Some Promises Are Better Broken

The notion that a promise is a promise is born of the very worthy goals of building character and integrity in young people, infusing trust into personal and professional relationships, and generally encouraging people to hold up their end of a bargain. But as countless wedding vows and campaign rhetoric prove, a promise isn’t always so simple and is sometimes better broken.

Most legal contracts have a clause built in to cover circumstances of force majeure -“superior or overwhelming power.” Legal meaning: an unanticipated and uncontrollable event that releases a person from a contractual obligation.

And while some will scream “but a promise is a promise” regardless, the vicissitudes of life make clear that at times the humane and compassionate thing to do is to release a person from their promise.

Or a dog, as the case may be.

Recently, a reader asked me to weigh in on a disagreement between she and her husband.

Here’s the issue:

“My husband and I have a 10-year-old Labrador-Rottweiler mix. We love her to bits, but will most likely need to put her to sleep due to an extremely fast-spreading mammary cancer.

“She’s a bit shaky in the hind legs, it’s impossible for her to walk up stairs anymore or jump into the car, and sometimes she yelps in pain if we rub her on her back.

“Because of her inherently gentle nature, she has been a volunteer dog, making regular visits to a senior care facility.

“In light of her pain, which still shows even with the painkillers we are giving her, I want to stop doing the visits and call it her official retirement.

I understand that no matter how gentle a girl she is, if she is hurt, even inadvertently, she could potentially snap at the offending hand.

“My husband, on the other hand, believes otherwise. He feels that as long as she is able to stand, and since we are right there with her, we should make her go, as “we made a commitment to volunteer and said we would do a full year’s term.”

Reduced Benefit Rates

Q: Whenever you mention the reduction for early retirement, you always say it is “about one half of 1 percent.” So what is it? Is it one half of 1 percent? Or is it something else? Why the ambiguity?

A: In this case, I think my ambiguous answer is better than the facts. And the facts are these: Retirement benefits are reduced five-ninths of 1 percent for the first 36 months of early retirement and five-twelfths of 1 percent for any additional months.

To explain how we came up with those crazy numbers, I’ve got to give a little history lesson:

When Social Security started in 1935, they set the retirement age at 65. And that was it. There were no other options. You had to wait until you were 65 to collect Social Security benefits.

In 1956, Congress decided to let women (and only women) choose early retirement.

They said a woman could start her Social Security as early as age 62, if she wanted. And they decided she should get 80 percent of her benefit if she took early retirement. Or to put that another way, they said there would be a 20 percent reduction if someone took benefits at 62.

In order to achieve that 20 percent reduction, they had to set the monthly reduction rate at five-ninths of 1 percent. (36 months times fiveninths of 1 percent equals 20 percent.)

Of course, a woman wasn’t stuck with just the two options of taking an 80 percent benefit at 62 or 100 percent at 65. She could start her Social Security at any age between 62 and 65 and get the appropriate reduction for that particular starting age.

And over the years, men got a little peeved when they saw their wives taking early retirement, while they had no choice but to wait until age 65. They must have shared their resentment with their congressional representatives because, in 1961, the law was expanded to let men also start their Social Security at age 62 -- with the same five-ninths of 1 percent per month reduction rate.

Things stayed relatively simple for the next couple decades. But the 1983 Social Security amendments included some major reforms. And one of those reforms was to gradually increase the retirement age (for men and women) from 65 to 67.

I don’t have the space to show all the graduated steps here. But people born in 1938 had to be 65 and two months to collect full benefits. People born in 1939 had to be 65 and four months. It kept going up in two-month increments, until it reached a 12-year age 66 plateau for people born between 1943 and 1954. Then the retirement age starts to creep upward again. People born in 1955 have to be age 66 and two months to get full benefits. It keeps going in those two-month increments until the full retirement age levels off at 67 for everyone born in 1960 or later.

Enclosed is a picture of Roseville vase that I have. Marked on the bottom is the name “Roseville.” It is about 7 inches tall and in perfect condition. The flowers are in relief, and the ver y dark background has a textured finish. A friend who is a collector told me the pattern is “Jonquil.”

Does my vase have any value?

A:

Roseville Pottery was founded in 1890 in Roseville, Ohio. It moved to Zanesville, Ohio, in 1898. The “Jonquil” pottery line was introduced in 1931.The collection can be distinguished by the textured, mottled body in muddy brown that shades to green.

The line consisted of vases, candlesticks, bowl, jardinieres, baskets, plantRoseville Pottery was founded ers and console in 1890. sets with glazed interiors. Jonquil pottery pieces were not marked but did have silver foil labels.

Having said that, because your vase is marked, it is likely fake. There are several clues that a Roseville Pottery piece is questionable: a straight letter “s” in the Roseville mark rather than a slanted one, the absence of the letters “U.S.A.” with the mark, and sloppy quality in the mold, finish and design. Authentic hand-decorated Roseville pottery can be recognized by a richly colored glaze with subtle shading and clearly defined details.

Roseville Pottery closed in 1957. Many reproductions were made, especially in the 1990s.

Hyalyn Pottery Company was founded

by H. Leslie Moody and his wife, Frances Moody, in Hickory, North Carolina, in 1947. Their vision was to produce high-quality and unusual porcelain at affordable prices. H. Leslie Moody’s strength was developing innovative glazes. New designs were attributed to Frances Moody’s artistic creativity.

The name “Hyalyn” was inspired by the word “hyaline,” which means “translucent.” The pottery used native white North Carolina clay, as well as clay imported from Georgia and Michigan.

It produced kitchenware, ashtrays, tableware and figurines. After H. Leslie Moody passed, Frances Moody sold the pottery to Hamilton Cosco in the 1970s. It was closed in 1997.
