MIRIAM MC GILLICUDDY ANSWERS YOUR LEGAL QUERIES
When a person dies leaving property it may be necessary to apply to the Probate Office for a grant of representation. This grant allows a person to administer the deceased’s estate and they have a right to custody and possession of the deceased’s body. In cases where the deceased has made a will, they will usually have appointed an executor, the executor has the responsibility to apply for the grant of probate and carry out the terms of the will as laid out by the deceased.
A Grant of administration is administered where somebody dies without a will. Usually, the next of kin applies for a grant of administration. The Succession Act 1965 states that priority is given in the following order:
• Spouse or civil partner.
• Child.
• Parent.
• Brother or sister.
• More distant relative.
However, in a recent high court case, the judge made an order which showed that the court has jurisdiction to override this if there are special circumstances. In this case there was difference of opinion between the deceased’s biological parents and her half siblings about where the deceased should be buried. The deceased sister wished for her to be buried in the town she grew up in so her friends and community could gather at her funeral and so the sibling could visit her grave. Her parents wished for her to be buried where they live and with her grandparents. According to the 1965 act the girl’s natural parents would be the people first entitled to take out a grant of letters of administration of the estate of the girl, while the girl’s half-sister is in the group next entitled. The circumstances here, where the girl was not living with her parents since she was very young, can be regarded as “special” thereby placing the wishes of her half-siblings and foster parents above those of her natural parents. The judge decided the grant should be extracted by the half-sister and not by the natural parents. The Judge also limited the Grant for the purposes of taking custody of the body, wake, funeral, burial and headstone erection.

‘My Dad’s Got Talent’ On Father’s Day At Féile na mBláth Tralee
If your dad can sing, dance, play music, cook, tell jokes, do keepyuppies or solve a Rubix Cube, then he should enter “My Dad’s Got Talent” which takes place at Féile na mBláth in Tralee on Father’s Day. Families throughout Kerry must nominate your dad before the Monday 12th June closing date to make sure he’s in with a chance of being shortlisted for the final on Father’s Day, Sunday 18th June. The Coordinator of Féile na mBláth, Bryan Carr, said: “There is no better way to celebrate Father’s Day than by staging a fun event
that showcases some of the most talented dads in the Kingdom. As someone who runs a stage school, it’s clear to see that the children who attend our classes didn’t lick their talent off the floor. Simon Cowell won’t be available to attend but our panel of judges are looking forward to the mother of all Father’s Day entertainment events.”

The Mounthawk Montessori School Group has once again been recognized as the All Ireland Business All Star Montessori Schools of the Year for 2023, marking their third consecutive win. In addition, they have received accreditation from the Department of Education in both April and May 2023, acknowledging their excellence in all aspects of early years education at both Mounthawk and Maureen’s campuses.
To commemorate this special achievement, Minister for Education,
Norma Foley, T.D., inaugurated the Casa Dei Bambini Outdoor Montessori School & Gardens. The ceremony included the Minister cutting the ceremonial ribbon, unveiling a plaque, and planting a weeping willow tree in honor of Susan’s late father, Tom Quirke, and Helena’s mother, Marion Wallace. Families, children, and staff members alike thoroughly enjoyed this wonderful afternoon celebration, as expressed by Helena.

further enhanced the occasion. The Montessori Schools have always been leaders in the field, continuously striving for innovation and receiving numerous awards, including the accreditation as Healthy Ireland Smart Start Preschools from 2015 to 2025.
In November 2022, the Oak Park Montessori School was inaugurated, and Susan represented Ireland as a delegate in the Early Years field during her travels to Norway, France, and Italy. Her most recent trip to Reggio Emilia in April 2023 ignited
the inspiration for the “Reimagining of the World of Early Years” and the innovative practice of the Casa Dei Bambini Outdoor Montessori School & Gardens. This unique project is the first of its kind in Ireland, integrating the Reggio Emilia Inspired Approach into everyday education and highquality practices within the Ateliers, led by highly qualified teams. The brilliant sunshine brought out sensational style at Listowel Races Summer Festival on Sunday 4th of June. The overall winners were Robert Yamac from Shanagolden and Moira O’Toole from Kilkenny, who both received a cheque for €500 sponsored by Listowel Race Company. Austin Stacks Triumph Over Castleisland Desmonds: Senior Football Match Recap
Austin Stacks secured a commanding victory with a final score of 0-12 to 0-5 against Castleisland Desmonds. The scorching hot Sunday afternoon (June 4th) at Connolly Park set the stage for an intense battle.
The second half showcased an exceptional performance by Austin Stacks, who scored eight more points, five of them from open play.
Despite the well-deserved victory, Austin Stacks remains in a precarious position on the League table, sitting third from bottom.
To improve their standing, the team must secure victories in the remaining three rounds against Milltown/ Castlemaine, Kilcummin, and Gneeveguilla.

The C Team’s next Co. League match against Laune Rangers is scheduled to take place at Connolly Park on the weekend of June 18th.
So far, the C Team has experienced two losses against Fossa and Rathmore, with a walkover received from Kerins O’Rahillys in the third round.
The D Team has played only one game in the five-round competition, securing a resounding victory against Scartaglin with a scoreline of 5-14 to 1-1.

Senior Men:
Mitchels secured a crucial victory against Brosna with a scoreline of 1-12 to 0-11.
Substitutes made a valuable impact, and Brian O’Donnell performed well in winning duels and securing possession. Congratulations to the team and management on the important win.
Senior Men Development League: The senior development team is awaiting the Junior Town League fixtures.
Senior Ladies:
The senior ladies had a break but will face Dingle on June 25th and Beale on July 2nd in the league.
Training continues with details to be confirmed.
Mother and Others:
The “Mothers and Others” session had a fantastic turnout, filled with fun and camaraderie.
All participants are welcomed back on Tuesday, June 6th, at 8pm.
Under 12 Girls:
The U12 girls had a great training session with guest coach Denis O’Regan and participated in the Mitchels 7s.
Training continues on Wednesdays and Sundays, welcoming newcomers. The U11 boys had an exciting match against Keel and will face Killarney Legion next.
Under 13 Boys:
The U13 team had an excellent performance in the Division 1 County semifinal against Kilcummin, securing a 5-17 to 3-12 victory. They have a county final to look forward to, and the Gold team will play a semifinal against Firies. Thanks to the players, management, and supporters for their dedication and support.
Minors:
Training details for the Town League fixtures will be announced soon. Free strength and conditioning classes are available for all members on Tuesdays and Thursdays at 6 am, facilitated by George Bastible.
Challenge Success!
Dingle Way Challenge 2023: A resounding success as St. Pats GAA hosted the event to raise funds for club development projects.
Ultra Route: Participants gathered at the clubhouse for a 48km long walk, taking in scenic locations such as Mt Brandon, Sauce Creek, Brandon Point, Tralee Bay, Loop Head, and sandy beaches.

U12 Girls:
North Kerry Division 6 final victory against Listowel B team, with outstanding performances and a welldeserved win.
Congratulations to the team for their development and thanks to captain Lucy for a heartfelt speech during the presentation.
U13:
Last group game against Kerins O’Rahillys ended in defeat, setting up a lower division final against Castlegregory.

Seniors:
Victory over Tarbert in Blennerville, with notable contributions from players such as Patrick Dowling, Brendan Poff, and Kieran Hurley.

U9 Hurling:
Impressive performance at the Ballyheigue blitz in sunny weather. Appreciation to all the families for their support.
Congratulations to the winners of the Féile fundraising raffle, with gratitude to Ballyseedy Castle for sponsoring the first prize.
U16 Camogie:
Rachel, Maeve, and Abbie competed in the Long Puck Club Qualifiers, with Maeve Trant advancing to represent Tralee Parnells in the County Long Puck Qualifiers.
Kerry U15 Academy Squad:
David Sargent and Christian Kennedy represented Kerry in the U15 Hurling
clash with Wexford.
Draw with a scoreline of 2-14 each.
Senior Hurling:
Parnells secured a great victory against St Brendans B in the Division 2 Co League Semi-Final.
First-ever Senior County League Final appearance against Causeway B awaits. Hurling & Camogie Summer Camp: Summer camp scheduled from Monday 24th to Thursday 27th of July.

Inaugural Golf Classic planned for Friday, July 21st, to raise funds for upgrading the GAA pitch at Pairc na Darach. Teams of 4 can participate for €200. Sponsorship opportunities available. Contact Agnes or any committee member for more information.

Mothers & Others group meets every Tuesday at the training field, open to all ladies aged 25 years.
No football experience required, a great workout with lots of laughter. Next Healthy Club meeting to be held in June, volunteers welcome to get involved.
