Real Estate Agents Obtain Labor Competency Certification

The CONOCER certification endorses the skills of real estate professionals to commercialize properties and is valid throughout Mexico.

In the last three months, approximately 60 real estate professionals from various local companies have taken the course and evaluation to obtain the federal real estate certification of the Consejo Nacional de Normalización y Certificación de Competencias Laborales (CONOCER) (National Council for Standardization and Certification of Labor Competencies) of the Secretaría de Educación Pública. This program is endorsed by the Asociación Mexicana de Profesionales Inmobiliarios (AMPI) (Mexican Association of Real Estate Professionals) and consists of three days in which the theoretical and practical aspects of real estate commercialization are reviewed, as well as two days of examination.

In the Banderas Bay area, the training and evaluation are provided by Corporativo Inmobiliario Estrada (CIE), with course coordinator architect Francisco Estrada and evaluator Eduardo García.

In an interview with Vallarta Real Estate Guide, both explained that they collaborate closely with the Puerto Vallarta, Riviera Nayarit and Compostela AMPI chapters and that those interested in the program can obtain more information through these organizations.

The CONOCER certification endorses the skills of a person to commercialize real estate and is valid throughout Mexico. However, its validity is subject to changes in the federal real estate standard, so it is recommended to take refresher courses regularly.

En los últimos tres meses, aproximadamente 60 profesionales de bienes raíces de diversas compañías locales han tomado el curso y evaluación para obtener la certificación inmobiliaria federal del Consejo Nacional de Normalización y Certificación de Competencias Laborales (CONOCER) de la Secretaría de Educación Pública. Este programa está avalado por la Asociación Mexicana de Profesionales Inmobiliarios (AMPI) y consta de tres días en los que se revisan los aspectos teóricos y prácticos de la comercialización de bienes inmuebles, así como dos días de examen.

En el área de Bahía de Banderas, el entrenamiento y la evaluación son impartidos por el Corporativo Inmobiliario Estrada (CIE), a cargo del coordinador del curso, el arquitecto Francisco Estrada y Eduardo García, evaluador. En entrevista para Vallarta Real Estate Guide, ambos explicaron que mantienen una colaboración cercana a los capítulos Puerto Vallarta, Riviera Nayarit y Compostela de la AMPI y que los interesados en tomar el programa pueden obtener más información a través de dichos organismos.

La certificación CONOCER avala las competencias de una persona para ejercer la comercialización de inmuebles, es válida en todo México y su vigencia está sujeta a las modificaciones en el estándar federal inmobiliario, por lo que se recomienda tomar cursos de actualización constantemente.

AMPI and FIABCI Mexico Seek to Expand Market With the intention of expanding business opportunities between Mexico and Spain’s real estate industries, a networking session was held for the major associations of the two nations: the Asociación Mexicana de Profesionales Inmobiliarios (AMPI) (Mexican Association of Real Estate Professionals), the Mexico and Spain chapters of the Federación Internacional de Bienes Raíces (FIABCI) (International Real Estate Federation) and Spain’s Colegio de Agentes de la Propiedad Inmobiliaria (API) (Organization of Real Estate Agents).

Local broker Silvia L. Elias, owner of PV Realty and president of FIABCI Mexico, attended the meeting in Barcelona, Spain. In addition, she accompanied Ernesto Meana (AMPI vice president of legal affairs) and Ramón Tierra Torroba (president of FIABCI Europe) during the signing of a collaboration agreement between the associations. Referring to the work of the organization she directs, Elias said, “FIABCI has to play a fundamental role in generating synergies between both markets. Beyond a historical, cultural and linguistic relationship, these countries are experiencing high real estate activity and there are many Mexicans interested in investing in Spain.”

Elias also took advantage of her stay in the capital of Catalonia, in the Iberian Peninsula, to attend the Global Symposium of Leading Real Estate Companies of the World (an organization with which PV Realty is affiliated). This event included conferences, property tours and social gatherings attended by prominent brokers and businessmen from more than 28 countries.

Con la intención de ampliar las oportunidades de negocio entre las industrias inmobiliarias de México y España, se llevó a cabo una sesión de networking entre las principales asociaciones del ramo de ambas naciones: la Asociación Mexicana de Profesionales Inmobiliarios (AMPI), los capítulos México y España de la Federación Internacional de Bienes Raíces (FIABCI) y el Colegio de Agentes de la Propiedad Inmobiliaria (API) de España.

La bróker local Silvia L. Elías, propietaria de la firma PV Realty y presidenta de FIABCI México, asistió a dicha reunión que tuvo lugar en Barcelona. Además, acompañó a Ernesto Meana (vicepresidente de asuntos jurídicos de AMPI) y Ramón Tierra Torroba (presidente de FIABCI Europa) durante la firma de un convenio de colaboración entre asociaciones. Refiriéndose a la labor del organismo que dirige, Elías mencionó: “FIABCI tiene que jugar un papel fundamental para la generación de sinergias entre ambos mercados. Más allá de una relación histórica, cultural y lingüística; estos países viven momentos de alta efervescencia inmobiliaria y hay muchos mexicanos interesados en invertir en España”.

Loft 268 Construction Completed

Located in Puerto Vallarta’s Romantic Zone, Loft 268 is the most recent project of Grupo Gich and Operadora MABU.

Construction of the Loft 268 development, located in Puerto Vallarta’s Romantic Zone, is officially completed. The common areas of this seven-level complex are completely finished, and the first deliveries of units to owners have already taken place.

The building has 64 studios and one- and two-bedroom apartments, of which 80 percent have already been sold by Timothy Real Estate Group, who announced that the development will hold a grand opening on Tuesday, November 13, at 5:00pm, to which clients and the general public are invited.

Loft 268 amenities include reception area, two elevators, terrace with infinity pool and waterfall, gym, jacuzzi, sundeck, BBQ area, sky bar with glass walls, fire pit, roofed lounge areas, gardens and a multilevel waterfall.

Loft 268 is the most recent project of Grupo Gich and Operadora MABU, which the concept was presented at the beginning of 2016. It has a contemporary design that mixes elements such as wood, concrete, tempered glass and brick, all inspired by the natural beauty of Puerto Vallarta.

Con su proyecto Casa Lago, los arquitectos Abraham Zermeño y Rafael Ruelas obtuvieron el segundo lugar en la categoría Mejor Residencia Unifamiliar del Premio Firenze Entremuros 2018, un certamen a nivel nacional en el que hubo más de 350 participantes.

Rafael Ruelas and Abraham Zermeño are two young architects from Puerto Vallarta who recently participated in the Premio Firenze Entremuros 2018, a national contest that recognizes the best of architecture and interior design in Mexico.

Rafael Ruelas y Abraham Zermeño son dos jóvenes arquitectos originarios de Puerto Vallarta que recientemente participaron en el Premio Firenze Entremuros 2018, un certamen a nivel nacional que reconoce a lo mejor de la arquitectura y el interiorismo en México.

Casa Lago, the architectural proposal with which they obtained an outstanding second place in the Best Single-Family Residence category, was up against the projects of outstanding national firms, clearly showing the quality and talent that exists in the region.

Casa Lago, su propuesta arquitectónica con la que obtuvieron un destacado segundo lugar dentro de la categoría Mejor Residencia Unifamiliar, se enfrentó con los proyectos de destacadas firmas y despachos de gran trayectoria en el país, por lo que el resultado obtenido es trascendental y una muestra clara de la calidad y talento que existe en la región.

The Gestation of a Unique Proposal “It all began in late 2016 with the construction company’s internal call to present an architectural proposal for the construction of a new luxury residence within the Sierra Lago development in Mascota, Jalisco, which would serve as a prototype to build 11 houses in total,” explains Zermeño.

“Initially, there were four or five proposals developed by some colleagues, but they did not fully convince the owner, and the idea of inviting the other architects of the company to participate with their own house concept was spread. We saw the opportunity, sat down to plan and began to lay the foundations of the project adhering some concepts and principles of design. For example: a simple architecture, a versatile location, framing views to generate ‘natural paintings’ and feel protected by the treetops. Of course, we had to comply with an architectural program and a list of needs,” adds Ruelas.

Their Participation “Shortly after our proposal was chosen by the construction company’s committee, some colleagues commented on our project: ‘This house has a very particular design.’ Their recommendation, basically, was to project 20

Internamente se hizo una convocatoria para presentar una propuesta arquitectónica en la que se basaría la construcción de una nueva residencia de lujo dentro del desarrollo Sierra Lago en Mascota, Jalisco, la cual serviría como prototipo para construir 11 casas en total”, explica Zermeño.

“Inicialmente había cuatro o cinco propuestas que algunos compañeros desarrollaron, pero no le convencían del todo al dueño. De ahí surgió la idea de invitar a los demás arquitectos del grupo a participar con su propio concepto de casa. Vimos la oportunidad, nos sentamos a planear y comenzamos a definir las bases del proyecto apegándonos a algunos conceptos y principios de diseño. Por ejemplo: una arquitectura sencilla, un emplazamiento versátil, enmarcar vistas para generar ‘cuadros naturales’ y sentirse arropado por las copas de los árboles. Desde luego, debíamos cumplir con un programa arquitectónico y una lista de necesidades”, añade Ruelas.

“In reviewing the categories, we automatically saw that Casa Lago fit into Best Residential Interior Design and/or Best Single-Family Residence. We opted for the second, and between the two of us we arranged our participation in the contest. In June, there was a cocktail party at the facilities of Grupo Reforma in Mexico City, where the 54 finalists were announced. Later, in September, there was a gala dinner and the first three places in each category were awarded. In total there were 354 firms,” explains Zermeño.

The engineer in charge of the construction was Óscar Baldenegro,” adds Ruelas.

“Dos arquitectos más se sumaron al proyecto: Alfonso Amaya, quien nos apoyó a desarrollar el proyecto ejecutivo —etapa en la que se generan los planos e información necesaria para ejecutar la construcción— y Martha Dado, quien nos apoyó con cuestiones de diseño de interiores. “Also, part of the excitement and experience was that the project was built as planned and visualized,” notes Zermeño.

Future Plans Both Ruelas and Zermeño visualize themselves working through their own offices, collaborating with different architects and generating projects that, in addition to providing security and confidence to those who invest in Puerto Vallarta, contribute to the destination through their profession.

Reynaldo Álvarez, abogado especialista, ofrece algunos consejos y consideraciones para llevar a cabo rentas comerciales con éxito y sin tanto sobresalto, siempre cuidando la operación y funcionamiento correcto del negocio.

Renting space can represent one of the biggest expenses for an entrepreneur. So, it is important that the business owner take special care with the terms and conditions of the lease and even seek specialized advice.

Reynaldo Álvarez, director of the firm Álvarez & Asociados Abogados, states that, legally, “a lease is where a person called a landlord grants the use of a property to another person, called a tenant. In the commercial sphere, it is a property destined to house a business or commercial enterprise.” According to our specialist, the law that governs them is the Código Civil para el Estado de Jalisco (Civil Code for the State of Jalisco), where how to handle a commercial rental is explained in detail.

La renta de un local puede representar uno de los mayores gastos comerciales para un emprendedor. Por ello, es importante que el propietario de un negocio ponga especial cuidado en los términos y condiciones del contrato de arrendamiento e incluso busque asesoría especializada.

Reynaldo Álvarez, director del despacho Álvarez & Asociados Abogados, plantea que, legalmente, “un contrato de arrendamiento es donde una persona llamada arrendador le concede el uso de un bien inmueble a otra persona llamada arrendatario. En el ámbito comercial, se trata de una propiedad destinada a albergar un comercio o negocio”. De acuerdo con nuestro especialista, la ley que los rige es el Código Civil para el Estado de Jalisco, en donde se explica a detalle cómo se debe manejar una renta comercial.

Basic Aspects to Consider “First of all, it is very important that the tenant makes sure that the property he is looking to rent has authorization from the municipality to be used for the business that he intends to put in that location.

Álvarez adds that, once the tenant is sure that the municipality can grant him the license to operate in that property, the next step is to make sure that he is dealing with the right person and that he has the capacity to permit the rental. “Sometimes, the deal is being made with the legal representative, the administrator or even the alleged owner, but if that person does not prove they have the right to rent it, frankly it will not do you any good, even if a contract has been signed. So, it is necessary to ask him to show the corresponding deed or property title. If he is a legal representative, ask him to show the power granted to rent.”

“Antes que nada, es muy importante que el arrendatario se cerciore de que el bien inmueble que está buscando rentar tenga la autorización por parte del municipio para poder ser usado bajo el concepto de negocio que pretende poner en ese local. Es preciso recordar que no todos los locales están destinados o fueron construidos para albergar todo tipo de comercio. Mientras que unos giros están restringidos en ciertas zonas, hay otros que pueden arrancar sin problema”, explica.

Nuestro experto añade que, una vez que el arrendatario esté seguro de que el municipio sí le puede otorgar la licencia para operar en ese inmueble, el siguiente paso es asegurarse de que el trato lo esté llevando con la persona indicada o que tiene las facultades para poder otorgar en renta el local. “En diversas ocasiones, es posible que el trato se esté llevando con el representante legal, el administrador o hasta con el supuesto dueño, pero si esa persona no acredita en su momento que tiene las facultades para rentar, francamente no te va a servir de nada, aunque se haya firmado contrato. Para ello, es necesario pedirle que exhiba la escritura o título de propiedad correspondiente.

Si es un representante legal, pedirle que muestre el poder que le otorga la facultad para poder rentar”.

A third aspect to consider would be the history of the premises and what other businesses have been there before.

“Sometimes, we see a very clean and good location, but it turns out that the previous tenant left, did not terminate, for example, the operating license, which often happens, and the new tenant, when going to process his license, finds that the place has charges or fines and/or there are unfulfilled obligations or municipal taxes due, and he cannot start his business until those payments are settled.”

Un tercer aspecto a considerar sería conocer los antecedentes del local y qué otros negocios han estado ahí anteriormente. “A veces podemos ver un local muy limpio y con buena ubicación, pero resulta que el arrendatario anterior se fue, no dio de baja, por ejemplo, la licencia de funcionamiento —que sucede a menudo— y el nuevo arrendatario, al momento de ir a tramitar su licencia, se da cuenta que ese local tiene recargos, multas y/o que no ha cumplido con sus obligaciones o impuestos municipales, por lo que no podrá arrancar su negocio hasta que se liquiden esos pagos”.

Al preguntarle por algunos consejos básicos para tener en cuenta al momento de negociar de manera eficaz un contrato de arrendamiento para un local comercial, Reynaldo Álvarez fue enfático en recabar la mayor cantidad posible de información: “En primera instancia, es imprescindible conocer a detalle todo el funcionamiento de tu negocio y en segundo lugar, mientras más información tengas con respecto al local, al propietario, a los anteriores arrendatarios y del lugar en el que está ubicado, más fácil será negociar el precio de la renta y/o tomar decisiones pertinentes”.

Before concluding, Álvarez recommends always having the support of a professional team that ensures the development of any company. “Depending on the industry or sector, I recommend having an accountant, a lawyer and a business specialist—not necessarily working in the office, but as external consultants that can be called regarding any detail or question that may arise. En el caso de los abogados, es ideal establecer una relación laboral desde el inicio, pues al contarle los planes concretos que se llevarán a cabo, él se encargará de analizar cierta información, de ver los requisitos y revisar contratos para subrayar exactamente cuáles son los derechos y obligaciones de los inmiscuidos en una renta comercial, evitando con ello sobresaltos que puedan desequilibrar el negocio”.
