CSA encourages all Canadians to take time to “Check before you invest”

T

he Canadian Securities Administrators (CSA) is encouraging investors to make use of free online

investor education tools that can help with finding and working with a registered financial adviser.

In October, the CSA added two new resources to its website to assist investors complete a background check and registration search - Check Before You Invest and Understanding Registration.

The CSA has also refreshed its Working with a Financial Adviser brochure.

“Before investors work with a financial adviser, it is essential that they do some homework on the adviser’s background and

registration status,” said Bill Rice, Chair of the CSA and Chair and CEO of the Alberta Securities Commission.

“Investors must do their due diligence whenever they are considering making an investment with a new financial adviser, and the CSA resources can help.”

The CSA provides a ‘check registration’ webpage (www.aretheyregistered.ca) where investors can find: ~ The National Registration Search - an online tool that makes checking your financial adviser’s registration quick and easy; ~ Understanding Registration - a resource that helps investors understand the results of their search; ~ Check Before You Invest - a workbook that people can use to record results of their background research; and ~ Working with a Financial Adviser - an updated brochure that walks investors through the steps they should take when considering and working with a financial adviser.

Canadians should also watch for investor education tweets throughout October on @CSA_News for helpful tips and information.

Other brochures and additional information is available on the CSA’s website, www.securities-administrators.ca, in the Investor Tools section.

The CSA, the council of securities regulators of Canada’s provinces and territories, coordinates and harmonizes regulation for the Canadian capital markets. Their mandate is to protect investors from unfair or fraudulent practices through regulation of the securities industry. Part of this protection is educating investors about the risk, responsibilities and rewards of investing.

Small business optimism highest since beginning of 2013

mall business optimism was higher in November,

and is now at its highest point since February, according to the Canadian

Federation of Independent Business (CFIB). The Business Barometer index rose by nearly a full point to 65.9, over last month’s 65.0.

“The picture we’re looking at right now is reasonably positive,” said Ted Mallett, CFIB’s chief economist and vice-president.“It will be interesting to see if this trend continues among modest pricing and wage expectations in the coming months.”

Newfoundland and Labrador entrepreneurs continue to have the strongest optimism in the country, leading at 74.4 points. Not far behind continue to be British Columbia (72.3), Alberta (72.1) and Saskatchewan (71.4), with Manitoba (67.6) joining its western neighbours in experiencing gains since last month. Small business optimism in Prince Edward Island and Nova Scotia also experienced slight increases (at 54.9 and 60.8 respectively), while Ontario (65.8) and Quebec (55.5) fell back slightly. With respect to sector, business owners in health and education, professional services, and natural resources were the most optimistic in November.

“Expected full-time hiring plans are no different in November, but there is a slight increase in businesses expecting to cut back staff,” added Mallett.“Although this is not unusual at this time of year, net hiring does look a little weaker now than the same time in 2012.”

Measured on a scale of 0 and 100, an index level above 50 means owners expecting their businesses’ performance to be stronger in the next year outnumber those expecting weaker performance. According to past results, index levels normally range between 65 and 70 when the economy is growing at its potential. The November 2013 findings are based on 1,114 responses, collected from a stratified random sample of CFIB members, to a controlledaccess web survey. Findings are statistically accurate to +/- 2.9 per cent 19 times in 20.

CFIB is Canada’s largest association of small and medium-sized businesses with 109,000 members across every sector and region.

Loan insurance a safe bet for self-employed

ccording to Desjardins Insurance’s last retirement survey, 17 per cent of self-

employed Canadians are carrying

“The most important part about this type of insurance is that it allows you to concentrate on getting better instead of worrying about your obligations.”

Before an investor undertakes this task, they should ask themselves; → Is it worthwhile to spend money for renovations if the rents can be increased as a result of the renovations? . → Do the increased rents justify the expense? → Will the increase in value as a result of the renovations justify the expense?

First let’s establish how long will it take to recoup the renovation costs? The answer comes down to doing the math.

In the above example the renovation cost was approximately $3,000.00 per unit. After the renovation was complete the rents were increased by an average of $100.00 per month or $1,200.00 annually. It will take 30 months to recoup the expense or in other words the payback on the investment is 2.5 years. That equates to an approximate 40% annual return on the renovation investment, ($1200/$3000 = 40%).

But most importantly the total value of the property based on a 7% cap rate had increased by $200,000.00. In this example, it’s clear that the renovations at a cost of $3,000.00 per unit ($30,000 for all 10 units) was a prudent investment

Let’s face it, paying too much realty tax on investment properties could significantly impact the NOI and dramatically reduce value. Unfortunately most investors take this large expense for granted and assume that the assessment on their investment property is correct and never bother to investigate it.

Should you not agree with the results from the reconsideration process, you still have the option for an appeal. The appeal process is more involved and will not be covered in this article.

In reference to the application for the Request for Reconsideration by my client I am pleased to say it was a huge success. The owner received a revised tax assessment and a refund cheque for over $11,000.00. It was not just the refund that was gratifying, the increase in the NOI as a result of the realty tax reduction translated to a huge rise in value. By taking the revised net income and using a market cap rate of 7%, this equated to about a $150,000.00 increase in value!

3. Rental Equipment: Another relatively easy way to reduce your expenses and increase the NOI is to eliminate rental equipment. Make a plan to owning them instead.

We continue another real life example of how the property value was increased for a 21 unit apartment building. The hot water tank rental was approximately $300 per month (including taxes) which equated to $3,600 per year. The cost to purchase and install the equipment was approximately $4,000.00. The purchase of this hot water tank was a great investment simply because of the approximate one year payback! The reality is that many landlords are paying too much realty tax without being aware of it. As an owner, you should make a point to investigate if you are paying too much realty tax on all your properties.

I would like to share another real life experience of how an owner reduced his property tax by over $10,000.00 per year.

In a transaction about 4 years ago, I noted that the property tax on my client’s new acquisition (a 20 unit apartment building in Hamilton On) appeared to be extremely high, based on my many comparables. Doing a quick check I calculated that the realty tax was about $12,000.00 too high. The first step was to ask MPAC to review the assessment through a simple on line application called Request for Reconsideration (RfR)” Do your homework by obtaining the assessments on similar properties.

If you are convinced your property is over assessed, then simply go to the MPAC website and follow the instructions; download, and fully complete the (RfR) form. A local assessment officer will be appointed to review your application. Once the officer completes his investigation you will be notified on their decision.

“Snowbirds” flock south for the winter,

they are encountering the fact that the cost of Florida real estate has drastically declined in recent years, making the idea of owning property in the sunny south increasingly palatable. One of the biggest

fears of owning foreign real estate is the question of, “What happens when I die?”

The recently passed Tax Relief Act, in the United States (“US”) has a $5-million indexed exemption and a 35-per-cent rate for tax payable, however the exemption does not apply to “Aliens” who own property in the US. Yes Canadians are “Aliens” and so Canadians who own US real estate held personally may be subject to US estate tax irrespective of income – and the worst part is that “Uncle Sam” may feel he is entitled to tax on all of the assets worldwide not just the Florida property. For the purposes of this article we will discuss purchases in Florida.

In essence, do we need to subject the Executors (Estate Trustees) to dealing with 14G COM

IRS and disclosing the full value of the deceased’s assets and getting into all of the myriad of cross-border tax issues that appear the minute we need to deal with the US authorities? Not if we can avoid it.

Canadians who purchase property in the US have certain advantages over your run of the mill Alien: First, Canada and the US have a tax treaty that prevents Canadians from paying double tax in many circumstances.

This will protect Canadians from double taxation in many circumstances, on the sale of the property. Second, for both tax and succession purposes, the property can be placed into a carefully constructed Canadian resident, US family trust (hereafter called a “Sunshine Trust”).

In order to determine the eligibility of a given purchaser for such a vehicle it is necessary to meet with a legal and/or financial professional (tax accountant) familiar with all of the complex issues that affect the area and in order to make the professionals understand the individual needs of the person or family requiring the advice. This will allow for the careful planning necessary to make these vehicles work and comply with the tax legislation of both the US and Canada. The cost to establish the trust and administer it is a small price to pay to avoid the extremely expensive time-consuming, frightening and complex world of US tax.

Now is a great time to purchase land in Florida, Arizona and elsewhere in the US – if done properly. Speaking to a law firm, such as ours, together with the right tax accountant can greatly decrease your potential risks in falling afoul of either the Canadian or US taxation authorities. When done properly, a Sunshine Trust will provide peace of mind and security. In other words: use a Sunshine Trust to shelter you from the cold!

ccording to the Small Business Banking in Ontario Study released by Meridian, Ontario’s largest credit union, 75 per cent of Ontario small business owners have no plans to hire next year.

The study, conducted by Harris/Decima, also showed that 52 per cent have no business plans for next year with: 75 per cent having no plans to hire more employees.

90 per cent not expanding their current location.

91 per cent not planning to open another location.

12 per cent planning to sell their business.

“Small business is the future of Ontario’s economy,” says Jeff Brown, Director of Small Business Banking at Meridian.“At Meridian, we exist to grow the lives of our Members and to improve the communities in which we live. With 52 per cent of businesses having no planned business changes for next year, I am concerned with the state of our small business community.

tarting a new professional practice may sound intimidating, but it doesn’t have to be. Whether you’re a recent graduate, an experienced professional looking to be an independent practitioner, or perhaps a seasoned veteran starting a post-retirement practice, there are a number of essential steps to follow that will put you on a path to success.

Your business banker can advise you on cash flow, the use of credit, investments, and borrowing, among other things. Joining a professional organization, your local business association or working with a mentor are also great ways to build networks of strong advisors.

So get a head start on your competitors. Combine your professional training with a straightforward business plan and surround yourself with a support system of experts. Very quickly, says Wilton, you will find yourself in the best position to launch NC and grow a successful practice.

Tight commercial inventory levels impede sales activity in most major Canadian real estate markets, says RE/MAX

hile unprecedented levels of demand have been reported for commercial real estate in key Canadian markets this year, a shortage of available product continues to hamper sales activity virtually across the board, according to a report released recently by RE/MAX.

The 2013 RE/MAX Commercial Investor Report, highlighting trends and developments in 11 major centres across Canada, found that commercial inventory remained scarce during the first half of the year, particularly in the multi-unit residential, industrial, and retail sectors. Sales softened in 73 per cent of markets

examined between January and June 2013 in response to dwindling supply. Hamilton-Burlington, St. John’s and Calgary bucked the trend, reporting a 15 per cent, 10 per cent and eight per cent increase respectively in the number of commercial units sold. Dollar volumes have declined in tandem, with the exception of the Greater Toronto Area – where RealNet reports volume is up almost 28 per cent over last year’s levels to $7.7 billion – Hamilton-Burlington and Winnipeg.

Despite some pullback by large institutional investors (REITs and pension funds), smaller investors and end users have been particularly active, fuelling demand for industrial product, multi-unit residential product – on both a large and small scale basis – and retail storefront.

“There’s a lot of money chasing a limited supply of commercial product, be it multi-unit residential, industrial, or retail storefront,” says Gurinder Sandhu, Executive Vice President, Regional Director, RE/MAX Ontario-Atlantic Canada.“In some areas of the country, we’re seeing unsolicited offers on product not available for sale – often well above market value. Demand has placed serious upward pressure on price in most markets and contributed to lower cap rates across all asset classes. Looking forward, little is expected to change heading into 2014, which makes inventory the ultimate wildcard in commercial performance.”

The report identified two major drivers responsible for the upswing in demand for commercial properties – the combination of historically low interest rates and relatively solid economic performance. Over the past two quarters, Gross Domestic Product has risen on a national basis by 2.2 and 1.7 per cent respectively.

The Bank of Canada is expecting third quarter performance to hover between two and 2.5 per cent. That’s translated into renewed confidence from a business perspective and provided the catalyst necessary to renew market activity.

“Risk aversion appears to be behind the thrust for commercial product, with owner-operators now investing in themselves,” says Elton Ash, Regional Executive Vice President, RE/MAX of Western Canada.“Rather than pay rising office, industrial or residential rental rates, end users are competing against small and large investors for prime commercial buildings. The trend is especially evident in terms of demand for industrial real estate where a limited supply of product has generated the lofty prices now attached to that sector.”

Tight market conditions were noted for industrial product in 91 per cent of markets (10/11) examined in the RE/MAX report.

Owner-operators were exceptionally active in major centres, with most seeking out buildings under 10,000 sq. ft. Strong demand fueled price increases across the board, with the most pronounced appreciation occurring in Regina, where the price per acre of industrial land almost doubled between 2008 and 2013.

The report also found that the market for retail product, including storefront, strip plazas, and malls, continued to be characterized by solid demand, with close to 82 per cent of major centres (9/11) noting an upswing in activity.

Supply was of particular concern in trendy, urban cores. Strong retail expansion – underway in centres across the country – supports ongoing demand, given the influx of American and international brands to the Canadian marketplace.

Their presence has increased competition, along with the desire for increased visibility and a stronger footprint in the marketplace. Ongoing residential construction has also provided a boost, giving rise to a growing number of box stores, power centres, outlets and strip plazas in newer communities throughout the nation.

consistent demand. End users were also extremely active, enticed by the opportunity to live in their investment, while at the same time securing a steady income stream. The appeal of this segment was universal in nature. From small to mid-market purchasers, right up to large institutional investors, buyers were keen to get a piece of this segment. However, inventory proved particularly elusive. The lack of new rental construction in many markets has created a bottleneck in demand versus sales, and the stark reality is few owners are listing existing product.

“Those with commercial holdings have sent a clear message,” says Sandhu.“They’re essentially saying, ‘we have a good thing going, and we’re not willing to part with it.’ For love or for money, owners are holding firm and it’s creating a real challenge in the marketplace.

A serious portion of commercial sales are exclusive – that’s been the case for years – but as demand has risen, it’s made navigating the market increasingly difficult, especially for those with a lighter portfolio. Yet, buyers remain undaunted. In what many have traditionally considered a ‘big fish’ game, more and more individuals are making the foray into the market – a reflection of confidence, climate and a new investor mindset.”

While most segments of the market remain fairly vibrant, the report found that inventory has been quietly building in Canada’s office segment. New construction and, in some cases, consolidation of space among existing tenants has resulted in rising vacancy rates. While values have held relatively firm so far this year, some softening of lease rates is possible should the current trend continue.

Land sales – especially on the residential end – have also trended downward in 2013, in tandem with housing starts which are off last year’s pace by 15 per cent. Although major players continue to step up to the plate to secure favourable positioning down the road, some developers have clearly scaled back.

“On the whole, Canada’s commercial market is quite sound,” notes Ash.“The majority of investors – both local and those from abroad – seem intent on long-term holds which, despite the supply issue, always bodes well for stability. Our major centres are redefining themselves through revitalization and exciting new projects, and we’re raising our profile in the process. Population growth and increased density will absolutely necessitate further evolution and place greater pressure on commercial product down the road. Future prospects, combined with current market realities – such as weak returns in other investment classes – have all but made commercial real estate a darling among investors.”

The “Street Smart Real Estate Appraiser” –

y last article was about “A Plan” as it could relate to property appraisal when purchasing a property. The Plan needs to include a series of questions: why do I need this property, what are my choices (lease or purchase), could I build it new, how do I finance it, what do I think about the economy and the political climate, what is my exit strategy, do I need more money after I purchase for renovations, etc. The answer to these questions will help develop the overall Plan and aid in the purchase of the property. These are some of the questions a real estate appraiser should ask himself when appraising a property for a client. Ultimately does the Plan make logical sense?

What I have found in the 20 plus years in the real estate industry is there is always someone that understands a property better than I do! Who are these other real estate pros? What do they think?

What do they see? Why should I find them? What’s important to them? Why do they buy?

In my opinion, some of these people include: the Property Owners, Property Managers, Developers, Brokers, Builders, Bankers, Accountants, Lawyers, Business Owners, Engineers, Architects, Consultants.... etc. These people offer an important contribution to the valuation of a property because they are industry specific professionals. Depending on the property being appraised, it’s best to talk to these people, understand what they think, know and see, and ultimately get their “trade secrets”. The mission - become a “STREET SMART APPRAISER”!!

I once again turned to a professional; typically I talk with professionals that service the property industry to facilitate day to day business. One of the real estate valuation techniques I’ll give you is “Are you Attached”!

Owing a property for several years and sometimes several generations will make it difficult to do an unbiased valuation. The owner of real estate often develops an emotional attachment to the land and/or buildings that form a property. Often a Seller can’t cut themself loose of a property to make a deal when they know they should, only to holdout for a value that is not attainable or defendable.

Owners are sometimes clouded by emotion; they need to try to disconnect themselves with their specific property history. Retaining a third party to bring rational and logical valuation approaches is critical. Can anyone else see the premium in the market value sought by the Seller? Hopefully, other professionals in the real estate industry will have the guts to tell the individuals that they are “Attached.”

PRIVATE LENDING IS NOT JUST FOR RICH PEOPLE...

IT WILL MAKE YOU RICH! For many years, we have been assisting people to make their money really work for them in mortgage lending. Most of the big, RICH, private lenders out there started out as just average people, that took the leap into mortgage lending regardless of what friends and family thoughts were. Many are stricken with fear of losing their money when contemplating this investment vehicle.

Before dismissing this investment direction, consider the following points. Private lending can be very financially rewarding.

Private lending is certainly not like putting funds into a guaranteed account with a guaranteed rate and a modest return. Yes, there is a bit more involved. The mortgage brokerage you work with is key. The typical brokerage will have a range of mortgage offerings that will include offerings that cater to individuals that are in a dire position. They may be losing their property and/or their mortgage is in arrears, their credit is challenged and they need to consolidate. The banks will not lend under such circumstances as the risk is too high. These are the type of deals I would not lend on, but are the basis of the high yielding returns.

Lending criteria has changed so drastically in the past few years. Banks have really tightened up their lending rules, specifically when it comes to income properties. This is when a private lender can come into play and really leverage on this opportunity to make anywhere from 8-20% annual return. These clients generally have clean credit, good income and other assets. This would make for a safer investment.

Lending your Self Directed RRSPs: You can utilize your RRSPs in this type of investment. Most folks are seeing very slim returns in their plans, unless you are in the industry of watching markets, you typically will not experience anything positive. The Self Directed route is really not too difficult in terms of process. The broker should handle the entre process from providing you the lender with the complete details of the investment so you can make an informed decision. – Check List: Credit bureau, credit application, appraisal or an evaluation, income and a scenario of why these borrowers are seeking funds.

Note: Not all RRSP plan holders will allow for you to self direct your funds into mortgages. Please confirm with your plan holder as to their protocol on mortgage lending. I am aware of plans that do so and have worked with them for several years, some are much less work and make it easier and less costly for you the lender.

You can also make equity in your home really work for you as the current rates are insanely low, borrow at a variable rate of 2.102.50% and lend at 9-20%, great profit. This is a great venue for people that are sitting on equity. For example, for a senior that has reduced income, this can bring you additional funds monthly and give you the peace of mind you are looking for.

Scenario – Borrow a mortgage for 100K your monthly payment @ 2.25% interest and a 25 year amortization would be $436.

Lend 100k at 14% interest at an interest only monthly payment of $1,167.

Your profit is a super $731 per month. In addition, you are paying down your mortgage with this borrower’s interest payments. As a bonus, you are also paying down principal of $3,018 in the first year (this will increase over time). So, you can service your debt, pay-down your principal loan and earn extra income to build a retirement nest egg. Not bad. At the end of the typical one year term the funds come back and you can re-invest again.

Ok, so that is the positive side of this investment vehicle. What about the risks?

What if a borrower does not pay their mortgage? The private lender is typically in second position. It is imperative for you to confirm that the first mortgage is up to date so you can control the sale process. Don’t let this scare you. If you have a good loan to value on the property you will be in a good position to charge back costs plus any associated fees to the sale. The key in managing your risk is to do your proper due diligence on the property and get a realistic valuation from a reputable Appraiser or valuator.

There is a lot of detail in this, but with proper counsel, the returns are worth this potential risk. Being a private lender has made people very wealthy. Do not let fear cripple your vision of having a great return.
