Use general language to describe rules or policies. For example: "No skateboarding on sidewalks" instead of "Children may not skateboard on sidewalks".

Take all reasonable accommodation requests seriously and involve legal counsel if you have any questions.

Government Affairs TAA Visits Capitol Hill | NAA Advocate Recap

In March, more than 700 members of the National Apartment Association converged on Capitol Hill for the annual NAA Advocate conference. Included in that number are nearly twenty representatives of the Triangle Apartment Association and dozens of our colleagues representing affiliates from across North Carolina.

Participants started off the conference with a briefing by the Congressional Management Foundation on best practices for making the most out of visits to Congressional offices. That discussion was followed by the Issues Briefing delivered

by NAA staff and focused on three policy priorities for this year’s Congressional visits: shaping infrastructure investments to better facilitate apartment construction, shoring up and protecting the National Flood Insurance Program, and making smart, common-sense reforms to the Section 8 Housing Choice Voucher Program to help incentivize private sector participation.

On Wednesday, March 13, conference participants converged on Capitol Hill for a full day of Congressional Office visits. Together, NAA members and staff visited the offices of all 535 members of Congress to talk about the issues facing the multifamily housing industry including the three main policy priorities outlined above. Members of the TAA Delegation visited our three area House Representatives: Rep. George Holding, Rep. David Price, and Rep. GK Butterfield. The TAA Delegation also participated in AANC-led meetings with Sen. Richard Burr and Sen. Thom Tillis.

During these visits, there were some great conversations, and hopefully, these meetings will help set a course for policy

changes that will be passed in the coming months. In the meantime, it’s important to continue the conversation by engaging with your local representatives. TAA Welcomes New Staff We are pleased to announce and welcome Jennifer Creech, CAM, NAAEI Faculty, as our Membership & Marketing Manager. Jennifer will market and sell Association membership benefits to companies who own or manage apartment communities and to companies who provide a product or service to the industry in the greater Triangle region. Additionally, she will work to retain and

TAA’s Day of Service TAA’s PR & Community Outreach hosted “TAA’s Day of Service” on March 21, 2019 at the Food Bank of Central & Eastern North Carolina. 83 TAA members volunteered sorting potatoes, labeling bags of pasta, and bagging peanut butter packets, all to be given to families and individuals in need. Thanks to everyone who was able to attend and help out, our volunteer group was able to bag 10,493 pounds of food and helped provide more than 8.417 meals with just 2.5 hours of work!

GOOD NEWS FOR EVICTIONS FEES!

By Brownlee Whitlow & Praet, PLLC On March 21, 2019, a federal court granted summary judgment to Camden Development, Inc. and its co-defendants finding that it legally charged the plaintiff for attorney’s fees and court costs related to an action for summary ejectment when the plaintiff failed to timely pay his rent in January, 2016 and dismissed the plaintiff’s related claims, as well as plaintiff’s application to make the lawsuit into a class action. Summary judgments are often difficult to obtain as a court must find that, based on the claims, there are no material facts in dispute, and that the party seeking a judgment is entitled to the judgment as a matter of law.

The basis for the ruling was in large part due to the “eviction fee” legislation, which we will refer to by its legislative designation, SB 224. SB 224 amended N.C.G.S. § 42-46, the law that governs a landlord’s ability to charge late, legal, and eviction fees. SB 224, championed by the NAA state and local affiliates, became effective on June 25, 2018. The defendants argued that SB 224 is merely a clarification that “eliminates any ambiguity” in N.C.G.S. § 42-46. The plaintiff argued that SB 224 “substantially and materially modified” N.C.G.S. § 42-46 and thereby has only or future effect under N.C. law. The court sided with the defendants (a/k/a the property owners and managers) and found that SB 224 clarified that the property owners may charge court filing fees, costs of service, and reasonable attorneys’ fees actually incurred. The court further found that because SB 224 clarifies, rather than changes N.C.G.S. § 42-46, it applies to actions instituted before SB 224 became effective.

To further understand this ruling, we’ll provide a brief outline of the court’s reasoning as follows:

1) If SB 224 intended to “change,” rather than clarify N.C.G.S. § 42-46, it would only apply to fees charged after it was passed in 2018, but if SB 224 was intended to clear up or “clarify” N.C.G.S. § 42-46, then it would apply to all fees charged previously under N.C.G.S. § 42-46; 2) Prior to SB 224, N.C.G.A.S. § 42-46 provided that it was illegal to collect fees not provided for in the statute, but the statute was not clear as to what fees were allowed;

1) You can only recover attorneys’ fees if allowed by statute, and a N.C. statute allows for recovery of attorneys’ fees if there is a written instrument showing an obligation to pay money and the money is collected through an attorney in an action reasonably related to an to collect a debt; and 2) An eviction action, even when not seeking a money judgment, is reasonably related to an attempt to collect a debt.

As we have not yet reached certainty in this evolving issue, you should still seek legal advice and review of all policies related to charging fees related to evictions as the law continues to develop.

3) Because, prior to the passage of SB 224, N.C.G.S. § 42-46 was unclear as to what fees were permitted to be charged including whether and when the court costs and attorneys’ fees could be charged surrounding an eviction, SB 224 clarified, rather than changed when court costs and attorneys’ fees could be charged. Therefore, all fees provided under SB 224 were legally chargeable prior to 2018; and 4) Additionally, as SB 224 was passed after and in response to a Wake County Superior Court judge’s ruling, it was further evidence that the law was intended to clarify the fees that were allowed to be charged under SB 224. the ApartMentor | April-May 2019 20

Although this is a very positive ruling for all of the North Carolina “eviction fee” cases, unfortunately, it is not yet “game over” for the eviction fee litigation, not even in the Camden action.

This is because the ruling was from a trial judge and can be, and likely will be, appealed. Hopefully, this will be the beginning of a trend for rulings in the eviction fee cases.

As we have not yet reached certainty in this evolving issue, you should still seek legal advice and review of all policies related to charging fees related to evictions as the law continues to develop.

This is especially important as further legislative clarifications will be sought in the 2019-2020 legislative sessions.

We will continue to keep you informed as the lawsuits progress. It is our understanding that the Wake County judge’s decision, referenced above as a reason for SB 224, will have a hearing seeking its reconsideration shortly.
