LEGAL MATTERS CORNER MIRIAM MC GILLICUDDY ANSWERS YOUR LEGAL QUERIES Curiouser and Curiouser Some fascinating legal cases The Oxegen Festival Mud Case (Ponisi v. MCD) A concert-goer broke his ankle at the Oxegen music festival at Punchestown Racecourse after his foot got stuck deep in the mud. He sued the concert promoters (MCD) for negligence. The court ruled in against the concert-goer. The judge noted that the organizers could not reasonably control the weather or keep an 80,000-person outdoor site completely mud-free after weeks of heavy rain. The decision established that event organizers are only required to take reasonable steps for safety, not impossible ones. The Monkey Selfie Case: A photographer was photographing Celebes Crested Macaques. He left his camera unattended and a curious monkey came up and took photos with the camera. There ensued a huge copyright battle over whether the photographer had copyright in the photos or were they public domain and free to use. Despite efforts by PETA copyright ownership by a monkey was denied by the courts. The photographer could prove his copyright through the development and processing of the photographs but an interesting legal conundrum all the same. Law Consultation: An owner of a chipper complained of the Seagulls who were dive bombing his customers for their chips – he called them “gangs of aerial hooligans” and wanted to sue them

for theft and harassment. His advisor had to tell him that this was not possible in law as they were wild animals not in the custody of anybody except the skies Nullity: A judge has annulled a marriage where the bride was tricked into going along with what she believed was a fake wedding organised as a social media prank. Catnapped: A judge has imposed a fine of more than €1,000 on the owner of a cat for trespassing into a neighbour’s garden — with further fines threatened for future transgressions. Shades of Halloween: This reached the headlines when a woman dressed in a full sumo wrestler suit was accused of assaulting her ex-girlfriend in a gay pub. The confrontation apparently started after the ex-partner waved at a man who was dressed up as a Snickers chocolate bar. Bathroom Breaks: An employer defended a case of firing a worker after tracking his habits and was able to prove that he had spent up to six hours of his standard eight-hour daily shift hiding out in the bathroom. The court ultimately ruled that the employer was entitled to dismiss the worker. Bombscare: Two men, Aaron O’Neill and Colin Hammond, decided to phone in a fake IS bomb threat to Intel in Leixlip as they didn’t want to go to work. The prank caused massive disruption for about 4,000 staff members and the company production. Both men received a two-year suspended sentence each along with community service. Lawquip: Hearsay is gossip wearing courtroom shoes.

Circus takes over Tralee: NCFI returns for 26th year Tralee is about to get a lot more daring. The National Circus Festival of Ireland (NCFI) is back from 5 to 8 November, with four days of acrobatics, absurdity and spectacle. Tickets run from €5 to €70 at www. circusfestival.ie. Acts from Czechia, the UK, Japan, Germany and Ireland will bring their hand-picked best to town, in what organisers call a celebration of contemporary circus that thrills and challenges.

The big night: Friday 6 November The festival’s showpiece is Endurance Above the Ice, a promenade spectacle from Elisa Gallo Rosso and Cork Puppetry Company. Inspired by Shackleton’s Antarctic expedition, in which Kerry’s Tom Crean played his part, it sets off from St John’s Church on Ashe Street at 6pm and finishes outside the Ashe Memorial Hall, with fireworks to follow. Festival Director Con Horgan says he is “excited

beyond measure”. At 8.30pm, Siamsa Tíre hosts Yes Person, a satirical, experimental show from Inka and Imogen of Based on Kimberly, billed as “new wave, new wonk circus”. Saturday 7 November Family variety show Circus Siamsa runs at 2pm and 5.30pm, with aerialists, jugglers and a professor of bubbles. At 9pm, St John’s Church stages 5x5, in which five female circus artists test brand-new work in front of a live audience, hosted by Kim McCaffery.

More to catch A four-day convention offers more than 45 workshops, at KDYS Hall on Denny Street on Thursday and Kerry Sports Academy from Friday to Sunday. Thursday’s film night at 9pm in St John’s Church screens Circus Is for Every Body, a documentary about Galway families, for €5, free with a convention ticket. Friday’s Future Producer Industry Day at

Kerry Sports Academy is held with Promenade Cork. Horgan promises there will be “no

Tralee Shines Again as Community Effort Earns National Honours Community pride and year-round teamwork have put Tralee firmly in the national spotlight, with the town celebrating another outstanding performance at the SuperValu TidyTowns Awards in Croke Park. Tralee retained its title as Ireland’s Tidiest Large Urban Centre for the second successive year and secured a remarkable 14th consecutive Gold Medal. The town also claimed the South and West Regional Award,

alongside special recognition for dementia-friendly initiatives, greenways and pollinator projects. Representatives from Tralee Tidy Towns, Tralee Chamber and Kerry County Council gathered on Sunday evening to celebrate with the trophy. Chamber CEO Colette O’Connor praised the volunteers, businesses and organisations whose shared commitment continues to make a difference. She highlighted the town’s willingness to work together and the dedication behind its achievements. Tidy Towns chairperson Brendan O’Brien said the awards reflected contributions from across the community. He acknowledged Kerry County Council’s Tralee Municipal District for its ongoing support and town-centre improvements, alongside Team Bramble, Friends of Able CE Scheme, local businesses, schools, the ETB, MTU and the growing volunteer team. The Dúlra Thrá Lí project received particular praise after winning the

Department of Transport Greenway Special Award. Community groups and individuals helped deliver its biodiversity action plan for the Tralee–Fenit Greenway, with further involvement encouraged in 2027. With celebrations continuing, the focus remains firmly on building a vibrant, sustainable and inclusive

Tralee. These latest honours celebrate much more than appearances: they recognise a community working together to make its town better for everyone. Ní neart go cur le chéile.

MTU honours Sister Consilio and Jimmy Deenihan at Kerry conferrings Munster Technological University has conferred honorary doctorates on Cuan Mhuire founder Sister Consilio and former Government minister Jimmy Deenihan, recognising their contributions to Irish society, community development and public service. The awards were presented at MTU’s autumn conferring ceremonies at its Kerry North campus in Tralee on 23 October.

Raised in Brosna, Sr Consilio founded Cuan Mhuire in Athy in 1966. Over six decades it has grown to offer services across Ireland for people affected by addiction and their families. She has received many honours, including Kerry Person of the Year. Unable to attend, she was

represented by her sister, Sr Agnes Fitzgerald. Finuge native Jimmy Deenihan taught at Tarbert Comprehensive School before serving in the Seanad and Dáil and as a minister for arts and heritage and for the diaspora. He helped secure funding for what is now MTU’s Kerry South Campus in Tralee and chaired the university’s Governing Body from 2021 to 2025. MTU President Professor Maggie Cusack said both had made a lasting contribution, with Sr Consilio offering hope to people facing addiction and Deenihan championing education and community development. Sr Consilio said she accepted the honour on behalf of everyone who had been part of the Cuan Mhuire

journey. Deenihan said he hoped MTU could act as a bridge between Kerry’s global community and the

region, turning goodwill into student bursaries and new opportunities.

Scoil Eoin donates 340 Christmas shoeboxes to Team Hope The Scoil Eoin community of pupils, parents and friends has once again shown its generosity, collecting 340 Christmas shoeboxes filled with gifts for Team Hope, despite the rising cost of living. The appeal is an annual event at the school, with undiminished interest from pupils and parents. It is coordinated by the Student Council and their teacher, Carol Anne O’Donoghue. Team Hope is an Irish Christian development charity that works to help children affected by poverty in Eastern Europe and Africa. Through its annual Shoebox Appeal and sustainable development projects, it aims to bring positive, long-term change. Thousands of gift-filled

shoeboxes are sent from Ireland each year, and young pupils are particularly drawn to the idea that their carefully chosen items will go directly to a child in need. Team Hope representatives Mick O’Connell and his wife Helen, from Ballybunion, collected the boxes from the school on Tuesday morning. Helen, who has travelled with the charity to several countries, shared stories from her trips with Student Council members. She said that being with the children as they open their boxes is heartwarming and makes all the effort worthwhile. The school congratulated everyone involved. Organised by the Irish Golf Tour Operators Association (IGTOA), the annual conference brings together golf tour operators, hotels, clubs, transport providers and industry partners to celebrate Irish golf tourism. Killorglin man Stephen Fitzpatrick named MS Ireland Volunteer of the Year

Killorglin’s Stephen Fitzpatrick has been named MS Ireland Volunteer of the Year 2026 for developing a nationwide sailing programme that has given 51 people living with multiple sclerosis (MS) the chance to take to the water this year. He received the award at the MS Ireland National Conference 2026 in Galway, in recognition of his commitment to creating new opportunities for people with MS. In 2024, Stephen encouraged MS Ireland to hold its first “Try Sailing” event in Dublin, which he helped coordinate. It has since grown into nine programmes across the country in 2026, supported by a dedicated network of volunteers. Beyond the physical activity, the programmes build confidence, friendships and peer support, with participants reporting improved wellbeing, optimism and sense of achievement. Working largely behind the scenes, Stephen has helped secure

Friday 30th October 2026

funding, coordinate volunteers, develop partnerships and support participants. His work with Sailing into Wellness and Oceans of Hope has expanded the initiative, and he helped establish the Irish branch of Oceans of Hope, an international charity that enables people with MS to take part in overseas experiences in countries including Greece and Turkey. An advocate for inclusion and wellbeing, Stephen regularly shares his own experience of living with MS through local media, including Radio Kerry, to raise awareness and encourage others to stay active and connected. MS Ireland Chairperson Mary McKeon congratulated Stephen and praised all nominees, saying the organisation was fortunate to have such a wonderful MS community. She thanked him for his continued dedication.

Paddy O’Connor Memorial Pool Tournament raises €755 for Kerry Mental Health Association Alan Murray is back-to-back champion after winning the 2026 Paddy O’Connor Memorial Pool Tournament at O’Sullivan’s Bar, Garrynadur, Lispole. In a repeat of last year’s final, he beat Kevin Griffin 6-3, but the main prize was the €755 raised for the Kerry Mental Health Association Corca Dhuibhne Branch. Organiser Tadhg Evans, a nephew of the late Paddy O’Connor, said his uncle died tragically in 2021. Though not a pool player, Paddy had taken positive steps to improve his mental health in the run-up to the Covid lockdowns, including meeting friends at O’Sullivan’s once or twice a week. Tadhg thanked the bar for hosting the tournament since its inception. Through donations and entry fees,

the event has now raised €4,500 for the branch, including this year’s total. Forty players took part over the summer months, and Barry Manning won the plate competition, which gives players who did not reach the last 16 a further outlet. Kerry Mental Health Association General Manager John Drummey, pictured receiving the cheque from Tadhg, thanked the organiser, players, hosts and everyone who donated to fund mental health support activities in the area. The association is also seeking volunteers to stage fundraising or educational events in West Kerry. Anyone interested can email volunteers@KerryMentalHealth. ie or visit KerryMentalHealth.ie/ volunteer-registration.

On behalf of the organising committee, a huge thank you was extended to the Best family, the hardworking organising committee, the judges, Brendan Fuller and, most importantly, the fantastic acts who took to the stage and entertained the audience so brilliantly. The committee said all the effort that went into the night was greatly appreciated. Special thanks also went to Jennifer and the entire team at Ballyroe Lodge for hosting the event. Antarctic adventure comes to Tralee with Endurance Above the Ice Tralee’s streets will be transformed into a frozen Antarctic landscape on Friday, 6 November, when Endurance Above the Ice parades through the town at 6pm as the headline public event of the National Circus Festival of Ireland. Created by Cork Puppetry Company, the free outdoor spectacle reimagines Shackleton’s Endurance expedition and the role of Annascaul’s Tom Crean, who was instrumental in the crew’s survival. Physical theatre, puppetry, music and moving ice formations combine

in a playful, interactive show, with audiences drawn into the adventure along the route. The parade begins at St John’s Church and travels via Ashe Street and Denny Street, ending with a fireworks display at Kerry County Museum. Festival Director Con Horgan described it as “an Antarctic adventure with a distinctly Kerry heart”. The event was supported by the Arts Council and delivered in collaboration with Samhain Chiarraí.

Minister Foley welcomes funding to support the work of 44 Tidy Towns groups in Kerry Minister for Children, Disability, Equality and Kerry T.D Norma Foley has welcomed confirmation of funding to support the work of 44 Tidy Towns groups in Kerry. It comes in the wake of fantastic results congratulated for Kerry towns and villages in the 2026 Tidy Towns competition, including Tralee being named Ireland’s Tidiest Large Urban Centre, Glenbeigh winning the Inclusive Communities Award

and Castlegregory for winning the Sustainable Development Goals award. Minister Foley welcomed the funding of between €1,000 to €4,000 for Tidy Towns groups right across Kerry from the Department of Rural and Community Development. “This is welcome support for Tidy Towns groups who do such fantastic work in their towns and villages across Kerry,” she said.

Remembering Ted Kelliher — A Gentleman of Tralee Chris and Coilette Shortt and The Tralee Advertiser extends its sincere sympathy to the family of Ted (Timothy) Kelliher, Derrybeg House, Oakpark, who passed away peacefully on October 26th, surrounded by his loving family at Fatima Nursing Home. Formerly of Denny Street, Ted’s working life was closely associated with Kelliher’s Garage and the motor trade in Tralee. His contribution to the family business brought him into contact with generations of customers and colleagues. Those remembering him have spoken warmly of his courtesy, sound advice

and integrity in business. The messages of condolence also offer a touching picture of the man beyond his work: someone who enjoyed conversation, offered a kind word and made time for others. Neighbours recall his familiar daily walks along Oakpark Road, while friends remember his love of Tralee, Kerry and the Irish language, including exchanging a cúpla focal after Mass. Above all, Ted was a beloved husband to Áine, a much-loved father to Úna, Alice, Tim, Colm and Sinéad, and an adored grandfather to eleven grandchildren. He will be

deeply missed by his siblings Mary, Rae and Maurice, his extended family and many friends. His funeral Mass took place at St. John’s Church on Wednesday, October 28th, followed by burial in New Rath Cemetery. Donations in Ted’s memory may be made to Baile Mhuire Day Care Centre or Kerry Specialist Palliative Care Services. Our thoughts are with all who mourn a husband, father, grandfather, brother and friend whose memory will be cherished. Ar dheis Dé go raibh a anam dílis.

KERRY FC - SSE AIRTRICITY MEN’S FIRST DIVISION The club’s first ever playoff campaign ended in the semi-final, with Bray Wanderers going through 5-1 on aggregate. In the first leg at a soldout Mounthawk Park, Bray led 2-0 before captain Sean McGrath pulled one back in his 150th game for the club, but a stoppage-time red card for Sean O’Connell left Kerry a goal down, 2-1. In the second leg at the Carlisle Grounds, Bray won 3-0 after Cian Brosnan was sent off just after the break, leaving Kerry with ten men. THE MIRACLE PRAYERS

Dear Heart of Jesus in the past I have asked for many favours, this time I ask you this special one (mention favour). Take it dear Heart of Jesus and place it within your Heart where your Father sees it, then in his merciful eyes it will become your favour not mine. Amen. Say this prayer three times for three days and your favour will be granted. Never known to fail. Must promise publication of prayer. P.F.
