Opulent, with forward aromatics (gobs of black fruits intermixed with toasty pain grille scents and a boatload of spice), this terrific Cos possesses remarkable intensity, full body, and layers of jammy fruit nicely framed by the wine's new oak. Because of low acidity and sweet tannin, the 1995 will be difficult to resist young, although it will age for 2-3 decades. 4 CHÂTEAU PALMER 1999 Margaux. 3ième Cru Classé The 1999 is the greatest Palmer made since 1961, 1966, 1970, 1983, and 1989. It is one of the superstars of the vintage. The wine is a blend of 48% Cabernet Sauvignon, 46% Merlot, and 6% Petit Verdot. It boasts a staggering bouquet of violets and other spring flowers intermixed with licorice, black currants, and subtle wood. Only 50% of the production made it into the grand vin. This is a multidimensional, compelling effort with both power and elegance, it offers sweet tannin along with flavors that caress the palate, and a 45-second finish. This is terrific stuff! 85 CHÂTEAU MONTROSE 1990 St.-Estèphe. 2ième Cru Classé u. 1vts. Tasted at the Montrose vertical in London, the 1990 Montrose is a blend of 64% Cabernet Sauvignon, 32% Merlot and 4% Cabernet Franc (almost identical to the 1989 Montrose) and picked between 14 September and 3 October. It has a formidable reputation and for years it overshadowed the 1989. That said, it is well known that there are incidences of bre"anomyces that compromise some bo"les and the one bo"le in London showed just a tincture of this. It still merited a score of 97/100, though it only served to highlight the ethereal delineation of the 1989. Then literally a couple of days later. I was served blind a magnum of the 1990 Montrose in Cape Town, which had been purchased on release and stored in perfect conditions. Now, here was the real deal, unfe"ered by any infection, a regal Saint Estèphe. It shows approximately the same evolution as the 1989 in bo"le, but unsurprisingly showed less bricking in magnum format. The bouquet is cut from a different cloth to the 1989 and a"ests to that warm vintage: hickory, clove, undergrowth and wild fennel, later garrigue-like scents and terraco"a, the la"er two more pronounced on the bo"le format compared to the youthful magnum. The palate is fullbodied and powerful, yet the balance is perfect, a ballerina-like poise with the structure of the Forth Bridge. It is a multi-layered Montrose that offers enormous length, fresh and vibrant with the magnum demonstrating tangible mineralite and tension as it fans out on the crescendo of a finish—a fanfare for Saint Estèphe in all its glory. Improving all the time in the glass, this example of 1990 Montrose is a privilege to behold. One can speculate whether larger formats are a "safer bet" in terms of experiencing this behemoth without any bre"anomyces. Perhaps. However, if you do come across the 1990 Montrose like this, you are in the presence of a king. Tasted January 2017. 100? WA 2 bts.

As I have noted consistently, this can be a breathtaking wine, but having tasted it close to a dozen times since the last edition of this book, over half the bo"les were marred by tainted corks. In fact, one would almost wonder if there was TCA problem in part of the wine storage area. The percentage of corked half-bo"les is even higher than in the regular format. However, when clean this 1983, which has seemingly reached full maturity far faster than I would have guessed a mere four years ago, has a dense, murky plum/purple color and a gorgeous nose of smoked herbs, damp earth, mushrooms, and sweet creme de cassis intermixed with vanilla and violets The wine is medium to fullbodied, deep, rich, and powerful, with sweet tannins and loads of fruit concentration. Anticipated maturity: Now-2020. Last tasted, 11/02. 96 WA CHÂTEAU MOUTON ROTHSCHILD 1986 (1) Pauillac. 1er Cru Classé u. 1bn. The 1986 Mouton-Rothschild is a blend of 80% Cabernet Sauvignon, 10% Merlot, 8% Cabernet Franc and 2% Petit Verdot that was picked from 2 October until 16 October. Winemaker Philippe Dhalluin, who was not working at the property back then, told me that the pH was fairly low at 3.54 when it is usually around 3.75, due to the natural tartaric acid in the vines. It has a powerful and intense bouquet as always: exemplary graphite and cedar scents, a touch of black pepper and incense. It seems to unfurl in the glass, like a motor revving its engine. The palate is beautifully balanced with its trademark firm tannic structure, a Mouton-Rothschild with backbone and masculinity. Layers of black fruit intermingling with mint and graphite, a hint of licorice emanating from the Merlot, gently fanning out and my God, it is incredibly long. It is not like the 1985 Mouton-Rothschild that is so fleshy and generous. This is serious, aristocratic Mouton, a true vin de garde and yes, I do think drinkers will have to wait until it reaches its true peak. Sometimes that's just the way it is. The Château La Mission Haut-Brion 1990 continues its epic trajectory. Here tasted in Holland, it has a scintillating bouquet with blackberry, black olive, warm gravel and touches of autumnal woodland that is just beautifully defined and gains momentum with each passing swirl of the glass. The palate is just wonderfully balanced, here with a slightly more powdery texture than before, but there is immense weight on the peacock's tail finish. This is a glorious La Mission and you know what? I think it is going to get even be"er. Tasted June 2014. 97+ WA 2 bts.

The 1990 Hermitage La Chapelle lived up to its reputation on this occasion, and of the three titans (1990, 1978 and 1961), it was probably my favorite. Still inky colored and ruby at the rim, it offers an absolutely profound bouquet of sweet cassis, smoked meats, chocolate, licorice and spice. This is followed by a full-bodied, insanely textured, pure and hedonistic palate that has that perfect mix of still-vibrant fruit and ample secondary nuances. Drink: 2015-2040 100 WA

Bo!led in June, 1997, this profound Mouton is more accessible than the more muscular 1996. A blend of 72% Cabernet Sauvignon, 9% Cabernet Franc, and 19% Merlot, it reveals an opaque purple color, and reluctant aromas of cassis, truffles, coffee, licorice, and spice. In the mouth, the wine is "great stuff," with superb density, a full-bodied personality, rich midpalate, and a layered, profound finish that lasts for 40+ seconds. There is outstanding purity and high tannin, but my instincts suggest this wine is lower in acidity and slightly fleshier than the brawnier, bigger 1996. Both are great efforts from Mouton-Rothschild. Anticipated maturity: 2004-2030. 95 WA CHÂTEAU MOUTON ROTHSCHILD 1996 (2) Pauillac. 1er Cru Classé It is four years since I last tasted the 1996 Château Mouton-Rothschild. Approaching 20 years old, the nose is now open for business but remaining classic in style, a mixture of red and black fruit, hickory, cedar and just a hint of lavender. It is very complex and beautifully defined. The palate is mediumbodied with a slightly herbaceous, undergrowthtinged opening, the tannins just a li!le abrasive at the moment, exerting a firmness in the mouth. I feel it is almost as if the palate has not kept pace with the aromatics, requiring more substance to fill out the foursquare finish. If you like a slightly more austere Pauillac then you will adore this, though I don't think it quite reaches the potential that it showed a few years ago. Tasted August 2016. It is extremely well defined and powerful yet succinctly focused. The palate is ripe and sweet on the entry. Vibrant red fruit, orange peel, marmalade, Asian spices all vie for a!ention. There is great weight and potency, building in the mouth that is rich in glycerine and climaxes with a spicy, meaty finish that tightly grips the mouth. The 2011 Taylor’s Vintage 2011 has a multifaceted, Pandora’s Box of a nose that is mercurial in the glass: cassis at first before blackberry and raspberry politely ask it to move aside, followed by wilted rose petals and Dorset plum. Returning a#er one 45 minutes that nose has shut up shop. The palate is sweet and sensual on the entry, plush and opulent, with copious black cherries, boysenberry and cassis fruit, curiously more reminiscent of Fonseca! It just glides across the palate with a mouth-coating, glycerine-tinged finish that has a wonderful lightness of touch, demonstrating how Vintage Port is so much more accessible in its youth nowadays. Another wine I’ve had multiple times recently, the 2003 Cabernet Sauvignon (97% Cabernet Sauvignon and 3% Merlot) is pure perfection in a glass and yields off-the-hook aromatics of cassis, black raspberries, tobacco leaf, pepper and licorice. Deep, layered and even elegant, with a seamless texture that conceals the sheer wealth of material present, it builds through the mid-palate, possesses huge amounts of extract and masses of polished tannin on the finish. Despite the overall size, it never loses its Cabernet Sauvignon soul and has an almost Bordeaux-like savoriness and tannic frame. Tasted from an ex-château bo#le in Bordeaux, I was not surprised to find the 2000 Château Haut-Brion flirting with perfection. The nose is simply breathtaking - quintessential Haut-Brion with ebullient red berry fruit, roasted herbs, gravel, terraco#a tiles on a warm summer's day...it is simply wave a$er wave of intoxicating scents that could bring even the most stoic person to tears of joy. The palate displays heavenly balance, pitch-perfect acidity, perhaps spicier than previous bo#les that I have tasted, and what depth and dimension in this outstanding wine. That hint of graphite on the finish is a cheeky nod to Pauillac, as if to thumb its nose at the First Growths, because alongside Château Latour, almost by stealth, the Haut-Brion is one of the greatest Bordeaux in this millennial year. A prodigious Petrus, this wine has that extra level of intensity and complexity that is monumental. The magic is clearly Petrus, and the 2000 will always be an interesting vintage to compare to another legend in the making, the 1998, or more recently, of course, the 2005, 2008, and 2009. Extremely full-bodied, with great fruit purity, an unmistakable note of underbrush, black truffle, intense black cherries, licorice, and mulberry, the wine seems to show no evidence of oak whatsoever. It has a sumptuous, unctuous texture, plenty of tannin, but also vibrancy and brightness. This is a remarkable wine that seems slightly more structured and massive than the 1998, which comes across as slightly more seamless, as if it were haute couture. This wine needs at least another 5-10 years of cellaring and should age for 50+ years. 100 WA

Tasted blind, the 2000 Chateau Margaux was a reminder of the peaks that the millennial vintage could reach. Noticeably deep in color, the bouquet rivets you to the seat with copious red berry fruit, clove and truffle, hints of cedar emerging with time. As the aromatics open and aerate, the fruit profile seems to darken and manifests blackcurrants and bilberries. The palate is medium-bodied with filigree tannin. There is immense depth and symmetry conveyed by this First Growth, quite masculine for the estate with a gentle but insistent grip. It is a brilliant wine that flirts with perfection. Afford it another 3-4 years if you can, because it will last decades. Tasted November 2016. 99 WA 2 bts.

The 2000 Latour (a relatively abundant 14,000 cases compared to what they produced in 2009, 2008, or 2005) is “packed and stacked.” The extremely rich, black/purple color to the rim is followed by a wine with some subtle smoke, loads of minerals, a hint of vanilla, and plenty of creme de cassis as well as roasted meat and a slight scorched earth character. Broad, savory, and rich, the wine seems to be about 5 years away from full maturity and should drink well for at least 40-50 more years. A great effort, probably eclipsed only by 2003 and 2009. 98 WA 2 bts.

The 2010 Syrah Armada Vineyard saw 22 months in puncheons and a second-fill foudre. It offers gorgeous purity in its black raspberry and cassis fruit, crushed rock and spice-laced aromatics, yet is relatively closed and backward at the moment, with an almost granite-like tightness and focus on the palate. It could flirt with perfection at maturity, but it needs 3-4 years of cellaring at the moment. Drink: 2019-2030 97+ WA

The 2000 Chateauneuf du Pape Cuvee da Capo is a monument to old vine Grenache as well as traditionally made Chateauneuf du Pape. Boasting a natural alcohol of 16%, this wine, which was bo"led in spring, 2003 because its fermentation was extremely slow, has virtually everything you could ever want in a profound Chateauneuf du Pape. The color is inky/ruby/purple to the rim. The extraordinary nose reveals aromas of kirsch liqueur, new saddle leather, animal fur, Provencal herbs, spice box, licorice, and a salty sea breeze character. On the palate, the wine is enormous, with an unctuosity, thickness, and purity that must be tasted to be believed. Over 95% of this offering is old vine Grenache, and the rest a field blend of ancient vines. Representing the essence of Chateauneuf du Pape, it possesses so much concentration that it is easy to pose the question ... “where’s the tannin?” Analytically, it has very high levels of tannin, but the tannin is barely noticeable given the wine’s exaggerated wealth of richness and power. This is a modern day legend in the making, and despite its precociousness and ease in smelling and consuming, it will not hit its prime for another decade. The 2000 Chateauneuf du Pape Cuvee da Capo is a monument to old vine Grenache as well as traditionally made Chateauneuf du Pape. Boasting a natural alcohol of 16%, this wine, which was bo!led in spring, 2003 because its fermentation was extremely slow, has virtually everything you could ever want in a profound Chateauneuf du Pape. The color is inky/ruby/purple to the rim. The extraordinary nose reveals aromas of kirsch liqueur, new saddle leather, animal fur, Provencal herbs, spice box, licorice, and a salty sea breeze character. On the palate, the wine is enormous, with an unctuosity, thickness, and purity that must be tasted to be believed. Over 95% of this offering is old vine Grenache, and the rest a field blend of ancient vines. Representing the essence of Chateauneuf du Pape, it possesses so much concentration that it is easy to pose the question ... “where’s the tannin?” Analytically, it has very high levels of tannin, but the tannin is barely noticeable given the wine’s exaggerated wealth of richness and power. This is a modern day legend in the making, and despite its precociousness and ease in smelling and consuming, it will not hit its prime for another decade. In contrast to the more linear, structured, but massive 2001, the 2002 Shafer Cabernet Sauvignon Hillside Select is pure fruit-bomb material, but stunningly proportioned, beautifully pure, with notes of melted chocolate, blackcurrant jam, sweet black cherries, licorice, camphor and charcoal. Very fullbodied, like the 2001, but much more lavishly fruited, it is more accessible and hedonistically, as well as intellectually, satisfying. If the 2001 is the longdistance runner, this comes across more like a middle-distancer. It had performed fabulously well since it was released by the winery, and even though it’s still an adolescent in terms of its evolution, this wine is a head-turner in wine tastings, and a spectacular effort from Napa. 400 SHAFER VINEYARDS CABERNET SAUVIGNON HILLSIDE SELECT 2001 Stags Leap District, Napa Valley. The 2001 Shafer Cabernet Sauvignon Hillside Select is the first of these back-to-back perfect wines from Shafer that, at age 13, is still a baby, but, wow, what an amazing wine. A fabulous growing season produced a wine with inky/purple black color, stunning crème de cassis notes, with additional hints of lead pencil shavings, spring flowers, cedar wood and forest floor. It is full-bodied, sensationally concentrated, with a seamless integration of acidity, tannin, wood and alcohol. This is a great, monumental Napa Cabernet Sauvignon that is still an infant, at age 13, going on 14. A blend of 93% Merlot / 7% Cabernet Franc (92% from the Alexander Mountain Estate, 6% from Benne! Valley and 2% from Knight’s Valley), the 2002 La Muse is a “kissing cousin” of the 2001, only so"er and more flamboyant. Classically Californian in its exuberant, flamboyant, super-rich, unctuously textured style, the tannins are so"er than in the 2001, but the wine unquestionably has the potential to last for another quarter of a century. It exhibits an opaque plum/purple color along with abundant notes of cassis, licorice, graphite, coffee cake and spice box. More approachable than the 2001, the 2002 will offer phenomenal drinking over the next 25 years. 99 WA VÉRITÉ LA MUSE 2007 (1) Sonoma County. A perfect wine, this blend of 85% Merlot, 10% Cabernet Franc and 5% Malbec emerges from Chalk Hill (48%), Knight’s Valley (21%), Alexander Mountain Estate (21%) and Benne! Valley (10%). Another prodigious effort, its extraordinary sweet notes of caramelized herbs, mocha, coffee, blackberries and cassis are followed by a multilayered, full-bodied wine revealing a seamless integration of acidity, tannin, alcohol and wood, and an opulent, voluptuous finish that goes on and on. It is thrilling to smell, taste and drink. Moreover, it possesses a similar seamlessness also found in the 2002 and 2001. From the Sonoma Coast vineyard with the most southerly exposure, the 2009 Pinot Noir Clos de Ciel (365 cases) was aged in 50% to 60% new Francois Freres barrels, and underwent a 5 to 7-day cold prefermentation maceration. A stunning, evolved effort, it boasts plenty of rose water, strawberry, lead pencil shavings and forest floor-like notes. This fullbodied, gorgeous Pinot should be drunk over the next decade. The more mortal 2011 Pinot Noir Ma Danseuse exhibits sweet notes of raspberry jam, currants, camphor and powdered rock. This a!ractive, elegant, medium to full-bodied 2011 is more evolved and fruit-forward than the 2009 or the perfect 2010. The 2011 will drink well for 8-12 years. (December 2013) (92-94) WA

Perhaps the most beautiful packaging ever on a Bordeaux bo!le, Baroness Philippine de Rothschild literally produced a work of art in the gold-engraved bo!le of 2000 Mouton Rothschild. Of course, one can’t drink the glass, but this is a top-flight Mouton Rothschild, eclipsed only by the 2006 and 2009. A rich, tannic, earthy style, with loads of creme de cassis and floral notes, the final blend of 86% Cabernet Sauvignon and 14% Merlot is a full-bodied wine with plenty of coffee, earth, chocolatey notes, and still plenty of tannin to resolve. I gave it an anticipated maturity range of 2015-2050 back in 2003, and that looks on target. (Reviewed June 2010) 96+ WA

There are only 140 cases of this beauty, which was cropped at just over a ton of fruit per acre. It offers up notes of bouquet garni, roasted meats, black raspberries, black currants, strawberries and cherries. Deep and full-bodied with a flawless integration of acidity, tannin, wood and alcohol, this glorious Pinot Noir should prove to be legendary. It will age effortlessly for 12+ years. Tasted blind as a vintage comparison at the Valandraud vertical, the 2003 Margaux is fully mature on the nose. There is ample fruit here, well defined for the vintage with blackberry and cedar, this bo!le demonstrating a subtle fungal character that I have not discerned in previous bo!les. There are faint scents of rust iron piping that develop with further aeration. The palate is medium-bodied with slightly dry tannin, offering more fruit than the 2003 Valandraud it was paired with: feisty black pepper and allspice finish with a decent a"ertaste. There might be be!er bo!les than this, even so, there is probably not another Margaux that touches this First Growth. I see no harm in broaching bo!les now and over the next ten years. The 2003 Lafite Rothschild comes as close to perfection as any of the great Lafites made over the past three decades (1982, 1986, 1996, 2000, 2005, 2008, 2009 and 2010). This sensational effort came in at 12.7% natural alcohol, it is made in the style of one of this estate’s great classics, the 1959. Composed of 86% Cabernet Sauvignon, 9% Merlot and the rest Cabernet Franc and Petit Verdot, it exhibits a dense ruby/purple color to the rim along with a luxurious bouquet of cedarwood, lead pencil shaving, white chocolate, cocoa and cassis. Fat, rich, opulent and full-bodied with low acidity and stunning seductiveness and complexity, this noble wine possesses a bountiful, generous, heady style. It is just coming into its plateau of maturity where it should hold for 20-25 years. This is one of the candidates for the wine of the vintage – make no mistake about that. (August 2014) 100 WA

412 HARLAN ESTATE THE MAIDEN 2005 Napa Valley. Bill Harlan’s fabled hillside vineyard has become, since 1991, one of the greatest names in the wine world. The first vintages were 1990 and 1991. The Maiden is their selection of lots and barrels that are deemed slightly less complex and impressive. That sounds critical, but this is a beautiful wine. Always more evolved, precocious and very sexy, the 2005 The Maiden is superb. Dense ruby/purple, with notes of underbrush, graphite, earth, loamy soil and oodles of blackcurrant and black cherry fruit, it offers supple tannins, beautifully integrated acidity and wood. This is a beauty that can be drunk now or held for cellaring another 10-15 years. (June 2015)

413 HARLAN ESTATE PROPRIETARY RED WINE 2004 Napa. Another rating identical to that which was given in 2007 (when first tasted from bo"le), the 2004 Harlan Estate is performing essentially the way I suggested in 2007 as it is one of the more precocious and accessible of the Harlan Estate wines to date. A great showing at this retrospective, this wine, which seems like a hypothetical blend of a Pauillac, St.Estephe and Graves, represents around 1,500 cases from 40 acres of beautifully manicured hillside vineyards overlooking Oakville. Still dense purple to the rim, with notes of creme de cassis, charcoal, blackberry and sweet toast, the wine is full-bodied and voluptuously textured with the tannins largely resolved. But the density and richness suggest this wine can go a long, long way, even though the window for drinking it seems open and inviting already. A world-class, first-growth wine if there ever was one from Napa, this is simply an exquisite Harlan Estate that has atypically reached mid to late adolescence at the age of ten. That is great given the fact that these are 30- to 40-year wines – possibly even half-century wines. Drink it over the next 30 years. (April 2014) 98 WA 2 bts.

A wine that flirts with perfection, and should rival the 1986 as one of the legendary Granges produced, the 1998 has one of the highest alcohol contents (nearly 15%) as well as one of the highest percentages of Shiraz in the blend (97%). Its stunning purple color is accompanied by exceptionally sweet aromas of blackberry liqueur intermixed with barbecue spices, an endearing, smoky earthiness, pepper, roasted meats, and coffee. Huge, massive, unctuously textured, and extraordinarily youthful, this impressive wine is a candidate for perfection. It should continue to evolve over the next three decades. The 1995 will have three decades of longevity, but it will not be approachable before 2006. It exhibits a deep dark ruby/purple color, and a provocative (probably controversial) aromatic profile of animal fur, tar, truffles, black cherries, cassis, licorice, and minerals. A medium to full-bodied wine, with a boatload of tannin, considerable grip and structure, and a weighty feel in the mouth, this appears to be a classic vin de garde made in the style of the 1978 Beaucastel (which is still not close to full maturity). Prospective purchasers over the age of forty should be buying this wine for their children. 92 WA

Showing classic la Chapelle smoked meats, currants, wood smoke and chocolate, this beauty hits the palate with no hard edges, a blockbuster texture and a finish that just won't quit. It shows the slightly more masculine, austere edge of the vintage, but the tannin is beautifully sweet and it packs a serious amount of fruit in the mid-palate. Still inky colored and ruby at the rim, it offers an absolutely profound bouquet of sweet cassis, smoked meats, chocolate, licorice and spice. This is followed by a full-bodied, insanely textured, pure and hedonistic palate that has that perfect mix of still-vibrant fruit and ample secondary nuances. Upon review of your list, our specialists will advise you on the best plan to proceed to meet your needs, including providing pre-sale estimates. We can also assist in determining the best manner of shipping your collection to our Toronto-based storage facility. Once onsite, we will inspect each bottle and catalogue accordingly. The complete auction catalogue will be made available as either a printed catalogue and/or digital catalogue posted online.

Conditions of Sale Fine Wine & Fine Spirits 1. Waddington’s conducts auctions of fine wine and rare spirits as agent for the Liquor Control Board of Ontario (the “LCBO”) and all such auctions are authorized by the LCBO. All auction sales shall be deemed to take place in Toronto, Ontario, Canada. 2. All purchasers of alcoholic beverages through an auction must be nineteen (19) years of age or older. Proof of age may be required prior to the transfer of any purchased goods, including, but not limited provision of photo identification. 3. All lots are sold “AS IS”. Any description issued by the auctioneer of an article to be sold is subject to variation to be posted or announced verbally in the auction room prior to the time of sale. While the auctioneer has endeavoured not to mislead in the description issued, and the utmost care is taken to ensure the correct cataloguing of each item, such descriptions are purely statements of opinion and are not intended to constitute a representation to the prospective purchasers and no warranty of the correctness of such description is made. No opportunity of inspection is offered prior to the time of sale. No sale will be set aside on account of lack of correspondence of the article with its description or its reproduction, if any, whether colour or black & white. Some lots are of an age and/ or nature which preclude their being in pristine condition and some catalogue descriptions make reference to damage and/or restoration. The lack of such a reference does not imply that a lot is free from defects nor does any reference to certain defects imply the absence of others. 4. Each lot sold is subject to a buyer’s premium of 20% of the successful bid price as part of the purchase price. 5. Unless exempted by law, the buyer is required to pay Harmonized Sales Tax on the total purchase price including the buyer’s premium. For international buyers, taxes are not applicable when purchases are shipped out of country. Items shipped out of Ontario, the buyer is required to pay taxes as per the tax status of that province, whether it HST or GST (Goods and Services Tax). Purchasers are solely responsible for ensuring that they comply with all laws or regulations in relation to international shipping or the import of alcohol, including, but not limited to the payment of customs charges and duties.

6. The auctioneer reserves the right to withdraw any lot from sale at any time, to divide any lot or to combine any two or more lots at his sole discretion, all without notice. 7. The auctioneer has the right to refuse any bid and to advance the bidding at his absolute discretion. The auctioneer reserves the right not to accept and not to reject any bid. Without limitation, any bid which is not commensurate with the value of the article offered, or which is merely a nominal or fractional advance over the previous bid, may not be recognized. 8. Each lot may be subject to an unpublished reserve which may be changed at any time by agreement between the auctioneer and the consignor. As previously agreed to as between the auctioneer and the consignor, the auctioneer may bid, or direct an employee to bid. In addition, the auctioneer may accept and submit absentee and telephone bids, to be executed by an employee of the auctioneer, pursuant to the instructions of prospective purchasers not in attendance at the sale. 9. The highest bidder accepted by the auctioneer for any lot shall be the buyer and such buyer shall forthwith assume full risk and responsibility for the lot and must comply with such other Conditions of Sale as may be applicable. If any dispute should arise between bidders the auctioneer shall have the absolute discretion to designate the buyer or, at his option, to withdraw any disputed lot from the sale, or to re-offer it at the same or a subsequent sale. The auctioneer’s decision in all cases shall be final. 10. The auctioneer will notify the successful buyer that they have won the bid. 11. The buyer shall pay for all lots within 48 hours from the date of the sale, after which a late charge of 2% per month on the total invoice may be incurred or the auctioneer, in his sole discretion, may cancel the sale. The buyer shall not become the owner of the lot until paid for in full. Items must be removed within 30 days from the date of sale, after which storage charges will be incurred at a rate of $4.00 per case per month.


12. Each lot purchased, unless the sale is cancelled as above, shall be held by the auctioneer at his premises or affiliated storage facility at the sole risk of the buyer until fully paid for and taken away. 13. Notwithstanding Section 3, if the buyer, prior to removal of a lot, makes arrangements satisfactory to the auctioneer for the inspection of such lot by a fully qualified person acceptable to the auctioneer to determine the genuineness or authenticity of the lot, to be carried out promptly following the sale of the lot, and if, but only if, within a period of 14 days following the sale a written opinion of such person is presented to the auctioneer to the effect that the lot is not genuine or authentic, accompanied by a written request by the buyer for rescission of the sale, then the sale of the lot will be rescinded and the sale price refunded to the buyer. 14. Payment for purchases must be by INTERAC direct debit (applicable to Canadian in-person clients only), certified cheque (not applicable to U.S. and international sales), travelers cheque, bank draft, electronic transfer (fee applies), and VISA or Mastercard (up to $25,000). 15. In the event of failure to pay for or remove articles within the time limit set out in Section 11, the auctioneer, without limitation of the rights of the consignor and the auctioneer against the buyer, may resell any of the articles affected, and in such case the original buyer shall be responsible to the auctioneer and the consignor for: a any deficiency in price between the re-sale amount and the amount to have been paid by the original buyer; b charges in relation to the storage of such articles in accordance with Section 11 until payment and removal by the subsequent buyer; and c the amount of commission which the auctioneer would have earned had payment been made in full by the original buyer.

16. It is the responsibility of the buyer to make all arrangements for insuring, packing and removing the Consigned Goods purchased and any assistance by the auctioneer or his servants, agents or contractors, in packing or removal shall be rendered as a courtesy and without any liability to them. 17. The auctioneer acts solely as agent for the consignor and makes no representation as to any attribute of, title to, or restriction affecting the articles consigned for sale. 18. The auctioneer reserves the right to refuse admission to the sale or to refuse to recognize any or all bids from any particular person or persons at any auction. 19. If you are a licensee licensed to sell liquor under the Liquor License Act and you purchase alcoholic beverages in an auction to resell pursuant to your license, you must provide Waddington’s with a copy of your license. 20. With respect to our collection of your personal information, you acknowledge the following: a

The personal information required is collected on behalf of the LCBO under the authority of Sections 3(1)(b), (n) and (o) and 3(2)(f) of the Liquor Control Act, for the purposes of controlling the purchase and sale of liquor by auction in Ontario.;

The collection of your personal information will be collected in compliance with the Freedom of Information and Protection of Privacy Act;

We may disclose information relating to the auction, including but not limited to your personal information, to the LCBO.

Consent to disclose your personal information to a third party for storage and certain fulfilment services, strictly limited to the minimum required to validate the pick up of purchased goods.
