eginning in May, 2,000-3,000 members w ill attend either the Women's National Junior Olympic Workshop or a Regional workshop . This will give you an opportunity to see first hand the tremendous job that has been done by the Junior Olympic Committee, chaired by Tom Kol!. The new compulsories are among the best, and many will say, the best, that have ever been produced by USA Gymnas tics. I think you will all be excited by them. The Committee challenged itself in 1993 to develop for this next cycle a new set of compulsories that would build on the best of w h at h as been before, but at the same time, move the ].0. program forw ard. The workbook and accompanying video are the first rate product that has resulted from their years of hard work. When you see the Committee members and / or Connie Maloney of our staff who has also put in tremendous effort on the project, please express your appreciation. w ho are too young to travel to the National Training Camp, are provided a week of interaction with the Nation al Coaching Staff. The Elite Committee, which has jurisdiction over the TOPs program, has decided to implem ent a competitive element to TOPs to provide an avenue for elite or potentially elite athletes to develop in a fashion that runs parallel to the J.O. program. This competitive track will supplement the existing regional and national elite meets. This way the United States can h ave the best of both worlds. While placing primary emphasis on the Junior Olympic program and its ongoing commitment to outstanding, progressive gymnastics, we w ill also have a track for those athletes who have the talent, commitment and desire to train for the elite program .
Special thanks are also due to Wally Eyman for his computer illustrations, Jamie Madison for help with the video and Carol Stabisevschi for creating the compulsory music - w h ich we w ill hear for the next four years! The minutes of the Women's Elite Program Committee are included in the last issue of Technique. I attended part of this meeting, which took place during the American Classic in ew Haven in March. It was a very important meeting. Because the new FIG code is simply too difficult and too complex for complete implementation w ithin the Junior Olympic program, the United States cam-lOt rely on that program alone to identify and train athletes w ho will ultimately be in the Elite program and eventually represent us as international elites.
I hope that many of you w ho attend the Junior Olympic Workshop will attend the Athlete Wellness Course being offered in conjunction with the Workshop. The Athlete Wellness Program is now in its second year. The Athlete Wellness Course, w hich was first offered at the 1996 Congress and w ill be offered again at the 1997 Congress, is excellent. In addition to the course, the A thlete Wellness Program is focusing this year on the development of the N ational Health Care Referral Network - a listing of sport psychologists, nutritionists, registered dieticians, physicians, athletic trainers, and other h ealth care professionals w ho can be of assistance to gymnasts and coaches. This Referral etwork h as already identified a group of speakers w ho are available at Region al meets this year to discuss Wellness issues w ith athletes and coaches. One of the most exciting components of the program is that m any of these speakers are former gymnasts w ho are uniquely positioned to relate to our athletes and coaches . For several years the T.O.P. (Talent Opportunity Program) has been exp anding as a way to reach talented yo ung athletes and their coaches . The regional TOPs testing n ow is in place in every region of the country, with approximately 1,500 athletes tested every year. COACHES AS EMPLOYEES OR INDEPENDENT d CONTRACTORS?

A
recent Technique article (Morris, 1996) discussed the tax benefits of classifying coaches as independent contractors as opposed to employees. While classification of coaches as independent contractors can provide some benefits, the decision to classify coaches as independent contractors can carry serious legal consequences which the gym owner must consider. This article discusses these consequences under general principles of American common law. Individual state law may vary and legal counsel should always be consulted. Independent contractor status and employee status each carry unique characteristics, benefits, and consequences. An employer is generally liable for the negligence of its employees, must withhold and pay taxes, and must carry worker's compensation insurance. Conversely, true independent contractor status can insulate the employer from liability for negligence of the independent contractor, and eliminate the duties to withhold and pay taxes and to carry worker's compensation insurance. These are attractive benefits. It is critical to note, however, that whether independent contractor status with its attendant benefits exists is not controlled by how the employer labels the relationship.

Even though the tax code provides a better probability of taxpayer success, the victory may be Pyrrhic as the costs and inconvenience of the liability concerns are far more serious. Presumably, the prudent gym owner will continue to carry general liability insurance to protect claims for injuries to athletes and guests. Failure to do so would be disastrous. However, the uninformed business owner will typically terminate worker's compensation insurance coverage since there is no duty to provide workers compensation benefits to an independent contractor. So what happens when a coach suffers a disability producing injury at the gym then properly files a request for worker's compensation benefits Had the gym owner maintained worker's compensation coverage, the claim for benefits would be handled administratively with a minimum of inconvenience. However, if the employer was uninsured, the injured worker will generally have two options both of which are unfavorable to the gym owner.

1. the ability of the gym owner to discharge the coach at will, 2. the inability of a discharged coach to maintain an ac tion for breach of contract based on the discharge, 3. p aym ent by hour or salary rather than a specified amount for a speCifically identified job, 4. ownership of apparatus and trai ning m ate rials, and 5. the ability to control the schedules of gymnas ts and coaches. A legal finding that an employer-employee relationship exis ts can create devastating problems for the gym owner who h ad arranged gym business affairs to take ad vantage of the ben efits of true indep endent contractor status. For instance, a well litigated May 1997
Second, in many states, an injured worker can pursue an action for damages directly against an uninsured employer, in addition to seeking benefits from the uninsured employers fund. This is a mos t unpleasant prospect. The damages available in such an action are not limited as they are a workers compensation forum. Further, in many states, it is presumed that an uninsured employer was at fault in causing the injury, making defending the action very difficult and very costly. This punitive presumption may seem unduly harsh, but it is intended to provide an incentive to obtain wo rker's compensation coverage. Apart from action initiated by the injured worker, the state department of industrial relations may impose stop work orders which will close the gym until insurance is obtained. The department may also seek penalTECHNIQUE

ties and fines for fa ilure to carry insurance. While most business owners would like to think that their employees wo uld not pursue options de trimental to the gym, in the event of long-term disability or significant medical bills, the injured worker may not h ave any other ch oice. Th e business owner must also consider the possibility of a questionable claim or outright fraudulent claim brought by a disgruntled employee which the employer will s till h ave to defend. Certainly, the primary defense ineachcase would be that the coach was not an employee, but an independ ent contrac tor, thus extinguishin g the a ttendant responsibilities. But as previously discussed, it is likely tha t a fi nding will be made tha t the coach was an employee. Even if the gym owner successfully proves that a true independent contracto r sta tus existed or d efeats the claim on other grounds, the cost of hiring counsel to litigate the issues can be as equ ally as devastating as the potential liability exp osure itself. As in an y oth er business, the gym owner must carefully weigh the legal ramifications of its organizational structure. In an industry that involves a high level of physical activity w ith potential for physical injury, especially careful review must be made of liability concerns. When the gym owner considers the costs of a legal defense and potential liability exposure, the costs of treating coaches as employees, carrying proper insurance a nd paying taxes seem minimal.

The result in Morris' article seems d ependent upon Section 530 of the Revenue Act of 1978. The test in Sec tion 530 is wheth er the taxpayer h ad no reasonable basis for not treating the in dividual as an employee. The following criteria must be m et for consideration as a Get It Going grant w inner:
"Get It Going" Introduce Rhythmic Gymnastics to Your Program The USA Gymnastics Get It Going Grant program is d esigned to promote the addition of rhythmic gymnas tics classes to club, school, YMCA, or Park District gymnastics programs who have had little or no rhythmic programming in the past. Twenty people (through application) w ill each receive a grant equivalent of $350 to attend a special Rhythmic Gymnas tics Introductory Workshop at the 1997 Congress in Den ver.
Applicants m ust be employed by a gymnas tics club, YMCA, or Park District program. Applicants must attend eight hours of d esignated Congress sessions plus elective sessions. Applicants will be encouraged to initiate rhy thmic classes in the Fall of 1997.

Background
In November, 1995, the Board of Directors of USA Gymnastics unanimously accepted the recommendations of the Task Force on the USA Gymnastics Response to the Female Athlete Triad. With this action, the Board m ade a commitment to implement those recommendations by funding the USA Gymnastics Athlete Wellness Program. In creating this program, USA Gymnas tics is taking a leading role in developing safeguards to balance some of the stresses elite athletes face.

The Manager of the Athlete Wellness Program is Nancy Thies Marshall. Nancy is a 1972 Olympian, the former Vice-Chair for Women for USA Gymnastics (1992-1996) and the Chair of the Task Force on USA Gymnas tics Response to the Female Athlete Triad .
AWP Coaches Course Description The pilot A thlete Wellness Program Coaches Course was conducted prior to the almual USA Gymnastics Congress and Olympic Trials in Boston, June 27, 1996. The curriculum for this course was developed by Dr. Joan Duda (artis tic national team sport psychologist) , Dr. Gloria Balague (rhythmic national team sport psychologist), and Dr. Dan Benardot (n ational team nutritionist). Over 75 111.en 's, women's and rhythmic National Board members, Regional and State Chairmen, and National Safety Certifiers participated in the 1996 course and subsequent evaluation process . Their feedback is critical to the development of the course w hich will eventually be offered to the general membership through national and regional congresses and regional symposiums.

Upcoming events and National Team rankings
Several members of our Oly mpic Team are not competing this weekend and have been/may be requested for meets in this half of the year. A list of coming meets was passed out for reference. Value and practicality of various invitati ons was discussed. We w ill send athletes to Moscow World Stars March 28-30, Ypres Cup (Belgium) May 17 (Jolu1 MacCread y is invited by name); Puerto Rico International Gymnastics Cup July 17-19, w ith selections for these and the March 21-22 International Team meet to be done this evening before the National Team meeting. We will not send athletes to Romania Cup, Bosphorus Tour. Juniors have a number of opportunities this year. They w ill participate in the Jr. Pacific Alliance to be held in US and a domes tic meet/ training camp w ith Germany. Our best juniors w ill travel to either China or Russia/ Belarus/ Ukraine. Juniors w ill participate in the international tri-meet in March. The Canberra Cup (a December meet) is ano ther possibility, but a timely request hasn' t been received to date.

July 12 Qualification Meets for USA Championships
Bids to host due by April 4. Conference call Thursday, April 24. Sites w ill be ann ounced May 2. No more than fi ve si tes w ill be approved, with regional representation a prime consideration. Use of at least one NAL/ TA in strongly suggested. Meets wi ll be held at the same time, 4 pm EDT (3 pm CDr, 2 pm MDT, 1 pm PDT).

It was determined to take no action on this due to input from the Elite Coaches Associa tion membership received at this morning's meeting. VII. Approval of Previous Minutes Motion to approve the previous minutes of January 29. Mo tion - M. Williams Second - T. Daggett APPROVED - 6-0
Cooperation between groups was lauded . Recent work on the NAL/ T A selections, input from Elite Coaches tod ay and in the National Team Plan development process, lobbying and having legisla tion passed to maintain Olympic sport championships in the NCAA are all examples of excellent teamwork . Prior to recessing Chris Waller was welcomed to the MPC and thanks were extended to Peter Vidma r (in absence) for his years of service.
The meeting was recessed at 3 pm until after the competition this evening. The meeting was reconvened at 8:05 pm.

VISA American Cup: Jolm Roethlisberger (defending champion), Olympic gymnasts; Blaine Wilson and Chainey Umphrey; rank order from 1997 Winter Cup. Interna tional Team meet: Rank order from 1997 Winter Cup Challenge. Invitations: Moscow World Stars _ rank order. [Steve M accepted w ith John M and Jay T. alterna tes]. Belgium, Ypres Cup _ they requested John M. If he declines, go rank order after team meet. [John M accep ted]. Puerto Rico Cup (7/17-19) andSr. Pan Ams (7/2-6) -Rankorderfrom 1997 Winter Cup Challenge. It may be necessary to add the OlympiCTeam members to our national team to allow us to use them in spring events if they weren' t in the Winter Cup. Official News The members of the FIG Executive Committee met in Rome, February 13-14, under the presidenc y of Bruno Grandi (ITA). At the close of the meetings, the following principal decisions were taken: The World Championships of Sports Aerobics 1998 were awarded to the Italian Federation (Rome), and those of 1999 to the German Federation (Hanover) . The exact dates still have to be confirmed. FIG Symposiums: At the time of the 1997 RSG World Championships in Berlin, the FIG will organize three Symposiums devoted to the following themes: October 20-21: Development of Junior Talent in Artistic and Rhythmic Gymnastics October 22-24: Development of Men's Artistic Gymnastics October 25-26: Structures and Schedule of FIG Competitions The Nepalese Federation (NEP) has been provisionally readmitted. Judges panels: Authorities ratified the modifications proposed by the Competitions Commission for a new organization of judges panels and their allocations. In the future, all FIG disciplines must adopt the same structures as their juries. Marks A (starting mark) and B (performance) must be scored simultaneously. Warnings and replacements may be carried out during competitions. Judges' wo rk will be evaluated after competitions based on video images. Proposals supporting the decrease of judges and the standardization of juries A and B are still being assessed.
In November 1996, 13 member federations participated in the General Assembly of the Pacific Alliance in Kuantan (MAS). At this time Jim Barry was re-elected to the Presidency . The next Alliance championships w ill take place for Juniors in 1997 in Houston. The Seniors will meet in 1998 in Winnipeg (CAN) Jul Y 10-12 and in the year 2000 probably at Christchurch (NZL). Henceforth, RSG will rightfully be part of the PANGF disciplines. 11th World Gymnaestrada The Swedish organizers of the 11 th World Gymnaestrada have just published their first information Bulletin. Welcome, program, location layou t, cultural activities, etc. - nothing is missing! In the chapter regarding no velties, we are impressed by the organization of a yo uth mega-camp . The opportunity will be offered to 500 adolescents, from all parts of the World to get better acquainted with Sweden and the Swedish people, to train together, to fraternize wi th other gymnasts from other countries, and to encourage a better understanding between the world's people. This is a new and superb initiative of the Organizing Committee, which allows young gymnasts to create strong and lasting ties, founded on the development of physical and moral values w hich bring to mind and defend the Statutes of the FIG. World Championships in Lausanne On March 1,58 national federations had returned their provisional registration forms for the World Championships in Lausanne to the FIG Secretariat. To date, the following are registered: 42 men's teams; 32 women's teams; 31 individual male gymnasts; and 49 individual female gymnasts.
The updating of the Apparatus Brochure was confirmed. Furthermore, in light of the General Assembly's decision to include 20 cm landing mats in Women's competitions, a height adjustment of respective apparatus (beam and uneven bars) will be necessary. The Federations w ill be informed of the new dimensions. In 1999, the Artistic World Championships of Tianjin (CHN) as well as the RSG in Osaka (JPN) w ill be the qualification for gymnasts desiring to attend the Olympic Games 2000 in Sydney.

WOULD YOU LIKE FOR YOUR CLUB TO PERFORM AT NATIONAL CONGRESS? During the 1997 National Congress, selected clubs will be able to do general gymnastics display performances in the Exhibition Hall. This year, the Exhibition Hall will include a performance area measuring 60' x 80' with a 42' x 42' AAI floor exercise area (carpet plus mat - NO spring floor). Selected groups will be able to perform their display routines in this area during the Congress Exhibition Hall showtimes. The routines should be choreographed to music and last no longer than 10 minutes. Limited equipment and matting w ill be available. Each group is responsible for their own costumes, props, etc.

Minutes of the June, 1996, m eeting were reviewed and approved as written.

President's Report
The Opernting Code was rev iewed as amended from the last meeting. The year end financial report was presented . For the first time in several years JCI has ended the year in the black thanks to everyone's working to avoid unnecessary expenses such as extra mailings, ulU1ecessary phone calls, etc. The 1997 budget was presented with discussion follow ing. Due to the additional expense related to production of the new written and practical exams two new ca tegories were added to the budge t. Motion to accept the 1997 Budget as amended. PASSED The Varina Frenclr Recovery Fund was closed when a check for just over $10,000 was sent to Varina along with the names of everyone/ organization that contributed . A thank you letter was sent from JCI to everyone w ho contributed . We thank you all again. Motion to purchase a fax machine for Ammerman's office and for her to get a separate phone line for the fax machine. PASSED Discussion occurred concerning the purchase of a new Scantron for the new cycle. The President will obtain information as to cos t, etc. , and report direc tly to the Board within a month so that a decision can be reached on the feasibility of such purchase.

Certification Coordinator's Report - R. Niccollai
A. The almual ratings report was presented (Exhibit A) . This report w ill
continue to be presented in the new cycle w ith modifications. The state with the few est and grea tes t number of judges will be eliminated . The passing rate for the practical w ill be by levels. A report showing the number of test administra tions by state w ill be added . B. The current list of active TA's was presented w ith discussion rega rding the problems Rene has had w ith some of them in terms of procedures. The President addressed scheduled test administrations that had been scheduled during the year, but no report had been made for them. All but one had been canceled w ith failure to notify JCI of the cancellati on . One tes t had been given in October, but the test were never sent for grad ing. This is a major problem fo r those ind ividuals that tes ted but never received res ults. We have asked USA Gymnastics (Maloney) to foll ow up on this since the TA is a state chairman fo r USA Gymnastucs. May 1997
The TA's w ho have failed to follow professional standards in the administration of the exam w ill not be allowed to schedule the exam until the problems are cleared up. The TA workshops scheduled for the NAWGJ Symposium and USA Gynmastics Na tional Congress w ill be directed by Rene. All TA's must attend to be eligible to administer the exams in the new cycle. In addition, in the future the following policies w ill be in effect: If a T A has not given the test within a year after having attend a workshop, they must attend another T A Workshop before being allowed to administer the exam. If a T A has been notified in writing of any irregularities in the procedures of the administration of the exams and/or report forms, they must attend another T A Workshop before being allowed to administer the exam. The new TA Guide w ill be given out to all TA's attending the workshops this summer. C. Level 10 Re-certification procedures The follow ing to pics were disc ussed regarding proced ures for the recertification of Level 10 program: 1 umber of eli gible judges and sites for course. N umber of individuals to teach the course. N umber of hours needed and how that time was to be spent. No tification and registration of attend ees. Cos t of program for JCI and for attend ees. A list of all eligible Level 10 Judges(have passed the Level 10 exam tw ice w ithin the las t two cycles) w ill be generated by the Certification office. Each eligible judge w ill be sent a letter of invitation with a registration form. This form must be sent to JCI w ith the fee of $30 by the due d ate. Motion that based upon the number of eligible Level10 judges, JCI will offer the Level 10 Re-certification course only at the four national sites, USAG-WTC symposiums in Reno, NV and Providence, RJ, NAWGJ National Symposium in Miami, FL and the USAG Gymnastic Congress in Denver, CO. The course will be 8 hours, two hours for each event with vault and general being combined. Each two hour session will consist of brief overview of the new rules, practice judging of Level 10 routines with the new rules, and a 10 question self-grading written exam to be administered at the end of the session along with questions and answers. USAG-WTC members C. Hamilton and M. Dykes will be the course instructors for all four courses. PASSED (see below )
NOTE:After the Presiden t met witlr the USAG-WTC, tire fo llowing change was made to tire above motion. If a judge is unable to attend one of these four re-certification courses he/she may obtain their rating by attending a regional course or by testing as in the past.
Regional courses will have the same requirements as the national cou rses. Costs for the regional courses will be the responsibility of the region sponsoring the course. All registration for all the Level lOre-certification courses w ill be administered by JCI. D. Level 10 testing w ill be administered in the new cycle the same as in the past cycle. Any ac tive TA w ho has interest in becoming a Level 10 TA should fill out the attached form(Exhibit B) . Please read carefull y the requirements for holding this position . New Level 10 T A' s w ill be appointed by JCI as soon as possible.

V. Vice· President, Examinations report - C. Hamilton A. The annual wri tten report was presented to the Board with the following information included: The new compulsory tests are completed and being proofed at the present time The optional exam writers have been contacted and w ill begin their work as soon as the USA Gymnastics completes their work on the new rules for Junior Olympic competition. The optional exams were videoed at the Buckeye Classic. They will be evaluated by the USAG-WTC, March 1-3 and also by the judges at J.O Na tionals in May. B. Disc ussion occurred regarding the different levels of testing in light of the rules es tablished by USAG. Motion to have the following testing leve ls for the optional exams. Written Level 7/8 - 70% re quired to pass Level 9 - 76% required to pass Level 10 - 80 % required to pass Practical Level 8 - 70% required to pass Level 9 - 75% required to pass Level 10 - 80% required to pass PASSED All other requirements remain as they have been in the present cycle. Motion made that all individuals directly involved in writing the compulsory routines and the deductions will be exempt from the Level 5/6 compulsory exam. PASSED V.

Sroufe The written report presented proposals for JCI testing at the NAWGJ Symposium and USAG Congress. After discussion on the proposals the report was accep ted . Betty will work w ith the Symposium and the Congress direc tor on the se t-up needed for the tests. The Registration form for the JCI test administrations at the Symposium and Congress was reviewed and revised. It will be included in the NAWGJ National newsletter as well as Technique . JCI Board members as well as additional TA's were assigned as assistants for the tes t administration at the SympOSium. Proctors must arrive at 8:00 a.m., testees must arrive at 8:30 a.m ., exams begin at 9:00 a.m. They are: Written exams - B. Sroufe Assistants: D. Darst, B. Heppner, and C. McLane Practical exams - R. iccollai Assistants: S. Ammerman, C. Hamilton, and B. Synol TA workshops were planned for NAWGJ TNs at the IAWGJ Symposium and for USAG T A's at the USA Gymnastics Na tional Congress. The schedule at the Symposium will be Wednesday, June 25'h, in the PM for 1 1/2 hours. A similar session will be arranged for the USA Gymnastics I ational Congress. Ac tive Status Coordinators workshop w ill also be held at the Symposium. It is schedu led for State Judging Direc tors and/ or Ac tive Status COOl'dinators for Thursday, June 26 in the morning for one hour. Update on Rome FIG/MTC meeting
G. Beckstead reported on ac tivities. The top 90% of those who a ttended the FIG course in December are eligible for A-panel assignments. Many concerns were covered . Beckstead w ill host the nex t FIG /MTC meeting in San Pedro, CA during the last weekend of May (four days). The committee can answer any questions that we pose at this time. Most ques tions were an swe red clearly at the Rome meeting. It is important to be specific in asking questions. The Rome meeting ran very well and everyone had an opportunity to speak and discuss items.

At present, the approved procedure does not allow a one-touch warm-up. Elite coaches overwhelmingly approved this last year. Is this in the best interest of the athlete? Should we re-align warm-up procedure w ith international procedures? R. Brant will be asked to poll the elite coaches for their current opinions.

The Winter Cup has been regularly scheduled for 2nd weekend of February: 1998 - 13-14; 1999 -12-13; 2000 -11-12. D. McIntyre has a list of suggestions regarding format and qualification to the meet. There is value for nonNCAA gymnasts. This paper w iII be fa xed to MPC members today. Suggested qualifiers include all w ho qu alified to previous U.s. Gymnas tics Championships, top 20 at previous J.O. Na tionals, both JE1 and JE2, plus approved petitions. Prelim session(s) cut to top 36 for second day. Prize money ex plained: $13,000+. Consequently, all difficulties not cited in the examples remain valuable on the condition that they respect the criteria defined by the Code. It particularly involves: 1.
