VMA ANNUAL EVENTS RETURN

NORFOLK | On September 29, 2022, the Virginia Maritime Association’s (VMA) 102nd annual Maritime Banquet returned along with the VMA’s International Trade Symposium to celebrate the progress of Virginia’s ports and associated supply chain industries, as well as the contributions and actions of specific individuals which were recognized before an audience of over 800 industry executives and dignitaries gathered at the Hilton Norfolk | The Main.

On June 7, 2022, a fire broke out in the engine room of the passenger ship Spirit of Norfolk while underway on a sightseeing cruise with 108 passengers and crew onboard, including large groups of school-age children. During the banquet, the U.S. Coast Guard joined with VMA to recognize the mariners who acted with skill, professionalism, and bravery to rescue the passengers and crew of the Spirit of Norfolk as it burned. Coast Guard awards for Distinguished Public Service, Meritorious Public Service, and VMA Resolutions of Appreciation were presented to crew members based on their individual actions during the rescue. Recognized were the crews of the Spirit of Norfolk, Victory Rover, Rosemary McAllister, Condor McAllister, Challenger, and the Ohio River.

The Honorable Barry D. Knight was presented VMA’s “Port Champion Award.” Representing the 81st House District since he was first elected to the Virginia House of Delegates in 2009, he currently serves as Chairman of the House Appropriations Committee.

VMA22 INTERNATIONAL TRADE SYMPOSIUM

NORFOLK – As the East Coast’s premiere conference on ports, logistics, and trade, the Association hosted the VMA22 International Trade Symposium September 28th and 29th in Norfolk, Virginia. Featuring two full days of content focused on “Strengthening the Supply Chain Together,” keynote speakers included The Honorable Glenn Youngkin, White House Special Envoy General Steve Lyons, and Brett Bruen from the “Global Situation Room.” General Steve Lyons emphaised that the industry has to commit to fluidity in order to rise to the ever changing landscape of the industry. Governor Glenn Youngkin spoke about the achivements of the maritime industry in Virginia and why Virginia is a great place for new members in the industry. Brett Bruen discussed the impacts global crisis can have on industry and how members can respond to such crises.

Additionally, eight informative panels addressed current industry topics such as inland transportation solutions, data automation and integration, the challenges and impacts of decarbonization, and the future of ocean carrier service. Wednesday evening, the Symposium also hosted the Annual Maritime Mixer, providing over 600 attendees the opportunity to connect and mingle at the beautiful Half Moone Cruise & Celebration Center. DETENTION RULES

The Federal Maritime Commission is proposing a new rule that seeks to bring more clarity, structure, and punctuality to the demurrage and detention billing practices of vessel operating common carriers (VOCCs), non-vessel-operating common carriers (NVOCCs), and marine terminal operators (MTOs).

This Notice of Proposed Rulemaking (NPRM) is responsive to a requirement of the Ocean Shipping Reform Act of 2022 (OSRA) and continues work the Commission initiated in 2018 when it ordered an investigation (Fact Finding 28) led by Commissioner Rebecca F. Dye into conditions and practices of VOCCS and MTOs related to demurrage, detention, and per diem charges. That fact finding led to the Commission issuing a final rule in May 2020 addressing how the reasonableness of demurrage and detention practices of VOCCs and MTOs will be interpreted.

If this proposed rule is adopted, VOCCs, NVOCCs, and MTOs will all be required to issue bills for demurrage or detention only to parties that they have a contractual relationship with, to be clear regarding the nature of the charges, and issue invoices within 30 days after the charges stop accruing, and provide 30 days to dispute the charges with clear information about how charges should be disputed.

The Commission is specifically interested in receiving comments on whether it would be appropriate to include the consignee named on the bill of lading as another party who may receive a demurrage or detention invoice. Interested parties will have until December 13th to submit comments to the Commission once the NPRM is published in the Federal Register. The Commission is now using the Regulations.gov portal to receive filed comments.

FOR ROADONE LOGISTICS

SUFFOLK, Va. -- Industrial Realty Group, LLC (IRG), one of the largest industrial real estate developers in the nation, is proud to announce an agreement has been executed to develop a state-of-the-art distribution facility in Suffolk near the Port of Virginia. Upon completion, the project will be fully leased to RoadOne IntermodaLogistics, a single source intermodal, distribution, and logistics services company with a national footprint.

“RoadOne is pleased to be working with IRG to add needed distribution capacity for the U.S. Mid-Atlantic and Southeast regions. This new facility will provide transload services to expedite the movement of inbound cargo from the Port of Virginia to U.S. markets. These strategic initiatives provide our shipper clients with the best logistics services and connectivity to our broad national network,” said Ken Kellaway, CEO of RoadOne IntermodaLogistics. “This is the fourth new transload facility and the second one in Virginia that we’ve added in the last year and a half.”

IRG purchased the 40-acre site in early June 2022. The new building will span about 227,000 sq. ft. and include cross docking for efficient distribution. Its proximity to the bustling Port of Virginia was also a key reason RoadOne was attracted to the location.

RoadOne is the largest intermodal trucking provider in North America and offers full-service intermodal transportation and related logistics services, including port and rail container drayage, terminal operations, dedicated truckload services, transloading, warehousing and distribution solutions. They operate 95 facilities in the U.S. and Canada, including several in Virginia IRG anticipates completion of the project in the third quarter of 2023.

Chairman Knight’s efforts have protected the marine terminals of the Commonwealth, improved their governance, and maintained an open and competitive business environment in Virginia’s port operations. Chairman Knight’s support has included leading multiple legislative efforts to fund the optimization of Norfolk International Terminals, the widening and deepening of the shipping channels to 55 feet, the Virginia Business Ready Sites Program, and Virginia’s first International Trade Plan. His significant contributions will accelerate growth in the Commonwealth’s maritime industry.

VMA’s “Distinguished Service Award” was presented to Catherine “Katie” Carney, Principal Owner of Carney Trade Consulting, LLC., who in 1975 began her career in the customs brokerage industry. As a licensed customs broker since 1980, a Certified Customs Specialist, and Accredited Zone Specialist, Ms. Carney built a career as a widely known and respected industry expert on Foreign Trade Zones, Bonded Warehousing, and In Bond operations with an emphasis on duty avoidance. She has held many leadership roles, including in the Virginia Maritime Association, Virginia Brokers Association, Virginia Port Authority Advisory Committee, the Virginia Freight Advisory Committee, and the National Foreign Trade Zone Association. Ms. Carney has acted with the utmost integrity and distinction as a tireless advocate for her importer and exporter customers, and for maritime and supply chain interests more broadly; and has utilized her extensive knowledge and influence to help position the Port of Virginia to become the preeminent port on the U.S. East Coast.

Roger Giesinger was presented with “Honorary Life Membership”

in VMA. He began his career in the maritime industry in 1972, and has served the last 28 years as President and Chief Negotiator of the Hampton Roads Shipping Association. He has produced numerous and repeated notable accomplishments in the areas of labor relations, negotiations of collective bargaining agreements, workforce training, processing new longshoremen into the industry, fostering a safety-first culture on the waterfront, and innovation and technological improvements in port operations. Mr. Giesinger has held numerous leadership roles in the industry and served on various philanthropic Boards. Mr. Giesinger is the 2014 recipient of the Virginia Maritime Association Distinguished Service Award, and he has announced his retirement effective December 31, 2022.

J.J. Keever was also presented with “Honorary Life Membership.” He originally joined the staff of Hampton Roads Maritime Association (today’s Virginia Maritime Association) and the Hampton Roads Shipping Association in May of 1977 and worked in various positions through 1988. He rejoined the Associations in January 1991 and served as Executive Vice President of the HRMA and HRSA until he joined the Virginia Port Authority in 2004. He served as the Senior Deputy Executive Director at the VPA through 2013. In 2001, he was awarded the Distinguished Service Award by the HRMA for his accomplishments in the industry. From 2010 to 2013, J.J. served as Chairman of the Virginia Offshore Wind Coalition, during which time he established relationships with developers and OEM’s throughout Europe and worked to deconflict a lease block off the Virginia coastline. He joined T. Parker Host in 2016 to focus on business development and special projects, and now works as HOST’s Government Affairs Representative.

HITACHI ENERGY TO EXPAND IN VIRGINIA CREATING 165 NEW JOBS

RICHMOND, VA — Governor Glenn Youngkin announced that Hitachi Energy, a global technology leader that is advancing a sustainable energy future for all, will invest $37 million to expand its operation in Halifax County. The company will add 26,000 square feet to its facility for a new production line for the manufacture of larger transformers specifically to support the utility and renewable energy markets, which will create 165 new jobs.

“We are pleased to see global manufacturers like Hitachi Energy expanding their footprint in Southern Virginia,” said Stephen A. Edwards, CEO and executive director of the Virginia Port Authority. “As The Port of Virginia moves forward on its goal of becoming carbon-neutral [by 2040], we look forward to providing a supply chain solution for a company that will deliver a sustainable energy future for all. When we work with like-minded businesses, like Hitachi, we see opportunities to grow. ”

NORFOLK, Va. – On the heels of the Bipartisan Infrastructure Law earlier this year, the Norfolk Harbor and Channels Improvement Project’s federal sponsor, Norfolk District, U.S. Army Corps of Engineers, announced more good news.

The Norfolk District awarded Norfolk Dredging Company work on the Channel to Newport News and Norfolk Inner Channel. This marks the fifth of eight awards slated for this project, with the first four granted by the Project’s nonfederal sponsor, Virginia Port Authority.

“Out of the pool of four bidders, the

district received a competitive low bid that was more than 3% below the Government Cost Estimate,” said Victor Roberts, Norfolk District project manager. Norfolk Dredging Company received the official notice to proceed for the Channel to Newport News from the Corps, and dredging activities are anticipated to kickoff around December.

Norfolk Harbor Inner Channel dredging is scheduled to begin around November 2024. With a period of performance of 360 days, this section should be complete by the end of February 2025.”

LOWE’S TO ESTABLISH COASTAL FACILITY IN VIRGINIA

RICHMOND, VA — Governor Glenn Youngkin announced that Lowe’s Companies, Inc. (NYSE: LOW), one of the largest home improvement retailers in the world, will establish a coastal holding facility in the City of Suffolk, which will create 100 new jobs. The company’s first distribution operation located in the Virginia Port Logistics Park will receive imported goods through The Port of Virginia to supply regional distribution facilities.
