UCANE Announces Chris Valenti as Board President Dear UCANE Members, It is an honor to step into the role of President of Utility Contractors’ Association of New England, Inc. UCANE has been part of my life, my family, and my professional journey for as long as I can remember, and I am grateful for the trust you have placed in me to help lead our association forward.

GVC Construction is proud to be a first‑generation UCANE member, and like many families in this association, our roots run deep. UCANE has shaped who we are as contractors and business owners, and it has fostered lifelong relationships built on trust, shared experience, and mutual respect. That sense of community remains one of UCANE’s greatest strengths.

I am fortunate to share this journey with my wife, Geselle, and my brother, Mike, who together form the senior management team at GVC Construction. Our partnership reflects the many family‑owned businesses that make UCANE unique. Just as importantly, the next generation at GVC is already stepping into the industry— learning firsthand the importance of hard work, safety, quality, integrity, and teamwork. These values are the foundation of our profession and the legacy we pass on. That generational connection keeps UCANE strong and ensures our industry will thrive for decades to come.

The last several years have underscored that UCANE is a familial and generational institution. At the same time, tradition alone is not enough. As stewards of this industry, we must keep improving how we serve members and how we carry our message across the Commonwealth.

My focus is to build on UCANE’s progress while reinvesting directly into our membership. We are modernizing technology to make UCANE more accessible and user‑friendly, including streamlined online registration and payment systems. We will expand training opportunities, strengthen safety programs, and host high‑quality events that provide real value to member companies and their workforce.

We will kick off the year at the UCANE Board of Directors’ Inaugural Meeting on January 28 at Venezia. It is the perfect opportunity to reconnect in person and set the tone for the year ahead. We are honored to welcome keynote speaker Marty Walsh, whose lifelong connection to the trades and deep understanding of workforce and infrastructure issues make him a fitting voice to launch the year.

UCANE will continue to strengthen its brand and expand its influence in support of sustained investment in water, wastewater, and utility infrastructure. We will advocate on Beacon Hill and Capitol Hill for policies and funding that protect public health, drive economic growth, and ensure the long‑term resilience of our communities.

EEA Releases Yearly Report; State Looks to Make Progress on Series of New Programs

T

he final month of 2025 saw the Massachusetts Executive Office of Energy and Environmental Affairs (EEA) release its 2025 Annual Report, highlighting key milestones and accomplishments from its agencies. According to a release from the agency, over the past year, EEA’s organizations have engaged residents and partners across the state through intentional environmental initiatives. These efforts include legislation to lower energy costs for families, investments in extreme weather preparation, and strategies to protect nature.

The EEA report closely aligns to reporting on the Healey-Driscoll Administration’s progress for meeting the Administration’s Energy Affordability Agenda. The plan, which was codified in proposed legislation that includes key reforms including eliminating and reducing certain charges on electric bills and reducing barriers to new nuclear technologies remains under consideration by the Massachusetts legislature. In addition to increasing energy affordability for residents, the Healey-Driscoll Administration touted the Mass Ready Act, an environmental bond bill proposing $3 billion to strengthen infrastructure and protect communities from extreme weather events. This legislation aims to upgrade roads, dams, and bridges, and establishes a Resilience Revolving Fund for similar projects. It also streamlines permitting for priority housing, culvert replacements, and restoration projects that protect communities from flooding. Additionally, the bill invests in farming and coastal economies and provides JANUARY, 2026

communities with resources to reduce flood and heat risk.

With respect to resiliency, the EEA’s report further highlights Massachusetts initiatives to restore ecosystems and strengthen coastal resilience by rebuilding wetlands, upgrading culverts, removing outdated dams, and improving habitats. As reported, the Massachusetts Department of Fish & Game, alongside many partners, developed a 25-year plan to protect and restore nature, sustain farms and fisheries, boost local economies, and connect people with nature.

Likewise, the Massachusetts Office of Coastal Zone Management (CZM) released the ResilientCoasts Plan, a statewide strategy to support coastal communities in preparing for storms, flooding, sea level rise, and erosion. The plan aims to save taxpayers billions by guiding smart coastal management decisions and preserving natural buffers to reduce flood risks.

Finally, in terms of financial support for municipal and private stakeholder, the EEA and its agencies distributed more than $237.9 million in grants across 70+ programs, supporting over 1,600 individual awards statewide in 2025.

The grant funding supported initiatives for environmental justice, recycling, outdoor recreation, farmland preservation, drought management and much more.

Massachusetts AG Joins States Suing Trump Administration over Electric Vehicle Charging Funds

M

id-December saw Massachusetts Attorney General Andrea Campbell join a coalition of 17 states who filed a lawsuit against the Trump Administration for suspending two bipartisan grant programs totaling nearly $2 billion dollars for electric vehicle charging infrastructure aimed at reducing pollution, expanding access to clean vehicles, and, potentially, creating new green jobs.

According to a press release from the Massachusetts Attorney General’s Office, the United States Department of Transportation (USDOT) has refused to approve any new funding under two electric vehicle charging infrastructure programs created in the Infrastructure Investment & Jobs Act (IIJA): the Charging and Fueling Infrastructure Program (CFI) and the Electric Vehicle Charger Reliability and Accessibility Accelerator (Accelerator) Program (together, the EV Charging Infrastructure Programs). In filing their lawsuit, the

17 state Attorneys General alleged that US DOT’s actions violate constitutional requirements and statutory mandates to carry out these programs.

In 2022, Congress passed the IIJA, also known as the Bipartisan Infrastructure Law. The CFI and Accelerator programs are five-year programs created by IIJA for building or repairing electric vehicle (EV) chargers. USDOT and the Federal Highway Administration have refused all new obligations of funds under both programs since the spring of 2025. In mid-January 2025, the Massachusetts Department of Transportation (MassDOT) was awarded $14.4 million in CFI grants for building new EV charging infrastructure across Massachusetts, enabling the implementation of approximately 458 Level 2 charging ports (for fast electric charging) and 14 Level 3 charging points (for faster, high capacity charging, including for heavycontinued on page 9

Healey-Driscoll Administration Launches Business Builds Program to Support Business Expansion Across Massachusetts

T

he Massachusetts Executive Office of Economic Development (EOED) announced the launch of Business Builds, a new competitive capital grant program designed to support business expansion, job creation, and climate-friendly investment across Massachusetts at the end of the year.

Created through the Mass Leads Act and administered by the Massachusetts Office of Business Development (MOBD), Business Builds provides strategic grants to businesses relocating to, expanding in, or creating new jobs in Massachusetts. The MOBD, located within the executive agency, assists businesses expanding in and relocating to Massachusetts, with specific attention paid to projects that create and retain jobs and invest capital. The program is aimed at strengthening Massachusetts’ competitiveness, accelerating private investment, and advancing projects that provide a clear public benefit, including job growth, revitalization of underutilized properties

and economic growth in rural areas.

According to information provided by EOED, Business Builds advances the Healey-Driscoll Administration’s commitment to increasing Massachusetts’ economic competitiveness while ensuring that public investments deliver meaningful public value.

The program will complement existing tools such as the Economic Development Incentive Program to spur job creation, strengthen regional economies, and support capital investments in facilities and equipment. Through Business Builds, EOED aims to attract and retain businesses across Massachusetts, including in gateway cities, rural towns, and underutilized or redevelopment areas.

Healey-Driscoll Administration Awards Funding to 160 Organizations to Improve Workplace Safety; Launches SafetyWorks Initiative

L

ate in 2025, the Healey–Driscoll Administration launched the newly repackaged SafetyWorks Initiative, a comprehensive program designed to help employers strengthen workplace safety through grant funding and free technical assistance. SafetyWorks serves as a one-stop resource, bringing together state occupational and industrial safety tools, guidance, and consultation to make it easier for businesses to access training and support.

A key component of the initiative is the SafetyWorks Training Grant, administered by the Department of Industrial Accidents (DIA). Formerly known as the Workplace Safety Grant Program, this funding provides eligible Massachusetts-based employers with grants of up to $25,000 to offset the cost of safety training. Supported training includes compli-

ance programs such as OSHA 10-hour and 30-hour courses, as well as prevention-focused instruction in areas like defensive driving, hoisting, and First Aid/ CPR. Employers may also propose customized training topics and curricula in partnership with approved training providers.

To the aforementioned point, the Executive Office of Labor and Workforce Development also announced $800,000 in SafetyWorks grants to support training for an estimated 13,832 workers at 160 organizations across the Commonwealth. Administered by the DIA, these grants are intended to enhance workplace safety through education, training, and other preventative measures. And the Ballot Questions Keep Coming; Potential Record Number of Ballot Measures Headed for Vote?

A

s noted by the State House News Service in its ongoing coverage of the same, Massachusetts is on track for what could be a historic number of statewide ballot questions in the November 2026 general election, as the Secretary of the Commonwealth’s office continues certifying initiative petitions that have met the required thresholds to advance in the process. With a January 7, 2026 deadline to complete certifications and transmit measures to the Legislature, a growing number of citizen-led proposals are moving steadily forward.

In the most recent announcement from the Elections Division, six additional proposed ballot questions were certified as having met the required minimum of 74,574 valid signatures, bringing the total number of initiative petitions cleared to date to 11.

These proposals span a wide range of policy areas, underscoring the breadth of issues being pursued through the ballot initiative process.

Among the newly certified measures is a proposal backed by State Auditor Diana DiZoglio that would expand the Massachusetts public records law to cover most records held by the Legislature and the governor’s office. The petition cleared certification with 89,013 signatures, reflecting sustained public interest in government transparency and accountability. Another certified initiative seeks to overhaul the Legislature’s stipend system. That petition received 96,797 certified signatures. Labor policy is also featured among the advancing initiatives. A ballot measure that would allow employees of the Committee for Public Counsel Services to collectively bargain received

86,153 certified signatures. The campaign backing the proposal is led by a partnership between the Service Employees International Union and the National Association of Government Employees. Finally, the Secretary of State’s Elections Division also certified 85,588 signatures for a proposal that would impose a new cap on annual state revenue growth. Under the measure, yearly state revenue would be limited to the prior year’s net revenue adjusted by the average growth in wages and salaries in Massachusetts over the preceding three years. Any revenue collected above that limit would be refunded to taxpayers the following year.

Right before the January 7 deadline, the Secretary of State announced certification for the last two proposed ballot measures remain under review. One would redirect sales tax revenue from sporting goods such as golf clubs, recreational vehicles, and camping equipment into a new “Nature for All Fund,” potentially generating approximately $100 million annually for water and land conservation and restoration. The other proposal seeks to make it easier for residents to purchase a home by updating local zoning rules.

Lawmakers now have until May 5, 2026 to act on the initiatives. If the Legislature does not enact a proposal as filed, petitioners must collect an additional 12,429 certified signatures by June 17 to secure placement on the November 2026 statewide ballot.

With all constitutional state officers and members of the Legislature up for election this year, the campaign season was already expected to be one of the busiest in recent memory – something 11 potential ballot continued on page 19 questions will only add to.

Revenue Continues to Meet Benchmark. In the last complete accounting (i.e. full month’s figures) before the end of the year, the Massachusetts Department of Revenue (DOR) announced that preliminary revenue collections for November totaled $2.562 billion, $107 million or 4.4% more than actual collections in November 2024, and $89 million or 3.6% above benchmark. FY26 year-to-date collections totaled approximately $15.572 billion, which is $657 million or 4.4% more than actual collections in the same period of FY25, and $188 million or 1.2% above the year-to-date benchmark. In general, November is among the smaller months for revenue collection because neither individual nor business taxpayers make significant estimated payments during the month. Historically, according to the DOR, roughly 6.5% of annual revenue, on average, has been received during November.

MassDOT SnowPlow Contest Winners.

MassDOT has announced the winners of its fourth annual “Name a Snowplow” contest, celebrating the creativity of elementary and middle school students across the Commonwealth while highlighting the essential work of public works crews during winter weather. Classrooms from public and private schools submitted entries to name 12 MassDOT snowplows that will be in service during the 2025–2026 winter season, with winning names ranging from playful to clever, including “Master Snowda,” “Flake Maye,” “Darth Blader,” “Clearopathra,” “Sleet Caroline,” and “Scrape Codder.” Selected by a panel of MassDOT employees, two winning classrooms were chosen in each of the state’s six Highway Division districts across two grade categories. safety requirements – for state contract holders, which primarily utilize Class 3 trucks that are greater than 10,001 lbs gvw - are now being enforced. Accordingly, contractors and fleet operators should ensure their vehicles are fully compliant and registered through the Massachusetts Registry of Motor Vehicles’ website.

The law requires the aforementioned classes of trucks operating in the Commonwealth to be equipped with additional safety devices designed to reduce blind spots and improve visibility, particularly to protect vulnerable road users such as pedestrians and cyclists. The additional equipment required includes lateral protective devices (i.e. sideguards), rear facing cameras and convex/concave mirrors. The Bid Unit of the Massachusetts Office of the Attorney General Addresses Allegedly “Obscure” and “Conditional” Bids In December of 2025, the Bid Unit of the Massachusetts Office of the Attorney General (the “Bid Unit”) issued a bid protest decision in a case involving questions concerning allegedly “obscure” and “conditional” bids. Although the decision dealt with a public building project and general bidder pricing in connection with a filed sub-bid scope of work, the decision is nevertheless informative for UCANE members. That is, the decision underscores the importance of the following principles that apply to public works projects: (1) the option of submitting pre-bid questions in the event of questions concerning the interpretation of the bid documents; and (2) the prohibition against submitting “conditional” bids.

Two Issues The case arose out of a municipal office renovation project and involved two issues: (1) the interpretation of provisions of the project specifications relating to the general bidders’ unit pricing and allowances; and (2) additional language that one general bidder inserted on the general bid form concerning substantial completion.

Issue No. 1: Apparent Low General Bidder The project specifications set forth detailed requirements concerning general bidder unit pricing and allowances. These details are beyond the scope of this article. That said, the apparent low general bidder had carried a filed sub-bidder for plastering work but “provided slightly higher unit price items” on its general bid form than the unit price items identified

in the filed sub-bid. As a result, the extended unit prices on the general bid form did not equate to the allowance figure set forth in the filed sub-bid.

The Third Low General Bidder Files a Protest Challenging the Apparent Low and the Second Low General Bidders In these circumstances, the third-lowest general bidder filed a protest challenging both the apparent low general bid and the second low general bid. The protestor argued that: (1) the apparent low general bid was “obscure” “because the unit prices multiplied by the estimated quantities did not match the listed allowance values”; and (2) the second-low bid “contained an impermissible condition on the completion date.” The Bid Unit rejected the protest with respect to Issue No. 1, but allowed the protest with respect to Issue No. 2.

Resolution of Issue No. 1. This issue came down to the interpretation and meaning of the specifications. The apparent low general bidder argued that the unit pricing on its general bid form was consistent with the requirements of the specifications

and had been “adjusted accordingly” to include all costs for the work. The Bid Unit agreed with the apparent low general bidder’s interpretation and denied the protest with respect to the apparent low general bid.

Resolution of Issue No. 2. With respect to the second-low bid, the Bid Unit concluded that “there is no question” that the second-low bid “must be rejected as conditional.” By stating that the substantial completion date was predicated on a December 1, 2025 award, the second-low bidder “impermissibly placed a condition on its agreement to the required substantial completion date” and therefore was “not on equal footing with all other bids and must be rejected . . . .” Therefore, the Bid Unit allowed the protest with respect to the second low general bid.

Takeaways Issue No. 1. When it comes to questions regarding the interpretation and meaning of bid documents, the decision illustrates the importance of the pre-bid question and answer process. Whether a bid is impermissibly “obscure” can often depend on the facts of a given case, including requirements of the bid documents. Although the bidders in this continued on page 25

When faced with questions concerning interpretation of the bid documents, prospective bidders should consider whether to submit a pre-bid question to the awarding authority for clarification. This process can sometimes cut potential bid protests off at the pass. Without pre-bid clarification of applicable requirements, bid protest challenges – like this one – can arise in circumstances involving competing interpretations of the bid documents.

Issue No. 2.

As illustrated by the second low general bid in this case, conditional bids are not permissible. This issue often arises when bidders manipulate or alter bid forms supplied by the awarding authority. By adding notations to a bid form supplied by the awarding authority, a bidder runs the risk that its bid will be rejected as impermissibly conditional. In this case, there was “no question” that the second low general bid was conditional because of the added notation that substantial completion would depend on the date of the award of the contract. n

t is with deep sadness we announce the passing of longtime member and friend, Cesidio Joseph “Joe Pinch” Pinciaro Sr., on December 11, 2025 at the age of 90 surrounded by his loving family members.

He was the beloved husband of the late Julia E. (Irwin) and the devoted father of Christina “Tina” DiBartolomeo and her late husband Anthony, Cesidio “Joe” J. Jr. and his late wife Patricia M., Lisa J. Morteo and her late husband Albert D. Sr., John W. and his wife Patricia, and James A. and his wife Donna. Son of the late Giuseppe and Crocifissa (Franciosa) Pinciaro.

Cherished grandfather of 14 grandchildren and 13 great grandchildren.

“Joe Pinch” started his construction career in 1954. Together with his brother-in-law Frank Federico and Frank’s brother Joe Federico. The three partners

were immediately active in the Boston area public works marker. By the end of 1954 their business along with a small group of like-minded contractors organized the first meeting of the Utility Contractor’s Association (UCA) later to become Utility Contractors’ Association of New England, Inc. In 1984 the three partners decided to turn the large construction company into three small companies, here C. J. P. & Sons was born with Joe Pinch and his sons Joe, Jr., John, and James. C. J. P. & Sons has remained an active and respected member of UCANE ever since.

The Officers, Board of Directors, Members, and Staff of UCANE extend their deepest sympathies and condolences to the entire Pinciaro family. Joe’s years of experience and knowledge of our industry brought him the unequaled respect of his peers who feel a deep and personal sadness at his passing. n

Any child or grandchild of a UCANE member OR an employee of a member in good standing.

The applicant should be a high school senior who will be enrolling full time in an accredited two- or four-year academic institution for the year beginning in September 2026 OR a current full-time college student who has not previously received a UCANE scholarship.

Releases FY25 Top 10 Violations List

O

SHA has released its FY2025 Top 10 Most Cited Violations, and the results deliver a clear and familiar message for the construction industry: long-standing jobsite hazards continue to drive enforcement, and repeat violations remain costly for contractors.

For the 15th consecutive year, Fall Protection ranked as OSHA’s most frequently cited violation.

Despite decades of awareness and training, falls continue to be the leading cause of serious injuries and fatalities in construction, making fall protection a top priority for both regulators and employers. Nearly 6,000 fall protection citations were issued in FY2025, reflecting OSHA’s continued focus on unprotected edges, missing or improper guardrails, unsafe scaffolding practices, and failures to properly plan and enforce fall protection measures. For contractors, this reinforces that even routine tasks at elevation remain a primary enforcement trigger.

Beyond fall protection, the Top 10 list shows little change from prior years. Hazard Communication, Ladders, Lockout/Tagout, Respiratory Protection, Fall Protection Training, Scaffolding, Powered Industrial Trucks, Personal Protective Equipment, and Machine Guarding all remain common citation areas, though there was a notable decline in Powered Industrial Truck citations. Many of these violations stem not from complex hazards, but from training gaps, incomplete safety procedures, or failure to follow established company policies in the field.

Another important trend for contractors is the continued rise in OSHA penalties. These increases, mandated by Congress to keep pace with cost-of-living adjustments, raised penalties in 2025 by approximately 2.6%. As of January 15, 2025, the maximum OSHA penalties for serious and other-than-serious violations increased from $16,131 to $16,550 per violation. The maximum penalty for willful or repeated violations increased from $161,323 to $165,514 per violation.

Large OSHA fines in recent years have frequently involved fall-related incidents, trenching and excavation failures, and fatality cases. In many of these situations, OSHA cited multiple repeat or willful violations, significantly increasing penalties beyond base levels. Inspection histories play a major role in these outcomes, as prior citations are closely reviewed and can quickly escalate enforcement actions.

OSHA’s enforcement capacity remains strong, though at times has been hindered by the government shutdown and Congress’ use of continuing budget resolutions (as opposed to passing a complete FY26 budget). The agency’s budget remained stalled at $632 million in 2025, supporting a workforce of over 1,800 federal employees. The FY2026 budget proposed by the Trump administration proposes an 8% cut to $582.4 million.

Since OSHA’s creation in 1970, workplace safety has improved significantly across all industries. Injury and illness rates have dropped from 10.9 incidents per 100 workers in 1972 to 2.4 per 100 in the most recent survey, while daily worker fatalities have declined from roughly 38 per day to under 15 per day, even as the U.S. workforce has continued to grow.

Despite this progress, construction remains disproportionately represented in fatality statistics. The industry accounts for approximately 9% of the workforce but roughly 20% of all worker fatalities. Across all sectors, motor vehicle incidents remain the leading cause of workplace deaths, particularly in transportation-related operations.

For contractors, OSHA’s FY2025 Top 10 list serves as a reminder that fundamentals matter. Reviewing fall protection procedures, reinforcing ladder, scaffolding, and trench safety, ensuring employees receive proper training, and addressing repeat hazards before OSHA does can significantly reduce risk.

Springfield Takes Action to Reduce the Risk of Water Main Breaks SPRINGFIELD, Mass. (WWLP) – Springfield is undertaking significant sewer upgrades to enhance the drinking water, aimed at preventing failures similar to recent water-main breaks in Waterbury, Conn.

O

n December 13, crews focused on realigning pipes and installing new valves along Birnie Avenue, as part of a larger project that began in the fall.

“This is a very important project for the commission,” said Jaimye Bartak, Communications Manager for the Springfield Water and Sewer Commission. “This is where most of the water for Springfield enters the city and then diverts into two main transmission mains.”

The urgency of these upgrades comes in light of recent incidents, particularly the severe water-main break that left many residents in Waterbury without water. Bartak emphasized, “These types of projects are really important because we’re trying to reduce the risk of those types of things happening. We have a lot of old infrastructure in Springfield.”

The commission has also partnered with the Massachusetts Department of Transportation for a project at the X. This project is part of Springfield’s water and wastewater infrastructure renewal program to replace pipes dating back to the 1800s.

“We’re doing tons of projects on water treatment plants and also around the city,” Bartak said. “We’re actually a year ahead of schedule for our work on that project.”

Bartak noted the importance of federal and state low-interest loan programs such as the Water Infrastructure Financing and Innovation Act and the Clean

Water State Revolving Fund, stating, “Right now, the clean water trust funding is up for reauthorization next year in Congress and so we just want people to be aware of how important these federal funds are for us to do this type of work.”

Springfield’s old water infrastructure increases the risk of failures. Therefore, the commission needs these loan programs to continue replacing old pipes in a more expedited manner, as they cannot necessarily count on the same pipes for yet another century.

While the Birnie Ave project itself is not contingent on the federal funding programs, other projects like needed transmission main upgrades and water main replacements need such federal and state loan funding to be feasible.

The age of Springfield’s water infrastructure puts it at increasing risk of failure, just like Waterbury’s – we need these loan programs to continue in order to replace old pipes in a more expedited manner, as we cannot necessarily count on the same pipes for yet another century.

The sewer project on Birnie Avenue is anticipated to be completed by the middle of 2026, contingent on federal funding and continued infrastructure renovations.

Building Careers Through Internships Preparing the Next Generation of Construction Leaders

Every year, the construction industry is growing with new talent — many of whom begin their career as interns. Thus, internships play a crucial role when it comes to building industries. Not only do they benefit the students that participate, but they also benefit the companies that host them.

F

or participants, internships introduce them to possible career paths, provide them with realworld experience and create a pipeline of future leaders.

For employers, internships are more than just a recruiting tool. They are an investment in the future of their workforce and the long-term success of their industry.

Creating a Strong Program A strong internship program should be more than just a “summer job.” It must be structured, intentional and supported at every level of an organization. The most successful programs center the following: Meaningful work — Busywork does not make an internship program. Programs should give interns the chance to apply classroom knowledge in real-life situations and contribute to projects that matter. In doing so, interns will feel like the work they have done will make a difference in the company and was worth doing.

In the construction industry, there are jobs on-site working as project engineers or safety interns supporting field operations, in the office supporting estimating and preconstruction, supporting our virtual design and construction teams through 2D and 3D models, and more. My company provides career pathway seminars that dive into the different roles in construction such as project engineers, estimators, virtual design and construction mechanical electrical plumbing scopes and superintendents.

EPA Announces $3 Billion in New Funding for States to Reduce Lead in Drinking Water Additionally, $1.1 Billion of Unused Funding Redistributed for States WASHINGTON – Today, U.S. Environmental Protection Agency (EPA) announced $3 billion in new funding for states through the State Revolving Fund (SRF) programs to reduce exposure to lead in drinking water. EPA conducted a thorough review of previously awarded funding and assessed updated lead service line data to increase accountability and ensure funds are properly distributed to achieve maximum impact in removing lead pipes and reducing lead contamination in drinking water systems. This funding will accelerate progress in finding and removing lead pipes (also known as lead service lines that deliver water to homes, schools, and businesses) as the agency also announces a new lead service line inventories dashboard with the latest information provided by states. Lead pipes are the key source of lead—a potent neurotoxin particularly harmful to children—in drinking water.

Reducing drinking water exposure to lead is a priority under EPA’s Powering the Great American Comeback Initiative. The Trump Administration’s commitment to tackling lead in drinking water is a throughline from the first term, when EPA issued the first regulation in 30 years to strengthen protections.

The agency is also releasing new information indicating that there are fewer lead service lines nationwide than previously estimated. EPA’s updated estimate is four million lead service lines, down from nine million previously estimated. This significant reduction is driven by improved data provided by service line inventories required by the first Trump Administration’s Lead and Copper Rule Revisions. The agency is releasing a new dashboard highlighting information from lead service line inventories provided by states.

EPA’s goal is to ensure these funds are deployed where they are needed most. Therefore, funding allotments will be distributed based on the best available information locating the approximately 4 million active lead service lines. EPA gathered this information from states in a lead service line inventory.

EPA is also announcing the redistribution of an ad-

ditional $1.1 billion in previously announced DWSRF funding to address lead. These funds were made available to states but have not been used. Consistent with the Safe Drinking Water Act’s directive to reallocate unused funds, these investments are now available to different eligible states with lead service line replacement needs.

States that have neither obligated or spent any awarded funds since at least fiscal year 2023 will be required to submit a plan to EPA detailing their strategy for expeditiously using funds to address lead before being eligible for new funding. EPA is committed to ensuring that the federal funding is used effectively and efficiently to address lead challenges facing local communities.

The agency will proactively work with states to ensure they are expeditiously spending this funding by making awards to water systems for lead service line replacement projects.

These funds can be used for lead service line replacement (LSLR) and associated activities like identification, planning, design, and replacement. With this funding, EPA is issuing an Additional Eligibilities for State Implementation of the IIJA DWSRF LSLR Appropriation memorandum underscoring important flexibilities under this appropriation to ensure states can use the funding more efficiently and effectively.

Algonquin Plans Twin HDD Crossings Under Cape Cod Canal in Mass.

(UI) — Enbridge’s Algonquin Gas Transmission is preparing for one of Massachusetts’ most technically demanding trenchless installations— twin horizontal directional drills (HDDs) under the Cape Cod Canal—as part of a 5.2-mile natural gas pipeline relocation tied to the replacement of the Bourne and Sagamore bridges.

A

ccording to FERC filings dated December 8 and December 11, the Cape Cod Canal Pipeline Relocation Project involves replacing and rerouting existing 16-inch and 18-inch lines, removing older segments, and constructing new meter and regulating stations to maintain gas supply to National Grid’s Cape Cod customers during bridge reconstruction.

The HDD crossings, which will accommodate twin pipeline sections, represent a key engineering feature of the project. FERC has requested detailed drilling profiles, geotechnical data, bore-path stability analysis, and risk-management plans to assess the design’s feasibility. Algonquin also was asked to provide information on right-of-way configuration, access roads, and noise mitigation measures associated with the drills and ancillary construction.

FERC’s environmental review schedule projects completion of the Environmental Assessment by April 17, 2026, with final federal

authorization expected by July 16, 2026. If approved, construction could begin in late 2026, coordinating with the Army Corps’ bridge replacement timeline.

$36 million, 8 Clean Water Projects, 6 Cape Cod Towns: What We Know So Far The Cape Cod and Islands Water Protection Fund Management Board in December advanced eight clean water infrastructure projects across six Cape Cod towns, according to a press release.

T

he projects are located in Barnstable, Chatham, Dennis, Harwich, Mashpee and Yarmouth. The board previously granted conditional subsidies for eligible projects included on the Massachusetts Department of Environmental Protection’s Clean Water Intended Use Plans for 2023 and 2024.

Dennis is among the latest Cape Cod towns to break ground on a wastewater treatment plant, on October 3, at 120 Theophilus F. Smith Road. The $83 million plant is part of the first of eight phases to provide sewer service throughout the town and nitrogen remediation for the town’s watersheds. The town received a subsidy from the Cape and Islands Water Protection Fund for the project, Dennis Public Works

Director Michael Lavin said.

The projects can move forward with financing through the Massachusetts Clean Water Trust.

Funded work will include sewer system expansions, sludge processing upgrades, pump station improvements, and the construction of wastewater treatment facilities and collection systems. Altogether, the awards represent more than $36 million in subsidies and support over $145 million in wastewater infrastructure investment across Cape Cod.
