MULTI-TRAIT EXCELLENCE LITERALLY selected for across the board balance, not just outliers or single trait extremes. Profit isn’t driven from one trait alone.
PHENOTYPE AND SHEATH DESIGN
Looks matter and we strive to produce cattle with legitimate coast to coast eye appeal and acceptance, because that’s what YOUR CUSTOMERS want.
INTRINSIC TRAITS BUILT IN The strictest and most ruthless culling process in the breed, NO EXCEPTIONS OR EXCUSES. Fertility, disposition, and structural correctness make you money, and we have sorted accordingly.
Friends and Fellow Cattlemen,
Everyone with GENEPLUS - the Partners, the Genetic Partners, the Ranch Managers and their crews, want to thank you for taking the time to look at our catalog. We feel certain you will find cattle that can help your program grow and give you the opportunity to experience our service. The GENEPLUS partnership has been together for 15 years due to our steadfast commitment to breeding cattle that our customers demand. We will never compromise our culling process for the purpose of marketing a larger offering. We will never be the biggest producer but will never lose sight of our goal of being the best.
Looking at the industry we see the need for more heat tolerant and durable animals as some in the business are recognizing the struggles with straightbred English cattle remaining fertile through drought-stricken summers, and in feedlots with heat stress and late term death issues. Our Brangus and Ultrablack cattle can and will help curb these problems while realizing the advantages of hybrid vigor, without sacrificing marketability or end product merit. We have designed them to do it all.
The females behind these bulls are from the upper end of their contemporaries and certainly the type of cattle we strive to have walking in our pastures. With a focus on fertility, the heifers have not been flushed, but forced to prove themselves before being elevated to that level and the donors have earned their way to the donor pen through their production and must continue to earn their right to stay. Buy these bulls with confidence knowing that the merit and integrity of their mothers is built into them.
Our commercial heifers just get better every year, and this offering is no exception. Certainly, the type to go home with you, live in the front pasture and produce calves that will make you money for years. This calf market is on fire and these females have never been a better investment.
Thanks again for your time viewing this catalog. Please be looking for the videos that will drop in early March and feel free to call anyone from GENEPLUS with any questions. We certainly hope you can join us in Concord March 26th to enjoy our fellowship and hospitality.
In closing I want to express my sympathies to the Milam family, Grady and his family over the loss of John. Draggin’ M was a good friend and supporter of CRC and our entire breed and he will be missed.
As been said many times, there is more difference within breeds than between breeds. The Brangus breed, like every other breed, is evidence of that. Each program within a breed has different goals, and that is good, it makes the world go round. The GENEPLUS program is simple at its goal and somewhat complex in arriving at it.
Our goal - Make the most well-rounded breeding bulls in the business. Period. They need to produce progeny that will breed, feed, and grade. Fairly simple. But what isn’t fairly simple is balancing that 3-legged stool, and the number of components that go into those 3 legs, so that the stool doesn’t fall over. Through conscience efforts, structured breeding programs, and understanding the importance of intangible traits like disposition, sheath design, structural correctness and mature size we evaluate the “hard to measure” from the get-go. As a result, we are much more easily able to incorporate and BALANCE EPD traits like Birth Weight, Yearling Weight, IMF and SC so that at the end of the day the resulting steer progeny will come easy, grow fast, be attractive and marketable in their design, feed efficiently, grade within CAB specs, AND the females will perform accordingly and when the time comes breed on time AND over time, so that you have a uniform calf crop and cow herd that last the 8, 10, 12, 14 years that we come to expect from the Brangus breed.
Too often seedstock producers are disconnected from the reality of the commercial business. We are not that. We are also not professional marketers or salesmen. We are cattlemen, who believe in the traits that Brangus and
Ultrablack cattle have to offer, and have a vision based on an understanding of what the industry actually wants and needs. We could easily breed for a couple performance or marbling extremes, which at its core really only requires a calculator and little practical cattle knowledge but it’s not healthy for the cattle, the cowherd or the pocketbook. Just as you are expected to cover all the bases in your operation, so are your cattle. Balance wins the race and will drive the most profit to your bottom line. Don’t settle for less, expect more.
If your program needs a bump in heterosis, an improvement in phenotype, and product that shies away from extremes but is focused on legitimate, real world, practical multi-trait balance come see us Tuesday, March 26th.
This year GENEPLUS will host the 31st year of the Suhn Cattle Company sale at Chimney Rock Cattle Company in Concord, Arkansas. This is a sale with a history of producing BREED LEADERS and this year will be no different. In 2022, Vern and Vicki Suhn of Suhn Cattle Company sold their outstanding herd to Bill and Gail Davis, Chimney Rock Cattle Company, Randy and Karen Schmidt, Schmidt Farms and Nic and Chasity Cornelison, Lake Majestik Farms purchased the Jack Moore herd allowing the GENEPLUS partners to continue the Suhn Cattle Company and TJM Ranch legacy’s. Chimney Rock is honored to host the ELITE bull sale the 4th Tuesday of March at the ranch in Concord, AR.
In order to best serve our customers, we will offer free trucking on bulls to GENEPLUS Partner Ranches at no
expense to the buyer. It is our goal that having these central drop points will allow buyers the opportunity to pick up their cattle closer to home if unable to haul them from the sale, or if buying online or sight unseen. If there is trucking needed beyond the specified drop point the expense will become the responsibility of the buyer at that time but GENEPLUS will be happy to facilitate further arrangements as needed. Prior to sale day we will have days assigned and times given for cattle to be picked up at each ranch location. If cattle are not picked up on the specified days, they will be maintained at the ranch for a nominal fee to cover feed and health expenses.
If you would like to visit about this option further, please call Cody, Vern or the GENEPLUS office.

Cattle will be available for load out immediately after the bull sale and proper settlement has been made on purchases. If you wish to loadout on Wednesday or at a later date please note that when you check-out. Arrangements can then be made to have your cattle ready when you arrive.
You can save shipping and handling charges by picking up semen that you will need for your spring breeding season at the Chimney Rock Cattle Company Sale. Representatives from either GENEPLUS or Integrated Breeders will be available sale day to fill your orders. We would ask that you keep your orders to goblet increments of 5’s or 10’s so that we can avoid excessive handling of semen. Please contact GENEPLUS at 1-877-436-3877 to place your order prior to the sale to assure we have enough semen on hand and available sale day.
The cattle will not sell in numerical lot order. We will have a printed sale order prior to the sale. Please note that the bulls and commercial females will be presented on video.
Any animals that are confirmed as carriers of a genetic condition such as DD, developmental duplication, will be listed above their pedigrees as DDC. Any animals we are still waiting test results on will be listed DDPC. All other animals have been either confirmed free of known genetic conditions by test results or from pedigree analysis.
We are extremely dedicated to providing our customers the genetics needed to positively impact their bottom line. As the motto of GENEPLUS states, “A Step Ahead. The Advantage You Can Trust”, we take very seriously the process of collecting phenotypic information and understand its fundamental importance and the role performance information and proper contemporary grouping play in providing the breed association with the most correct and current information possible, which in turn impacts the EPD’s you see directly. We will never compromise the integrity of our data.
All of the weights in this offering were taken by a scale, no tapes or windshield guesses. The ultrasound information reported to IBBA was all taken by Donnie Robertson to provide consistency of measurement across the program. In addition, these cattle have had DNA pulled and submitted to verify parentage and establish their genomically enhanced EPD’s and the status of their genomically enhanced EPD’s is denoted in each catalog lot in the top right hand corner as to whether that information was back prior to the catalog deadline.
The industry has changed over time and a process which was once dominated by visual appraisal, then performance testing and contemporary grouping now has the ability to roll all of the information into a scope of genomically enhanced EPD’s. This gives the customer a tremendous edge in the accuracy of EPD’s and the assurance of parentage, thus dramatically improving the selection process for the future of their ranching enterprise. We encourage you to utilize these tools. For your convenience we have listed the current non-parent Brangus average EPD’s in this catalog for reference and comparison on how an individual compares to the average of the breed in any trait.
All bulls selling in this sale have passed a thorough and stringent BSE (Breeding Soundness Evaluation) by Dr. Craig Fontenot of Town & Country Animal Clinic. Each bull selling has passed Dr. Craig Fontenot’s tests and is considered a satisfactory potential breeder. All bulls are
guaranteed as breeding bulls through the first breeding season from the date of purchase. Please keep in mind that we expect the bull (s) to be treated with proper animal husbandry and that they are young bulls and require some additional management compared to mature bulls. Proper management should include the following requirements: 12 to 15 month old bulls at time of sale are utilized in a ratio of one bull to 15 cows and 16 to 20 month old bulls one bull to 20 cows. Furthermore, if these requirements are not adhered to or these bulls are placed in service or are housed until time of service with mature bulls then GENEPLUS will not stand behind this breeding guarantee.
If a problem does arise please contact GENEPLUS, Cody Gariss 417-2621257 or Vern Suhn 620-583-3706, as soon as any question occurs as to a bull’s breeding soundness. GENEPLUS will evaluate the problem, consult with a veterinarian if needed and if replacement is required will replace with a bull of equal quality. If a replacement bull is not available GENEPLUS will issue a credit for a future GENEPLUS sale. Please contact us before shipping any bulls. Shipping an animal you feel is unsatisfactory before contacting GENEPLUS will void our guarantee. In an effort to simplify the guarantee and credit process, cull salvage value within this guarantee and credit process moving forward is figured at a standard $1500/head.
This is a partial breeding guarantee and is not designed to mirror that of an insurance policy to stand death loss, debilitating physical injury, etc. If full morbidity or mortality coverage over and above this GENEPLUS breeding guarantee is desired we encourage you to contact Marcus Creasy, Adams & Creasy Insurance, at (501) 206-2281.
CRC will work with customers on delivery of cattle in an effort to have the cattle delivered to customers as soon as possible after the sale. However, if you are not ready for the cattle at this time we will maintain the cattle at the ranch for a period of time until you are ready for them. A nominal fee of $5.50 per day will be charged plus any veterinarian charges incurred will be billed. Cattle will be maintained on a growing ration in grass traps. Cattle become the buyer’s responsibility immediately after the sale. CRC or GENEPLUS is not responsible for insurance costs or death.
At the conclusion of the sale or as soon as possible following the sale if purchases are made via video or sight unseen agreement; please notify the sales staff as to specific instructions about cattle delivery. If you request our assistance the GENEPLUS staff will make every effort to help coordinate the most reliable and economical trucking available. We will offer free trucking on bulls to GENEPLUS Partner Ranches at no expense to the buyer. If there is trucking needed beyond the specified drop point the expense will become the responsibility of the buyer at that time but GENEPLUS will be happy to facilitate further arrangements if needed. If you do not wish to have your purchases delivered to one of these locations then trucking expense will be the responsibility of the purchaser. If you prefer to make your own arrangements Gary Tharp, Dixie Grove Trucking will be available sale day to discuss your needs or we can place you in contact with other reliable truckers.
Please note that the animals you purchase become your responsibility at time of purchase. GENEPLUS and/or the individual breeders represented are not responsible for animals that may be injured in transport. Third party insurance coverage is available for those who are interested with Marcus Creasy, Adams & Creasy Insurance, at (501) 206-2281.

Please make note that many of the animals were in different contemporary groupings at weaning; therefore, it is not fair to compare birth, weaning and yearling weights from one herd to another.
Expected Progeny Difference (EPDs) is the best estimate of an animal’s genetic merit for a particular trait. It takes into account the animal’s own performance compared with its contemporaries and the performance of it’s relatives compared against their contemporaries.
Birth Weight (BW) EPD predicts calf size and calving ease.
Weaning Weight (WW) EPD predicts preweaning growth potential.
Yearling Weight (YW) EPD predicts overall growth potential.
Milk EPD predicts the maternal contribution to weaning weight of the calf through milk production, behavior, immunity and other maternal environmental factors.
Scrotal Circumference (SC) EPD predicts not only testicular size of male progeny but also daughters onset of puberty.
Ribeye Area (REA) EPD predicts total muscle.
Intramuscular Fat (IMF) EPD predicts % of intramuscular fat which is highly correlated to marbling.
TERMINAL INDEX (TI) is a bio-economic index which considers six growth and carcass-related traits, each trait weighted according to its heritability and economic importance in a feedlot situation with carcasses valued by weight, yield, and quality grade. The value is expressed in standard deviation terms, which can be difficult to comprehend. IBBA advises breeders to evaluate the percentile rank rather than the actual index value.
FERTILITY INDEX (FI) is a bio-economic index which considers six traits, each trait weighted according to its heritability and economic importance in a cow-calf enterprise. The value is expressed in standard deviation terms, which can be difficult to comprehend. IBBA advises breeders to evaluate the percentile rank rather than the actual index value.
HEIFER PREGNANCY (HP) is reported in percentile units and represents the probability of a sire’s daughters becoming pregnant during their first breeding season compared to daughters of other sires.
STAYABILITY (ST) is reported in percentile units and represents the probability that a cow will have five consecutive calves compared to her yearling contemporaries.
Individual performance data is provided as supplementary information as EPDs provide more reliable evaluation of genetics differences of animals.
Actual Birth Weight (BW) are reported.
Scrotal Circumference (SC) is adjusted to 365 days
Brangus EPDs are calculated by the Livestock Genetic Services and are part of a program called the National Cattle Evaluation (NCE).
Individual ranking relative to the entire breed population on a specific trait, represented in the form of a percentage, with 1% being best and 99% being worst.
Sire parentage has been verified and GE-EPD’s will be available March 1st
Extremely gentle, difficult to get out of the way
Calm but moves away from you when you get close to them
Calm but moves away from you sooner than a 4 (Larger Flight Zone)
Nervous and moves away rapidly when you enter their flight zone
Extremely nervous and/or aggressive temperament. Thrashes about when confined and may attack the scorer in the pen
We have included a disposition score for every Brangus & Ultrablack bull selling. These bulls were scored following gathering yearling weight and ultrasound data. Vern and Cody scored them individually at this time. Please note the explanation of our scoring system above, with 5 stars being the best and 1 being the worst. There are no 1 or 2 star rankings in this sale because they were culled. Please contact us with any questions you may have.

Fed slow and steady, they have been allowed to grow at a natural pace and we hope you will agree have developed into a very impressive set of age-advantaged bulls. “Multi-generational Brangus bull with top tier growth, carcass, phenotype, and a cow family to back him.” That’s what we hear many registered breeders mentioning they want in their next frontline herd sire and that’s what we find in 2L. A standout since birth, he was the natural calf of his storied and proven dam, 2A, who has been a staple in the Suhn and CRC programs as a true source of power, correctness and Brangus character. The dam of Blueprint, who gained worldwide prominence and has been one of the top 3 G+ semen sellers worldwide in the last 2 years, 2A is a cow that earned her way to the donor pen and still resides there, working to multiple sires. Trail Boss is no stranger to the breed as an elite source of consistency, carcass and quality. Typically seeing him with high success back on UB females, he’s no less effective on Brangus cows, as evidenced here. The balance he brings numerically, combined with the maternal function he leaves in his daughters has truly made him one of the elite sires of his time. Analyzing 2L you appreciate the massive body and capacity, excellent bone, joint and foot design, correct and quality sheath design, and the dimension he presents from head
to tail all in the right sized package. Numerically he started life with a 90# BW, running to a 725# adj WW, 1258# adj YW, 15.17 adj sq in REA and 5.11 adj IMF alongside his 43.9 cm adj SC and 5-STAR DISPOSITION. Ranking in the top 2% for SC, 3% for WW & YW, 4% for TI, 5% for REA, 20% for IMF and 35% for HP, it is always refreshing to view a program where the numbers and cattle match, giving you confidence in the cattle and the data. The breed can utilize a bull heavily that has this much phenotypic capacity, real world maternal value, growth and carcass merit, and a sheath that has the correct angle and design. Brangus, UB, registered, commercial, north, south, east, west, domestic, international, this bull has the potential to literally work any direction. Make no mistake, when we highlight a bull here it is for a reason, not just filler space, and it is no coincidence he is the first one out the gate. Saddle up and tie into one that can put you in the driver’s seat in the business. Selling terms are the buyer’s option. A) Selling 2/3 interest and full possession. Chimney Rock will retain 1/3 semen interest. OR B) Selling full interest and full possession, with Chimney Rock retaining the rights to 400 units of semen at the cost of production for in-herd use only.

History tends to repeat itself, and it did again in this lot as 53D2 brings another feature lot to the forefront. A female hailing from the 53 cow family, stemming back to the Bradley 3 Angus program and brought to Brangus prominence by Vern Suhn, 53D2 is no doubt one the of the most phenotypically correct UB females to ever sell in this breed, commanding $35,000 to Genesis Ranch, and her 7 month old daughter (a full sib to this lot) netting $16,000 to Quail Valley. Also, the dam of the $29,000 Octane, whose career was cut short to injury, and maybe most famously Kingpin, the full brother to 53L4, who was selected by CRC in 2021 and doing a great job, with his first sons in this offering. The Trail Boss x 53D2 mating works. On the ground 53L4 possesses the magnitude of a herd sire, with his tremendous internal capacity, flexibility and overall mass. His balance packing 8 traits in the top 35% or better land where we think the industry should, with across-the-board balance

and his 746# adj WW that transitioned into 1290# adj YW, 15.24 sq in adj REA, 5.27 adj IMF, 38.4 cm adj SC and 5 STAR DISPOSITION land him again where the industry needs. Practical, functional and efficient. Undoubtedly one of the biggest bodied individuals to sell this spring, 53L4 is full of volume and substance. A bull that not only screams herd sire producer, but his daughters should also be unbelievable cow makers given the maternal heritage on every end of the pedigree. If you need that shot of balance, function, fertility, and good ol’ fashioned cow power that is lacking from chasing extremes, your answer lies within lot 42. UNIQUE COMBINATION OF HISTORY AND FUTURE
An intriguing lot that gives us interesting angles on paper and in person comes in lot 59, 302L. At first glance you see a legitimate calving ease individual that still stacks WW in the top 5%, YW in the top 10% and all his indexes in the top 30% or better. His performance matches the paper with his 53# BW parlaying into an adj 717# WW, 1257# adj YW, 14.74 sq in adj REA, 4.57 adj IMF, 41 cm adj SC and 5 STAR DISPOSITION. Further you see him as a true moderate framed individual that will control mature size but gives up nothing in terms of shape and mass with a humongous hip, top and lower stifle. Moving from him as an individual to his heritage, you recognize his sire, Currency, as a high accuracy calving ease sire who has outpaced himself over the years, and a bull we believe is underutilized in the purebred segment with the phenomenal tools he brings to the table as an EPD set. His sons have been easy to sell, and his daughters are leading their contemporaries in production, loaded with fertility and milk. Not to be outdone, the maternal side of the pedigree presents a top end 2-year-old Foundation daughter from Lake Majestik, who just happens to be a maternal sister to one of
the all-time leaders in registrations in Three D. That’s right, the maternal granddam of this lot, 302X3, is the dam of Three D. Her dam, 302H6, was one of the anchor females first purchased by Bill Davis and one of the all-time revenue generating cows in the history of the breed. There is a lot of history in the pedigree and for good reason! 302L has the phenotypic pieces to add value to the vast majority of the purebred population, the EPD presence to hit the marks the industry needs, and the pedigree history to back up what we see in living color. Expect his progeny to be moderate, stout, sound, fertile and functional. With the bulls retaining his shape and data profile, they should be highly marketable, and with the females combining the best of Currency on top of Foundation back to the revenue generating history the next two generations possess, this one is loaded up with all the bells. Don’t bet against Patrick Mahomes in the playoffs and don’t bet against 302L, he’ll get the job done. Selling terms are the buyer’s option. A) Selling 2/3 interest and full possession. Lake Majestik will retain 1/3 semen interest. OR B) Selling full interest and full possession, with Chimney Rock retaining the rights to 400 units of semen at the cost of production for in-herd use only.

When we view the beef industry, what it needs, what it wants and what it actually takes to be profitable, it looks like lot 93, and his two brothers, selling as lot 92 and 94 respectively. Consistency, balanced, eye appealing, multi-trait data excellence, backed by one of the top young sires in the breed and a dam that epitomizes what a donor cow should be, earning her spot into a donor pen through production and quality, not her name or price tag. These three flush brothers are exceptional, and we argued, cussed and discussed which one to highlight at catalog time and chose 535L5 as the most complete of the three, the leader in performance, power, and balance. You easily notice the 9 traits he places in the top 30% or better, with 8 of them landing in the top 10%! His data mirrors this with a modest 76# BW jumping to a 731# adj WW, 1331# YW, 41.4 cm adj SC and 5 STAR DISPOSITION
You also easily notice the tremendous length of spine he possesses, as one of the most extended bulls in the entire offering, while still maintaining ample body, expressive muscle shape, tremendous foot integrity and a sheath design that can go any direction. This is the type of BEEF bull the industry needs, and the type that will compete with the best of any breed. Sired by Data Bank, who commanded
$52,000 through this ring 2.5 years ago and has gone on to fulfill what we expected in terms of consistency, including a $38,000 son in his first calf crop to Thomas Soileau. The dam of 535L5 is a crowd favorite at Schmidt’s, as a prototypical Mack daughter back to the SF 535 tribe that Randy has put his own twist on, making them the soundest, most consistent, highest IMF 535’s in the breed. 535E20 is one of the good ones and if there were a pick of the herd at Schmidt’s to sell, she would most definitely be on the short list. Never satisfied with the status quo, we keep pushing the envelope for consistency and balance. Not breeding for “AI Sires” but breeding for front end, industry-driven BEEF bulls, and when they lead the pack, and a flush this good they get elevated to a half page. This is our focus, this is what sells the next 129 bulls, trying to make them one like another. Like begets like, and you can’t ignore the consistency 535L5 presents from every angle. Consistency will keep you in the business. Selling terms are the buyer’s option. A) Selling 2/3 interest and full possession. Schmidt Farms will retain 1/3 semen interest. OR B) Selling full interest and full possession, with Schmidt Farms retaining the rights to 400 units of semen at the cost of production for in-herd use only.

SIRE PROSPECT Cool Design from an Outcross
The GENEPLUS partners, as well as our commercial customers that have consigned females to this offering, continually strive to offer the industry the highest quality and most genetically superior commercial females available. We utilize the majority of tools available to us such as AI’ing to the most genetically superior calving ease bulls, the utilization of genetics that have been parent verified, many of which have genomically enhanced EPD’s, plus data compilation and transfer to the IBBA from birth to weaning to more accurately identify the lineage of the genetics behind this offering. We do,
however, in no way quantify the progeny of these commercial genetics to be kept as intact males for use as sires in the industry. We are definitely proud of what we are offering, and without a doubt feel they are an asset to generate increased productivity for the programs purchasing them. It is our belief that for the beef industry to stay competitive with the other protein sources available that the male progeny from this genetic pool being offered do not meet the standards necessary to move our industry forward to use as breeding bulls and should be made steers as we intended.
Heifers will be penned at the sale site in pens ranging in number from 10 to 25 head. We will video the cattle as a pen and will show that video as that pen of cattle is being sold. The cattle will not be run through the ring but as stated earlier most can be viewed at the sale site prior to the sale in their pen. We will produce a sale order for cattle selling and each pen will be split into several groups. As each pen comes up for sale we will sell the

Each animal will be sold to the highest bidder. The auctioneer will settle any disputes as to bids and his decision on such matters shall be final.
Each animal becomes the risk of the purchaser as soon as sold, but it shall be the obligation of the seller to see that animals are fed and cared for, until loaded for shipment or until the expiration of 48 hours after the sale, whichever occurs first. After 48 hours a maintenance fee of $3.50 per day will be assessed until pickup.
All sales are for cash unless satisfactory credit arrangements have been made with the seller or GENEPLUS prior to the sale. Payment must be made within 30 days of the sale date. Parties not adhering to said settlement terms will be assessed a nominal interest charge by GENEPLUS.
Buyers may purchase cattle through GENEPLUS personnel at auction or private treaty without viewing the cattle. For sight unseen purchases, the buyer has the right of inspection at the time of delivery. If the animal is deemed unsatisfactory, it may be reloaded on the delivery truck at no obligation to the buyer. All transportation expenses will be the responsibility of GENEPLUS. If the purchaser is unable to view the animal upon delivery that purchaser would have one week to deem the animal as unsatisfactory. In this instance the buyer may, at their expense, return the animal to GENEPLUS for a refund of the purchase price. DVAuction purchases do not fall under this guarantee.
A transferred certificate of registry will be furnished to the purchaser for each registered animal within 45 days of proper settlement.
Interstate health papers suitable for interstate shipment will be furnished on all animals as required by federal and state regulations.
Any changes from the information of any kind in this catalog will be provided in a sale day supplement sheet or announced from the auction block and such information shall take precedence over cataloged information.
1. The seller guarantees all animals to be breeders with the exception of:
a) Calves under 12 months of age at the time of sale; b) animals shown by purchaser after sale in which the breeding
guaranteed (if any) shall be agreed upon between the seller and the buyer;
c) animals who suffer injury or disease following the sale;
d) animals subjected to gross negligence by willful misconduct on the part of the purchaser.
2. The seller guarantees that all bulls are breeders for a period of 90 days following the initial turnout date with buyers’ herd as long as this occurs within 60 days of date of sale. Or in the case of a bull purchased in the fall and not used until spring or vice versa they will be guaranteed for the 90 days from that first date as long as bulls have been kept in good condition and not run with other older mature herd bulls. This only applies to bulls that are at least 12 months old at time of sale and have not been allowed to run with the herd until at least 14 months of age. Seller does not guarantee death loss or injury.
Any bull which settles cows by natural service and passes a fertility test made by competent veterinarians, mutually agreed upon by buyer and seller, during any six-month period of trial (provided for in paragraph 2 of the section of these sales terms and conditions entitled “Option and Privilege of Return and Adjustment”), shall be considered a breeder unless otherwise agreed by the buyer and the seller. The seller makes no guarantees with respect to the bull’s ability to freeze semen.
3. Cows with calves at their side are presumed to be breeders with no further fertility guarantee.
4. “Safe-in-calf” females are guaranteed by the seller to have been examined by a competent veterinarian or reproductive technician and determined to be safe-in-calf by examination or other proven method (e.g., ultrasound, pregnancy blood tests, and rectal palpation).
5. Exposed females are not guaranteed to be with calf.
6. “Open” females are guaranteed by the seller to be without calf.
7. Donor females:
a.) Unless otherwise agreed by the buyer and the seller, a female that has been used in an embryo transfer program is not guaranteed to be a breeder after the date of the sale.
b.) Unless otherwise agreed by the buyer and the seller, a female is not guaranteed to be a breeder after the date of the sale, when that female is to be used, or attempted to be used, in an embryo transfer program.
c.) Virgin, open heifers that are placed in IVF or conventional embryo transfer prior to being confirmed bred will void any seller’s guarantee of breeding or embryo production.
8. The seller makes the following guarantees with respect to all “pregnant recipients”: (i) that the female is pregnant, (ii) that the resulting calf is of the pedigree represented, and (iii) that the resulting calf is of the sex represented (if so represented).
1. Unless otherwise agreed by the buyer and the seller, with respect to the sale of semen the seller makes no guarantees with respect to the performance or characteristics of such semen and the buyer is purchasing such semen “as is.”
1. Embryos being offered for sale will be sold “as is” unless the seller provides additional guarantees.
1. With the exception of any applicable transportation expenses described herein, a seller shall never be liable to a buyer for an amount greater than the original selling price of any animal sold under these Sales Terms and Conditions.
2. Unless otherwise stated, all claims for adjustment or refund must be made in writing to GENEPLUS within 180 days following the sale of the animal in question.
3.If an animal is claimed to be a non-breeder, the animal may be returned to the seller if it is in good condition and complies with the health requirements of the seller’s state. At the option of the buyer, the seller may issue a credit to the buyer for use in a future purchase or provide an animal of equal value subject to the approval of buyer. If the buyer exercises either such option, the claim shall be deemed fully and satisfactorily resolved. The seller does have the option on any animal’s claimed to be a non-breeder that the buyer, at his expense, return the animal to the seller and the seller has 180 days from the date the animal is returned to the seller’s ranch to conduct a trial to demonstrate the returned animal is a breeder. If the animal is confirmed to be a breeder during the test trial this shall be deemed full satisfaction and settlement of the claim. Any expense incurred for transporting an animal claimed to be a non-breeder will be the responsibility of the buyer.
4. If a female sold as “safe in calf” proves not to be in calf, the seller must make a satisfactory adjustment on the purchase price to the buyer or, at the buyer’s option, either credit can be given for the purchase price of the female or a satisfactory animal agreed on by both parties to replace original female. Any claim for adjustment under this paragraph must be made in writing to GENEPLUS within 60 days of date of sale.
5.If a female represented as “safe in calf” to a certain bull at the time of sale proves to have been bred to a different bull, the seller must make a satisfactory adjustment on the purchase price to the buyer. Any claim for adjustment or refund under this paragraph must be made in writing to GENEPLUS on or before the first anniversary of the date of sale.
6. If a female sold as “open” proves to be with calf, the buyer may return the animal to the farm of the seller prior to calving for a credit of the full purchase price or for another animal of equal value, whichever is acceptable to the buyer. The Seller is responsible for all transportation expenses.
7. If an animal (including the offspring of a pregnant recipient) is sold and through parentage verification is proven to have incorrect parentage, as represented by the animal’s certificate of registration and for which correct parentage can be determined, the seller is obligated to make satisfactory adjustment on the purchase price only to the buyer or, at the buyer’s option, credit the purchase price upon the return of the animal to the farm of the seller. Any claim for adjustment or credit under this paragraph must be made in writing to GENEPLUS on or before the first anniversary of the date of the sale. Those animals upon which parentage verification has been recorded with the IBBA will be so noted in the sale catalog or in a supplement sheet. At time of purchase it becomes the buyer’s responsibility to adhere to the rules of the IBBA regarding parentage verification for animals used for semen and embryo production.
8. If the resulting calf of a pregnancy is not of the sex represented at the time of the sale, the seller is obligated to make a satisfactory adjustment on the purchase price to the buyer or, at the buyer’s option, credit the purchase price upon the return of the animal to the farm of the seller. Any claim for adjustment or credit under this paragraph must be made in writing to GENEPLUS on or before the first anniversary date of the sale.
9. Unless stated otherwise, all transportation expenses incurred will be the responsibility of the buyer, except that the seller will be responsible for transportation costs in excess of the distance between the buyer’s farm and the location where the sale took place.
The above terms and conditions of sale shall constitute a contract between the buyer and seller of each animal and shall be equally binding upon both. Other than the guarantees and warranties stated above, no other warranties or guarantees are expressed or implied. Each sale or resale of an animal constitutes a separate transaction.
Neither GENEPLUS, the ranch the sale is being held on, nor any other sale consultant or persons connected with the management of this GENEPLUS sale, assumes any liability, legal or otherwise.
GENEPLUS, as the selling agent, believes all printed information to be correct as provided by the IBBA and respective breeders on 2/1/2024 but does not asssume liablity as such. EPD’s are subject to change per monthly Genetic Evaluations and updated EPD’s will be provided on sale day at request. Any and all updated information, pedigrees, EPD’s etc provided on sale day and take precedence over printed materials.
