The Summer Clerkship Guide, produced with much hard work by the UTS Law Students’ Society (LSS), is a great resource. It will give you information about the firms, the process, and tips about how to go about preparing an application. You can also read about the experiences of former summer clerks. Importantly, the Guide will provide you with information about the proper procedures to be followed throughout the entire process. If you are not sure about your plans, then the Guide will still be useful in providing you with information about the type of firms involved and the experience of working in these practices. If you are unsure, it would be good to read the Summer Clerkship Guide alongside the Careers Guide, another valuable resource produced by the LSS, which will give you an insight into the broader range of careers available to a law graduate. I know from my conversations with law firms that UTS:Law students are well regarded. However, the clerkship program is highly competitive and there will be many more applicants than places.

Do not be daunted by the level of competition. If you think this is the type of practice that interests you, then put in an application. Just be realistic.

Welcome to our 2019 Clerkship Guide. A clerkship is a fantastic opportunity to experience life and work within a commercial law firm. With dozens of firms on offer, and a high degree of hype (not all justified) surrounding the application process, pursuing a clerkship can easily sound more daunting than it actually is.

With this in mind, this Guide was created to guide you through the process in a realistic, hype-free way. With articles on cocktail nights, cover letters, CVs, and interviews this Guide will help you put your very best foot forward and ensure you feel confident as you step through the process.

On behalf of the Society, I thank our Careers (Publications) Director, Ryan Machado, for leading the Careers (Publications) Sub-Committee, comprising of (Aryan Golanjan, Emil Obaid, Derick Luong, Kimberley Ching and Lara Czysnok), in creating this publication and commend their efforts in extending the guide with the authoring of several all-new articles for 2019. The guide is an essential tool that will be of use to you, especially if you are in the penultimate or pre-penultimate year of your law degree. Even if you are in the early stages of your degree, it is recommended that you use this guide to gain an insight into what a clerkship is like and whether it is something that you wish to apply for in your penultimate year of your legal studies.

As clerkships are coveted amongst those who wish to pursue a career in commercial law, the process of application can be highly competitive, demanding, and time-consuming. For this reason, it is essential that you keep track of key dates and incorporate suggestions that will boost your candidacy and employability throughout the clerkship process. I hope that this guide will provide you with a comprehensive understanding of the clerkship process and how best to make yourself a competitive candidate.

A General Overview

Why are clerkships important?

Clerkships are a vital part of the graduate recruitment process for most commercial law firms.

Firms of all sizes offer clerkships to penultimate year law students as an invaluable opportunity for students to gain practical work experience and understanding of what it is like to work in a commercial law firm. It is commonplace for firms to offer the majority of graduate roles available per year to those who have undertaken a clerkship with them in their penultimate year. As such, clerkships are coveted by those who wish to pursue a career in commercial law as it significantly increases (but does not define) your chances of securing a graduate role in the firm that you wish to pursue a career in. Many people also use clerkships as a way of determining the area of law that they wish to pursue, gaining valuable practical legal experience along the way.

When are they run?

Whilst the actual dates of clerkships may vary amongst different firms, clerkships are generally held between December and February.

How long do they run for?

Clerkship programs will generally range from 4-15 weeks. The number of weeks and format of the clerkship however varies with each firm. For more information on the length and format of the clerkship program the firm you wish to apply for

What will you do as a clerk?

Writing a Cover Letter:

Cover letters are essential as it is likely to be the only form of contact you have with a firm before they start conducting interviews. You should view the cover letter as a brief presentation that highlights you as a candidate that possesses excellent written communication skills, with skills and abilities that relate to the selection criteria and tasks that you will undertake as a prospective clerk.

For this reason, it is essential that you keep your cover letter brief, easy to understand, and straightforward in order to effectively relate your experience and interest for the role to that firm’s selection criteria.

Whilst you may be tempted to reduce the page margins in order to fit more words and sentences, refrain from doing so, as it makes the page unpleasant to read, and could be viewed unfavourably by the recruiter.

Paragraph One: Greeting and introduction

A cover letter is exactly that, a cover letter! It is a one-page formal letter that should contain the following: — Addressee details, including the name of the person you are addressing the letter to, the name of the firm and its address. These details should sit above the date, aligned to the left.

— Date of sending. This should be aligned to the left.

— Sender details, including your name, address, contact number, and email address. These details should be placed on the top of the page, aligned to the right.

Writing a CV: Advertising Yourself on Paper A Curriculum Vitae (CV) is a 1-2 page document that acts as a summary of your professional and educational background. It is imperative that this document be sufficiently explanatory of all essential aspects of your educational and professional background, extracurricular undertakings, and achievements that places you as a candidate with the ‘complete package’. The document should be concise, professionally formatted, and make it easy for the recipient to understand what it is that you bring to the table.

Formatting There is no one particular format that you should follow. However, the following rules should be adhered to: — The CV should contain simple and formal language.

— Appropriate margins (no less than 2 cm each side) should be used throughout the document.

— The document should not exceed more than 2 pages in total.

— Professional fonts such as Times New Roman 14

— Clear headings should be used to allow the reader to differentiate between the relevant sections containing information about your educational and professional background.

— Bullet points should be used instead of long, descriptive sentences and paragraphs. Using short succinct sentences will allow the reader to peruse without having any difficulty in identifying the key elements of your background that are relevant to the role and their selection criteria.

General Structure Every CV is different, and there is no one set structure to follow. A quality CV will contain the following elements: Personal Information This should be clearly placed at the top of your document, aligned to the centre of the page.

You should include your name, address, phone number, and email address.

Avoid unprofessional email addresses.

Educational Background State your degree/double degree that you study, the university you attend, any relevant awards, accolades, undertakings (i.e. university exchange programs, participant in XYZ mooting competition etc.), and your WAM/GPA (if you do wish to display it on the document).

Professional Work/Volunteer Experience Start a new section for each role, presenting your most recent work experience first, working backwards from there. State the title of your role, the name of the organisation you worked in, and details pertaining to how long you worked there for.

Be descriptive of the main aspects of each role you have undertaken. Use bullet points, and succinct sentences to convey key information about the role and tasks you performed to the reader.

Highlight (without disclosing any private/confidential information) any key projects and/or cases that you took part in during the course of your employment.

There is no need to add all experience to this document. Add only what is relevant, highlighting any transferable skill/experience you obtained that will assist you in meeting the selection criteria and/or performing any tasks demanded by the role.

Extracurricular Activities/Interests Be sure to add any key activities/undertakings that you are involved in (make sure that these are relevant to your professional and personal development).

Ensure that you relate such activities/undertakings to an ability/skill that was obtained in the course of the undertaking E.g. Playing team sports has honed your oral communication skills in an intense environment, allowing you to perform well and enjoy activities involving team efforts.

Referees Ensure you have current referees for the roles you have undertaken, who are willing to act as your referee for the role.

Include relevant contact details such as their office number and mobile number (with permission).

Avoid including friends and family as referees. It creates an unprofessional tone at the end of your CV that may cause the recruiter to view your application unfavourably.

Navigating cvMail

Many firms use cvMail as the application portal for law students applying for clerkships. Students may access cvMail through the cvMail website (www.cvmail.com.au) or through their cvMail account on a firm website. Upon accessing the site, you will need to register your details as a first-time user and follow the prompts to apply for your desired program. It is recommended that you apply directly from the careers page of the firm you wish to apply for, as doing so will take you directly to the cvMail portal for that program alone.

Tip: Most (if not all) firms have their applications open for one month (June-July). For a smooth application process, it is recommended that you have your documents (CV, Covering Letters and Official Academic Transcript, Passport/Rights to Work in Australia etc.) ready by the time applications open. Nothing is more stressful and disheartening than missing out on applying to your dream program due to not being able to produce the required documentation at the time of application.

Keeping Things in Perspective: What exactly is it that firms look for?

There is no doubt that applying for clerkships can be a stressful time. However, it is important that you keep in mind that hundreds to thousands of prospective clerks apply each year, and each firm will hire at their own individual discretion (after all, they will be investing a considerable amount of time and resources in you). Each firm’s hiring team (generally consisting of Human Resources Directors and Partners) will have their own selection criteria for incoming clerks.

— Excellent written and oral communication skills: This is essential for drafting correspondence, letters of advice, and liaising with third parties such as courts, counsel and clients.

— The ability to perform legal/technical research and analyse documents closely, checking for accuracy.

— Extracurricular activities and employment that add to your personality and sense of professional development.

When applying for a clerkship, try and think from the perspective of your potential employer about what exactly it is that they seek within a prospective clerk. An offer to a clerk is generally made with the intention that that clerk continue to work at the firm as a graduate lawyer upon the completion of his/her legal studies. Firms will be looking for candidates who are motivated, committed to their learning and professional development, and are easy to work with.

It is also recommended that you have a look at your desired firm’s website and speak to former clerks and graduates to gain a better understanding of the selection criteria and roles performed.

Speaking to such people will allow you to determine what avenues of experience to pursue prior to applying in order to give you the best chances of including such experience on your CV and Cover Letter.

Whilst it is not specified exactly what will get you in the door, general selection criteria will include (amongst other things): — A well-tailored CV and covering letter — Organisational skills: You will regularly be assigned tasks by partners and supervisors who will oversee your tasks as a clerk. It is essential that you are able to multi-task and comply with deadlines.

— The ability to work both autonomously and as a team to problem solve and generate solutions.

Gaining Experience for Your Applications: Pre-Penultimate/Penultimate Year Students

Penultimate Year Students Do not panic if you do not meet all the criteria/ experience a typical clerk may have. Every firm has their own preferences when it comes to hiring clerks.

— All experiences have a transferable value that you may include as part of your application (part-time jobs, volunteer work etc.). Perhaps you can undertake small ventures (i.e. moots, client interview competitions, paper presentations, hackathons etc.) to test your abilities.

Doing so will give you a transferable lesson/ experience that will enhance your professional development and associated skills.

— Firms do not expect you to have had a lifetime of legal experience before you apply, so when applying, look to the experience you already have and how your interests and experiences will enable you to perform well as a clerk at their firm!

Pre-Penultimate Year Students If you are in the earlier stages of your degree, you have ample time to add to your experience prior to your application.

— You should consider applying for roles in the legal sector, be it volunteer or paid work. Look to SEEK, Indeed, and your university job board for any opportunities. Even if you are unable to secure such a role, look to roles outside of the legal sector that will provide you with a transferable skill that could bolster your performance as a prospective clerk. Short Answer Questions: How to Handle Them?

As part of their recruitment process, many firms require you to answer a series of short answer questions. Whilst you may be tempted to copy and paste relevant sections of your cover letters as you answer, don’t. It is imperative that you provide quality and authentic responses to such questions as every portion of your application is assessable and may determine whether you secure an interview, or not.

As such questions may demand a certain word limit, be sure to answer them on a separate document and then paste them into the answer box.

Spelling and grammar errors may also be easily identified in this manner.

Interview Advice So, you have been called in for an interview. Now is not the time to worry...this is your chance to excel!

Every firm will have their own way of conducting interviews. Some may choose to only do one round; however, many will choose to do more than one. It is essential that you perform well in all stages, as it could make or break your chances of securing the role! Contrary to what you may believe, it is imperative that you prepare well.

Common questions that may include (but are not limited to):

Tell us about a time where you had to apply logical reasoning to generate a solution to a problem.

Advice: Prepare this beforehand, but do not be afraid to pause and think (within reason)!

— Draw upon any logistical/practical issues you faced in one of your roles (legal/non-legal) and guide them through your reasoning.

— Be sure to tell them about what you learned from the process and how you will use that lesson obtained in any future role.

Interviews may be stressful, but try and remember that: 1. It is a formal conversation between you and the interviewer. Maintain a professional tone and manner, but do not be a machine. Be yourself!

2. You should aim to link any experience you have obtained to a skill obtained or ability tested. Make it known that you will apply that skill or ability to your duties as a clerk. If that is impractical, explain how such experience has

shaped your personality, attitude, and work ethic.

3. You need to show that you have researched the firm well by mentioning a few matters the firm has handled that is of interest to you. If you are unable to draw upon particular cases, talk about what you know about the firm’s culture and explain why you would be a good addition to their team.

4. You should not memorise sentences! Try and think about the type of questions that you may be asked and remember key points to mention for each question.

5. You should know your availability and the notice period you are required to give to your employer.

6. You should research several behavioural questions that may be asked and prepare answers accordingly.

7. Practise questions and responses with your family or mentor.

8. Make sure you arrive at least 15 minutes prior to the interview starts. Give yourself plenty of time to travel!

9. Eat, drink, exercise and sleep well in the days leading up to the interview.

10. Stay calm, make plenty of eye contact, and respond well and logically to all questions asked.

Networking 101

Networking takes many forms. It is essential that you take the time to network, not only to practise how you speak to members of legal profession, but also to gain valuable insight about the firm; information that may not be publicly available elsewhere!

Here are some tips you may want to keep in mind during the next networking event you attend and/or professional interaction you have:

1. Be approachable and dress appropriately.

How you dress and conduct yourself will create a lasting impression. You want that impression to be a good one.

2. Aim to speak to a wide range of professionals.

Do not cling to one partner or human resources director for 20 minutes. On the other hand, you do not want to make the person you are talking to feel that they are being interviewed for specific questions/time period only. Take a genuine interest in their role within the organisation, absorb the knowledge/information they tell you, and ask questions where appropriate.

3. Approach members of the recruitment team.

Do not be afraid to ask colleagues and attendees if they know who takes part in conducting interviews.

4. Talk about what draws you to their firm and ask them about firm’s culture and initiatives.

This will help you the most in interviews.

5. Do not treat this as a chance to secure a role (before interviews have even commenced)!

Yet, what truly set Ashurst apart for me were the genuine and down to earth people I met throughout the application process, as I was committed to joining a firm where I could work on market-shaping matters alongside people who were genuinely invested in my personal and professional development. 2. YOUR WORK AS A CLERK From the outset of my clerkship I was afforded a wide range of responsibilities and was exposed to a variety of work. Specifically, I had the opportunity to draft advices for multinational organisations, sit in on client meetings and assist in ongoing litigious matters run by the firm.

Further, Ashurst is the only firm that offers its clerks the opportunity to complete a one week client secondment and through this, I was fortunate enough to gain an insight into the in-house legal environment at a large foreign investment bank.

5. ASHURST IN THE COMMUNITY Ashurst’s strong commitment to the community reaffirmed my belief that it was the right firm for me. Each year, the firm sets a target of ensuring that every lawyer completes 50+ hours of pro bono work and clerks were presented with opportunities to get involved in this from our very first day. Further, a particular highlight of the clerkship experience for me was the opportunity I had to volunteer at the Exodus Foundation, where alongside my fellow clerks I prepared and served food to those in need.

3. SOCIAL ASPECTS OF THE CLERKSHIP Whilst the work you will engage with as a clerk at Ashurst is both challenging and intellectually stimulating, the true highlight of the clerk experience will be the social activities that you are able to attend. As a clerk cohort we were invited to a number of Christmas parties, played weekly inter-firm sport and even organised our own weekend away at the Hunter Valley. The result of this was that not only did I get to work alongside some extremely talented individuals, but I also made some friends for life in the process.

We appreciate diversity in our clerks and are not looking for identical or ‘cookie-cutter’ candidates. We look for well-rounded individuals who can demonstrate exceptional academic performance, evidence of work experience (law or non-law related), as well as experience in leadership positions, volunteering or community service, and other extra-curricular activities. We want people who are looking for a broad experience with exposure to different practice areas and clients where they will have the opportunity to experience hands-on and intensive learning.

The Clerkship Program Corrs’ Clerkship Program is a great opportunity for you to experience the people, clients, work and culture that differentiates Corrs from other law firms.

During the nine week program, Clerks will rotate through three different practice groups. During the clerkship program, clerks will have the opportunity to draft advice, conduct research and review documents.

Clerks are also encouraged to ‘shadow’ partners and lawyers on activities such as meetings with clients, barristers or witnesses; client phone calls; and mediations, settlements and court appearances. The clerkship program promotes a more hands-on approach to developing your knowledge and skills.

As a clerk you will also undertake a pro bono project for the duration of the summer which you will present to one of our pro-bono clients as a cohort.

Graduate Development Program The majority of our graduates are recruited through our Clerkship program and our commitment to developing exceptional lawyers starts at day one. Our Graduate Development Program lays this foundation by providing rich, on-the-job training with a greater opportunity to work directly with partners and senior lawyers, and includes structured learning, mentoring and regular feedback.

Supervised by partners and mentors, you will complete three different rotations across transactional and disputefocussed practice groups before settling in your final practice group at the end of the 16-month program.

I found the support at KWM to be very robust. During each rotation I was assigned a buddy to which we could ask any questions we had. I was also assigned a development coach, which was a senior lawyer that gave me feedback and helped developed my professional skillset. Additionally, everyone that I worked with was highly supportive, and were conscious of how I was going and my workload. The People and Development team were also highly approachable and answered any questions or concerns that we had.

SUMMER CLERK INTAKE: 2018/19 AREAS OF ROTATION: Banking & Finance (Financial Regulation) and Mergers & Acquisitions (TMET/IP) UNIVERSITY: University of Technology Sydney DEGREE: Bachelor of Laws (Legal Futures and Technology) THE APPLICATION AND INTERVIEW PROCESS: I found the application and interview process to be the most pleasant out of all the firms that I applied to.

PRO BONO AND COMMUNITY:

The application was unique in that it didn’t concentrate on the firm, or ask you to justify your interest in the law.

Rather, it focused on asking the applicant what interests them, and this informed the interviewers about the applicants personality and interests.

This was a unique approach that really demonstrated to me what the firm values.

THE WORK: I thoroughly enjoyed the work as a summer clerk at KWM. Both teams that I rotated through actively involved me in work that I was interested in, and always involved me in big matters and client calls.

During my first rotation, I had the opportunity to work on a variety of incredibly interesting blockchain infrastructure matters (which were of particular interest to me). My favourite moment during my clerkship was when I was able to work closely with the partner in a blockchain matter, and had the opportunity to materially contribute to the final product.

During the clerkship, we had the opportunity to engage with one of the firm’s pro bono programs, where we were asked to develop a way for the program to be scaled to rural and remote areas. Teams were asked to make a 7 minute pitch to various members of the firm. I found this experience invaluable as it helped me develop my presentation skills, as well allowing me to engage with the program on a meaningful level.

I was also able to be involved in other pro bono initiatives through my rotations, where we gave advice to various individuals through our pro bono partners.

THE SOCIAL LIFE: The social life at the firm was a particuarly fun part of the clerkship.

During the first day, the firm organised an Amazing Race activity as an icebreaker, and it was incredibly fun. We were tasked with running around the city to collect clues and achieve objectives.

During my second rotation, the M&A practice group held a firm wide pingpong competition, where the clerks were responsible for organising teams and the team costume. This was one of the social highlights of the clerkship, and demonstrated to me the firms commitment to a fun and inclusive culture. Overall, the social life at KWM as a clerk was very rich and engaging.

WHY I CHOSE KING & WOOD MALLESONS: Firstly, I was impressed with the firm’s commitment to emerging technologies, particularly their work in the areas of blockchain, smart contracting and open banking. My desire to work at KWM was tied to working in these areas, as I considered the firm a leader in the space.

Secondly, I picked KWM because of the firm’s culture. Every interaction that I’ve had with the firm has been positive, even throughout the interview process. I always felt comfortable at the firm, and felt that its attitudes and goals alligned with my own.

MY CLERKSHIP VS. MY EXPECTATIONS: My clerkship exceeded my expectations. The firm was incredibly receptive to what I wanted to work on, see and experience, and actively sought to give me those experiences. I came out of the clerkship with brilliant training and having experienced a wide variety of interesting work.
