President’s Pen They say time flies when you are having fun and I cannot believe how quickly this year has gone by. It feels like I was just being sworn in at the January Dinner Meeting! TAA has been a busy place and I am so proud of all the accomplishments our association had this year. The committees, volunteers, and staff have all worked so hard. I am truly honored to have served as president for our membership, but it takes a village to make TAA successful. I’d like to take the time to brag a little on all the achievements we had in 2019! The Education Committee and TAA Education Foundation (TAAEF) raised $6,100 at their annual Battle of the Baskets fundraiser at the Trade Show. The baskets keep getting bigger and better each year. Thank you to those who donated! This money is distributed through education scholarships for members to receive their NAAEI credentials. This year 11 scholarships were given out to candidates. TAAEF also hosted their “Take 5” Breakfast Business Exchange Reverse Trade Show” and it sold out in record time – 44 minutes! The Government Affairs Committee had an amazing year and collected a record-breaking $23,988 in PAC donations from our members. This year also saw the creation of the PAC Board of Trustees. This board is made up of those who donated at the Vice President ($500) level or above. The board members also had the opportunity to interview candidates for our most recent local elections. The PAC money raised was used to endorse candidates based on their commitment to smart growth strategies, their focus on sustainable development, and their attention to the housing affordability crisis in our communities. This year, 79% of our endorsed candidates won their races. The Independent Rental Owners Committee continued to grow our member benefits by offering monthly
lunch and learns. Each lunch and learn hosted a speaker and topic relevant to their member type and their unique needs. Their monthly meetings are open to all TAA members. I encourage you to check out the topics and attend a meeting! The Membership Committee continued to grow the Ambassador program and helped to recruit 151 new members. TAA ambassadors assist new members to make connections and make the most of their TAA experience. Their Volunteer Appreciation Event was also held in January. The cocktail hour was to thank all our hard-working volunteers to help TAA make 2018 such a successful year. This year, the Membership Committee introduced our “Tour of Cities” networking events and they launched the “This is Us” membership engagement campaign for 2020! The PR and Community Outreach Committee had a very busy year. During the summer, they hosted a backpack drive to help local non-profits and schools. In addition, two days of service were held, benefiting the Food Bank of Central & Eastern North Carolina. Volunteers were able to sort food and pack boxes at both the Durham and Raleigh locations. The PR Committee also put together a task force to assist our A New Lease on Life partner, Family Promise of Wake County with renovations of one of their transitional housing apartments. Discounted and donated supplies were graciously given to us by several vendor partners to make this project successful. The goal is to complete the remaining 11 units in 2020-2021. The Products and Services Committee held its annual “Inside the Multifamily Mind” seminar with over 80 attendees. The seminar was made up of two panels of executive-level Service and Corporate Owner/Operators who answered numerous questions on how our vendor partners are better able to

communicate, service, and grow their businesses within our membership. The Special Events Committee worked tirelessly this year to host our annual Golf Tournament and After Work Networking Events. This year the Trade Show was moved to the Jim Graham Building and was able to accommodate 21 new booths. A familyfriendly Spring Carnival was added to the schedule and most recently they hosted TAA’s 35th Anniversary Celebration. The Anniversary Celebration was a glamorous affair where we celebrated everything TAA, including all 33 past presidents who served before me. I’m lucky to follow in such esteemed footsteps. The XCEL Committee is hosting a Happy Hour Headshots at the December 3 After Work Networking event at Wild Wings Café in Brier Creek. Make a monetary donation benefitting A New Lease on Life and get a free professional headshot! I can’t wait to see how our committees and volunteers outdo themselves next year! On Friday, November 1, over 410 members and guests came together and celebrated 35 years with the Triangle Apartment Association. The newly renovated Embassy Suites by Hilton Raleigh Durham Research Triangle Hotel proved to be the perfect backdrop for such an incredible evening. Guests enjoyed networking, dinner, a short program, and dancing. Special touches included a Jazz Musician, DJ, Live Event Painting, Photo Area, Photo Booth, and LOTS of photos for a trip down memory lane. The brief program highlighted special guests, event sponsors, a congratulatory letter from Governor Roy Cooper, the NAA-PAC raffle winner, a check presentation to the Food Bank of Central and Eastern North Carolina for disaster relief, a toast, recognition of the Association’s Executive Director and recognition of our 16 TAA Presidents that joined us for the event. Local Initiatives Raleigh Elections
Accessory Dwelling Unit (ADU) construction, allows duplexes in more locations, legalizes smaller houses and smaller lots, and changes zoning to allow for cottage court home clusters. Most importantly, the EHC represents the first attempt by any municipality in the region to seriously rethink their zoning code’s emphasis on singlefamily zoning and should result in more homes being built and Durham becoming a denser community.
Traditionally, TAA has not been a big player in local elections, but this year, we played a huge supporting role as we mobilized both TAA-PAC and our Super PAC, the Triangle Government Alliance and ran one of the largest political campaigns in the Triangle this election-cycle in support of our candidates. In the end, seven of our eight endorsed candidates won their races and the new city council that begins work in December will be a decidedly pro-growth group.
Durham Housing Bond The City of Durham recently passed the state’s largest-ever affordable housing bond with support from TAA. The $95 million bond will dramatically increase the city’s supply of affordable housing with the construction of an estimated 1,800 affordable units and the preservation or replacement of an
EHC in Durham Earlier this fall, TAA proudly supported the City of Durham on the Expanding Housing Choices (EHC) initiative. The package of land use reforms includes new rules that encourage
additional eight hundred others. In total, that would increase the stock of subsidized units by at least a third providing housing to thousands of Durhamites. The bond initiative is meant to complement the EHC initiative which was passed earlier this year by City Council, and together they represent a major step forward for the City of Durham in addressing housing affordability.
Project PHOENIX TAA continued its successful partnership with the Cary Police Department on Project PHOENIX, which is aimed at fostering the relationship between the Town of Cary and residents and staff at local apartment communities. This year TAA participated in three manager’s workshops in support of the program and will continue to look for opportunities to collaborate in 2020.

Affordable Housing Study Legislation
TAA took the lead in developing and lobbying for HB 796, which represents a sweeping reform of Emotional Support Animal regulations in North Carolina. The bill passed the North Carolina State House earlier in the year, and although it hasn’t yet passed the Senate, it seems poised for passage in
This summer, the General Assembly passed SB 316 which mandates that municipalities across the state conduct studies and make public data on their supply of affordable housing stock, and
what, if anything, they are doing to facilitate the creation of additional units. While TAA played no role in the development of the bill, we did lend our support to it and assisted in engaging AANC in the effort. The bill that ultimately passed will result in the creation of a new toolkit for groups like ours to lobby for policy changes across the Triangle.
Fundraising Initiatives TAA-PAC The TAA-PAC is closing out the most successful year of fundraising in its history. This year TAA-PAC raised $23,988, and the PAC Board of Trustees also partnered with NAA to raise an additional $6,115 for NAA-PAC. The unprecedented fundraising allowed TAA to endorse 19 candidates across Cary,
Durham, Morrisville and Raleigh with 79% of our endorsed candidates winning their races.
Launch of new 501(c)4 This year, TAA launched a new 501(c)4 Social Welfare Organization known as the Alliance for Progress in the Triangle. The group was active during

the most recent municipal electioncycle, and in the coming years, the group will be utilized as an Issue Mobilization Fund to advocate for industryfriendly positions on issues such as housing affordability, transportation and development. Stay tuned for more on this exciting initiative in 2020!
TAA’s Day of Service On October 10, 2019, TAA’s Durham Food Bank | 32+ Volunteers PR & Community Outreach Sorted food to feed 7,980 people hosted “TAA’s Day of Service” at the Food Bank of Central & Eastern North Carolina. This Day of Service was hosted in two locations simultaneously, giving TAA Members the choice of serving in Raleigh OR Durham. TAA members volunteered sorting potatoes and doing quality control of donated food, all to be given to families and individuals in need. Thanks to everyone who was able to attend and help out, our combined volunteer groups were able to box/sort enough food to feed 16,313 people!

The Triangle Apartment Association’s Education Foundation (TAAEF) held its “Take 5” Breakfast Business Exchange Reverse Trade Show on Thursday, September 5 at Brier Creek Country Club. This event sold out in a record time of 44 minutes with 15 vendor/supplier companies on a waitlist. Year after year, this event has proven to be a great platform for both, the vendor/supplier companies as well as the owner-management companies. Each of the 24 vendor/supplier companies paid to have the opportunity to meet with owner-management company executives who could make the buying decision. In other words, it was like networking and speed-dating with apartment industry execs! Each of the participating companies had 5 minutes to educate owner-management executives about their business, products, and services. This fundraiser raised over $30,000 with proceeds to benefit the TAAEF Education Scholarship Fund and A New Lease On Life. TAAEF President Terry Ragland along with the Foundation Board of Directors would like to take this opportunity to say thanks so much for your support and participation. DATA PRIVACY AND PROTECTIONS: What you don’t know that you signed up for! By Brownlee Whitlow & Praet, PLLC Reports of data breaches are so frequent in the news that we, as a society, are becoming de-sensitized to them. Based on a recent review, the author had information compromised in a data breach on ten different occasions! Currently, data breach laws are different in every state making it challenging for businesses who operate in multiple states. California has recently passed the most sweeping and, some would say, onerous data privacy protections modeled on the European Union laws. Due to this disparity between states, the National Apartment Association has included a national data privacy law among its top legislative priorities. Now that you are hopefully sufficiently concerned, we will look at the North Carolina Identity Theft Protection Act (ITPA). The ITPA was passed in 2005 and has not been changed in any significant way since then. Beginning in 2018, new bills were filed seeking to amend or replace the law in each session of the North Carolina Congress, but none have been successful. Primarily, the ITPA requires that businesses: 1) protect personal information such as social security numbers, 2) dispose of records in a manner that protects sensitive information, 3) institute policies to protect data, including employee training, 4) and notify affected North Carolina residents in the event of a data breach.
The first of the four requirements above is pretty straightforward. You must not disclose an applicant or resident’s social security number unless authorized to do so.

In the case of a breach, you should: 1) determine who is affected by the breach and what information was shared, 2) restore the security of your system, 3) notify the affected person(s), and 4) if more than 1,000 people are affected, you must notify the NC attorney general and consumer reporting agencies. The notice must be made without unreasonable delay unless law enforcement asks you to wait. The ITPA requires specific information that must be placed in the notice and provides information as to how the notice may be provided.
The third requirement simply requires you to train your employees in your procedures for proper destruction and maintain the official policies in writing.
Finally, a violation of the ITPA is considered an unfair and deceptive trade practice. So, failure to comply may result in significant penalties.
The final requirement is that residents be notified of a breach. A breach occurs when the following information is obtained by someone who should not have the information: First name, or initial, and last name, PLUS the social security number; driver’s license number, state ID or passport number; financial account numbers; etc. Disclosure of the following information will not be a breach: electronic identification numbers, electronic mail names or
