uying a brand-new home offers you an opportunity to customize it to your liking. It can be a dream come true and an investment for the future – but don’t forget, it’s also legal transaction.

The term “get it in writing” has never been more important in the case of the new-home purchase, since such a document outlines everything your home will have in it, on it and around it. Otherwise known as the Agreement of Purchase and Sale, the contract spells out the terms and conditions between you and your builder. Without it, if there is a misunderstanding or disagreement, it’s impossible to prove what was agreed upon.

Since building a home is much more complicated than a resale transaction where the unit and/or property likely already exists, there is

no set Agreement of Purchase and Sale or standard contract for buying a new home. In some provinces, builders may have standard contracts prepared by the local home builders’ association or their new-home warranty program. Builders often prepare their own agreements, so contracts can vary from one builder/ developer to another and from province to province.

Before you sign a contract, review it carefully with the builder and ask questions to make sure you fully understand what it contains. Your next step is to then take it to a real estate lawyer and have it reviewed. Once it is signed, it becomes a legal document and an agreed-upon contract, so seeking the services of an experienced real estate lawyer is an important step toward ensuring that your dream home becomes a reality.

e and other industry sources in New Home Guide have been writing more and more recently about Development Charges, trying to bring attention to this increasingly important topic – and what buyers might be able to do about it. DCs are the fees applied by various levels of government when homes are built, to pay for new roads, transit and other infrastructure.

Now, we’re happy to report, home builders are getting creative, looking for ways to give buyers a break on rising new home costs. In one example in Toronto, Edilcan Development Corp., found a way to freeze DCs at 2013 levels at one its

projects – a master-planned community that involves townhomes and three condominium towers.

We don’t expect that all home builders will be able to find similarly innovative solutions, but the initiative is a shining example of what can be done – while home builder associations across the country lobby government on behalf of new-home buyers.

Given that these rising fees are almost always transferred right on to you, the new-home buyer – along with your associated mortgage costs – such creative efforts should be applauded.

As you’re out there scouting about for your new home, ask your builder how it is handling DCs, and if there are any opportunities to save.

A

home that provides flexibility and substantial space for growing and extended families is proving popular with new-home buyers in the northwest community of Sherwood.

The Bentleigh, crafted by the Genesis Builders Group, a 2,213-sq.-ft. two-storey showhome with a front-attached garage, “is a big seller for us,” says area manager Harry Levy.

“People really love this plan, which has four bedrooms and three full bathrooms upstairs because it’s ideal for families who have lots of kids, older kids or have extended family or even a nanny living with them,” Levy says. “It provides everyone with their own space.”

“What makes this home stand out is it offers an ensuite bathroom in the fourth bathroom – a feature you usually only see in more expensive homes,” he says.

“The plan also offers several options allowing you to choose the design that suits your family’s needs,” Levy says, for example, the showhome has a smaller loft to accommodate the fourth bedroom and ensuite, but you can also have a three-bedroom layout with a large bonus room, a fourth bedroom without an ensuite and a smaller bonus room with a computer nook.

The Bentleigh opens to a bright entry providing sufficient space to accommodate a large bench or hall table.

The hardwood floor and soft colours give the home a warm, welcoming feel.

Just off the entry is a front living room, with the option to close it off if you want to create a private office or den.

Down the hall from the living room are a convenient half-bath and a large mud room off the garage.

Canadians lacking in mortgage literacy: survey The majority of Canadian adults (61 per cent) don’t know what options are available to them if they can’t pay their mortgage, according to a survey of 1,500 Canadians by Lawyers’ Professional Indemnity Company (LAWPRO).

Another key finding – 79 per cent of Canadians currently own or have considered purchasing property – paints the picture of a nation that values homeownership, but lacks the mortgage literacy necessary to safeguard their biggest asset.

“Arming yourself with knowledge is key,” says Ray Leclair, vice-president at LawPRO. “If you’re experiencing financial difficulties, you don’t have to go to your lender alone and unprepared. Speaking with a lawyer is an investment in learning your rights and obligations regarding a mortgage you can’t pay. An experienced real estate lawyer can also help you find solutions and strategize how to protect your most significant asset.”

The survey findings were particularly alarming for the 18- to 34-year-old age group, as almost three quarters (74 per cent) of Canadians in this group don’t understand their options if they can’t make a payment.

Understanding mortgage terms and options is more important than ever. Economic and employment concerns mean that income and mortgage payments can be less secure.

There may be a number of solutions available if you are having difficulty meeting your mortgage payments, or expect to miss payments in the future: » Restructuring your payments » Refinancing with your lender or another lender » Working out an agreement to make forward payments despite missed payments in the past » Reviewing revenue possibilities from the property » Selling your home on your terms » Reaching out to friends/family for a loan A lawyer can provide valuable advice and insight as you consider your options. For example, if parents, other family members or friends offer to help meet your payments via a loan or gift, a lawyer can develop agreements to clarify whether the funds represent an ownership interest, or set the terms of repayment.

“If you’re behind on your mortgage payments, other priority payments associated with the property, such as taxes, condominium fees and utility bills may also be affected,” adds Leclair.

Mortgage interest rates, still at historical lows and expected to remain so until later this year and maybe even into 2015, represent a window of opportunity for those looking to buy a home.

The Bank of Canada, in its latest rate announcement on June 4, once again held its influential overnight target rate at one per cent – where it has been since September 2010.

Indeed, the mortgage industry remains ultra-competitive, lenders often introduce new products and otherwise there are plenty of options for borrowers.

If you could lock in at a low rate over 10 years, for example, that gives you the comfort of knowing what your mortgage payments will be over that period, while over that time you can also take advantage of any pre-payment and lump-sum payment options to pay down your mortgage.

Another appeal of this scenario is that, as we often point out, experts advise you take a long-term view of your home purchase. For example, there has been some talk recently about cooling prices and softening sales. But even if that were to happen in your market and housing type, ask yourself: in 10 years, is a home you buy today likely to be worth more or less? If you need an answer to this question, just take a look back at prices 10 years ago. It’s unlikely that the first home you buy will be the one you stay in forever. At some point, you’ll want to sell and buy a new home – either to upsize, downsize or move to a new location. And when you find yourself in that situation, there’s a good chance you’ll be relying on the equity from your existing home to help you purchase your next one.

Unfortunately, you could get stuck in a situation where the closing date for your new home is before the closing date of the home you’re selling, which leaves your down payment tied up in equity. Mortgage brokers estimate that 20 to 30 per cent of Canadian homeowners find themselves in this situation; if you’re one of them, bridge financing is the tool that can help you out of it.

How does a bridge loan work? Well, let’s say the closing date for the home you’re buying is 40 days before the closing

To qualify for a bridge loan, all you need is a copy of the Sale Agreement from your existing home and the Purchase Agreement for your new home.

date for the home you’re selling. A bridge loan is simply a loan for the amount of equity you want to take from your existing home that covers you for those 40 days. Bridge loans are automatically repaid when your sale goes through and your equity is put against the mortgage on your new home.

Because bridge financing is so common, all of the big banks offer it to their mortgage customers. (Note that some smaller lenders and credit unions do not.) Most lenders are comfortable lending up to $200,000 for as many as 120 days. If you require a larger loan or an extended period of time, you may need to hire a real estate lawyer, which makes the financing process more expensive, as legal fees will be involved.

Of course, as much as a bridge loan is meant to help you out with your home purchase, it is still subject to interest – often at a rate similar to an open mortgage or a personal line of credit (such as Prime plus two or three per cent). The interest rate may seem high, but remember it’s only charged for a short period of time, before the equity from your first home will be available to repay the loan. Your lender may also charge a flat administration fee in the range of $200 to $500.

To qualify for a bridge loan, all you need is a copy of the Sale Agreement from your existing home and the Purchase Agreement for your new home.

Oh, and firm closing dates on both properties – without them, you may need to get a bridge loan from a private lender, who will charge you a much higher interest rate than what one of the big banks would. Good luck!

Do you need

mortgage loan insurance?

Buying a new home and not sure if you need mortgage loan insurance? Well, if you’re making a down payment of less than 20 per cent of the purchase price (what’s known as a high-ratio mortgage), your lender will almost certainly require you to have mortgage loan insurance.

What many consumers don’t realize, however, is that this insurance doesn’t protect you, the homeowner – it protects your lender against mortgage default.

But since the mortgage is insured – essentially guaranteed by Canada Mortgage and Housing Corp. – this program also enables consumers to purchase homes with a minimum down payment of five per cent.

Mortgage loan insurance is not to be confused with mortgage life insurance, which guarantees that your remaining mortgage at the time of your death will not be a burden to your estate.

The CMHC Mortgage Loan Insurance premium is calculated as a percentage of the loan and is based on the size of your down payment. The higher the percentage of the total house price/value that you borrow, the higher percentage you will pay in insurance premiums.

If you’re putting down five per cent as a down payment and mortgaging the balance, your loan-to-value (LTV) ratio is then 95 per cent. Generally speaking, the higher the LTV, the greater the premium for mortgage loan insurance. For example, for an LTV of 95 per cent, the standard premium is 2.75 per cent of the purchase price; for an LTV of 90 per cent, it’s two per cent; for an LTV of 85 per cent, the premium is 1.75 per cent, and so on.

The premium can be paid in a single lump sum or it can be added to your mortgage and included in your monthly payments.

Without mortgage insurance, you may avoid the insurance premium, but you could also pay higher interest rates for the mortgage, as well as additional administrative fees. At the end of the day, for the vast majority of borrowers, the cost of CMHC Mortgage Loan Insurance is more than fully offset by the savings achieved.

Under the CMHC Green Home program, buyers may qualify for a 10-per-cent premium refund and extended amortization period without surcharge, for mortgages used to finance an energy-efficient home.

Since the downturn of the economy more than five years ago, financial institutions and various credit adjudicators have tightened the reins on their lending policies, and in particular, pay much greater attention to an individual’s past credit experience than ever before. Nowhere has this been more evident than in the mortgage industry. With foreclosures at historic levels, most lenders, insurers and their investors have reduced their product offerings, while at the same time, they have placed considerably more emphasis on a client’s credit (beacon) score when making their final decision.

Still, there are a number of things you should know, not only when it comes to you qualifying for a specific credit product, but also in maintaining a good credit rating in general.

Due to the level of fraudulent activity that is occurring in the world today, it is prudent that you check your credit report on an annual basis to ensure that all account information that is contained in the report is accurate. There are two main credit report providers in Canada; Equifax and Transunion. Each of these providers can be accessed online at econsumer.equifax.ca and transunion.ca, respectively.

When applying for credit, it is important that you don’t apply to several different banks or financial institutions within a short time of each other. Each time you do so, it is referred to as a “hit,” and this may result in your score dropping enough to prevent you from qualifying for that particular credit product. In the case of purchasing a home or refinancing your existing property, it is beneficial to use the services of a mortgage broker as we typically access your credit report once, and supply it to the various financial institutions for review. If you access your own credit report by contacting either Equifax or Transunion directly, this does not represent a “hit” on your file and therefore does not impact your score.

In order to get your score as high as possible, you may want to consider doing the following. It is best to make at least the minimum payment required for that particular credit card or line of credit each month. If possible, keep your balance(s) at or below 75 per cent of your credit

limit(s). In the event that you are either late with a payment or your account has gone to collection, it is vital that you bring the account up to date as soon as possible. You would be amazed how much your score will drop if you are so much as 30 days late on an account, regardless of how much or how little that minimum payment required is. The good, the bad and the ugly stay on your credit report for a minimum of six years.

In situations where there has either been serious delinquency or a bankruptcy in the past, it can be very difficult to re-establish one’s credit rating. One of the easiest ways to do so however, is to get a cash secured credit card. It is recommended that you get a limit of at least $1,500, which means you need to pledge at least that much money as security. In order to qualify for a mortgage, you need to have at least two credit products with a minimum of a $1,500 limit, and they need to have been open for at least a year with no repayment issues. If you hold the card for a year and continue to make the minimum payment each month, you will find your credit score will go up significantly. This same approach may be used in situations where a client doesn’t have any credit whatsoever.

Individuals with no credit history are often viewed in the same light as those clients with bruised or poor credit ratings, because there is no previous credit to base their decision upon.

Mortgage Types

All mortgages are of two basic types: Conventional The buyer can borrow up to 80% of the purchase price or the value of the property, whichever is less.

The buyer has to pay 20% down.

A conventional mortgage cannot exceed 80% of the value of the property.

Insured or High-Ratio: A buyer can borrow up to 95% of the purchase price or the value of the property, whichever is less. The down payment can be as low as 5%.

Mortgage OPTIONS

You can choose any of these mortgage options which fit into the two basic mortgage types.

Lenders may even customize these options to suit your needs.

Open mortgage: Allows borrowers to repay all or part of the total amount of their mortgage at any time without penalty.

Because of flexibility, this is ideal for borrowers who plan to sell their homes in the near future or who want to switch from a short-term mortgage at high interest rates to a longer term when mortgage interest rates fall.

Closed mortgage: Usually has the lowest interest rate available but lacks the flexible features of other mortgage options.

A good choice for those who want the security of knowing their monthly payment is fixed for a longer term.

Prepayment options are available but they are subject to conditions.

Portable mortgage: Flexibility if borrowers move.

Borrowers can take the mortgage to their new home or can transfer it (usually with the consent of the lender) to the purchaser of their old home. This is an attractive option if the rate on the existing mortgage is lower than current rates.

With the increasing in-migration to Calgary, it stands to reason many people will be looking to buy a new home this year.

For those who have never gone through the process of buying a new home, it can be a daunting task and often leads to a number of questions about the construction process.

Many new-home buyers will want to know answers to questions such as: How long will it take to build? What order are things done, and when do you make final decisions about features and finishings?

Your home builder is a great resource to help answer these and other questions that may arise during the home-building process.

However, to help you further, here is an outline of the typical construction process. Keep in mind that this is a generalized description – your own builder may use a different approach. The process and schedule will also be affected by the size and style of the house, construction techniques used, the amount of customized work being done and other factors, so be sure to ask your builder for the specifics on your own home.

Typically, before any construction begins, plans for your home are developed, finalized and required permits are obtained.

Construction begins with the foundation, so your house is staked out and the land is prepared with often the topsoil being removed and piled elsewhere for later use. Excavation is done and the footings are formed and poured. Utilities such as water, electricity, telephone and cable services may be brought in at this time.

The foundation walls are erected and the foundation may be insulated and damp-proofed. Weeping tiles are installed to drain ground moisture away from the house. A city inspection of the foundation will be conducted before the outside perimeter is backfilled.

At this time, your builder may ask you to begin making your selections for interior finishings, such as type of flooring, tiles, cabinets and paint. While it will be weeks before these items are needed, they are usually ordered early to prevent delays.

Next, exterior walls, interior partitions and the roof are assembled. Roof trusses are most often brought to the site ready for installation, and roofing is completed and windows and doors are installed with the goal to “lock up” the home as quickly as possible to protect it from the elements, especially

at this time of year when Calgary’s weather can go from sunny to rainy in hours.

Then, the basement floor is installed and electrical and plumbing services are roughed in, plus ducting for heating, cooling and ventilation is installed. The city will require a structural inspection at this time to ensure the home is being built according to code, plus electrical and plumbing inspections will be conducted as well.

For the next several weeks, a great deal of work will happen inside and out, much of it at the same time and during this period of work your builder will likely provide updates and ensure selections and other decisions are made.

The exterior walls and the roof are insulated and a vapour barrier is applied. Another inspection will occur to ensure this work has been done properly, before the drywall is installed.

Heating and cooling systems are installed, including fireplaces.

Now the finishing touches begin as walls and ceilings are painted, flooring is put down and cabinets are installed.

Plumbing and electrical fixtures are put in, trim is applied and interior doors are hung. Outside, siding, porches and decks, final lot grading and driveway and walkways are completed. Several additional inspections occur at this point.

Finally, your builder will complete the final touches and clean up, and ask you to do a walk-through inspection of the home with them to check for any deficiencies that may need to be addressed. Then any last-minute touch-ups will take place.

On the date of possession, you will be handed the keys – the home is now yours, so enjoy!
