Rights of Way:
People need to travel the highways and byways to access property and where it is a public road that is maintained by the local authority it allows full access. The issues arise in relation to access routes over private property as Declan found problematic when he bought a house, and the access was along a private road, but his use of the road was restricted by the owner of the land initially with a gate and then by making the road narrower when he extended his fields into the roadway.
Land ownership in Ireland is usually clearly defined by title documents and maps but in the case of a long user right of way one has rely on the type of user and extent of use over the years and if there is a dispute about this the only way of sorting it out is going to court. For example, a landowner could say that the right of way was only for horses, bicycles and pedestrians and it was never used for vehicles and definitely not tractors, trucks, and farm machinery. The landowner might also demand that a gate be put on the right of way to prevent animals escaping if a gate was a feature of the said route in the past. The gate might be a locked gate with limited numbers of
people having a key etc. This would be very awkward if one was trying to get in and out of one’s home. As a result, the clear registered rights of way are the best as they clarify that the right of way is for a particular purpose e.g., for the use of pedestrians, animals, and vehicles and that it is for the person who has the right of way and their successors in title. It will also be clearly marked on a map in yellow and showing the width, beginning and end of the right of way thus showing the extent of the right of way. Even better is a situation where everyone who uses this right of way including the landowner if he uses the roadway as well make a written agreement in relation to sharing the costs of maintaining the roadway.
If a landowner is refusing to sign a formal Grant of Right of Way to allow one to register the right of way one can still apply to register the right of way based on long user over 20 years as a kind of squatter’s title application to Tailte Eireann the Property Registry Authority in relation to the right of way.
Moreover, with a long user right of way it is either use it or lose it and if it is not used for several years the right of way may be lost.

Siamsa shares traditional skills in Muckross School House
Siamsa Tíre is bringing the traditional arts of music, song and dance to the Muckross Traditional Farms School House for Heritage Week. An initiative of The Heritage Council, the festival celebrates Ireland’s cultural, built and natural heritage. This year’s theme is “Living Heritage”, how we can conserve our rich living Heritage including the practises, past times and skills that are passed between generations. This is the essence of Siamsa Tíre, The National Folk Theatre of Ireland as it continues to bring people together to share stories and skills and explore Irish folk culture, as it has done for nearly 50 years.
Opening the week of events on Sat 12th August, Siamsa Tíre’s Artistic Director and North Kerry Dance master Jonathan Kelliher presents a very special series of North Kerry “Munnix” Traditional Dance talks, demonstrations and workshops, from 1.30 - 4.30pm. Visitors can learn the unique North Kerry Munnix dance steps and learn how Siamsa Tíre cherishes and passes on this style across the generations, a skill that dates back to the 1700s.
To close out the week on Sunday 20th August, The National Folk Theatre will collaborate with Harp
Ireland to provide a spectacular afternoon of live music, song and dance combining Ireland’s leading and upcoming harpists with performances from the National Folk Theatre performers. The concert starts at 3.30pm in the Muckross Traditional Farms School House.

Tralee lady Brenda Houlihan got a lovely surprise recently when she received a personal phone call from one of her favourite Irish Music artists Margo ! Brenda had just sent up a few photos of when she last met Margo at her show on May 25th in the INEC Killarney ! And the following day , Brenda received a lovely phone call from Margo , thanking her . One of Brenda’s next musical trips is the upcoming Daniel O Donnell ( Margo’s brother !) concert in the Cork Opera House ...Brenda says “ I cant wait to go and see Daniel also ...he’s nearly as good as Margo...I might even go to the concert on both nights !”
