COMMERCIAL FEMALE SALE
IMMEDIATELY FOLLOWING

Friends,
Everyone at GENEPLUS wants to thank you for looking at our catalog and considering our offering. All of the Partners, the Genetic Partners and our crews appreciate your support through the years - we don’t make it to our 16th consecutive sale without a lot of continued support, so thank you. For the first time visitors we thank you for your interest and hope to have the opportunity to introduce you to our product and our service.

We have a great set of cattle top to bottom from registered females to bulls to commercial heifers. As I’ve heard Cody and Vern say, we listen to our customers and breed functional cattle that will work for them in any environment and we hope you see the value in the consistency of phenotype and data that is assembled in this offering. There is a lot of this country that can utilize the kind of Brangus and Ultrablack we have developed.
This cattle market is fantastic, and we hope you are getting to experience it to the fullest extent. It is hard to imagine what some of these calves, feeder cattle and fat cattle are commanding and there looks to be no slowing it down for a while. There is not much rebuilding happening yet and that bodes well for this market staying stable for quite some time.
We hope to see you at the ranch Nov 3rd and 4th for the fellowship and Gail’s hospitality. The videos will be up in early October so be looking for those. Feel free to call Cody, Vern, Derrick or any of the partners or crews with any questions.
Look forward to seeing you at the sale.
BILL DAVISDARE TO BE DIFFERENT
The ability to survive within any industry requires great minds, plans, effort, capital, and a little bit of timing and luck. But we want our customers to do more than survive - we want them to thrive. At GENEPLUS, we understand the importance to adjust and adapt our process in order to stay one step ahead of the industry. We are the brand daring to break the mold. The breeders within GENEPLUS are partners by choice, not by chance. They made that choice because they vowed never to be satisfied with the status quo and adopted a model to build the best Brangus and Ultrablack bulls the world has ever seen.
The GENEPLUS focus on balance of performance and carcass merit, importance of genomics and EPD’s, emphasis on structure, foot design, fertility, and attention to a correct and industry accepted phenotype and sheath design, has led to a population of Brangus and Ultrablack cattle that is unlike any other. The notion that heat tolerance and durability are highly correlated to the increased amount of sheath or ear an animal possesses is as unrealistic as the belief that Brangus cattle can’t quality grade with Angus because of the Bos Indicus influence. Similarly, the notion that you have to receive discounts because of your “ear”
in the Midwest and West is also genuinely false, and we have disproved all of these things through our customers’ experiences via our breeding program.
The key to overcoming these misconceptions is a focused and dedicated selection process. At GENEPLUS, we understand what the end goal needs to look like before we mate and make the next generation. You can use an Ultrablack in the Gulf Coast region if you choose, with the same or more success than a Brangus with a #3 sheath. You can also use a Brangus or Ultrablack bull in Missouri on fescue, sell the progeny to a Northern feedlot and top the market - it’s all about the selection process and knowing and understanding your environment.
The good news is that we have the experience and genetic toolbox to accomplish these goals and more. If you’re trying to maximize the return on your cowherd, you’re in the right place. We sell more bulls to more states than any other Brangus and Ultrablack breeder in America for one reason – because we built a product unmatched by any of our competitors. DARE TO BE DIFFERENT.

TRUCKING LOCATIONS AVAILABLE FREE
In order to best serve our customers, we will offer free trucking to GENEPLUS Partner Ranches at no expense to the buyer. It is our goal that having these central drop points will allow buyers the opportunity to pick up their cattle closer to home if unable to haul them from the sale, or if buying online or sight unseen. If there is trucking needed beyond the specified drop point the expense will become the responsibility of the buyer at that time but GENEPLUS will be happy to facilitate
further arrangements if needed. Prior to sale day we will have days assigned and times given for cattle to be picked up at each ranch location. If cattle are not picked up on the specified days, they will be maintained at the ranch for a nominal fee to cover feed and health expenses.
If you would like to visit about this option further, please call Cody, Vern or the GENEPLUS office.

SAVE SHIPPING AND HANDLING
You can save shipping and handling charges by picking up semen that you will need for your fall breeding season at the Chimney Rock Cattle Company Sale. Representatives from either GENEPLUS or Integrated Breeders will be available sale day to fill your orders. We would ask that you keep your orders to goblet increments of 5’s or 10’s so that we can avoid excessive handling of semen. Please contact GENEPLUS at 1-877-436-3877 to place your order prior to the sale to assure we have enough semen on hand and available sale day.
SALE ORDER
The cattle will not sell in numerical lot order. We will have a printed sale order prior to the sale. Please note that the registered females, bulls and commercial females will be presented on video.
GENETIC CONDITION POLICY
Any animals that are confirmed as carriers of a genetic condition such as DD, developmental duplication, will be listed above their pedigrees as DDC. Any animals we are still waiting test results on will be listed DDPC. All other animals have been either confirmed free of known genetic conditions by test results or from pedigree analysis.
TRUSTED PERFORMANCE INFORMATION
We are extremely dedicated to providing our customers the genetics needed to positively impact their bottom line. As the motto of GENEPLUS states, “A Step Ahead. The Advantage You Can Trust”, we take very seriously the process of collecting phenotypic information and understand its fundamental importance and the role performance information and proper contemporary grouping play in providing the breed association with the most correct and current information possible, which in turn impacts the EPD’s you see directly. We will never compromise the integrity of our data.
All of the weights in this offering were taken by a scale, no tapes or windshield guesses. The ultrasound information reported to IBBA was all taken by Donnie Robertson to provide consistency of measurement across the program. In addition, these cattle have had DNA pulled and submitted to verify parentage and establish their genomically enhanced EPD’s and the status of their genomically enhanced EPDs is denoted in each catalog lot in the top right hand corner as to whether that information was back prior to the catalog deadline.
The industry has changed over time and a process which was once dominated by visual appraisal, then performance testing and contemporary grouping now has the ability to roll all of the information into a scope of genomically enhanced EPD’s. This gives the customer a tremendous edge in the accuracy of EPD’s and the assurance of parentage, thus dramatically improving the selection process for the future of their ranching enterprise. We encourage you to utilize these tools. For your convenience we have listed the current non-parent Brangus average EPD’s in this catalog for reference and comparison on how an individual compares to the average of the breed in any trait.
PARTIAL BREEDING GUARANTEE
All bulls selling in this sale have passed a thorough and stringent BSE (Breeding Soundness Evaluation) by Dr. Craig Fontenot of Town & Country Animal Clinic. Each bull selling has passed Dr. Craig Fontenot’s tests and is considered a satisfactory potential breeder. All bulls are guaranteed as breeding bulls through the first breeding season from the date of purchase. Please keep in mind that we expect the bull (s) to be treated with proper animal husbandry and that they are young bulls and require some additional management compared to mature bulls. Proper management should include the following requirements: 12 to 15 month old bulls at time of sale are utilized in a ratio of one bull to 15 cows and 16 to 20 month old bulls one bull to 20 cows. Furthermore, if these requirements are not adhered to or these bulls are placed in service or are housed until time of service with mature bulls then GENEPLUS will not stand behind this breeding guarantee.
If a problem does arise please contact GENEPLUS, Cody Gariss 417-262-1257 or Vern Suhn 620-583-3706, as soon as any question occurs as to a bull’s breeding soundness. GENEPLUS will evaluate the problem, consult with a veterinarian if needed and if replacement is required will replace with a bull of equal quality. If a replacement bull is not available GENEPLUS will issue credit in a future GENEPLUS sale. Please contact us before shipping any bulls. Shipping an animal you feel is unsatisfactory before contacting GENEPLUS will void our guarantee. In an effort to simplify the guarantee and credit process, cull salvage value within this guarantee and credit process moving forward is figured at a standard $1500/head.
This is a partial breeding guarantee and is not designed to mirror that of an insurance policy to stand death loss, debilitating physical injury, etc. If full morbidity or mortality coverage over and above this GENEPLUS breeding guarantee is desired we encourage you to contact Marcus Creasy, Adams & Creasy Insurance, at (501) 206-2281.
MAINTENANCE AFTER THE SALE
CRC will work with customers on delivery of cattle in an effort to have the cattle delivered to customers as soon as possible after the sale. However, if you are not ready for the cattle at this time we will maintain the cattle at the ranch for a period of time until you are ready for them. A nominal fee of $5.00 per day will be charged plus any veterinarian charges incurred will be billed. Cattle will be maintained on a growing ration in grass traps. Cattle become the buyer’s responsibility immediately after the sale. CRC or GENEPLUS is not responsible for insurance costs or death.

For 2023 and beyond Chimney Rock will be hosting the HBO program that Schmidt Farms has managed for many years. Since it’s inception, it has been well received by our customers who wish to have a higher percentage of their newly purchased heifers bred with known AI sires. The HBO program has worked particularly well for those breeders who, for whatever reason, may not be able to AI breed their heifers at home. The program has consistently had a high percentage of these heifers bred safe to known GENEPLUS AI sires. The HBO period lasts approximately 90-120 days, and for the $500 cost, the new owner is guaranteed a bred heifer, safe in calf, or a 100% credit for the original purchase price of the heifer, if we are unable to get her bred. So basically, you are guaranteed a bred heifer (or a credit) for an additional $500 over the cost of the open heifer you purchased.
• The HBO is available as an option, at buyers choice on any virgin, registered heifer {13 to 17 months of age} sold through a GENEPLUS sale. Lots that are eligible will be noted in the catalog as HBO ELIGIBLE.
• Heifers stay at Chimney Rock Cattle Company to be managed and AI bred to a GENEPLUS herd sire of the buyers choice. Cody or Vern would be happy to make breeding recommendations to the new owner, but the final decision will be left to the new owner.
• GENEPLUS pays for pasture, feed, mineral, normal vaccines, synchronization meds and parasite control as required. Semen costs will also be paid for if the buyer uses a GENEPLUS bull. A quality clean-up bull will be provided after AI is completed at no additional cost.
• Heifers will be managed similarly to the virgin heifers at Chimney Rock Cattle Company of the same age.

• The cost of this program is an additional $500 over the cost of the heifer. Settlement of this fee, along with the full purchase price of the heifer, must be made on day of the sale. Heifers will be moved to the breeding location at no cost to the buyer.
• When heifers are palpated safe in calf, they will be considered a breeder with no further guarantees from GENEPLUS partners or it’s cooperators. Registration papers will be transferred to the new owner when heifers are confirmed pregnant. If the heifer does not palpate pregnant the purchaser will be given, a credit for the purchase price only, which can be used in future GENEPLUS sales and does not include the $500 HBO cost, or the salvage value of the heifer.
• It is the buyers responsibility to pick up the heifers within 2 weeks of notification of palpation results. The arrangement for trucking from Chimney Rock Cattle Company to the customer’s ranch is the responsibility of the new owner and not GENEPLUS.
• GENEPLUS partners and cooperators are not responsible for death or any incurred vet expenses on any heifer in this program. We strongly advise the purchaser to purchase mortality insurance on heifers.
Customers who are considering the HBO are encouraged to discuss the details with a GENEPLUS member or sale representative prior to the sale. At the conclusion of the sale and after check out we encourage all customers who wish to enroll heifers in the HBO to visit with Derrick Miller or Bill Davis to work out all details, make sure we have all contact information, and to get any questions answered that you might have. Derrick Miller is more than happy to discuss prior results and details of the program. He can be reached by phone or text at 318-332-2341 or e-mail: derrickmcrc@gmail.com.
EPDS
CRC DATA BANK 30K93 202

Please make note that many of the animals were in different contemporary groupings at weaning; therefore, it is not fair to compare birth, weaning and yearling weights from one herd to another.
Expected Progeny Difference (EPDs) is the best estimate of an animal’s genetic merit for a particular trait. It takes into account the animal’s own performance compared with its contemporaries and the performance of it’s relatives compared against their contemporaries.
Birth Weight (BW) EPD predicts calf size and calving ease.
Weaning Weight (WW) EPD predicts preweaning growth potential.
Yearling Weight (YW) EPD predicts overall growth potential.
Milk EPD predicts the maternal contribution to weaning weight of the calf through milk production, behavior, immunity and other maternal environmental factors.
Scrotal Circumference (SC) EPD predicts not only testicular size of male progeny but also daughters onset of puberty.
Ribeye Area (REA) EPD predicts total muscle.
Intramuscular Fat (IMF) EPD predicts % of intramuscular fat which is highly correlated to marbling.
TERMINAL INDEX (TI) is a bio-economic index which considers six growth and carcass-related traits, each trait weighted according to its heritability and economic importance in a feedlot situation with carcasses valued by weight, yield, and quality grade. The value is expressed in standard deviation terms, which can be difficult to comprehend. IBBA advises breeders to evaluate the percentile rank rather than the actual index value.
FERTILITY INDEX (FI) is a bio-economic index which considers six traits, each trait weighted according to its heritability and economic importance in a cow-calf enterprise. The value is expressed in standard deviation terms, which can be difficult to comprehend. IBBA advises breeders to evaluate the percentile rank rather than the actual index value.
HEIFER PREGNANCY (HP) is reported in percentile units and represents the probability of a sire’s daughters becoming pregnant during their first breeding season compared to daughters of other sires.

STAYABILITY (ST) is reported in percentile units and represents the probability that a cow will have five consecutive calves compared to her yearling contemporaries.
PERFORMANCE
Individual performance data is provided as supplementary information as EPDs provide more reliable evaluation of genetics differences of animals.
Actual Birth Weight (BW) are reported.
Scrotal Circumference (SC) is adjusted to 365 days
Brangus EPDs are calculated by the Livestock Genetic Services and are part of a program called the National Cattle Evaluation (NCE).
EPD PERCENTILE RANKINGS
Individual ranking relative to the entire breed population on a specific trait, represented in the form of a percentage, with 1% being best and 99% being worst.

Genomically Enhanced EPD’s
Sire parentage has been verified and GE-EPD’s will be available Oct. 1st

more bull customers need cattle that can do it all. They aren’t as concerned with breed prefix as they are cattle that check the box, and this heifer checks a lot of boxes. County Line has been a pleasant surprise and a bull that will see more use at G+ moving forward and it’ll be easy to see why.

HARD TO FIND KIND
Sired by the $52,000 high selling bull of the 2021 GENEPLUS at Chimney Rock Sale, GACC Data Bank 102H3, has done nothing but gain in recognition and popularity for his ability to consistently sire uniform, light birth weight offspring who grow and are readily acceptable by our customers. His paternal granddam is also recognized as one of the elite young donor cows in the breed. Tie that paternal strength to the outstanding maternal strength and reputation for delivering herd sires through the 30 cow family and, in this case, the 30F74 female who just dropped her fourth calf that keeps her on a 365 day calving interval and destined for the donor pen at CRC. Her first calf, sired by Signal, is 30H175 and is already in the donor pen at Schmidt Farms and recorded a 117 WWR on her first calf. His maternal granddam, 30Y12, has recorded 9 calves, all AI sired, with a little over a 365 day CI and his maternal great grandam 30M needs little introduction.

FERTILITY AND LONGEVITY
His sire, Suhn’s TTT LM Signal 30E13, has definitely left his mark on the breed for his ability to sire light BW calves that also have enough growth punch to compete with the power bulls. His daughters are making extraordinary cows and if his top 4% EPD ranking for stayability is any indication they will be with us for a long time. This lot follows in his father’s footsteps with top 10% ranking for both CED and BW while still projecting growth EPD’s in the top 20% for WWEPD and top 25% for YWEPD. His dam is sired by Suhn’s Augustus 416Y14 whose daughters do an incredible job and her dam is the outstanding 30X6 donor female. His dam has also recorded 7 calves, all AI sired, with a 365 day calving interval and is still in production at CRC. A full sister, also sired by Signal, sold through the GENEPLUS at Chimney Rock Fall 2021 Sale going to Phillip DeSalvo, Big D Ranch for $12,000. This young prospect possesses the genetics for calving ease and growth and combines that in a structurally

correct package that is pleasing to the eye. Cowmen will appreciate his base width, depth of rib, muscle expression, tight slick hair coat, disposition, and neatness of sheath and underline design. He possesses the genetics for fertility and longevity, traits still most important to the commercial cowman who the rest of the industry relies on for product. Fertility and longevity still reign supreme over growth and carcass by a 3 to 1 margin. His pedigree lineage as well as his EPD’s with rankings in the top 3% for HP, top 10% for stayability and top 20% for fertility are a testament to his genetic ability to be beneficial in improving these traits. 5 Star Disposition. Buyers option. A. Selling 2/3 semen interest and full possession. Chimney Rock Cattle will retain 1/3 semen interest. OR B. Great herd sires are produced by dominant females and this lot has one of the greats as his dam. At just 6 years of age, she is well on her way to recording a storied production career. Suhn’s Miss Trail Boss 53E2 was selected by Reggie McDaniels as the pick of the Suhn Cattle Co. herd through the 2022 Genetic Edge Sale in Houston for $65,000. Her first calf, by Priority One, is still in production at CRC and her second calf by Brickhouse, Suhn’s Wide Load 53H6, was the selection of Lake Majestic through the 2021 SCC sale. She was placed in embryo transplant after that, and another son, Suhn’s Expansion 53J7, was selected by Chimney Rock through the 2022 SCC sale. This lot, 53K30, sired by Signal had lots of friends at the SEBBA field day at CRC. You gravitate to him the minute you walk into the pen. His strength and length of top line, spring and depth of rib, muscle expression and base width all flow together in an eye appealing package. 53K30
combines an awesome set of EPD’s that excel for BW, CED and SC and continue from there to blend a balanced set of EPD’s that incorporates the whole gamut of traits evaluated. His sire, Suhn’s TTT LM Signal 30E13, and his maternal sire, Suhn’s Trail Boss 30B3, are two of the most significant sires of their time. Their unmatched consistency in the type and kind of both sons and daughters produced is unrivaled. Progeny that are right for the time from calving ease to fertility and blend those traits together in a moderate framed, easy fleshing factory that will not bust the budget to keep them productive and adaptable to any environment they are exposed to. Do not miss him sale day. 5 Star Disposition. Buyers option. A. Selling 2/3 semen interest and full possession. Chimney Rock Cattle will retain 1/3 semen interest. OR B. POTENTIAL BRANGUS SUPERSTAR
This lot, 59K7, has been a standout in his contemporary group since birth. His sire, QVF PR Empower 30G16, is without doubt one of the most admired and prolific Brangus sires of his time. His paternal grand dam, 30D is regarded as one of the most influential donor females in the breed. 59K7’s dam records a 365-day calving interval on 5 calves all AI sired. Her sire, Tradition, is one of the most influential sires of females ever used in the Suhn program. She exemplifies the moderate framed, deep ribbed, wide based, big hipped, sweet uddered type of female that raises herd sires. His maternal granddam, 59X7, produced over $100,000 in progeny from two sires through the 2016 bull sale at Suhn Cattle Co. You will appreciate 59K7’s masculinity, boldness, and stoutness of structure. His wide base and width of chest floor coupled with depth and spring of rib, length of body and width and dimension of top

line plus the thickness and strength through the center section of his stifle. Moreover, we would be amiss if we did not mention his ideal sheath design and angle with a small prepuce opening are all qualities, we need in more Brangus sires. He stands on above average bone, possesses a correct foot structure and strides out with authority and purpose. Without question this lot incorporates the credentials you look for in a herd sire. Pedigree, paper, eye appeal plus elite raw performance. He may be the Brangus sire you have been looking for your herd. 4 Star Disposition. If your breeding goals are intent on reducing frame size, adding thickness, base width and muscle shape, improved fleshing ability, cleaning up underlines and correcting sheath design in a docile user-friendly package then you need to study this lot. One of the smaller framed bulls in the sale he still recorded an AYW of 1261 to ratio 103 while recording ultrasound ratios of 108 for REA and 116 for IMF in his contemporary group. 331K80 ranks in the top 10 percentile for WW, top 15% for YW, top 30% REA, and top 25% for IMF. You will be super impressed when you evaluate this lot for his overall base width front to rear, spring of rib, thickness and power through his top line and throughout his hind quarter and stifle. Although different in his design than the norm he has the slick, tight hair coat, superb sheath design and angle to make his offspring readily acceptable to a wide variety of environmental challenges. His sire, SF Brickhouse 909D9, is setting a high standard in

382K5
the breed for the quality and type of females he delivers. This lot’s lineage through the 331 cow family, that needs little introduction to the breed, adds to his credibility. I feel that I need to mention though that as we study EPD’s we need to make sure we peel the skin off the onion and look at the raw performance. His fertility and stayability EPD’s are not stellar; however, as one evaluates the production of the first 4 females in his pedigree you find that his dam has 4 progeny, his granddam 6 progeny, his great granddam 11 progeny and his great great granddam 8 progeny with 365 day calving intervals. Reproductive efficiency plus growth and carcass to fit the needs of today’s industry. 5 Star Disposition. Buyers option. A. Selling 2/3 semen interest and full possession. His dam is one of the favorites of the Chimney Rock crew. If you like her on paper you will be even more impressed when you view her in person. Her first calf, Suhn’s Surge 416G11, sold through the 2020 Suhn Cattle Co. Bull Sale and sold to Danny Farris, Tuscola, TX. After delivering 2 more calves with a 365 day calving interval she was moved into the embryo transplant program. Her dam, Suhn’s Miss Guardian 416C3, has also been a standout producer with an ABWR of 98, AWWR of 106 and AYWR of 106. This lot’s dam being her first calf followed by a total of 7 calves with a 365 day calving interval and she is pregnant with her eighth. COMMERCIAL FEMALES
The GENPLUS partners, as well as our commercial customers that have consigned females to this offering, continually strive to offer the industry the highest quality and most genetically superior commercial females available. We utilize the majority of tools available to us such as AI’ing to the most genetically superior calving ease bulls, the utilization of genetics that have been parent verified, many of which have genomically enhanced EPD’s, plus data compilation and transfer to the IBBA from birth to weaning to more accurately identify the lineage of the genetics behind this offering.
We do, however, in no way quantify the progeny of these commercial genetics to be kept as intact males for use as sires in the industry. We are definitely proud of what we are offering, and without a doubt feel they are an asset to generate increased productivity for the programs purchasing them. It is our belief that for the beef industry to stay competitive with the other protein sources available that the male progeny from this genetic pool being offered do not meet the standards necessary to move our industry forward to use as breeding bulls and should be made steers as we intended.

HOW THEY WILL SELL
Heifers will be penned at the sale site in pens ranging in number from 10 to 25 head. We will video the cattle as a pen and will show that video as that pen of cattle is being sold. The cattle will not be run through the ring but as stated earlier most can be viewed at the sale site prior to the sale in their pen. We will produce a sale order for cattle selling and each pen will be split into several groups. As each pen comes up for sale we will sell the first group and the
winning bidder will have, at the discretion of the sale personnel and auctioneer, the right to purchase the next group of cattle in that pen and each succeeding group of cattle in that pen until that pen is sold. If the purchaser does not take the option to buy the next group of cattle that group will be sold and, at our discretion, that buyer will be given an option until that pen is sold and we proceed onto the next pen of females.

TERMS & CONDITIONS
Bidding
Each animal will be sold to the highest bidder. The auctioneer will settle any disputes as to bids and his decision on such matters shall be final.
Terms
Each animal becomes the risk of the purchaser as soon as sold, but it shall be the obligation of the seller to see that animals are fed and cared for, until loaded for shipment or until the expiration of 48 hours after the sale, whichever occurs first. After 48 hours a maintenance fee of $3.50 per day will be assessed until pickup.
Cash Sales
All sales are for cash unless satisfactory credit arrangements have been made with the seller or GENEPLUS prior to the sale. Payment must be made within 30 days of the sale date. Parties not adhering to said settlement terms will be assessed a nominal interest charge by GENEPLUS.
Sight Unseen Purchases
Buyers may purchase cattle through GENEPLUS personnel at auction or private treaty without viewing the cattle. For sight unseen purchases, the buyer has the right of inspection at the time of delivery. If the animal is deemed unsatisfactory, it may be reloaded on the delivery truck at no obligation to the buyer. All transportation expenses will be the responsibility of GENEPLUS. If the purchaser is unable to view the animal upon delivery that purchaser would have one week to deem the animal as unsatisfactory. In this instance the buyer may, at their expense, return the animal to GENEPLUS for a refund of the purchase price. DVAuction purchases do not fall under this guarantee.
Certificate of Registry
A transferred certificate of registry will be furnished to the purchaser for each registered animal within 45 days of proper settlement.
Health
Interstate health papers suitable for interstate shipment will be furnished on all animals as required by federal and state regulations.
Announcements
Any changes from the information of any kind in this catalog will be provided in a sale day supplement sheet or announced from the auction block and such information shall take precedence over cataloged information.
Breeding Guarantee
1. The seller guarantees all animals to be breeders with the exception of:
a) Calves under 12 months of age at the time of sale;
b) animals shown by purchaser after sale in which the breeding guaranteed (if any) shall be agreed upon between the seller and the buyer;
c) animals who suffer injury or disease following the sale;
d) animals subjected to gross negligence by willful misconduct on the part of the purchaser.
2. The seller guarantees that all bulls are breeders for a period of 90 days following the initial turnout date with buyers’ herd as long as this occurs within 60 days of date of sale. Or in the case of a bull purchased in the fall and not used until spring or vice versa they will be guaranteed for the 90 days from that first date as long as bulls have been kept in good condition and not run with other older mature herd bulls. This only applies to bulls that are at least 12 months old at time of sale and have not been allowed to run with the herd until at least 14 months of age. Seller does not guarantee death loss or injury.
Any bull which settles cows by natural service and passes a fertility test made by competent veterinarians, mutually agreed upon by buyer and seller, during any six-month period of trial (provided for in paragraph 2 of the section of these sales terms and conditions entitled “Option and Privilege of Return and Adjustment”), shall be considered a breeder unless otherwise agreed by the buyer and the seller. The seller makes no guarantees with respect to the bull’s ability to freeze semen.
3. Cows with calves at their side are presumed to be breeders with no further fertility guarantee.
4. “Safe-in-calf” females are guaranteed by the seller to have been examined by a competent veterinarian or reproductive technician and determined to be safe-in-calf by examination or other proven method (e.g., ultrasound, pregnancy blood tests, and rectal palpation).
5. Exposed females are not guaranteed to be with calf.
6. “Open” females are guaranteed by the seller to be without calf.
7. Donor females:
a.) Unless otherwise agreed by the buyer and the seller, a female that has been used in an embryo transfer program is not guaranteed to be a breeder after the date of the sale.
b.) Unless otherwise agreed by the buyer and the seller, a female is not guaranteed to be a breeder after the date of the sale, when that female is to be used, or attempted to be used, in an embryo transfer program.
c.) Virgin, open heifers that are placed in IVF or conventional embryo transfer prior to being confirmed bred will void any seller’s guarantee of breeding or embryo production.
8. The seller makes the following guarantees with respect to all “pregnant recipients”: (i) that the female is pregnant, (ii) that the resulting calf is of the pedigree represented, and (iii) that the resulting calf is of the sex represented (if so represented).
Semen
1. Unless otherwise agreed by the buyer and the seller, with respect to the sale of semen the seller makes no guarantees with respect to the performance or characteristics of such semen and the buyer is purchasing such semen “as is.”
Embryos
1. Embryos being offered for sale will be sold “as is” unless the seller provides additional guarantees.
Privileges of Return or Adjustment: Options
1. With the exception of any applicable transportation expenses described herein, a seller shall never be liable to a buyer for an amount greater than the original selling price of any animal sold under these Sales Terms and Conditions.
2. Unless otherwise stated, all claims for adjustment or refund must be made in writing to GENEPLUS within 180 days following the sale of the animal in question.
3.If an animal is claimed to be a non-breeder, the animal may be returned to the seller if it is in good condition and complies with the health requirements of the seller’s state. At the option of the buyer, the seller may issue a credit to the buyer for use in a future purchase or provide an animal of equal value subject to the approval of buyer. If the buyer exercises either such option, the claim shall be deemed fully and satisfactorily resolved. The seller does have the option on any animal’s claimed to be a non-breeder that the buyer, at his expense, return the animal to the seller and the seller has 180 days from the date the animal is returned to the seller’s ranch to conduct a trial to demonstrate the returned animal is a breeder. If the animal is confirmed to be a breeder during the test trial this shall be deemed full satisfaction and settlement of the claim. Any expense incurred for transporting an animal claimed to be a non-breeder will be the responsibility of the buyer.
4. If a female sold as “safe in calf” proves not to be in calf, the seller must make a satisfactory adjustment on the purchase price to the buyer or, at the buyer’s option, either credit can be given for the purchase price of the female or a satisfactory animal agreed on by both parties to replace original female. Any claim for adjustment under this paragraph must be made in writing to GENEPLUS within 60 days of date of sale.
5.If a female represented as “safe in calf” to a certain bull at the time of sale proves to have been bred to a different bull, the seller must make a satisfactory adjustment on the purchase price to the buyer. Any claim for adjustment or refund under this paragraph must be made in writing to GENEPLUS on or before the first anniversary of the date of sale.
6. If a female sold as “open” proves to be with calf, the buyer may return the animal to the farm of the seller prior to calving for a credit of the full purchase price or for another animal of equal value, whichever is acceptable to the buyer. The Seller is responsible for all transportation expenses.
7. If an animal (including the offspring of a pregnant recipient) is sold and through parentage verification is proven to have incorrect parentage, as represented by the animal’s certificate of registration and for which correct parentage can be determined, the seller is obligated to make satisfactory adjustment on the purchase price only to the buyer or, at the buyer’s option, credit the purchase price upon the return of the animal to the farm of the seller. Any claim for adjustment or credit under this paragraph must be made in writing to GENEPLUS on or before the first anniversary of the date of the sale. Those animals upon which parentage verification has been recorded with the IBBA will be so noted in the sale catalog or in a supplement sheet. At time of purchase it becomes the buyer’s responsibility to adhere to the rules of the IBBA regarding parentage verification for animals used for semen and embryo production.
8. If the resulting calf of a pregnancy is not of the sex represented at the time of the sale, the seller is obligated to make a satisfactory adjustment on the purchase price to the buyer or, at the buyer’s option, credit the purchase price upon the return of the animal to the farm of the seller. Any claim for adjustment or credit under this paragraph must be made in writing to GENEPLUS on or before the first anniversary date of the sale.
9. Unless stated otherwise, all transportation expenses incurred will be the responsibility of the buyer, except that the seller will be responsible for transportation costs in excess of the distance between the buyer’s farm and the location where the sale took place.
RIGHTS AND OBLIGATIONS
The above terms and conditions of sale shall constitute a contract between the buyer and seller of each animal and shall be equally binding upon both. Other than the guarantees and warranties stated above, no other warranties or guarantees are expressed or implied. Each sale or resale of an animal constitutes a separate transaction.
Neither GENEPLUS, the ranch the sale is being held on, nor any other sale consultant or persons connected with the management of this GENEPLUS sale, assumes any liability, legal or otherwise.
