A Message from the President

The New Normal I'm writing this column on April 9, 2020. Over the last four weeks, there's been something new every single day regarding the COVID-19 pandemic. At the TCBA, we have implemented remote working, remote committee and board meetings, and remote CLE. We've had to do this quickly just like law firms and solo practitioners out there. In addition, we've been doing our best to deploy useful information to our members, using our website and Facebook page. We have been

working with the courts to send out notices as they request. We have offered to assist the Tulsa County Courthouse using the fund established through the TCBA judicial dinner fundraisers. The bottom line is that this year is different from every other year that any of us have been practicing law. And it's different from any other time during which the TCBA has been in operation. But the TCBA has made it through wartime and peacetime. The TCBA was around when the Spanish Flu pandemic hit in around 1918. If you've been reading my President's Letters, you'll know that I am a history buff. I would love to know who the TCBA President was in 1918. I would love to know how they handled the Spanish Flu pandemic. But I am self isolating, working from home, and avoiding any errands other than those that are essential. As the TCBA moves toward its remodel, staff is reviewing our archives and photographs. Certain of these items will be digitized, with the thought that they can be added to a digital library available to our members. As a result, history buffs such as myself may be able in the future to find out what the TCBA did way back when. I checked to see what I could find online using Google Books, and found a notation that the morse code operators for Western Union were struck by the Spanish Flu in 1918, and as a result Western Union was operating on a short staff. There were a few other stories that could be found. The Daily Oklahoman ran several good stories on Sunday, April 5, 2020, about how Oklahomans dealt with the Spanish Flu, and regarding various similarities to how things are going now. But with all of us glued to the news on a daily basis these days, you don't need to hear that from me. Just rest assured that the TCBA is doing its best to remain of service to you, our members, during this most trying of times. Keep watching our website and social media for the latest updates from the Bar Association. With luck and hope, we can all be back in the Courthouse, and at the deal table, in a few more weeks. TCBA COVID-19 Update & Events Announcement:

In remaining consistent with current measures being deployed, the Bar Center is closed for member services and in-person LRIS. Members are encouraged to interact with staff via phone or email during regular business hours. Lawyer Referral assistance is still available 24 hours online or via phone during regular business hours. In following current CDC recommendations on social distancing, the following TCBA and TCBF events have been postponed: • YLD Trivia Night • 50 Shades of Energy Arbitration CLE • Law Day Luncheon • Lynn Miller Law Day Book Club-April & May Sessions • Law Day Student Reception • Law Day Naturalization Clinic • Monthly Section and Committee Meetings • TCBF Annual Charity Golf Tournament The Law Day 5K & Ruck Run events are being monitored for possible postponement. Members will be notified as soon as dates have been rescheduled.

The Bar Center will remain closed until further notice. The staff is available to members via phone or email during regular business hours of Monday Friday, 9am-5pm

Incoming President Kimberly K. Moore

My name is Kimberly Moore. I graduated from the University of Tulsa College of Law in 2001. I have been an attorney with Legal Aid Services of Oklahoma since 2005 practicing in the areas of family, landlord tenant, consumer and estate planning.

In addition to the practice of law, I am the proud mother to Alexander (12) and Zachary (10). We also have four fur babies, Maggie (Yorkie), Cooper (lab), Pluto (Dane), and Tigger (cat). Oh and Zachary said not to forget Pickle and Fuzzy Butt, our 2 rehab squirrels. In my spare time I have been teaching my boys about the importance of wildlife through wildlife rehab volunteer work.

Since 2005 I have been active in the TCBA and the OBA holding various officer, committee and volunteer positions throughout the years including: TCBA Secretary, Treasurer, Vice President, President-elect, Chair Pro Bono Committee Chair, TCBF Law Day Chair, OBA Leadership Academy graduate and VP Women in Law Committee. Being a member of the TCBA is one of the best decisions I have ever made. The knowledge, experience and relationships I have developed have been invaluable.

I was honored to have been elected your Presidentelect for 2019/2020 and look forward to representing our county Bar for the 2020/2021 year. As in every year new challenges are presented and this coming fall we will be faced with the needs of our community in the face of the effects of COVID-19. Which qualities that you bring to this office do you want members to consider when voting for you: Some people believe that if you apply to be a candidate for President-Elect, you’re probably just crazy enough to do the job effectively. I’ve served in many different capacities within the TCBA over the last several years and I’m really excited about the capacity for our organization to serve its members and the larger community. I’d like an opportunity to use all of the knowledge I’ve gained during my years of service to find new and creative ways to increase the value our members realize from their membership with the TCBA.

During my term as TCBA treasurer, I have worked to improve operations of TCBA. I have familiarity with the TCBA’s operation and programs gained through recent experience and prior TCBA board experience as chair of the YLD, Tulsa Lawyer, and Santa Brings a Lawsuit committees. I am in my third year as treasurer of the Tulsa County Bar Foundation and have worked to improve coordination between the TCBA and TCBF. I have approximately 8 years of professional management and financial analysis experience gained through employment before law school. TCBA Teaming Up with Food Bank to Make a Difference The Food Bank and Tulsa County Bar Association invite Tulsa's legal community to participate in Food from the Bar, a fundraising campaign during May 1 - June 1, 2020. For every $1 donated to the Food Bank, we can provide the equivalent of four meals to our neighbors in need. Food from the Bar is designed to provide a Hunger-Free Summer for the 1 in 4 children in our community who experience food insecurity. Summer can be a difficult time for the 85% of Tulsa-area students who rely on free and reduced lunch at school. Last summer, the Food Bank provided 99,000 meals to children through Mobile Eatery food trucks and Summer Feeding sites, as well as the distribution of additional non-perishable food, prepared lunches, and fresh produce to partner agencies. The Food Bank cannot do this without your support.

The Children and the Law Committee will be trying to change that by providing foster children with their own suitcases to move their belongings and have for their own safekeeping.

When Do You Need a Forensic Accounting Expert in Divorce Matters? By Leah Wietholter In our ten years in business, Workman Forensics has been asked to provide expert services in many divorce matters. The most common services requested are the following: • Find hidden assets. • Trace funds to determine pre-marital versus marital assets. • Uncover business accounting practices that decrease the value of the company. As an attorney, having a clear understanding of the forensic accounting services needed for your case can help you and your clients save time and money. Hire an expert forensic accountant Hire an expert forensic accountant when there are issues of tracing sources of funds or preparing for a business valuation. Tracing sources of funds to determine whether financial accounts are marital or should be apportioned is a job for an expert forensic accountant who can also testify, if needed. There are methodologies, considerations, and calculations that are best explained by an expert who specializes in this area. When a divorce case requires the division of the value of a business, an expert forensic accountant creates a lot of value – especially in a closely held, family

business. An expert forensic accountant can analyze the accounting records of a company for changes in the company financials that would reduce the valuation. Other cases require evaluation of commingled personal and business assets and expenses. This analysis is then provided to a business valuation expert to calculate the value to be divided. Having an experienced forensic accountant to uncover and interpret these details is vital to ensuring the business valuation expert is working from the best set of facts available. Hire a consulting forensic accountant Finding hidden assets in a divorce matter does not necessarily require the expertise of a forensic accountant. Although many experienced forensic accountants know the most common places to look, and have the tools to make the process more efficient and smooth, they are not performing “CSI” magic to locate the assets. Contrary to the belief of many clients, there is no legal database that forensic accountants or private investigators can search via Social Security number to retrieve a list of all associated bank accounts. However, using logical, structured processes, forensic accountants can use information gathered from the client’s story, financial account records, and public records to construct a well-organized list of assets. Be Your Own Factfinder in Divorce Cases While studying the processes used in my practice over the last ten years, I have realized that the finding hidden assets part of our services does not actually require expertise. It requires logic, problem solving, and a lot of organization. The basic process looks like the following: • Create a timeline. Although it may seem simple, a timeline listing dates of marriage, divorce filing, property acquisitions, business changes, et cetera is one of the most useful places to start. As the case is

worked, adding additional findings to this list, and sorting by date if using a spreadsheet, can help identify connections that might be missed otherwise. • Make a list of all documents or other sources of information. Information in divorce cases can come from all kinds of sources: client stories, crumpled papers from desk drawers or safety deposit boxes, financial institutions, or discovery requests. Starting a case with a list of the information received or found, including the source and the Bates stamp numbers, helps keep everything orderly and easily accessible. Cases involving financial information always grow, so organization is critically important. In fact, we recommend specifically listing financial account numbers and dates covered as part of this step. Regular, continuous updating of this list will make the property settlement, mediation, or even trial preparation so much easier. Using a spreadsheet to track this list will allow for future sorting and filtering to access documents when needed.

• Convert bank statements and credit card statements to spreadsheets. This step is usually where eyes begin to glaze over, but I assure you, this is where the hidden money is found. A few things I have learned about the importance of this step: 1. I can digitize statements now or later, but I almost always find that I might as well have digitized it all because by the end of the case, I needed all of it. 2. Some people “cherry-pick” what they believe to be important transactions by reading paper or PDF bank statements. When compared to this method, I will always find more money through data analysis. Not only am I looking at everything in the data set, I can analyze all of the transactions together to find trends, anomalies, and items that would not have caught my eye by reviewing individual bank statements. • Summarize transactions from bank and credit card statements. One of the easiest ways to analyze bank and credit card statement transactions is to sort and summarize the spreadsheet by payee or dollar amount. This initial analysis identifies names, businesses, and other accounts that need further research. • Create a lifestyle analysis. Another use of the digitized financial transactions is to summarize the transactions year-over-year or month-over-month to create a lifestyle analysis. This is also a great place to find things such as additional mortgages, extra automobile loan payments, and girlfriend/boyfriend expenses. My favorite use of the lifestyle analysis is to identify whether or not the spouse is understating income – especially for child support purposes. • Review paycheck stubs. A common way for spouses who receive income through traditional payroll to hide related financial accounts is to direct the payroll provider to deposit funds in two or more bank accounts. Since it is

now common for pay stubs to be delivered electronically, spouses often do not see the pay stub and never know the other account exists. • Organize information and questions. As you work through the steps above, track the information, facts, or findings uncovered in the following three categories: 1. Assets to list on the marital balance sheet (financial accounts, investments, properties, related debts, et cetera) 2. Leads for which additional information should be requested 3. Questions for the opposing party As additional information becomes available, continuously update the three categories until notes in the leads and questions categories become as few as possible. Finding Money in Divorce Whether the client you are working with has a few assets or a complicated marital estate, the process of finding assets in divorce is essentially the same. Most hidden assets, investments, bank accounts, and extramarital relationship spending is found by keeping information organized and analyzing financial transactions. Understanding the role of an expert versus consulting forensic accountant in divorce cases is vital to creating value for the client and your case. • Hire an expert forensic accountant when calculations need to be made or business accounting records need to be reviewed. • Hire a consulting forensic accountant as a factfinder when the marital estate involves a lot of assets and accounts. This can sometimes become an expert engagement down the road. • Be the factfinder, or empower your client to track down facts, when they suspect hidden assets or understated income by following the steps above.

BAR CENTER IMPROVEMENT PROJECTS

The Foundation continues to invest in the Bar Center with upgrades, improvements and repairs. The parking lot has been repaired, sealed and repainted. New parking barriers were installed along 15th street and new signage has been added. Metal fencing was added along the north wall and cedar fencing was added to the east facing wall and denies easy access to the roof of the Trainers building. An alarm and lighting was also installed on the building that will be triggered if accessed during non-business hours. Unfortunately the building was tagged with graffiti again early this spring but due to the previous preventive measures completed by TCBF, this round was easy to remove. The new fencing and alarm measures should stop further vandalism.
