JULY 3, 2018 AT CLIFF’S AUTO IN MADRAS, OREGON AMOUNT OF TRANSACTION: $639.99 AMOUNT DISPUTED: $200 ATTEMPTS TO RESOLVE: THEY (MR CLIFF & ASSOCIATIONS AT CLIFF’S AUTO REPAIR) KNOW THE TRUTH, but ARE NOT BEING HONEST TO ME NOR TO CAPITAL ONE. THEY CAN VOLUNTARILY REFUND ME $200; OR IF THEY PERSIST IN THEIR DISHONESTY, I ASK CAPITAL ONE TO USE THEIR AUTHORITY TO MAKE THE CORRECTION BASED ON THE INFORMATION & EVIDENCE DISCUSSED BELOW. COMPOSED ON 8/10/18 SHORT VERSION: On July 3, 2018, I was stuck a traffic jam due to a wildfire detour when MY 2006 FORD FREESTAR VAN (3.9L) BROKE DOWN in a remote area north of Madras Oregon. All I thought was a broken serpentine belt. I was stuck 4

overnight until I got a tow truck the next morning which took me to Cliff’s Auto in Madras. The owner or operator (I still do not know his name. Maybe Cliff or Mr. Cliff? ) diagnosed the primary problem as a bad water pump and offered to replace it and the serpentine belt for $429, which he wrote by hand on a pink paper and showed it to me and asked me if this was okay.

The pink paper with the original estimate was NOT provided to me for my records. Mr Cliff said it would be done by noon. He offered no place to wait at the shop and suggested I walk into town, and he would call me when it is ready.

I received NO CALL NOR TEXT the entire day, and when I checked in was provided NO STATUS UPDATES NOR FURTHER INFORMATION. Finally around 4pm I returned again to the shop, and they had changed the final price to $639.99 , ONLY justifying it by saying it was a “LOT OF WORK” . Why did I pay this amount if I did 5

NOT AGREE TO IT ? READ SECTION #6 BELOW. The original price offered differed from the final price demanded by over $200 dollars without justification. Also they may have inflated the price of the parts they used and/or used the highest priced parts without asking me for my preference (see more below) .

Finally, their final labor amount is also far above the average cost for such a job. If they had given me an original estimate of $639.99 as falsely claimed on their invoice, I would have GONE SOMEWHERE ELSE despite the inconvenience of perhaps having to remain overnight for a day or two.

LONG VERSION: 1) BACKGROUND/ CONTEXT: Being a Christian Evangelist (BA/BA/M.Div) , every summer I take a “mission trip� to different parts of the country. Last summer (2017) I traveled by vehicle from California to Key West. The 6

previous summer (2016) I traveled by vehicle to the Midwest Chicago area. And the list goes on, including mission trips to the Philippines, and other parts of the world.

This year (2018) due to a family event in Northwest Washington this summer, and for the purpose of Christian mission, as well as exploring other parts of beautiful America, & contemplating a re-location of my ministry base, I drove from southern California in my 2006 Ford Freestar van (3.9L) (vin # 2FTZA54646BA64176 ) thru northern California, Oregon, & Washington, & a little bit of Nevada near Tahoe/Reno, and enjoyed many famous hikes along the way, including Yosemite, as well as the Oregon Coast, also around North Bend Washington & the Mt Baker area, and later returned south through the Cascade Loop and then the Mt Hood area, while also engaging in Christian evangelism, as best as I can, and according to the receptivity of others.

All of this of course requires gas and other expenses, not to mention lodging, etc along the way. I DO have a budget and try to be frugal, but always honest, and never compromising integrity, and enduring some hardships along the way to try to remain on budget.

1A) DIRECT ROUTE TO BEND OREGON CLOSED DUE TO WILDFIRE IN WARM SPRINGS. DURING DETOUR TRAFFIC JAM IN A REMOTE AREA, THE SERPENTINE BELT ON MY VEHICLE SNAPS. I SPEND THE NIGHT IN MY VEHICLE . On July 2, after leaving the Tamanawas waterfall hike near Mt Hood I headed southward with the intention of reaching Bend Oregon (via highway 35 & highway 26). However, when I reached the junction of highway 26 & highway 216 I discovered highway 26 was closed due to a wildfire in the Warm Springs area. The sign indicated the only option to continue south was to go east on highway 216 towards Maupin and 8

then southward on highway 197 & 97 which goes thru Madras towards Bend.

So I continued on the detour route but around the junction of 97 & 293 (near Willowdale) there was an ENOURMOUS TRAFFIC JAM going southward. The traffic was barely moving. As I sat in traffic, suddenly I heard and felt a jolt , and I knew something had happened to my engine.

Fortunately, I was adjacent to a pullout and was able to roll over to it despite now having no acceleration ability. I turned off the engine , opened the hood , and immediately noticed the serpentine belt had snapped. Unfortunately, at the moment I was also unable to get any phone connection. The sun was setting. The traffic jam continued right next to me. I climbed in the back of the van for the time being and fell asleep in my vehicle for the night.

1B) MY ROAD SERVICE MANAGES TO CONTACT A TOW TRUCK FOR ME THE 9

NEXT MORNING The next morning (July 3) I awoke and was able to get a roaming phone connection, and contacted my road service and eventually a tow truck arrived and a nice young man took me to Madras. My towing service had recommended I go to “Sandy’s Auto Repair” but the tow driver said that Sandy’s was no longer in business.

I asked him if he had any recommendations and he said “Maybe Cliff’s can do it, I’ll give them a call…” So as we were driving he called Cliff’s and thinking the repair was just a serpentine belt, the owner or operator of Cliff’s auto said he could do it (whom I will refer to as “Mr Cliff” assuming his first or last name is Cliff, but I do not know for sure) 2) ARRIVING AT CLIFF’S AUTO IN MADRAS, OREGON VIA TOW TRUCK: A few moments later we arrived at Cliff’s Auto, and Mr Cliff came out, and said “A broken serpentine belt usually indicates other problems” or something 10

like that. SO FAR SO GOOD, HE WAS RIGHT ABOUT THAT. He looked and immediately diagnosed it as a bad water pump. At the same time he became more and more boisterous about “how busy” they are, and kept talking aloud wondering if he could get the job done today (July 3) or not. I stood there waiting for him to make a decision, and noticed he had three or four young men also working at the shop. He kept telling me how busy they were, although I didn’t necessarily notice a lot of activity , so I was NOT sure if he was “posturing” or whether he was being totally sincere.

I wondered if he was trying to “hustle” me or if he was an honest merchant trying to decide if they could do the job in a timely manner or not.

By this time the tow truck driver had left, so if I was going to go anywhere else it would require another tow service.

3) re THE ORIGINAL QUOTE OF $429 WHICH CLIFF’S AUTO FALSELY OMITTED FROM THE INVOICE THEY SUBMITED TO CAPITAL ONE (see images at bottom).

Eventually, Mr. Cliff said aloud to himself or me “Nobody else in town can do this today” … and seemed to suggest that he would TRY to get it done mostly out of the goodness of his heart , otherwise I would be stuck in town over the holiday (the next day was Independence Day, nobody would be open).

Once again, I was wondering if he was “posturing” and planning on trying to “hustle me” or if he was being totally sincere. He went back into his office and he or his assistant looked up the time & parts required, and came out with a pink paper indicating the job would cost around $429 dollars. He held the pink paper with the number $429 hand-scrawled on it, and said, “IS THIS OKAY?” That was a LOT OF MONEY but given my years of travel and auto repair 12

experiences , now at the age of 51, I believed it to maybe be a bit above average price, but I accepted THE $429 PRICE AS IS. I said “OKAY” to this price.

4) NOT ALLOWED TO WAIT IN THE WAITING ROOM (OR THEY DIDN’T HAVE ONE) AND WAITING FOR THE REPAIR TO BE COMPLETED, EXPECTING A CALL OR TEXT THAT NEVER CAME So Mr. Cliff & his employees pushed my van into the garage, at the same time he said, “We should be DONE around noon”…and suggested I walk into “town” and he would call me when it is ready.”

I wanted them to do a good job and said “I’m not in a hurry” to which Cliff snapped, “But we are…” I had NOT SLEPT WELL as you can imagine and was a bit tired, and might have preferred to sit in the waiting room for a while, but apparently there was NO WAITING ROOM..or he didn’t want me to wait around.

This made me feel a bit uncomfortable, but I walked into town and went to a McDonalds for a while, and then over to the local library. Around noon I had NOT heard from Mr. Cliff and so I walked back to the shop and nobody was there EXCEPT Mr. Cliff.

He said that all the employees were “out to lunch� and gave me no further information about the status of my vehicle. He did NOT offer a place to sit down in the office or any hospitality, so I walked back to town, and just sat at a park for a while, and then went to Taco Bell for another hour or so.

I still received NO PHONE CALL NOR TEXT indicating that there was any reason for it taking longer than he had initially indicated. Then around 3 pm I walked back to the shop and sat on a wall outside and Mr Cliff ignored my presence. I really had NO IDEA if they were still actually working on my van or not.

If they had found additional problems that REQUIRED MY APPROVAL to fix or at least that I should be INFORMED ABOUT , Mr. Cliff indicated nothing as I sat there, NOR by phone or text. NOR DID I OBSERVE ANY OTHER CUSTOMERS WAITING FOR THEIR VEHICLES. If they did have other vehicles they were working on, one can safely assume they were for local people or businesses who did not have an urgent repair need as I did. Nonetheless, I was being respectfully patient , and wanted to GIVE THEM THE BENEFIT of the DOUBT assuming they would inform me of anything out-of-the-ordinary.

And since Mr. Cliff insinuated he was doing the job as a FAVOR to me even though he was very busy, I also wanted to BE RESPECTFULLY APPRECIATIVE and give them the time and space they needed to finish my job as well as the other alleged work they had to complete.

4) RETURNING TO THE SHOP TO PICK UP MY VEHICLE ASSUMING IT IS READY, BUT STILL NO CALL OR TEXT FROM MR. CLIFF So I took a hike up to the viewpoint nearby and spent another hour or so allowing time to pass.

Finally around 4 or 430 pm I felt I HAD to interrupt and check the status of the work on my vehicle. As I walked back up to the garage I noticed one of their workers, a tall fellow, saw me coming and suddenly turned quickly around about as if he wanted to warn Mr. Cliff that I was returning.

In the next few moments they either PUT ON AN ACT that they JUST FINISHED the JOB, or it honestly took them ALL DAY to do the work (albeit I assumed they were simultaneously working on the other alleged busy work they had to complete as well).

NEEDLESS TO SAY, Just because the vehicle was in the shop ALL DAY does NOT mean they 16

were WORKING ON IT ALL DAY. I WAS NOT BORN YESTERDAY. Once again, they never informed me face-to-face nor by text or phone or any other means that there were ANY ALLEGED complicating factors.

Nonetheless, Mr. Cliff at this time began repeating that it took a ‘LOT OF WORK” to do the job. I began to feel like I was being HUSTLED AGAIN. After Mr Cliff & then also the guy behind the desk repeatedly told me that it was a “LOT OF WORK”, Mr Cliff quietly said , “So we had to add a bit to the final cost…” I had a bad premonition that this was coming, and rolled my eyes waiting for the additional amount they were adding because it was a “LOT OF WORK” , as if I was a millionaire who could pay WHATEVER. By this time, all of the guys in the shop were standing around me apparently trying to intimidate me. I had NOT slept much last night.

I had walked around all day. I was tired. I wanted to get going. They knew this as well. They knew I was traveling. They saw my out-of-state plate.

5) UPON RETURN, MR CLIFF & ASSOCIATES REPEAT THAT IT WAS A “LOT OF WORK” AND THEREFORE THE FINAL COST IS NOW MUCH HIGHER. $429 dollars was ALREADY A LOT TO PAY for such a job.

Then Mr. Cliff told me it WAS NOW $639 DOLLARS !! I groaned. I knew I was being SCAMMED. I could NOT BELIEVE IT ! I had a QUEASY FEELING this was going to happen, but was HOPING AGAINST HOPE that it wouldn’t. I did NOT BELIEVE it . I still do NOT BELIEVE IT. I am in denial, but it’s true.

They had told me $429 and NEVER INFORMED about any complications during the day. They had NOT COMMUNICATED with me at all the entire day. NOR did they take any photographs of the ALLEGED COMPLICATIONS which mentions in writing on the invoice something 18

about “coolant pipe frozen in water pump…” and “ had to remove harmonic balancer to perform repair. “ (later I looked this up and found a video entitled “ HOW TO REMOVE ANY HARMONIC BALANCE IN 5 MINUTES OR LESS” 6) ANALYZING MY OPTIONS IN A MATTER OF SECONDS : Now I am standing there NOT SURE what might happen IF IF REFUSE TO PAY THE EXTRA AMOUNT. I knew they could SABOTAGE MY VEHICLE (I’ve heard stories) , or they could even call the police I suppose, and make up a story that would get me in trouble if I refused to pay the extra amount (OR I COULD CALL the police on them, but they typically would NOT handle something such as this , calling it a “civil matter”. Thus, at the moment, if they chose to be UNSCRUPULOUS, they had the UPPER HAND. ) I FELT VERY UNCOMFORTABLE, even under illegitimate duress given all that had transpired and what I had observed during the day, as 19

mentioned above. ALL of this went through my head in a matter of moments, and then I said, “OK” , DESPITE FEELING LIKE THEY WERE ROBBING ME. They were TWISTING MY ARM , SO TO SPEAK. I knew NO ALTERNATIVE AT THE MOMENT BUT TO PAY & MAKE A CASE LATER. PAYING THE HIGHER PRICE DESPITE KNOWING I WAS BEING SCAMMED . SO I TOOK A DEEP BREATH, PULLED OUT MY CREDIT CARD, all the while feeling I was being SCAMMED. I have NEVER in my 51 YEARS Of living had an auto repair experience where there were alleged complications & the original price was increased without being informed DURING the WORK and without my approval. It was UNCONSCIONABLE !

7) LATER, I CONFIRMED MY SUSPICIONS ABOUT BEING SCAMMED . I took it upon myself to double-check the prices of the parts and also called and asked other auto repair places for their estimate to do the work. When I add up the total of the parts that Mr. Cliff used it comes to 20

approximately $300 ($295.13 + $4.80 for “hazardous waste”) .

However, I called various auto parts stores in Madras (including O’Reilly’s , Car Quest, NAPA, & Chappy’s) and asked for individual prices for each part . Cliff’s water pump allegedly cost $128 . The highest of the above-referenced other parts stores in Madras charged $88 for a pump with a lifetime warranty (O’reilly , ph#541-475-2190).

If, in fact, Cliff’s used the higher-priced OEM water pump, once again, he did NOT give me the option as the paying customer to make the choice ! And Josh (the guy behind the desk) mentioned that he got the water pump from one of the local auto parts stores (which one I do not recall, but none of the above four mentioned Madras auto parts stores offered me the option of the higher-priced supposedly superior OEM water pump) .

Cliff’s charged me $64 for a Tensioner Assembly, but when I called the four above-mentioned auto parts stores in Madras, the highest price tensioner assembly was $44 . Once again, why am I being charged $20 more for a part that is $44 across-the-board at these nearby auto parts stores, actually even as low as $39 dollars at NAPA (ph# 541-475-7214). I also called a local AutoZone near me later & received the same approximate lower prices than that which Cliffs charged. If I used the lower-priced items including the $88 waterpump with lifetime warranty the parts price total ranges from as LOW AS $169 to AT MOST, only $203 dollars ($100 less than Cliffs) .

NEXT, CLIFF’S AUTO charged me an ASTRONOMICAL $340 DOLLARS for labor, which the Capital One arbitrators can see for themselves on the invoice. But when I called other nearby MADRAS AUTO REPAIR SHOPS I received the following quotes: 22

A) Tyson’s Auto repair quoted $225 for labor (ph# 541-460-5083) B) Cisco’s auto repair quoted $150 for labor (ph#541-815-4047) C) An independent auto repair guy (Zach Weaver) recommended by an auto parts clerk quoted a price of $212 for labor (ph#541-4600072) .

If you take any of the three above-mentioned labor quotes by the auto repair stores also in Madras and add them to the lower-priced parts (as mentioned range from $169 to $203) , the final price ranges from $319 at the lower level to $428 at the higher level.

IF removing the “harmonic balancer” can be done as quickly as 5 minutes (see youtube video at https://www.youtube.com/watch?v=_8yjWElx3c0&t=3s ) this would NOT justify any increase in labor cost. As for the COOLANT PIPE allegedly being “frozen in the water pump” , I don’t find any “tutorials” about such complications online. If their using the word “frozen” as a synonym for “stuck” , it 23

STILL does NOT seem to legitimize a $200 dollar increase in labor cost.

There are ALWAYS SMALL complications that every decent mechanic knows how to handle with a few improvizations in a matter of minutes , NOT HOURS ! I worked at a radiator repair shop when I was a young man .

I observed and know that all decent mechanics are able to improvise and have “workarounds” for almost every situation. Even if the mechanics at Cliff’s Auto are younger and perhaps less experienced, and therefore did not have the prior knowledge or experience to handle new “complications” in a speedy manner, this sort of “learning on the job” should not be passed on to the customer as an “extra cost”, especially to the amount of $200 dollars .

Every vehicle repair job comes with it’s own unique difficulties as well as unique conveniences. Do you imagine that CLIFF’S ever gives a customer a LOWER PRICE if the job turns out to be easier & shorter than they 24

anticipated. Nonetheless, the two ALLEGED COMPLICATIONS do NOT LEGITIMIZE A $200 INCREASE in labor. Based on ALL of the above, I CONTEND that Cliff’s Auto treated me dishonestly, and SOLELY FOR THE SAKE OF EXTRA PROFIT. I ACCEPTED a quote of $429 from Cliff’s at the start of the day. In the LOWER LEFT-HAND CORNER of the “invoice” provided to Capital One by Cliff’s Auto THEY FALSELY CLAIM that the “original estimate” was $639.99 . This is ABSOLUTELY FALSE. If they had given me an ORIGINAL ESTIMATE of $639 I would have called another tow truck, and even waited another day or two to get a FAIR & HONEST PRICE. 7A) CLIFF’S DID NOT EVEN DO DUE DILIGENCE IN TERMS OF INVOICE DATA ALL in all, just looking at the final invoice (which is NOT the original quote that was on pink paper) one can also see that they did NOT even 25

do DUE DILIGENCE in terms of entering the odometer mileage, NOR the VIN # , NOR even the license plate number. My guess, based on my observations during the day is that at some point they decided to STRETCH OUT THE REPAIR JOB to SEEM LIKE it took all day, when it actually probably did NOT. 7B) AUTO REPAIR “ESTIMATORS” SUCH AS CONSUMER REPORTS INDICATE CLIFF’S FINAL PRICE OF $639.99 WAS EXCESSIVE Also, on one of many auto repair job “estimators” , Consumer Reports (SEE https://www.consumerreports.org/cars/repair/ ) indicates that replacement of a waterpump for a 2006 Ford Freestar should cost between $372$489 total. It itemizes labor as being between $221-282, and parts between $151-207 . Cliffs charged me $340 for labor , and $300 for parts , approximately $150 more than the highest estimate, and approximately $270 more than the lowest estimate, and once again $211 higher than 26

their original estimate, which they FALSELY & DISHONESTLY OMIT from the invoice they provided to CapitalOne .

And in reference to my quotes above from the other auto repair shops in Madras , when I asked for their estimates I included the need for serpentine belt & tensioner assembly, which did NOT seem to add much (in terms of labor) to their final price.

(AAA estimator comes to $387.13 - $566.12 ) NAPA estimator also comes to $372 - $489) Another estimator which includes the serpentine belt comes to $422.87 (see https://www.yourmechanic.com/estimates ) Based on local quotes from other mechanics as well as these online estimators , EVERYTHING INDICATES A FAIR PRICE OF ABOUT $400 TO THE VERY MOST, $500 . Cliff’s surpasses this by $140 to $240 dollars , which may NOT BE MUCH for a millionaire but for a Christian evangelist on a budget, it is a substantial amount.

Furthermore, Madras Oregon has a median income of $40,000 (see https://www.bestplaces.net/economy/city/oregon/ madras , and therefore slight or moderate regional auto repair differences based on socioeconomics would usually indicate an average or slightly below-average price, rather than excessively above-average. This is why the online estimators also ask for zip code .

That is to say, if I was in San Franciso, one of the highest cost-of-living regions in the country (around $78,000 ) , one would expect an aboveaverage cost because the auto repair shop has above-average costs of rent, wages, etc. Thus, for example, while the NAPA auto repair estimator for Madras Oregon gives an estimate of $372-489, the same job in San Francisco is estimated at $481-628 . While I am “from California� (albeit originally from Michigan) but NOT from San Francisco , I am getting charged more than the 28

higher-end of the San Francisco estimate. And yet, Cliff’s Auto has MUCH LOWER COST-ofLIVING in Madras , Oregon.

8) IN ADDITION TO THE EXCESSIVE COST, I LEFT FEELING AS IF I HAD BEEN

MISTREATED & CHEATED, CONTRARY TO THE NORMS OF GOOD CITIZENSHIP & CIVIL SOCIETY. Finally, it’s NOT just the EXCESSIVE PRICE that bothers me, albeit this DEFINITELY impacts my ministry budget and certain aspects of which will have to be curtailed for a while , but it LEAVES ME FEELING WOUNDED & disrespected.

I feel like they took advantage of my emergency predicament, knowing I had NO ALTERNATIVE , AFTER-THE FACT !!!

I am NOW 51-YEARS-OLD, & based on my years of traveling and various automotive repairs along the way here & there I INTUITIVELY KNOW a decent or fair price AS OPPOSED TO 29

EXTORTION ( other words that come to mind include: profiteering, unethical, unscrupulous, exploitation, price-gouging, greedy, unreasonable, dishonest, rotten, preposterous, exorbitant, & yes, even corrupt, among others), and IN THIS DAY & AGE OF INTERNET & SMART PHONES, WE CAN ALL DO DUE DILIGENCE IN TERMS OF CALCULATING A FAIR PRICE. I agreed at the time, based on my judgment, to a price of $429.

And I have verified ex post facto, that $429 is a fair price, even if, perhaps, a bit above average, but $639 is ROBBERY ! Cliff’s Auto should be ASHAMED OF THEMSELVES and do the right thing voluntarily of their own volition and make a refund of $200 .

I ask that Mr. Cliff, be a REAL AMERICAN MAN and treat others with HONESTY, RESPECT, INTEGRITY, & FAIRNESS, the same way which you wish to be treated. I don’t 30

know if there was some sort of “prejudice” or bias based on something they inferred about me.

It does not seem to be a matter of race or skin color or some other form of discrimination because I am also “white” (as were all the workers in this shop), nor am I gay. I am heterosexual.

But if it was based on any misperception of race, or skin color, or anything else, it would be even more unconscionable. I assume it is just greed, and the assumption they could get away with it because I am from “far away” and have no other options at the moment.

BELOW ARE IMAGES OF THE RECEIPT & INVOICE WHICH I WAS PROVDED BY CLIFF’S AUTO AT THE TIME OF TRANSACTION, which is identical to the one submitted by Cliff’s Auto Repair, which is identical to the one submitted by Cliff’s Auto to Capital One. However, Cliff’s Auto DISHONESTLY states that the “original 32

estimate� was $639.99 (have you ever heard of an original estimate being so precise ? ) It SPEAKS FOR ITSELF (res ipsa loquitur), and NO REVISIONS, despite the extra work required due to the alleged complications? As discussed above, the original estimate was handwritten as $429 on a pink piece of paper which was NOT included by Cliff’s Auto to Capital One, and a copy of which was NOT given to me at the time.
