Montreal’s commercial property taxes reach new high Tax survey shows other Canadian cities lowering realty taxes to encourage growth, while Montreal goes in the opposite direction

M

ontreal’s commercial tax rates continued to increase with startling speed in 2013, soaring for the second year in a row past Canada’s two other highestrate cities, Vancouver and Toronto.

This was part of the “encouraging and alarming” results revealed in the 2013 Property Tax Rate Analysis produced by Altus Group for The Real Property Association of Canada (REALpac), released recently.

Despite Montreal, Toronto and Vancouver posting the highest commercial-to-residential tax ratios, all in excess of 4:1, Toronto continued its slow but steady downward trend for the tenth consecutive year. Vancouver’s slight increase was attributed to reductions in its residential taxes that outpaced those of its commercial rate.

REALpac has long advocated for a commercial-toresidential ratio of about 2:1, which the association maintains is needed to support healthy economic growth, and could be achieved through gradual reductions. Toronto, in particular, has been on a “watch list” for many years for having excessively high commercial tax rates that are out of balance with residential taxes, acting as a deterrent to downtown business and job growth and commercial real estate investment. Now, Montreal is at the top of the list.

Montreal’s commercial-to-residential ratio increased by 2.7 per cent year over year, reaching a new highwater mark of 4.40 in 2013, compared to Vancouver at 4.35 and Toronto at 4.07.

“For the first time, Montreal has vaulted past Vancouver and Toronto and has the highest commercial-to-residential tax ratio in Canada,” said Carolyn Lane, VP, Membership, Marketing & Communications, REALpac.

The survey cites Calgary and Edmonton as making the most significant year-over-year improvements to their ratios, at 14 per cent and 5 per cent decreases, respectively. Toronto, Halifax and Winnipeg saw decreases between 1 per cent and 2.2 per cent. This enabled Halifax and Winnipeg to keep their ratios well below the national average of just over 3:1 among the municipalities surveyed. Ottawa was subject to a slight increase of 1.8 per cent compared to 2012, but still kept its ratio below the average. Still, the survey points to continued concerns about high realty tax rates in Vancouver, Toronto and especially Montreal.

“The sustainability of our urban centres is vitally important. High realty taxes are a barrier to business growth and deter investment in downtown office, hotel, apartment, and retail property development. With so many shifts taking place in our global economy, Canadian cities need to be seen as competitive with other markets in the U.S. and around the world,”added Lane.

On an absolute tax basis, Calgary, Vancouver, Edmonton and Winnipeg have the lowest estimated property taxes per $1,000 of commercial assessment, while Toronto, Ottawa, Montreal and Halifax have the highest. On the residential assessment side, Vancouver, Calgary, Edmonton and Toronto have the lowest property taxes per $1,000 of residential assessment, while Winnipeg, Ottawa, Montreal and Halifax have the highest.

While most cities in Canada have moved to decrease commercial tax rates in the last ten years, the survey notes that residential tax rates have declined at an even faster rate.

GTA office market pauses in wake of new development cycle and burgeoning sublet space Avison Young releases its Third Quarter 2013 Greater Toronto Area Office Market Report

he Greater Toronto Area (GTA) office market continues to deliver disappointing results. However, despite falling occupancy levels and rising availability and vacancy rates to date, the rental market, though fragmented, remains intact. A burgeoning sublet market is also raising concerns, having jumped 30 per cent in the past year to 3.7 million square feet (msf) at the conclusion of the third quarter of 2013. All of these conditions are transpiring as the market braces itself for a new wave of office development, starting later this year and continuing through 2017.

Notwithstanding these results, corporate Canada remains intact with ample cash on hand to expand its operations, while the development community is obviously looking beyond the current malaise and proceeding with some degree of confidence.”

According to the third-quarter report, the overall vacancy rate (physically unoccupied space) in the GTA continues to climb incrementally, closing the third quarter of 2013 at 8.8 per cent up 20 basis points (bps) from the previous quarter and 70 bps from the same quarter one year prior. More importantly, overall availability (which includes space being marketed for lease) is significantly higher at 11.4 per cent, having jumped 90 bps between quarters and up 220 bps from the same quarter one year earlier. Both metrics are sitting at three-year highs.

These are some of the key trends noted in Avison Young’s Third Quarter 2013 Greater Toronto Area Office Market Report, released today.

The report goes on to observe that the market’s softness is clearly evident in Downtown Toronto.

Despite a tight and landlord-favourable vacancy rate of 5.6 per cent in the third quarter of 2013, the availability rate was substantially higher at 8.9 per cent. This compares with a rate of 7.6 per cent in the second quarter of 2013 and 6.6 per cent in the third quarter of 2012. These increases are largely attributable to future known tenant relocations to the new towers underway as well as a noticeable uptick in sublet space.

The announcements continued regarding new office towers in Downtown Toronto. On the heels of Oxford Properties’ launch of the Ernst & Young Tower in the second quarter of this year, prominent newspaper publisher The Globe and Mail (G&M) captured the headlines in the third quarter. After cancelling plans to build a new corporate headquarters in Downtown West earlier this year, the G&M quickly secured a new location, this time in Downtown East. Branded as The Globe and Mail Centre, the new office tower will be LEED Gold and comprise 500,000 square feet (sf) over 17 storeys when it is completed in mid-2016. The publisher has leased the top five floors (130,000 sf) of the building, while developer First Gulf will also be moving its head office to the tower, raising the prelease level to 40 per cent.

Argeropoulos adds: “This project raises the total office space announced or under construction in Downtown Toronto to 5.8 msf, with slightly more than half of that space already preleased and lease deals poised to climb in the coming months.

There was very little down time between the end of the last development cycle and the start of the current one. At the start of the previous cycle in 2006, vacancy hovered in the 6.5 per cent range, while at the start of this one, some five years later, vacancy was roughly 100 bps lower.

“Although there will be more office development in this cycle (5.8 msf vs 4.5 msf), the delivery is more spread out rather than the bulk of it coming in any one year, as it did in 2009. This should cushion any further turbulence in the marketplace. It’s interesting that some developers are already strategizing for the next phase of development with deliveries in the 2018 and 2019 time frame.”

The report also notes that downtown available sublet space has climbed 525,000 sf in the past year, with the vast majority (422,000 sf) in class A buildings in the financial core. The effects

of this increase are somewhat ameliorated by the spread of future delivery times. In all, sublet space as a proportion of total available space is now 20 per cent, up from 16 per cent one year earlier.

“A subsequent analysis of sublease listings in Toronto’s downtown reveals some interesting facts,” continues Argeropoulos.“Class A sublets in the financial core account for 52 per cent of all available sublet area downtown, despite representing only 66 of the 157 available individual spaces (42 per cent). As this implies, class A sublease spaces in the financial core are also larger, on average, than those in the other nodes and classes downtown - 9,700 sf compared with 6,400 sf. Across all of downtown, however, tenants will find a full range of size options available, from spaces less than 1,000 sf to multi-floor opportunities in excess of 90,000 sf. The largest number of individual spaces are small, in the sub-5,000-sf range; while on a length-of-term basis, the largest number have more than four years remaining.”

“Of note, the profile of sub-landlords shows that the uptick in sublease availability is spread across a range of industries, including banks and finance, large law and professional services firms, the natural resources sector, and technology companies. In addition, and contrary to what might be expected, the buildings where the subleases are located likewise form a cross-section of downtown inventory, with recently constructed or renovated buildings represented alongside the more established towers.

Though restrictive, these types of opportunities cater to start-ups and other price-sensitive organizations looking for well-located premises in what would otherwise be unaffordable buildings.”

“Corporate downsizing, consolidation and relocations are fuelling the rise of sublet space not only in Toronto, but in most major markets across Canada. Toronto’s downtown sublet figure pales in comparison to Downtown Calgary where nearly 50 per cent of the total available space is on the sublet market.”

The report also notes that the suburban market regressed further in the third quarter; and although vacancy (11.9 per cent) held steady, availability increased 40 bps to 14.1 per cent.

While Toronto North (7.2 per cent) and East (13.7 per cent) saw marginal changes in availability, Toronto West continued to lose ground with availability jumping 100 bps to 16.7 per cent - a 10-year high.

Argeropoulos concludes: “The ongoing dynamic in the marketplace has created a balanced environment where there are significant opportunities for both tenants and landlords.”

Small business optimism fairly steady in October

O

ctober saw small business optimism trend up ever-soslightly from the previous month, according to the Canadian Federation of Independent Business (CFIB). The Business Barometer index rose by just half a point to 65.0 from September’s 64.5.

“Although the index went up slightly in October, what we can take from the last four months is a general stabilizing trend,” said Ted Mallett, CFIB’s chief economist and vice-president.“In the coming months, it will be telling to see if business owners can build confidence levels further in light of reasonably stable price and interest rate environments and improving prospects for the US economy.”

Small business optimism in Newfoundland and Labrador rose four points to 76.4, tops in the country. These levels are difficult to sustain, and a correction could be coming. Also up in October was British Columbia, which at 70.7 is now number 2 in Canada, along with Ontario, Manitoba and New Brunswick (66.6, 62.4, and 57.0 respectively). Prince Edward Island’s small business optimism stabilized in October, but it remains by far the lowest reading of any of the provinces at 49.0. Nova Scotia (60.1), Alberta (70.4) and Quebec (57.8) fell off slightly, although Alberta remains near the top of the rankings. Saskatchewan, also near the top, held steady at 69.4.

By sector, the strongest results were in professional services, manufacturing and natural resources. Business owners in transportation, finance, real estate and retail were somewhat less optimistic than the average.

“The ideal results are stability with an upward trend, and that’s exactly what we are seeing over the past quarter,”added Mallett.“After a rough spring, small business optimism has leveled off somewhat, and that stability is reflected in all of the indicators.

Full-time hiring plans are steady, orders and accounts receivables show gradual improvements, and pricing and wage expectations have also increased of late.”

CFIB is Canada’s largest association of small and medium-sized businesses with 109,000 members across every sector and region.

Measured on a scale of 0 and 100, an index level above 50 means owners expecting their businesses’ performance to be stronger in the next year outnumber those expecting weaker performance. According to past results, index levels normally range between 65 and 70 when the economy is growing at its potential. The October 2013 findings are based on 1,009 responses, collected from a stratified random sample of CFIB members, to a controlled-access web survey.

Findings are statistically accurate to +/- 3.1 per cent 19 times in 20.

Investing in real estate and being a landlord should be treated like any other business. The goal is to end up with a profit at the end of the day. After collecting rent and paying all the expenses, you must have money left over to be profitable.

As a bonus, slowly and steadily your mortgage will be paid down and you’ll end up with a tidy nest egg. Remember that like any other business it takes effort, time and skill to be successful.

Follow these tips and it will be financially rewarding for you.

1. RESEARCH: Take the necessary time to inform yourself about property values in the locations you’re considering purchasing. Think about obtaining a market analysis from a real estate agent or appraiser for a property in which you are interested. Research if the location is in decline or moving upwards?

A good indication is if large chains like Wal-Mart, Tim Hortons, Home Depot or Star Bucks are moving into the neighbourhood. Such companies do a lot of market research on demographics and income before deciding where to locate.

If a large chain finds a neighbourhood appealing, it’s a good indication the neighbourhood in moving upwards. You may find that you have to view many properties and submit many offers before you find the investment property that is the right fit for you 2. SURROUND YOURSELF WITH EXPERIENCE: Retain a real estate agent who has firsthand experience; who is also a local investor; and who has owned and managed investment properties. Many agents purport to be experts in investment properties, but have never owned or managed one. Retaining a real estate agent with experience is invaluable. Additionally, utilize the services of other experienced professionals, such as property managers, insurance advisers, mortgage brokers, home inspectors, accountants and lawyers. A knowledgeable professional team working with you will make the process smoother and save you time and money in the long run.

3. EFFECTIVE PROPERTY MANAGEMENT: A critical member of your professional team is an experienced and reliable property manager. If you are not experienced in dealing with tenant concerns, evictions, and other property issues, you will want a property manager. Depending mainly on the number of units being managed, (although there are many other factors), the management fee will range from between 3 and 10 percent of the monthly or yearly rental income. Good property management will pay for itself in the long run. When looking for a property management company, be sure you do your research ask for references.

4. BE AWARE OF ILLEGAL UNITS: Before you make the purchase, research the zoning of the subject property. There is a good possibility that you may come across illegal units, mostly in duplexes and triplexes (usually a basement apartment). You could also find them in larger apartment buildings and students housing units. These apartments are illegal in that they contravene the zoning by-law. Although these units provide additional income, be aware that they may not be fire code compliant, and that you may be forced to convert them back to the legal use of lesser units. Be aware that your lender will probably not include the income from those units in determining the principal amount you will qualify for under your mortgage.

5. BUY WITH THE GOAL TO HOLD LONG TERM: If you’re looking for a quick flip and a quick profit, you might as well put your money on the roulette wheel. Historically, real estate has always increased over the long term. The probability of you making money is greater in the long term then the chance of you making short term gains. Plan to hold the investment for the long haul, and wait for the changes in the market conditions that could make it prime time for selling. Remember that by keeping your investment for an extended period, you will trigger capital gains on the sale as opposed to a business gain.

6. PARTNERSHIP AGREEMENT: If you’re investing with other persons, it’s recommended that you have an agreement in place, (i.e. partnership agreement, joint venture agreement, shareholders’ agreement) to address various matters. Those agreements should address issues such as; 1) failure for a partner to put in their share of cash calls when called upon, 2) selling their interest of the property, 3) sudden death or illness of a partner and a myriad of other situations. With an agreement in place, you have a mechanism already in place to deal with the many issues that may arise, rather than having to deal with them later when it could create problems and or opposition. It’s better to pay for the agreement before the purchase, then pay much more later on.

7. BE CAUTIOUS WITH HIGH LEVERAGE: While there are some investments that require minimal dollar investment, most real estate transactions require a significant down payment and financing that is personally guaranteed. Don’t fall prey to the “no money down” schemes. The people making the most money on the “no money down schemes” are the ones putting on the seminars. Chances are you will be paying a premium for the property because there is no money down; the property is a money drain and that’s why the seller is willing to sell with no money down so the losses can be passed onto you. Get a second opinion from a professional. Never be hurried by a real estate agent or a seller to act quickly to get in on the deal as there are many other, probably better, deals outs there.

8. PROPERTY INSPECTION: A thorough property inspection by a qualified inspector is a necessity. Avoid using a contractor friend or a handyman’s opinion. Use a certified home inspector, who will provide a complete report with pictures and recommendations. Avoiding this step could lead to major unexpected costs or overpaying for the property.

9. EDUCATE YOURSELF: It is extremely important to educate and familiarize yourself with investment strategies, the terminology, and the current tax laws. You should also be familiar with all the regulations that govern investment properties such as fire, health and safety, landlord and tenant laws.

Take your time and only proceed when you are ready. Know the business before you make the plunge.

10. DON’T OVERPAY FOR A PROPERTY: As a wise investor, you should always remember that when investing in real estate you make money when you buy the property; by buying it right. Determine in advance how much you are safely prepared to invest without overextending yourself, and be cautious not to over pay for a property. Also make sure you have enough funds reserved for the unexpected capital expense.

Follow these tips and you will be assured to make money, and become a successful real estate investor.

“Growing communities raise property values, utilize infrastructure more effectively and provide residents with a greater range of economic and social opportunities,” said Ted Mallett, CFIB Vice-President & Chief Economist.“While we recognize communities that do this well, it’s important to acknowledge that all Canadian cities could do much better, particularly in addressing fairness issues around business property tax.”

Top mid-sized cities include Lloydminster, AB/SK; Red Deer, AB; Leamington, ON; Grande Prairie, AB and Rivière-duLoup, QC. The annual report attempts to identify cities’ relative entrepreneurial strengths and weaknesses, looking at 14 indicators applied to 3 main categories (Presence, Perspective and Policy), to arrive at a score out of 100.

“Some measures of what makes a “boom-town” are obvious, such as a high concentration of entrepreneurs and a high business startup rate,” added Mallett.“Other indicators are not as obvious, like the level of business optimism and supportive local government.

Notice we have no hundreds on the board. These cities are leading the way, but even they can stand to improve in one area or another.”

CFIB is Canada’s largest association of small and medium-sized businesses with 109,000 members across every sector and region.

Historically, the highest scores in Communities in Boom have gone to urban areas that ring large urban cores (identified in the report as “Greater”, as opposed to “City of”, which identifies the cores themselves). Canada’s prairie cities have also typically scored well.

Small businesses support measures in 2013 Throne Speech

“It is clear the Federal Government is listening carefully to the needs of Canadian entrepreneurs by announcing plans to legislate balanced budgets, reduce taxes on small businesses and address the burden of red tape they shoulder,” said CFIB president, Dan Kelly.

• Legislation to reduce red tape (One-for-One rule) and Canada Revenue Agency rules; • Action to implement the Canada Job Grant; and, • Action on public sector pensions, sick leave and benefits.

CFIB remains concerned with the government’s plan to proceed with poorly designed changes to the Temporary Foreign Worker Program. “The majority of measures in the Throne Speech will send a positive message to small firms,” added Kelly.“We at CFIB are committed to working with the government on these and other measures in the months ahead to support job creators.”

I

n residential real estate in Ontario, Toronto usually gets all the headlines – bigger market, high prices, larger gains and, often, fancier projects. Hamilton, like other areas in southwestern Ontario, may not experience the headline-grabbing digit-growth in home prices, but it’s enjoying slow, steady, quiet and consistent performance.

The Conference Board of Canada, in its Metropolitan Outlook for fall 2013, calls for modest economic growth in Hamilton this year, with a better outlook next year. The Board calls for local GDP growth of a modest 1.3 per cent this year, lead by growth in the construction sector, as gains will b partly offset by a decline in manufacturing.

Better news is in store for 2014; more widespread gains across all sectors should lead to a 2.5 per cent increase in GDP next year, the Board says.

It’s no secret manufacturing is a key part of Hamilton’s economy, so when this sector suffers, it resonates in the city. But as the U.S. economic recovery picks up steam into next year, as more and more economists are predicting, manufacturing here is expected to benefit.

Some bad news came this week, however, when United States Steel Corp. announced it is permanently shuttering its steel making operations in the city.

While in the past this may have been cause for deep concern – to be clear, it’s neither a reason to celebrate – it won’t have the devastating affect on the local economy that it once might have.

That’s because, in recent years, Hamilton has seen significant expansion in sectors such as health care and post-secondary education, offsetting its historical reliance on steel and other manufacturing industries. The Conference Board, in fact, calls

Hamilton one of the most diversified economies in the country.

This continuing diversification, combined with increased accessibility provided by the transportation and infrastructure improvements, are among the reasons that investors love Hamilton.

Opportunities abound, as the city is pegged for substantial growth: projections are that Hamilton’s population is to increase to 740,000 by 2014 – a 42-per-cent increase over 2011’s census population of 520,000.

Other factors in Hamilton include an industrial vacancy rate that is at an all-time low; tight vacancy rates in the residential rental market; and an unemployment rate that is among the lowest in Ontario.

Growth and development is expected to occur in all areas – industrial, residential and commercial.

Indeed, looking at commercial real estate, better times are ahead, according to commercial real estate firm CBRE Ltd. The industrial market has long set the tone for the regional economy, and an assessment of commercial real estate transactions from the past year points to new sources of demand that could bolster municipalities across the region.

“The worst is behind us in the industrial sector,” Peter Whatmore, senior vice-president, said in a release. “We are experiencing employment gains, which are translating into demand for commercial real estate. Southwestern Ontario is a market in transition and the prospects for the future are encouraging.”

Commercial lease agreements: Why landlords need lawyers

O

wnership of income-producing properties typically involves the negotiation of commercial leases with your tenant(s). This article explores a few of the considerations inherent in the negotiation and drafting of commercial lease agreements.

Covering off all the bases

Commercial leases are complex documents and in this article we can only skim the surface. You need to speak to a lawyer who understands this area of law. There are fundamental components of the lease which a solicitor should prepare/review to ensure it meets your practical and commercial expectations. Principally, you will want rental payments defined and broken into “base rent” and “additional rent.” Base rent is your money. This is the amount used to determine net income. Additional rent represents all of the expenses that may be shared by the tenant or paid directly for utilities such as electricity, water and gas and things like maintenance insurance and realty taxes. If you are thinking of a net-net lease this is critical. Have you ensured the lease clearly defines how any increases in rent during the lease term are calculated?

Aside from the financial considerations noted above, commercial leases must also cover off any “special” requirements to prevent confusion going forward; as an example, use clauses or renewal terms. Tenants typically prefer leases with renewal options. Tenants typically also desire the ability to “assign” their lease as this affords them flexibility to sell their business. Any such provisions should give you broad discretion to vet any prospective assignee to ensure they would be a prudent and reliable tenant. The lease should make sure the tenant will pay any legal and/or administrative costs incurred on any renewal or assignment of the lease.

Negotiation of the lease Landlords often have their standard form or “boiler-plate” commercial lease agreement which they present to prospective tenants for review prior to execution. Savvy tenants will typically have retained a lawyer to review the document and offer proposed amendments. In a scenario where there will be a back-and-forth in respect of the ultimate wording – and particularly where the prospective tenant has retained a lawyer – I highly recommend hiring a solicitor to quarterback the negotiations. From my practice I have found landlords all-too willing to cut out provisions which could severely compromise them in the interests of not losing the tenant.

Conclusion It goes without saying that all warranties, representations and terms outlining the landlord/tenant relationship must be incorporated into the lease agreement. These documents can often run between 30 to 50 pages in length.

It is far better for your commercial lease to be “too long” than “too short.”

Sitting down with an experienced commercial lawyer to properly negotiate and draft your commercial lease at the front end can save you considerable aggravation down the line.

CSA encourages all Canadians to take time to “Check before you invest”

he Canadian Securities Administrators (CSA) is encouraging investors to make use of free online investor education tools that can help with finding and working with a registered financial adviser.

The CSA has added two new resources to its website to assist investors complete a background check and registration search - Check Before You Invest and Understanding Registration.

The CSA has also refreshed its Working with a Financial Adviser brochure.

“Before investors work with a financial adviser, it is essential that they do some homework on the adviser’s background and registration status,” said Bill Rice, Chair of the CSA and Chair and CEO of the Alberta Securities Commission.

“Investors must do their due diligence

whenever they are considering making an investment with a new financial adviser, and the CSA resources can help.”

The CSA provides a ‘check registration’ webpage ,(aretheyregistered.ca) where investors can find: ~ The National Registration Search - an online tool that makes checking your financial adviser’s registration quick and easy; ~ Understanding Registration - a resource that helps investors understand the results of their search; ~ Check Before You Invest - a workbook that people can use to record results of their background research; and ~ Working with a Financial Adviser - an updated brochure that walks investors through the steps they should take when considering and working with a financial adviser.

CIBC Poll – Younger business owners have big expansion plans

R

esearch shows a majority of business owners under 35 are planning to expand in the next 3 years, while Boomers say they’re holding the line and eyeing retirement.

“There’s a clear split in the market, with a new generation of small business owners looking to fuel growth and expansion, while some experienced owners are thinking about transitioning out of business and into retirement,” said Jon Hountalas, Executive VicePresident of Business Banking, CIBC.

A new CIBC (TSX: CM) (NYSE: CM) poll by Leger shows that business owners under 35 years of age are twice as likely to be planning a business expansion when compared to owners 55 and over. While this trend suggests that younger owners will play a key role in driving future economic growth, it also highlights the need for these owners to have a strong business strategy and access to additional capital to make these plans a reality.

With the majority of business owners 35 and under in the survey planning to expand in the next three years, Mr. Hountalas noted that it is important to have the capital to invest in the expansion, and the cash flow to support the business after it grows.

When asked why they were not interested in expanding their business, the most common answer among business owners 55 and over was that they are planning to wind down the business to retire (54 per cent) Regionally, businesses in BC (30 per cent) were the least likely to be expanding.

“While it’s encouraging to see a new generation of business owners with plans to drive growth in the next few years, it’s important to enter any growth phase with a plan for both your business and your finances,” said Mr. Hountalas.“Growth can sometimes take longer than planned, or can happen faster than you expect, and you need to ensure you have built in the financial flexibility to deal with either outcome.”

The “Street Smart Real Estate Appraiser” I have always viewed the valuation of real estate as an “Art and a Science”, which properties are more art and less science is often hard to determine. Typically, properties that have ample comparable data don’t require a creative view to determine a value, whereas unique properties with almost no sales data or similar comparison often involve a large degree of subjectivity and creativity. How does a typical appraiser obtain a – let’s say “Creative Valuation Zealous” needed for unique property appraisals?

I think a real estate developer can train an appraiser, helping him understand the creative side to the valuation of real estate development parcels. By definition Real Estate Development is a multifaceted business, encompassing activities that range from the renovation and re-lease of existing buildings to the purchase of raw land and the sale of improved parcels to others. As a real estate appraiser what does this mean to me? A developer that buys raw land at price X dollars and then adds value inputs at Y dollars, should have the equation (X + Y = $$) added together or approximately together. There it is….. an expert real estate developer creates the value and should know his valuation. I should talk to real estate developers and get their “trade secrets”. The mission - become a “STREET SMART APPRAISER”!!

A real estate developer valuation trick I give you is “CAMP-OUT”!

Rainer Hummel taught me this appraisal “trade secret”.

Rainer is the Owner of Hummel Properties Inc., which operates and develops residential and commercial properties in Ontario.

I have had the pleasure of working with Rainer several times over the last few years. On our most recent assignment I pulled him aside and ask for his valuation views. Of the many great ideas he put forth, one of the simplest ideas that morning was; how he would sit outside of a property he was considering as an investment for hours on end….just patiently waiting for the property to “talk to him”…almost as an engineer looks at a plan for a solution to a problem. Fundamentally, this “camp-out” strategy is an excellent valuation tool. I often find patience is the key to commercial valuation of a development property. Most appraisers rush though the inspection process of an appraisal…hurrying to the next property; when a “Street Smart Appraiser” should spend extra time at a property and possibly go back again and again to ensure that the property “talks to him” about its value.

First Gulf puts shovels in the ground to kick start construction of The New Globe and Mail Centre

irst Gulf officially broke ground on October 31, on The Globe and Mail Centre located at 351 King Street East scheduled for completion in 2016.

With more than 130 guests in attendance, and dignitaries including Minister Brad Duguid, Toronto Mayor Rob Ford and Toronto Ward 28 Councillor Pam McConnell, the event marked a new era of revitalization for King Street East.

New Lending Rules and Practices Are you a real estate investor that has run out of options for purchasing rental properties? Are you self-employed and successful in your career, yet cannot get a mortgage? You are not alone!

Having been in the mortgage business now for over 15 years, I have seen many new rules and regulations introduced by various governments. Some changes have worked well and others...not so well. The recent federal changes to borrowing/lending criteria involving cutting back loan-to-value (LTV) ratios from 85% to 80% and amortization periods from 30 to 25 years on insured mortgages has certainly impacted the industry. Of far greater impact and consequence are guidelines issued from the Office of Superintendent of Financial Institutions Canada (OSFI). OSFI has issued practices and procedure guidelines impacting all federallyregulated financial institutions on residential mortgages of 1 to 4 units and include home equity lines of credit. The impact is only starting to make itself felt as various financial institutions have re-worked and are re- working their lending practices and criteria.

The results are becoming dramatic and are beginning to significantly impact the industry.

One result of these changes is that many mortgage brokers have become challenged with finding appropriate financing for smaller investment properties. Lenders and other institutions have now virtually ended small rental property financing. Further, self- employed stated income or low documentation loans and lines of credit have been reduced to 65% (reference “income verification” and “non-conforming loan principles”). Institutional mortgage lending to self-employed investors has been dramatically affected.

Small real investors who have rental properties which were financed some years ago, may be looking at injecting additional cash into their properties for things like improvements and life-cycle repairs. With Banks no longer offering the financing that was available 5 years ago, much stress is now being created. We recently had a client (who is self-employed) who purchased 2 properties some 5 years ago. He wanted to put additional cash into the properties to improve them. However, he was not in a position to contribute his own additional cash equity into the property. Even though the property values have increased, and the investment has run very smoothly with principal loan amounts repaid as part of the amortized mortgage, the investor could not get more than 65% financing based on his specific circumstance. 5 years ago he received 95% LTV financing!

What is the solution to these new restrictions and limitations? The answer is private lending. There are no “rules” imposed on private lending. Pro Funds Mortgages has been focusing on private lending in the recent years. Interest costs are higher, but lending documentation and criteria is not regulated. Different private lenders set their own rules and lending criteria. Often, the strength of the real estate security is of greatest importance. If you are self-employed, or if you are buying a student rental, or if you are buying an investment or a home that needs renovations or may not be complete, or if you are buying in a region that may not be on the Banks list to lend on, or if this is an investment or rental property (large or small), Private lending may be the best approach. We can get the mortgage done. We have lenders that will lend up to 85% loan-to-value in most cases (and up to 90% on exceptions). Why let the banks deter your investment direction and activities. There is (almost) always a way. With the historically low interest rates of today, perhaps a business case can be made to invest with private funds at slightly higher interest rate.

It is certainly worth exploring.

If you are looking for a mortgage and cannot seem to get approved by our Banks then give this option a shot. On the other side, if you are an investor and have RRSPs and cash, this is your time to get involved in investing in mortgages as a lender. New doors are now opening for both borrowers and lenders.
