Change is an inevitable fact of life. As friends and customers of Suhn Cattle Company over the past 29 years, you are probably wondering how this change of the sale moving to Chimney Rock Cattle Company in Concord, AR will affect you. I can assure you that Bill Davis and his manager, Derrick Miller; plus, the rest of their crew will do everything in their power to make this transition as seamless as possible.
As we sorted through the bulls on Monday the 6th of February the bulls had been through about 10 days of wet weather with freezing rain. Roberto Velazquez, the Bull Development Manager at Chimney Rock, had done his part and more to get the bulls to that stage in the best condition possible with the weather conditions he was dealt and the bulls weathered the storm very well.
You have my assurance that these are the same bulls that would have ended up at Eureka, KS had Vicki and I not made the decision to slow down a bit and disperse our cow herd. As Cody and I sorted through the bulls it became evident to me that they were the best disposition set of bulls we had ever sorted on and as we got into the bulls further, I was convinced that top to bottom they were the best set of bulls we had ever offered to the public in my 29 years. These bulls excelled not only from a phenotypic design and structure but also from a performance and EPD standpoint. They represent the passion and dedication the GENEPLUS partners, as well as our cooperators, have for providing you, our customers, with the best possible genetics to stay viable in a most challenging industry.
Yes, the sale location is different but Bill and Gail Davis, Derrick Miller, Cody Gariss and myself along with the rest of the G+ team will be available to answer any questions you may have concerning this offering. We will be offering free delivery back to Eureka, KS for pick up at Suhn Cattle Co. as well as other GENEPLUS partner ranch locations. If you cannot attend the sale, we are available to discuss the cattle with you and make any recommendations or help you select a bull that will best fit your program. We look forward to visiting with you prior to the sale and assisting you any way we can.
The entire GENEPLUS team, Partners, Genetic Partners plus all the crews want to invite you to our 1st Spring Bull and Commercial Female sale at Chimney Rock Cattle Co. While this sale will be the first spring sale at Chimney Rock it is far from the first for this group. As many of you are aware, Chimney Rock was fortunate enough to purchase the Suhn Cattle Co. herd, moving the cattle to our ranch in Arkansas. As part of the acquisition Randy and Karen Schmidt of Schmidt Farms, Simms, TX also acquired the fall calving two-year olds and and Nic and Chasity Cornelison, Lake Majestik Farms purchased the Jack Moore herd. Following these purchases, the decision was made to feed all bulls at Chimney Rock and also move the spring sale to Concord, AR. Please be assured that the cattle being offered at this sale are the same group that would have been presented at the Suhn Cattle Co. facility in Eureka, KS – same ELITE bull offering, same TRUSTED cattlemen behind your purchase – just a NEW address for sale day.
When we sorted the bulls a few weeks ago, Vern made the comment that this was the best set of bulls top to bottom that we have ever presented to the public, and that is quite a statement when you look at the many herd sires that have come through the March sale at Suhn Cattle Co. We continue to assess the beef industry and strive to breed bulls built for the market and those that will work coast to coast and border to border. Our genetics are built to work in a multitude of environments. Our proof is that we have sold bulls to satisfied customers in more states than any other Brangus breeder. Be watching for the videos that will be available the beginning of March. Study the catalog, the videos and give any one of us from the G+ team a call if you have any questions.
This will be the largest set of commercial females that GENEPLUS has offered in the spring but be assured they will be just as fancy as what you have become accustomed to in the fall sale. The partners and our customers continually select cattle out of their programs that are the right kind to go home with you and get right to work.
In closing, let me once again invite you, on behalf of Gail, Derrick, Justin, Berto and all of the GENEPLUS group to come see us on the 4th Tuesday in March for some good fellowship and a set of cattle that we are very proud to offer for your consideration. We greatly appreciate your support and interest in our program.
This year GENEPLUS will host the 30th year of the Suhn Cattle Company sale at Chimney Rock Cattle Company in Concord, Arkansas. This is a sale with a history of producing BREED LEADERS and this year will be no different. In 2022, Vern and Vicki Suhn of Suhn Cattle Company sold their outstanding herd to Bill and Gail Davis, Chimney Rock Cattle Company, Randy and Karen Schmidt, Schmidt Farms and Nic and Chasity Cornelison, Lake Majestik Farms purchased the Jack Moore herd allowing the GENEPLUS partners to continue the Suhn Cattle Company and TJM Ranch legacy’s.
Chimney Rock is honored to host the ELITE bull sale the 4th Tuesday of March at the ranch in Concord, AR.
In order to best serve our customers, we will offer free trucking to GENEPLUS Partner Ranches at no expense to
the buyer. It is our goal that having these central drop points will allow buyers the opportunity to pick up their cattle closer to home if unable to haul them from the sale, or if buying online or sight unseen. If there is trucking needed beyond the specified drop point the expense will become the responsibility of the buyer at that time but GENEPLUS will be happy to facilitate further arrangements if needed. Prior to sale day we will have days assigned and times given for cattle to be picked up at each ranch location. If cattle are not picked up on the specified days, they will be maintained at the ranch for a nominal fee to cover feed and health expenses.
If you would like to visit about this option further, please call Cody, Vern or the GENEPLUS office.
The ability to survive within any industry requires great minds, plans, effort, capital, and a little bit of timing and luck. But we want our customers to do more than survive - we want them to thrive. At GENEPLUS, we understand the importance to adjust and adapt our process in order to stay one step ahead of the industry. We are the brand daring to break the mold. The breeders within GENEPLUS are partners by choice, not by chance. They made that choice because they vowed never to be satisfied with the status quo and adopted a model to build the best Brangus and Ultrablack bulls the world has ever seen.
The GENEPLUS focus on balance of performance and carcass merit, importance of genomics and EPD’s, emphasis on structure, foot design and fertility, and attention to a correct and industry accepted phenotype and sheath design, has led to a population of Brangus and Ultrablack cattle that is unlike any other. The notion that heat tolerance and durability are highly correlated to the increased amount of sheath or ear an animal possesses is as unrealistic as the belief that Brangus cattle can’t quality grade with Angus because of the Bos Indicus influence. Similarly, the notion that you have to receive discounts because of your “ear”
in the Midwest and West is also genuinely false, and we have disproved all of these things through our customers’ experiences via our breeding program.
The key to overcoming these misconceptions is a focused and dedicated selection process. At GENEPLUS, we understand what the end goal needs to look like before we mate and make the next generation. You can use an Ultrablack in the Gulf Coast region if you choose, with the same or more success than a Brangus with a #3 sheath. You can also use a Brangus or Ultrablack bull in Missouri on fescue, sell the progeny to a Northern feedlot and top the market - it’s all about the selection process and knowing and understanding your environment.
The good news is that we have the experience and genetic toolbox to accomplish these goals and more. If you’re trying to maximize the return on your cowherd, you’re in the right place. We sell more bulls to more states than any other Brangus and Ultrablack breeder in America for one reason – because we built a product unmatched by any of our competitors. DARE TO BE DIFFERENT.

Cattle will be available for load out immediately after the bull sale and proper settlement has been made on purchases. If you wish to loadout on Wednesday or at a later date please note that when you check-out. Arrangements can then be made to have your cattle ready when you arrive.
You can save shipping and handling charges by picking up semen that you will need for your spring breeding season at the Chimney Rock Cattle Company Sale. Representatives from either GENEPLUS or Integrated Breeders will be available sale day to fill your orders. We would ask that you keep your orders to goblet increments of 5’s or 10’s so that we can avoid excessive handling of semen. Please contact GENEPLUS at 1-877-436-3877 to place your order prior to the sale to assure we have enough semen on hand and available sale day.
The cattle will not sell in numerical lot order. We will have a printed sale order prior to the sale. Please note that the bulls and commercial females will be presented on video.
Any animals that are confirmed as carriers of a genetic condition such as DD, developmental duplication, will be listed above their pedigrees as DDC. Any animals we are still waiting test results on will be listed DDPC. All other animals have been either confirmed free of known genetic conditions by test results or from pedigree analysis.
We are extremely dedicated to providing our customers the genetics needed to positively impact their bottom line. As the motto of GENEPLUS states, “A Step Ahead. The Advantage You Can Trust”, we take very seriously the process of collecting phenotypic information and understand its fundamental importance and the role performance information and proper contemporary grouping play in providing the breed association with the most correct and current information possible, which in turn impacts the EPD’s you see directly. We will never compromise the integrity of our data.
All of the weights in this offering were taken by a scale, no tapes or windshield guesses. The ultrasound information reported to IBBA was all taken by Donnie Robertson to provide consistency of measurement across the program. In addition, these cattle have had DNA pulled and submitted to verify parentage and establish their genomically enhanced EPD’s and the status of their genomically enhanced EPDs is denoted in each catalog lot in the top right hand corner as to whether that information was back prior to the catalog deadline.
The industry has changed over time and a process which was once dominated by visual appraisal, then performance testing and contemporary grouping now has the ability to roll all of the information into a scope of genomically enhanced EPD’s. This gives the customer a tremendous edge in the accuracy of EPD’s and the assurance of parentage, thus dramatically improving the selection process for the future of their ranching enterprise. We encourage you to utilize these tools. For your convenience we have listed the current non-parent Brangus average EPD’s in this catalog for reference and comparison on how an individual compares to the average of the breed in any trait.
All bulls selling in this sale have passed a thorough and stringent BSE (Breeding Soundness Evaluation) by Dr. Craig Fontenot of Town & Country Animal Clinic. Each bull selling has passed Dr. Craig Fontenot’s tests and is considered a satisfactory potential breeder. All bulls are
guaranteed as breeding bulls through the first breeding season from the date of purchase. Please keep in mind that we expect the bull (s) to be treated with proper animal husbandry and that they are young bulls and require some additional management compared to mature bulls. Proper management should include the following requirements: 12 to 15 month old bulls at time of sale are utilized in a ratio of one bull to 15 cows and 16 to 20 month old bulls one bull to 20 cows. Furthermore, if these requirements are not adhered to or these bulls are placed in service or are housed until time of service with mature bulls then GENEPLUS will not stand behind this breeding guarantee.
If a problem does arise please contact GENEPLUS, Cody Gariss 417-4250368 or Vern Suhn 620-583-3706, as soon as any question occurs as to a bull’s breeding soundness. GENEPLUS will evaluate the problem, consult with a veterinarian if needed and if replacement is required will replace with a bull of equal quality. If a replacement bull is not available GENEPLUS will issue a credit for a future GENEPLUS sale. Please contact us before shipping any bulls. Shipping an animal you feel is unsatisfactory before contacting GENEPLUS will void our guarantee. In an effort to simplify the guarantee and credit process, cull salvage value within this guarantee and credit process moving forward is figured at a standard $1500/head.
This is a partial breeding guarantee and is not designed to mirror that of an insurance policy to stand death loss, debilitating physical injury, etc. If full morbidity or mortality coverage over and above this GENEPLUS breeding guarantee is desired we encourage you to contact Marcus Creasy, Adams & Creasy Insurance, at (501) 206-2281.
CRC will work with customers on delivery of cattle in an effort to have the cattle delivered to customers as soon as possible after the sale. However, if you are not ready for the cattle at this time we will maintain the cattle at the ranch for a period of time until you are ready for them. A nominal fee of $5.50 per day will be charged plus any veterinarian charges incurred will be billed. Cattle will be maintained on a growing ration in grass traps. Cattle become the buyer’s responsibility immediately after the sale. CRC or GENEPLUS is not responsible for insurance costs or death.
At the conclusion of the sale or as soon as possible following the sale if purchases are made via video or sight unseen agreement; please notify the sales staff as to specific instructions about cattle delivery. If you request our assistance the GENEPLUS staff will make every effort to help coordinate the most reliable and economical trucking available. We will offer free trucking to GENEPLUS Partner Ranches at no expense to the buyer. If there is trucking needed beyond the specified drop point the expense will become the responsibility of the buyer at that time but GENEPLUS will be happy to facilitate further arrangements if needed. If you do not wish to have your purchases delivered to one of these locations then trucking expense will be the responsibility of the purchaser. If you prefer to make your own arrangements Gary Tharp, Dixie Grove Trucking will be available sale day to discuss your needs or we can place you in contact with other reliable truckers.
Please note that the animals you purchase become your responsibility at time of purchase. GENEPLUS and/or the individual breeders represented are not responsible for animals that may be injured in transport. Third party insurance coverage is available for those who are interested with Marcus Creasy, Adams & Creasy Insurance, at (501) 206-2281.

Please make note that many of the animals were in different contemporary groupings at weaning; therefore, it is not fair to compare birth, weaning and yearling weights from one herd to another.
Expected Progeny Difference (EPDs) is the best estimate of an animal’s genetic merit for a particular trait. It takes into account the animal’s own performance compared with its contemporaries and the performance of it’s relatives compared against their contemporaries.
Birth Weight (BW) EPD predicts calf size and calving ease.
Weaning Weight (WW) EPD predicts preweaning growth potential.
Yearling Weight (YW) EPD predicts overall growth potential.
Milk EPD predicts the maternal contribution to weaning weight of the calf through milk production, behavior, immunity and other maternal environmental factors.
Scrotal Circumference (SC) EPD predicts not only testicular size of male progeny but also daughters onset of puberty.
Ribeye Area (REA) EPD predicts total muscle.
Intramuscular Fat (IMF) EPD predicts % of intramuscular fat which is highly correlated to marbling.
TERMINAL INDEX (TI) is a bio-economic index which considers six growth and carcass-related traits, each trait weighted according to its heritability and economic importance in a feedlot situation with carcasses valued by weight, yield, and quality grade. The value is expressed in standard deviation terms, which can be difficult to comprehend. IBBA advises breeders to evaluate the percentile rank rather than the actual index value.
FERTILITY INDEX (FI) is a bio-economic index which considers six traits, each trait weighted according to its heritability and economic importance in a cow-calf enterprise. The value is expressed in standard deviation terms, which can be difficult to comprehend.
IBBA advises breeders to evaluate the percentile rank rather than the actual index value.
HEIFER PREGNANCY (HP) is reported in percentile units and represents the probability of a sire’s daughters becoming pregnant during their first breeding season compared to daughters of other sires.
STAYABILITY (ST) is reported in percentile units and represents the probability that a cow will have five consecutive calves compared to her yearling contemporaries.
Individual performance data is provided as supplementary information as EPDs provide more reliable evaluation of genetics differences of animals.
Actual Birth Weight (BW) are reported.
Scrotal Circumference (SC) is adjusted to 365 days
Brangus EPDs are calculated by the Livestock Genetic Services and are part of a program called the National Cattle Evaluation (NCE).
Individual ranking relative to the entire breed population on a specific trait, represented in the form of a percentage, with 1% being best and 99% being worst.
Sire parentage has been verified and GE-EPD’s will be available March 1st

They are the top cut from our late fall bulls primarily born after October 1, 2021. None have been taken off the top. Handled with longevity in mind these bulls were developed steadily across their growth curve, not pushed and over fed to gain unnecessarily and become over conditioned. Semen checked and ready to go to work, they have been on a controlled and steady incline since weaning, and you will find them in tip top shape for turn out.

An almost impossible task of finding a quartet of traits as this young herd sire possesses all wrapped up into one incredibly formidable package that some would say defies that it can be accomplished. Calving ease genetics with top tier growth, end product dominance; plus, reproductive efficiency all rolled into one. Your search is over. Add to his numerical predictions a phenotype that expresses sturdiness of design with an abundance of rib shape, thickness of top line and rear quarter expression while still standing on an abundance of bone with a correct foot design. He started life with an 84 lb. BW to ratio 99 and went on to record an AWW of 785 lb. to ratio 117. There was no backing off at yearling as he logged a phenomenal AYW of 1325 lb. to ratio 112, an AREA of 15.04 to ratio 108 and a respectful AIMF of 5.12. But that does not end his supremacy as he ranks in the Top 25% of the breed
or higher on 12 economically relevant traits. He is at the top of the breed for WW at 1%, followed closely with a Top 2% TM, Top 3% SC & TI, Top 5% YW, Top 10% CED & REA. Three traits make the Top 15% for BW, IMF & HP along with Top 20% STAY & Top 25% ranking for NC, and a 5 STAR DISPOSITION. From there we move to his extraordinary dam who has done what cows are supposed to do - calve as a 2-year-old and do so every 12 months. She raised this lot as a 4 year old and currently has 3 progeny recorded a ABWR of 98.7, AWWR of 110 and an AYWR of 103. A UB1 daughter, she exemplifies the type of cow you would want your herd sire to be out of. His sire Masterpiece needs little introduction as he sired the $72,000 Suhn’s Triple Crown 416J39 who topped the fall 2022 sale at Chimney Rock selling to American Cattle Enterprises. Selling 2/3 semen interest and full possession. Chimney Rock Cattle will retain 1/3 semen interest.

His sire, Currency, needs little introduction to the breed. He is a widely used AI sire and has more than proven his value as a solid calving ease sire whose offspring still have the performance to compete with the power bulls when you look at pounds delivered at weaning. This lot does not reflect his sire’s capacity as far as calving ease; however, he more than makes up for it with his own stats for performance and EPD rankings. From the maternal side his dam did an exceptional job as a first calf heifer and his grandam 53C6 is a full sister to the 53D2 donor that sold through the fall 2022 sale at Chimney Rock to Genesis Ranch, Mike Weathers for $35,000. As each year moves forward the 53 cow family proves that it was a good decision when Suhn’s purchased the TO53 Angus cow from Bradley 3 Ranch in Texas. However, this lot does not have to rest solely on ancestral laurels. He

started life with an actual 86 lb. Pedigree, performance + DNA combine to project a ranking for WW and YW in the upper 2% of the breed, Top 4% for TI and Top 5% TM. He also ranks in the Top 15% for REA & HP, Top 20% for IMF, STAY, and BB, with a 4 STAR DISPOSITION. Trail Boss has certainly found his nitch the past several years in the Brangus breed. He now records over 480 progeny and has done a superb job when used on both Brangus and Ultrablack females. His daughters make exceptional females, and his outstanding son Masterpiece is now taking second seat to his sons that are making their own mark on the industry. When you critique his phenotype and structure, he leaves little doubt that he needs to be propagated within this industry. As you appraise this bull and evaluate the expression of muscle down his top and through his rear quarter, his massive depth and spring of rib, correctness of foot and leg structure and the way he strides out with authority and confidence of presence, one is reminded again that it takes more than just high IMF readings, big ribeyes and lots of pounds to keep us viable in the beef industry. He does not
come by this by mistake as his cow family heritage through the Bradley 3 program in Texas was patterned around cattle that could survive and reproduce under harsh environmental conditions. The sire line developed at Suhn Cattle Co. had much of the same requirements in that if there was a place for Brangus in the north they had to be bred to thrive and survive under those conditions. 53K7 has a 5 STAR DISPOSITION and ranks in the Top 10% of the breed for SC & HP, Top 15% for WW, IMF & TI, Top 20% for YW, TM & STAY plus the Top 25% FI. His dam is another standout Foundation daughter who is a full sister to 53D2 and the grandam of 53K. He has the credentials to write new chapters in Brangus history. Selling 2/3 semen interest and full possession. Chimney Rock Cattle will retain 1/3 semen interest.

Analyzing this lot’s data, it is quickly apparent that he is an outlier for calving ease with his projections in the Top 4% for both CED and BW. Phenotypically you quickly become impressed with his stature. From the ground up he stands on exceptional bone, is wide based in his structure both from the front and rear, lays in neatly through his shoulder, is boldly sprung through his ribcage, possess excellent dimension down his top line and carries it into a quarter that ties deep into his hock with exceptional thickness through the center section of his stifle. Great 5 STAR DISPOSITION with rankings in the Top 10% for YW and STAY, Top 15% for WW and TI, Top 20% REA and NC, Top 25% FI and BB, plus the icing on the cake with a Top 4% HP and Top 5% SC. All this plus a lineage of Signal, Trail Boss and the 102 cow family who is rewriting history for the Gariss family. Yes, all this adds up to more than
just a calving ease bull, but rather one that has the genetic prowess to have a big impact on our industry. However, before you shut the gate on his pen, we already know the first question you will ask. Is he big enough? From our perspective the Brangus breed picks up great attributes from both parent lines. One disadvantage from Brahman genetics is the longer extended growth and maturity patterns. Much of the basis behind Ultrablack was to control that with Angus genetics to make our cattle more sustainable. You can skip the Angus step with herd sires like this. Yes, we definitely think he is big enough. Selling ½ semen interest and full possession. Lake Majestik Farms will retain ½ semen interest.

Masterpiece strikes again with this individual that projects top tier growth and carcass EPDs and backs it up with actual performance numbers that totally overshadowed his contemporaries. His three-year-old Epic sired dam did not disappoint with her second calf. He recorded a commanding AWW of 760 lb. to ratio 117 and continued down that path with an AYW of 1367 lb. to ratio 112. Ultrasound readings were also off the charts with an AREA of 15.67 to ratio 111 coupled with an AIMF of 6.52 to ratio 123. Daughters of Epic have done us a tremendous job and this one is no exception. They just do an awesome job of raising their calves - solid practical females that are functional and appear to be in it for the long haul. The 918 cow family has not had a lot written about them nor have they received a lot of press. Just a hidden gem tucked away in the Flint Hills of Kansas waiting for their time to flourish. We talked earlier about 918K4’s performance credentials and he backs them

up with an EPD profile that ranks him in the Top 15% or higher on 11 traits and he has a 5 STAR DISPOSITION. Top 1% for WW, YW, TM & TI; Top 3% REA; Top 10% SC, IMF & HF and Top 15% for STAY, FI & NC. Is there more to him than just big performance and high EPDs? When you view him from behind and analyze his strength of top and dimension of quarter he expresses the muscle his ultrasound reading predicts. His ample bone, tremendous length of body, spring of rib, extension through his front end and the smoothness of how he is laid in through his shoulder makes him one you gravitate to when you walk into the pen. He deserves your attention. Buyers option. A. Selling 2/3 semen interest and full possession. Chimney Rock Cattle will retain 1/3 semen interest. OR B. We hear more talk and press daily about functional, sustainable cattle. The quest for top tier growth and carcass has the potential to be detrimental to sustainability through reduced maternal function. We have always admired the Tradition daughters because of their low maintenance requirements while still raising some of the biggest calves in the pasture. The right cow is an important part of a herd sire’s credentials and this lot’s dam would be at the top of anyone’s list after viewing the entire cowherd at Chimney Rock. She has proven herself as a donor. She is currently nursing a bull calf by Data Bank that is one of the best you will find in the pastures at CRC and her first daughter as a two-year-old is also a donor. 919K21’s sire, Signal, is recognized as one of the most elite calving ease bulls in the breed
and his sons and daughters are commanding more attention daily. This lot follows in the footsteps of his sire with an incredible calving ease package ranking in the Top 10% for BW and Top 20% CED coupled with that same ranking for WW and YW growth. His Top 3% ranking for HP, Top 15% for STAY and Top 25% rank for REA TI, FI, and NC. EPDs that combine to project increased sustainability for his offspring. As you evaluate this young prospect in the pen you would not consider him a calving ease bull. He is bolder in his dimensions and more rugged in his shape and design than you would expect from one with his genetic profile. He handily marks all the boxes to have a great future as a breeding bull with a 5 STAR DISPOSITION Selling 2/3 semen interest and full possession. Chimney Rock Cattle will retain 1/3 semen interest.

The GENEPLUS partners, as well as our commercial customers that have consigned females to this offering, continually strive to offer the industry the highest quality and most genetically superior commercial females available. We utilize the majority of tools available to us such as AI’ing to the most genetically superior calving ease bulls, the utilization of genetics that have been parent verified, many of which have genomically enhanced EPD’s, plus data compilation and transfer to the IBBA from birth to weaning to more accurately identify the lineage of the genetics behind this offering. We do, however, in no way
quantify the progeny of these commercial genetics to be kept as intact males for use as sires in the industry. We are definitely proud of what we are offering, and without a doubt feel they are an asset to generate increased productivity for the programs purchasing them. It is our belief that for the beef industry to stay competitive with the other protein sources available that the male progeny from this genetic pool being offered do not meet the standards necessary to move our industry forward to use as breeding bulls and should be made steers as we intended.
Heifers will be penned at the sale site in pens ranging in number from 10 to 25 head. We will video the cattle as a pen and will show that video as that pen of cattle is being sold. The cattle will not be run through the ring but as stated earlier most can be viewed at the sale site prior to the sale in their pen. We will produce a sale order for cattle selling and each pen will be split into several groups. As each pen comes up for sale we will sell the first group and the
winning bidder will have, at the discretion of the sale personnel and auctioneer, the right to purchase the next group of cattle in that pen and each succeeding group of cattle in that pen until that pen is sold. If the purchaser does not take the option to buy the next group of cattle that group will be sold and, at our discretion, that buyer will be given an option until that pen is sold and we proceed onto the next pen of females.

Each animal will be sold to the highest bidder. The auctioneer will settle any disputes as to bids and his decision on such matters shall be final.
Each animal becomes the risk of the purchaser as soon as sold, but it shall be the obligation of the seller to see that animals are fed and cared for, until loaded for shipment or until the expiration of 48 hours after the sale, whichever occurs first. After 48 hours a maintenance fee of $5.50 per day will be assessed until pickup.
All sales are for cash unless satisfactory credit arrangements have been made with the seller or GENEPLUS prior to the sale. Payment must be made within 30 days of the sale date. Parties not adhering to said settlement terms will be assessed a nominal interest charge by GENEPLUS.
Buyers may purchase cattle through GENEPLUS personnel at auction or private treaty without viewing the cattle. For sight unseen purchases, the buyer has the right of inspection at the time of delivery. If the animal is deemed unsatisfactory, it may be reloaded on the delivery truck at no obligation to the buyer. All transportation expenses will be the responsibility of GENEPLUS. If the purchaser is unable to view the animal upon delivery that purchaser would have one week to deem the animal as unsatisfactory. In this instance the buyer may, at their expense, return the animal to GENEPLUS for a refund of the purchase price. DVAuction purchases do not fall under this guarantee.
A transferred certificate of registry will be furnished to the purchaser for each registered animal within 45 days of proper settlement.
Interstate health papers suitable for interstate shipment will be furnished on all animals as required by federal and state regulations.
Any changes from the information of any kind in this catalog will be provided in a sale day supplement sheet or announced from the auction block and such information shall take precedence over cataloged information.
1. The seller guarantees all animals to be breeders with the exception of:
a) Calves under 12 months of age at the time of sale;
b) animals shown by purchaser after sale in which the breeding
guaranteed (if any) shall be agreed upon between the seller and the buyer;
c) animals who suffer injury or disease following the sale;
d) animals subjected to gross negligence by willful misconduct on the part of the purchaser.
2. The seller guarantees that all bulls are breeders for a period of 90 days following the initial turnout date with buyers’ herd as long as this occurs within 60 days of date of sale. Or in the case of a bull purchased in the fall and not used until spring or vice versa they will be guaranteed for the 90 days from that first date as long as bulls have been kept in good condition and not run with other older mature herd bulls. This only applies to bulls that are at least 12 months old at time of sale and have not been allowed to run with the herd until at least 14 months of age. Seller does not guarantee death loss or injury.
Any bull which settles cows by natural service and passes a fertility test made by competent veterinarians, mutually agreed upon by buyer and seller, during any six-month period of trial (provided for in paragraph 2 of the section of these sales terms and conditions entitled “Option and Privilege of Return and Adjustment”), shall be considered a breeder unless otherwise agreed by the buyer and the seller. The seller makes no guarantees with respect to the bull’s ability to freeze semen.
3. Cows with calves at their side are presumed to be breeders with no further fertility guarantee.
4. “Safe-in-calf” females are guaranteed by the seller to have been examined by a competent veterinarian or reproductive technician and determined to be safe-in-calf by examination or other proven method (e.g., ultrasound, pregnancy blood tests, and rectal palpation).
5. Exposed females are not guaranteed to be with calf.
6. “Open” females are guaranteed by the seller to be without calf.
7. Donor females:
a.) Unless otherwise agreed by the buyer and the seller, a female that has been used in an embryo transfer program is not guaranteed to be a breeder after the date of the sale.
b.) Unless otherwise agreed by the buyer and the seller, a female is not guaranteed to be a breeder after the date of the sale, when that female is to be used, or attempted to be used, in an embryo transfer program.
c.) Virgin, open heifers that are placed in IVF or conventional embryo transfer prior to being confirmed bred will void any seller’s guarantee of breeding or embryo production.
8. The seller makes the following guarantees with respect to all “pregnant recipients”: (i) that the female is pregnant, (ii) that the resulting calf is of the pedigree represented, and (iii) that the resulting calf is of the sex represented (if so represented).
1. Unless otherwise agreed by the buyer and the seller, with respect to the sale of semen the seller makes no guarantees with respect to the performance or characteristics of such semen and the buyer is purchasing such semen “as is.”
1. Embryos being offered for sale will be sold “as is” unless the seller provides additional guarantees.
1. With the exception of any applicable transportation expenses described herein, a seller shall never be liable to a buyer for an amount greater than the original selling price of any animal sold under these Sales Terms and Conditions.
2. Unless otherwise stated, all claims for adjustment or refund must be made in writing to GENEPLUS within 180 days following the sale of the animal in question.
3.If an animal is claimed to be a non-breeder, the animal may be returned to the seller if it is in good condition and complies with the health requirements of the seller’s state. At the option of the buyer, the seller may issue a credit to the buyer for use in a future purchase or provide an animal of equal value subject to the approval of buyer. If the buyer exercises either such option, the claim shall be deemed fully and satisfactorily resolved. The seller does have the option on any animal’s claimed to be a non-breeder that the buyer, at his expense, return the animal to the seller and the seller has 180 days from the date the animal is returned to the seller’s ranch to conduct a trial to demonstrate the returned animal is a breeder. If the animal is confirmed to be a breeder during the test trial this shall be deemed full satisfaction and settlement of the claim. Any expense incurred for transporting an animal claimed to be a non-breeder will be the responsibility of the buyer.
4. If a female sold as “safe in calf” proves not to be in calf, the seller must make a satisfactory adjustment on the purchase price to the buyer or, at the buyer’s option, either credit can be given for the purchase price of the female or a satisfactory animal agreed on by both parties to replace original female. Any claim for adjustment under this paragraph must be made in writing to GENEPLUS within 60 days of date of sale.
5.If a female represented as “safe in calf” to a certain bull at the time of sale proves to have been bred to a different bull, the seller must make a satisfactory adjustment on the purchase price to the buyer. Any claim for adjustment or refund under this paragraph must be made in writing to GENEPLUS on or before the first anniversary of the date of sale.
6. If a female sold as “open” proves to be with calf, the buyer may return the animal to the farm of the seller prior to calving for a credit of the full purchase price or for another animal of
equal value, whichever is acceptable to the buyer. The Seller is responsible for all transportation expenses.
7. If an animal (including the offspring of a pregnant recipient) is sold and through parentage verification is proven to have incorrect parentage, as represented by the animal’s certificate of registration and for which correct parentage can be determined, the seller is obligated to make satisfactory adjustment on the purchase price only to the buyer or, at the buyer’s option, credit the purchase price upon the return of the animal to the farm of the seller. Any claim for adjustment or credit under this paragraph must be made in writing to GENEPLUS on or before the first anniversary of the date of the sale. Those animals upon which parentage verification has been recorded with the IBBA will be so noted in the sale catalog or in a supplement sheet. At time of purchase it becomes the buyer’s responsibility to adhere to the rules of the IBBA regarding parentage verification for animals used for semen and embryo production.
8. If the resulting calf of a pregnancy is not of the sex represented at the time of the sale, the seller is obligated to make a satisfactory adjustment on the purchase price to the buyer or, at the buyer’s option, credit the purchase price upon the return of the animal to the farm of the seller. Any claim for adjustment or credit under this paragraph must be made in writing to GENEPLUS on or before the first anniversary date of the sale.
9. Unless stated otherwise, all transportation expenses incurred will be the responsibility of the buyer, except that the seller will be responsible for transportation costs in excess of the distance between the buyer’s farm and the location where the sale took place.
The above terms and conditions of sale shall constitute a contract between the buyer and seller of each animal and shall be equally binding upon both. Other than the guarantees and warranties stated above, no other warranties or guarantees are expressed or implied. Each sale or resale of an animal constitutes a separate transaction.
Neither GENEPLUS, the ranch the sale is being held on, nor any other sale consultant or persons connected with the management of this GENEPLUS sale, assumes any liability, legal or otherwise.
