Background
More than gender binary system: Sexualityandgenderdiversity

ISSUE OFGENDER BINARY

In this binary model, sex, gender, and sexuality may be assumed by default to align, with aspects of one's gender inherently linked to one's genetic or gamete-based sex, or with one's sex assigned at birth. [1]

These aspects may include expectations of: dressing, behavior, sexual orientation, names or pronouns.

These expectations may reinforce negative attitudes, bias, and discrimination towards people who display expressions of gender variance. [2]

LGBTQ + POPULATIONS

Modern scholars and scientists generally agree that the number of homosexuals accounts for about 6-10%of the overall population.

The number of homosexuals in Hong Kong is estimated to be around 600,000-700,000. [3]

Transgender people generally make up about 0.3% of the adult population.

Based on the latest Census and Statistics Department figures for the population aged 15 and over, it is estimated that there are nearly 20,000 transgender people in Hong Kong.[4]

MENTAL HEALTH OF LGBTQ+

Discrimination and homophobic culture

The psychological distress of "I am different from ordinary people"

Fear of losing relationships[5]

THE ISSUE OF LGBTQ+ COMMUNITY IN HONG KONG

Hong Kong still lacks an environment that is fully tolerant of sexual minorities.

There is no law to protect the discriminant of sexual orientation.

IDENTITY ISSUES

--Hong Kong court denies male status to 3 transgender men.

In 2019,Hong Kong’s High Court refused to allow three transgender men to be recognized as males on their official identity cards because they have not undergone full sex-change operations.

Amnesty International called the judgment “a missed opportunity to address the discrimination transgender people in Hong Kong face.”

“No one should be forced to undergo gender affirming surgery in order to have their gender legally recognized,” Man-kei Tam, director of Amnesty International Hong Kong, said in a statement.[6]

DIFFICULTIES IN DAILY LIFE

--Transgendered women banned from Telford Plaza’s 6ixty8ight fitting room: Female customers only.

The complainant,Ms. Hui, said she tried on a sports bra at the 6ixty8ight branch in Telford Plaza last month, but was refused by the shop assistant because of her male voice. The assistant said that only female customers were allowed to try it on. She showed the clerk her ID card to clarify her gender, indicating that she had undergone sex reassignment surgery, but the store still refused to recognize her as a woman.

Ms. Hui questioned the assistant’s differential treatment. The assistant that the company had instructed that only female customers would be allowed to try themselves on. Ms. Hui asked the assistant to explain the definition of “Female”. The assistant pointed obliquely at other customers and staff, she thinks all of them are women, but doesn’t agree Ms.Hui is one of them.[7]

-- When transgender people use traditional public toilets, it is often inconvenient to choose between men’s or women’s.

Brenda,a trans woman, said she was evicted from the shopping centre's ladies’toilet and her identity card and telephone number were searched, leaving her traumatized.[8]

DIFFICULTIES IN DAILY LIFE

Siufung Law,a trans man, said he pointed out that he did not intend to have sex change surgery, and legally could not use the men’s toilet, but using the women’s toilet would be treated unkindly, so he usually did not drink water when he went out in the past and avoided going to the toilet.

he said he can not use the men’s changing rooms and he didn't want to put himself in a place where he could be subjected to violence, because that could lead to physical violence or sexual harassment.

But in his experience of using the women’s locker room, he has been pointed at and verbally abused in public, suddenly pulled back from the shower curtain, questioned, complained about and even reported to the police.[9]
