Thank you to everyone who contributed to the success of the annual Law Week Luncheon. The staff at the Tulsa County Bar Association did another outstanding job putting together the event this year. It is always a pleasure to see the newest members of the bar at these gatherings, as well as getting in touch with old acquaintances. The TCBA staff continues to work hard and do a wonderful job for its members. I cannot thank them enough for their support and dedication to ensuring our attorneys get the most from their membership.

It is difficult to believe it is already May, as it seems like we were just celebrating the holidays. After what turned out to be a mild (and welcomed) winter, our calendar is now taking us into the middle of what has, so far, been a wonderful spring. There are still many events on the calendar upon which our members can take advantage. In particular, May brings us several events and opportunities.

The Young Lawyer’s Division is putting on its 3rd Annual Trivia Night on May 12th beginning at 6pm. This event is a lot of fun and should not be missed by anyone who enjoys trivia and competition. Any members looking for an opportunity to show off their intellectual prowess should get tickets. Each of the last two years has been very successful and well attended, and we expect this year to be the best yet. Clayton

Baker and the YLD Committee have done a great job this year in putting together this event. Please show your support and join them for a fun evening with your friends and family.

On Monday, May 16th, the Tulsa County Bar Foundation’s Annual Charity Golf Tournament will be held at LaFortune Park Golf Course. If you have not entered the tournament and still would like to do so, please contact William Kellough or the staff at the Tulsa County Bar Association. The tournament will be played in groups of 4 people, and the first group will tee off that morning around 10am. This event is one of the most important annual events of the TCBF, as the money raised will be donated to select charities here in Tulsa and the surrounding area.

There are still plenty of CLE scheduled for this year for those of you who want to get ahead of the last-minute rush that usually occurs in the fall. Feel free to take advantage of all of the benefits the TCBA has to offer you. It is your organization, and we are here to serve you. Thank you all for your continued support and contributions. Enjoy the rest of your spring.

TCBA VOTING INFORMATION Electronic voting will be available for all current eligible voting members of the TCBA in early May. A paper ballot may be requested or picked up beginning May 9th, 2016.

Ballots will be counted on Thursday May 26, 2016 by the nominations committee.

The results will be posted on the TCBA website the following day.

Along with being an attorney, I began my working career as an accountant and have been a CPA for 17 years. My accounting background is comprised of audit and tax work and has been supplemented by my role as a Certified Fraud Examiner. These skills give me an ability to analyze financial data and review it for accuracy. My understanding of the TCBA as a whole, my abilities as CPA, and my legal knowledge make me well suited to work closely with our outstanding TCBA staff to produce financial statements that are clear and accurate.

Other: I am the mother of two sons. One has been successfully raised to adulthood (he’s married and is finishing Pharmacy School) and is the father of my first grandson (would you like to see pictures?). The second is a 15 year old freshman in high school and I am often prone to reminding him that he is not yet grown (his 6’2” height can be deceiving). I love being a mother and all the joy and challenges that it brings and I am continually amazed that I have been blessed with two boys who, I am absolutely sure, will leave this world better than they found it.

Why you want the position: I have had the privilege to serve on the ABA House of Delegates for several years now, and I leave each House of Delegates with a renewed appreciation of the legal profession and respect for my fellow colleagues. There are many big changes happening in the legal profession right now, and it is an invigorating experience to be part of an organization where top lawyers from across the country debate the issues that are at the forefront of our profession, then bring the conversation back to Tulsa.

Why you think you are particularly qualified for this position: I have been involved with the ABA for the past thirteen years and am familiar with the issues, the process, and the people who are leading change on issues of the utmost importance to the legal community.

I have also actively participated in developing and debating proposals before the ABA YLD Assembly (which debates some of the resolutions prior to the ABA House of Delegates). Not only have I been involved with the ABA, but I have also been involved with the TCBA and am familiar with and knowledgeable about the issues that affect lawyers and the legal profession in Tulsa. Summary of the ABA Midyear Meeting

Molly Aspan Tulsa County Bar Association Delegate to the ABA House of Delegates

I was honored to serve as the Tulsa County Bar Association Delegate at the 2016 ABA Annual Meeting held in San Diego last month. The ABA House of Delegates is made up of 559 members representing state and local bar associations, ABA entities, and ABA-affiliated organizations. Other

TCBA officers attended sessions relevant to their roles, and we were thrilled to have Tulsa attorney Leonard Pataki there as the President of the National Conference of Bar Foundations and Dwight Smith there as a member of the Commission on the Future of Legal Services.

This meeting had a full agenda and involved lively discussion on several areas of interest to lawyers across the country. In short, the House adopted 26 resolutions on a variety of topics, including delivery of legal services by non-lawyers and the use of a uniform bar exam.

The most heated debate centered around a proposed resolution from the Commission on the Future of Legal Services that lays out a framework for regulating the provision of legal services, including services provided by non-traditional legal service

providers such as Avvo and LegalZoom. The Commission explained that given that state supreme courts in the United States are beginning to consider the adoption of regulatory objectives in this area and that providers of legal assistance other than lawyers are actively serving the public, it is timely and important for the ABA to offer guidance in this area. After much debate and discussion and several amendments, the proposed ABA Model Regulatory Objectives for the Provision of Legal Services were adopted.

Also prompting debate was a resolution urging bar admission authorities in each state and territory to expeditiously adopt the Uniform Bar Exam, which allows those taking the exam to transport their scores across state lines. The Uniform Bar Exam is currently used in 17 states, including Missouri, Kansas, Colorado, and New York.

A similar resolution urged bar authorities to consider the impact of the Uniform Bar Exam on minority applicants and include subjects, such as Indian law, that are important in certain jurisdictions. Both of these resolutions were ultimately adopted.

The following is a summary of other resolutions approved by the House of Delegates:

Administrative Procedure Act. Urges Congress to amend the APA rulemaking provisions to modernize the Act to help enhance

public participation in the rule-making process and provide clearer direction to federal agencies.

Health Care Disputes.

Urges lawyers and all interested parties to encourage the informed and voluntary use of alternative dispute resolution processes as an effective, efficient, and appropriate means to resolve health care disputes. Opposes the use of binding forms of ADR involving patients in medical malpractice disputes, disputes with private managed health care organizations, or involving residents in disputes with long-term care facilities or similar health care institutions, unless the parties agree to do so voluntarily and knowingly after the dispute arises.

Surrogacy. Urges the U.S. State Department to seek - in negotiations concerning a possible Hague Convention on private international law concerning children - recognition of the clear distinctions between adoption and surrogacy and allow individual member countries to regulate surrogacy as deemed appropriate by those countries without imposing new international restrictions on surrogacy arrangements.

Emotional and Behavioral Disorders. Urges that state, local, territorial, and tribal child welfare and juvenile justice agencies develop comprehensive policies and that state courts improve oversight for the administration of psychotropic medications for children in their custody, recommends that attorneys and judges become better educated on this subject, and urges Congress to enact legislation to require data collection from states to learn about progress that is being made.

Reproductive Technology.

Adopts the ABA Model Act Governing Assisted Reproductive Technology Agencies (ART), which provides model licensing legislation governing ART agencies, and recommends consideration and

Equal Rights Amendment (ERA).

Supports constitutional equality for women and urges the extension of legal rights, privileges, and responsibilities to all persons, regardless of gender; reaffirms support for ratification of the ERA, and calls on all bar associations to support and take up the pursuit of ERA ratification.

Prisoner Emails. Urges the Department of Justice and the Federal Bureau of Prisons to amend their policies with respect to monitoring emails between attorneys and their incarcerated clients to permit attorneys and clients to communicate confidentially via email and thereby maintain the attorney-client privilege. This would provide those emails with the same confidentiality protections as traditional letter mail.

Sexual Conduct. Urges legislatures to review all statutes criminalizing consensual Tulsa Lawyer

noncommercial sexual conduct, in private and between persons who have the legal capacity to consent, and to repeal or amend such statutes to ensure that such conduct is not made criminal. Urges legislatures to repeal or amend any statutes, regulations, or policies that denigrate persons who engaged in constitutionally protected sexual conduct.

Supreme Court Video Recording. Urges the U.S. Supreme Court to record and make available video recordings of its oral arguments to allow citizens to access and better understand the process through which the court arrives at its decisions.

Continuing Legal Education (CLE). Encourages all state, territorial, and tribal courts, bar associations, and other licensing and regulatory authorities that have mandatory or minimum CLE requirements (MCLE) to modify their rules to include, as a separate credit, programs regarding diversity and inclusion for the legal profession of all persons regardless of race, ethnicity, gender, sexual orientation, gender identity or disabilities, and programs regarding the elimination of bias. Resolves that the ABA will assist in the development and creation of diversity and inclusion CLE programs to ensure attorneys can meet their MCLE requirements.

The International Academy of Trial Lawyers limits membership to 500 Fellows from the United States. The Academy seeks out, identifies, acknowledges and honors those who have achieved a career of excellence through demonstrated skill and ability in jury trials, trials before the court and appellate practice. Members are engaged in civil practice on both the plaintiff’s and the defendant’s side of the courtroom, and the trial of criminal cases. A comprehensive screening process identifies the most distinguished members of the trial bar by means of both peer and judicial review. Tulsa CASA (Court Appointed Special Advocates) recently presented Crowe & Dunlevy’s Tulsa office with the “Heart of CASA” award during their 30th Anniversary and Volunteer Appreciation Celebration in recognition of the firm’s support of the nonprofit. CASA trains volunteers to advocate for abused and neglected children in the court system.

The firm has sponsored a holiday gift-giving event for CASA for the past several years.

“We are proud to support the worthy efforts of Tulsa CASA,” said Randall Snapp, director at Crowe & Dunlevy. “This cause is close to our hearts, and we encourage others in the Tulsa community to learn more about CASA and to volunteer their time or dollars to help speak for the best interest of abused and neglected children in our community.”

Most recently, Crowe & Dunlevy attorneys and staff filled 36 laundry baskets full of food and holiday treats for families, as well as 20 stockings with goodies for teens. The gifts were distributed at the Tulsa CASA holiday party that included children who have a case pending on the deprived docket of the Tulsa County District Court Juvenile Division, the foster families

with whom those children are temporarily living and the CASA volunteers who advocate for them.

The firm, attorneys and staff provided funds to purchase items and provided their time to assemble the baskets and stockings.

Crowe & Dunlevy recently announced the addition of J. Blake Johnson, Harry “Skeeter” Jordan and Melissa McDuffey as attorneys in the firm’s Oklahoma City office and Alexandra Shipley as an attorney in the Tulsa office.

A member of the firm’s Litigation & Trial, Indian Law & Gaming and Product Liability Practice Groups, Johnson received his Juris Doctor from the University of Oklahoma College of Law and holds several honors including Order of the Coif, Order of the Barristers and Law Review. He also is an American Bar Association Appellate Advocacy National Championship quarterfinalist and has received the National Order of Scribes Legal Writing Award.

Johnson received his bachelor’s degree in political science from the University of Oklahoma, where he became the National Champion of College Debate in 2007. He founded the Bay Area Urban Debate League in 2008, a nonprofit organization creating debate teams in inner-city high schools in the San Francisco bay area.

Jordan has joined the firm’s Intellectual Property and Litigation & Trial Practice Groups. He received his Juris Doctor from the University of Oklahoma College of Law, where he was on the Dean’s List, a member of Phi Delta Phi Legal Honor Society, served as special

projects editor for the American Indian Law Review, was treasurer for the Intellectual Property Society and was honored with the American Jurisprudence Award in Legal Research and Writing I.

Jordan was also an award winner in the school’s Negotiation Competition, a 2015 American Bar Association Regional Mediation Competition champion and a 2015 American Bar Association National Mediation Competition champion. He received his bachelor’s degree from the University of Oklahoma.

McDuffey is a member of the Labor & Employment and Litigation & Trial Practice Groups.

She graduated from the University of Oklahoma College of Law with honors. During law school, McDuffey was on the Dean’s List, was a member of Phi Delta Phi and served as a note and comment editor for Oklahoma Law Review. She received several honors and awards, including selection into Order of the Coif and Order of Solicitors. She also earned American Jurisprudence Awards for Academic Excellence in Constitutional Law, Comparative Law and Family Law.

Additionally, McDuffey competed in the American Bar Association Representation in Mediation competition, where her team won both the regional and national titles in 2015. She received her bachelor’s degree from Cameron University in Lawton, Oklahoma.

An attorney in the firm’s Tulsa office, Shipley is a member of the Energy, Environment & Natural Resources and Litigation & Trial Practice Groups.

She received a Juris Doctor from the University of Oklahoma College of Law, graduating with highest honors and as a member of the Order of the Coif.

During law school, Shipley served as an assistant managing editor for the Oklahoma Law Review, earned a place on the Dean’s Honor Roll and was the recipient of the American Jurisprudence Award in: Legal Research & Writing I, Civil Procedure II, Federal Courts and Professional Responsibility. As an undergraduate at Indiana University, she studied ballet, business studies and Spanish.
