TWUA PRESIDENT: Norma Clark, Permian Basin Regional Officer
It is hard for me to believe that this is my last President’s article. The year has gone by so quickly. I want to thank Russell, David, Angela, Henrietta and Donna for all of the help they have given me during my term as President.
6. To endeavor by kindness, honesty and courtesy to win and merit true and lasting friendship, remembering that friends are a great asset.
As I mentioned in my first article, I have been reading "A History of the Texas Water Utilities Association". I think in order to plan the future goals of the Association, it is important to look at where we have been. TWUA has grown and evolved immensely during the past 95 years. Changes have been made to meet the requirements of changing rules and regulations and changes in technology. Not all of the changes have been popular, but they have been necessary to ensure that TWUA continues to as our motto states, “protect the public health and our environment through educational excellence”.
7. To refrain from criticism or harsh and unjust judgment of friends or fellow members, zealously guarding a brother’s reputation, forgetting his faults and striving to emulate his virtues; declining to profit by unfair advantage that would result in loss of another.
One thing that has not and will not change, is the obligation of those involved in the water utilities industry. The individuals that were instrumental in forming TWUA developed a Code of Ethics for Water Works Operators, which was adopted by the Association on January 28, 1927. Although the language might be dated, I think the principles set out are still relevant. The Code of Conduct reads as follows:
8. To meet all the obligations in connection with my vocation, not grudgingly but with joy in service, confident that I am doing a great work. Thank you again for the honor of serving as TWUA President. It has been a truly rewarding experience.
The business in which I am engaged in freighted with large responsibility, namely: that of bringing health, comfort, and prosperity to the community I serve. My thought, purpose and best endeavor, shall be to discharge my duty so that, although all I had striven for may not have been accomplished, I may lay down the task in better form and on a higher level than when accepted. With this in mind, it is my duty as a member of this Association, 1. To accept my responsibility with a sincere desire to be of real benefit to those whom I serve. 2. To take advantage of every opportunity to gain knowledge that will add efficiency in service. 3. To remember that honesty, faithfulness and morality are principles that make for strong character fitting men for leadership. 4. To guard my words and actions at all times as to bring honor to the community I represent, believing that a state or city is judged by its representatives. 5. To give my best efforts to add to the standards of the business in which I am engaged, encouraging the passage of laws, and securing by an educational campaign the help of the public in the enforcement of all sanitary regulations. 6 TEXAS WATER UTILITIES JOURNAL www.twua.org

EXECUTIVE DIRECTOR NEWS: Russell Hamilton, TWUA ED
I hope 2013 is going well for you. I personally wanted to thank you for your support of TWUA and say, we realize you have options when it comes to operator training and we thank you for choosing TWUA. It’s not too late to register for Annual School. If you missed the pre-registration you may still register using the website or by contacting Central Office. We hope many of you can be a part of this great experience. ANNUAL SCHOOL REGISTRATION AND TCEQ TESTING: We are still continuing to modify and fine tune our school process, this year all attendee registration packets will need to be pickup at the Convention Center, with early registration opening on Sunday, February 24th at 12:00 p.m. All association meetings and events will take place at the Omni Bayfront Hotel. TCEQ Testing will take place at the Omni Hotel on Wednesday, February 27th beginning at 1:30 p.m. The event schedule for the complete school is on (page 9), signage will be in the lobby of the Omni Hotel as a reference. I encourage everyone to arrive on Sunday, to attend the Final Board Meeting for the year 2012 and the Opening Session. Following these two events there will be a reception in honor of the Award Recipients. MEMBERSHIP RENEWALS: We have all heard the message, and by popular demand we are returning to paper renewal invoices for the entire membership. Like the majority of our members, we at Central Office are less than satisfied with the postcard process. Many of you have utilized the electronic renewal process and seem to have been happy with the system. Surprisingly Central Office has received numerous calls and requests indicating that before an entity will process a membership renewal of any kind, they would need some form of documentation (like an invoice). Therefore, TWUA has decided to revert to the original process as requested. For those of you who wish to continue with the electronic renewal process, we will still have that as an option available for your use. This change will be effective as quickly as possible. Our Membership Coordinator Henrietta Adee is working on finalizing the final steps to make this a smooth transition for everyone. We hope to have everything in place by the 1st of March. We sincerely thank you for your support with this change. I apologize for any confusion or extra work the postcards and electronic renewals may have caused. Story goes like this – A reporter for the Washington Post came up with the idea to take a world class concert violinist and dress him in old clothes and a baseball cap then place him in the Washington D.C. subway platform to see if people would stop, listen or recognize the musician or his talent. On a cold January morning in 2007, concert violinist Joshua Bell stood incognito in the metro station in, Washington D.C. He played six Bach pieces for about 45 minutes. During this time, since it was rush hour, it was calculated that literally thousands of people went through the station, most on their way to work. Three minutes went by, and a middle aged man noticed there was musician playing. He slowed his pace and stopped for a few 8 TEXAS WATER UTILITIES JOURNAL www.twua.org
seconds and then hurried up to meet his schedule. A minute later, the violinist received his first dollar tip: a woman threw the money in the till and without stopping continued to walk. A few minutes later, someone leaned against the wall to listen to him, but the man looked at his watch and started to walk again. Clearly he was late for work. The one who paid the most attention was a 3 year old boy. His mother dragged him along, hurriedly, but the kid stopped to look at the violinist. Finally the mother pushed hard, and the child continued to walk turning his head all the time. This action was repeated by several other children. All the parents, without exception, forced them to keep moving. In the 45 minutes, the musician played, only 7 people stopped and stayed for a while and only one recognized him. About 20 gave him money but continued to walk their normal pace. He collected $39.00. When he finished playing and silence took over, no one noticed it. No one applauded, nor was there any further recognition. Only one person knew the violinist was Joshua Bell, considered one of the best musicians in the world. He played one of the most intricate pieces of music ever written with a hand crafted Stradivarius violin worth $ 3.5 million dollars. Two days before his playing in the subway, Joshua Bell sold out Boston’s Symphony Hall, and the seats averaged $100. He plays more than 200 engagements a year internationally. This is a real story which can be verified on the Washington Post website. There is even a video of the event. This event was organized by the Washington Post reporter Gene Weingarten, as part of a social experiment about perception, taste and priorities of people. The outlines were: in a commonplace environment at an inappropriate hour: Do we perceive beauty? Do we stop to appreciate it? Do we recognize the talent in an unexpected context? One of the possible conclusions from this experience could be: If we do not have a moment to stop and listen to one of the best musicians in the world playing the best music ever written, how many other things are we missing? Different perspective - Was such an experiment really necessary to determine that a busy subway platform during rush hour might not be conducive to an appreciation of the sublime? Probably not, though it makes for an interesting story just the same. Do we as supervisors and employers have staff that we have yet to recognize their talents or strengths? Are we too busy with our duties and responsibilities to thank those who have a direct impact on how we as supervisors and managers are perceived? Do we stop and appreciate our accomplishments? Remember - We do not need all the operators in Texas to be members of TWUA – Just You ! ! February 2013

TCEQ NEWS:
New TCEQ Requirement for Individuals Seeking to Obtain or Renew and Occupational License New TCEQ Requirement for Individuals Seeking to Obtain or Renew an Occupational License As of August 20, 2012, the Texas Commission on Environmental Quality (TCEQ) requires all individuals, applying for a new license or renewing an existing license, to fill out a Criminal Conviction Notification attestation (to certify in an official capacity). This attestation must be submitted as part of a new or renewal application, regardless of whether or not an individual has a criminal history. Individuals not in the process of submitting an application to obtain a new license or renew an existing license are not required to submit this form at this time. Occupations Code. Title 2. Chapter 53. Subchapter A - D authorizes the TCEQ to consider the criminal background of all applicants attempting to obtain or renew a license. The types of convictions requiring evaluation and the considerations being used to determine eligibility to obtain or renew a license are outlined in the TCEQ Criminal Conviction Guidelines. The TCEQ Criminal Conviction Guidelines (follow link below) are issued by the TCEQ pursuant to the Texas Occupations Code, §53.025(a). These guidelines describe the process by which the executive director determines whether a criminal conviction renders an applicant an unsuitable candidate for the license, or whether a conviction warrants revocation or suspension of a license previously granted. These guidelines also present the general factors that are considered in all cases and the reasons why particular crimes are considered in relation to each type of license issued by TCEQ.
Conviction guidelines: www.tceq.texas.gov/assets/public/licensing/criminal-convictionguidelines.pdf
The TCEQ evaluates an individual’s complete criminal history, including, but not limited to, cases that may have been deferred or dismissed. The Criminal Conviction Notification attestation may be submitted either online or through a paper form (follow link below). This will notify the TCEQ of your criminal history, or lack thereof.
Printed and Online attestations: www.tceq.texas.gov/licensing/criminal-conviction-notification
In the event an individual does not recall their specific criminal arrest or conviction information, they may reference the TxDPS or Fingerprint Applicant Services of Texas websites (follow links below) to conduct a background search on themselves and then submit this information to TCEQ along with a signed paper attestation.
TxDPS Public Criminal History Search: records.txdps.state.tx.us/DpsWebsite/CriminalHistory/
Fingerprint Applicant Services of Texas: www.txdps.state.tx.us/administration/crime_records/pages/applicantfingerprintservices.htm
Individuals who believe that they may be ineligible to obtain an initial license due to a conviction or deferred adjudication may request an evaluation of their criminal conviction history prior to applying for their first TCEQ license of any type. Evaluations will not be performed for individuals that already have a TCEQ license or for individuals that are not actively seeking to obtain a TCEQ Occupational License. To request an evaluation, you may email licenses@tceq.texas.gov. SAFETY NEWS:
Sling Safety: Don't be the Weak Link By, Renee Witherspoon, CSP, CIH, CHMM, Safety Committee Chair Being able to move materials safety and efficiently is key to a successful job. Everyone responsible for handling or moving materials from one location to the other should be familiar with the hazards especially if they have to rely on a sling. Whether it is a chain sling, web sling or a rope sling, a sling is a tool, like other tools must be inspected and maintained in good working condition for it to work safely.
•
Slings shall be padded or protected from the sharp edges of their loads.
•
Sling legs shall not be kinked.
•
Hands or fingers shall not be placed between the sling and its load while the sling is being tightened around the load.
Having good equipment is important, but knowing how to rig a load safely can save a life. Good riggers are sometimes not appreciated as they should be. They have many technical skills, such as being able to calculate weight distributions, understand load tables and hitch types, read engineering drawings, understanding of structural dimensions of a load and how it might affect the surrounding area, and a very important skill – being able to think fast on their feet so that they can avoid a possible accident.
•
Suspended loads shall be kept clear of all obstructions.
•
All employees should be kept clear of loads about to be lifted and of suspended loads.
•
Shock loading is prohibited.
If you have a job that requires a sling to move materials, a well-trained rigger is the key for a safe and efficient job. Although riggers have specific training and experience, everyone can learn to recognize the hazards of slings and attachments. OSHA Standards for Slings Since employees of states, cities and counties, are exempt from OSHA coverage, it is a good policy that all public-sector employers follow the OSHA standards as a minimum. For slings and rigging the OSHA requirement can be found in Title 29 of the Code of Federal Regulations (CFR) 1910.184. Since OSHA has not updated this regulation significantly since it was introduced in 1975, sling manufacturers have relied on the American Society of Mechanical Engineers (ASME) standard B30.9-2010 for current standards and specifications. Whenever any sling is used, OSHA standards require the following safe operating practices: •
Damaged or defective slings shall not be used.
•
Slings should not be used without affixed and legible identification markings.
•
Slings shall not be loaded in excess of their rated capacities.
•
A sling must not be loaded in excess of its recommended safe working load as required by the sling manufacturer on the identification markings permanently affixed to the sling.
•
Slings shall be securely attached to their loads.
•
Slings used in a basket hitch shall have the loads balanced to prevent slippage.
•
A sling shall not be pulled from under a load when the load is resting on the sling.
•
Slings shall not be shortened with knots or bolts or other makeshift devices.
12 TEXAS WATER UTILITIES JOURNAL www.twua.org
OSHA requires that slings be inspected “each day before being used” and that inspection must include all fastenings and attachments including shackles, hooks, rings and links. OSHA also requires additional inspection during sling use. If damaged or defective slings are found, they must be immediately removed from service. All of these inspections according to OSHA must be completed by the employers “competent person”. The OSHA “Competent Person” How do you know if you are a “competent person” by the OSHA standard? According to the definition, a competent person is someone who is capable of identifying a hazard either an existing hazard or predicting a potential hazard, in a working area that may endanger employees. Importantly, the OSHA competent person must be able to take prompt corrective action if necessary. Types of Slings There are six basic types of slings:
1. Alloy steel chain 2. Wire rope 3. Metal mesh 4. Natural or synthetic fiber rope 5. Synthetic web 6. Synthetic round Each has its advantages and disadvantages. Choosing the best sling for the job takes not only training but experience by a well-trained rigger. Here is a brief summary of some of the key inspection items for each type of sling. Alloy Steel Chain Inspections All alloy steel chain slings should have an identification tag with its size, grade, rated capacity and reach. Common with all sling inspections; if there’s no tag or legible marking February 2013
- don’t use the sling. Inspections should include a thorough examination for wear, defective welds, deformation and an increase in length. As part of the maintenance of a chain sling, a written inspection should be completed at least once every 12 months.
possible tragedy. Learning how to rig safely is a skill, and should not be performed by untrained operators. So if, you move materials or equipment learn what it takes to become a “competent person” in rigging, so that you are not a weak link in safety.
Wire Rope Sling Inspections: As with the alloy steel chain inspections, wire-rope slings should have permanently affixed and legible identification markings that show the recommended safe working load for the type of hitch(es) used. Inspections for wire rope should include examination for broken wires, wear, kinking, crushing, corrosion, bird caging or any other damage or distortion of the wire rope structure or end attachments. Hooks that have been opened more than 15 percent or twisted more than 10 degrees should be taken out of service.

Metal Mesh Sling Inspections: Metal mesh slings are used in metalworking and other industries where the loads are hot, abrasive or could possibly cut a synthetic sling, so we may not see this type of sling in common use. If your organization uses them, the inspection is similar to the other types of slings. Each metal mesh sling has a permanently affixed marking that has the rated capacity for hitch loadings. Inspections should include examination for broken welds or brazed joints along the sling edge, lack of flexibility due to distortion of the mesh material and distortion of either handle. Natural and Synthetic Fiber Rope Slings: Fiber rope slings as with the other types of slings have permanently affixed and legible identification marking stating the rated capacity, as with the wire rope slings, with the types of hitch(es) used and the angle upon which is it based. The identification marking will also have the type of fiber material and number of legs if more than one. Inspections should include examination for abnormal wear, broken or cut fibers, powdered fiber between strands, discoloration, rotting or distortion of the hardware in the sling. Synthetic Web Slings: Web slings are marked or coded to show the rated capacities for each type of hitch and type of web material. Inspections should include examination of the webbing to make sure it is of uniform thickness and width with selvage edges in good condition and not split, melted or charred, broken or worn stitches, snags, punctures, tears or cuts. Fittings should also be free of distortion or sharp edges that may cut the webbing.

Since work with hazardous chemicals is typical in water and wastewater operations, care needs to be taken as nylon slings can be damaged where acids are present, and polyester or polypropylene slings can be damaged where caustics are present. If web slings have aluminum fittings, these can also be damaged by chemical vapors or liquids present in the area.

Conclusion: There is a sling for each operation each has its advantages and disadvantages but it takes a trained person not only do the inspections, but to actually move the material safely without damaging materials or having an injury.

Synthetic Round Slings: Interestingly OSHA does not specifically cover round slings in its regulations. Since there is not a specific OSHA regulation, general rules for sling inspection would apply. Round slings are typically made of polyester tubing and color coded for size reference. Each sling is marked to show the rated capacity, type of hitches, material and number of legs if more than one. Inspections should be similar to that of fiber ropes and web slings looking for any abnormal wear, broken or cut fibers, powdered fiber between strands, discoloration rotting or other distortion.

OSHA NEWS:
OSHA Says Employers Must Pay Tab for PPE
On November 15, 2007, the Occupational Safety and Health Administration (OSHA) issued a long-awaited final rule regarding employer payment for personal protective equipment (PPE). With a few exceptions, the rule requires that most PPE be provided at no cost to the employee. OSHA anticipates that this rule will have substantial safety benefits that will result in more than 21,000 fewer occupational injuries per year. The rule does not specify the method that employers must use to pay for PPE. Many employers use allowances or reimbursement systems or maintain a stock of PPE that can be issued to employees. Any of these methods are acceptable, as long as the employee receives the PPE at no cost. Under the rule, employers are required to pay for most PPE costs. OSHA believes that when employees pay for their own PPE, they: • Are more likely to purchase the wrong equipment, • May use the PPE beyond its expected service life or • May avoid purchasing the equipment at all. When employers pay for PPE, however; they are more likely to:
or steel-toe boots) provided that the employers permit such items to be worn off the job-site. If the equipment, however, is a non-standard “specialty” item, for example, non-skid shoes, employers must pay for the items. Prescription eyewear (29 CFR 1910.132(h)(2); 1915.152(f)(2); 1917.96(b); 1918.106(b); 1926.95(d)(2)) Employers are not required to pay for non-specialty prescription safety eyewear such as “regular” safety glasses with prescription lenses. If the equipment, however, is a non-standard “specialty” item, for example, prescription eyeglass inserts for full-face piece respirators, employers must pay for the items. Everyday clothing and weather issues Employers are not required to pay for everyday clothing, such as long-sleeve shirts, street shoes, normal work boots, skin creams or other items used solely for protection from weather. The employer does, however, need to pay for clothing used to protect employees from artificial heat or cold (e.g., employees working in a freezer warehouse who need heavy coats). The exposure to excessive heat or cold are created by the work environment, therefore OSHA requires the employer to pay for the PPE. There is not a specific regulatory citation to support the requirement, but OSHA has made this clarification in the preamble to the final rule.
• Select the right PPE for the hazards present in their workplaces, • Make sure the equipment is maintained and replaced as necessary; and • Generally take more responsibility for PPE selection and use.
Logging boots The final rule clearly states that logging boots required by 29 CFR 1910.266(d)(1)(v) will continue to be exempted from the employer payment rule.
Who Is Covered?
The following examples further exemplify types of equipment for which employers are or are not required to pay. Please note that what follows should not be construed to be an all-inclusive list.
The changes affect most of the agency’s PPE standards, including 29 CFR Parts: • 1910 General Industry, • 1926 Constructions, • 1915 Shipyards, • 1917 Marine terminals and • 1918 Longshoring. Exceptions The final rule contains exceptions for: Safety-toe footwear (29 CFR 1910.132(h)(2); 1915.152(f)(2); 1917.96(b); 1918.106(b); 1926.95(d)(2)) Employers are not required to pay for non-specialty safety-toe protective footwear (including steel-toe shoes 20 TEXAS WATER UTILITIES JOURNAL www.twua.org
Dos and Don’ts
Employers DO have to pay for: • Foot protection • Special boots for longshoremen working logs specified under 29 CFR 1918.106 • Rubber boots with steel toes • Shoe covers—toe caps and metatarsal guards • Prescription eyewear inserts/lenses for welding and diving helmets • Goggles • Face shields February 2013
• Laser safety goggles • Fire fighting PPE • Hard hats • Hearing protection • Welding PPE • Items used in medical/laboratory settings to protect from exposure to infectious agents • Chemical resistant gloves/ aprons/ clothing • Rubber insulating gloves • Mesh cut proof gloves, mesh or leather aprons • SCBA, atmosphere-supplying respirators (escape only) • Respiratory protection • Fall protection • Ladder safety device belts • Climbing ensembles used by linemen (e.g., belts and climbing hooks) • Window cleaners’ safety straps • Personal flotation devices (life jacket) • Encapsulating chemical protective suits • Reflective work vests • Bump caps
Employers DO NOT have to pay for: • Ordinary rain gear • Back belts • Long pants • Dust mask/respirators used under the voluntary use provisions in 29 CFR 1910.134 Providing workers with the necessary PPE helps keep them safer and can lead to higher productivity, and fewer illnesses and injuries.
