LEGAL MATTERS CORNER MIRIAM MC GILLICUDDY ANSWERS YOUR LEGAL QUERIES Henry has worked for the same company for 50 years he is now 67 years of age and the retirement age in his workplace was 66. He is worried he will be let go. He in very good health and would like to work for years to come. He understands that there has been a change in the law recently and wonders what is the situation. The Employment (Contractual Retirement Ages) Act 2025 came into effect on 29 June 2026, The legislation allows eligible employees to choose to remain in employment beyond their contractual retirement age, where that age is below the State Pension age of 66. Importantly, the Act gives employees choice, it does not require anyone to stay in work if they prefer to retire. This new right allows employees to formally notify their employer that they do not consent to retire at their contractual retirement age. In order to do this they need to provide at least 3 months’ notice, and no more than 12 months’ notice before the intended retirement date. Where a contract specifies a longer notice period, employees must give that notice or 6 months (whichever is shorter). Due to the minimum notice requirement, the earliest contractual retirement date the Act can apply to is 29 September 2026.
If the employer allows ongoing working they may offer Henry a fixedterm contract it must clearly state, the length of the contract and the legal grounds. Where an employer intends to enforce a retirement age, they must respond in writing within one month and clearly set out the decision and ensure that it complies with the higher legal threshold set out in the Act. If the employer decides to enforce the contractual retirement age, they must: 1.Reply in writing within one month. 2. Explain the reasons for the decision 3. Show that the decision is objectively and reasonably justified by a legitimate aim 4. Show that requiring retirement is an appropriate and necessary way of achieving that aim. Some examples of legitimate aims are e.g. Allowing employment opportunities for younger workers, Health and safety concerns, for safety-critical jobs, Addressing age imbalances in the workforce, Succession planning. In deciding to have a mandatory retirement age, the employer must also consider if there is a less or non-discriminatory way of achieving the intended aim or aims as age is covered by the equality legislation. There is also updated Code of Practice on Longer Working, developed by the Workplace Relations Commission (WRC) which applies from 29 June 2026. Lawquip: “Anyone who stops learning is old, whether at twenty or eighty. Anyone who keeps learning stays young.” Henry Ford
Employers are required to carefully consider any notification made under the Act. Henry’s employer should have a meeting with Henry and consider Henry’s request asap. If you have a legal query or need further information on any item addressed in this column please send in your query to miriam.mcgillycuddy@gmail.com Miriam McGillycuddy, Solicitor, Derryana, Ballyard, Tralee, County Kerry. shoulders. The class also included a check-in on foot strength and mobility.
Catriona, a STOTT Intensive Mat Instructor and APPI Comprehensive Mat Instructor, said everyone left the class “a few millimetres taller.” The next Mixed Mat Pilates class takes place Thursday next week at 10am. The studio shared the update on its Facebook page, facebook.com/ zerogravityfitnessstudio.

Q: I’m going through the menopause and have noticed changes in my sleep, energy and body, as well as experiencing hot flushes. I’d like to support my health naturally during this stage of life. Are there particular foods, lifestyle changes or herbs that can help?
Serves: 2 Ready in: 20 minutes Swips: 7 per serving, or 1 if using the bread as your Healthy Extra fibre choice.
Edel, Tralee A: Menopause is a natural transition and it can be a wonderful opportunity to reassess how we nourish and care for ourselves. A varied, predominantly plant-based diet rich in vegetables, fruit, wholegrains, beans, lentils, nuts and seeds provides a broad range of nutrients to support overall health. Adequate protein, calcium and vitamin D are particularly important for maintaining muscle and bone health, while strength and weight-bearing exercise are valuable additions. For hot flushes, sage is one herb traditionally used to support women during menopause. Sage contains phytoestrogens, plant compounds that mimic estrogen and may help regulate body temperature, mood and sleep during menopause. A simple sage infusion can be incorporated into a daily routine: fresh or dried sage leaves can be infused in hot water for several minutes before straining. Other supportive habits include staying well hydrated, prioritising sleep and noticing whether alcohol, caffeine or spicy foods influence your individual symptoms. Every woman’s experience of menopause is different, so it can be helpful to take an individual approach, combining nourishing food, movement, restorative practices and appropriate herbal support.

Kieran from KP Therapy answers your questions about Muscles, Aches & Pains.
Stretching, Mobility & Muscle Health When muscles lose their ability to move freely, they also lose their ability to “breathe” comfortably. Restricted movement limits blood flow, starving tissues of oxygen and nutrients — a state known as ischemia. Over time, this lack of circulation contributes to muscle contractures, stiffness, and the development of sensitive trigger points. These tight, oxygen-deprived knots can reduce strength, restrict performance, and even alter posture and joint mechanics. The good news? Restoring healthy movement doesn’t require extreme workouts or fancy equipment. Gentle, consistent stretching and mindful mobility work can reopen the body’s natural pathways for circulation. Techniques that combine breathwork, slow controlled movement, and awareness of tension help bring life back into tired tissues.

Byrnes SPAR Team take on Chicago Marathon for Breast Cancer Some of you might have spotted local SPAR Retailer Louis Byrne and his son Greg pounding the streets of Tralee or running the Fenit Greenway in recent months. Those training miles have been building towards a challenge with a worthwhile cause: taking on the Chicago Marathon to raise funds for the National Breast Cancer Research Institute. Now, they are hoping their local community will get behind them once again as they swap familiar Kerry routes for the streets of Chicago Louis, owner of BYRNES SPAR in Oakpark and Caherslee, and Greg (24) will line up on Sunday, 11 October, for the 42.2km race. Louis has previously completed the Berlin Marathon, while Chicago will be Greg’s first marathon — a special milestone for the father and son to share. “Running Berlin last year for NBCRI showed me how generous people in
Tralee are when it comes to cancer research, a cause that touches so many families,” said Louis. “Doing Chicago alongside Greg makes this one extra special. It’s his first marathon, and I’m not sure which of us is more nervous.” The pair have been training for months, fitting long runs, strength work and Saturday morning parkruns around full-time work. Between them they have raised over €4,200 so far, and they are hoping the local community will help push that past last year’s €7,000 total before they cross the finish line. “Knowing that every kilometre is helping fund breast cancer research here in Ireland will get me through the tough miles,” said Greg. NBCRI is an Irish charity that funds breast cancer research carried out in Ireland. Its work aims to improve diagnosis, treatment and outcomes for patients.

Your Goals. Our Coaching. Real Progress. MEET JONATHAN SILLES — GYM MANAGER & LEAD COACH AT FORGE & FLOW, BANNA BEACH LEISURE CLUB Hi, I’m Jonathan. With over 10 years’ experience in fitness and performance, I’ve worked with everyone from complete beginners and general gym members to GAA players, athletes and sports teams. As a UKSCA-accredited Strength & Conditioning Coach, I help people become stronger, fitter and more confident — in the gym, in sport and in everyday life. Over the past year, we’ve been developing Forge & Flow and the wider facility, expanding our coached classes, team training, athletic development, recovery services and HYROX events. My philosophy is simple: provide quality, structured training in a welcoming environment where everyone can make lasting progress.

Minister Foley welcomes increased sports capital grants for clubs
Minister Norma Foley has welcomed an increase in the maximum Community Sport Facilities Fund (CSFF) grant for sports clubs, community groups and local authorities from €200,000 to €250,000. The fund is the Government’s primary vehicle for supporting sports facility development and the purchase of non-personal sports equipment. Minister Foley encouraged Kerry clubs with eligible projects to apply, calling the fund
vital in helping communities access the facilities and equipment they need. Applications open online from 9am on 19 October 2026 and close at 5pm on 26 February 2027. Thirdlevel colleges, ETBs and schools may only apply jointly with sports clubs or organisations. Local grants, the main category most clubs will apply under, now have a maximum of €250,000. As in 2023, projects must guarantee equal access for men and women and demonstrate a “sport for
all” commitment. School-club collaborations will no longer require a formal lease, instead needing a minimum 10-year licence agreement guaranteeing shared access. Regional Tier 1 grants require applications via NGBs, Local Authorities or joint club applications for shared facilities, while a new Tier 2 pilot category offers up to €750,000 for larger multisport projects, with 70% maximum funding and a requirement for 30% match-funding.

Tralee man wins Tech Innovation Award Tralee man Lee Walker has won the Tech Innovation Award at the 2026 Home &
Community Care Ireland (HCCI) Awards, presented at the organisation’s annual conference in Naas, Co Kildare. Lee identified a practical problem at Bluebird Care Kerry and West Cork and developed Quick Wing, an online fleet-management app allowing carers to book vehicles and monitor compliance in real time. The system has cut admin work, boosted accountability and ensured safe, compliant vehicles are available when needed. It’s already been rolled out to a second office, with potential for wider adoption. Lee was one of 44 home care workers shortlisted nationwide across nine categories at the event, held under the theme “A New Deal for Carers” and opened by HCCI Chair Frances Fitzgerald.

...Good News Only!!! TALKING SPORT WITH THE TRALEE ADVERTISER KERINS O’RAHILLYS GAA CLUB NOTES Senior B Team - Shield Champions: Huge congratulations to the Senior B team who captured the Tralee/ St Brendan’s Junior League Shield at John Mitchels on Sunday with an emphatic 5-7 to 2-7 victory over Ballymacelligott. A magnificent team display and a fantastic way to conclude the competition. Well done to all players and management on bringing silverware back to Strand Road! Historic Return of the Houlihan Cup: An electric atmosphere at Strand Road on Thursday evening as the Houlihan Cup made its long-awaited return for the first time in 47 years. A huge crowd turned out to witness two thrilling finals. The Shield Final was settled by late goals in the final minute, with Team Danno Keeffe edging it 5-6 to 3-8. The Houlihan Cup Final itself went to Golden Score in extra time after a titanic fulltime draw, with Conor O’Shea slotting over the decisive score to crown Team John Dowling as the first champions to lift the cup in 47 years. Luke Kelly had the honour of lifting the cup as winning captain. A very special thank you to the Houlihan family, and particularly Richie Houlihan, for their generous sponsorship in reviving this historic competition. Gaelic for Mothers & Others - Tara Festival, Watford: The G4MO squad represented Kerins O’Rahillys and Kerry with distinction at the Tara Festival in Watford, playing four games across a wonderful weekend of football, friendship and fun. The boys represented the club brilliantly across three group games. NA GAEIL GAA CLUB NOTES Senior Men - County Championship: A 2-16 to 0-11 defeat to North Kerry ended Na Gaeil’s county championship campaign. Na Gaeil battled hard throughout but North Kerry’s strength in depth proved the difference. U8 Boys: Welcomed Currow to Killeen for the final Go Games of 2026. The season concludes on Sunday October 18th. Club Walking Group: Na Gaeil have launched a new walking group, the “Na Gaeilgoers,” with their first outing on Thursday October 8th on a 5km route from Na Gaeil’s main car park. A fantastic year for the U6 to U10 boys and girls. Best wishes to all players graduating to U12s next year and special thanks to all volunteers and to academy sponsors Shines Pharmacy in Tralee. ST PATS GAA NOTES U13 Boys - Central Region Shield Final: A brilliant comeback win over Ballymac in the Central Region U13 Shield Final in Blennerville. Trailing 3-04 to 0-01 after 15 minutes, St Pats showed tremendous heart to fight back, going in at half time just a goal down. Ballymac raced into a seven-point lead early in the second half but the boys dug deep once more to pull

The boys came through a nerve-wracking shootout to advance to a quarter-final away to East Kerry on Sunday October 11th at 12pm. GARVEY’S TRALEE WARRIORS DOMINO’S Men’s Super League Round 1 Garvey’s Tralee Warriors opened their Super League campaign in stunning fashion, overcoming Belfast Star 82-71 before a bumper crowd at the Kerry Sports Academy. Trailing 31-13 after the first quarter, the Warriors produced a devastating 28-05 third quarter to turn the game on its head and run out deserved 11-point winners.
