A Leadership Look Back...

Five Firsts and a Last First Membership Meeting

It was 1980. I was excited to be at my first Membership Meeting, having just become an employee of what was then Underground Contractors Association. Just after dinner was done, I heard a lot of yelling and went to investigate. I found that two of our members were literally having a fist fight in the men’s bathroom!

This is the exact moment when I knew that there had to be a better way. That these fierce competitors could be at least as successful by working together rather than against each other. That by cooperating and caring about each other we could do more. I set out to prove to the members and the industry that this was true. This was the birth of what I call the Non-Adversarial Way (that eventually turned into Partnering). This set us on a great journey that continues today, 40 years later.

First Woman in the U.S.

When John Pestana retired as the Executive Director two years later, I became the first woman in the United States to head up a major construction industry collective bargaining unit. This was unheard of, unprecedented, unfathomable for most. The Board of Directors were WAY ahead of the times by having a woman in this role. And of course, we always took our non-adversarial approach with us to each negotiation, grievance and relationship. And, we found that having a woman at the table meant that all the old rules of engagement no longer worked. This was exactly what we needed to begin to use the non-adversarial approach in our negotiations and in resolving real industry issues—always looking for what was good for all and good for the industry and marketplace. that the unions are our partners—we are interdependent and so we need each other and must treat each other fairly, with respect and care. This was a time when unions were losing membership very quickly and I believe that this strong partnership has created something so very special in Northern California that can serve as a model for other regions.

First Committee

The very first committee I set up as the Executive Director was the Specifications Committee. You can imagine how the members didn’t want to be on a committee with people they considered their enemies, but after a lot of convincing, we had a great committee set up. At the first meeting I asked the committee members what was the very worst, most unfair specification that they have to deal with all of the time? It didn’t take long for them all to agree that it was a water district that had a spec that was unfair. The members had tried to fight this unfair spec for over 20 years, and each time it went to court the members lost. They of course felt that this was a hopeless issue to tackle. I asked them if it were to be fair, what would the spec say, and of course it must be fair to everyone involved, including the water district. The committee worked on language for a few meetings and then they felt that had what they believed to be a fair and reasonable spec. I told them that I was going to write to the General Manager of the water district and share our proposed new spec. The water district accepted.

At the meeting, the General Manager turned to me and said “we got your letter and proposed spec, and we agree with you that our spec is unfair and we are going to replace ours with your new proposed spec.”

WOW! Can you imagine how excited the Specifications Committee was? In an instant what they thought was impossible just happened!!! One of the committee members asked them why they were willing to change it now? The General Manger said that no one had ever asked them before! There was no project involved, only wanting to do what is best for everyone involved.

This was just the first committee, and the first time they accomplished what they thought was impossible— UCON has done this for 40 years now!!

First Strike

We had negotiated our agreements with all the Plumbers locals, except for one. We continued to negotiate for months. The Business Manger would lie and walk out and use other techniques to get his way. The negotiation committee continued to use the non-adversarial approach and refused to be an adversary to this man, no matter what tactics he used. The committee continued to work to come to agreement for over a year. Then one day pickets began to arrive at various members’ shops and projects. I got a call from the head of the Plumbers’ District Council saying that we can’t give this local the kind of raise they are looking for as we had already settled on a financial package with all of the other locals and this guy was looking for over three times what had already been agreed upon. We knew we had to hold the line and stay together. We were in for our first strike!

There had been industry strikes before, but in each case, one of the members of the collective bargaining unit caved in and signed to the union’s new agreement and this “sold out” everyone who now were forced to sign, or truly be singled out. Never before had a group of signatory contractors held together and stayed strong, despite real financial losses and risks. Every single contractor agreed to stay strong and not give in.

We continued to negotiate in our non-adversarial manner working to give the local leader what he needed. Eventually we realized that what he truly needed was to save face with his members and to be seen as a leader to his peers. So, we fashioned a proposal that would give him this large raise, but to a new classification where no one would ever be placed. And we created a new lower rate for trainees so all of the

plumbers could capture more of the market. This was accepted!! The strike was done, and we had developed a level of trust and credibility with the local and all the locals in the District Council. In fact, when the NLRB came to the Local’s leader and asked him what had happened, he sent them to me for our notes because he trusted that our notes were accurate and fair.

First Staff

My first staff hire was a beautiful, smart, warm, 18 yearold woman, Leslie Garza (Lord). Leslie came to become the heart of the association. She was eager to learn, caring, organized and very creative. We all worked to put on the many events, committees and meetings that were held.

Then, we had grown to where we needed someone to help us grow faster. An energetic, smart 25-year-old Mark Breslin came on board to do membership development and to better serve our current members. In his first year he was given the challenge to bring in enough new members to pay for his next year’s salary—which of course he did and much more. When I left in 1986 to start OrgMetrics, Mark stepped up to take on the Executive Director Role. He is a phenomenal leader and is remarkable!! Leslie, also a great leader, has been the heart and soul of the association for 40 years! The association staff members set the stage, and continue the great work as UCON goes statewide!!!

Last-ing Legacy

The non-adversarial way continues to be the underpinning of UCON today. So many things have been accomplished that others believed to be impossible that we have lost count. There is a collective wisdom in the members who are willing to be open and honest and committed to doing what is best for all. We should never take it for granted. This is a very special place and is something to care for and cherish. I am more grateful than words can say for having been a small part of this wonderful association!! It was the association that started me on my path for my life’s work in partnering and developing collaborative cultures. I am so proud of UCON! Happy 50th Anniversary!

50 YEARS OF LABOR RELATIONS

1970’s

yy The UCA (Underground Contractors Association) is founded as an all-union construction association, representing underground contractors in the heavy and highway industry. yy UCA signs four Master Labor Agreements. yy Bargaining was conflict-based, hard-nosed and unrelenting in tone and strategy.

1980’s

yy UCA changes its name to EUCA (the Engineering & Utility Contractors Association) to better reflect the wide range of work performed by its members. yy EUCA is instrumental in founding the California Alliance for Jobs.

1990’s

yy EUCA begins joint bargaining with AECE and AGC, for greater bargaining power and the betterment of the industry as a whole. yy Bargaining evolved due to both non-union competition and a generational change. To see with a more win-win viewpoint did not seem weak any longer. yy California prevailing wage laws are attacked by the Republican caucus and Governor’s office. EUCA members testify in support of prevailing wages.

yy EUCA signs contracts with more construction crafts, in order to better represent the work performed by all of our members. yy EUCA helps found the Basic Crafts Alternative Dispute Resolution Workers’ Compensation Program, the first multi-craft program of its kind in the state and still the largest in California.

The UCON Culture: Relationship-Building Events for 50 Years The Event Team at United Contractors has been developing and producing events that encourage active participation amongst the membership for 50 years now. The team works to create valuable relationship building opportunities while keeping true to its original roots that every member matters, big or small. Our goal continues to reflect that original family feel at each and every event.

These Events provide opportunities for members to get involved and gain exposure to hundreds of professionals, leaders and industry affiliates. UCON Events are well attended (most sell out) and include the following today: Membership L.I.V.E.–Leadership, Innovation, Vision & Excellence: Over the many years, this premiere dinner dance event recognizes and celebrates our incoming Board of Directors and Officers. In addition, UCON recognizes members that have made a significant contribution to our industry with the association leadership awards.

This event is a great opportunity to network with and support UCON’s emerging leaders in their goal to carry out their vision of the future of the association.

Annual Crab Feed: Put on your plastic bibs and belly up to the table to crack some crab with 800 of your closest peers. This is a casual night of food, drink, fun and new friends—a great event to bring a potential member or new member! Back in 2013, attendance was close to 400 and now, 6 years later, the event has doubled to 800!

Scholarship Throw Down Fundraiser Cornhole Tournament: This fairly new event (in its 3rd year and replacing the long lasting Poker Tournament) supports our future leaders and the Scholarship Program by participating in the Throw Down Fundraiser which is an official cornhole bean bag toss tournament.

This event offers a chance to compete, mix and mingle with industry professionals and affiliates, while enjoying good food, beverage and musical entertainment, while supporting a great cause. Over the last two years, our Cornhole Tourney has raised over $96,000 in Scholarship funds (Tripling what the Poker event had previously raised in a year), and permitted us to grant scholarships to additional worthy recipients.

Annual BBQ & Chili Cook-Off: The annual BBQ is our longest standing and most “infamous” event, running more than 45 years.

It is the largest event we host, and the largest industry event of its kind in northern California, rivaling the Beaverdilly. In 1970’s a handful of contractors and associates got together for a BBQ, including employees and family members but the official 1st BBQ was held in June 1983, with a ticket cost of $13! UCON’s BBQ continues to reflect the family feel and demonstrates the values of sincere relationship building. Every year we aim to grow the BBQ in attendance and quality, while remaining true to the values that it was created from— Every company matters, no matter how small. Family.

Sal Rubino Golf Classic: the United Contractors Sal Rubino Golf Classic is named after long time Associate member, Sal Rubino, who gave his all to the association many years ago (photo at right, Sal is pictured far left). This tradition continues with the tournament now taking on two courses and celebrating its 31st year in 2020. Always a fun day as members enjoy the year long memories made on these beautiful (yet sometimes foggy) coastal courses. Sal Rubino brings out a crowd of long-time attendees, many of whom wait all year to attend this sold-out tradition, while enjoying the beautiful Monterey Coast.

Legislative Summit: now in its third year, this Summit is developed to inform, engage and connect members to the industry’s most pressing issues—to hear from important industry figureheads, elected officials, agency leaders and compelling keynote speakers covering a wide range of relevant political and business topics.

Government Advocacy Dinner & Auction: Guests enjoy the formal, black tie optional, event at the historic Claremont Hotel. The United Contractors Government Advocacy Dinner & Auction is the biggest fundraiser United Contractors puts on each year to support our Government Advocacy efforts of maintaining UCON’s presence, voice and agenda at the Local, State and Federal level. Leadership, Innovation, Vision & Excellence This year United Contractors celebrates a milestone anniversary, 50 years! January 25, 2020 kicked off a year of celebration as United Contractors members, affiliates and guests gathered at the San Jose Fairmont to celebrate the installation of the 2020 Board of Directors and President, Charles Wall of Brosamer & Wall, Inc. The evening was a journey through the decades and began with a touching video to pay tribute to the Associations 50-year history, remembering where we came from and looking forward to a bright future ahead.

Five esteemed and highly respected guests were awarded for their involvement and support of United Contractors and the Industry in 2019 (see page 34): Governor Edmund G “Jerry” Brown­—Impact Award Paul Cianciarulo, Graniterock—The Foundation Award Trony Fuller, West Coast Sand & Gravel—Associate Leadership Award Bob Spinardi, St. Francis Electric LLC—Honorary Lifetime Member Award Leslie Lord, United Contractors—Special Service Award As a conclusion to the awards and Installation ceremony, Charles Wall, Brosamer & Wall, Inc, was sworn in as 2020 President by his longtime friend and mentor, Bob Brosamer of Brosamer & Wall, Inc. Charles says it’s not about one man. The Board, as a whole, leads the organization, and it is his goal is to help facilitate their mission, to provide the best service to United Contractors members in both Northern and Southern California.

To start the party, balloons dropped with confetti cannons before going back in time to 1970, to dance through the decades. Dancers joined guests on the dancefloor as we danced to favorite hits from the 70’s, 80’s, 90’s, 00’s, and 10’s. The evening concluded with a photobooth and interactive desserts including a nitrogen ice cream bar and chocolate fountain. Congratulations to the 2020 UCON Board of Directors and Award Winners!

They stand apart as those who take on the broadest responsibility for their industry brothers and sisters in this organization and across the industry.

Their time and commitment and talent are put to work for the many. And it is the thoughtfulness and perhaps even selflessness that Paul brought, that creates the platform for UCON’s success. It is leaders like him who uphold our foundational principles; that every member counts, that every voice matters, and that unity is the key to the success of our efforts.

Special Service Award Leslie Lord, United Contractors The 2019 Board of Directors chose UCON’s Vice President/ Deputy Director, Leslie Lord to receive the Special Service Award in light of her extraordinary contributions to the association, and her unprecedented tenure and commitment and the care she has shown for the members and the organization. As this organization came from humble roots, so did she. And arriving at the association as a teenager, she carved out a reputation of empathy, thoughtfulness, care and integrity which carries over to the association’s member commitment to this day.

Associate Leadership Award Trony Fuller, West Coast Sand & Gravel Trony Fuller was chosen by the 2019 Board of Directors as someone who has significantly contributed time and commitment. He served as volunteer and chairman for events and programs.

He contributed at the level of peer and leader and distinguished the Associate membership with his Board service.

In a year of extraordinary growth and challenge he contributed and earned the respect of his fellow Board members. Trony was honored as UCON’s top Associate Member as Associate of the year.

The Impact Award Governor Edmund G. “Jerry” Brown In decades of our existence there has never been a politician more worthy of this award. The truth of the matter is, that it is not just UCON and our members here tonight, but hundreds of thousands of union craft persons and millions of Californians, who will benefit for decades to come because of his leadership and foresight. There is one word that summarizes Governor Edmund G “Jerry” Brown’s contribution to this state. Often overused, this word is—legacy. A legacy of pragmatism. A legacy of sober thoughtful leadership. A legacy of value delivery.

A legacy of unabashed truth telling. It is not just the benefit our industry received by his leadership, but the cumulative impact he has had for decades in the industry. It is for this we are most grateful.

He served on the union bargaining teams for decades. He was a union trustee at the very beginning of our growth in labor influence. And he served as Co-chair of our Laborers Negotiating Committee through challenging times and relationships. His commitment was consistent and remarkable. His impact profound.

He has been an outstanding ambassador for the industry. He brought thoughtful analysis, intellectual vitality, passion, and industry knowledge to his work, his contributions to the business, and to the Association.

Trench Shoring Company’s SBH® Slide Rail Shoring system met the multiple challenges of shoring a 650’ long trench at 14’ deep by 16’ wide. As an added degree of difficulty, the trench had a starting distance of over 41’ from the center of the adjacent railroad track, reducing down to 21’6” away from the track. Our patented shoring system also supported all surcharge loads from trains, soil and all construction equipment required for this portion of the project. Result? Use of our equipment vs the traditional beam and plate of solid sheet shoring saved the general contractor money and kept the project on schedule.

Water Pollution Control Manager Training Requirements The California Department of Transportation (Caltrans) will require Water Pollution Control (WPC) managers, alternate WPC managers, or assistant WPC managers who perform WPC tasks such as inspection, repair, and maintenance practices, collecting water quality samples, and record water quality data to complete the stormwater management trainings as specified in Section 13-1.01D(3), “Training” and Section 13-1.01D(4) (b), “Qualifications,” of the 2018 Revised Standard Specifications (RSS).

This RSS will begin showing up on all projects submitted to Office Engineer as of the April 17, 2020 specification posting. Projects advertised after April 17, 2020 will include this RSS. Furthermore, this may show up as a Non-Standard Special Provision on projects advertised between now and April 17, 2020 if the Project Engineer obtains owner approval for its use and is included in the bid documents.

To become a WPC manager, alternate WPC manager, or assistant WPC manager for Caltrans construction projects, one of the stormwater management training requirements is to submit a certificate upon completion of an 8-hour WPC manager training.

This training requirement is initially a one-time training.
