The new rules for planned giving and charitable donations

When making arrangements for life to continue for loved ones after your death, taking the time to understand the terms and subsequently the impact of your options is vital. This means keeping up to date with policy changes that can affect your posthumous wishes.

Effective January 1st, 2016, changes to the Income Tax Act (ITA) have made Planned Giving an attractive option for Canadians considering including charitable donations in their Wills as part of their estate planning.

Previous rules stated that gifts outlined in Wills would produce tax credits which could only be used against the last two tax returns of the departed.

Similarly, gifts originating with the Estate produced tax credits which could only be used against the Estate tax returns.

How did these rules affect your Will in the past?

Tax credits are valuable because they reduce taxable income.

With the old rules in place, tax credits were being attributed to the ‘wrong’ tax return, resulting in the full beneficial income reduction being lost.

These old rules had significant consequences for both the family and the testator’s final wishes.

With the new rules in place, gifts made by Will are now on behalf of the Estate. For Estates that meet the criteria for Graduated Rate Estates under the ITA, the executor will now have the power to attribute the tax credits to any one of five possible tax years, including the testator’s last two tax returns.

As well, tax credits can be used on any of the Estate tax returns during the three-year period that the Graduate Rate Estate is open. As a direct result, there is great potential for the full benefit of the income reduction from a charitable gift to be realized.

The decision to include planned giving in your estate planning is an important one. Be aware of how planned giving benefits many by consulting professional advisors like financial estate planners, accountants, and lawyers to put your mind at ease in getting it right.

A meaningful coincidence: How I met Charles Simonds

I first met Charles on a McCoy Passport to Healthcare Tour - an open invitation tour that gives an educational insight into the work of the Kingston university hospitals. The tour includes stops within three Kingston organizations; Hotel Dieu Hospital, Kingston General Hospital and Providence Care.

This particular tour ended at Providence Manor. While at Providence Manor, we visited the Veteran’s Room and there, among all the keepsakes that have been given by Veterans from the past is a book. It is a book that you can sign to remember a Veteran who was special to you or just sign to say you were there. I chose to sign in memory of my Father, Captain A. R. Fowler who served with the Canadian Armed Forces 2 RCHA (Royal Canadian Horse Artillery).

I left the room so that others could sign the book and then I heard a noise behind me. Charles rushed

up to ask if I had signed for Art Fowler – I told him, “Yes, he is my father.” Charles had a big grin on his face and said, “I knew him; I met him in the mid 1950’s when I was in Officer Cadet Training in Camp Shilo, Manitoba, and he was one of my mentors when I later served in 2 RCHA (Royal Canadian Horse Artillery).” The feeling that came over me was like a wave of warmth, excitement, and especially synchronicity. I am convinced it was my father’s way of having me meet this wonderful man.

I wanted to know more about Charles. He agreed to meet me for lunch, and I soon found out that Charles is a person who also created a planned gift with University Hospitals Kingston Foundation (UHKF). So, we had even more to discuss!

Charles said the Cancer Centre of Southeastern Ontario is his focus because both his oldest son, David and his wife Barbara passed away from cancer. Charles said he was most thankful for the care and compassion they both received from Kingston General Hospital during their treatments.

Because of this care, he has left a future gift of his Registered Retirement Income Fund (RRIF) to the Cancer Centre.

Charles was a graduate from the Royal Military College and

Queen’s University, and was commissioned into the Canadian Armed Forces with 2 RCHA (Royal Canadian Horse Artillery) and the Royal Canadian School of Artillery. He served as Director of International Policy and Director of Defence Intelligence at National Defence Headquarters and was Commander of the Canadian Forces Base Shilo.

At the young age of 81, Charles is extremely active in the community. At present he is President of the Kingston Symphony; Chair of the Kingston, Frontenac Lennox & Addington Board of Health; Founder and former President of the Canadian Kennel Club; and President of the Board of Trustees of the Cataraqui Cemetery Company.

It is obvious that he has a high regard for health care in Kingston and other organizations close to his heart. I feel privileged to have spent time with him and to have the opportunity to get to know him better. Thank you, Charles, for all that you do for the community. May I call you Charlie?

we were,” she recalls. “We just couldn’t have had better treatment than we’ve had for [Rex’s] medical conditions.”

As a result of Pamela’s experiences with the wonderful care shown to her husband and witnessing the quality of life made possible for patients at Kingston’s hospitals, she felt compelled to give back.

Not only do the Welbourns make an annual donation to be used where the hospitals most need it, but Pamela also volunteers by working with residents at Providence Manor, including some with dementia. She considers her ability to work with the residents in care at Providence Manor as a gift from the heart, and would like to do more for geriatric care if she can find time for training.

Additionally, Pamela and Rex have bequeathed in their Wills that part

of the residue of their estate go to UHKF to sustain the excellent care they have experienced. Pamela encourages others not to hesitate in consulting a lawyer to draft a Will, and to consider contributing to the community through planned giving during this effortless process.

“We found the planning was actually quite a relief, and we know now that things will be the way we want. There’s a sense of peace about that,” she says.

Pamela considers Kingston area residents fortunate to have the care that they do, and wants to see that continue well into the future. “The personal touch is there, which I don’t know if we would get in a big city like Toronto.”
