council rejected a proposal for a ninestorey building in Sandy Hill that had been supported by Ottawa’s Planning Department and by the Planning Committee.

What’s going on?

There is a lot of growth happening in Ottawa. New tall building projects are in the media on a regular basis. More than 1,600 infill units have been built in last five years.

It is the nature of this growth that is upsetting residents.

Ottawa is building inwards and upwards, not outwards. The practical result is more tall buildings and infill developments and fewer suburban housing developments.

When residents get upset, they look to their community associations and city councilors for help. How and where Ottawa is growing, once largely the privy of builders and planners, is now of interest to many more people.

Infill housing and streetscape character

There’s a lot of infill development happening in Ottawa’s older neighbourhoods. Single-family homes on large lots (50 ft. wide) are being sold to infill home builders. These old homes are being torn down, and in their place, builders are building modern semi-detached or three-unit homes.

The type and volume of infill development is causing concerns with some residents who live in Sandy Hill, Westboro, Old Ottawa South, West Ottawa and the Glebe. Residents are looking for rules that will maintain and protect the cherished character of their communities.

In response to the rapid rate of infill building and the concerns of residents, the City of Ottawa has been working on an infill zoning bylaw, intended to maintain the established character of Ottawa’s mature neighbourhoods.

The challenge has been to develop a practical way to determine whether a proposed infill project conforms to the character of the homes in the community.

The Planning Committee approved an infill zoning bylaw that introduces a streetscape character test. Under the new bylaw, a homeowner or builder would be required to demonstrate that the proposed change is consistent with the dominant pattern of the 21 lots surrounding the lot in question.

While the streetscape character test may sound simple, the rules are complex and confusing.

Why does this matter?

Many of the Planning Department’s suggested design solutions involve elements such as shared driveways and rear yard parking that can be problematic for owners and unsightly for neighbours.

Another challenge for existing homeowners is that the new bylaw will be applied to all homes and not just the few that were previously scrutinized due to their redevelopment. Existing homeowners who are unaware of the new bylaw may also be surprised and disappointed at the additional time and expense involved in dealing with another layer of approvals required to make small changes that were previously possible.

Home building and residential development in Ottawa are becoming increasingly difficult. Projects are facing lengthy and costly delays and differences are being resolved at the Ontario Municipal Board.

Few of us will be concerned about the impact of delays and uncertainty on “developers.” However, we may want to think about the additional costs that delays and uncertainty add to the price of a home as well as the potential negative impact on the 25,000 people working in the home building industry.

Home building pumps $1.5 billion per year into the Ottawa economy and is the fourth largest employer in Ottawa.

Infill builders are small businesses, employing some of your friends, neighbours and family members.

Ottawa’s home builders understand the need for rules – bylaws and building codes are second nature to us. What we need, and what Ottawa needs, is a set of rules that works for all of us and balances the interest of residents with those of landowners. It will be interesting to see how the Ontario Municipal Board deals with the bylaw approved by Planning Committee this week as the City resubmits it and the original hearing reconvenes.

Unpack your common sense for a smooth move » by Chuck Resnick When it comes to moving, a little common sense goes a long way in transporting your belongings to your destination so that they arrive in good shape and on time.

Considering the importance our “stuff” has in making us feel comfortable in our surroundings, these items deserve special thought and care. Thinking ahead is the best thing you can do when it comes to making arrangements and packing.

Organization should be your mantra, efficiency your goal.

If you are doing the packing, look ahead to lifting, stacking and unpacking the boxes during your move. People often run to the grocery or liquor store to pick up cartons, and then use newspaper as cushioning. Although this approach can save you a few dollars, in the long run, you may pay for it in stress, time and broken items. Instead, think about purchasing cartons and packing paper from the professional mover you’ve chosen. The boxes come in uniform small, medium and large sizes, which are easy to stack in a moving truck or van.

Trust me, this convenience is huge on moving day. Unlike newspaper, packing paper does not leave behind ink that then has to be cleaned during an already hectic time in your life.

During the packing itself, be generous with whatever you are using to cushion your things, especially fragile items.

People often cram too much in each box in an attempt to keep the number of cartons down. As good as that sounds, it can backfire, as too many items with not enough cushioning may shift during transportation and damage each other. In addition, someone will have to lift each box and place it into the moving vehicle. Packing too many heavy items into one container can result in no one being able to pick it up, or worse yet, the box breaking from the weight. Common sense will tell you that heavier items should be packed in smaller boxes, and vice versa.

Did I mention labeling?

Again, a little common sense goes a long way to success at the other end.

When you pack the moving vehicle, remember to place the boxes you’ll need first, last – and label accordingly with the contents and which room it goes into. Even better, if you are driving to your next residence, place things such as garbage bags, tissues and dish liquid into the car. You should also carry valuables such as jewelry, your laptop, important papers and the like separately from the bulk of your items.

Another way to apply common sense to packing is to look at each item with the thought, “Do I really need and use this?” Especially if you are moving from a house into a condominium suite or apartment, paring down possessions is important. The fewer things you move, the less your move will cost in terms of time and money. And speaking of money, if your budget allows, hire movers to do your packing and transporting. We do this every day, and we have it all down to an efficient system. Professional movers want our moves to go smoothly as much as our clients do.

Everyone is born with common sense, but few use it. If you are planning a move, I encourage you to be one of those savvy few!

No bubble to burst in Canada’s housing market

Fears of a housing bubble are exaggerated, though Canadian house prices may be headed for a modest decline nationally and in some local markets, according to The Conference Board of Canada’s initial Housing Briefing: Bubble Fears Overblown.

“Mortgage costs, not just house prices, are the principal deciding factor for potential homebuyers,” says Robin Wiebe, senior economist, Centre for Municipal Studies.

“Mortgage rates are expected to rise this year, but not dramatically, because the Canadian economy remains in a slow-growth mode.

“The housing market may be undergoing a correction in some regions and market segments, but it is more likely to be a soft landing than a bubble bursting.”

Fears of a housing bubble hinge on the ratio of house prices to apartment rents and house prices to incomes. The Conference Board’s view is that while these ratios are high, they are also misleading. Better indicators of affordability are the ratio of mortgage payments to rents and mortgage payments to incomes, and neither presents much cause for alarm about a housing bubble.

In addition, Canadian employment continues to increase, albeit modestly, and the national population is growing.

In general, housing starts are in line with demographic requirements, and markets do not appear to be overbuilt.

Total housing starts in Canadian cities with at least 10,000 residents ended 2013 at just below 170,000 units.

Although down from nearly 194,000 starts in 2012, this is in line with Canada’s 25-year average.

Furthermore, a low proportion of Canadian mortgages are in arrears. As a result, a market downturn in Canada would not be amplified by a wave of “distressed” home sales, as occurred in the United States in the 2000s.

Over the medium-term, a modest market correction, particularly in market segments in Ontario and Quebec as projected rising interest rates potentially crimp affordability, could produce a moderate decline in the national average housing price.

Toronto’s resale market is balanced.

Sales stabilized in June 2013, and rose on a year-over-year basis during each of the six months leading up to the end of 2013. Price growth remains healthy and a major price correction is hard to envision, given solid employment and population growth. While the condominium market is at some risk, a soft landing appears to be the most likely scenario.

Industry applauds Province for proposing new building options

Wood is good: six-storey wood buildings coming to Ontario The building industry has long advocated for Ontario to adopt an OBC six storey wood standard similar to what currently exists in British Columbia

The Ontario Home Builders’ Association (OHBA), the Building Industry and Land Development Association (BILD) and the Residential Construction Council of Ontario (RESCON) applaud the provincial government’s proposal to allow for the construction of six-storey wood-frame buildings.

All three associations recognize the leadership of Premier Kathleen Wynne and Municipal Affairs and Housing Minister Linda Jeffrey on this important proposal that provides new building options for the land development and building industry.

“Communities across Ontario, from London to North Bay, will all benefit from the housing, rental and office opportunities that this provincial proposal provides,” says Joe Vaccaro, CEO of OHBA. “We look forward to seeing Ontario projects this year.”

Currently, the Ontario Building Code limits wood-frame construction to four storeys. The building industry has long advocated for Ontario to adopt an OBC six storey wood standard similar to what currently exists in British Columbia. BC has benefited from over 100 building projects as a result, giving B.C. consumers new housing and rental choices.

“The proposed change would result in the construction of safe, affordable midrise buildings that will bring new housing and rental options to our communities and vibrancy to our streets,” says BILD president and CEO Bryan Tuckey.

“More importantly, we believe this proposal will help cities and towns achieve their goals of planning for the up to 100,000 people and 50,000 jobs that come to the GTA every year.”

Answer: Meals and entertainment are tricky expenses, and subjective and confusing in practice. Plus, there are plenty of exceptions. Assuming that someone owns a few properties, and they are out of town a distance of 40 kms and you’re there more than eight hours (in some cases 12), then the meals are more likely deductible. Alternatively, if you are having a meal with a prospective tenant, supplier or accountant, then there are no time or distance restrictions – they are deductible, as there is a clear business purpose.

The primary issue in Canada Revenue Agency’s mind is similar to what you indicated in your question. You obviously had to eat, so the CRA is saying “Why should real estate investors get to deduct their meals at work when nobody else does?”

Practically speaking, I don’t think it hurts to do this now and again, but this would be an administrative concession from the CRA, as compared to a technical ability to make the deduction.

Over the years, I’ve worked with clients whose ease with numbers would make your head spin – from accountants to engineers. But, in my experience, such “mathletes” are far outnumbered by those of us who face financial calculations with apprehension.

Thank heaven for mortgage specialists. Whether you opt to go through a broker or your financial institution, a good specialist will guide you through the intricacies of choosing a mortgage with patience and know-how.

Remember that mortgage pre-approval is the way to go.

This means visiting your specialist before shopping for a home, and obtaining a realistic budget to work from.

Pre-approval also speeds up the purchasing process once you’ve found your perfect home.

In comparison with the early 1980s, when mortgage rates surpassed 20 per cent, today’s rates – which tend to hover below five per cent – seem astonishingly low. Substantial savings can also be found by choosing certain mortgage features over others. Here are some basic options: Term Length: A term is a set length of time, typically

ranging from one to 10 years, in which a certain mortgage rate applies. At the term’s end, you’ll renew your mortgage

for another term. The shorter the term, the lower the interest rate; however, by choosing a longer term, you’re insuring yourself against the possibility of skyrocketing mortgage rates in the future.

Fixed rates, variable rates

and capped rates: A fixed interest rate remains the same throughout the term, while a variable rate rises and falls along with prime rate. While the second option means accepting some unpredictability, it may yield greater savings than a fixed rate. A capped rate is a type of variable rate that cannot exceed a set upper limit. If interest rates are low but you’re facing a longer closing date, you may choose to be locked into a capped rate, which will apply once your mortgage payments begin.

Frequency of payments: Most lenders offer weekly, bi-weekly, semi-monthly or monthly payments.

While, at first glance, the difference between bi-weekly payments (every other week) and semi-monthly (twice a month) may seem unimportant, it works out to two more payments per year. Ultimately, those extra installments could take a couple of years off the life of your mortgage.

Amid all the ongoing talk of mortgage rates, market conditions, high levels of household debt and economic uncertainty, good news comes from RBC Economics Research’s latest Housing Trends and Affordability report. After two straight quarters of modest deterioration, housing affordability improved mildly in Canada in the fourth quarter of 2013, thanks primarily to income gains and still-low mortgage rates.

“The relative strength in income gains in Canada offset the minor increase in homeownership costs in the final months of 2013, meaning that homes were more affordable for those looking to buy,” says Craig Wright, senior vice-president and chief economist, RBC. The RBC report notes that household incomes outpaced a modest rise in mortgage carrying costs associated with buying a home at market value in the fourth quarter, which contributed to the improvement in affordability. Easing price gains in most markets across the country and marginal increases in mortgage rates kept the rise in mortgage carrying costs subdued.

The way RBC’s affordability measures work is, the higher the measure, the more difficult it is to afford a home. For example, an affordability measure of 50 per cent means that homeownership costs, including mortgage payments, utilities and property taxes, take up 50 per cent of a

typical household’s pre-tax income. A decline in the measure represents an improvement in affordability.

For the Ontario market, homeownership affordability eased by 0.1 percentage points for both bungalows and two-storey homes, and remained flat for condominiums in the fourth quarter of 2013. Owning a single-detached home at market value in the province continues to take a larger share of household income compared to the historical average despite marginal improvements for the first time in a year.

For the Ottawa market, specifically, affordability improved slightly in two of the three housing categories – down 0.4 per

recognized for excellence in customer service Tarion Warranty Corp. announced today the finalists for the 2014 Tarion Awards of Excellence, the only awards in Ontario that recognize new home builders based solely on their customer service delivery.

“Attention to detail has become essential in today’s competitive home building industry and this extends past the construction phase into a superior experience after taking possession of a new home,” says Tarion President and CEO Howard Bogach. “The 2014 Tarion Awards of Excellence finalists have been recognized by their home buyers for providing first-in-class after-sales service, which is what truly resonates with homeowners for years after the sale is complete.”

Finalists were determined based on the results of a comprehensive survey sent to almost 46,800 Ontario homeowners who took possession of a new home between Oct. 1, 2012 and Sept. 30, 2013. More than 6,400 survey responses were received, representing 14 per cent of consumers who bought a new home in Ontario during that time. The results were tabulated by Crunch Research in partnership with Harris Decima.

Survey questions focused on homeowners’ satisfaction with their builder, covering every stage in the homeownerbuilder relationship from the signing of the Agreement of Purchase and Sale, through construction and the pre-delivery period, to after-sales service.

To qualify for the Awards, builders must have at least five new home possessions during the survey timeframe and a specified number of completed questionnaires must have been received.

Award recipients will be announced at a luncheon in Toronto on Wednesday, April 16, 2014.

If you’ve decided to make a move, your choice is likely the result of some other major milestone in your life.

Maybe you’ve graduated from university and landed your dream job. Maybe you’re getting married and want to plant your roots. Perhaps, like my family, you’ve outgrown your current home.

So, here we are: the “For Sale” sign is up and our schedule now revolves around showings – the bane of my existence. Strangers size up our home, sit on our sofa, scrutinize the decor, and snoop through the closets and cabinets. I wonder how many of these “prospective purchasers” are serious buyers versus browsers? And, well, everyone who walks through the front door has got to be the one, right? Boy, this is already taking a toll, and it’s just the beginning!

Deciding to move is an emotional experience. The experts will tell you that you have to detach from the process. Think objectively. Leave your feelings at the door.

But parting with something as personal as a home is easier said than done.

Apart from emotions, a real estate transaction involves money – lots of it. This is probably the biggest and most complicated purchase you’ll make in your lifetime, so hiring qualified professionals who have been there, done that is key to a solid, successful, and hopefully, stress-free experience. Don’t think of it as spending money, rather as saving you hassle and avoiding mistakes that could cost you a bundle in the long run.

Mortgage Broker The broker’s job is to find the best interest rate and terms. Aside from potentially saving you thousands in interest over the life of your mortgage, you don’t have to pay for this service.

Sound too good to be true? Mortgage brokers are compensated by the lender who gets your business, so let them do the legwork while you reap the rewards.

guide, especially if you’ve never bought or sold a home. An agent can advise you on the best neighbourhoods and homes to meet your budget and lifestyle, and will negotiate on your behalf to get you the best deal on your buy. If you’re considering a DIY sale, how much time can you devote to marketing, showings and closing the deal? That alone is a full-time job, and you probably already have one of those.

Real Estate law yer Don’t skip

this step in the interest of saving a few bucks – it’s a drop in the bucket, in the grand scheme of things. A home is an investment of hundreds of thousands of dollars, so do your due diligence.

Home inspector The money pit is a scary reality many homebuyers jump right into, and one that can be avoided. A home inspector will identify components in your potential home that are missing, broken, unsafe and not up to code. While you may be tempted to forgo this condition of purchase – especially if you find yourself in a multiple offer – do so at your own risk!

It can be difficult to think impartially about something as personal as a home, which can complicate things when it comes to pricing, staging and selling it. A professional, objective opinion certainly makes “detaching” a little easier.

First-time buyers’ increase budgets, while rising prices cause delays: BMO Home Buying Report

First-time homebuyers have increased their budget to an average of $316,100 – up from $300,000 in 2013 – according to the BMO 2014 FirstTime Home Buyers Report. However, the average down payment percentage

has remained unchanged from last year at 16 per cent ($50,576).

The report, conducted by Pollara, also revealed the average expected spend by major city:

“Among the many considerations for those trying to get a foot in the door of the real estate market for the first time, the most important of all is building a substantial down payment,” says Laura Parsons, mortgage expert, BMO Bank of Montreal. “Buying a home is one of the most important financial decisions one can make, and typically represents the largest form of savings for Canadian households. It’s crucial that those planning to buy are well prepared and have considered all options available to them.”

Parsons added that it isn’t surprising to see real estate prices causing delays in this demographic’s buying timeline. “In a real estate market such as Canada’s, where prices have been consistently rising, those who put off their purchase need to ensure that the rate at which they are saving outpaces price gains. Otherwise, they may find themselves further behind in the long run.”

According to BMO Economics, rising prices in urban markets are causing many first-time buyers to adjust their buying plans.

“High prices in a few major cities, and the fact that prices are outrunning incomes in Toronto, are turning off some first-time buyers, while forcing others to go deeper into debt, tap their parents for hefty down payments, and opt for a condo rather than a detached house,” says Sal Guatieri, senior economist, BMO Capital Markets.

The report also reveals that 60 per cent of first-time buyers plan to set a fixed budget with a maximum amount, and will not deviate from their plan. However, one third of respondents are willing to break their set budget for the right home.

Parsons notes that first timers would be wise to establish price boundaries before setting out on the home buying journey.

“To help ensure first-time buyers don’t spend beyond their means, they need to be fully prepared to purchase the right house, at the right price. Getting preapproved gives buyers the opportunity to consider multiple options, during a time-sensitive decision period,” Parsons says.

TD advises on specific considerations when taking a less conventional approach to buying property

Today’s homebuyers don’t always look like the traditional nuclear family of the past. As a recent TD survey

discovered, a quarter of Canadians who bought a home in the last 24 months – or are planning to in the near future – did so on their own. Furthermore, four in 10 Canadians think buying property – whether a primary residence or vacation home – with friends or family members is a great way to get started. With this shift towards non-traditional ways of purchasing property, planning carefully can help avoid potential bumps on the road.

Homebuyers pooling their resources may be able to make a larger down payment on their purchase, and there are benefits to this. For example, homebuyers who put down 20 per cent or more may avoid paying for mortgage default insurance. The premiums for mortgage default insurance are calculated as a percentage of the mortgage and paid up front or by adding it to the principal portion of the mortgage. Eliminating or decreasing this premium can result in significant savings over the lifetime of the mortgage.

“Once homebuyers set their budget and down payment, they can take their prospective monthly mortgage payment for a test-drive and ‘pay’ into a TFSA or savings account,” says Snow. “This two-fold solution allows the homebuyer to see how comfortable the monthly mortgage payment is before locking in, and save for a larger down payment at the same time. For co-purchasers, it opens the line of communication to talk about how these monthly payments will work after the purchase.”

While agreeing on a budget and down payment are essential, the conversation shouldn’t stop there, Snow advises. Co-purchasers also need to agree on the key characteristics they want in a property, and what they are and are not willing to compromise on. For example, will the primary residence be a house or condominium? If it’s a second home to be used as a vacation

destination, will it be a cabin in the woods or a cottage by the water? Once these decisions are made, consider how the associated costs, like taxes, insurance, utilities, repairs and maintenance fees will fit into the overall budget.

“The last thing new homeowners want is an unwelcome surprise when they’re about to sign on the dotted line,” Snow says. “Whether purchasing alone, or with a co-purchaser, a mortgage specialist can help navigate home financing questions well before they’ve entered the house hunt, so they can make informed decisions that can save money and stress in the long run.”
