Bert owns a house in the town centre which he purchased in 2000. Just beyond the boundary of his garden is a small patch of waste land owned by Ernie who lives abroad. Since 2000, Bert has been parking his car and from 2002 began cultivating the waste land as a garden and constructed some temporary sheds and a wall around the land. In 2022, Ernie returned for a holiday and wrote to Bert offering to lease the land to him. Bert responded that he would consider the offer. There has been no further correspondence until this month (December 2025) with Ernie threatening to evict Bert as he is trespassing, and Ernie wants to sell the land to developers for parking for a nearby apartment block that is being built. Both parties would need to be aware of the principle of adverse possession often commonly referred to as ‘squatters rights’. Adverse possession arises where a person is in sole and exclusive occupation of land without any acknowledgement of the legal owner and that occupation is inconsistent or adverse against the title of the true owner.
When making a claim for adverse possession the court will usually need to consider the following two questions:
• Is there a continuous period of 12 years during which the squatter was in exclusive possession of the lands in question to an extent sufficient to establish an intention to possess the land itself And
• Is any period of possession broken by an act of possession by the landlord? If so, the time will only start again when the act of possession of the landowner terminates.
When assessing the second question courts have found the act of possession required for the landowner to break possession is a very low threshold. Certain acts of possession on the part of the landowner such as painting the property, mowing a patch of grass, planting something or in another case just surveying and keeping an eye on the land have been sufficient to break the possession of the squatter. Ernie writing to Bert asserting his ownership of the land and offering him the opportunity to rent the land and continue to utilise it as a garden may constitute an act of possession along side Bert replying to Ernie’s offer to rent the land may reset the limitation period, which starts to run a fresh from the date of the acknowledgment of the title of the true owner. There is also a question over when Ernie become aware of Bert’s possession of the land as Ernie does live abroad. Section 7 of the Statute of Limitations 1957 Act states that the period of possession shall not begin to run until the owner has discovered the fraud or could with reasonable diligence, have discovered it. As mentioned, although the threshold is low for positive acts demonstrating continued use and ownership by the landowner. Most importantly a landowner must act promptly once they become aware of the squatting, ideally within the 12-year window, to avoid their title to the land being extinguished.

Dr. Susan Lawlor of State of Mind Ireland has been honoured with the HiStyle Gold Award 2025 for Mental Health, a national recognition celebrating outstanding professionals in health, fitness, nutrition and wellness. The awards, held on November 22nd at the Radisson Blu Hotel & Spa, Little Island, Cork, showcased the very best across sectors including counselling, coaching, physiotherapy, wellness, fitness and alternative therapies. With hundreds of nominees nationwide — including 90 counsellors and counselling centres
— Dr. Lawlor was named the overall winner, a testament to her exceptional impact and reputation within the community.
HiStyle praised her work as “a reflection of dedication, compassion, and resilience,” adding that she has “saved countless lives and continues to help many remain safe in an everchanging world.” She was described as “a shining light in so many people’s darkness, carrying out her work with humility, respect and dignity.”

Joan Reynolds Cleaning has announced that the business is fully booked for the entire month of December. A cancellation list is now in place and will operate strictly on a first-come, first-served basis across all services.

Two outstanding Munster Technological University students, Nicole Horgan and Shingirai Mushayakarara, have received the Social Care Ireland Award for Academic Excellence at MTU’s recent graduation ceremony.
Tralee native Nicole Horgan completed her BA in Social Care in June 2025 and now works as a Social Care Pedagogue with Compass Child and Family Services. During her degree, she completed placements at Shannow Family Resource Centre and Compass.
Shingirai Mushayakarara, originally from Zimbabwe and now living in Ballyheigue, returned to education in 2022 as a mature student. She is currently completing her one-year add-on honours degree in Social Care at MTU Kerry. Her professional practice experience includes placements with Enable Ireland and Novas Homeless Services.
Congratulating both students, MTU spokesperson Dr Patrick McGarty said the awards reflect their dedication and the support of their lecturers and practice educators. Minister for Children, Disability, Equality and Kerry TD Norma Foley has welcomed confirmation of €6.3 million in funding for MTU from the Technological Enhancement Fund.
The Technological Enhancement Fund will see funding disbursed to the institutions this year for projects commencing in January 2026. Projects will operate over a 36-month period to 31 December 2028.
MTU, which has 18,000 students across its campuses in Cork and Kerry, will be able to use the funding for assisting student success, digital capability and security, and climate and sustainability. Minister Foley said: “This funding will be a great boost
for students and staff in the MTU campus in Kerry. I look forward to the campus continuing to grow and develop in the coming years.” The investment will be used by MTU to advance digital transformation and business intelligence, support student success and engagement, increase professional development opportunities for staff, and support the attainment of Climate Action targets including monitoring of and reporting on Climate Action Roadmaps. Additionally, the fund will be utilised to support collaborative activities including the development of solutions to enhance academic integrity, enhance TU data infrastructure and business intelligence and prepare for further developments in AI.

These heroes are individuals and groups who have shown outstanding community spirit, courage, vision and leadership in the last 12 months here in Kerry. They make us proud to be of Kerry. There will be eight award recipients and each will receive a personalised plaque to display in their home or business.

Kerry’s Active Retirement bowls players proved that age is no barrier to top-class competition as they claimed two major honours at the 13th annual Active Retirement
Ireland National Bowls Competition, held last week at the Gleneagle INEC Arena in Killarney.
Tralee Indoor Bowls Club’s Margot Lyons, Pat O’Mahony, Steve Renardson and skip Eddie Wall captured the 2025 Large Bowls Plate, while Milltown’s Willie O’Shea, Mike Long, Paddy Lawlor and skip Kevin Coleman secured the runnersup prize in the Large Bowls Cup. Both teams received their awards from Active Retirement Ireland
National President Mai Quaid and CEO Fran Brennan at Thursday’s closing gala.
Milltown’s Mike Long also earned
the prestigious 2025 Pat Cussen Prize, chosen by fellow competitors for embodying fair play and friendly spirit.
Teams from Carlow, Cork, Kildare, Waterford, Westmeath and Wexford were also recognised following three days of competition involving 64 four-person teams, including 17 from Kerry.
CEO Fran Brennan praised participants for showcasing the energy, connection and determination of older people nationwide, and thanked sponsors Hidden Hearing and hosts the Gleneagle Hotel for supporting the event. Active Retirement Ireland supports 516 local groups, including several across Kerry.

Woodie’s colleagues in Kerry are celebrating after raising more than €12,000 as part of the retailer’s 2025 Woodie’s Heroes campaign. The Tralee store alone collected an impressive €12,389, thanks to the generosity of customers, colleagues, and suppliers.
The annual fundraiser, now in its eleventh year, supports four national children’s charities: Autism Assistance Dogs Ireland, Cancer Fund for Children, Childline by ISPCC, and Down Syndrome Ireland. This year’s campaign brought in a remarkable €598,205, bringing the total raised since the initiative began in 2015 to €4.7 million. All funds collected are distributed equally
among the partner charities, helping them continue their vital work with children and families across Ireland.
Woodie’s CEO, Damien Dwyer, praised the commitment shown by staff nationwide. He said the success of Woodie’s Heroes reflects the dedication of colleagues across all 35 stores and the consistent goodwill of customers and suppliers. “Woodie’s Heroes has become a proud part of who we are,” he noted, adding that the initiative has made a “real and lasting difference” to those the charities support.
Dwyer also highlighted Woodie’s wider community efforts, with colleagues volunteering 263 days this year to local charities. These

initiatives, he said, underscore Woodie’s long-standing commitment to supporting communities throughout Ireland.

The festive season has officially begun at the Mounthawk Montessori Group, as the children and staff of Maureen’s Childcare launch their Meals on Wheels and St. Vincent de Paul Annual Christmas Fundraiser 2025.
Families are warmly invited to take part in a series of Singalongs with Santa, with events taking place across all three centres in the coming week. The celebrations begin on December 8th at 10:30am at Mounthawk Montessori School & Busy Bees Nursery, followed by a second gathering on December 12th at 10:30am at Maureen’s Childcare, Casements Avenue. A third singalong
will be held on December 11th at 2:40pm at Before The Bell, The Lodge, Balloonagh.
As part of the fundraiser, the group is appealing for donations of non-perishable food items, while monetary contributions—though optional—are also welcome. All proceeds and goods collected will support vital local services during the Christmas season.
Organisers say the spirit of the initiative is rooted in community and generosity. “The true magic of Christmas is in the giving,” staff noted, adding that they look forward to celebrating with families across all three centres.

The U16 end-of-season celebration and medal presentation took place in the Brogue Inn on November 30th, marking the close of a successful year. Medals for Tralee/ St Brendan District and Central League Division 1 were presented. Thanks were extended to all mentors, parents and supporters.
In the Corn Uí Mhuirí, The Green defeated Mercy Mounthawk 1-22 to 1-10, progressing as group winners to the quarter-finals. Rock players featured on both panels. In the O’Sullivan Cup final, Tralee CBS
edged St Brendan’s 2-12 to 2-11, with several Rock players involved.
Austin Stacks players lined out for Mercy Mounthawk in their Russell Shield final win over St Brendan’s Killarney, 6-9 to 4-12, after an excellent high-scoring game.
Rock players represented Tralee CBS in their narrow Frewen Cup loss to St Brendan’s. Clonakilty CC now face St Brendan’s in the final.

Kerry FC have confirmed the signing of midfielder Vincent Borden from Galway United ahead of the 2026 campaign.
The 26-year-old New York native arrives with major experience, having made 96 appearances for Galway United since 2023, including more than 50 in the Premier Division. He played a key role in Galway’s 2023 First Division title win, scoring 10 goals, and later helped secure their top-flight status in 2024 and 2025.
Borden previously lined out for New York Red Bulls and Slovenian side NK Rudar Velenje. Speaking about the move, Borden said he is excited to join Kerry FC and eager for a strong start to the season. Manager Colin Healy welcomed the signing, praising Borden’s proven quality and experience.

Minister for Children, Disability, Equality and Kerry TD Norma Foley has welcomed confirmation of of €696,000 in funding for Kerry projects under the 2025 CLÁR programme
The CLÁR programme provides funding for enhancement of existing community facilities and the provision of new amenities to support young and old across a range of services.
The projects receiving funding include €100,000 for Dingle GAA to develop a walkway and a building for young people, €99,990 for the upgrade of Tarbert public toilets and €65,000 for Causeway Comprehensive School to upgrade a hurling wall. A full list of the 10 projects receiving funding is attached.
