A Message from the President

Be the Leader You Want to Follow We’ve reached May my friends, and the time is approaching to vote on the 2022-2023 leadership for the TCBA. Next year, I will have the easiest job in the TCBA, that of Immediate Past-President. By the way, Michael Taubman has threatened to run against me. I’m looking forward to the campaign if he does. As we enter the final months of this fiscal year and in light of the upcoming elections, I am compelled to think about leadership and what that word really means. Generally, there are seven characteristics for being a good leader. I’ve included those characteristics and some words that describe how that characteristic is implemented: •

Promote a compelling vision – innovation, problemsolving skills, resilience, inquisitiveness

Treat others the way they want to be treated – respect for others, fairness, empathy

Admit mistakes – integrity, honesty, accountability, humility, self-confidence, resilience

Make yourself part of the action – decision-making skills, self-motivation, self-discipline

Great communication – emotional intelligence, passion, self-awareness

At first glance, it’s not a long list, but spend a day trying to put these characteristics into action, and you will discover it is difficult – especially when dealing with the issues we encounter each day. Regardless, every attorney reading this article is in a leadership position. Society expects us to rise above the fray and to “do the right thing.” Maybe that expectation is too high, but we all know perception is reality for most people. Any failing on our part to achieve the goal is greeted with negativity. The pressure can be great. In a time when the mental health of the general populous is suffering, it can seem overwhelming. Even so, the people in our communities need our help and our leadership. Rather than retreating from the roles of leadership for fear of being berated or perceived as lackong ability, we should lean into those roles. We have a skill set that is unique. Even if you don’t practice in litigation, you have been trained to see both sides of an argument. Of course, you can also pick one and fight for it, but you recognize the opposing view. Many people can’t (some won’t) do that. It takes a leader to see both sides of an issue and drill down to find the common ground. It happens in contract negotiations, mediations, and really, all facets of our work.

Additionally, I earned my Master degree in Public Administration & Human Organizational Sciences, while working for a suburban township in Philadelphia during graduate school. My knowledge and experience expanded as a departmental manager during law school for my corporate employer, planning and budgeting for the facilities management and new construction projects as well as directing IT services for the entire organization across multiple locations domestically and internationally. Finally, I utilized my years of knowledge and experience for myself in starting and running my own law practice from 2008-2020.

Oklahoma Bar Association High School Mock Trial Competition Owasso High School Emerges as State Champs Tulsa County was well represented in the Oklahoma Bar Association High School Mock Trial competition held in the Bell Courtroom at the University of Oklahoma College of Law recently. Longtime rivals Jenks and Owasso met in the State Finals after also meeting in earlier rounds three times with their younger teams. The two senior teams battled in the Final Round judged by Supreme Court Justice Noma Gurich, federal judges Shonn Irwin, Janice Loyd and Charles Goodwin, Oklahoma Court of Criminal Appeals Judge David Lewis, and Canadian County retired judge Edward Cunningham who presided over the trial. Owasso emerged victorious to claim their fourth State Championship in five years.

The competition involves teams of students taking on the roles of attorneys and defendants in a fictional case. The mock trials are presided over by a judge and attorneys in a courtroom setting, where individual and team performances are evaluated.

 The case this year is a criminal trial stemming from a peaceful protest gone awry. The murder victim was one of the organizers of the intended peaceful protest, who died during a clash between groups that were exercising their constitutional rights as citizens of Oklahoma and the United States. Murray said. “These skills, together with developing self-confidence, team building and leadership will benefit them in whatever career path they choose.” Owasso Coach District Judge Daman Cantrell said, “this is my 34th year to volunteer for the OBA program, and it is one of the best things the OBA does. I appreciate all of the attorney volunteers that give of their time. We have had six young people come out of our program and go on to law school and become lawyers. Even those that don’t fondly remember their experiences and appreciate the skills that they have gained and friendships made. Two of our attorney coaches, Maegan Murdock and Kaylind Baker, were on our Owasso team when they were in high school, so they’ve come full circle to giving back. “

In recent years, Tulsa County teams have dominated the OBA competition. Jenks, Holland Hall and Owasso have won recent championships, and Bishop Kelley has been near the top. Broken Arrow has been in the semifinals consistently. Other judges have been involved as coaches, including Judge James Bland of Macalester, Judge Douglas Kirkley of Coweta, and Judge Jill Weedon of Clinton. Jenks’ attorney coaches were Mike Horn, Morgan Medders, Stacey Accord, and Jenny Day. The Owasso team will compete in the National Championship tournament hosted virtually by the Michigan Bar Association on May 5-7.

In fact, federal judges Irwin and Goodwin pointed out to the students after the competition that they were competitors in the OBA program decades ago when they were in high school. Tulsa lawyer Ken Underwood, also an Owasso coach, said, “The Owasso High School Mock Trial Team has taken us to the State Championship Finals eight years in a row. Every year we are amazed and inspired by the dedication, focus and talent of these young people we coach. They are simply the best. They work hard, remain focused, stay humble and always act with character and integrity. They treat each other and opposing teams with respect and kindness. As we watch them develop their courtroom skills and master the rules of evidence, we also see them develop the confidence and personal power to overcome challenges in law and in life. In every Mock Trial competition, one team wins, but no one ever loses. Every student we coach is a champion, and they always fill our hearts. Judicial Q&A Judge Greg Blackwell Oklahoma Court of Civil Appeals What area(s) of the practice of law did you find most interesting? I've been fascinated with appellate law since the beginning of my legal journey. I am thriving doing the work of the Court of Civil Appeals because it requires two things that I truly enjoy: deep thought about the law and building a consensus around the truth. I’m humbled and privileged to have been given the opportunity to come to work each day to serve the trial bench, the bar, and the people of Oklahoma doing what I love. · Please explain your philosophy of public involvement and practice of giving your time to community service. How do you anticipate your personal philosophy would translate to your service at the Court of Civil Appeals? As an appellate judge, I’m blessed with two full-time attorneys on my staff. As a former federal law clerk, I’m a big believer in term judicial clerkships and have elected to make one of these positions open to new lawyers for one-year terms. Although I do not view this as true community service—as I think the Court and I stand to gain from the practice as much as the clerks—I am hopeful that the program, especially if followed by other appellate judges throughout the state, will increase the judiciary’s engagement with the bar, our law schools, and the general public. Although it’s early days, thus far, the program has been a great success. ·

When in doubt, make a list of everything you need or want to do. And when I say everything, I mean everything. Getting that information out of my head and onto a piece of paper has been a key to my success (and my sanity) over the years. Everyone has an opportunity to make their world, and the world at large, better from right where they are. Anything else you’d like the TCBA members to know? If you're interested in arguing your client’s case before the Court, file a motion requesting oral argument pursuant to Supreme Court Rule 1.9. Surprisingly, for what is likely a complex set of reasons, we receive very few such motions. To quote an author far more eloquent than myself: “Ask for what you want and be prepared to get it!”

The BruntonWill CLE award is presented once a year to an outstanding Tulsa County attorney who has demonstrated excellence in teaching CLE courses on a regular basis. The award is intended to honor someone who made the commitment and sacrifice to help educate and instruct attorneys in the ever changing world of law. The Tulsa County Bar Foundation is proud to present the 2022 award to Sabah Khalaf. Sabah is a trial lawyer whose practice is focuses on DUI defense and major crimes in federal, state, tribal, and municipal criminal courts from pre-filing investigation to trial. He effectively

communicates with his clients, prosecutors, and other agents to quickly minimize the stress and disruption a criminal case can be and he applies that same tenacity to coordinating quality and information continuing legal education to attorneys and paralegals. One of this awards namesake, Paul Brunton, retired in 2017 and without prompt, Sabah stepped into providing the TCBA’s Annual Criminal Law Hodgepodge CLE. Sabah is also a member of the TCBA Bench & Bar Committee and assisted with coordinating the return of the Brown Bag CLE series at the Tulsa County Courthouse. “Sabah organized an informative and insightful CLE, Criminal Law Hodgepodge, in December 2021 amid COVID restrictions. I do not practice criminal law but there was crossover appeal for civil practitioners, particularly concerning an overview of McGirt. Sandra Day O’Connor Award Presented to TCBA Street Law Committee The Sandra Day O’Connor Award is given in honor of the retired Justice of the US Supreme Court, and first female Justice in history, who in retirement has made her mission highlighting the importance of legal civics education. Justice O’Connor was instrumental in establishing the award-winning website icivics.com which has been invaluable to educators teaching this critical subject matter. The award will go to the person or persons who have significantly advanced the teaching of legal civics in Oklahoma schools. This year’s award goes to the 2022 TCBA Street Law Committee. TCBA President Kara Vincent gathered some YLD attorneys and the chairs of multiple TCBA committees to discuss how we can expose more middle school and high school students to the profession of law. Two young attorneys mentioned the Street Law program and their positive experiences with the program through other connections we found a group of students to start a pilot program. The Street Law program and content was designed using current research and best practices in the fields of civic education, youth development, teacher professional development, and democracy education. Since its inception in 1972, Street Law has been providing legal community partnership program to teach practical law to young people and adults who are most vulnerable to injustice. This program ensures that participants know their rights and build key life skills to help them advocate for themselves and their communities. By utilizing the Street Law Legal Life Skills Program this committee has spent this Spring providing students from the Zone Academy “opportunities to develop the legal knowledge, skills, and confidence needed to live as informed, empowered, and civically- engaged community members”. Committee members include Rachel Baker, Carol Beatty, Katie Dilks, Whitney Dockrey, Jeril Haug, Timothy Michaels-Johnson, Pansy MooreShrier, Deborah Reed, Pierre Robertson, Kara Vincent, and Tami Williams.

W. Michael Hill

1947-2022

Mike Hill, beloved husband, father, grandfather, brother, uncle, and friend passed away on March 24, 2022. His sudden passing is a reminder that tomorrow is never promised. Mike was born on July 14, 1947 in Norman, OK to Windham and Bette Hill. He moved to Tulsa at a young age, and he attended Will Rogers High School. After graduation from high school, he attended Baylor University where he was a member of Beta Tau Alpha. Mike was an avid Baylor fan, and he attended multiple games, including several bowl games and the 2021 National Championship basketball game. While at Baylor, he met his wife of 48 years, Sally McGill. Together they built a life full of love, fun, adventure, and family. After graduation from Baylor, he was drafted and served in the US Army, stationed in Germany. Upon discharge, he attended law school at the University of Tulsa. He was a member of the Tulsa County and Oklahoma Bar Association. He also had the great honor of being admitted to practice before the Supreme Court of the United States. In 1984, he was co-founder of the law firm Secrest & Hill where he worked until his passing. He was a long time member of Asbury Church where he served on the Foundation Board. He was also a member of the Faithbuilders Sunday School class where he served as a teacher. Although Mike was dedicated to his work, his greatest joy was spending time with his friends and family. Whether it was after-church lunches with the class, traveling the world with family and friends, or his annual trip to the Indy 500, Mike was always up for an adventure. Wherever he went, he was always in a hurry to get there and in an even bigger hurry to leave. An avid reader and music-lover,

he enjoyed discussing books and music with others, and his signed leather book and vinyl record collections were quite impressive. Mike is survived by his wife, Sally; son, Eric Hill and his wife, Kelli; daughter Jayme Wilson and her husband, Jonathan; grandchildren Noah, Gabe, Leah Claire, and Creek; brother, John Hill and his wife, Linda; along with several nieces and nephews. A Celebration of Life service was held Saturday, April 2, 2022 at Asbury Church in Tulsa, OK. In lieu of flowers, donations can be made to Asbury Church in memory of Mike Hill. Kenneth Miles

1946-2022 Kenneth George Miles passed away on April 12, 2022 after a brave fight with cancer. Ken was born in Lancaster, PA in 1946 and married Judy Lehew in 1971. He attended Central Michigan University in Mount Pleasant, MI and the University of Texas School of Law in Austin, TX. Ken also served in the US Army for 20 years, including two tours of duty in Vietnam, and was a decorated combat veteran. He was an avid Volksmarcher, an attorney specializing in real estate and banking and a longtime member of the TCBA. Ken was also a long time member of the Tulsa Opera Chorus and served as a Scoutmaster for Tulsa’s Troop 20, and at the Scouting District level for many years.In lieu of gifts and flowers please donate to the Oklahoma Baptist Homes for Children in Owasso.

Attorney Thomas M. Askew was appointed as the Presiding Municipal Judge for the City of Sand Springs by its city council on March 28. Attorney Sharon Weaver was appointed as Assistant Municipal Judge for the City of Sand Springs at the same meeting. Askew is a shareholder and director in the firm’s Tulsa office. He litigates business disputes, first- and third-party insurance matters, transportation liability cases, "bad faith" cases, business torts, contract disputes with private and governmental entities and personal injury matters. Weaver is also a shareholder in the firm’s Tulsa office. She serves in a number of practice areas, with a focus on civil litigation, appellate law and alternative dispute resolution. Both Askew and Weaver will serve a two-year term, serving from May 1, 2022 through April 3, 2024.
