LEGAL MATTERS CORNER

Sophie was married to Jim when they were really young. In all they have been married ten years. They have both developed in different directions personally and have decided that they should go their separate ways and obtain a divorce. They have effectively been living separate and apart for about 3 years in the one house which they bought during the marriage. They own their own home together and have €100,000 left on the mortgage. They have no children. They both have good jobs and pensions. They have no sorted out their separation arrangements yet.

The best way if parties cannot agree immediately the financial separation arrangements is to go to mediation to sort out the financial and other arrangements. This means sitting down with a mediator who will help the parties to come to an agreement. Mediation is provided through a government funded service which is a great help to separating couples. There are several ways that Sophie and Jim could go about matters either one or other buying each other out of selling the property and dividing the proceeds usually 50/50 after deduction of sale costs. If one party decides to buy out the other, they could help the other with a little bit extra to facilitate the move. So, there are various options that could be looked at to see which solution best suits the parties. The issues of maintenance if applicable, pensions and financial costs of separation will all be looked at and examined in detail. Mediation is solution focused and leaves the power in the hands of the parties. It is extremely cost effective as the service is free and the service requests a voluntary donation

only. If the parties cannot agree matters between them and are at loggerheads it may have to go to court with consequent large costs, expenses and stress. Throughout the mediation process both parties should have access to legal advice to make sure what is being proposed is fair and reasonable

Once the parties agree arrangements in Mediation, they take it to their solicitors who put in place the agreement which then is the basis of consent divorce proceedings. They have the required two out of three years separation which can also apply where parties can prove that separation in the one house. The parties will sign a consent agreement in the presence of their separate solicitors with independent legal advice. One or other solicitor will then institute the consent divorce proceedings through the court services and the other solicitor will put in a document known as an appearance and the matter can then be listed before a judge for hearing. Full affidavits of means ideally need to be available from both parties for the court hearing as the Judge needs to ensure that proper provision has been made for all the parties. He also needs to be shown that there are the two years separation out of three years marriage and that there is no chance of reconciliation. The Divorce order as well as giving the right to remarry would also provide usually provide that neither party has an interest in each other’s pension funds or property after divorce and financial arrangements and cannot apply for an order for a share of the other’s estate after their death.

Minister Norma Foley Welcomes Funding for 196 Kerry Community Groups, Including Several Tralee Organisations

Minister for Children, Disability, Equality and Kerry TD, Norma Foley, has welcomed confirmation of €118,000 in funding for 196 community groups across Kerry under the Local Enhancement Programme 2025. This round of funding provides small-scale grants for community-based projects, including IT upgrades, minor building renovations, and operational support.

Launched in November 2024, the programme offers €7 million nationally and is administered by Local Community Development Committees with support from Local Authorities.

The funding aims to strengthen the work of grassroots organisations that make a tangible impact in their local areas.

Several Tralee-based groups

are among this year’s recipients, reflecting the town’s vibrant community spirit and volunteerism.

These include:

• Tralee Dynamos AFC, receiving €1,600 to enhance local sports facilities.

• Tralee Tidy Towns, awarded €1,300 to continue their work improving public spaces.

• Tralee Pipes & Drums – St. John’s Pipe Band, granted €1,700 to support cultural and musical activities.

• Austin Stacks GAA Club, awarded €1,871 to strengthen one of Tralee’s most historic sporting organisations.

Minister Foley praised the programme as “an endorsement of the incredible voluntary work happening in every corner of our county.”

She added: “These groups are the beating heart of our communities and this funding allows them to continue their invaluable contributions.”

The funding also supports a wide range of groups from across Kerry, from heritage centres to youth clubs and sports teams, all working to enhance community wellbeing and inclusion.

James Finnegan Honoured with Major Toastmasters Award and Plans Daring Fundraiser for Debra Ireland

Tralee’s own James Finnegan has reached the pinnacle of achievement in Toastmasters International by earning the Distinguished Toastmaster (DTM) award—its highest honour—in just over four years. Recognised for exceptional leadership and communication, James was praised by Toastmasters CEO Daniel Rex for “helping others in their self-development efforts.”

To earn the DTM, James completed two advanced education paths in Motivational Strategies and Leadership Development, while also holding leadership roles at local and regional levels across the UK and Ireland. His dedication also earned him two personal awards from District 71: Vice President Public Relations of the Year in 2021 and the Above and Beyond service award in 2024.

Beyond Toastmasters, James is a familiar face in Tralee’s cultural and community life, contributing to local festivals, fundraising efforts, and performance events. His voluntary spirit was recognised last year with a Civic Award from Tralee Municipal District and Kerry County Council.

James is also co-curator of TEDxTralee, returning to Siamsa Tíre on 18 October 2025. The conference has reached over 3.25 million viewers worldwide.

To mark his DTM milestone, James is abseiling 140 feet from Croke Park on Friday, 27 June, raising funds for Debra Ireland, which supports families affected by the rare skin condition EB. Donations can be made on James’s Facebook page or via iDonate.

“I wanted to mark this achievement with something bold,” said James.

MEDICAL CORNER

Dr Pieter van der Merwe answers your medical queries

Q: I HAVE BEEN RECENTLY DIAGNOSED AS SUFFERING FROM HIGH BLOOD PRESSURE ...CAN YOU GIVE ME A SIMPLE EXPLANATION?

Tom, Ardfert

Dr Pieter says: Understanding Hypertension

Q: What is hypertension?

A: Hypertension, commonly known as high blood pressure, is a condition where the force of the blood against artery walls is consistently too high. It's often called the “silent killer” because it usually has no symptoms but can lead to serious health issues like heart disease, stroke, and kidney failure if left untreated.

Q: What causes hypertension?

A: Hypertension can be caused by a mix of genetic and lifestyle factors. Common contributors include obesity, lack of physical activity, high salt intake, excessive alcohol consumption, smoking, stress, and certain chronic conditions like diabetes or kidney disease. In some cases, there’s no identifiable cause—this is known as primary hypertension.

Q: How is hypertension diagnosed?

A: Blood pressure is measured using a cuff placed around the arm. A reading of 130/80 mm Hg or higher is considered elevated. Doctors may require several readings over time to confirm a diagnosis.

Q: Can hypertension be managed or cured?

A: While there’s no cure, hypertension can be effectively managed. Lifestyle changes such as eating a balanced, low-salt diet, exercising regularly, limiting alcohol, quitting smoking, and managing stress are key. In some cases, medication may be necessary to keep blood pressure under control.

Q: Why is managing hypertension important?

A: Uncontrolled hypertension significantly increases the risk of life-threatening conditions like heart attacks, strokes, and heart failure. Managing it not only improves quality of life but also extends life expectancy.

Q: When should someone see a doctor?

A: Adults should have their blood pressure checked regularly. If you experience symptoms like severe headaches, vision problems, chest pain, or difficulty breathing, seek medical attention immediately.

Bootcamp Blitz: Rose Escorts Face Fun, Fire & Freezing Dips in Wild Kerry Weekend

There were flips, flops, and plenty of laughs as 32 of Ireland’s top gents arrived in Kerry for the legendary Rose Escort Bootcamp—an actionpacked weekend of endurance, charm, and unexpected surprises. Once welcomed at the Meadowlands Hotel in Tralee, the hopeful Escorts kicked off their whirlwind journey with photos and intros—before the real adventure began. Over 48 adrenaline-fuelled hours, the group journeyed across

Kerry, testing their stamina and their teamwork.

Highlights included scaling Mount Brandon with Irish Adventures Dingle, a visit to Paudie O’Sé’s pub, and “educational” tastings at Dingle Distillery. Their sea legs were then tested on a dolphin tour around Dingle Bay, followed by a BBQ and singalong at Paul Geaney’s—where impromptu boyband auditions were rumoured to break out.

Sunday morning brought a

traditional Kerry wake-up: a jog and dip at Banna Strand led by Seán O’Connor of Beachfit. From there, the group headed to Tralee Fire Station for training with Kerry Fire & Rescue—proving Rose Escorts need more than a nice suit! Professions ranged from teachers to farmers, radiographers, and even a Forbes 30-Under-30 entrepreneur. Cork and Dublin lead the count with four Escorts each, with Kerry and Meath close behind. One Escort

even flew in from California! The bootcamp wrapped with brunch and phone reunions, just in time to prepare for August’s big event. Escort of the Year Barry Lysaght reminded them: “This is where friendships start and nerves fade. Tralee in August is unforgettable.” The 2025 Rose of Tralee Festival runs August 15–19. Aghadoe Heights Launches Laid-Back

Family Sunday Lunch where Kids go Free

Aghadoe Heights Hotel & Spa is putting a fresh spin on Sunday dining this summer, with the launch of a new family-friendly lunch offering in its Heights Lounge – and a generous deal for parents.

Starting this weekend, the five-star hotel overlooking the Lakes of Killarney will offer complimentary kids’ meals from the hotel’s newly updated kiddies’ when two adults dine from the Heights Lounge Sunday Lunch menu. The offer is open to children aged 12 and under and includes a starter, main, and dessert from the kiddie’s menu.

As part of the refresh, a classic Sunday Roast will also be introduced to the Heights Lounge – a welcome addition for locals and guests looking for a more relaxed alternative to the hotel’s formal Lake Room.

“We know families are looking for something easy and enjoyable on a Sunday, especially during the summer when things are a little more laid-back and they have more time to get out and about,” said General Manager Brian Bowler. “The Heights Lounge is the ideal spot – it’s elegant but informal, with unbeatable views and now, a Sunday roast the whole family can enjoy for a great deal.”

The Kids go Free offer runs every Sunday from 12:30pm to 3:30pm from now until the end of August.

Conor Kelly Named 2025 School Spirit Award Winner at Scoil Eoin

Scoil Eoin celebrated the presentation of its prestigious School Spirit Award 2025 in a special ceremony held in the school yard this

morning. Students gathered under the guidance of the Student Council, Mr. O’Toole and Mrs. O’Donoghue, as anticipation built for the annual announcement.

This year’s award was presented to Conor Kelly, a 4th class pupil from Mrs. Healy’s class, in recognition of his quiet leadership, respectful manner, and kindness to others. Conor was nominated

for his gentle, unassuming nature and strong sense of fairness— qualities that earned him unanimous support from the Student Council. The School Spirit Award, first introduced in 2016 by the Student Council and Mr. O’Toole, is designed to honour a student who consistently promotes inclusiveness, respect, and exemplary behaviour. It is not based on academic achievement but rather on the positive impact a pupil has on the school community.

Each teacher nominates one student from their class, and the Student Council reviews the anonymised nominations to ensure fairness. This year, all nominees received medals for their outstanding contributions.

Three Generations Bloom at Féile na mBláth’s 20th Anniversary

The vibrant Féile na mBláth festival marked its 20th anniversary in style this year, with stunning displays of floral artistry and community spirit at its heart. Among the standout moments was Tralee native Michelle Kerins winning the coveted Best in Show trophy in the “Meadow of Joy” category.

Michelle, a dedicated member of the Tralee Flower and Garden Club, has entered the festival’s annual Flower Festival every year. Organised by Anne Sullivan of the Tralee Flower

& Garden Club in collaboration with Kerry County Council’s Tralee Municipal District, the festival has become a much-loved tradition celebrating horticultural creativity.

This year’s event was a true family affair for Michelle, with three generations of her family taking home prizes. Her mother, Helen McElligott, and daughter, Roisín Kerins, also received awards— making the occasion all the more memorable.

Bookings are recommendedcall +353 64 6631766 or email reception@aghadoeheights.com. For more see aghadoeheights.com

Speaking after the event, Michelle described the festival as “a fantastic, successful celebration with something for everyone.” Her winning display in the “Meadow of Joy” captured the spirit of the festival perfectly, blending colour, imagination, and nature.

The Féile na mBláth continues to flourish as a highlight of Tralee’s cultural calendar, bringing families, gardeners, and flower enthusiasts together in celebration.

Conor was visibly surprised and emotional as Mr. O’Toole announced his name and presented the trophy. His parents, Loretta and Richard, had been secretly invited and joined him in the yard after the announcement, alongside his proud brother James, a 6th class pupil.

Conor now joins previous winners Grace, Luke, Tomás, Leon, Philip, Ella, Rían and Alan on the Scoil Eoin School Spirit Plaque, a testament to his role as a true ambassador of kindness and integrity within the school.Photo ; Carol Anne O Donoghue Student council coordinator, The winner Conor Kelly, his parents Loretta and Richard and brother James, class teacher Mrs. Laura Healy and Mr. O’Toole.

JRIA Tralee awards $35,000 USD in grants to local charities

JRI America (JRIA) Tralee recently welcomed three local charities to its office to present $35,000 USD in grants. The charities each received a share of the total amount from the SMBC Global Foundation, part of JRIA’s parent company Sumitomo Mitsui Banking Corporation (SMBC). The SMBC Global Foundation, the philanthropic arm of SMBC Americas, celebrated its 30th anniversary in 2024 by awarding several grants to charities representing the causes most important to SMBC employees. At JRIA Tralee, an employee vote selected three local charities to receive grants in the region: Kerry Hospice, Recovery Haven Cancer Support House, and Kerry Mental Health Association (KMHA). At the cheque presentation, the charities shared how they will use the grants to improve the

community – including providing transportation for people to attend KMHA’s outreach centres, supporting acupuncture services for clients at Recovery Haven, and contributing to a five-bed expansion programme at Kerry Hospice. JRIA has operated from its Tralee site since 2011 and employs nearly 250 people across a range of IT-related disciplines. JRIA is proud to support local community-based activities, and its staff are encouraged to engage in volunteering when time allows. Numerous beach cleaning, litter-picking and tree planting events have been undertaken to support local community groups and foster a healthy workplace culture.
