COMMERCIAL FEMALE SALE

IMMEDIATELY FOLLOWING

Friends and Fellow Cattlemen,

Everyone connected with GENEPLUS wants to thank you for taking the time to view our catalog and considering the offering. Since the inception of GENEPLUS we have had a goal of being the best seedstock provider possible, with quality from end to end. I am more excited about the cattle being offered in this sale than ever before. Through the shared vision carried by each of the partners and their staffs, we have continued to raise the bar of quality, which for us is far more important than quantity. Our breeding, selection and culling process is second to none, and it helps when you have a hall of famer like Vern Suhn in your lineup. We are so appreciative of his willingness to stay involved in this program and the major contributions he has made to this breed over the last 40+ years, making it better every single day. I also want to thank the CRC crew – Derrick, Justin, Roberto, Ricardo and Chumo for their endless dedication to this ranch as well as the GENEPLUS partners and cooperators for their hard work and contributions. It is truly a team effort.

As you have grown accustomed to, the Registered Females come from the top end of all the partner herds and studying the catalog you will recognize the best of the best. Proven producers, fresh genetics, it is all there.

Please take a hard look at the bulls. We have listened to our customers and have built bulls that will work in any environment. They have the phenotypic look, the feet and legs that will stay under them for the long run, and the best disposition that I see anywhere. All that said, I think the EPD balance and tremendous across the board percentile rankings may be the most impressive. I would put them up against anyone’s. We have bred for balance, not extremes, and we have been rewarded more than I could imagine with tremendous consistency throughout the entire catalog by staying focused on our goals.

The catalog wraps up with the commercial offering you have come to expect. Don’t miss out on one of the best markets in history. The cow herd is not rebuilding in the nation yet, get in on the ground floor.

Look for the videos in the next few days. Please study your catalog and videos and call anyone with GENEPLUS for answers to your questions. We have volume discounts and multiple trucking options available to get you anywhere in the country.

In closing, I want to acknowledge Dr Wilkes, Joy Sundbeck and everyone who worked on the IBBA 75th Anniversary Gala. It was certainly an informative, memorable event that was enjoyed by all.

See you at the sale,

GENETIC CONDITION POLICY

Any animals that are confirmed as carriers of a genetic condition such as DD, developmental duplication, will be listed above their pedigrees as DDC. Any animals we are still waiting test results on will be listed DDPC. All other animals have been either confirmed free of known genetic conditions by test results or from pedigree analysis.

TRUSTED PERFORMANCE INFORMATION

We are extremely dedicated to providing our customers the genetics needed to positively impact their bottom line. As the motto of GENEPLUS states, “A Step Ahead. The Advantage You Can Trust”, we take very seriously the process of collecting phenotypic information and understand its fundamental importance and the role performance information and proper contemporary grouping play in providing the breed association with the most correct and current information possible, which in turn impacts the EPD’s you see directly. We will never compromise the integrity of our data.

All of the weights in this offering were taken by a scale, no tapes or windshield guesses. The ultrasound information was collected by David Aborn and processed through a certified CUP Lab prior to submission at IBBA.

The industry has changed over time and a process which was once dominated by visual appraisal, then performance testing and contemporary grouping now has the ability to roll all of the information into a scope of genomically enhanced EPD’s. This gives the customer a tremendous edge in the accuracy of EPD’s and the assurance of parentage, thus dramatically improving the selection process for the future of their ranching enterprise. We encourage you to utilize these tools. For your convenience we have listed the current non-parent Brangus average EPD’s in this catalog for reference and comparison on how an individual compares to the average of the breed in any trait.

PARTIAL BREEDING GUARANTEE

All bulls selling in this sale have passed a thorough and stringent BSE (Breeding Soundness Evaluation) by Dr. Craig Fontenot of Town & Country Animal Clinic. Each bull selling has passed Dr. Craig Fontenot’s tests and is considered a satisfactory potential breeder.

All bulls are guaranteed as breeding bulls through the first breeding season from the date of purchase. Please keep in mind that we expect the bull (s) to be treated with proper animal husbandry and that they are young bulls and require some additional management compared to mature bulls. Proper management should include the following requirements: 12 to 15 month old bulls at time of sale are utilized in a ratio of one bull to 15 cows and 16 to 20 month old bulls one bull to 20 cows. Furthermore, if these requirements are not adhered to or these bulls are placed in service or are housed until time of service with mature bulls then GENEPLUS will not stand behind this breeding guarantee.

If a problem does arise please contact GENEPLUS, Cody Gariss 417-262-1257 or Vern Suhn 620-583-3706, as soon as any question occurs as to a bull’s breeding soundness. GENEPLUS will evaluate the problem, consult with a veterinarian if needed and if replacement is required will replace with a bull of equal quality. If a replacement bull is not available GENEPLUS will issue credit in a future GENEPLUS sale. Please contact us before shipping any bulls. Shipping an animal you feel is unsatisfactory before contacting GENEPLUS will void our guarantee. In an effort to simplify the guarantee and credit process, cull salvage value within this guarantee and credit process moving forward is figured at a standard $1500/head.

This is a partial breeding guarantee and is not designed to mirror that of an insurance policy to stand death loss, debilitating physical injury, etc. If full morbidity or mortality coverage over and above this GENEPLUS breeding guarantee is desired we encourage you to contact Marcus Creasy, Adams & Creasy Insurance, at (501) 206-2281.

MAINTENANCE AFTER THE SALE

CRC will work with customers on delivery of cattle in an effort to have the cattle delivered to customers as soon as possible after the sale. However, if you are not ready for the cattle at this time we will maintain the cattle at the ranch for a period of time until you are ready for them. A nominal fee of $5.00 per day will be charged plus any veterinarian charges incurred will be billed. Cattle will be maintained on a growing ration in grass traps. Cattle become the buyer’s responsibility immediately after the sale. CRC or GENEPLUS is not responsible for insurance costs or death.

TRUCKING

At the conclusion of the sale or as soon as possible following the sale if purchases are made via video or sight unseen agreement; please notify the sales staff as to specific instructions about cattle delivery. If you request our assistance the GENEPLUS staff will make every effort to help coordinate the most reliable and economical trucking available. Trucking expense will be the responsibility of the purchaser. If you prefer to make your own arrangements Gary Tharp, Dixie Grove Trucking will be available sale day to discuss your needs or we can place you in contact with other reliable truckers.

Please note that the animals you purchase become your responsibility at time of purchase. GENEPLUS and/or the individual breeders represented are not responsible for animals that may be injured in transport. Third party insurance coverage is available for those who are interested with Marcus Creasy, Adams & Creasy Insurance, at (501) 206-2281.

Once again, Chimney Rock will be hosting the HBO program that Schmidt Farms has managed for many years. Since it’s inception, it has been well received by our customers who wish to have a higher percentage of their newly purchased heifers bred with known AI sires. The HBO program has worked particularly well for those breeders who, for whatever reason, may not be able to AI breed their heifers at home. The program has consistently had a high percentage of these heifers bred safe to known GENEPLUS AI sires. The HBO period lasts approximately 90-120 days, and for the $500 cost, the new owner is guaranteed a bred heifer, safe in calf, or a 100% credit for the original purchase price of the heifer, if we are unable to get her bred. So basically, you are guaranteed a bred heifer (or a credit) for an additional $500 over the cost of the open heifer you purchased.

• The HBO is available as an option, at buyers choice on any virgin, registered heifer {13 to 17 months of age} sold through a GENEPLUS sale. Lots that are eligible will be noted in the catalog as HBO ELIGIBLE.

• Heifers stay at Chimney Rock Cattle Company to be managed and AI bred to a GENEPLUS herd sire of the buyers choice. Cody or Vern would be happy to make breeding recommendations to the new owner, but the final decision will be left to the new owner.

• GENEPLUS pays for pasture, feed, mineral, normal vaccines, synchronization meds and parasite control as required. Semen costs will also be paid for if the buyer uses a GENEPLUS bull. A quality clean-up bull will be provided after AI is completed at no additional cost.

• Heifers will be managed similarly to the virgin heifers at Chimney Rock Cattle Company of the same age.

• The cost of this program is an additional $500 over the cost of the heifer. Settlement of this fee, along with the full purchase price of the heifer, must be made on day of the sale. Heifers will be moved to the breeding location at no cost to the buyer.

• When heifers are palpated safe in calf, they will be considered a breeder with no further guarantees from GENEPLUS partners or it’s cooperators. Registration papers will be transferred to the new owner when heifers are confirmed pregnant. If the heifer does not palpate pregnant the purchaser will be given, a credit for the purchase price only, which can be used in future GENEPLUS sales and does not include the $500 HBO cost, or the salvage value of the heifer.

• It is the buyers responsibility to pick up the heifers within 2 weeks of notification of palpation results. The arrangement for trucking from Chimney Rock Cattle Company to the customer’s ranch is the responsibility of the new owner and not GENEPLUS.

• GENEPLUS partners and cooperators are not responsible for death or any incurred vet expenses on any heifer in this program. We strongly advise the purchaser to purchase mortality insurance on heifers.

Customers who are considering the HBO are encouraged to discuss the details with a GENEPLUS member or sale representative prior to the sale. At the conclusion of the sale and after check out we encourage all customers who wish to enroll heifers in the HBO to visit with Derrick Miller or Bill Davis to work out all details, make sure we have all contact information, and to get any questions answered that you might have. Derrick Miller is more than happy to discuss prior results and details of the program. He can be reached by phone or text at 318-332-2341 or e-mail: derrickmcrc@gmail.com.

CRC BUSINESS LINE 53L29

Please make note that many of the animals were in different contemporary groupings at weaning; therefore, it is not fair to compare birth, weaning and yearling weights from one herd to another.

EPDS

Expected Progeny Difference (EPDs) is the best estimate of an animal’s genetic merit for a particular trait. It takes into account the animal’s own performance compared with its contemporaries and the performance of it’s relatives compared against their contemporaries.

Birth Weight (BW) EPD predicts calf size and calving ease.

Weaning Weight (WW) EPD predicts preweaning growth potential.

Yearling Weight (YW) EPD predicts overall growth potential.

Milk EPD predicts the maternal contribution to weaning weight of the calf through milk production, behavior, immunity and other maternal environmental factors.

Scrotal Circumference (SC) EPD predicts not only testicular size of male progeny but also daughters onset of puberty.

Ribeye Area (REA) EPD predicts total muscle.

Intramuscular Fat (IMF) EPD predicts % of intramuscular fat which is highly correlated to marbling.

TERMINAL INDEX (TI) is a bio-economic index which considers six growth and carcass-related traits, each trait weighted according to its heritability and economic importance in a feedlot situation with carcasses valued by weight, yield, and quality grade. The value is expressed in standard deviation terms, which can be difficult to comprehend. IBBA advises breeders to evaluate the percentile rank rather than the actual index value.

FERTILITY INDEX (FI) is a bio-economic index which considers six traits, each trait weighted according to its heritability and economic importance in a cow-calf enterprise. The value is expressed in standard deviation terms, which can be difficult to comprehend. IBBA advises breeders to evaluate the percentile rank rather than the actual index value.

HEIFER PREGNANCY (HP) is reported in percentile units and represents the probability of a sire’s daughters becoming pregnant during their first breeding season compared to daughters of other sires.

STAYABILITY (ST) is reported in percentile units and represents the probability that a cow will have five consecutive calves compared to her yearling contemporaries.

PERFORMANCE

Individual performance data is provided as supplementary information as EPDs provide more reliable evaluation of genetics differences of animals.

Actual Birth Weight (BW) are reported.

Scrotal Circumference (SC) is adjusted to 365 days

Brangus EPDs are calculated by the Livestock Genetic Services and are part of a program called the National Cattle Evaluation (NCE).

EPD PERCENTILE RANKINGS

Individual ranking relative to the entire breed population on a specific trait, represented in the form of a percentage, with 1% being best and 99% being worst.

Genomically Enhanced EPD’s

Sire parentage has been verified and GE-EPD’s will be available Oct. 1st

VALUE BUILT-IN

Since 2007 Chimney Rock has been the annual elite source of females in the Brangus breed. Not only have the cattle been consistently known for their quality, the revenue generating ability for their new owner(s) is literally countless. This offering is stacked with hand selected quality - cattle that will produce the bulls and females that the industry desires.

Not chasing fads or extremes, they are built for the long haul in every way. Study the lesson and the consistency and you will see what a defined and structured breeding plan will offer.

PICK LOT OPPORTUNITY

The story behind these two full sisters began at the 2016 South East Brangus Show Case Sale when their dam, who was consigned to the sale by Robert and Bonnie Mullican, W O Cattle Company, caught the attention of Nic Cornelison. Nic purchased this young Ultrablack female 70D1 and she would go on to spend the rest of her life at Lake Majestik. 70D1 was sired by an incredibly popular Angus sire, SAV International 2020, who was the high selling bull through the 2013 Schaff Angus Valley Sale for the then record price of $400,000. His progeny went on to be extremely popular not only here in the US but also internationally. 2020’s dam, a fifth generation Pathfinder daughter, who recorded an average weaning weight ratio of 104 on 8 calves sold through the 2016 SAV Female Sale for $250,000.

70D1 calved as a 2-year-old and her status within the Lake Majestik program continued to impress and in the spring of 2021 a son, LM Intrigue 70H, sold through the 2021 GENEPLUS@ Suhn Cattle Co. bull sale to Vern and Vicki Suhn and Jack Moore for $20,000. He has proven himself through his impressive progeny. 70D1 was later placed in embryo transplant and worked to several sires including Signal, Data Bank, Triple Crown, Ultimate, Wide Load and Currency until her untimely death in 2023.

Sale day November 1 will offer a breeder the unprecedented opportunity to select one of these heifers to add to their program. Only one other heifer has been sold from the LM herd out of this great dam. In 2022 a Signal daughter was purchased for $9500 at the GENEPLUS@CRC sale. However, in our opinion, these heifers are in a league of their own. Both are sired by Signal, who is leaving a lasting

legacy through his daughters, and has several sons and grandsons who are doing a tremendous job of breeding. As you study these two lots for those who were fortunate enough to see the 70D1 female we think you will see some striking similarity between them and their dam. Both are big bodied, big ribbed, big hipped with an abundance of thickness down their top line and through their quarter. They stand on an ample amount of bone with excellent width of chest, clean, neat underline and excellent foot. 70D1 was an exceptionally easy fleshing female as are the Signals and these heifers exhibit those same qualities. We have covered their excellent phenotype but their geneotypic projections are equally impressive. They rank in the top 20% for calving ease, the top 10% for WW, YW and REA ending up with a combined terminal index in the top 15%. Add to that a HP Index in the top 1%, Stayability index in the top 5%, and an overall fertility index in the top 20%. Some may question that their IMF ranking is only in the top 50% of the breed but do not let that worry you as these are the type of females needed to make most high IMF bulls relevant. Opportunities like this do not present themselves very often in the purebred genetics marketplace. And please do not be sitting in the seats thinking that they will sell the one and then they will sell the other. It was hard enough convincing Nic to let one go so there is no way he is selling both. If what we have talked about so far you still have some doubt as to the genetic merit of this cow family turn in your catalog to the highlight yearling bull Lot 231/70L10 who is a Triple Crown back to the same dam. CONSISTENT REPRODUCTIVE PERFORMANCE

If an award were to be given for consistency of production this female’s pedigree contains two candidates that should be nominated for that award. Her sire, Tradition, stands in his own league as a sire that has consistently left a set of daughters in the herd that were fertile, functional, moderate sized with super udder attachment. The cowman’s kind of female. Likewise, the 919 cow family has been a model cow family when it came to producing the right kind, maintaining a 365 day calving interval and doing what great cow families do--making the best better generation after generation. If you are searching for a donor female that is in the prime of her life and will move your program forward, you need to study this lot. Thus far four male progeny have sold out of this cow for an average of $9750. This would have included the Signal son CRC Eureka 919K21 who sold in 2023 to Lake Majestik for $19,000. Through this sale the first female lots from this outstanding female will be offered. Her 2024 heifer calf by Triple Crown is awesome and sells

Lot 57/919H10 is her first calf sired by Signal and is without doubt a super donor female and may be the best daughter of Signal we have seen in production. No doubt her production has been stellar; but additionally, her genetic profile adds to her overall genetic merit. She ranks in the top 25% for both WW and YW. Not often do you find a female that possesses as striking a physical appearance as this lot and combines it with a genomically enhanced EPD profile that would make everyone envious. Her first calf, a heifer by Abstract, was purchased by Cavender Ranches as a bred heifer in the fall of 2023 for $10,000 and is currently in their embryo program. That heifer, 919K11, also recorded dominating ratios as she recorded a WWR of 125, YWR of 120, REAR of 111, and IMFR of 144. This data all adds to the reliability of her outstanding EPD profile. Highly proven mating coming in Lot 166, with recognizable names, stories and success on every corner. In the effort to create a more consistent, uniform and high-quality product, we have identified a few cow families that do this over and above the population and set out to reproduce them in mass, not just naming a “donor” for the sake of it. The 102’s are one of those families. With the most notable family members to date being Data Bank and Landline, 102G14, is quickly making her mark as a herd sire producing female like her maternal sister, 102F3. A ¾ sib to Signal, 102L6 comes to us with a world of body, shape and mass in a very acceptable frame size, while setting square on his feet and legs as we expect with a quality sheath design and is easy to handle in his 4 STAR DISPOSITION. His data enhances his presentation with 11 traits in the top 30%, and coming as calving ease himself at 65#, he offers up a true birth to yearling spread, and more than enough carcass to satisfy the industry. 102G14, was originally selected by Jack Moore through this

sale as a bred heifer, and was flushed by Vern and Jack before Lake Majestik acquired the TJM cows, where Nic placed her at the cornerstone of his donor program. A Trail Boss daughter with great udder attachment, foot structure and fleshing ability, she produced a full brother to 102L6 in the March 2023 sale at $25,500 to Reggie McDaniel, who unfortunately was injured at the bull stud and had to be put down. Her matings to Signal have been overly consistent, with the heifers being as good or better than the bulls. The look and feel of a true herd sire, he is genuinely hard to pick a hole in. The family lineage of herd sires shows you they’ll work, being a ¾ sib to Data Bank with a shot more carcass, and the overall usefulness of the individual make this a no-brainer for those seeking a quality and consistent producer. Bet on a winner here. Selling terms are the buyer’s option. A) Selling 2/3 interest and full possession. Lake Majestik will retain 1/3 semen interest. OR B) Selling full interest and full possession, with Lake Majestik retaining the rights to 400 units of semen at the cost of production for in-herd use only.

The Barnett family is as connected to the real world of the cattle business as anyone in the breed, dealing in it day in and day out with their own enterprise, as well as the two livestock markets they own and operate. They see and know what the bigger segment is after, and Matt always has an eye to that when mating cows, as evidenced by the bulls he offers. 655L is a great testament to that in life and on paper. Near perfect in his phenotype for a majority of the U.S., regardless of breed type, he is long, SMOOTH, deep, stout, sound and did we mention SMOOTH. Much like he is, his cow family has always been one that is deep hearted, deep flanked, bold sprung and good sheathed, where he is again, not an anomaly. A mirror of the industry, 655L is a unique breeding piece that can help the breed move the needle in a direction that satisfies the masses, regardless of region, environment or marketing structure. Cavling ease, growth, maternal and carcass with stoutness and structural integrity, why would you need anything else? Selling terms are the buyer’s option. A) Selling 2/3 interest and full possession. Barnett Cattle Co will retain 1/3 semen interest. OR B) Selling full interest and full possession, with Barnett Cattle Co retaining the rights to 400 units of semen at the cost of production for in-herd use only.

Entourage was the $35,000 selection of Sunshine Acres and Lake Majestik through the 2021 sale at Suhn’s, and unfortunately died unexpectedly in his first breeding season, with only limited semen frozen prior to going out with cows. With this limited test, his progeny have been very well received by our commercial bull buyers, but 30L38 steps up the game in 2024, showing us what we thought Entourage himself had in store for the future. Complete best describes 30L38- from nose to tail he is precise in his lines, correct in his design, attractive in his appearance and functional from all angles. Coming with plenty of spine, depth and more than enough stoutness from behind, he has ample bone and stands on a strong and correct foot structure. His data represents what this breeding program expects, multiple leading traits across the board, with 11 in the top 35% or higher. His modest 68# BW and EPD combo allows him to work multiple directions and his 5 STAR DISPOSITION will improve that trait as well. His dam comes from a herd sire producing family made famous in Eureka and is an exciting young Signal donor in the

Schmidt herd that will be a focal point of their program moving forward. With several notable females in her pedigree including 30F74 (the dam of last year’s $38,000 high seller, Bourre’) and the immortal 30M, his maternal base is stacked. The beef business as a whole has chased marbling so hard, many have forgot what true muscle shape looks like, and why it is necessary on ranches in the real world. 30L38 can fix that. The business has also lost some functionality from single trait selection, where so many of these cattle become tighter hearted and harder doing, lacking the spring, shape and volume it takes to forage without a bucket of corn a day. 30L38 can fix that. 30L38 has the pieces and parts missing to bring the cow business back to the cow business. Data balance, phenotypic balance, and pedigree strength, in a package that can serve as an outcross for several programs. Little different twist with a whole lot of future. Selling terms are the buyer’s option. A) Selling 2/3 interest and full possession. Schmidt Farms will retain 1/3 semen interest. OR B) Selling full interest and full possession, with Schmidt Farms retaining the rights to 400 units of semen at the cost of production for in-herd use only.

The headlining brother of a great group of flushmates, 53L29 is a standout herd sire who hails from a sire that has worldwide fame and a dam that was the past $65,000 pick of the herd selection at Suhn’s in 2022 and has a proven track record of producing herd sires. 53E2 is a standout Trail Boss daughter who is the dam of LM’s resident herd sire Wide Load, CRC’s up and comer Expansion, and Lawman’s calving ease leader Bullet Proof. Business Line will be the 3rd different sire 53E2 produced a highlight bull out of-HIGHLY impressive by all standards. As an individual, 53L29 leads his exceptional flush mates with his overall shape and style as one of the top sons of Business Line to surface in the breed. He has body, bone, muscle, and completeness with foot shape and leg set as it should be. His data also excels among his contemporaries with 10 traits in the top 30% (9 of which are in the top 15%!), a modest 84# BW and 5 STAR DISPOSITION. pedigree with the functionality of the great Angus female Vern snuck out of the real-world Bradley 3 program on the bottom side. Bred for balance and the real world at every turn. There is little guess work in what the results will be here. With as much maternal is as behind him, and as much promise as is in front of him, 53L29 should combine all the traits necessary to excel in the seedstock business. It is no accident that this is yet another highlight bull in this offering out of a highly proven cow. Rest assured; however, he was selected because of what HE is, not solely because of what his pedigree says. A result of a focused, tried and true breeding program, invest in seedstock, where the seedstock provider has vetted the path ahead for you. This mating and this individual is certainly that. Selling terms are the buyer’s option. A) Selling 2/3 interest and full possession. Chimney Rock will retain 1/3 semen interest. 70D1 has become a gem in the Lake Majestik program, first producing the herd sire Intrigue, originally selected to be used back in the Suhn program and since producing a number of great daughters, including 70K5, who is a donor at Quail Valley and what may be her best two to date in pick lots 17 and 18 in this sale. 70D1 is a cornerstone type female, working to a number of bulls including Signal, Data Bank, Wide Load, Ultimate and of course, Triple Crown. Triple Crown’s first full calf crop has certainly not disappointed, as they are cattle that come easy and hit the ground running from day one. While certainly calving ease, one would not be surprised to see his performance numbers climb as they have plenty of gas in the tank at yearling time. 70L10 backs up this mantra on the bottom side of his pedigree as well, out of a cow whose progeny have not lacked in real world performance. 70L10 is an ultracomplete individual who shows the consistency we see when we take UB1’s back to UB1’s,

LM TRIPLE CROWN 70L11

with his superior balance of body, muscle, structure, sheath and frame size, he moves about with ease and that herd sire look. Numerically, he places 11 traits in the top 30% or higher, exactly where we are striving this offering to land. His 65# BW backs up his EPD’s and calving ease potential and his 5 STAR DISPOSITION assures anyone can handle him. As you analyze 70L10, take a look at the next two lots as well. While he is the leader, they certainly are not slouches and lend to the consistency behind the individual he will be in the future. He is the real deal, without holes, without asterisks and without reservation. This is the most uniform set of bulls to ever sell at Chimney Rock, and the most uniform set of highlight bulls to be offered as well. The consistency to build on is built into this offering, and that consistency is as deep in 70L10 as anywhere. Selling 2/3 interest and full possession. Lake Majestik will retain 1/3 semen interest.

COMMERCIAL FEMALES

The GENPLUS partners, as well as our commercial customers that have consigned females to this offering, continually strive to offer the industry the highest quality and most genetically superior commercial females available. We utilize the majority of tools available to us such as AI’ing to the most genetically superior calving ease bulls, the utilization of genetics that have been parent verified, many of which have genomically enhanced EPD’s, plus data compilation and transfer to the IBBA from birth to weaning to more accurately identify the lineage of the genetics behind this offering.

We do, however, in no way quantify the progeny of these commercial genetics to be kept as intact males for use as sires in the industry. We are definitely proud of what we are offering, and without a doubt feel they are an asset to generate increased productivity for the programs purchasing them. It is our belief that for the beef industry to stay competitive with the other protein sources available that the male progeny from this genetic pool being offered do not meet the standards necessary to move our industry forward to use as breeding bulls and should be made steers as we intended.

HOW THEY WILL SELL

Heifers will be penned at the sale site in pens ranging in number from 10 to 25 head. We will video the cattle as a pen and will show that video as that pen of cattle is being sold. The cattle will not be run through the ring but as stated earlier most can be viewed at the sale site prior to the sale in their pen. We will produce a sale order for cattle selling and each pen will be split into several groups. As each pen comes up for sale we will sell the first group and the

winning bidder will have, at the discretion of the sale personnel and auctioneer, the right to purchase the next group of cattle in that pen and each succeeding group of cattle in that pen until that pen is sold. If the purchaser does not take the option to buy the next group of cattle that group will be sold and, at our discretion, that buyer will be given an option until that pen is sold and we proceed onto the next pen of females.

Each animal will be sold to the highest bidder. The auctioneer will settle any disputes as to bids and his decision on such matters shall be final.

Terms

Each animal becomes the risk of the purchaser as soon as sold, but it shall be the obligation of the seller to see that animals are fed and cared for, until loaded for shipment or until the expiration of 48 hours after the sale, whichever occurs first. After 48 hours a maintenance fee of $3.50 per day will be assessed until pickup.

Cash Sales

All sales are for cash unless satisfactory credit arrangements have been made with the seller or GENEPLUS prior to the sale. Payment must be made within 30 days of the sale date. Parties not adhering to said settlement terms will be assessed a nominal interest charge by GENEPLUS.

Sight Unseen Purchases

Buyers may purchase cattle through GENEPLUS personnel at auction or private treaty without viewing the cattle. For sight unseen purchases, the buyer has the right of inspection at the time of delivery. If the animal is deemed unsatisfactory, it may be reloaded on the delivery truck at no obligation to the buyer. All transportation expenses will be the responsibility of GENEPLUS. If the purchaser is unable to view the animal upon delivery that purchaser would have one week to deem the animal as unsatisfactory. In this instance the buyer may, at their expense, return the animal to GENEPLUS for a refund of the purchase price. DVAuction purchases do not fall under this guarantee.

Certificate of Registry

A transferred certificate of registry will be furnished to the purchaser for each registered animal within 45 days of proper settlement.

Health

Interstate health papers suitable for interstate shipment will be furnished on all animals as required by federal and state regulations.

Announcements

Any changes from the information of any kind in this catalog will be provided in a sale day supplement sheet or announced from the auction block and such information shall take precedence over cataloged information.

Breeding Guarantee

1. The seller guarantees all animals to be breeders with the exception of:

a) Calves under 12 months of age at the time of sale;

b) animals shown by purchaser after sale in which the breeding

guaranteed (if any) shall be agreed upon between the seller and the buyer;

c) animals who suffer injury or disease following the sale; d) animals subjected to gross negligence by willful misconduct on the part of the purchaser.

2. The seller guarantees that all bulls are breeders for a period of 90 days following the initial turnout date with buyers’ herd as long as this occurs within 60 days of date of sale. Or in the case of a bull purchased in the fall and not used until spring or vice versa they will be guaranteed for the 90 days from that first date as long as bulls have been kept in good condition and not run with other older mature herd bulls. This only applies to bulls that are at least 12 months old at time of sale and have not been allowed to run with the herd until at least 14 months of age. Seller does not guarantee death loss or injury.

Any bull which settles cows by natural service and passes a fertility test made by competent veterinarians, mutually agreed upon by buyer and seller, during any six-month period of trial (provided for in paragraph 2 of the section of these sales terms and conditions entitled “Option and Privilege of Return and Adjustment”), shall be considered a breeder unless otherwise agreed by the buyer and the seller. The seller makes no guarantees with respect to the bull’s ability to freeze semen.

3. Cows with calves at their side are presumed to be breeders with no further fertility guarantee.

4. “Safe-in-calf” females are guaranteed by the seller to have been examined by a competent veterinarian or reproductive technician and determined to be safe-in-calf by examination or other proven method (e.g., ultrasound, pregnancy blood tests, and rectal palpation).

5. Exposed females are not guaranteed to be with calf.

6. “Open” females are guaranteed by the seller to be without calf.

7. Donor females:

a.) Unless otherwise agreed by the buyer and the seller, a female that has been used in an embryo transfer program is not guaranteed to be a breeder after the date of the sale.

b.) Unless otherwise agreed by the buyer and the seller, a female is not guaranteed to be a breeder after the date of the sale, when that female is to be used, or attempted to be used, in an embryo transfer program.

c.) Virgin, open heifers that are placed in IVF or conventional embryo transfer prior to being confirmed bred will void any seller’s guarantee of breeding or embryo production.

8. The seller makes the following guarantees with respect to all “pregnant recipients”: (i) that the female is pregnant, (ii) that the resulting calf is of the pedigree represented, and (iii) that the resulting calf is of the sex represented (if so represented).

TERMS & CONDITIONS

Semen

1. Unless otherwise agreed by the buyer and the seller, with respect to the sale of semen the seller makes no guarantees with respect to the performance or characteristics of such semen and the buyer is purchasing such semen “as is.”

Embryos

1. Embryos being offered for sale will be sold “as is” unless the seller provides additional guarantees.

Privileges of Return or Adjustment:

Options

1. With the exception of any applicable transportation expenses described herein, a seller shall never be liable to a buyer for an amount greater than the original selling price of any animal sold under these Sales Terms and Conditions.

2. Unless otherwise stated, all claims for adjustment or refund must be made in writing to GENEPLUS within 180 days following the sale of the animal in question.

3.If an animal is claimed to be a non-breeder, the animal may be returned to the seller if it is in good condition and complies with the health requirements of the seller’s state. At the option of the buyer, the seller may issue a credit to the buyer for use in a future purchase or provide an animal of equal value subject to the approval of buyer. If the buyer exercises either such option, the claim shall be deemed fully and satisfactorily resolved. The seller does have the option on any animal’s claimed to be a non-breeder that the buyer, at his expense, return the animal to the seller and the seller has 180 days from the date the animal is returned to the seller’s ranch to conduct a trial to demonstrate the returned animal is a breeder. If the animal is confirmed to be a breeder during the test trial this shall be deemed full satisfaction and settlement of the claim. Any expense incurred for transporting an animal claimed to be a non-breeder will be the responsibility of the buyer.

4. If a female sold as “safe in calf” proves not to be in calf, the seller must make a satisfactory adjustment on the purchase price to the buyer or, at the buyer’s option, either credit can be given for the purchase price of the female or a satisfactory animal agreed on by both parties to replace original female. Any claim for adjustment under this paragraph must be made in writing to GENEPLUS within 60 days of date of sale.

5.If a female represented as “safe in calf” to a certain bull at the time of sale proves to have been bred to a different bull, the seller must make a satisfactory adjustment on the purchase price to the buyer. Any claim for adjustment or refund under this paragraph must be made in writing to GENEPLUS on or before the first anniversary of the date of sale.

6. If a female sold as “open” proves to be with calf, the buyer may return the animal to the farm of the seller prior to calving for a credit of the full purchase price or for another animal of equal value, whichever is acceptable to the buyer. The Seller is responsible for all transportation expenses.

7. If an animal (including the offspring of a pregnant recipient) is sold and through parentage verification is proven to have incorrect parentage, as represented by the animal’s certificate of registration and for which correct parentage can be determined, the seller is obligated to make satisfactory adjustment on the purchase price only to the buyer or, at the buyer’s option, credit the purchase price upon the return of the animal to the farm of the seller. Any claim for adjustment or credit under this paragraph must be made in writing to GENEPLUS on or before the first anniversary of the date of the sale. Those animals upon which parentage verification has been recorded with the IBBA will be so noted in the sale catalog or in a supplement sheet. At time of purchase it becomes the buyer’s responsibility to adhere to the rules of the IBBA regarding parentage verification for animals used for semen and embryo production.

8. If the resulting calf of a pregnancy is not of the sex represented at the time of the sale, the seller is obligated to make a satisfactory adjustment on the purchase price to the buyer or, at the buyer’s option, credit the purchase price upon the return of the animal to the farm of the seller. Any claim for adjustment or credit under this paragraph must be made in writing to GENEPLUS on or before the first anniversary date of the sale.

9. Unless stated otherwise, all transportation expenses incurred will be the responsibility of the buyer, except that the seller will be responsible for transportation costs in excess of the distance between the buyer’s farm and the location where the sale took place.

RIGHTS AND OBLIGATIONS

The above terms and conditions of sale shall constitute a contract between the buyer and seller of each animal and shall be equally binding upon both. Other than the guarantees and warranties stated above, no other warranties or guarantees are expressed or implied. Each sale or resale of an animal constitutes a separate transaction.

Neither GENEPLUS, the ranch the sale is being held on, nor any other sale consultant or persons connected with the management of this GENEPLUS sale, assumes any liability, legal or otherwise.
