UCANE Advocacy Continues As we entered the month of March and inch closer to spring, I know that UCANE members are looking forward to a busy, safe, and productive construction season. While the weather has been warming up, UCANE has already been extremely active advocating for member companies and our industry.

B

y now members are aware of the welcome news that a large Federal Infrastructure Bill became a reality last year. That, in conjunction with COVID-19 stimulus money, will provide much-need additional funding for infrastructure projects that UCANE has long advocated for. However, as I have mentioned before, we will continue to meet with Federal, State, and local officials to make sure that this funding is utilized and that jobs are put out to bid. On March 23, we will again be fortunate enough to be joined by MassDEP Commissioner Martin Suuberg, MWRA Executive Director Fred Laskey, and BWSC Chief Engineer John Sullivan at our 10th Annual Forecast Meeting and Trade Show to highlight their capital plans and projects for the upcoming year. This is also the time of year when the Massachusetts Legislature will be considering the State Budget for the upcoming fiscal year, and UCANE has been busy meeting with legislators from across the State to discuss our priorities and concerns. However, UCANE’s advocacy work is much more than just lobbying for funds for public infrastructure projects. There were over 8,000 bills filed in the State Legislature that are being considered in the current session, which ends on July 31. Together with our contract lobbyist, Mark Molloy of Cascade Strategies, we have been combing through all of these proposals to find the ones that could have an impact on our comMARCH, 2022

panies and our industry. We identify and track these bills, and give written and oral testimony either supporting or opposing these measures. UCANE has also filed our own legislation, including bills to provide a long-term dedicated revenue stream for water infrastructure, to update the Dig Safe law, increase the lookback time for DCAMM pre-qualification, and to provide consistency among all awarding authorities for how police details are handled as a bid item. We are strongly supporting the passage of all these measures, while opposing overly burdensome regulations and legislation that may negatively impact our industry.

Our members are our best advocates. As the saying goes, “All politics is local,” and your voice truly makes a difference. If you receive an “Action Alert” email from UCANE regarding a piece of legislation, I hope that you will take the time to contact your legislators and speak to them about the matter. If you have any suggestions for additional legislation, or want to stay up-to-date on what we are working on, please feel free to contact the UCANE office and register to attend one of our monthly Government Relations Meetings. Governor Baker Files Supplemental Budget Based on Surplus Revenue

G

overnor Charlie Baker filed a fiscal year 2022 (FY22) $2.4 billion Supplemental Budget in mid-February that uses $1.6 billion of the State’s anticipated revenue surplus and several federal revenue sources to maintain and expand several COVID-19 related programs, cover ongoing public costs, and increase funding for municipal infrastructure assistance programs. Of the $2.4 billion in spending proposed by the Administration, more than two-thirds is directly related to COVID-19 response and recovery efforts. Other spending proposals include $450 million for local infrastructure products and $109.9 million to fund recently negotiated collective bargaining agreements. The Governor’s proposal does not use any of the state’s remaining discretionary $2.3 billion America’s Rescue Plan Act (ARPA) funding. In particular, the Governor’s Supplemental Funding Bill proposes an investment to stabilize child care providers, special education schools, and human service providers to ensure that the critical services that they provide remain available to all who need them, despite enrollment and utilization fluctuations caused by the pandemic. The legislation includes $450 million to extend Commonwealth Cares for Children (C3) stabilization grants for child care providers through fiscal year 2023 (FY23). It also includes $140 million for special education schools to continue support through FY23 that will help address direct care and clinical staffing needs and ensure that these schools are able to safely provide residential and day education services to approximately 7,000 children between the ages of 3 and 21. The bill further proposes $401 million to extend rate enhancements for human service providers and support other investments in Home & Community Based Services; $346 million of this spending is supported by federal funding provided MARCH, 2022

through non-discretionary ARPA funding, for a total of $55 million in net State cost. The Administration’s supplemental spending proposal also includes 65 policy sections. A large number of these sections (38) make technical corrections to the $4 billion ARPA spending bill and other recent legislation. Of note to UCANE, the Governor’s supplemental budget proposes to make job order contracting for state agency maintenance and repair projects costing $150,000 or less permanent. As well, the proposal contains a number of climate resiliency projects related to water infrastructure under a $150 million appropriation to line-item 20001014. According to an analysis by the Massachusetts Taxpayers Foundation, through January, tax revenues exceed the original FY22 estimate by $2.3 billion. A significant portion of this increase is likely due to capital gains collections, which will automatically be transferred to the State’s Stabilization Fund and other reserves and, therefore, is not available for operational spending. However, even after accounting for this transfer, the revenue surplus available for the budget is significant – particularly in light of three of the largest tax collection months (April, March, and June) upcoming. Given the size of the surplus to date and the fact that collections in April largely reflect economic activity from the prior year, a sizable revenue surplus in FY22 is highly likely. Dr. David Cash Named Regional Administrator for EPA Region 1

T

he month of February also saw the United States Environmental Protection Agency (EPA) Administrator Michael S. Regan announce that President Biden has appointed Dr. David Cash to become EPA’s Regional Administrator for Region 1. Dr. Cash will lead the implementation of the Biden-Harris environmental agenda in Maine, New Hampshire, Vermont, Massachusetts, Rhode Island, Connecticut, and in 10 Tribal Nations. Dr. Cash’s appointment began on February 7, 2022. According to a press release from the EPA, Dr. Cash has spent his career in public service harnessing science, innovative policy, and participatory decision-making to solve challenges and seize opportunities at the intersection of environment, economy, and equity. In his most recent position, Dr. Cash was the Dean of the John W. McCormack Graduate School of Policy and Global Studies at the University of Massachusetts-Boston. He also spent a decade in Massachusetts state government where he held a range

of senior positions. As Assistant Secretary of Policy in the Executive Office of Energy and Environmental Affairs in Governor Deval Patrick's Administration, he was an architect of the Commonwealth’s climate, clean energy, and environmental justice policies. Dr. Cash then served as a Commissioner in the Department of Public Utilities, followed by serving as the Commissioner of the Department of Environmental Protection. In these roles, he collaborated in government and with communities and the private sector to craft and implement innovative science-based policies around climate, environmental justice, energy, job creation, water, land use, waste management, and grid modernization. Dr. Cash holds a Ph.D. in public policy from the John F. Kennedy School of Government at Harvard University. He and his wife Annie Weiss, a psychotherapist, live in the Boston area and have two young adult daughters. continued on page 11

Audit Finds Shortcomings in the Reporting of Workforce Participation Goals

A

ccording to an audit released by her office, State Auditor Suzanne M. Bump (OSA) found inadequacies in the Massachusetts Division of Capital Asset Management and Maintenance’s (DCAMM’s) processes to ensure equal opportunity staffing requirements of its contractors for women and minority participation. The audit, which reviewed the period of January 1, 2019 through December 31, 2020, also found that DCAMM’s internal control plan was not updated with a coronavirus pandemic component as required by the Comptroller’s Office, and employees’ cybersecurity awareness training certificates were not retained by DCAMM. This audit is one in a series of performance audits that focuses on equitable access and equitable results for services and programs provided by state agencies and their contractors. Of particular note to UCANE, the audit found

that DCAMM did not have sufficient processes in place to effectively monitor its contractors’ compliance with workforce participation goals for women and minorities. According to state guidelines, each construction contract should include workforce participation goals of 15.3% of the hours of construction work performed should be done by minority workers and 6.9% by female workers. The audit found that of the 127 construction contracts active during the audit period, 120 (95%) did not meet the women’s workforce participation goal, 78 (61%) did not have any hours worked by women. In addition, 81 (64%) of the 127 contracts did not meet the minority workforce participation goal, and 36 of those (28%) did not have any hours worked by minorities. In its defense, DCAMM noted that “monitoring of workforce participation goals has historically taken place via a comprehensive tailored continued on page 13

The Compliance Officer meets regularly and conducts site visits with the project managers, resident engineers, primes, and contractors. The Compliance Officer reviews submissions, daily reports, meeting minutes, and other communications. The comprehensive tailored approach allows the Compliance Officer to best review the project process, understand the (often evolving) timing of various categories of work and, because each project is unique, to best tailor actions to achieve and increase both minority and women businesses and workforce participation.” The audit also found issues with documentation at DCAMM. Specifically, the audit found that there were no cybersecurity awareness training certificates in the personnel file for any of the 424 active DCAMM employees in 2019, and issues were identified in the documentation of information supporting DCAMM’s FY20 Annual Report submitted to the state legislature. Additionally, DCAMM’s internal control plan was not updated

with a 2019 coronavirus pandemic component, as required by the Office of the Comptroller’s internal controls guidance issued in September 2020. To address the issues identified, the audit recommended that DCAMM develop policies and procedures to monitor its contractors’ compliance with achieving workforce participation goals for women and minorities, update its internal control plan when significant changes occur, and keep cybersecurity awareness training certificates in employee personnel files. For its part, DCAMM was recognized in the audit as responsive to the various points in need of attention. As well, many of the items highlighted by the audit were more administrative (i.e. recordkeeping) than content oriented. According to the OSA, DCAMM manages more than $2 billion annually in state-funded construction projects and 550 active leases, consisting of more than five million square feet of office space that house state agencies. Leader Wagner to End Accomplished Tenure on Beacon Hill; Won’t Seek Re-Election

T

hrough a press release issued by his office, State Representative Joseph F. Wagner announced that he will not seek re-election to the Massachusetts House of Representatives in 2022. Wagner, who currently serves as the Second Assistant Majority Leader, has been the State Representative of Chicopee’s Eighth Hampden District for more than 30 years. His term will end in January of 2023. First elected in 1991, Leader Wagner has been a member of the House Leadership for the past twentyone years. In addition to his current leadership role, Leader Wagner has served as Chairman of the Election Laws, Transportation, and Economic Development & Emerging Technologies Committees. As Chair of the Joint Committee on Transportation for eight years, Representative Wagner authored legislation creating MassDOT, consolidating transportation agencies and streamlining services within a single unified entity. He wrote the 2010 Safe Driving Law, which included updates to junior operator laws to increase roadway safety and reduce distracted driving. Wagner also championed the 2019 Hands-

Free Driving Law, for which he had worked and advocated for more than a decade. As Chair of the Joint Committee on Economic Development & Emerging Technologies, Wagner guided the 2011 Expanded Gaming Act to final passage, resulting in the construction of the MGM Casino in downtown Springfield, and authored four omnibus job creation bills. Additionally, he spearheaded the effort to reauthorize funding for the Massachusetts Life Sciences Center to stimulate job creation, private investment and workforce pipeline training in the life sciences and related industries. His efforts led to the establishment of a dedicated funding mechanism for the Workforce Competitiveness Trust Fund. Most importantly, Leader Wagner has had a significant role supporting his hometown, the City of Chicopee and its residents. During his time in office, Leader Wagner has secured more than $120 million to improve nearly every major road and bridge in the City. Legislative Update continued from page 15 tion of Chicopee’s two high schools, and the renovation and modernization of the Dupont Middle School and the former Fairview Middle School. Delivering millions of dollars from the MassWorks grant program to support the redevelopment of Chicopee’s downtown, the upgrading and expansion of the Memorial Drive corridor, improvements to and expansion of the Westover Metropolitan Development Corporation’s civilian aviation facilities, he also assisted with the relocation of the Food Bank of Western Massachusetts to Chicopee. Other local projects that bear his signature include the main-branch Chicopee Public Library, which received nearly $3 million in the form of a state library reconstruction grant. Most recently, Leader Wagner was able to deliver nearly $1.2 million in federal American Rescue Plan funds for priority Chicopee capital projects. As someone who understands the importance of infrastructure, Representative Wagner will be missed by UCANE and its membership. Whether discussing procurement policies, the intricacies of development, or infrastructure funding, Leader Wagner has always been a thoughtful and effective legislator – working with a wide variety of organizations to garner valuable perspectives from each. Upper Bay Regional Wastewater Feasibility Assessment Completed

he Buzzards Bay Coalition recently released its Upper Bay Regional Wastewater Feasibility Assessment, finding that a regional wastewater solution through expansion of Wareham’s wastewater treatment facility could have a beneficial impact on water quality. According to the report, the Wareham Water Pollution Control Facility currently reduces nitrogen pollution by over 90% and could be expanded to meet the current and future needs of Marion, Wareham, South Plymouth, the Massachusetts Maritime Academy, and Bourne. A unified approach would reduce nitrogen pollution, identified as the primary source of pollution in the region’s coastal waterways, by removing an estimated 100,000 lbs of nitrogen from coastal waters each year. The Upper Bay Regional Wastewater Feasibility Assessment (aka Upper Bay Project) joined all of the communities in upper Buzzards Bay – Mar-

ion, Wareham, Bourne, and South Plymouth – together with the Massachusetts Maritime Academy (MMA) and the Buzzards Bay Coalition (Coalition) – to evaluate whether a regional wastewater solution to reduce nitrogen pollution in upper Buzzards Bay was feasible. The Upper Bay Project hypothesized that if these communities worked together, they may be able to expand wastewater treatment, reduce pollution, and restore water quality, and support the economic needs of their communities at a lower cost and better environmental outcome than taking on municipal wastewater projects individually. Since 2015, this project has secured $737,000 in federal funding through grants from the EPA’s Southeast New England Program to complete the preliminary engineering, science, and economic analysis to answer the feasibility question. Scientists at the Woods Hole Oceanographic Institution determined that discharge to the Cape Cod Canal would ensure that highly treated water would flow through the wellflushed canal rather than fragile coastal ecosystems, with no adverse impact to water quality in the canal and surrounding waters. The report estimates the project would cost $150 million, with local communities potentially sharing the costs with state and federal funding sources. Upon completion of their Comprehensive Wastewater Management Plans, the towns will have to decide whether to pursue individual or regional solutions to the wastewater problem. New Planning Grants under MVP Program. The Baker-Polito Administration announced $158,800 in Municipal Vulnerability Preparedness (MVP) Program Planning Grants to seven municipalities (Brimfield, East Brookfield, Hinsdale, Holland, Montgomery, New Ashford, and Washington) that are new to the program. The addition of these new communities brings total enrollment in the program to 95%, or 335 municipalities, representing over 99% of the Commonwealth’s population. The MVP grant program, created in 2017 through Executive Order 569, provides communities with critical funding and technical support to, among other actions, retrofit and adapt infrastructure, invest in and protect environmental justice communities, design and engineer studies, stormwater upgrades, dam retrofits and removals, culvert upgrades, drought mitigation, energy resilience, and projects that focus on implementing naturebased solutions such as wetland restoration and floodplain protection. Responding to an Investigative Demand: The Massachusetts Attorney General’s Office Issues 25 Citations to Local Paving Company and its Owners In a recent press release, the Office of the Attorney General (AG) announced that it has cited a Massachusetts paving company and its three owners for alleged violations of prevailing wage and recordkeeping requirements. The AG seeks more than $1.2 million in restitution and damages. The state’s investigation and aggressive enforcement of alleged prevailing wage violations should not come as a surprise. Rather, the case is noteworthy because of the company’s allegedly improper recordkeeping and deficient response to the AG’s investigative demands.

aving received several complaints from current and former employees of the company, the AG’s Fair Labor Division commenced an investigation in 2019 to determine whether the company had properly paid prevailing wages. As many of you are aware, violations of certain state labor and wage laws cannot only result in liability for the company, but can also lead to civil and criminal liability for certain individuals within the company. When it comes to compliance with these laws, the AG strongly supports the interests of Massachusetts employees. In this case, the AG’s investigators determined that the company had allegedly underpaid 22 workers for work performed on various public projects in Massachusetts. The AG also concluded that the company had failed to submit true and accurate certified payroll records for work performed for various Massachusetts towns. As part of its investigation, the AG demanded that the company produce its certified payroll and timekeeping records. But according to the AG, the comMARCH, 2022

pany failed to produce certain requested records. Not only that, the records that the company did produce were incomplete or missing information and also contained errors or other omissions. As noted in the press release, employers are required to maintain proper records and must provide their records to the AG upon demand. A failure to do so “is considered a violation of state law,” as is submission of records that lack the required information. In light of the perceived wage violations and decontinued on page 27

with UCANE’s Officers and Board Members Will you please give us some information on your background and tell us how you got started in the construction business? My father owned a MACK truck repair shop in Cambridge, so I was exposed to automotive truck repair even before high school. I worked with my father for about eight years and he not only taught me everything he knew about truck and equipment repairs, he taught me how to run a business. Eventually, while working with my Dad, I bought my first dump truck, a “well-used” 1972 Mack 10-wheeler and started doing some snow plowing and truck rentals on weekends. Before long I was getting lots of calls for my truck rental and I started meeting local contractors in the area. That was the mid80s and that was when I first took an interest in construction and excavation. Pretty soon I was spending less time at my Dad’s shop, and more time with my truck rental. In 1988, I bought my first backhoe, a 1970 Dynahoe, and went off on my own as CHB Excavating. What was the motivating factor that led you to start your own business? Leaving the security of my father’s truck repair business was a little daunting at first, but my father knew what I wanted to do and he was my biggest booster. Equipped with the valuable work ethic that both of my parents instilled in me, and a little bit of construction experience, I felt confident that I could earn a living in the business. We do a decent amount of trucking and hauling, including snow removal, and we continue to rent our equipment out on occasion. CHB pursues this work in Middlesex County, Metro West, and Boston. We bid on work in both the private and public sectors. We have had some long-standing relationships with some large GC’s and local developers. How long has your company been a UCANE member, and why did you make the decision to serve on the UCANE Board of Directors? CHB Excavating has been a UCANE member since 2018. I was always interested in serving on the Board but never had the time to dedicate to the organization. Now that I have the time, I decided to serve on the UCANE Board of Directors to support utility contractors across New England as well as to be a voice for minority contractors. Between COVID-19 issues and supply chain problems, 2021 was certainly a challenging year for contractors. How do you see the New England horizontal and heavy construction market shaping up for 2022, and what do you think are the biggest challenges facing contractors might in 2022? Utility contractors should be prepared to navigate uncharted territory in 2022. The public sector work certainly looks like it is ready to break some records. There is still a demand for housing, and private work doesn’t show signs of slowing down. In normal times this would present a great opportunity to grow my business. But these aren’t normal times. Although the amount of infrastructure work about to hit the streets may look better than ever, CHB will be approaching 2022 cautiously. As a successful small business, I’ve learned not only to limit my risks, but to also realize that “all that glitters is not gold.” n

2022 Scholarship Applications Now Available UCANE to Award Twelve $2,000 Scholarships WHO IS ELIGIBLE TO APPLY? •

Any child or grandchild of a UCANE member OR an employee of a member in good standing.

The applicant should be a high school senior who will be enrolling full time in an accredited two- or four-year academic institution for the year beginning in September 2022 OR a current full-time college student who has not previously received a UCANE scholarship.

HOW WILL THE APPLICATION BE JUDGED? Twelve $2,000 scholarships will be awarded. Two of the 12 scholarships will be awarded to applicants pursuing a construction related degree. There will be a question on the application to indicate if you believe you are eligible for these scholarships. The other 10 scholarships are open to all other courses of study. Applications are judged and winners are selected by independent outside educators. Selection will be based on the overall worthiness of the applicant by considering: 1. Scholastic achievement; 2. New Commercial Drivers License Requirements Set by the FMCSA With the growing need for more qualified drivers and concern for public safety on our highways, the Federal Motor Carrier Safety Administration (FMCSA) has recently set updated minimum training standards for commercial driver’s license (CDL) applicants under 49 CFR Part 380, Subpart E. FMCSA will oversee the new regulations, designed to improve highway safety. Entry-level drivers of commercial motor vehicles must now complete minimum federal training requirements before being permitted to take certain CDL tests.

s of February 7, 2022, the Registry of Motor Vehicles (RMV) is requiring proof of completion of the new Entry Level Driver Training (ELDT) requirements. These requirements apply to individuals who are: • Aiming to obtain a commercial learner’s permit • Upgrading from a Class B to a Class A commercial driver’s license • Applying for their first passenger (P), school bus (S), or hazardous materials (H) endorsement Individuals who were issued a CDL or an S, P, or H endorsement prior to February 7, 2022, are not required to complete training for the respective CDL or endorsement. WHEN YOU DIG IT, USE CAUTION!

BEFORE YOU DIG IT, PLAN IT! • Assign and train a competent person. • Call 811 to identify and mark underground utility lines. • Dig a minimum 5 ft away from utility lines. • Evaluate the soil to determine its stability. • Plan the job layout to identify safe locations for spoil piles and heavy equipment routes. • Before the job starts, if the trench will be 5 ft or deeper, set up a protective system. If the trench will be 20 ft or deeper, provide engineering protections. • Have a traffic control plan and lane closure permits. • Develop a trench emergency action plan.

• Have the competent person inspect the trench, nearby areas, and protective systems each day before the start of work, when conditions change throughout the shift, and after every rainstorm. • Maintain signs, barriers, and protection around the trench. • Keep all vehicles and machinery a safe distance from the excavation. • Ensure ladders and exits are never more than 25 ft away from any worker in the trench. • Remove workers from the excavation upon any evidence that could cause a cave-in. • Monitor other types of trench-related hazards that can occur, such as falls from the edge, rigging hazards, or toxic and combustible gases, or oxygen deficient conditions. • Enforce procedures to ensure that work in an unprotected trench does not occur.

IF YOU WORK IN A TRENCH: Check the trench for problems before entering and never enter an unprotected trench. Make sure there is safe entry and exit before entering. When there is evidence of problems, exit the trench and inform the competent person. Never assume there will be a warning before a cave-in, or that you will have time to get out. A return to in-person events and a review of the Infrastructure Bill was well received by members and guests alike! Sponsored by C. N. Wood Company, Inc. On February 15, more than 150 UCANE members and guests braved the winter cold to attend a long-awaited in-person dinner meeting sponsored by C.N. Wood Co., Inc., at the Four Points by Sheraton Hotel in Norwood, MA. With COVID-19 interfering with most events over the last two years, this meeting was warmly welcomed by our members who were excited to once again meet with their fellow contractors, suppliers, friends, and even competitors! They were even more excited to view a presentation regarding what they and their companies can expect from the recently enacted Federal Infrastructure Bill.

rior to the Cocktail Hour, the UCANE Board of Directors held a combined Board/Government Relations Meeting in a private function room in the hotel. Per usual practice, UCANE members are invited to attend monthly meetings to bring up a current issue or to simply observe the meetings. This evening, approximately 15 members supplemented the 30 Board and Government Relations members that filled the seats around the extended meeting table. UCANE lobbyist Mark Molloy of Cascade Strategies began the meeting and led the Government Relations discussion. He first updated the group on the status of the bills most important to UCANE that are moving through the State House. Many potentially problematic bills for the construction industry were tabled in 2021 because of limited legislative sessions due to COVID-19. One negative bill that would unfairly impose vicarious liability onto general contractors remains alive and will be a focus for UCANE and other construction groups this spring. Mark then noted the unusually large legislative exodus that will be occurring this year at the State House, and reminded Board members to prepare for some personal visits that might be required to introduce our Association, and our current issues, to a host of freshmen legislators this year. As most readers know, the Massachusetts State House has been semi-vacant and totally closed to the public (and lobbyists) for two years due to COVID-19. It re-opened to the public on February 22. The highlight of the meeting was the swearing in ceremony for our 2022 Officers and Board of Directors by Executive Director, Jeff Mahoney, who administered the oath of office to the four officers and the 18 Board members. Incoming President Ryan McCourt praised our Association and thanked everyone for their support. He also thanked outgoing President Marcella Albanese for her two years of outstanding achievements, despite being made more difficult by the pandemic. Ryan then welcomed our new Board members, and thanked our outgoing members for their participation and contributions to our membership and our industry over the last two years. Ryan also asked our members to extend business opportunities to our Associate Members whenever possible. He compared the additional funds coming into our industry to a rising tide, “If we work together, there’s no reason why all of our boats can’t be lifted.” UCANE is always proud to point out that our Board is comprised of both large and small contractors, who represent both union and open shop companies, as well as two Associate Members…this year’s Board continues that tradition. Next, there was a power-point presentation by Mark Molloy explaining when and where the Infrastructure Funding will be distributed in Massachusetts, and how municipalities can access these funds. This information was well received by UCANE members and our six guests from Norfolk-Bristol-Middlesex Highway Assn. and Mass. Highway Assn. who are current or past DPW Directors. Between the new Infrastructure Funds and last year’s unused “American Rescue Plan” funds, Massachusetts and all of New England is in a position to embark on a historic level of investment into roads, bridges, water and sewer, and other underground infrastructure. UCANE members applauded the news and are poised and ready to perform. Following Mark’s uplifting presentation was Peter Howe, principal from the Boston Public Relations firm, Denterlein. Peter updated the audience on UCANE’s onMARCH, 2022

going initiative called #InvestInWaterMA. The goal of this initiative is to keep the importance of investing in underground infrastructure in the conversation, not only for legislators but for the general public as well. With a series of slides, Peter explained how we are using multiple forms of advertising, newspaper articles and editorials, and social media to increase awareness of this issue across the Commonwealth. With funds from the Infrastructure Bill starting to roll into New England, the timing of UCANE’s publicity campaign in early 2021 could not have been better. With Mark Molloy and Jeff Mahoney leading the way, #InvestInWaterMA has signed on 10 other influential associations as partners to our outreach program. They represent a wide ranging group including Environmentalists, Real Estate, BioTech, Commercial Developers, and Municipal Water officials. They all understand the common need for investments in drinking water and sewer systems as not only the first step in growing the Massachusetts economy, but for preserving our quality of life, our natural habitats, and our recreational waters that every Massachusetts citizen has a right to enjoy. Peter Howe’s presentation on the progress being made with our #InvestInWaterMA Campaign was a great ending to not only an enjoyable social occasion, but to a very informative night out as well. n

An Interview with Robert “Brutus” Cantoreggi DPW Director Town of Franklin, MA Will you please provide us with some insight into your background, education, and history that led you into your current position. I have been in the public works field for 23 plus years in various positions in Massachusetts, 16 of those years as the Director of Public Works for the Town of Franklin. Previously, I was the Director of Public Works for the Town of Millis, the Highway and Grounds Superintendent for the Town of Norwood, and I began my career in public works as the Turfgrass Manager for the City of Cambridge. Prior to my career in public works, I served our country starting as a junior in high school in the Massachusetts Army National Guard. While attending college at the University of Massachusetts Amherst, I successfully completed the Army’s Reserve Officer Training Corps Program (ROTC) and was commissioned as an officer and selected to serve on Active Duty in the United States Army with the 7th Infantry Division in Fort Ord, CA. This was an awesome time in my life when I learned so much about managing people. I ended my tenure as a 1st Lieutenant and Airborne Paratrooper in 1993. I returned to College at UMass and continued my education with the GI bill. Besides my degree in Business Management, I gained additional degrees in Agriculture, Arboriculture, and Turfgrass Management. After graduation again from UMass, I was hired as a construction superintendent and built golf courses in Scottsdale Arizona and San Diego California before returning to Massachusetts. What other Industry Groups or Associations do you belong to? I have been a member of multiple public works associations on both the local and national levels for many years. I’m active in the Massachusetts MARCH, 2022

Highway Association where I currently serve on the Board of Directors, as well as being a member of other committees. You’ll also find me at the NorfolkBristol-Middlesex (NBM) Highway Association meetings, where I’ve been a long-time Board member and past president. Both of these groups develop not only camaraderie, they also keep me and other DPW officials up-to-date on what’s happening in the public works business. They are strong voices at the State House for Chapter 90 and other infrastructure funding increases. The development and growth of mutual aid between members has been a great accomplishment, and is helping to stretch our DPW budgets a little further. Last Fall, I had the distinct honor of being selected as a Top Ten Public Works Leader by the American Public Works Association. You might say I’m a big advocate of “Success through Association”! Under my direction the department is responsible for Drinking Water, Wastewater, Highways, Solid Waste, Engineering, Parks and Grounds, Street Lighting, Vehicle Maintenance, Snow Removal, and Stormwater.

Public Works Pipeline continued from page 47 The second biggest issue is the $40 million backlog of roadway improvement the Town is facing. I implemented a road asset management and evaluation plan over 13 years ago to rate and then prioritize road improvements. The issue the town is facing is the big “bubble” of work coming up, because Franklin was the fastest growing community in Massachusetts for many years in the early 1990s. Many of the sub-division roads that were constructed during that time period are starting to fail, even though we have had a very strong and committed maintenance program of crack sealing, chip sealing, mill and overlay, hot in place, and micro surfacing to name a few. Finally, I feel the new Federal funds coming our way is awesome, but it is also going to present many challenges. Obviously all of the new funding to assets, infrastructure repairs, improvements, and construction, is great, but how is it going to all get done? At my level, I know it is going to be a difficult bureaucratic process to obtain the funds and get reimbursed in a timely manner. I really do not have the staff to design and oversee the work at this time. I also think with all of the funds coming down, it is going to be difficult to obtain materials in a timely manner. Just as I am having staffing problems with hiring laborers, inspectors, and managers, I am sure contractors who want to bid

on our work will have a difficult time finding the appropriate staffing as well to be successful and profitable. How has your municipality historically funded infrastructure projects? Does the Town utilize the SRF Loan Program through MassDEP for water infrastructure projects? The Town of Franklin City Council has done an excellent job in funding capital improvement programs over the last 15 years. The biggest local funding commitment has been a five year “water and roads” improvement program where every five years they have authorized $7.5 million in debt service funding. The Town Council has also allocated all the funding from the local hotel tax to road improvements, and usually appropriates $1 million from free cash annually. The Town has used SRF funding as warranted for two water treatment plants and hopefully will again for the upcoming Beaver Street Interceptor Project. The town has also been very aggressive in obtaining grants. Franklin has been awarded over $1.4 million in stormwater grants over the last 15 years. Besides “Complete Streets” and “Small Bridges,” the Town was also just awarded a $.2.2 million MassWorks Grant that will commence next year! continued on page 51

Public Works Pipeline continued from page 49 As you know, the Mass. Legislature has recently allocated some surplus 2021 ARPA funds for horizontal infrastructure work, and the long awaited “Infrastructure Bill” was recently passed in Washington. Both promise to provide substantial funding opportunities for roads, bridges, water, and sewer projects for the next five years (minimum). Is Franklin weighing in at the State House for these funds, and does the DPW have some “shovel-ready” projects available for 2022 if necessary? Our Town’s financial leaders are very much at work now with our local delegation to determine what funding we will be able to count on from the new 5-Year Infrastructure Bill. I’m sure our DPW will qualify for a decent portion of these funds. I’ve got a few projects that are “shovel-ready” now, but it won’t take long to add some more. All in all, it looks like the Franklin DPW will be seeing a sizable increase in activity and spending in the next few years. With inflation fast becoming an issue, there is a concern on how far the money will go, but delaying these needed projects won’t solve that problem. n

GHS: Secondary Containers In 2012, OSHA revised the Hazard Communication standard. That revision included the addition of compliance with the Global Harmonized System (GHS). Material Safety Data Sheets (MSDSs) became Safety Data Sheets (SDSs), and the standardized form for SDSs was adopted. However, compliance with GHS is more than just Safety Data Sheets. We have all heard of the term “Right to Know,” which was created with the original standard, the revised version brought about the term “Right to Understand.”

A

secondary container is any container holding a product that is not the original container supplied by the manufacturer. Three common causes of incidents or health effects that can be traced back to secondary container labels include: 1.

The material was not being used within the same work shift as the person who transferred from primary to a secondary container.

2. The person who oversaw the transfer left the work area. 3. The secondary container itself leaves the work area where it cannot be correctly identified. At a minimum, a secondary container label must include the full name of the chemical and the hazard. Secondary containers are usually smaller, such as spray bottles, jugs, and jars. A driver of whether a secondary container needs to be labeled is based on the term immediate use. Immediate use means that the hazardous chemical will be controlled and used only by the person who transfers it from a labeled container and only within the work shift in which it is transferred. To create a secondary container label, you need to start with the Safety Data Sheet. Every primary container containing hazardous chemicals should MARCH, 2022

arrive from the supplier with an OSHA-compliant Safety Data Sheet (SDS). The SDS will provide the information needed to create the secondary container label. You can find the product name in Section 1 of the SDS. Section 2 provides the pictograms, signal words, and any special hazard statements relevant to the secondary container label. The OSHA Hazard Communication standard allows some limited flexibility when labeling secondary containers. When it comes to primary containers, six clearly defined elements are required, but with secondary containers, the standard is less strict. All secondary container labels must provide the product name and a general hazard statement. To use the bare minimum elements for secondary container labeling, each container must be accompanied by auxiliary information such as the safety data sheet. Secondary containers are often the containers used most frequently, so it’s important to choose labels that are durable, waterproof, and specifically designed to resist damage from chemicals, abrasions, and extreme temperatures. Review which chemicals are frequently transferred to smaller containers and have a stack of those secondary container labels on hand. Ideally, that stack should be located with the primary container. If a particular container gets used repeatedly, you can label that container and leave it ready for the next transfer. Lastly, to ensure everyone understands and complies with the secondary container labeling requirement, you must train them on that. n

How Estimating Software Works and How to Succeed With It Success for every utility contractor begins with bidding. There is no doubt that specialized software brings big speed and accuracy advantages to the estimating process, but moving away from familiar spreadsheets and manual process can be a daunting prospect. Understanding how software applications for estimating work, and the proven processes for implementing and succeeding with the technology, can alleviate some of these fears. The Basics Capabilities, features, and performance of estimating applications vary widely, but the basic premise of how most function is similar. The software allows contractors to pre-populate resource databases with starting-point costs. This could be as simple as the cost per ton of a material like gravel or pipe. Items can also be bundled together into templates and cost structures that align with the type of work a company typically does. A cost structure for a pipe crew, for example, might include the daily costs for the people and equipment associated with that crew. Pre-populated items, templates, and structures become the building blocks for bids. Estimators can plug them in quickly and with confidence, as opposed to starting from scratch on each bid and spending a lot of time researching, verifying, combining, and calculating costs. The basic concept of pre-populated data opens the door to more accurate estimating. In addition to the opportunity to turn out more bids, the added speed can leave more time for strategizing. Estimating software will also do all the calculations automatically through the bidding process, eliminating the dreaded spreadsheet formula errors that can skew the bottom-line price or the totals in individual sections within the bid. Nice-to-Have Features Beyond the basics, more advanced estimating software applications have features that further streamline the bidding process. These are four that contractors find especially valuable. Software can send RFQs automatically and then assist in a methodical analysis of the submitted quotes. Changes in scope after the original bid are common across most sectors. The ability to organize change orders within the base bid and have them appear as independent nodes in the menu structure allows estimators to create, manage, and track them quickly and easily. Being able to run reports across selected ranges of previous estimates without a lot of time-consuming manual effort is extremely important to bidding strategies. This allows contractors to analyze historical costs for materials or tasks, margins, and variances with actual costs, win-loss ratios, subcontractor performance, and a wide range of other data. Good estimating applications come with specific pay item databases for every U.S. state built in. Once estimators populate them with their own prices, they can download electronic bidding system (EBS) files, conform the estimate automatically to the required DOT format, and upload for submission very quickly.

The Implementation Process Estimating software suppliers thrive not just on the merits of their technology, but also on their ability to help customers succeed with it. The good ones have extensive experience in assisting construction companies in the transition away from paper and spreadsheets. They deliver a proven, structured process for installation, implementation, and training that is balanced with the ability to customize according to the specific work types, needs, expectations, and experience level of each contractor. Implementation typically kicks off with a call to identify estimators and key people on the contractor side that will be involved and to set requirements, expectations, and a timeline for the process. IT requirements to run the software and any integrations, such as with an accounting program, should also be covered in this initial phase. Next, a series of calls is usually held to help contractors build the all-important estimating databases that will be the foundation of their success with the software. This transfer of knowledge from spreadsheets, the personal experience of estimators, and other sources to the software program can seem like the most challenging piece of the transition, but softcontinued on page 63

Too Busy continued from page 65 years ago. It grew quickly to $2 million in sales with 15 employees. Then the economy started to take off and he grew to $5 million in annual revenue. This increased workload was beyond his ability to properly manage all the contracts he had signed. As a result, he worked harder, got out of control, profits began to fade, had no life, and he was stuck being too busy. When his company was smaller, it was easier for him to act as the ship’s captain, process the work flow, and meet with customers to keep them happy. But now he had to work harder and harder to keep his company above water at a higher and faster pace. Dan was frustrated and needed help. He had a few supervisors and key foremen, but he hadn’t delegated much of his responsibilities. He was still preparing the estimates, scheduling crews, awarding subcontracts, and negotiating every general contract. When he first started his company, he had time to find new customers, manage the work, and make sure everything went well. But now that wasn’t happening, and customers were demanding more hands-on supervision, lower prices, and faster schedules. Dan was stuck, too busy taking on low price work, and his old ways of running the business weren’t working at a higher level.

Building a better construction business takes a commitment to continuous improvement. Realize you’re never finished getting better or upgrading. When you get too busy, you don’t have time to improve your operations, productivity, people, customers, or margins. You only have barely enough time to keep doing what you always have done at a faster speed with lower results. And when great opportunities come along, you can’t fit them into your program and you miss out on better projects and customers.

Remember Your Vision! When your business began, you had a vision and goal of high margins, great customers, productive energized employees, organized systems, excellent service, and plenty of time to enjoy your time off. As you got busier, these dreams all got postponed and pushed aside in the pursuit of more. At this level, the owner acts as supervisor in charge of every decision, contract, customer conversation, price, purchase, delivery, and what work gets done when. Too Busy continued from page 66 employees. He is the boss and calls all the shots. He is the business. Without him, there is no business and no company. And worst of all, there is no time to upgrade or improve any part of the company. As the small business owner does excellent work, he or she gets more referrals, customers and jobs. With more referrals, your company continues to grow. This requires renting a small shop or office. Next, you hire a field foreman, more field workers and a part-time office assistant to help with paperwork and pay the bills. At this point, the owner is still the estimator, salesman, project manager, and general field superintendent with everyone reporting to him. As the hands-on supervisor and manager, he makes every decision, signs checks, and still oversees each transaction, customer, contact, purchase, proposal, invoice, subcontractor, and employee.

More Work is Not the Answer! More work keeps coming. So next he hires a junior project manager or estimator, and a full-time administrator to handle more of his workload. Now as a micromanaging boss, he gets frustrated with employees not doing things the way he wants. He starts to get more and more stressed-out having to keep too many balls in the air, managing lots of people, and

getting all the work done. He feels over-worked and out of control without systems, structure, standards, accountable employees, or a handle on job costs. Cash-flow is tight, he spends lots of time chasing money, and he’s not getting a very big paycheck for all the effort and time he works. The pressure of owning and running a too busy business is getting to him. He’s not achieving his vision and doesn’t see how he can ever get his business to work. Most small business owners stay stuck at this level - too busy keeping their speeding boat headed in the right direction while continuing to do the same things without taking time for improvement. When companies grow beyond the level where the business owner can control everything himself or make all the important decisions anymore, it gets stuck. At this point, the owner is unable to manage, supervise, and take care of everything efficiently. He or she knows they need to do something different, let go, hire better people, delegate, install systems, find better customers, improve service, get a better handle on costs, or find more hours in the day.

Too Busy continued from page 67 with too much work and nothing to show for it, you begin to hate going to work because of all the demands, stress, and pressure to get everything done for your customers, employees, bankers, bonding company, subcontractors, and suppliers. But you don’t have any time with all the work you have to complete! yan is the fifth generation President of McCourt Construction Company of South Boston, MA. He attended Boston College where he graduated with a Bachelor of Science Degree in Finance. Soon after graduating, he joined his family’s business. McCourt Construction has been a leader in the construction industry since 1893. Ryan, along with his brothers Matt and Trevor continue to tackle some of the largest and most complex construction projects in New England. Ryan is following in his father Richard’s footsteps, and moving up the ranks at UCANE. He previously served on our Board of Directors, and later took on the offices of Secretary, Treasurer, and President Elect for two years each. In addition, like his father before him, Ryan is a member of the McCourt Foundation’s Board of Directors. Ryan steps into the President’s role as the Bipartisan Infrastructure Bill is about to finance an historic amount of national investment into our country’s roads, bridges, and underground Infrastructure. For Ryan, and so many other UCANE members, the Infrastructure Bill is a testament to their many years of pressing public governments at every level to close the growing gap that has long existed resident between infrastructure needs and funding commitments. As one of the larger employers in the Massachusetts heavy conyan c ourt struction industry, Ryan has been actively working with UCANE’s lobMcCourt Construction byist, Mark Molloy, Executive Director, Jeff Mahoney, and fellow officers to promote the construction trades as a solid career choice for Company young graduates and those wanting to change their current career. Ryan and McCourt Construction are well known and respected on Beacon Hill, and he looks forward to working with our legislators and agency officials to not only make sure that Massachusetts takes maximum advantage of what the Infrastructure Bill has to offer, but that the State has the next generation of construction workers available to build the much anticipated projects ahead. Ryan is committed to increasing UCANE membership during his tenure and has issued a challenge to his fellow officers and Board members to recruit at least one of their vendors or subcontractors to join UCANE in 2022. He understands how important our Associate members are to UCANE’s success, and reminds contractors to extend bidding opportunities to our Associates whenever possible. Ryan is honored to step into the President’s position and he extends his congratulations and sincere thanks to our outgoing President Marcella Albanese (Albanese Brothers, Inc.) for a job well done. rian is Vice President and Project Manager of C. C. Construction, Inc. of Plymouth, MA. His father, Christopher Cooney founded the company in 1983 and they have been UCANE members since 2009. C. C. Construction performs site work and utility work on the entire South Shore, including Cape Cod and the Islands. Brian graduated from Northeastern University in 2009, with a Bachelor’s Degree in Finance and Entrepreneurship. He also took construction management classes at Wentworth Institute of Technology at night. Soon after receiving his degree, Brian joined his family’s business. Brian previously served as UCANE Secretary and Treasurer, and is currently serving as President Elect. He will face the challenges our industry has with project funding and permitting head on, in an effort to get more projects out to bid and on the street.

hris is Vice President of GVC Construction, Inc. of Lunenburg, MA where he works with his wife Geselle who is President of the company. His brother Michael Valenti, Jr. is also a Vice President of the company and works side by side with Chris and Geselle. GVC was founded by Geselle and Chris in March of 2000, and along with Mike they perform utility and heavy civil construction projects in Massachusetts, Southern New Hampshire, and Southern Maine. Chris studied Construction Management at Wentworth Institute of Technology and the company is now SDO Certified MBE/ WBE/DBE and SBA Certified EDWOSB. GVC joined UCANE in 2004, and throughout the years Chris has been an active member, having served on many of our Committees. He previously served as Secretary for two years and is now serving as Treasurer. He has earned the respect and admiration of his peers within the utility construction industry, and his ongoing commitment to UCANE is evident by his efforts in effectively communicating the issues of vital importance to our industry.

Querino Pacella - RJV Construction Corp.

Q

uerino is President of RJV Construction Corp. of Canton, MA. The Pacella name in the Massachusetts utility construction industry goes back 75 years. Querino’s grandfather was one of the founding members of UCANE in 1954. The Pacella family has been active members of UCANE ever since, and Querino follows a long line of his relatives who have taken leadership roles in our Association. He grew up in the family construction business before attending Worcester PolyTechnic Institute where he graduated with a degree in Civil Engineering in 1999. After two years working at a Boston engineering firm and earning his Professional Engineers License, Querino returned to the family business where he worked his way up over the past 20 years. In 2019 Querino and his two brothers Chris and Ron III and two cousins David and Victor took over ownership of the 4th generation business. Querino has been active on several UCANE committees and has been on the Board of Directors for four years before stepping up to the Secretary position this year. He is an effective communicator and a staunch supporter of clean water programs, as well as open and fair competition in the underground construction industry.
