LEGAL MATTERS CORNER MIRIAM MC GILLICUDDY ANSWERS YOUR LEGAL QUERIES

Sean is hoping to locate a suitable pet or pets for his growing family that will grow up alongside his children and is wondering what are the legalities around animal purchase and welfare. Animal law is a relatively new area. It looks at our attitude to animals, questions the idea of animals as property and looks at animal rights and their position in society. As Mahatma Gandhi said “The greatness of a nation and its moral progress can be judged by the way its animals are treated.” The main law related to animal protection in Ireland is the Animal Health and Welfare Act 2013. This act means that anyone owning a pet or animal has a duty to protect its welfare. The Act also incorporates bans on animal cruelty, abandonment, animal fighting, animal poisoning. It provides protections related to welfare of animals during sale and regulation of sale of animals to minors. It also has measures related to animals in distress. Regulations under the act apply to anybody selling more than 6 pet animals a year. A Pet is defined as any animal kept or intended to be kept as a pastime or hobby, for companionship for ornamental purposes or any combination of 1-3 but does not include a farm animal. So it could include dog, cats, amphibians, fish, rabbits, guinea pigs, birds inter alia. The Pet supplier must register with the Department of Agriculture Food and Marine and keep certain records including where the animal came from and medical record. The ad for the pet should Seller or supplier registration number (if there is one), the Animal’s age, Microchip number if it is a dog and Animal’s country of origin. There is a Voluntary Code of Practice for Sellers and Suppliers of pet animals and this ensures the pet was properly looked after before you get it so it would be a good idea to ensure the seller or charity adheres to this code. When buying your pet it is a good idea to have a list of questions to ask the supplier in relation to age, health, microchipping, health screening tests, food it has been eating, age of the parents and how many litters the female has had, does the animal have all the necessary documents e.g. vaccination record, parent health record. There are additional considerations if buying an exotic animal in relation to their care, how long they will live and how big they will grow and to make sure you have a Vet to deal with exotic animals e.g. Llamas, wolves, Owls, bearded dragons etc. They also may be subject to special regulation if an endangered species and may need an import permit and certificate. Lawquip: Having a ruff day? Just stay paws-itive! If you have a legal query or need further information on any item addressed in this column please send in your query to miriam.mcgillycuddy@gmail.com Miriam McGillycuddy, Solicitor, Derryana, Ballyard, Tralee, County Kerry. Back to School: Why Hearing Checks Matter for Your Child’s Learning As children prepare to return to the classroom, parents are busy organising uniforms, schoolbooks and stationery. However, one important aspect of a child’s wellbeing is often overlooked – their hearing. Good hearing plays a vital role in a child’s speech, language development, communication and academic progress. Even a mild hearing loss can make it difficult for children to follow classroom discussions, understand instructions and participate confidently in school activities. Because hearing loss can develop gradually, many children adapt without realising there is an underlying issue. At Audiology Medical Services,

we understand the importance of identifying hearing concerns as early as possible. Our experienced paediatric audiology team provides comprehensive hearing assessments for children in a friendly, calm and reassuring environment, helping both children and parents feel comfortable throughout the appointment. Parents should consider arranging a hearing assessment if their child frequently asks for repetition, struggles to hear in noisy environments, turns up the television volume, has delayed speech development or appears inattentive in school. These signs are not always behavioural and may indicate an underlying hearing difficulty.

As an Irish-owned family business with over 20 years of experience, OR NOW Audiology Medical Services is committed to delivering expert pp FOR hearing care compassion and MICRwith OSUCTION TWO For Both Ea rs professionalism. PEOPLE If you have any concerns about your Usually €70 child’s hearing ahead of per theperson! new school year, now is an ideal time to arrange an assessment. For further information or to book an appointment, contact Audiology BEFORE Medical Services on Freephone 1800 501 501 or visit www.AFTER audiologymedicalservices.ie

Early diagnosis is key. Identifying hearing issues promptly allows appropriate support to be put in place, helping children reach their full educational and social potential. Whether the concern is temporary, such as ear infections, or a more permanent hearing loss, professional assessment provides valuable reassurance and guidance. Audiology Medical Services offers expert paediatric hearing assessments carried out using the latest diagnostic equipment by qualified audiologists with extensive experience working with children.

Mounthawk Montessori Welcomes Its 28th Cohort of Children There were smiles, new friendships and plenty of exploring as Mounthawk Montessori School & Busy Bees Nursery in Tralee welcomed its class of 2026, marking the arrival of its 28th cohort of children. A special first-day welcome session offered children and their families the chance to meet the teaching team, led by Helena Wallace Dowling and Katie O’Sullivan, and discover the classrooms, gardens and Outdoor Casa Dei Bambini. The morning was filled with creativity, discovery and play, helping children become familiar with their surroundings and the teachers who will guide their early learning. Established in 1999, Mounthawk provides a child-led curriculum inspired by Reggio Emilia, Montessori, Aistear and Síolta. Its approach encourages creativity, independence and a connection

with nature through everyday experiences. Children enjoy free-flow access between indoor and outdoor spaces, with individual classroom gardens offering opportunities to explore, learn and play. Susan Quirke Crowley, CEO and Founder of Mounthawk Montessori School Group, described the welcome session as a happy occasion. “We were thrilled to welcome our wonderful new children and their families. It was a very happy and positive first experience, filled with fun, friendship and exploration.” She added that the children settled beautifully, with some reluctant to leave. “In fact, many of the tears came when it was time to leave! Thankfully, the children were quickly reassured that they could return for even more fun the following day.”

The team looks forward to helping each child grow in confidence, build friendships and enjoy new discoveries, while sharing many happy memories with families throughout their time at Mounthawk.

A Climb to Remember: Greenheat Team’s Tribute to John Kelly The team at Greenheat & Bathrooms in Tralee will climb Mount Brandon on Saturday, September 12th, in a heartfelt tribute to their friend and colleague, John Kelly, who passed away unexpectedly in May. “Walk for John” will bring his colleagues together to honour his memory while raising funds for Croí Uíbh Ráthaigh / Iveragh Community Defibrillator Project, supporting lifesaving work across the community. Describing John as “our dear friend and colleague”, the team hope the fundraiser will offer a meaningful way to remember him and help others. The project provides and maintains defibrillators throughout Iveragh, trains local people in CPR and

defibrillator use, and supports local Cardiac First Responder groups. With many of the area’s defibrillators needing replacement in the near future, donations will help maintain this vital community resource. Every contribution, whatever its size, will support the project’s work. The Greenheat team are also asking people to spread the word, recognising that not everyone will be in a position to donate. “Thank you for helping us remember John and support such an important local cause,” the team said. Anyone wishing to support “Walk for John” can find the GoFundMe donation link through Greenheat & Bathrooms’ social media page.

Threshing Time Again in Ballyheigue! Ballyheigue’s traditional Harvest Festival returns to the White Sands Hotel on Monday, September 7th, bringing music, song and dance to the seaside town on the eve of its annual Pattern.

All-Ireland accordion champion John Lucid will perform the festival’s signature tune, Harvest Home, while Risteárd Ó Fuaráin will sing Ballyheigue, composed by the late Michael O’Carroll.

Beginning at 8pm, the celebration will be opened by Ballyheigue native Alan O’Sullivan, who will cut a specially woven súgán rope, honouring the festival’s farming roots and traditional crafts. Young local singers, dancers and musicians will launch the evening with an outdoor showcase of talent.

Celebrations will continue across the hotel’s two venues, with traditional music, sean-nós singing and dancing. Richard Casey and John Lucid will lead proceedings, assisted by MCs Tom Lawlor and Sonny Egan. All musicians, singers and dancers are welcome to join this gathering, offering returning visitors and

neighbours a chance to reconnect. This year, the committee also remembers its late vice-chairman, Liam O’Mahony, whose passing is deeply felt.

On Pattern Day, Tuesday, September 8th, Bishop of Kerry Raymond Browne will celebrate Mass at the Blessed Well and Grotto at 11am. A hearty céad míle fáilte awaits everyone for this celebration of community and heritage.

New E-Scooter Safety Rules Make Helmets and High-Visibility Clothing Mandatory

E-scooter users in Tralee and across Ireland must wear helmets and high-visibility clothing from Friday, September 4th, 2026, under new regulations announced by Transport Ministers Darragh O’Brien and Seán Canney. The measures respond to concerns over collisions, serious injuries and fatalities involving e-scooters. Further changes are planned. From

October 2nd, charges for seized e-scooters will double to €80 for detention and the first day’s storage, plus €30 for each additional day. The Government also intends to raise the minimum riding age from 16 to 18 before year-end, subject to the EU notification process. Fixed penalties for e-scooter offences are set to increase to €100, with new offences covering failure

to wear a helmet or high-visibility clothing.

Ministers said the changes would strengthen safety and enforcement while supporting responsible use. Registration, insurance and driving licence requirements remain under consideration, with further proposals to follow a Department of Health report on e-scooters.

Spotlight on one of the Sports Ambassador at Manor West Leisure Club AOIFE DILLANE – LADIES GAELIC FOOTBALL, Kerry Senior Ladies & Austin Stacks The team at Manor West Leisure Club caugjht up with one of their Sports Ambassadors for 2026, Aoife Dillane Aoife, How do you maintain motivation and momentum when faced with challenging tasks or setbacks in your sporting life? I’d usually seek advice from someone else, usually a teammate or a family member, usually talking about whatever is challenging me or bothering me out loud helps a lot. If it was a bad session or an off week taking down time helps, completely switching off on my rest days is nice, can’t always do this but when we can it’s helpful. What strategies do you use to stay focused and productive during long periods of training and possibly repetitive tasks? Setting smaller targets or goals for myself personally help during intense

points of the season, rather than focusing on the potential outcome I would place my focus on the small things I can control to contribute to the outcome. Eg. My recovery and my weekly training goals. How do you prevent burnout and maintain a healthy personal life with your sporting obligations and responsibilities? Being organised helps here, setting times aside to do all the jobs outside training that’ll contribute to my training ie. Meal prep, video analysis and recovery. Having these penciled in at certain times/ days makes my free time completely my own free time to spend with friends and family.

Reliability Survey has positioned Kia as a market leader in automotive excellence, ranking 8th out of 30 manufacturers with an exceptional 94.4% brand reliability rating. The standout star of the poll was the all-electric Kia EV3, which achieved a flawless 100% score with zero reported faults. It earned praise from What Car? experts as a pinnacle of
