Clean Drinking Water is Taken for Granted…Again!

A recent story making headlines reminded me that the majority of people don’t even think about how their clean drinking water gets to their faucets and are even less mindful of the condition of underground water pipes.

It is basically out-of-sight and out-of-mind. We all need to face facts: CLEAN WATER is TAKEN for GRANTED. It’s expected that when the faucet is turned on, clean water magically appears. Other misconceptions are that clean water is a human right; that there is an endless supply, and that it is free. These misconceptions are the driving force behind UCANE’s efforts to tell the full story, but sometimes I wonder if the message is getting through.

A

case-in-point is U.S. News and World Report’s recent article on the “Best States Rankings,” where Massachusetts came in at #1. The news media gave a lot of attention to the rankings and of course leaders in the states that were highly ranked spoke positively about their state’s livability. Now I live, work, and raise my family in Massachusetts; and I think this state is exceptional with or without this report, but I was curious about the criteria used to set the rankings. The answer was in the article: Education (MA ranked #1), Health Care (MA ranked #2) and several other categories that all made sense as to why Massachusetts was ranked first.

One category where Massachusetts did not do well was the infrastructure category where Massachusetts ranked #19, its lowest rating in any category. At first glance that was not much of a surprise; since I knew that our state has an estimated $20 billion gap in our water infrastructure funding, as well as the need to invest billions of dollars to rebuild our roads, bridges, and our public transit system. What was surprising and extremely disappointing were the three subcategories of infrastructure that were evaluated. The report looked at Transportation (roads, bridges, public transit, and commute times), Energy (reliability of power grids, renewable energy consumption, and the price of electricity), and lastly, Internet Access (download speed for broadband and the percentage of households with broadband internet). That was it!

There was no mention or consideration of water quality; or the condition of each state’s water infrastructure; or the plan for future water needs.

While in today’s world internet access is important, it pales in comparison to the need for clean drinking water.

A person can go a day without access to their favorite show on Netflix, however it is a lot more difficult to live without access to clean drinking water. This was yet another example of people taking clean drinking water and our underground water infrastructure for granted.

So while we rightfully should take pride in having Massachusetts ranked #1 by U.S News and World Report, we should also recognize the limitations of this ranking based on the criteria evaluated and those criteria not considered.

If anyone thinks that clean drinking water is not important, then they should visit Flint, Michigan and sample their water, and see the devastation that polluted water has caused to that city’s economic base and the health of its citizens.

Everyone in local, state, and federal government must get the message out to the public that our clean drinking water supply is not inexhaustible and the process to get it from its source to their faucet takes considerable construction skills…and of course it’s not FREE! UCANE will continue to advocate for investment in water infrastructure, one of our core missions. However, this can’t happen without the strong support of our membership.

I had the opportunity to review all the congratulatory ads and well wishes placed in this month’s magazine by our members and friends. To say that I was overwhelmed by this show of support is an understatement.

I know I speak for each Officer and Board member when I say thank you for your ongoing support. I will do everything in my power to maintain UCANE’s outstanding reputation and prestige. I am proud to serve as UCANE President this year, and I feel honored to have the support of all our members. Thank you. n

Committee Leadership Announced for 2017-2018 Legislative Session

n mid-February, the Massachusetts House and Senate announced their leadership teams for the 2017-2018 legislative session. Both the House and Senate top leadership remains essentially the same. Representative Ron Mariano remains Majority Leader; Representative Pat Haddad remains Speaker Pro Temp, and Representative Brian Dempsey remains the Chairman of the House Committee on Ways and Means. Of note, the only real upper leadership change in the House is Representative Mike Moran moving into the 2nd Assistant Majority Leader position. On the Senate side, Senator Harriet Chandler remains the Majority Leader, Senator Marc Pacheco remains Senate President Pro Tempore, and Senator Karen Spilka remains the Chairwoman of the Senate Ways and Means Committee.

Of particular note to UCANE’s membership and the committees that handle many of the matters impacting the membership, the following leadership personnel were appointed: Joint Committee on State Administration.

This committee, which considers legislation impacting public construction and procurement, will see the return of House Chairman Peter Kocot and the arrival of Senator Walter Timilty, who served in the House last session.

Joint Committee on Labor and Workforce Development. This committee will have entirely new leadership from the previous session as Senator Jason Lewis and Representative Paul Brodeur assume the mantle of this important committee. The committee will consider the wide sweeping “wage theft” legislation that seeks to attach joint and several liability to any subcontracting arrangement. The Committee will also be charged with considering the ever contentious “non-compete” legislation that almost reached the Governor’s desk last session, but failed to emerge from a conference committee.

Joint Committee on the Environment, Natural Resources and Agriculture. Considering matters impacting air quality and, equally important, water infrastructure, this Committee will continue to be led on the Senate side by Chairwoman Anne Gobi. Representative Gail Carridi, a first time Chairwoman, will lead the House side, bringing issues of importance to her district in Western Massachusetts.

Joint Committee on Consumer Protection and Professional Licensure. Senator Barbara L’Italien and Representative Jen Benson will continue their partnership as respective Chairs for a committee that considers licensing matters for trades as well as consumer protection issues.

Joint Committee on Public Safety. Helming the committee that oversees issues impacting trench safety, police details, fire safety, and hoisting laws, Senator James Timilty and Representative Hank Naughton were both re-appointed as Chairs for this wide-ranging and important committee.

Joint Committee on Revenue. Senator Mike Brady, a first time Chairman and recent House member, will be joined by longtime House Chairman Jay Kaufman. The Committee, which is charged with reviewing all matters increasing or decreasing taxes, will likely review a variety of matters, which seek to fund the existing $20 billion water infrastructure gap within the Commonwealth.

With committee appointments now completed, the various committees will begin to sort through the legislation sent to them by the respective House and Senate Clerks. After leadership announcements were made, both the House and Senate Clerks began releasing timely filed legislation to the subject matter committees. It is anticipated that public hearings on filed matters will begin in mid-March. continued on page 9

Preparing for the Inevitable, Town of Milton Takes the Lead and Begins Collection of Stormwater Fees

A

s reported by the Patriot Ledger, the Town of Milton became one of the first towns in Massachusetts, if not the first town, to institute a stormwater fee to address the expanded requirements of the United States Environmental Protection Agency (EPA).

As explained on the Town of Milton website, Milton has been in compliance with the EPA permit since it was first issued in 2003. To address the additional costs with the expanded EPA requirements, the Town expects to spend more than $700,000 to fully comply with the first year requirements of the new EPA permit.

The National Pollution Discharge Elimination System Program (NPDES) Stormwater Program, in place since 1990, regulates discharges from municipal separate storm sewer systems (MS4s), construction activities, industrial activities, and those designated by EPA due to water quality impacts. At the

onset of the program, only large cities were regulated under NPDES. In 2003, NPDES jurisdiction was widened to include all communities (except the smallest and most rural) across all of the USA. This expanded jurisdiction is known as NPDES II, and Milton first became included in the NPDES jurisdiction.

The NPDES permit was set to expire after five years from the effective date (2003-2008). Ever since 2008, the EPA has issued annual extensions to the permit so that they, and all states, could work out the conditions and requirements of a proposed broader and stricter new permit. Finally, in 2016, the EPA issued the new permit to Massachusetts, which affects all communities, including the Town of Milton.

In explaining their decision to levy this fee, Town officials pointed out that Milton has been far ahead of other communities by addressing the cost question for over three years now. A pilot study was commissioned continued on page 11

Legislative Update continued from page 9 allowing Milton to develop and understand what the cost implications of the new permit would be and to identify and consider several funding options.

Of all of the options available, and as a matter of providing the greatest degree of fairness and equity to all fee payers, the Milton Board of Selectmen elected to base the stormwater fee calculation on a “per square-foot of impervious surface” basis. The Selectmen also chose to use a four-tier system that would set a fixed annual stormwater fee for each of the four ranges of impervious area for single-family properties. The annual stormwater fee for all other property types would be based upon a calculation of the property’s impervious area.

The stormwater fees were calculated using a GIS Based analysis that determined the amount of Impervious Surface area located on each property. This analyses was completed by the Milton DPW Geographic Information System (GIS). Data for this analyses was taken from the Milton DPW’s Geo-spatial data library and the Milton Assessor’s Office. Property types were determined using the land use code from the assessor’s database and the property type classification codes from the Massachusetts Department of Revenue. continued on page 13

MassPIRG and Toxics Action Push for Mandatory School Lead Testing for Water Infrastructure

A

s reported by various media outlets, environmental advocates, MassPIRG and Toxics Action, are advocating for legislation that would require every school and early childhood center in Massachusetts to test water fountains for lead and eliminate any lead that is found.

Voluntary testing by school districts last year found lead in approximately half the drinking fountains tested.

The legislation, which is sponsored by Senator Joan Lovely and Representative Lori Ehrlich, would require the state's public water systems to remove lead service lines from all schools, public and private, and early childhood care programs within three years. The service lines that bring water into the school from an outside water supply may, in some cases, be a source of lead in drinking water. It is estimated that the cost of replacing

these primary lines could cost $3,000 to $5,000 each under ideal conditions.

The legislation would also require annual water testing in schools and early childhood programs. If elevated levels of lead are found, the school would have to shut off the fountain with the lead and fix the problem. The bill would require any school with elevated lead levels to install lead filters on faucets and fountains.

In terms of paying for this mandate, schools would be responsible for covering the costs of testing and remediation. While the Commonwealth would be required to provide a list of potential funding sources to public schools, the state would not be subject to pay for the proposed mandate.

Legislative Update continued from page 13 poisoning that can come from things like lead paint, scientific organizations have increasingly studied the danger of even low levels of lead in children. The American Pediatric Association and the Centers for Disease Control and Prevention have both updated their guidelines in the last few years to say that there is no safe level of lead for children.

Lead exposure in children can lead to problems including anemia, kidney disease, and abnormal brain function. The voluntary testing program made possible by the Massachusetts Department of Environmental Protection tested 40,000 public school water fountains with about half of the tested items showing some level of lead contamination. The vast majority of those were in concentrations of greater than one part per billion, which is the level at which the bill would require schools to take action to eliminate the lead. The Massachusetts Water Resources Authority and the Massachusetts Clean Water Trust have also developed programs to eradicate lead from school water infrastructure. continued on page 17 Since 1962

Treasurer Announces Two New Deputy Treasurers

ccording to a press release from the Office of the Massachusetts Treasurer, Treasurer Deborah Goldberg named Sue Perez and Sarah Kim as Deputy Treasurers for the Commonwealth.

Sue Perez was promoted from her previous position as Assistant Treasurer and will continue serving as Executive Director of the Massachusetts Clean Water Trust and overseeing the Commonwealth’s Debt department.

Ms. Perez has over 25 years of experience in accounting, audit, and financial management and is a graduate of the Boston University School of Management. She has been the Senior Finance Director for a $3.4 billion service company and at the other end of the spectrum, was one of the initial members of a start-up company with the responsibility of establishing the finance and human resources departments.

Perez was an auditor at Pricewaterhouse Coopers, during which time she received her CPA. Sarah Kim has served as General Counsel to the Office of the State Treasurer and Receiver General

since the start of Treasurer Goldberg’s administration. As General Counsel, she manages the legal team that provides support to the Treasury.

Previously, she was an attorney in the litigation practice group of Bingham McCutchen LLP (now Morgan, Lewis & Bockius LLP). Ms. Kim is a graduate of Villanova University School of Law and Dartmouth College.

Auditor Announces New Director for Division of Local Mandates

S

tate Auditor Suzanne M. Bump recently announced that Ben Tafoya has joined her staff as Director of the Division of Local Mandates (DLM), the division that recently produced a water infrastructure report outlining the rising costs for municipalities throughout the Commonwealth.

According to the press release issued by the Auditor’s Office, Tafoya will oversee the day-to-day operations of DLM, which was established to respond to requests from municipalities to determine whether the state has passed an unfunded mandate on to local governments.

Most recently, Tafoya was Academic Program Director for the doctoral program in Public Policy and Administration at Walden University. He previously served as Interim Program Director for the doctoral and masters programs in Criminal Justice and as an Assistant Professor of Political Science. Tafoya has also been a Senior Lecturer at Northeastern University since 2009. He was on the Board of Selectmen in the Town of Reading for nine years, serving multiple terms as the chair and vice-chair.

A Reading resident and former Selectman, Tafoya holds a bachelor’s degree in Economics with a minor in Government from Georgetown University, a MBA from Suffolk University, and a Doctorate in Law and Policy (DLP) from Northeastern University. He has been active in local and state politics for many years. n

Representative Joseph Wagner (D-Chicopee) House Chairman, Joint Committee on Economic Development and Emerging Technologies

Representative Wagner lives today in the community where he grew up.

As such, his Chicopee roots are deep. He has dedicated the better part of his adult life to public service with the belief that collaboration and partnerships on common goals can improve a community and the quality of life for its people. Earlier in his career, he spent four years in the Chicopee Mayor’s Office where he developed extensive knowledge with respect to the strengths and challenges in his city in such areas as economic development, urban planning, infrastructure and transportation, and sustainable housing policy. In seeking elected office in 1991, he saw an opportunity to build upon the foundation he had established and make a greater impact in his hometown. As a state representative, he believed he could use that position to advance and develop partnerships on a larger scale to secure resources to increase opportunity and services in the district. As he reflects, he feels that he has accomplished a great deal in obtaining resources to improve the city’s schools, infrastructure network, and regional economy. However, each day he seeks to take on a new challenge to better the quality of life for residents in Chicopee and across Massachusetts. Representative Wagner’s drive for this is as strong as ever.

Q:

Massachusetts, along with the rest of the country, continues its rebound from the previous economic downturn. Please give your thoughts on how the state will continue to support local aid to cities and towns to help support basic municipal services, specifically water infrastructure.

A:

Although we’ve faced some fiscal challenges in recent years, I am proud of the legislature’s commitment to local aid. With that said, I am cognizant of the fact that the state’s limited resources are insufficient to satisfy the level of investment necessary to advance many local projects that are in some stage of the planning. In my role as Chairman of the Joint Committee on Economic Development and Emerging Technologies, I had the opportunity to help shape and advance the Expanded Gaming Act in 2011. One of our key priorities when crafting the bill was to protect and increase local aid. As such, we set forth in statute that 100 percent of tax revenue received from the slots licensee be dedicated to local aid. This generated over $66 million in local aid dollars in Plainridge Park Casino’s first year in operation. Additionally, we also

provided that 20 percent of state revenue dollars generated by the resort casinos go directly to local aid when they’re operational. Another 4.5 percent of total tax revenue from the category 1 gaming establishments will be dedicated to a local capital projects fund to provide cities and towns with an additional source of funding to complete local projects.

The General Court also passed a municipal modernization bill last session that updated regulations to allow for more efficient governance at the local level. The economic development bill enacted last summer provided a number of tools for our municipalities to utilize, particularly in the area of infrastructure. Taken as a whole, these efforts serve to illustrate the state’s commitment to provide new and additional resources to assist communities in addressing important infrastructure needs, namely water infrastructure.

Q:

The Massachusetts Water Infrastructure Finance Commission found that there is a $20 billion gap in water and sewer infrastructure over the next 20 years in the Commonwealth. Representing the City of Chicopee, can you discuss some of the water continued on page 21

Over the past number of years, the City of Chicopee has made significant efforts to separate sewer and storm water pipes to prevent backups and overflows in the city and the Connecticut River, which can be problematic for residents and the environment.

Meanwhile, the city continues to make investments to replace antiquated water mains and upgrade infrastructure.

Last session, I filed a local approval bill to accommodate the installation of a new water transmission line to serve as a backup water supply for residents as a safeguard against a major breach in an agingBoston main water line. As you note, the WIFC raised a great deal of awareness on the challenges relative to drinking water infrastructure and wastewater projects.

The 2014 reform bill, An Act improving drinking water and wastewater infrastructure, made some great strides in taking a run at that gap, and I expect we will build on those efforts.

Interview continued from page 21 site assembly, site assessment, pre-development permitting, and other pre-development and marketing activities in an effort to enhance a site’s readiness for commercial, industrial or mixed-use development. On a similar note, we provided a $15 million authorization for the Innovation Infrastructure Program to make grants and loans available to municipalities, private property owners, and business operations for design, construction, and improvement of buildings and for equipment to spur innovation and entrepreneurship across the state. We also advanced $45 million in capital dollars for the Brownfields Redevelopment Fund and $45 million in capital spending for the Transformative Development Fund to support development projects in Gateway Cities around the state. By putting state dollars on the table to support infrastructure, such as water, sewer, and other improvements, the businesses, jobs, and housing units are much more likely to follow.

Q: A:

As the legislature heads into the 2017-2018 session, can you share some of your priorities for this session?

Workforce development is always a top priority for me. We’ve made some real gains in the past few years through economic devel-

opment legislation and budget commitments to advance policies and investments to support training programs and make efforts to narrow the skills gap. However, there’s always more that can be done. Employers often mention to me that they experience challenges in finding the skills needed to support their businesses and spur growth. I know well that sound workforce development policy and sound economic development policy go hand in hand. Last summer’s economic development bill included $45 million in capital dollars to purchase and install equipment and related building improvements for career technical education and training programs that are aligned to regional economic and workforce development priorities.

This investment will allow our young men and women to learn trades and skills on cutting edge technologies so that they’re prepared to enter the workforce and step into rewarding careers. This session, I’ve filed a bill to establish a sustainable funding mechanism for the Workforce Competitiveness Trust Fund, which provides grants to develop training programs to meet the skill needs of high demand occupations, such as healthcare, manufacturing, and the construction trades. Our workforce is our greatest asset so we must continue to build on our talent pipelines. It is my expectation, and certainly my goal, that the legislature will continue to work with the administration to support targeted MassWorks investments to improve infrastructure in support of economic development. n

OSHA’s New Electronic Reporting, Employee Notice, and Anti-Retaliation Rules Take Effect On May 13, 2016, the Occupational Safety and Health Administration (“OSHA”) published a final rule for the electronic reporting and publication of employer injuries and illnesses, requiring employers to notify employees of their right to report injuries or illnesses, and protecting employees from retaliation for reporting injuries or illnesses.

Construction industry employers are subject to this rule.

A. Electronic Reporting Requirement Effective January 1, 2017, this rule requires certain employers to electronically submit injury and illness data to OSHA. This data is the same they have already been required to collect. ​OSHA intends to have software available for employers to make their submissions. Existing employer data and forms and formats may not be compatible with the OSHA software. ​By July 1, 2017, establishments with 250 or more employees or 20-249 employees must electronically submit Form 300A to OSHA. ​As of July 1, 2018, establishments with 250 or more employees must submit Forms 300A, 300, and 301 to OSHA electronically. ​In 2019, the submission deadline will be changed from July 1 to March 2. ​It is unclear whether each construction site is or is not a separate establishment for electronic reporting purposes. ​OSHA will post the establishment specific injury and illness data it collects under this rule on its public website (www.OSHA.gov). By OSHA posting raw data, the data may not accurately inform the public

of the totality of the circumstances that may have caused the injury or illness.

B. Employee Reporting Rules Since August 10, 2016 this rule requires employers to establish “reasonable procedures” for employees to report work-related injuries or illnesses. The rule did not specify whether the required procedure be in writing. However, to be able to provide evidence of a reasonable reporting rule, it is recommended it be in writing, distributed to employees, and posted at each jobsite. There is presently pending litigation brought by OSHA claiming an employer rule requiring reporting within seven (7) days of injury or illness is illegal because it would discourage reporting. As the case proceeds, we will monitor it.

C. Anti-Retaliation In effect since August, 2016, the rule expressly prohibits retaliation for reporting work related injuries or illnesses. Under the rule, OSHA may cite an employer who it believes retaliated against an employee for filing a safety and health complaint, requesting access to OSHA related safety and health records or exercises rights under the OSH Act. UCANE Seminars Held on Asbestos-Cement Pipe and Competent Person/Confined Space Entry February was a busy month at UCANE, and members proved once again that safety is their top priority, as large numbers of owners and employees attended UCANE safety seminars on Asbestos-Cement Pipe and Competent Person/Confined Space Standards.

wo capacity training classes were held at the Irish Cultural Centre in Canton, MA dealing with asbestos safety, titled “8-Hour OSHA Class II Asbestos Training: Asbestos-Cement Pipe (ACP) Worker Safety. The classes, presented by Greg Morsch of ATC Group Services covered important topics such as the identification and recognition of asbestos related materials, the potential devastating health effects related to asbestos exposure, federal and state regulations, safe work practices, tool demonstrations, respiratory protection, and waste handling procedures. This course is certified by the MassDEP and is a must for any employee who may come in contact with asbestos pipe on a jobsite.

Once completed successfully, employees are given a certificate valid for 5 years.

At our other February seminar, UCANE was once again fortunate enough to have veteran safety trainer John Barrasso fit a Massachusetts Safety Class into his busy schedule. On February 16 John con-

ducted his comprehensive session at the Lantana in Randolph, MA, in front of a sellout crowd of UCANE member employees. Trained by OSHA, John has been doing these training sessions for UCANE for more than 30 years. He is well known to other trade associations up and down the East Coast for his forte in excavation safety, confined space entry, and training employees to become Competent Persons as defined by OSHA. John’s knowledge of the OSHA standards is matched only by his experience with real on-site construction challenges faced by utility contractors. His 20 years as a construction superintendent/manager for one of New England’s largest heavy civil and pipe contractors allows John to communicate with his UCANE audience on a special level.

The comprehensive full-day seminar covered all current OSHA Standards and best practices for CFR 1926 Excavation, SubPart P. How to test for and identify soil types, selection of shoring equipment, record keeping, and the responsibilities that come with being a “Competent Person” were reviewed through discussion and video presentations. This year’s attendees were a mix of those who were there for the first time, and those who had previously attended one or more or our seminars. While UCANE will continue to keep our members updated on the latest OSHA rulings through email as well as our monthly magazine, the best way to get this information disseminated throughout your company is to send your management personnel, foremen, and employees to our seminars. Being prepared, and knowing and following the rules is the only way to assure the highest levels of safety. n

regarding constant monitoring of confined spaces, and changes to rescue team requirements were discussed along with a multitude of existing OSHA rules that govern employees working in a confined space.

John’s presentation also highlighted OSHA’s new ruling on jobsite silica (dust) and how it impacts conventional work practices, as well as tool selection in 2017. The need for employees to receive job and tool-specific training for dust causing operations was stressed. The need for jobspecific “Dust Control Plans” and the role of the competent person in monitoring compliance with those plans would not only be new responsibilities but also an OSHA emphasis for 2017.

MBE/WBE Bid Protest Issues The Bid Unit of the Massachusetts Attorney General’s Office (the “AGO”) posts bid protest decisions in a searchable online database located at http://www.bpd.ago. state.ma.us/. This is an incredibly helpful library for those interested in bid protest issues both current and historical (the AGO’s database includes decisions dating back nearly three decades). The AGO’s database can provide a glimpse into how the AGO is treating hot-button bid issues. There may be no better example than recent bid protests involving MBE/WBE issues.

T

he AGO issued four notable MBE/WBE decisions in a nine-month period, reaching varying results in each case. At first blush, these decisions may seem inconsistent. But a closer review demonstrates that – although the conclusions differed – the AGO’s approach remained steady.

Case No. 1 (12/11/15). The first case may come as a surprise to those familiar with MBE/WBE bid protests. This is because the AGO determined it did not have jurisdiction to decide the case, even though it has been deciding MBE/WBE cases for years. However, the issue in this case did not involve questions of compliance with MBE/WBE bid submission requirements. Rather, the protestor challenged whether certain subcontractors could be properly certified as MBEs at all. The Supplier Diversity Office (“SDO”) had certified the subcontractors as MBEs, but the protestor argued that, as Portuguese Business Enterprises (“PBEs”), the subs could not qualify as MBEs under M.G.L. c. 7C. Since the protest did not involve the public bidding laws, the AGO concluded that “[i]f there has been any violation of any statute or the regulation, it is a matter for SDO to address.”

Case No. 2 (6/13/16). The second bid protest was different. Although Chapter 7C was relevant to the protest, there was no jurisdiction issue because the protest did not challenge the SDO’s certification of MBEs. Instead, the question was whether a bidder could submit its MBE/WBE forms after bid openMARCH, 2017

ing when the bid documents were “emphatic” that late forms would not be accepted and would result in the bid being declared “informal,” resulting in rejection. The answer in this case was “no.” Since it was a state-funded project, Chapter 7C required the awarding authority to provide the processes and procedures for MBE/WBE participation. The awarding authority did so, mandating that the MBE/WBE forms be submitted at bid time and cautioning bidders that a failure to do so would be grounds for disqualification. In these circumstances, the untimely submission of the required MBE/WBE forms was fatal. The AGO recognized that accepting late MBE/WBE forms in this case (which required the bidders to identify their MBE/WBE subs) would permit inappropriate bid shopping. continued on page 35

Legal Corner continued from page 33 Case No. 3 (8/25/16). The third protest also involved a situation where the low bidder submitted an MBE/WBE form late on a state-funded project.

This time, the AGO allowed the awarding authority to accept the bid. Unlike the second protest above, the bid documents in this case did not state that the awarding authority must reject bidders who submitted their MBE/WBE form late and the form itself did not require bidders to identify their MBE/WBE subcontractors. In addition, the bid documents expressly required post-bid negotiations with MBE/WBE subcontractors, so there was no danger of bid shopping.

As a result, the AGO distinguished its prior decision and concluded that the late submission of MBE/WBE forms was not fatal to the bid.

Case No. 4 (9/7/16). The last case in this series of MBE/WBE decisions dealt with a MBE/WBE “Letter of Intent” form, which was part of the bid package. The awarding authority rejected the protestor because the protestor did not fill out and sign the Letter of Intent form. But the reason the protestor did not fill out and submit the form is because the protestor was not a SDO-certified MBE/WBE. The AGO determined that the awarding authority improperly rejected the protestor because the language of the Letter of Intent form made “crystal clear” that only bidders who

were certified as MBEs/WBEs were required to complete and submit the Letter of Intent. Since the protestor was not a certified MBE/WBE, it “did not have to fill out and sign” the form.

“Final Thoughts.” All four cases can be reconciled. While the AGO does not have jurisdiction to determine questions of MBE/WBE certification, it continues to have jurisdiction over questions of compliance with MBE/WBE bid submission requirements. Those issues are often fact-specific, and will be decided on a case-by-case basis depending in large part on the plain language of the bid documents. Importantly, if the project is state-funded – and the bid documents make MBE/WBE bid submission requirements absolutely mandatory – a failure to comply with those requirements can be fatal. But bid documents are not all made the same, and a failure to strictly comply with MBE/WBE bid submission requirements may not always require rejection if that is not spelled out in the bid documents.

These MBE/WBE issues can be subtle, and when it comes to state-funded projects, involve a recently amended statute.

As a result, we expect that MBE/WBE bid protest issues will continue to crop up in 2017 and beyond. n

Wastewater Issues Stymie Buzzards Bay Redevelopment BUZZARDS BAY — While the journey to revitalize Main Street has several obstacles, including multiple dilapidated buildings and flood zone and transportation issues, perhaps the largest roadblock is the lack of wastewater allocations left in the village.

"It has been one of the biggest hurdles for the last 20 years," said Sallie Riggs, the chair of Bourne's wastewater advisory committee and the Main Street Steering Committee.

ourne currently has an agreement with Wareham that allows the town to send 200,000 gallons of wastewater a day from Buzzards Bay to their neighbor's wastewater treatment facility.

The town is now close to that cap and needs to leave a slight cushion until a plan is made to either get a larger allowance from Wareham or get Buzzards Bay its own treatment facility, said Peter Meier, selectman and sewer commissioner.

The dwindling cushion between the claimed allocations and the cap has highlighted the need for a policy on how future allocations are to be handed out, even if it may be a few years before there are any more allocations to give.

Talks of formulating a policy first came about after plans for a hotel at 25 Perry Ave. stalled when one of the six family members who owned the property backed out of a deal with the developer. This left the town sewer commissioners with a 23,000-gallon allocation in the hands of a developer who didn't have the land to build his hotel.

The family member eventually agreed to sell the property and the hotel plans are back underway.

The need for a policy arose again when local developer Vincent Michienzi came before the sewer commission earlier this year and asked for a 13,000-gallon bump in his wastewater allocation for a mixed-use project almost 10 years in the making. The plan for a hotel and retail complex was little changed

from a presentation he made a year before and used a 10-year-old town-commissioned rendering.

Stephen Mealy, a sewer commissioner and selectman, said that it seemed Michienzi was dragging his feet on the project and Michienzi, who currently holds an allocation for 27,000 gallons, told the board that he needed a larger wastewater allocation.

"We are not dragging our feet," Michienzi said at the Jan. 31 meeting. "We need more allocation and we need more land. ... The town doesn't have enough sewer available to build our project, to make it feasible."

The commissioners said that a timeline for the project along with more detailed plans would make them more comfortable in handing over more wastewater allocation.

After the hotel plans sparked the process of an allocation policy a couple years ago, Mealy submitted six policies from other New England towns that Bourne could use to guide their process. Nothing ever came of those findings, Mealy said, but the town's wastewater advisory committee is now also taking up the task.

A policy is tough, Mealy said, because many of the projects need to be taken on a case-by-case basis. Some potential factors in the policy could be whether the developer has financial backing and a timeline, Mealy said, but it can't go too far into nittygritty details. continued on page 43

But a policy is definitely needed, said Selectman Michael Blanton, also a sewer commissioner. "It would bring clarity to the process," he said.

"I think it's probably a good thing to at least define how the process works," said commissioner Donald Pickard.

Blanton suggested a possible "sunset clause" that would give the commission authority to rescind an allocation if it was not used in a certain time period. The allocation could be applied for again, Blanton said, and it wouldn't be a "one bite at the apple" type of situation.

"We are looking for a little bit more of a clear timeline," Blanton said, noting that it isn't fair to other developers who have shovel-ready projects but can not proceed because there are no allocations left.

"We need the economic development so badly."

There are two possibilities on the horizon that could ease the wastewater crunch. The first is a prefabricated treatment plant, called a "packaged" plant, planned for Queen Sewell Park. The plant would give the town an extra 100,000 gallons a day to work with, something that would be needed for residents in Tay-

lor's Point who have been paying betterments in hopes of tying into the town sewer system, Meier said.

But funding for the project needs to pass at town meeting, and an estimated cost of about $3.5 million to the town from July has ballooned to about $5 million. Funding requests for the plant are expected for this spring's town meeting.

While the packaged plant would be the quickest option, it would only be a temporary fix because they are designed to last only 25 years. The larger plan is for Bourne to continue to work with Wareham in expanding their treatment facility and discharge treated effluent into the Cape Cod Canal.

According to a 2015 wastewater plan, because the canal is tidal and fully flushes out, this makes it a prime candidate to receive the wastewater. This could allow Wareham to increase its daily allocations, but that is at least 10 years down the line, and officials have expressed hesitancy about sending sewage into the canal.

Any future development on Main Street remains years away, but town leaders remain hopeful. "Those two are both very viable," Riggs said of the two wastewater options, adding that they could bring "vitalization that has been talked about for the last 40 years."

Any high school student who is the son or daughter of a UCANE member or an employee of a member who will be enrolling full time in an accredited four year academic institution for the year beginning in September 2017.

harlie Tyler, a resident of Sherborn, MA and a retired Engineer of the Massachusetts Water Resource Authority (MWRA), is being honored with a “2016 Regional Lifetime Achievement Award” by EPA. Mr. Tyler has provided training and technical assistance to wastewater professionals in New England throughout his many years of employment with MWRA. Among other things, Mr. Tyler will always be remembered for his enthusiasm while narrating tours of the MWRA Deer Island Wastewater Treatment Facility to the many public, state and federal officials.

Stay the Course

Many investors will prefer to keep their current stock market positions. For nearly a century, every stock market reversal has been followed by a recovery. Even the severe shock of late 2008 through early 2009 has led to new peaks less than a decade later.

What’s more, holding onto stocks and stock funds won’t trigger any tax on capital gains.

Move into Cash Investors who are truly nervous about pricey stocks can sell some or all of those holdings, then put the sales proceeds into vehicles that historically have been safe havens, such as bank accounts and money market funds. This would reduce or eliminate the risk of steep losses from a market crash. In both the 2000–2002 and the 2007–2009 bear markets, the S&P 500 Index of large-company stocks fell about 50%. After a loss of that magnitude, investors need a 100% rebound, just to regain their portfolio value.

However, cash equivalents have negligible yields right now, so investors would essentially be treading water in bank accounts and money funds. Timing the market has proven to be extremely difficult, so investors who go to cash risk missing out on future gains as well as possible losses. In addition, investors who sell appreciated equities held in taxable accounts will owe capital gains tax, which could be substantial.

Treasury Bond Interest Interest income from Treasury bills, notes, and bonds is subject to federal income tax.

That interest is exempt from state and local income taxes.

If you invest in a bond fund that holds only U.S. Treasuries, you will owe federal income tax on the interest income but no state or local income tax on that interest.

aul is Vice President of Albanese D&S, Inc., Dracut, MA. The company has been a UCANE member since 1992. Paul earned his degree in Civil Engineering at Merrimack College and pursued his MBA at Suffolk University while working full-time.

He has been a UCANE Board Member since 2008, and during that time he moved up the ladder to serve as UCANE Secretary, Treasurer, and President Elect. Paul currently serves on our Budget, Executive, Government Relations, and Nominating Committees. On several occasions he was called upon to provide testimony before State Legislative Committees on behalf of UCANE. Paul has earned the respect and admiration of his co-workers and peers within the utility construction industry. His ongoing commitment to UCANE is evident through his hard work in effectively communicating the issues of vital importance to our industry.

Some of Pauls’s goals for the coming year include, securing increased state funding for the SRF Program to assure that the maximum number of projects are put out to bid; assisting the MassDEP and other state agencies whenever possible to help cities and towns fund needed underground infrastructure projects; and promoting UCANE’s in-house safety programs while advocating for employee safety on the jobsite. Together with our Board, he will continue our legislative agenda by pressing for the passage of our Interest on Retainage and Dig Safe bills.

Paul is committed to strengthening our Association in the coming year by increasing membership. His goal is to enlist 25 new members and has requested our member’s support to help him achieve his goal.

Paul is highly respected in our industry, and is viewed as someone who is hard working and dedicated. He believes strongly in UCANE and its goals and future, and has committed to continue the work of those who served before him who have strived to make Massachusetts’ clean water and drinking water infrastructure a model for the entire country.

Rich graduated from Wentworth Institute of Technology with a degree in Construction Management. He currently serves as Foxborough, MA Water and Sewer Commissioner and Mansfield-Foxborough-Norton Regional Wastewater District Commissioner. In addition, he served on UCANE’s Board of Directors and has now ascended to President Elect. He is also a member of our Budget, Executive, and Government Relations Committees.

Like so many other UCANE members before him, Rich intends to carry on the family tradition of involvement and support of our Association. He is a dedicated member who brings commitment, enthusiasm, and new ideas to our industry…ingredients that are vital to every organization!

Marcella Albanese - Albanese Brothers, Inc.

M

arcella is President of Albanese Brothers, Inc., Dracut, MA. Her father Marco and his brother John founded the company in 1978. Marcella, along with her siblings Maria and Dino, represent the second generation of Albanese contractors who are highly respected for their ability to take on difficult projects.

Since Marco retired in 2010, Marcella, Maria, and Dino have continued to grow the family business, working on projects throughout Massachusetts and New Hampshire. Albanese Brothers, Inc. is also WBE/DBE accredited.

Marcella has been involved in UCANE since she began working at Albanese Brothers. She has served two terms on our Board of Directors, and now has taken on the additional responsibilities as Treasurer. Her knowledge of issues facing the construction industry is invaluable, and for that reason her peers voted Marcella UCANE’s 2015 Contractor Member of the Year. She and her family continue their strong support of UCANE and our industry.

Ryan McCourt - McCourt Construction Company

R

yan is the fifth generation President of McCourt Construction Company, South Boston, MA. Since 1893 McCourt has been building the infrastructure of Massachusetts. Today with his brothers, Matthew and Trevor, McCourt Construction is tackling some of the largest and most complex construction projects in New England.

Ryan attended Boston College where he graduated with a Bachelors of Science degree in Finance. Soon after receiving his degree he joined McCourt Construction.

Ryan realizes the importance of industry organizations in ensuring that the infrastructure of the Commonwealth gets the attention it so desperately needs, and he knows that UCANE is the most effective organization in getting attention for the drinking water and wastewater industry. With this in mind, he previously served from 20122013 on the UCANE Board of Directors, following in his father Richard’s footsteps. As UCANE Secretary, he looks forward to working with our elected officials to improve clean water and drinking water systems, which will positively impact our citizens and the environment.
