Risk Management in Regulatory Frameworks: Towards a Better Management of Risks

UNITED NATIONS ECONOMIC COMMISSION FOR EUROPE

Risk Management

Ján Kubiš, Special Representative and Head of the United Nations Assistance Mission in Afghanistan

This publication provides an insight into how risk management standards and guidelines can be applied not just to enhance the management of risk within a single entity, but also to provide an effective way of ensuring the efficiency of regulatory systems for all stakeholders. It calls for a broader application of international risk management related standards by regulators and business companies globally as a way of facilitating trade and commerce”. Kevin W Knight AM, Chairman, ISO Technical Committee 262 - Risk Management.

This publication explains complicated theoretical concepts of risk management in an easy to understand manner and presents a methodology of how these concepts can be applied to building regulatory systems. It is well-structured and full of examples. Our students will certainly find it valuable reading as will all those who are interested in practical risk management”.

Towards a better management of risks

Towards a better management of risks

“The main purpose of the UN is to enable its member States to better shield their peoples from natural and man-made hazards. This publication addresses the need for a structured and inclusive decision-making process to manage risks and to achieve the desired level of safety without stifling economic growth. It will help the UN and its member States to apply risk management as a central process underlying all regulatory activity, involving all stakeholders at the highest level of policy-making. As such, it is intended to assist policymakers, regulators, and businesses in building regulatory systems aimed at effectively mastering the risks that confront our families, our communities and our planet."

Risk Management in Regulatory Frameworks_cvr 04 February 2013 11:27:36

A flurry of extreme weather events, together with projections that grow more somber with every new scientific advance, have dramatically highlighted the need to respond more effectively to the threats already upon humankind. In the midst of a rapidly expanding global adaptation agenda, it is of primary importance to get adaptation and its constituent parts right, in order to generate the most appropriate and effective interventions. Reacting to events after they occur is no longer sufficient; we increasingly need to anticipate and reduce the suffering and the enormously damaging impacts coming events will cause. This book addresses a major gap in adaptation efforts to date by pointing to the vital role that an understanding of population dynamics and an extensive use of demographic data have in developing pre-emptive and effective adaptation policies and practices. Politics and an oversimplified understanding of demographic dynamics have long kept population issues out of serious discussions in the framework of climate negotiations. Within adaptation actions, however, this is beginning to change, and this volume is intended to provide a framework for taking that change forward, towards better, more evidence-based adaptation. It provides key concepts linking demography and adaptation, data foundations and techniques for analyzing climate vulnerability, as well as case studies where these concepts and analyses illuminate who is vulnerable and how to help build their resilience.

Recent years have been marked by many catastrophic events both natural and man-made. Close interconnections mean that the impact of these crises has been felt throughout the world. Although many tools have been developed to manage risks successfully, there can be no doubt that many of the losses we have recently witnessed could have been prevented, or minimized, in the context of an effective and well-balanced regulatory system. The goal of this publication is to provide insights and recommendations for policymakers on designing regulatory systems that result in an efficient, effective and transparent management of risks. This is a practical book. It introduces a holistic model of a regulatory system, function by function and with real-life examples, which is based on the objective of managing risks effectively. Spring Summer 2013

Local Commons and Democratic Environmental Governance

Providing a much-needed antidote in this age of globalization, this volume advances the idea of collaborative governance as an integration of open and closed commons. Taking into consideration the dimension of conflict resolution, it studies examples of governance structures in various countries around the world to develop a new type of democracy towards multilevel environmental governance that involves the public, private and commons spheres. With contributions from researchers in a wide variety of disciplines, this volume demonstrates through institutional and empirical analyses the essential role of local commons in providing an axis of resistance to increasing environmental devastation and social inequality towards creating a sustainable future for local communities as well as society at large. Reducing Vulnerability and Exposure to Disasters The Asia-Pacific Disaster Report 2012

un.org/publications

This report is a product of cities’ and local governments’ efforts to protect their cities and make them safer and productive places to live and work. Today, with more that half of the world’s population living in urban areas, building resilience to natural hazards has become a pressing challenge that cannot be ignored. Recognition of the inextricable links among disaster risk reduction, climate change adaptation and sustainable development reveals the critical challenges that still remain. UNISDR and global partners in the Making Cities Resilient Campaign: My City is Getting Ready! continue to accompany local authorities as they tackle these issues and take action to minimize the impact of natural hazards on those most at risk. Technology and Innovation Report 2011: Powering Development with Renewable Energy Technologies

This report argues that responding to the dual challenge of reducing energy poverty and mitigating climate change requires a new energy paradigm. Such a paradigm would have renewable energy technologies complementing (and eventually substituting) conventional energy sources in efforts to alleviate energy poverty across the developing world. This is a realistic paradigm given that the world is faced with energy poverty issues that cannot be resolved using conventional fuel sources without risking irreversible climate change. In finding newer energy solutions that integrate renewable energy with existing energy sources, developing countries will need to develop technology and innovation capabilities. This report seeks to contribute to new policy insights in this extremely complex area. Migration, Environment and Climate Change: Assessing the Evidence

Gradual and sudden environmental changes are resulting in substantial human movement and displacement, and the scale of such flows, both internal and cross-border, is expected to rise with unprecedented impacts on lives and livelihoods. Despite the potential challenge, there has been a lack of strategic thinking about this policy. Adequately planning for and managing environmentally-induced migration will be critical for human security. The papers in this volume were first presented at the Research Workshop on Migration and the Environment: Developing a Global Research Agenda held in Munich, Germany, in April 2008, which addressed the need for more sound empirical research and identify priority areas of research for policy makers in the field of migration and the environment. Final Environmental Review of the 2010 World Exposition: Shanghai, China

Expo 2010 took place in Shanghai, China, from May-October 2010, under the theme, “Better City, Better Life.” This review looks at the quantitative and qualitative environmental impact of Expo 2010, and its long-term influence on the development of Shanghai and surrounding areas. It highlights the city’s development of a 400-kilometer rapid transit network, a significant improvement of municipal planning and management systems, climate change mitigation efforts estimated to have mitigated 4,341 kilotons of carbon dioxide (CO2) equivalent, and the use of LED lighting in nearly 100 percent of the Expo buildings. World Urbanization Prospects: The 2011 Revision (CD-ROM)

The 2011 Revision presents estimates and projections of the total, urban and rural populations of the world for the period 1950-2050. The results are shown for development groups, six major areas (i.e., Africa, Asia, Europe, Latin America and the Caribbean, Northern America and Oceania) and 21 regions. Data are further presented for the 231 countries or areas of the world. The 2011 Revision also provides estimates and projections of the population of urban agglomerations with at least 750,000 inhabitants in 2011 for the period 1950-2025. Estimates of the proportion of the population living in urban areas and the population of cities are based on national statistics. Business and Climate Policy: The Potentials and Pitfalls of Private Voluntary Programs

Climate change has become one of the most important and challenging global policy fields. Attention has primarily focused on the successes and failures of States and intergovernmental organizations but many more actors are involved and contribute solutions. The contributions to this book assess the different potentials of existing schemes. They scrutinize how very different programmes at national and international levels seek to marry complex public and private goals in and across industries addressing wide groups of firms. Lessons from these programmes can help design and improve programmes but they also show different types of pitfalls. Lessons learned are relevant not only for climate policy, but for the many other policy fields where private voluntary programmes are active. Climate-smart Trade and Investment in Asia and the Pacific: Towards a Triple-win Outcome

Trade and investment indirectly contribute to greenhouse gas emissions through the energy used in associated production and transportation processes to the extent that energy is generated on the basis of fossil fuels. However, if technologies can be developed and distributed which are clean and contribute to energy efficiency and conservation or use renewable energy, then trade and investment will be part of the solution rather than the problem. This publication makes a strong case for trade and investment in climate-smart goods and services, in particular climate-smart technologies resulting in a triple win for economic growth, trade and environment. The Business Case for the Green Economy: Sustainable Return on Investment

Examples in this report, from both developed and developing countries, from small-size companies to large multinationals, demonstrate how integrating sustainability into core business activities can generate a positive return on investment. Returns that go beyond the financial component and contribute to the socio-economic and environmental framework conditions necessary for business to grow and operate successfully. The Least Developed Countries Report 2013: Growth with Employment for Inclusive and Sustainable Development

UN estimates show that Least Developed Countries (LDCs) population will grow rapidly to 1,500 million by 2040 from today’s 880 million, and the labour force will almost double. Approximately 130 million people in LDCs will be entering the labour force until 2020, which makes creating employment opportunities a real challenge. The report aims to raise awareness and galvanize the attention of policy makers to the magnitude of the problem. It also reviews and analyses recent labour market performance of the LDCs, compares it with the future needs in relation to job creation, and elaborates concrete policy recommendations for growth with employment. Global Sustainable Development Report 2013

E CO NO M IC AN D S OCI A L S T U D I ES

This report aims to contribute to strengthening the global science-policy interface, in order to support science-based decision making. The report provides the first-ever comprehensive mapping of assessments for sustainable development. It assesses global progress towards sustainable development in all its dimensions, discusses future pathways towards sustainable development, offers options and means to achieve them and ways to better monitor and measure progress in the future. The benefits of integrated decision-making are illustrated with national case studies of the climate-landenergy-water-development nexus. The report is expected to provide a firm scientific basis for the intergovernmental deliberations at the High-level Political Forum on Sustainable Development in September 2013. Financing Human Development in Africa, Asia and the Middle East

This book assesses feasible financing strategies for policymakers to follow in pursuance of human development, taking as reference the United Nations’ Millennium Development Goals (MDGs) and their achievement by 2015. These strategies are analysed in the context of broader concerns of economic development with special reference to nine countries from Africa, Asia and the Middle East; that is, how to make macroeconomic policies support more effectively sustained growth while reducing widespread poverty and inequalities and other human development gaps in low- and middle-income countries, especially in times of global economic crises or external shocks. In this sense, this book adds new evidence regarding the social deficits in these countries and suggests policy options to overcome them. Economic Development in Africa Report 2013: Boosting intra-African Trade - What Role for the African Private Sector?

This report argues that for African countries to reap developmental gains from intra-African trade and regional integration, they need to place the building of productive capacities and domestic entrepreneurship at the heart of the policy agenda for boosting intra-regional trade. It also analyzes the range of strategies and complementary policies that will be needed, besides trade policies, to ensure that regional integration enhances African enterprise development and economic development in general. It explores, among others, the role of national and regional industrial policy and the scope for developing regional development corridors. Lessons are drawn from other developmental regional experiences. World Economic and Social Survey 2013: Post-2015 Strategies for Development and Progress

The 2015 deadline to meet the targets of the Millennium Development Goals is fast approaching. There has been significant progress, but it is uneven. Meanwhile the context within which development goals are pursued has become much more challenging, visible in the recent food, fuel and financial crises. Environmental degradation, demographic changes and persistent inequalities further threaten progress. The WESS 2013 discusses new directions and policies at the national and international level to achieve transformative change and sustainable development post-2015. International Cooperation for Sustainable Development

The report reviews trends in international development cooperation, including commitments and quality and impact of development assistance. It analyses a broad range of issues that affect the effectiveness of development cooperation. Building on the DCF’s work, special emphasis was placed on mutual accountability on development cooperation as well as SouthSouth and triangular cooperation. The report also examines the implications of putting sustainable development at the heart of a post 2015 UN development for the future of development cooperation. This second independent International Development Cooperation Report draws upon analysis produced in connection with the 2012 biennial Development Cooperation Forum. Like the Forum itself, the report pays particular attention to the views of various stakeholders. Publisher: United Nations Publication Date: June 2013 ISBN: 9789211046878 Pages: 200 Price: $20.00

Report of the World Social Situation 2013: Inequality Matters

The 2013 report examines the key drivers of inequality that have emerged in the recent past and the impact of rising inequality. It examines key trends in social, economic and spatial inequalities and assesses why inequality matters in order to propose policy solutions to this persistent problem, paying particular attention to the potential role of empowerment and participation. The report highlights inequalities within and across countries and shows the cumulative, mutually-reinforcing effects these inequalities have on the systematic lack of participation and disadvantage of some social groups and on the intergenerational transmission of poverty. The report discusses the role of economic and political institutions in promoting participation and empowerment. World Youth Report: Youth Employment - Youth Perspectives on the Pursuit of Decent Work in Changing Times

This is a biennially recurring publication of the United Nations. This edition is largely based on an e-discussion with young people and representatives of youth-led organizations on the transition from schools and training institutions into the world of work. It shares the participants’ views, experiences and recommendations on preparing for, entering, and remaining active in the labour force. Young people are crucial stakeholders in the pursuit of decent and productive work for all, often pioneers in their respective fields, yet, too frequently, their voices go unheard particularly with decision-makers. This report brings young people’s voices into the forefront where youth issues are discussed and acted upon. Economic Report on Africa 2013: Making the Most of Africa’s Commodities Industrializing for Growth, Jobs and Economic Transformation

Africa’s growth plummeted during its ‘lost decades’ of the 1980s and 1990s while unemployment soared, and production and export bases became more concentrated. Africa boasts significant human and natural resources that can be used to promote industrialization and structural economic transformation through value-addition strategies in all sectors. This publication examines key constraints and opportunities for African countries to make the most of their commodities by adding value through linkage development. It also addresses how African countries can design and implement policies to promote value addition and economic transformation, and reduce their dependence on producing and exporting unprocessed commodities. Social Panorama of Latin America 2012

To cast new light on social inequality, the latest edition of Social Panorama of Latin America is devoted mainly to aspects of caregiving on which systematized information for the region has not been available hitherto: paid employment in carerelated activities, household expenditure on care, and the situation and care needs of persons with disabilities. This edition aims, in fact, to generate knowledge on a link in the chain of social reproduction which has long been sidestepped by public policy, since the issue made little inroads into the discussion or the policy agendas of the countries of Latin America and the Caribbean until a few years ago. Preliminary Overview of the Economies of Latin America and the Caribbean 2012

The 2012 edition of the Preliminary Overview of the Economies of Latin America and the Caribbean analyzes the impact of the global economic crisis in the region. In general terms, the region’s economy proved resilient, despite the global economic downturn. The monetary policy was slightly expansionary during 2012, the fiscal position deteriorated in most of the countries, but fiscal policies remained predominantly prudent, employment and wages rose, with unemployment falling more among women than among men. The economic outlook for Latin America and the Caribbean depends heavily on how the global economy will evolve in 2013. Development Financing and Economic Insecurity

Despite the rise in recent decades in the average income level, economic insecurity has also increased. True for both developing and developed countries, this increasing economic insecurity is harmful for human welfare for several reasons. Job and income insecurity directly affect the material and psychological well-being of people. Economic volatility and high uncertainty also tend to exert negative influence on productive investment, thereby hurting long-term development. This book sheds light on the causes of economic insecurity and how better functioning financial systems, more effective macroeconomic policies and extended micro-financing schemes could mitigate the degree of economic insecurity in developing countries and overcome many of its negative consequences. Towards Human Resilience: Sustaining MDG Progress in an Age of Economic Uncertainty

E CO NO M IC AN D S OCI A L S T U D I ES

The global economic crisis has reinforced concerns about the impact of financial and economic shocks on human development. The increasing frequency of such shocks raises questions about their systemic character and the ability of developing countries to withstand the negative impacts of economic uncertainty. Indeed, vulnerability to macro-level shocks has the potential of significantly slowing progress towards the Millennium Development Goals. This report addresses essential questions about economic vulnerability and resilience. Most significantly, it explores how macro-economic crises affect vulnerable economies, what structural characteristics make economies susceptible to the harmful effects of such shocks, and what policies can help developing economies build resilience in the face of unpredictable economic change. Jacketed Women: Qualitative Research Methodologies on Sexualities and Gender in Africa

In 2004, the African Gender Institute ran a continental research project, Mapping Sexualities, among the objectives of which was the development of a research methodology suited to carrying out in-depth case studies of the dynamics of gender and contemporary sexual cultures in Ghana, Nigeria, South Africa and Uganda. This book is the result of that research. The chapters cover broad-ranging issues and include questions about what it means to research topics that are unpopular or fraught with the sense of the taboo that underpins much work in sexualities and gender studies. Overall, the diverse pieces within the collection offer the opportunity to see qualitative research not as the ‘poor cousin’ of quantitative studies but as a zone which raises intellectual and political challenges. UNITED NATIONS ECONOMIC COMMISSION FOR EUROPE

This publication sheds light on innovative entrepreneurship and difficulties that entrepreneurs face when creating businesses based on research and development results. The legal and regulatory conditions for enterprise development and the existing infrastructure for applied research are explored. Sources of financing for innovative entrepreneurs and roles of specialized financial providers are explored. Highlighted is the need to strengthen linkages between institutions that generate knowledge and the firms that strive to use it commercially. The publication discusses government policies facilitating the emergence of new innovation-based enterprises, its initial growth, identifying bottlenecks and suggesting corrective action for governments and other stakeholders. World Economic Situation and Prospects 2013

The World Economic Situation and Prospects (WESP) is the definitive report of the United Nations on the state of the world economy. It highlights the continuing Euro debt crisis, the protracted jobs crisis and the possibility for the world economy to plunge back into another recession. One of the most highly anticipated economic reports from the United Nations, it is jointly produced by the UN Department of Economic and Social Affairs, the UN Conference on Trade and Development and the five United Nations Regional Commissions. Publisher: United Nations Publication Date: January 2013 ISBN: 9789211091663 Pages: 206 Price: $30.00

Globalization and Development in Sub-Saharan Africa

This publication critically reviews the effects of globalization on sub-Saharan Africa over the last three decades. The large gains expected from opening up to international economic forces have, to date, been limited, while there have been significant adverse consequences. Foreign direct investment in the region has been largely confined to resource—especially mineral—extraction, even as continuing capital flight has reduced financial resources available for productive investments. Premature trade liberalization has undermined prospects for the economic development of productive capacities in many sectors – including manufacturing and agriculture -- which are not sufficiently competitive to take advantage of improvements in market access. The Hidden Alternative: Co-operative Values, Past, Present and Future

The hidden alternative Co-operative values, past, present and future Edited by Anthony Webster, Alyson Brown, David Stewart, John K. Walton and Linda Shaw

In light of the recent global economic recession, this publication seeks to challenge the hegemony of the investor led business model in economics and business studies, and needs to be promoted in relation to these debates. The contributions to this book demonstrate that cooperation offers a real and much needed alternative for the organization of human economic and social affairs, one that should establish its place at the forefront of public and academic discussion and policy making. It includes chapters on education, fair trade, politics and governance, planning, and sustainability and on how cooperatives have coped with the global economic crisis. Public Works and Social Protection in Sub-Saharan Africa: Do Public Works Work for the Poor?

Public Works Programmes (PWPs) are widely implemented in developing countries, often with funding from major international donor agencies. They provide employment for the chronically poor while creating assets for the state, offering a transfer of welfare which is also a tangible economic investment. This book critically explores the concept of the PWPs and questions their social protection performance in the context of chronic poverty. It reviews over 200 PWPs in eastern and southern Africa, using original research drawn from extensive field analysis, interviews and survey work. It also examines case studies of six international PWPs — in India, Argentina, Ireland, Ethiopia, Indonesia and the USA. It is argued that the current PWPs approach may need to be revisited. Evaluation of UNDP Partnership with Global Funds and Philanthropic Foundations

The evaluation recommends that UNDP should engage more consistently with global funds and philanthropic foundations to develop mutual approaches to development challenges. UNDP should place more explicit emphasis on the central importance of mainstreaming a human development perspective and developing national capacity. UNDP needs stronger central coordination of information and knowledge management functions in order to facilitate a more strategic approach, and should develop a partnership strategy for engaging with philanthropic foundations. As UNDP prepares to develop a new Strategic Plan against the background of a development cooperation architecture that is in considerable flux, this may be a key moment for decision-making with respect to UNDP partnership initiatives. Championing Children’s Rights: A Global Study of Independent Human Rights Institutions for Children

Independent institutions bring an explicit child focus to traditional adult-oriented governance systems. Acting as direct mechanisms for accountability, they fill gaps in checks and balances and make sure that the impact of policy and practice on children’s rights is understood and recognized. At a time of global economic uncertainty, a period in which inequities between rich and poor are widening, and a period of reflection on progress towards achieving the Millenium Development Goals and in defining what sustainable and equitable goals should come after, these institutions are key players in promoting systems that are effective in delivering results for children. Crushed Hopes: Underemployment and Deskilling among Skilled Migrant Women

This report is a collective publication comprising a review of international literature on the subject of migrant deskilling and underemployment from a gender perspective and three empirical case studies from Switzerland, Canada and the United Kingdom. It explores the disproportionate difficulties skilled migrant women can face in transferring their skills and finding employment commensurate with their education when relocating to a new country. The case studies highlight situations in which migratory status and labour market dynamics can combine to constrain skilled and highly skilled migrant women to low-skilled occupations despite their often high human capital. They also analyse the impact that such occupational downgrading can have on migrant women’s well-being and the strategies that women can adopt to regain a professional status. Escaping Victimhood

Edited by

Albrecht Schnabel & Anara Tabyshalieva

This publication draws on experiences from post-conflict environments in different parts of the world. The authors examine the proactive roles of girls and boys in promoting security for themselves and their families. The publication focuses on children’s suffering and their specific vulnerabilities during and after a war. It also looks into the international legal frameworks created to protect and empower children and youth in post-conflict environments, and gives examples of initiatives to help young people escape victimhood and voicelessness. As the young post-war generation will become the next leaders, parents and teachers, ensuring children and youth’s active role in post-conflict peacebuilding today could be among the most effective means of building sustainable peace tomorrow. The first chapter describes the international legal and policy frameworks for women’s right to adequate housing. Basic Training Manual on Investigating and Prosecuting the Smuggling of Migrants

Migration is one of the great driving forces of human progress and development. The movement of people around the globe has contributed many stories to the shared history of humanity. People have moved all over the world for a variety of reasons: to increase economic opportunities, to provide their children with an education, to find a family, to embark on an adventure or to seek protection. In turn, migration has led to the proliferation of languages, cultures, cuisines and ideas throughout the world. Global migration today is one of the great by-products of globalization, and yet the exploitation of it by profit-seeking criminals represents a darker side of the phenomenon. Defying Victimhood: Women and Post-conflict Peacebuilding

Women are among the most competent, yet marginalized and underutilized actors in efforts to rebuild war-torn societies. Opportunities for sustainable peacebuilding are lost and sustainable peace at risk when significant stakeholders in a society’s future peace are excluded from healing the wounds of war, and building a new society and State. The contributors to this book draw on comparative case and country studies from post-conflict contexts in different parts of the world to offer insights into frameworks for understanding women as both victims and peacebuilders; to trace the road that women take from victimhood to empowerment and to highlight the essential partnerships between women and children and how they contribute to peace. Inclusive Social Protection in Latin America: A Comprehensive, Rights-based Approach

This publication examines the main debates under way on social protection and co-responsibility transfer programmes. It identifies the role played by these programmes and considers the conceptual elements, needs and the challenges that will have to be overcome to consolidate comprehensive social protection systems in Latin America. The authors argue that these should be solidarity-based systems that provide universal coverage and are essentially egalitarian in the guarantees established as citizens’ rights. Citizenship as a whole is thus becoming part of protection policies as the region moves towards all-encompassing social policies that combine the complementary principles of targeting as the instrument and universality as the end. Intellectual Property Commercialization: Policy Options and Practical Instruments

Innovation is the key driver of economic growth and development. A well-balanced, affordable and reliable system of intellectual property rights is needed to protect the often large and highly risky investments of innovative and creative companies against potential imitators and thereby provide key incentives to undertake such investments in the first place. Countries with economies in transition face particular challenges to integrate into global production networks and to find their own niche in the increasingly global value chains. This book discusses intellectual property management and focuses on the challenges that research organizations and small/medium enterprises face in using the intellectual property system, particularly in transition countries, and on the policy options available to support them. Guidelines on Citizens Engagement for Development Management and Public Governance

I NT E RN AT I ONA L L AW/GOV ER N A N CE

Countries emerging from conflict situations are almost always plagued by social upheaval, damaged infrastructure, reduced productive capacity, severe revenue shortfalls, seriously weakened human resources and greatly diminished security. The challenges are daunting as post-conflict governments strive to ensure peace and security, foster social reconciliation and promote development. As there are no “one size fits all” solutions to governance challenges, public administration reforms should be tailored to local needs. This report highlights that post-conflict situations not only present challenges, but also offer opportunities to leapfrog stages of development by adopting innovative practices in public administration, particularly the application of ICTs in government and service delivery in the information age. UNCITRAL Legislative Guide on Insolvency Law, Part Three: Treatment of Enterprise Groups in Insolvency

Adopted in 2010, this text is designed to provide timely guidance to States on how to develop and improve the administration of the insolvency of enterprise groups, both domestically and in the cross-border context. It recognizes that the business of corporations is increasingly conducted, both domestically and internationally, through enterprise groups, which are therefore an important feature of the global economy and significant to international trade and commerce. Notwithstanding that significance, and the importance of knowing how a group will be treated in insolvency if its business fails, as well as the need for fast and efficient resolution of its financial difficulties, the Commission noted that very few, if any, States recognized enterprise groups as distinct legal entities or had a comprehensive regime for their treatment in insolvency. Reflections on the Regional Seminar on Local Governments and Indigenous Peoples

The main objective of this report is to record experiences of local governance and indigenous peoples in seven countries in Latin America (Bolivia, Colombia, Guatemala, Mexico, Nicaragua, Paraguay and Peru). It neither qualifies nor compares experiences. It is rather an attempt to analyse and understand seven different dynamics in their respective political contexts, with their respective protagonists, achievements and challenges. It is intended to complement broader efforts and to offer a reflection as a programming and policy input. A basic framework emerges to understand the design, implementation, critical situations and other elements needed to support local governance and indigenous peoples. ORGANIZED CRIME AND INSTABILITY IN CENTRAL AFRICA A Threat Assessment

IN TE RN ATIO N AL L AW/GOV E RN AN CE

Organized Crime and Instability in Central Africa

No area of the world faces a greater challenge with regard to resource-related conflict than Central Africa. The violence and instability in the region has cost millions of lives, ranking among the most deadly in recent history. All those presently indicted by the International Criminal Court come from Central Africa, broadly defined, and more children are exploited in armed conflict in Central Africa than in any other part of the world. While the causes of the conflict are complex, there can be little doubt that resource theft and smuggling have enabled armed groups and perpetuated an environment of lawlessness and impunity. This publication assesses the mechanics of how contraband and resource smuggling fuel conflict, prolong instability and retard development. Friend or Foe? Dominant Party Systems in Southern Africa: Insights from the Developing World

Within southern Africa, there is an observable increase in dominant party systems, in which one political party dominates over a prolonged period of time, within a democratic system with regular elections. This book seeks to understand this trend and its implications for southern Africa’s democracies by comparing such systems in southern Africa with others in the developing world. Zimbabwe stands out as a concerning example of the direction a dominant party can take: regression into authoritarianism. India, South Korea and the territory of Taiwan present alternative routes for the dominant party system. This book poses the question of which route Botswana, Namibia and South Africa are taking, and draws conclusions as to whether these countries are moving towards liberal democracy, authoritarianism or a road in between. Is Good Governance Good for Development?

Whilst good governance is a worthy goal by itself, this book argues that it is not a prerequisite for economic growth or development. Challenging the conventional good governance paradigm favoured by the donor community, this book exposes the methodological shortcomings of the commonly-used governance indicators developed within the World Bank. It argues that aggregate good governance indicators are less helpful for identifying governance failure in specific areas needing policy interventions. Bringing together contributions from leading political scientists, political economists and development practitioners, this is the first book that focuses on such good governance issues. Trade and Development Report 2013: Winds of Change in the World Economy - Rethinking Development Strategies

The shape of the world economy has changed significantly over the last two decades, with a rising importance of several developing countries and regions as additional drivers of global economic growth. The main objective of this publication is to assess the systemic changes in the underlying structure of the world economy and to analyse the resulting policy challenges. Particular attention will be paid to a plausible scenario in which developing and transition countries must design their development strategies in a context of a prolonged period of sluggish growth in developed countries. They will need to strengthen domestic income and demand and reinvigorate regional linkages. Publisher: United Nations Conference on Trade and Development Publication Date: September 2013 ISBN: 9789211128673 Pages: 170 Price: $55.00

Asia-Pacific Trade and Investment Report 2012: Recent Trends and Developments

This report focuses on trends and developments in the economies of Asia and the Pacific in their post-recovery from the 2008-2009 crisis and trade collapse. The report finds that after the initial promising signals of a recovery in 2010, exports from Asia and the Pacific are again facing a risk of deceleration. Pressure in the euro zone and the rising threat from a slowdown in the emerging economies have raised the fear of trade and investment contractions. The growth of goods exports in developing Asia and the Pacific countries, in real terms, was expected to drop in 2012, while import growth was projected to fall. Export opportunities continues to depend on the growth of intraregional demand and the ability of developing countries to deal with various external shocks. Transparency

Section I of the book contains an explanation of the concept of transparency as it is understood in the context of international investment agreements. Section II provides a review of current treaty and arbitral practice with respect to transparency issues. Section III analyses the interaction of transparency obligations with other related issues. The final section of this paper contains a series of policy options available to negotiators and those involved in revising arbitral rules. In this final section, the paper also briefly discusses the implications of those options for host State development considerations so as to assist with negotiator decision-making on whether or not to include transparency provisions in agreements, and, if so, which formulation to insert into new agreements. Expropriation

In this publication, Section I defines the concepts of direct and indirect expropriation and reviews the variety of measures that can constitute an expropriation. Section II focuses on the core issue of establishing an indirect expropriation: the recent treaty practice on defining indirect expropriation as well as arbitral practice. Section III discusses the differences between compensation for a lawful expropriation and reparation for unlawful expropriations, as well as the question of valuation of investments. Section IV offers options which policy makers and negotiators may wish to consider. Twenty Years of India’s Liberalisation: Experiences and Lessons

India’s growth miracle has attracted worldwide attention, particularly because this growth has been pursuant to the wide ranging economic reforms introduced in the early 1990s. Many other developing countries intensified liberalisation during this period but were unable to experience a similar spurt in their economic growth. One distinctive feature of Indian liberalisation experience is the gradual and calibrated manner in which reforms were introduced, especially with respect to external liberalisation, be it in the financial, agricultural or manufacturing sector. This book brings together distinguished economists from India, who analyse the role played by trade and foreign direct investment polices in growth and development of different sectors in India. Investment Policy Review: Mozambique

The Investment Policy Review recommends that the Government of Mozambique widen the scope of its investment promotion efforts and further improve its regulatory framework in order to foster economic activity, job creation and sustainable development. It encourages the authorities to look beyond mega-projects and investments in the mining sector for sources of job creation, economic diversification and poverty reduction. It warns against the potential pitfalls of relying excessively on mineral resources for development, while stressing the need to maximise the positive impact of investment in extractive industries. It also suggests concrete ways through which the business environment could be further improved to foster economic activity. India: A New Player in Asian Production Networks?

While the international policy network phenomenon has accelerated trade and investment linkages between countries in East and South-East Asia, the remainder of the region has not matched those countries in this process. The objective of this study is to explore the reasons for this by using India’s performance in the Asian IPNs as a case study for other countries that are trailing behind in this area. The study seeks to identify the reasons why India has performed below its potential in this new form of international division of labour, even though that country possess several supportive factors including: (a) the sheer size of the economy and population; (b) a large pool of engineers; (c) relatively sound intellectual property protection; and (d) an increasingly open trade and investment climate resulting from progressive economic reforms. A Practical Guide to Trade Policy Analysis A Practical Guide to Trade Policy Analysis

In recent years, globalization and trade openings have become increasingly contentious. This book aims to fill a gap in the market by guiding the users through the main sources of data and the most useful empirical tools for trade and trade policy analysis in an applied, real-world context. This approach builds on the comparative advantage of the authoring organizations - the WTO and UNCTAD - both of which have a strong policy focus. It quantifies trade flows and trade policies, presents the gravity models, and covers a number of simulation methodologies to predict the effects of trade and trade-related policies on trade flows, welfare and the distribution of income. Trade-led Growth: A Sound Strategy for Asia

The global economic crisis triggered changes in real economies and trade in all countries, including those in Asia, which adopted the so-called export-led growth model. With these drastic changes in trade flows, and the need to counteract potential adverse effects, the old debate on the advantages and flaws of the export-led model has re-opened. It aims to provide some theoretical and empirical reasons towards an argument that for developing Asian economies, export-led growth is still a valid model of stable, equitable and sustainable growth. While there is extensive literature published arguing against an export-led growth strategy, this volume argues in defence of trade-led growth for the Asian region. Guidelines on Integrated Economic Statistics

The motivating source of developing guidance for the operational use of an integrated approach to economic statistics in national statistical programmes has been the benefits of integrated economic statistics for nationally and internationally coordinated economic policy. The methodological and practical guidelines in this publication respond to the recognized need for an integrated approach to increase the coherence and consistency of basic economic statistics for enhancing the quality and analytical value of both basic economic statistics and macroeconomic statistics. Its conclusions suggest a fundamental shift in power from capitals and headquarters to the people aid agencies aim to assist. The report also comprises World Humanitarian Data and Trends which presents global and countrylevel data and analysis on humanitarian needs, response and trends. It is intended to help establish a common baseline of humanitarian data to support humanitarian policy and operational decision-making. United Nations Global Compact Annual Review 2011

This annual study assesses how, and to what extent, the private sector companies that participate in the United Nations Global Compact are implementing its ten principles; taking action in support of broader UN goals and issues, and engaging with the Global Compact locally and globally. At the centre of the review are the findings from the Annual Global Compact Implementation Survey, an annual, anonymous online survey of Global Compact participants, conducted to take stock of environmental and social performance and identify trends and developments related to corporate sustainability policies and action issues. The United Nations works across the world for peace, sustainable development, human rights and the rule of law. This collection of speeches by Secretary-General Ban Ki-moon shows the breadth of those efforts – advances and struggles alike – at a time of profound transition for the human family. Since taking office in 2007, Secretary-General Ban Ki-moon has sought to mobilize the international community behind global solutions to urgent challenges ranging from climate change and poverty to armed conflict and the spread of deadly weapons. The goal: dignity, freedom and opportunity for all. Norms of Protection: Responsibility to Protect, Protection of Civilians and their Interaction

A series of humanitarian tragedies in the 1990s (Somalia, Rwanda, Srebrenica, Kosovo) demonstrated the failure of the international community to protect civilians in the context of complex emergencies. These brought to life two norms of protection – Responsibility to Protect (R2P) and Protection of Civilians (POC) – both deeply rooted in the empathy that human beings have for the suffering of innocent people. Both norms raise concerns of misinterpretation and misuse. They are developing – sometimes in parallel, sometimes diverging and sometimes converging – with varying degrees of institutionalization and acceptance. This book engages in a profound comparative analysis of the norms and aims to serve policy-makers at various levels; practitioners with protective roles; academics and researchers; civil society and R2P and POC advocates. The report contains a Youth Charter, developed by youth representatives from Somaliland, Puntland and south central Somalia which underlines the aspirations, perceptions and needs of young Somalis. The League of Nations: From Collective Security to Global Rearmament

In the wake of the First World War, at the Peace Conference at Versailles, US President Wilson called for the creation of a League of Nations for the purpose of affording mutual guarantees of political independence and territorial integrity to great and small nations alike. For the first time, conflicts between nations were a matter of global concern. Numerous key areas – social, economic and statistics, health, labour – were dealt with either directly by the League or indirectly by its specialized agencies. The League, the predecessor to the United Nations saw the creation of bodies that would be at the origin of the International Labour Organization, the United Nations Educational, Scientific and Cultural Organization, the World Health Organization and the Office of the United Nations High Commissioner of Refugees. 2008, residents of Alexandra Township near Johannesburg turned violently on their s, launching a string of attacks that, two weeks later, left 60 dead, dozens raped hundred thousand displaced. Most of those killed were from beyond South Africa’s ut at least a third were citizens who, for reasons of ethnicity or political affiliation, otect their space in the country’s urban core. Although not the most severe political n South Africa’s turbulent past, the 2008 attacks reflect an important moment in y’s post-apartheid, post-authoritarian existence: a moment when the government’s and the post-apartheid order were called into question. This xenophobic violence ent cracks in the cohesion of law and society while helping to redefine both.

the demons within both migration and violent citizenship and in a longer historical e, this book succeeds in surpassing current interpretations of the 2008 violence migrants in the townships as just resulting from xenophobia. The authors masterfully the politics of statecraft – notably the African National Congress’ (ANC) language of ral dominance – inspired a fatal depolitisation of difference. The very coherence of tion offers a challenging analysis of struggle over belonging and denial of difference much broader relevance than South Africa alone.

On 11 May 2008, residents of Alexandra Township turned violently on their neighbours, launching a string of attacks that, two weeks later, left 60 dead, dozens raped and over a hundred thousand displaced. This book situates recent anti-outsider violence within an extended history of South African statecraft that both produced the conditions for the attacks and has been reshaped by it. It is the first academic text to fully theorise the events that made global headlines in 2008. Through its subtle, empirical and theoretically informed analysis, the book reshapes discussion of xenophobia and violence in South Africa while injecting local debates into global considerations of the meaning of citizenship and the post-colonial State. anniversary of the opening for signature of the 1982 United Nations Convention on the Law of the Sea, delegates of the Third United Nations Conference on the Law of the Sea overwhelmingly responded to the request from the Legal Counsel of the United Nations to send their personal recollections and reflections to be set out in a publication. The result is a personal tribute to the negotiations which took place in the last century and which led to the adoption of the Convention. It is a reflection of the spirit of consensus at the Third United Nations Conference and of the importance the Convention still has thirty years later as the legal framework for all matters related to the oceans and seas.

Measuring Vu l n e r a b i l i t y to Natural Hazards

“The main purpose of the UN is to enable its member States to better shield their peoples from natural and man-made hazards. This publication addresses the need for a structured and inclusive decision-making process to manage risks and to achieve the desired level of safety without stifling economic growth. It will help the UN and its member States to apply risk management as a central process underlying all regulatory activity, involving all stakeholders at the highest level of policy-making. As such, it is intended to assist policymakers, regulators, and businesses in building regulatory systems aimed at effectively mastering the risks that confront our families, our communities and our planet."
