Warm Weather Has Arrived
My time as your TCBA President is nearing an end. I can’t believe how fast time has flown by. Membership renewal packets will go out soon, so please watch for it. We hope you have enjoyed all the membership activities this year. Due to the restrictions of COVID-19, the TCBA was committed to serving the membership in an exemplary manner. The TCBA Special Events Committee and Membership Appreciation Committee joined forces to provide year-long events to its membership. Thank you to Membership Chair Kara Pratt and Special Events Committee Chair Natalie Sears.
Our new website is currently in Beta mode. We will announce when it is ready for its debut. I am excited to announce our TCBA/TCBF Annual Luncheon will be back in person this August. Please watch for announcements on the location.

3rd Quarter Golden Rule Award Greg Lavender
Award Criteria The Golden Rule award is given to lawyers who make outstanding contributions to their profession and have the highest of ideals and are willing to mentor to those with less experience. Criteria for Award:
1. Recognizes the ethical and professional obligations as an officer of the court as well as the spirit and intent of the Rules of Professional Conduct. 2. Practices ethically and honestly and is true to his/her word. 3. Strives for the traditional goals of moral excellence. 4. Exhibits the highest standards of fairness and integrity. 5. Sets a model example for conduct with members of the Bar and the Judiciary not only by words but more importantly by deeds. 6. Is civil, courteous and respectful towards the court and his/her opponents. 7. Is loyal to his/her client without trickery and deception and without using abusive practices or misleading the court or opposing counsel. 8. Avoids the temptation to make his/her client’s case into a personal vendetta. 9. Conducts himself/herself in a manner that improves the image of the legal profession in the eyes of the public.
Greg Lavender has a general legal practice with heavy emphasis on criminal defense, juvenile proceedings, family law, and personal injury litigation. Greg has a contract with Legal Aid Services of Oklahoma and the Parent Child Center for representation of indigent parents in juvenile deprived proceedings. He also accepts conflict appointments for indigent criminal defendants from the Tulsa County District Court. Greg graduated in 2013 from the University of Tulsa College of Law where he excelled in several courses and authored a law review article entitled At the Mercy of Two Kings: The Utility of the Dual Sovereignty Doctrine. The article’s focus was justification of successive prosecutions between states, tribes, and the federal government under prevailing punishment theories. His baccalaureate is from the University of Central Florida where he earned a degree in political science. Greg has a five-year-old daughter and enjoys spending time with her, his fiancé, and exploring his interest in movies, gardening, guitar, and reading. Greg was nominated for the Golden Rule Award for his zealous advocacy of parents in Juvenile deprived cases and his on-going professionalism as an officer of the court. He is a dedicated, prepared, professional, and reliable attorney. He diligently advises the court in advance of any conflict that might prevent his appearance in court or potential tardiness. He provides announcements in advance of any absence to inform and to allow the court’s work to continue to the extent possible. Following a recent jury trial, several jurors particularly noted him, expressing their admiration for his perseverance and trial skills even though his client did not prevail. Congratulations to Greg Lavender, the TCBA 3rd Quarter Recipient of the Golden Rule Award.

Motivation, Fear and Deadline
On the Monday before the Thursday submission deadline for this article, my working title for this month’s installment was “TBD” or “to be determined.” I explored various potentially germane topics related to finance and bankruptcy, which are the topics for this month’s issue, and the Association’s approaching Annual Meeting, which may or may not be an in-person event. I found nothing particularly inspiring in my efforts. Going back to the tried and true, I attempted to identify a song or saying about July. At least for purposes of the discrete exercise of topic identification, James “Living in America” Brown and ‘Merica itself failed me. On the eve of the submission deadline, I came across a meme on social media of Dwight Kurt Schrute III of The Office with the caption: “All you need to write is motivation. False: You need fear and an approaching deadline.” Upon reading the meme and recording it in my working draft, I set aside this work and turned

to the billable tasks awaiting my attention, with the full knowledge that my continued delay would test the efficacy of Mr. Schrute’s astute, if not skeptical, observation. On the submission deadline, I am still without motivation, ostensibly leaving me with Dwight Schrute and fear. With regard to the former, I recall with some amusement one of the Association’s early virtual board meetings when my son (who is a tremendous fan of Mr. Schrute, especially the CPR-training episode) and I shared a laptop computer. Unknown to me until I joined the meeting, Master Hixon had installed a Dwight Schrute wallpaper in Zoom during a virtual meeting with one of his chums. The wallpaper was accompanied with the name, “Look How Smart I Am.” Being a semiprofessional Luddite, it took me several—very long— minutes to remove my then fifth-grader’s handiwork. So much for Dwight Schrute.
With regard to the latter—that is “fear,” I’ll share several discerning (but unverified) quotes I discovered in my last-minute efforts to find motivation. “Fear is the path to the Dark Side. Fear leads to anger, anger leads to hate, hate leads to suffering,” a truth shared by no other than Yoda. Bill Cosby observes (in something of double entendre?), “Decide that you want it more than you are afraid of it.” Nelson Mandela and Babe Ruth share harmonizing observations. Mr. Mandela: “The brave man is not he who does not feel afraid, but he who conquers that fear.” Mr. Ruth: “Don’t let the fear of striking out hold you back.” And finally, my personal favorite, “Have no fear of perfection—you’ll never reach it,” courtesy of Salvador Dali. So much for fear. Whether this article is the result of motivation, fear, a deadline, or otherwise, I have nonetheless found myself in the final paragraph. Whether in-person or virtual—I voted for the former—please join us at this year’s Annual Meeting as we hear from author Denver Nicks, recognize some deserving peers, and pass leadership to the incoming Association officers.

Cyberattacks Threaten Business, Industry, and Infrastructure By Trent Shores, Tom Vincent & Susan Linberg Colonial leader and Founding Father Benjamin Franklin advised that an ounce of prevention was worth a pound of cure. One must wonder to what extent Colonial Pipeline or any of the other ransomware victims in the recent news had invested in cybersecurity prevention. Today’s world functions in large part due to interconnected digital networks where information, currency, and other data are merely a hack away for cybercriminals, cyberterrorists, and enemy foreign states. With the onslaught of recent cyberattacks, it is clear that any individual, government or business must be proactive in building up its defenses against cyber incursions and preparing for the aftermath if and when there is a breach. American ingenuity drives world markets and inspires advances in science and technology. Nowhere is that more true than in the energy industry where American innovation, born out of our free-market system and democratic values, is the envy of the world. That makes American companies and institutions valuable targets for cyberattacks and espionage. It also puts a target on American cities and states where those companies are based. Now, more than ever, it is essential that our systems and data are both secured and preemptively protected – both in terms of managing competitive business advantage and in protecting the private information of customers, clients, and employees. Neither a remnant of the by-gone Cold War era nor a creative plot of a sci-fi movie, cyber-espionage is a real and increasingly frequent threat to all Americans. When it comes to meeting these and other requirements, for most organizations the first (and sometimes last) line of compliance is their employees – information technology departments may be able to install firewalls, but they can’t prevent an employee from “clicking that link” (at best) or preventing active theft (at worst). To ensure employees don’t inadvertently assist attackers, employers should empower them appropriately – some sample steps are provided at right. The collective response from America’s private and public sectors will send a clear message to the any would-be enemy states and cybercriminals. Thus, it is imperative at this pivotal time that our public and private sectors stand together, unified, to guard the longterm security and prosperity of this country and everyone in it.

Ending of an Era: Eddetta Beier Grant Retires Eddetta Beier Grant provided dedicated service to the Tulsa County District Court for over 45 years. Eddetta retired from her lengthy career with the court system as of May 1, 2021. She began as a deputy court clerk for then Court Clerk Don Austin on August 25, 1975, before the time of computers. Eddetta’s assigned tasks were to transfer court minutes on to docket sheets, wait the counter, and process civil appeals.

Eddetta experienced many happenings over her years with the Tulsa County District Court, the antics, victories, and losses of attorneys; the rise and fall of judges; and, the camaraderie and respect of the judges, clerks, bailiffs, court reporters, and law enforcement staff who make possible the progress of justice. Although Eddetta richly deserves retirement, she is sorely missed for her remarkable and long-lived service, her good humor and sense of fun, and her invaluable history and knowledge of the Tulsa court In January 2019, Eddetta became bailiff to system. In addition, she assisted over the years Special Judges assigned to the Juvenile Division, including Judges Kirsten Pace, Terry Bitting, Ed Hicks, Bill Hiddle, Kyle Haskins, Mark Barcus, Rodney Sparkman, Wilma Palmer, and Martha Rupp Carter.

actively recruiting attorneys interested in improving the lives of maltreated children in Tulsa County. As an attorney, you already have the basic skills you need. But TLC provides you with the specific training and mentorship you need to make a real difference for our children in state custody In 2000, TLC was incorporated with the assistance of the Tulsa County Bar Association to provide legal services for Tulsa County’s abused and neglected children. Children in state custody are presumed by law to be indigent and are entitled to a court-appointed attorney. In Tulsa County, this role is traditionally filled by the Office of the Public Defender. However, conflicts can arise when there are pending criminal matters against the parents (represented by a Public Defender) or when siblings disagree and desire different legal outcomes in their case. TLC fills this gap in legal representation. The children referred to TLC by the Tulsa County Family Center for Juvenile Justice have all suffered abuse and neglect. Whether sexual
abuse, domestic violence, or physical abuse, these children have been maltreated and deserve to have their voices heard in and out of court proceedings. While the total number of children served by TLC fluctuates from year to year, there is a significant concern that unnoticed and thus unreported abuse and neglect over the past year will be identified and reported as schools once again normalize and ultimately require in-person attendance.
