VT state’s attorneys endorse Ted Kenney Saying it was time for a change in protecting the public, four current and former Vermont state’s attorneys endorsed Ted Kenney Monday afternoon in the primary contest for the Chittenden County State’s Attorney.

Current state’s attorneys James Hughes (Franklin County) and Douglas DiSabito (Grand Isle County), as well as former Chittenden County state’s attorneys Lauren Bowerman and Bob Simpson, issued a joint statement supporting Kenney in the Aug. 9 Democratic primary.

All four are Democrats.

It is unusual for sitting state’s attorneys to endorse a candidate in another county in a contested primary.

The group is familiar with the work of Kenney, who has been a lawyer for 30 years and served most recently as a divisional chief for the Vermont Attorney General’s Office. Kenney previously had a private law practice in Colchester.

Vermont Mittens and Outright Vermont have joined forces to raise money for local LGBTQ youth through a new donation effort amid a surge of laws targeting the community.

Vermont Mittens founder Jen Ellis — who earned national attention for crafting mittens worn by U.S. Sen. Bernie Sanders during President Joe Biden’s inauguration — promises to donate a portion of every sale of mittens to the Burlington LGBTQ advocacy nonprofit.

“I can’t wait to see how we can harness this partnership together for powerful human connection and social change,” said Ellis, an elementary school teacher and a member of the LGBTQ community.

More than half of the states in the U.S. lack laws protecting individuals from discrimination based on sexual orientation or gender identity, according to The Trevor Project, a nonprofit focusing on suicide prevention among LGBTQ people. The group also reports that 45 percent of LGBTQ youth have seriously considered suicide, a rate that’s higher among youth of color, and that one in five transgender and nonbinary youth tried to take their own life in the past year.

The partnership began June 1 and will last at least one year.

Vermont Mittens is a sister brand of Vermont Teddy Bear Company, which Ellis partnered with last year to mass produce her viral mittens.

Together, the organizations hope to bring national awareness to the importance of caring about marginalized, at-risk youth.

“People may think, ‘I don’t need this, or this is not for me’ and the truth of the matter is that it’s going to take us all to change the world that we’re living to benefit everybody,” Outright Vermont

executive director Dana Kaplan said.

Outright hopes to reach visitors of Vermont Teddy Bear Company who may be questioning their identity or gender and to let them and their loved ones know they are not alone, Kaplan said.

“We can spread Outright Vermont’s message, not just in Vermont, but outside of Vermont,” said Cassandra Clayton, brand creative design manager for Vermont Teddy Bear Company.

“Hopefully get people to think about how they can be allies of the LGBTQ community in their own regions and states.”

At least five candidates running for statewide office this year are members of the gay and transgender communities, including U.S. House candidate Becca Balint, Senate candidate Isaac EvansFrantz, gubernatorial candidate Brenda Siegel and state treasurer hopeful Mike Pieciak, all Democrats. U.S. Senate candidate Christina Nolan, a Republican, is also seeking office.

Siegel, who, like Pieciak, is running unopposed in the party’s primary, has said she wants to make Vermont a sanctuary state for people fleeing states with active and aggressive anti-LGBTQ laws.

She also wants to enshrine those rights in Vermont’s Constitution.

Republican Gov. Phil Scott, who is running for re-election, signed a bill last April prohibiting defendants at trial from citing a victim’s gender or sexual orientation as justification for violence.

Across the country, people charged with assaults and murders of LGBTQ people have used this strategy to win acquittal in court.

This April, Scott also signed a bill streamlining the process for people to change the gender identity on their birth certificates. The law was championed by Rep. Taylor Small, P/D-Winooski, Vermont’s first openly transgender state representative, and allows Vermonters to

continued from page 1 bond to fund a new facility after the town two years earlier received a discharge permit requiring it to reduce the amount of phosphorus and ammonia in its discharges into the LaPlatte River.

Nearly $6.3 million of the bond was forgiven through a “a mix of federal and state grants,” Lovell said. The remaining debt is being financed over 30 years, and the town is expected to pay $33,333 for the first phase of the loan installments.

The new rates are “designed so that current users are only covering 50 percent of the expected $33,333 treatment facility phase I loan payment in fiscal year 2023,” Lovell said. “The other 50 percent of the loan payment will be covered by connection and allocation fees collected from new users.”

Selectboard members during their meeting said that, as more development projects begin to come online in the village, that fixed cost will be spread out among new customers.

There are currently 650 users on the wastewater system. Lovell said that if the “approximately 400 new units planned to be added to the system come to fruition, that would reduce an individual users share of the loan by 40 percent once all of those units were connected.”

Nonetheless, rates are expected to continue climbing in the next several years. The town will have to pay annual loan payments of $182,033 once the construction of the plant is complete in either 2025 or 2026, town manager Todd Odit said.

“Back when they were discussing the wastewater treatment plant upgrade, users were told to expect about a $360 to $400 annual increase, once all of the debt was on the books and needed to be paid for,” Odit said. “With the proposed increases here, residential customers are looking at an annual increase of $120 to $145, so combined with water, they’re looking at a $150 to $175 increase annually.”

Leaving the wastewater fees unchanged would leave the overall water and wastewater budget with “a deficit of about $60,000,” Odit said. “That’s obviously not a good position to be in.”

“Had the town started to increase the rates more gradually years ago, it wouldn’t have been more pronounced now, but that’s not where we are,” he said.

The new facility, once it’s completed, will reduce phosphorus and ammonia discharge levels, and will also allow the facility to make increased treatment capacity possible, improve water quality and make the building more energy efficient, officials said.

Shelburne’s Fisher wins second race in July Shelburne’s Kaiden Fisher did it again for the second time this month, winning the Flying Tigers race at Thunder Road at the Times Argus Midseason Championships night July 21.

The rookie quickly overtook the field in the 50-lap race.

Fisher’s outside had a whole lot of Cameron Ouellette. While Fisher powered away, Ouellette didn’t give in, staying within a car length.

By lap 40, a new character arrived on the scene as Sam Caron charged hard on the outside to overtake Ouellette for second. As the final laps clicked away, Caron

gained inches in each corner, but Fisher held his own.

Caron got to within one foot of Fisher’s rear bumper in the trip around the high banks, but it still wasn’t enough as Fisher took down his second win of his rookie season in the Lenny’s Shoe & Apparel Flying Tigers followed by

Milton’s Caron and Barre’s Ouellette.

Derrick Calkins of Hinesburg finished 15th.

In other race action that night Cooper Bouchard of Hinesburg placed fifth in the Late Models and Michael Gay of South Burlington was 16th in the Street Stocks.

dates’ positions, the American Civil Liberties Union of Vermont invited each candidate to answer 15 questions on issues impacting local communities — everything from police misconduct and the opioid crisis to racial disparities and mass incarceration.

Out of seventeen candidates, only seven responded to the survey: Eva P. Vekos and Tim Lueders (Addison County); Sarah George (Chittenden County); John Lavoie and Zach Weight (Franklin County); Todd A. Shove (Lamoille County); and Michelle Donnelly (Washington County).

The remaining candidates refused repeated invitations to respond over a three-week period — underscoring the lack of transparency and accountability common among many prosecutors’ offices.

The good news is that, for many survey questions, the

responding candidates aligned with the viewpoints of a majority of Vermonters. All seven respondents pledged to hold traffic fine forgiveness and criminal record expungement clinics within their first year in office. Six of seven candidates agreed to publish policies and data on their office’s actions and would decline to prosecute minors for low-level offenses. Five of seven supported opening overdose prevention sites and other mobile services and agreed to implement Brady lists to track dishonest and biased police.

All that is encouraging, particularly because in recent months some public officials have promoted false narratives about public safety to stoke fear and justify a return to failed tough on crime policies.

It is important to recognize that these blasts from the past

— built upon racist tropes, the criminalization of poverty and an over-reliance on incarceration — aren’t what Vermonters want. We want solutions to issues such as discriminatory policing, record overdose deaths and chronic underfunding of mental health services — not more punishment.

Voters should expect their state’s attorney candidates to reflect their values, and to be transparent about whether they support a smarter justice system that invests in people over prisons. If your candidate refused to respond to our survey, use your voice and ask them directly if they want to maintain the failed policies of the past or move Vermont closer to a more just, equitable, and holistic public safety system.

Letters to the Editor Why Phil Pouech won’t get my vote To the Editor: I am interested in having an actual leader be our representative and unfortunately, I have not seen Phil Pouech be able to show leadership skills in the last couple of years.

When Hinesburg was considering a town mask mandate, he said, “People that are not masking up are not listening to the science

nor do I think they are being particularly good neighbors, but I just don’t want to enforce or make local businesses enforce a mask mandate.”

That is a pretty good example of not displaying leadership skills.

I want my representative to take a stand on issues and lead. Pouech apparently thought that masking was a good idea but didn’t want to lead the town in that direction even though he believed it was the right thing to do.

Why is that? Is that leadership?

Where has his leadership been with all the mass shootings of late? Have you heard anything or read any statement by him? I sure haven’t.

Where has Phil’s leadership been when the right to choose has been taken away (and will continue to be taken away) for so many women across our country? Have you heard anything or read any statement by Phil? I sure haven’t.

(He finally addressed the issue last week when The Citizen posed the question of where he stands on abortion rights and Prop 5, almost a month after the Supreme Court ruling on Roe v. Wade.)

It seems to me that he would just like to sit back quietly and rest his case on that fact that he has been a selectboard member to prove he is qualified to be our representative instead of putting his neck out and taking a stand. I’m guessing his strategy is to not offend as many as possible in hopes of a primary victory.

That isn’t the type of leadership I am interested in. How about you?

I may not agree with everything that Christina Deeley has stated, but I can tell you she has made her beliefs known and isn’t afraid to take a stand and lead Hinesburg in a better direction.

Charity Clark is the right person to tackle the high-stakes issues that the attorney general will be facing, including reproductive freedom, climate change and privacy rights. And Clark is the most qualified candidate in the race, without a doubt.

She has served for the last eight years in the attorney general’s office, both as an assistant attorney general and most recently as chief of staff. The Vermont Attorney General’s Office is also the last statewide office to have never elected a woman. It is

I see an America deeply dissatisfied with the way things are going. The New York Times reports that only 13 percent of voters say the country is on the right path. There is a generational turnover coming in political leadership. The Boomer generation is about to retire, thus requiring new leaders. There

is a strong hunger for change that demands unconventional outsiders, and the further outside the better.

Mudge is steeped in management and financial experience that will bring value to our state. His true love is field research as a tool for deep understanding of important issues and impacts on human life. He is a man who espouses the best of democratic principles. He wants to fight to keep our county green as it grows; he is committed to open spaces and access to nature; he wants families with young kids to have a helping hand with child care; he is committed to affordable housing for those most in need in Chittenden County; and, most important, he will take a genuine sense of community to Montpelier.

If ever there was a moment ripe for Lewis Mudge in the Vermont Senate, this is that moment.

Brick houses, and their connection to glacial age Connect the Dots Jane Dorney When the invitation came to visit an old brick farmhouse nearby, I jumped at the chance. The owners walked us around their home and passed along its stories. One wall section had been removed because of water damage, and the bricks had been saved in a shed out back. Looking through the old bricks, I could see they were basically the same size, shape and heft as modern bricks, but no two bricks were exactly alike.

When I found one with finger impressions baked in, I knew they Jane Dorney were truly handmade.

Once I delved into the bricks’ stories, I also found that they were deeply knit into the story of the landscape.

The bricks dated to the early 1800s and were made of local clay from a low area just down the road, now a cornfield. I visited the site and could feel the clay’s plasticity while kneading some soil in my hands. To one side was a square-sided pit where some of the clay had been harvested. The kiln had also been nearby, and the small brick fragments scattered through the cornfield were its tangible evidence more than 150 years later.

In that era, bricks were made by hand using wooden molds. The clay was laboriously mixed and kneaded, then handpressed into molds and the excess scraped off with a flat, wet stick. They were then knocked out of the molds and set to dry for days. They were turned regularly to promote even drying and discourage bending. Once dry, they were built into a kiln shape and wood-fired in a carefully monitored process. When finished, the best ones were used for house exteriors, and the others in less critical areas.

The bricks in the shed were idiosyncratic. Some had small, embedded pebbles, not unlike the cornfield’s soil. Some had pitted surfaces, or were curved, probably from the molding and drying process. Some had shallow, parallel grooves along the tops, probably from the wet stick scraping off the excess clay. The fingerprints were from handling it while still wet. These brick details were witnesses to the many hands and multiple steps involved in their creation.

Each brick weighed 4 to 5 pounds, and with the thousands needed to build a house, the total weight of bricks moved from kiln to house site was measured in tons. In these pre-railroad days, newly finished bricks traveled by horse- or oxen-drawn wagon to house sites. It’s not surprising that most

were built very near the clay source.

After this visit, I watched for old brick houses in my journeys, and read any stories I could find. Many Champlain Valley towns have 10 to 20 brick farmhouses from this era, and there are many mentions of using local clay from near the house site.

After mapping them, I noticed that most of the old brick houses are at 600 feet in elevation or below. We have the glaciers to thank for this. Not only did the glaciers generate huge volumes of clay and other particles as they scraped over rock faces, but they also moved huge quantities of these particles in their meltwater.

In the last glacial stages 13,500 years ago, glacial Lake Vermont was formed when an ice dam plugged the Champlain Valley’s northern end. The ice dam held back the melted glacial water that normally drained north and filled the basin to about 600 feet in elevation for about 1,500 years.

All of Lake Vermont’s tributaries brought meltwater filled with sediments from the glacier-scraped hillsides.

After the ice dam failed, the lake level dropped, and was partly replaced by saltwater flooding to about 300-feet in elevation. The Champlain Sea, as it was called, lasted 2,000 years, and very heavy clay deposits accumulated during its time. The Champlain Valley below 600 feet, then, had mostly clay-rich soils dating to these two different stages of the glacier’s melting.

The valley’s glacial history set the stage for the old brick houses, but it also brought other related landscape features. Because the clay makes very rich farming soil, farms were established early and are still very productive. With few stones in the soil, no

stone walls were built around the fields.

Instead, early farmers brought in non-native black locust trees to use for fencing, and many of the old brick farmhouses have black locust trees nearby. (“Black locust trees have ties to origins of local farming,” Connect the dots, Shelburne News, Jan. 21, 2021) The lack of stone walls has also made it easier to consolidate the smaller farm fields of 5 to 10 acres to the much larger sizes today. These features work together to make

a distinctive clay valley farming landscape, anchored by the brick houses.

Now, every handmade brick house I see reminds me of the warm hands that shaped the clay into brick, as well as the ice-cold water that deposited that clay.

Citizen legislators should be adequately rewarded for their work. Earning a living as a legislator should not be the goal. A pay increase and a health care safety net for legislators can begin after a full analysis. It is important anyone can run for the Legislature — not simply those with resources.

The governor signed the Legislature’s new education formula into law, which could mean some school districts like Champlain Valley School District and South Burlington School District will have to face tough financial choices in coming years. How would you explain to a voter/taxpayer your support or opposition to this measure?

Weighting factors for school funding haven’t changed in 30 years. The Legislature’s choice was either to ignore increased costs for English as a Second

Language learners or ensure equitable access to education. I support the latter. Overall, our educational system will benefit, as will new Americans.

What is an issue that you think has been overlooked or needs more attention in broader state-wide discourse?

Emergency service providers are worn out by COVID-19.

We need to help mental health and substance use counselors and emergency response services, locally and statewide. In addition, removal of toxic chemicals from consumer products protects public health.

Continuity is important for the Senate, when a third of the senators are leaving. I will provide stability to the Senate next session. I will also bring a scientific perspective for decision making. Data informed decisions ensure that working people have access to child care, Vermonters’ reproductive rights are protected, the health care economy is stabilized, renewable energy economy and transportation infrastructure expand, systemic reform addresses racial or other disparities, rural economies prosper, and people are food secure. I enjoy working with diverse people and ideas. My long-term record demonstrates my success.
