President's Pen While 2021 doesn’t feel like a complete blur, there is certainly an element of déjà vu as we look forward to what the next year holds. To think this is my last article as President doesn’t quite seem real yet.

It’s been a wonderful two years at the helm of this Association and I’m so proud of our members and all that we’ve accomplished together.

I feel like I need to acknowledge the real elephant in the room as we have an end of year wrap-up…. How is everyone? How are you feeling? How are you mentally, physically, socially? I just want to take the time to acknowledge this last two years has changed many of us and some of that change is unwelcome and uneasy. I want to say that you are not alone. You guys have been the front-line workers in our offices the last two years and that can certainly take its toll. Our residents have been home more than ever which means more interaction and issues to address.

I want to personally thank every on-site team member that has held it down! For those of you (us), that have had the flexibility of working from home, I also acknowledge that it brings on a certain feeling of chaos and loneliness. I look forward to each of us returning to whatever the new normal looks like, but also seeing how our roles adapt to the needs of our company’s expectations.

What I value most about this Association is that we have become family and are all in this together! I believe this is evident by our offerings this year such as XCEL’s “It’s Okay to Not Be Okay” which was tremendously impactful discussing mental health overall. We hope to continue to provide resources like this to connect to what matter most to our members – our health. This flows so well with Membership’s “This is Us” campaign to truly show off the long-lasting relationships formed in this Association.

I’m pleased to say that Committee attendance is still seeing success with virtual meetings! We expect this trend to continue

in 2022, but also allow for in person meetings to return! We believe this allows for folks from the same company/office to attend and be involved. With that said, we couldn’t wait to get back to in person events this year as WE HAVE MISSED YOU! We jumped right in with our Golf Tournament on arguably the most beautiful day of 2021 and had over 200 attendees! Our Special Events committee are the BEST in the biz and have been quite busy this year!

We had over 700 registrants for our Trade Show, and I personally LOVED seeing the outfits, the networking, THE FOOD, and overall good time of the event. KUDOS to the 110 supplier companies and I hope you will reap the benefits throughout the next several months!

Speaking of the Trade Show, our Education Committee completely crushed their goal with Battle of the Baskets and raised over $5,700 which all goes towards scholarships for Credential Prorgams! I am incredibly proud of this group and thank you so much to our membership for your support!

Most recently, we saw each other in early December in our festive attire at our last networking event of the year! This was a casual, yet fun event with great attendance and a HUGE contribution to Toys for Tots!

Again, we couldn’t do what we do without you guys showing up and showing up BIG, so THANK YOU! Our Government Affairs Committee remained busy all year and the PAC, Political Action Committee has raised approximately $26,000. These funds are used to engage and support our local leadership that has the best interest of our industry and Association. We represent a diverse set of candidates and representatives and can announce that 9 of the 13 backed candidates won their respective races.

As we look forward, I am happy to announce our newest committee “Diversity Equity and Inclusion.” Deriving from our 2019 Strategic Plan, our Board of Directhe ApartMentor 2021 | Issue 4 4

tors had a goal to make this happen and were able to do so from the efforts of our Task Force in 2021. Thank you so much to this group of open-minded, passionate, and vocal individuals that contributed to the greater good of keeping DE&I at the forefront of our Association. I look forward to seeing what this committee can do! Stay tuned to see how you can sign up to join— open to ALL members!

Last, but certainly not least, this Association is nothing without its staff. This group is truly made up of some of the best people on earth and much like many of us in our offices, they have been running LEAN all year and yet never let the Association or our members miss a beat. I am grateful for the relationships I have formed with these people and look forward to connecting more in the years to come. Do yourself a favor once we are “normal” again—go spend time with these folks, they truly are amazing!

As I close-out my Presidency, I’d like to reiterate how incredibly grateful I am for the opportunity! I’m excited for 2022 and seeing you more in person and all that we will accomplish and overcome together.

TAA Welcomes New Team Members Sydney George joined the TAA Staff, on December 13, as our Administrative Coordinator! Sydney started with TAA through a staffing agency at the end of September and very quickly became an integral part of our team.

Talk about jumping in wherever needed – she certainly did that and continues to do so! In her role with TAA she will be responsible for coordinating the administrative functions of the office to include processing Sydney George member orders, ordering office supplies and keeping items stocked, and most importantly, serving as the first point of contact for members.

So, when you come to the office or call us, Sydney will most likely be the first team member with whom you speak. Other duties include assisting with membership database entry, promoting and overseeing the use of our rental spaces, and providing administrative support to the team. And Sydney will serve as the staff liaison for the XCEL Committee.

Sydney is a 2020 graduate of NC State University with a B.S. in Business Administration. Her work experience includes being an office assistant with the Pinnacle Appraisal Group and serving as hostess at two local restaurants.

Lily Mather joined the TAA Staff, on September 27, as our part-time Accounting Coordinator. Lily previously worked part-time at a CPA firm as an Accounting Intern and tax preparer.

She has also served as Librarian, Leasing Agent, Sales Associate and Staff Accountant in her previous roles. She has obtained several certifications in accounting including an Associates in Applied Science in Accounting & Finance, an Income Tax Preparer Certificate, and an Accounting Software Certificate.

Along with her experience, Lily speaks three languages, English, Russian and Ukrainian. She is excited about this opportunity and looks forward to putting her previous education and experience to use in this position. Her hours are Monday – Friday, 10am – 3pm.

FAIR DEBT COLLECTION PRACTICE ACTS CONSUMER RIGHTS LAWS EXTENDED EFFECTIVE NOVEMBER 30, 2021 By: Christopher Loebsack, Loebsack & Brownlee, PLLC and Norm Praet, Brownlee Whitlow & Praet, PLLC As a preface, this article addresses the federal Fair Debt Collection Practice Act (FDCPA) and not the North Carolina Fair Debt Collection Practices Act (NCFDCPA). There are both significant similarities and differences between the two consumer protection laws.

Discussing these similarities and differences is beyond the scope of this article.

On November 30, 2021, two final Rules (combined totaling more than 600 pages) that were previously issued by the Consumer Financial Protection Bureau (CFPB) under the Fair Debt Collection Practices Act (FDCPA) took effect. Following is a summary of the pertinent parts of each Rule:

The first rule, issued in October 2020,

focuses on debt collection communications and clarifies the FDCPA’s prohibitions on harassment and abuse, false or misleading representations, and unfair practices by debt collectors when collecting consumer debt.

This Rule requires debt collectors who communicate electronically to offer the consumer a reasonable and simple method to opt out of such communications at a specific email address or telephone number. The rule also provides that consumers may, if the debt collector communicates through a medium of electronic communications, use that medium of electronic communications to place a cease communication request or to notify the debt collector that they refuse to pay the debt.

The second rule, issued in December 2020, clarifies what disclosures a debt collector must provide to consumers at the beginning of collection communications. The Rule also provides a model form that debt collectors may use to comply with the Rule’s requirements. This second Rule also prohibits debt collectors from suing or threatening to sue consumers on debt that is so old as to fall outside the applicable statute of limitations.

Additionally, this second Rule requires debt collectors to take specific steps to disclose the existence of a debt to consumers before reporting information about the debt to any consumer reporting agency.

The Final Rules apply to all “debt collectors” as they are defined by the FDCPA, but they generally do not extend to apply to “first

party” creditors who are merely collecting their own debts. The FDCPA defines a debt collector as any person who regularly collects, or attempts to collect, consumer debts for another person or institution or uses some name other than its own when collecting its own consumer debts. However, the FDCPA provides certain exemptions to who is or is not a debt collector. In a case involving the interpretation of the FDCPA, the Fourth Circuit Court of Appeals (in an unpublished decision) stated: Critically, the FDCPA excludes from the definition of “debt collector” “any person collecting or attempting to collect any debt owed or due or asserted to be owed or due another to the extent such activity . . . concerns a debt which was not in default at the time it was obtained by such person.” The Court went on to find that to the extent residential property managers begin attempting to collect the debts from their residents before those debts are in default, they may be excepted from the general “debt collector requirements”.

Based on this case, it is currently a generally accepted theory that the FDCPA should not apply to most (if not all) residential property management firms in North Carolina. However, as an unpublished decision, it is not binding precedent, AND courts in other jurisdictions have reached the opposite interpretation of this FDCPA language, finding that managers of residential rental properties are debt collectors within the FDCPA. So, there is reason for caution around what policies and practices you may want to employ in your operations. Until the Supreme Court has determined whether a residential property manager is (or may) meet the definition of “debt collector”, our understanding of who is and is not a debt collector must remain open to change in the future. We will keep you appraised of any new developments as these new Rules take effect across the Country, as well.

All that being said, there is one provision that allows a property manager to assist any future collectors of the resident’s debt. A property manager’s email communications can affect protections provided to a debt collector who the account may be referred the ApartMentor 2021 | Issue 4 9

to later on. The following steps are required of the property manager to trigger protection of the debt collector under this provision: 1) creditor obtained the email address from the consumer; 2) The creditor used the email address to communicate with the consumer about the account and the consumer did not ask the creditor to stop using it; 3) Before the debt collector used the email address to communicate with the consumer about the debt, the creditor sent the consumer a written or electronic notice, to an address the creditor obtained from the consumer and used to communicate with the consumer about the account, that clearly and conspicuously disclosed:

• that the debt has been or will be transferred to the debt collector;

• the email address and the fact that the debt collector might use the email address to communicate with the consumer about the debt;

• that, if others have access to the email address, then it is possible they may see the emails;

• instructions for a reasonable and simple method by which the consumer could opt out of such communications; and

• the date by which the debt collector or the creditor must receive the consumer’s request to opt out, which must be at least 35 days after the date the notice is sent.

4) The opt-out period provided has expired and the consumer has not opted out; and 5) The email address has a domain name that is available for use by the general public, unless the debt collector knows the address is provided by the consumer’s employer.

As a final reminder, the discussions in this article are limited to the federal Fair Debt Collections Practices Act and do not include the North Carolina Fair Debt Collection Practices Act. This article is not legal advice and should not be relied upon as such. You should seek guidance from legal counsel for any specific questions that you may have.

TAA Golf Tournament

After a year hiatus, the TAA Golf Tournament was held on Thursday, September 23 at the River Ridge Golf Club. The picture-perfect weather and new location provided a terrific opportunity for golfers, sponsors, and Special Events Committee volunteers to come together for a day of networking and fun on the links. Barone Meatball Company, Empire Eats & Magnificent Concessions Food Trucks provided lunch and dessert.

The event sold out in record time and included over 215 members and guests. Thanks to everyone who joined us! Your support and participation made the day even more special.

October After Work Networking On the evening of October 12, we

held our second and final After Work

Networking of the year. We gathered on the outdoor patio of RallyPoint Sport Grill in Cary, and were lucky enough

to have the most beautiful fall weather to accompany us. We had over 125+ guests in attendance, and had

scrumptious appetizers, corn hole, and

lots of good company to keep us entertained throughout the evening.

It was truly wonderful to see so many smiling faces under the glow of the

patio lights, especially after another

the triangle apartment association’s 2021 trade show

On Wednesday, November 3, we saddled up and were back in-person for our Trade Show at the NC State Fairgrounds. After a year’s hiatus, it was so nice to come together with our members and celebrate what many would consider their favorite event, the annual trade show. This year saw some changes that included a new floor plan, extended hours and an information booth in the lobby. And not only did our exhibitors get into the spirit, showing off their western wear, so did our attendees!

There were 110 Exhibiting Member Companies with 310 Exhibitors and 616 Owner/Operators. And while the show was a bit smaller this year, it allowed our attendees and exhibitors to spend more quality time chatting at the booths. Thank you to our Exhibitors, Attendees, Strategic and Premier Business Partners and Volunteers for making this show a success! A special thank you to the Special Events Committee for planning and presenting this event.

This year’s food vendors featured a variety of options that included something for everyone. Thanks to Danny’s Bar-B-Que, Hibachi Xpress, Moe’s Southwest Grill, NY Hot Dog & Catering and The Mac House.

Battle of the Baskets Fundraiser Yippee-ki-yay! Ace-high (first class), as they say in the good ole west, describes the baskets donated for this year’s fundraiser.

On November 3rd, the TAA Education Committee kicked off its 21st Battle of the Baskets fundraiser. Thirteen baskets were donated by members, including one from the Education Committee. TAA’s cowboys, cowgirls, and members hurdled up to purchase raffle tickets to support the foundation in hopes of being lucky enough to have their name drawn to win one of the baskets. The committee set a goal to raise $4,000. They exceeded that amount and raised $5,777.69 with proceeds to benefit the TAAEF Education Scholarship Fund. On behalf of the Education Committee, thanks so much! We are so indebted to TAA’s generous basket donors, members, and devoted supporters.

The TAA/TAAEF Education Scholarship Fund was established in 2001 to provide qualifying candidates the opportunity to further their career development. On Thursday, December 2, TAA hosted a Holiday Networking Party & Toys for Tots Collection at RallyPoint Sport Grill in Cary. We rented out the entire restaurant and patio for a private event, exclusive to TAA members only. The over 135 in attendance enjoyed being together for a relaxed evening of fun. Everyone was encouraged to wear festive attire and bring an unwrapped toy for our Toys for Tots Drive. The generosity of our members once again shined as we collected 296 toys, filling up 6 large donation bins. Delicious food was available throughout the evening and for dessert, holiday cupcakes were provided by The Kupkake Fairy.

TAA GOVERNMENT AFFAIRS YEAR-IN-REVIEW Inaugural Government Affairs 101 Session Held In the spring, the Government Affairs Committee hosted their inaugural Government Affairs 101 session to promote both the committee and the Association’s advocacy work to membership. The event was organized and produced by a team of volunteers from the Committee, who presented an

informative event covering varied topics including TAA-PAC, legislative day visits, the relationship between TAA and AANC and NAA and ways to get involved for members. Stay tuned for additional sessions in early 2022!

Housing Affordability Subcommittee Launches Earlier this fall, TAA officially launched a new subcommittee with a focus on housing affordability. The new Housing Affordability Subcommittee, which reports to the Government Affairs Committee, was created to provide a standing body which can review and provide advice on issues relating to Affordable Housing and housing affordability. Examples of issues which

will be addressed by the new group include rent stabilization and rent control measures, Housing Choice Vouchers-related policy, and inclusionary zoning among others. The group meets monthly and is open for any TAA member with an interest in affordable housing to join.

Priority Legislation Passes at the General Assembly After years of hard work and a sustained campaign by AANC and apartment association affiliates across the state, the General Assembly passed priority legislation which was signed into law by Governor Cooper in July. The legislation, SB 622, included three key areas of AANC’s legislative agenda: (1) clarification of recovery of out-of-pocket expenses and litigation costs in Summary Ejectments; (2) protection for

landlords from negligence claims related to a tenant’s criminal record; and (3) allowing a deceased tenants property to be collected or disposed of by affidavit. TAA Members participated in legislative visits to dozens of lawmakers in May and sent emails and made calls to support the successful campaign.

Ongoing Pandemic-related Support Year 2 of the COVID-19 Pandemic brought continued challenges to the industry in the form of further economic disruption and evolving legal and regulatory issues that continue to affect operations. In this context, TAA endeavored to provide regular, real-time updates to help our members navigate issues such as court orders, eviction moratoria, and public

health orders amongst others. TAA has also played a key role in liaising with local rental assistance program administrators and elected officials, advocating for a more streamlined assistance program with maximum reach. To date, member companies have recovered tens of millions in rental assistance dollars through these programs.

TAA’s Day of Service

On September 23, we held our 2021 Day of Service.

A group of amazing volunteers made up of TAA

members worked simultaneous shifts at both the Raleigh and Durham Food Bank of Central & Eastern NC.

At the Raleigh location, the volunteers formed an

assembly line to create food supply packs for those in need. They put the boxes together, stuffed the boxes

full of non-perishable food, and sealed them up to be de-

livered. At the Durham location, the volunteers sorted and packed produce.

Altogether, both

groups were able

to pack 9,877 lbs of food, which is the

equivalent of 8,230 meals! Fantastic

job TAA members! Thank you to everyone who was able to come out,

volunteer, and support our Day of Service! It is because of you that we are able to give so much back to our community.
