David would like to transfer his home to his daughter Cynthia and her husband Michael who live with him subject to his having a right of residence in the property. He is wondering what options are available to him.
Your home is your castle and not always a good idea to relinquish any rights at all in it before one dies but often parents wish to benefit their children and give them security and it may be that once his daughter and her husband have title to the property that they could apply for a mortgage to do essential home improvements and extend the property to make it more comfortable for all. The mortgage company would need all parties to sign for the mortgage in that case. In that case both David and Cynthia and Michael would have separate solicitors in relation to obtaining independent legal advice. If Cynthia and Michael lived separately it would be better if David had an exclusive right of residence which is effectively like a life interest and that might also apply if they build separate quarters that David could get an exclusive right of residence in the a purpose built extension which would give him strong security of possession. However as they all live together now it would be more likely to be a simple right of residence.
In relation to taxation and the cost of the transfer a valuation of the property is needed and three taxes potentially apply, stamp duty which is 1% of value , (retaining the right of residence reduces this down by 10% and exclusive right of residence/life interest considerably more), CAT/ Gift Tax ( Cynthia’s tax threshold is €400,000 Michael’s is €20,000 ) and CGT/ Gains Tax but as it is Davids principle private residence there is a CGT relief. As a result of the above David would transfer to Cynthia and as long as Cynthia is married to Michael she can do a separate transfer tax free of a joint interest to Michael. Cynthia and Michael could then mortgage the property to raise the finance to make the property liveable for all.
With pressure on housing it is a good idea for families to look at existing properties to see if an extension or mews property would suit to house extended family and an architect/engineer can design structures that can give security, privacy and provide for all the family’s needs in a new built environment.

Minister for Children, Disability and Equality, Norma Foley TD, has welcomed the publication of the draft National Planning Statement, describing it as a significant step towards making it easier for people with strong local connections to live and build in rural Ireland.
The draft statement represents the biggest overhaul of rural housing policy since the Sustainable Rural Housing Guidelines were introduced in 2005 and aims to provide greater clarity and consistency for planning applications across the country. Speaking following its publication, Minister Foley said she strongly supported the proposed changes.
“I really welcome this draft National Planning Statement on rural housing.
“Recognition of the importance of planning applications in rural Ireland is something I have long advocated for. I want to thank my Cabinet
colleagues, Minister for Housing James Browne TD, and Minister for Rural and Community Development and the Gaeltacht, Dara Calleary TD, for recognising the importance of young people and families having the right to live, work and put down roots in rural Ireland.
“Those of us who live in rural Ireland and love rural Ireland know the only opportunity it has to thrive and grow into the future is to allow people to live and work there. The draft guidelines are a proactive step in that direction.
“These new guidelines will allow people who have a connection to rural Ireland, either through living or working, to successfully apply for planning.
“Over the last number of years, we have been really conscious of rural depopulation and the impact it has on all aspects of community

life — rural schools, employment and service opportunities, sports clubs and much more.
“This is an important intervention by Government to rebalance and afford opportunities for rural Ireland to grow and develop.”
The draft National Planning Statement is intended to modernise Ireland’s approach to rural housing, while supporting sustainable development and helping communities across rural Ireland to grow and flourish.

KERRY FC - SSE AIRTRICITY MEN’S FIRST DIVISION
Kerry FC made history on Friday evening by winning three consecutive games for the first time, defeating Longford Town 2-1 at Mounthawk Park. They now face back-to-back away games before welcoming Shelbourne in the FAI Cup.
U15 Féile: Huge congratulations to the Tralee Parnells U15 hurlers who were crowned regional Féile champions in New Ross, Wexford, winning their group before defeating Bray Emmets in the Division 2 Cup Final.
