Working from Home

Darragh lives in Dublin and during the pandemic he was able to work from home in his native county Kerry with his family and keep an eye on his elderly parents. He is wondering what his legal position is in relation to seeking ongoing working from home status from his employer.

In April 2021 the Code of Practice in relation to the Right to Disconnect was established whose aim was to allow employees have a work life balance. It was aimed to allow flexibility in relation to working hours and was envisaged as a family friendly policy. The Right to Disconnect gives employees the right to switch off from work outside of normal working hours, including the right to not respond immediately to emails, telephone calls or other messages. There are three rights enshrined in the Code

1. The right of an employee to not have to routinely perform work outside their normal working hours.

2. The right not to be penalised for refusing to attend to work matters outside of normal working hours.

3. The duty to respect another person’s right to disconnect (e.g., by not routinely emailing or calling outside normal working hours).

Currently in Ireland, all employees can ask their employers for the right to work remotely, but there is no legal framework around which a request can be made and how it should be dealt with by the employer.

A new legislative proposal has now been introduced to the Dail in the form of the General Scheme in relation to the Right to Request Remote Work Bill 2022. This is the subject matter of Committee discussion by the Dail at present. It envisages that an employee can request remote working after working for a business for 6 months and once they make the request for the remote working the employer has 12 weeks to respond. If they agree they must set out details of how it will operate e.g., the proposed remote working arrangement, start date, how long a period, if indefinite or not, review, equipment requirements etc.

The employer can refuse for business reasons and some of those specific reasons will be set out in the legislation. They could give the employee a counteroffer e.g., 3 days home working and 2 days in work environment. The Employer must also have a Remote Working Policy and if not, it will be a criminal offence. If the employee is unhappy with the Employer’s decision around home working, they can appeal and/or take the matter to the Workplace Relations Commission.

Minister Foley welcomes announcement of €50 million scheme for rural village waste water improvements

Minister for Education and Kerry TD Norma Foley welcomes the announcement of a new €50 million scheme targeting the waste water collection and treatment needs of villages and settlements without access to public waste water services.

This weeks announcement follows the completion of a review by the Department of Housing, Local Government and Heritage, of villages and settlements that do not have access to public waste water infrastructure. This work included consultation with stakeholders and a detailed survey completed by local authorities of villages and

settlements in their area not serviced by waste water collection and treatment systems.

The first phase of funding announced today will focus on areas of most need based on housing and environmental criteria. Local authorities are now being invited to submit proposals for consideration for funding under this new measure.

Minister Foley said: “Improving the quality of waste water treatment and collection is imperative to support, cultivate and progress the development of sustainable rural communities.

I welcome this funding which will provide a vital boost to local economies and enrich

rural villages with sustainable housing projects.”

Lead Déjà Vu Tralee Parade

Craig Breen, who is lying third in the World Rally Championship will lead (fingers crossed ) , a spectacular parade of 150 cars on Déjà Vu Tralee on Saturday May 28th. Craig hopes to be driving his recently rebuilt ex-Frank Meagher Circuit of Ireland winning Ford Sierra Cosworth RS.

Forward a generation and a half to recall number 2 seed Kris Meeke’s first World Rally Championship win with Citroen in Argentina in 2015. . Kris will be driving his family’s unique Project X four-wheel-drive 2L Opel Corsa and Sydney Meeke, the cars creator will be alongside his son in this 1996 Kit Car. Barry Meeke will be in another of Sydney’s creations, the Ford Orion that Bertie Fisher, Stephen Finally and the World Championship boxer Barry McGuiggan drove in 1986.

Seven-times Belgium Rally Champion, Dutch Champion, and European Champion Patrick Snijers will also feature ! Patrick will drive a Lancia 1991 Delta HF Integrale 16v., thanks to its owner Jonathan Radley , the suave multi-

generational driver.

Déjà vu – “a feeling of having already experienced the present situation”, will revive memories of machines and drivers when this key event in the Kerry Motor Clubs 50th anniversary year starts at 10am in The Mall Tralee before setting out in their 130 mile route around the Dingle Peninsula. Déjà vu Motorsport is the brain child of two retired rallying enthusiasts Dr. Beatty Crawford and Alan (Plum) Tyndall. Beatty was a well known co-driver in the ‘60s winning the Circuit of Ireland with Adrian Boyd in 1971 and ‘Plum’ a former Irish saloon racing champion is best known for his motorsporting commentaries and his RPM tv show that ran on the major Irish TV channels for 23 years. Déjà vu events have raised over €200,000 for charity since their inception and the Tralee events chosen charity is Recovery Haven Kerry. Ballymac the Exciting New Venue For Kingdom County Show

THE 2022 KINGDOM COUNTY SHOW promises to be one heck of a special event this year. Back after a two-year pandemic-related absence, the stalwart Kerry show is relocating lock, stock and barrel from the old Tralee Racecourse grounds to its new venue at Ballymacthomas, just outside Tralee. All involved are chomping at the bit to showcase this fantastic new, 20 acre site.

“This is land we have owned for 30 years now. We got very comfortable at the racecourse but we’ve known for some time it wasn’t always going to be available to us. So, this year, we decided to take the plunge and move. I’m delighted we’ve finally done it. The new site is ideal and we are very excited about the inaugural show,” says James Tarrent, one of the event’s organisers. The Show takes place this Sunday, 8th May, and is billed as a fun-filled day out for all the family. The gates

are open from 9am with the official opening performed by Minister Norma Foley following a parade to the new showgrounds. Other guests on the day include Seán Kelly MEP for Ireland South and current Kerry Rose, Sally Ann Leahy. Children’s entertainment will be provided by Little Rose Buds, Fanzini Productions and more. The designated charity for this year’s event is the Irish Guide Dogs for the Blind.

“We have more stalls than ever this year and we will be erecting seven or eight tents and marquees. The Kingdom show is a wonderful platform to promote local producers and celebrate Kerry agriculture. Sadly, we were stuck for someone to organise the baking section but we have it in hand now and next year, the backing competition will be back with a bang.”

JOE... THE HAPPY SNAPPER...

Missing you already Joe!

Joe, a big snooker fan!

The late Joe Hanley aka The Happy Snapper, was laid to rest on Bank Holiday Monday to a large outpouring of sadness online, in Tralee and further afield. Ironically, Joe was a big Snooker fan and he took this picture of Rocket Ronnie O Sullivan with Mark Leen and Ken Doherty at one of Mark’s snooker events a few years back. Ronnie won his seventh world title on the very day Joe was buried.

“I informed Ronnie” said Mark, “that the man who took that photo was laid to rest on Monday. Joe was already looking forward to meeting the other seven time champion Stephen Hendry whom we have coming to Ballygarry House on May 22nd “ said Mark. He had a seat at table number one. “On the evening I will pay a tribute to Joe” said Mark “and lay a single red rose on his se at to signify his association with the festival of Kerry. Joe will be missed, everytime I look at that photo I’ll think of him.” Mark Leen

Something is missing this week... As I work late thru the night midweek , getting this weeks issue ( Friday 6th May 2022) of the Tralee Advertiser ready, theres a gap there , a hole , a vo id ..Then it hits me ...Nothing has come in from Joe , no special occasion photos, launches , no missed calls , no emails telling me which of the many photos he sends are ‘Priority Status‘ ...(“sure we cant fit them all in Joe !”).Steady as a rock for 9 years and now suddenly, silence! I was there on Monday at St Johns, Joe would have loved to be there, it was his kind of Gi g... but then it was his gig , his last gig ! The whole event was ju st beautiful , so fitting .As someone said outside afterwards ‘ Sure it was like a state funeral‘ ...and it was , from the huge turnout, to the Irish Flag, his military colleagues, the music , both his families , Snapper his Pal, the stories and of course, all his fellow photographers, Kerry, John, Adrienne, Paddy, Dermot, Domnick, Donal, and there were more that I couldn’t see ! This was Tral ee, sadly, paying respect to one of their own who has gone too soon. Joe Hanley had woven himself into the families , friends, organisations , groups and individuals simply by clicking his camera, making people feel good, and that was what Joe did best .Miss you Joe... Bréanainn documentary premieres at the Rose Hotel

Bréanainn is a new documentary on the life, legends and legacy of St. Brendan the Navigator which will première at the Rose Hotel, Tralee on Sunday 15th May at 8pm.

Over many years, there has been much debate over the question who were the first Europeans to discover North

America. Notables among them credited with the feat are Christopher Colombus, Leif Eriksson and St Brendan the Navigator. During the past six years, the Fair Drop Film Production Team have researched and produced a film documentary that makes a compelling case for the most extraordinary and internationally known Kerry sailor saint, Brendan the Navigator.

In this film, the production team present factual evidence, fascinating topography, folklore, and history, illustrated richly with maps, photography, video clips and text. They have appealed to the available archaeological and historical evidence concerning Saint Brendan, and explored the legacy and effects of this inspiring figure throughout the ages to the present. The production team was co-ordinated by Dr Declan Downey, The Royal Academy

of History Madrid & University College Dublin, and Mr Sean Quinlan, The Rattoo Heritage Society; and Éamonn O’Reilly, who had, initially, proposed the project to Seán. ALL ROADS LEAD TO PAIRC UI RINN:

The talking is over and all the hassle of where the game will be played is now in the past as Kerry head to Pairc Ui Rinn this Saturday evening to face the Rebels with a place in the Munster final up for grabs.

Kerry fans – those lucky enough to have tickets - are asked to get in early and cheer on the Kerry Ladies as they take on Tipperary in the Munster Championship game throwing in at 4pm. Everything points to an easy win for Jack O’Connor’s side which is something managers hate and yiu can be sure that along with his backroom team they will be pointing out that if the players buy into this it could make for a long evening. Indeed Jack made the point when talking to the media that already two Division 2 sides have defeated Division 1 sides with Galway defeating Mayo and Monaghan getting the better of Tyrone and he certainly doesn’t want it to become three. Kerry rightly stayed out of the controversy regarding the venue and then did the right thing when agreeing to Corks request to change the home and away agreement to include the smaller venue on this occasion.

Now we all want to see the boys – and girls – coming away from Pairc Ui Rinn with two wins.

AUSTIN STACKS NEWS

The club was delighted with the turn-out at the Paul Lucey Run/Walk and thanks all those who sponsored they much appreciated treats after the event. Members are reminded that fees for 2022 are now due to be paid as soon as possible.

The seniors were 9 points down at home to Dingle in Division 1 but staged a great comeback to draw 2-12 to 1-15. The B’s lost out to Cromane while the C’s play Listry this Friday evening. In the underage section there was a great reaction to the Austin-Stacks-for-All and there is another session this Sunday morning and will continue through the summer.

The Kellogg’s Cul Camp 2022 will take place in Connolly Park from July 4th to 8th and bookings are now open on-line. The u7’s and 9’s are out training again this weekend, the 11’s continue in their County Leagues. The u13’s were in Town League Division 3 action with the Amber team going down to Ardfert. They will play their final round game against Ballymac this Sunday. Training continues this week. The County League begins on May 22nd. The 15’s defeated John Mitchels in the County League Division 1. The Division 9 side got the better of Kilcummin. They will play Ballymac B on Wednesday next, May 11th.

The club was delighted with the win in Feile Boys Division 1 defeating Laune

Rangers, Killarney Legion and Ballymac in the final. The Division 9 semi-final versus Kenmare B is on in mid-week. The club is looking for participants in Scor na bPaisti which will take place in June. Lotto – there was no winner of the Lotto from the numbers drawn 16, 23, 29 and 31 and the next jackpot will be e2,250.

PARNELLS NEWS:

There was great excitement for the u7’s as they pulled on the Blue and White jersey for the first time when they played away to Abbeydorney. 21 players were on duty with Sean De Hora Gumley named as Player of the Week. The u9’s enjoyed their games in Ardfert with the club fielding three teams. Parnells thanks St Brendan’s for the games.

The u12 Girls Blue and Amber sides began their League campaigns this week with the former defeating Causeway and the latter going down to Killarney. The u13’s boys put in a big effort against Ballyheigue but the opposition finished the stronger to take the win 3-01 to 5-05.

The u13’s and u15’s Girls combined to take part in the Feile na Gaeil and did the club proud. The club wishes Georgia a speedy recovery from an injury. The boys were also in Feile action defeating Ballyheigue but losing out to Ballyduff in the final.

The club was very proud of its Trath na gCeist team who finished 4th in the All Ireland Scor final.

The Seniors took on Causeway in the County League and trailed 0-05 to 1-07 at the break. They put in a great effort in the second half but came up just two points short 1-12 to 1-14.

TOP FOUR FOR THE WHEELBLASTERS:

The Kingdom Wheelblasters finished their League season on a high with a 4432 win over Titans BC from Galway. The final round of League games took place in Clontarf at the IWA Sports Centre hosted by Killester BC. The final table sees the Rebel Wheelers crowned 2021/2022 Champions with 8 wins from 8 followed by Limerick Celtics on 22 points, Killester WBC on 20 and the Kingdom Wheelblasters on 16 points with 4 wins and 4 losses. In this game the Kerry side made the better start and were 19-10 ahead at the end of the first quarter. Galway had the better of the second period to lead 2322. However the Wheelblasters were the stronger over the final two quarters with their full court press paying dividends. Tadgh Buckley had another big day hitting a game high 24 points followed by Ryan Paul on 10, Dean McCarthy on 6 and Cian Horgan with 4.

The Kingdom Wheelblasters will finish their season in the day long IWA Cup competition where they will face the unbeaten Rebel Wheelers. And as in any sport the Kerry side are relishing a crack at their neighbours.

The Junior team in the club had another good weekend defeating Killester and North East Thunder but they did go down to the Rebel Wheelers and Shannonside Stealers.

There was more joy for the Wheelblasters when Robyn Evans was awarded the Female MVP title with Ruairi McMahon named the Male MVP.

TWO TRALEE PLAYERS ON MEN’S U16 IRISH BASKETBALL SQUAD: Ireland u16 Men’s Head Coach Pat Price has named two Tralee players in his squad who are in Dundee this weekend to take part in the Four Nations tournament with England, Scotland and Wales. On the 14 man squad are Tralee Imperials Tomas Kennedy and Tralee Tigers player Joshua Osayanrhion.

KERRY OFFICIALS OFFICIATE AT THE HIGHEST LEVEL:

Whether you are a player or an official you want to get the opportunity to compete at the highest level. Last weekend four Kerry officials took charge of one of the biggest games in junior soccer – the FAI Junior Cup semi-final which saw Villa FC from Waterford defeat Salthill Devon. The four on duty were referee Derek O’Shea, assistants Thomas Sheehy and Anthony Morrison with Kevin Cunningham in the role of fourth official. The four did Kerry soccer proud.

ON THE SOCCER FIELD:

The Kerry 17’s League of Ireland enjoyed another good win defeating Waterford FC 2-0 but the 19’s lost 4-1 to the same opposition.

This Saturday the 17’s play away to Cobh Ramblers in the League. The 19’s are also in Cobh as they play Ramblers on Sunday in the Cup.

OPEN DAY AT THE TRALEE BAY SWIMMING CLUB:

This weekend the Tralee Bay Swimming Club are holding two open days from 9am to 12 noon on Saturday and Sunday May 7th and 8th.

Anyone interested in getting into sea swimming is invited along where they will find out all about the club’s activities. The club will hold 10 organised swims this summer, two away trips plus three bbq’s and an end of season party in September as well as the annual awards night.

The club’s desk will be at the main beach in Fenit on both days.

NO JOY AT THE CREASE:

There was no joy for the Kerry cricket sides in action last weekend. The Kerry 1st XI went down to Cork County after a tight game at the Oval at The Spa. Kerry were all out for 166 with their opponents making 167 for 8 with 2 wickets to spare.

The Kerry 2nd X1 were all out for 96 as they lost out to Cork Harlequins 2nd X1 as they reached their target with 5 wickets to spare.

The Kerry 3rds were at home as well and were chasing the 150 that Nenagh 2nd hosted but they were all out for 136 and went down by 14 runs.

ON THE GREENS: PITCH AND PUTT READY FOR TEE-OFF:

As planning for the Pitch &Putt season continues those involved in the sport in Kerry remember the contribution made by Tralee club Chairman and former County Board officer Tim Scannell who passed away in the off season. The Inter Club Matchplay gets underway in June where the Shield will be re-named in his honour.

They also remember Shane Murphy from Carrigaline who was well known on Kerry courses.

Play gets underway with the County Strokeplay Championships for adults getting the season underway. The action is on the Deerpark course with an 18 hole playoff for the Top 6 in the Senior, Intermediate and Junior Men’s after the first 36 holes. Play gets underway at 8.30am.

These competitions are also the first of five trials for Kerry Intermediate and Junior teams for the Munster InterCounty competitions in August. Four scores from the five trials will count. The Munster Schools competitions take place today (Friday May 6th) on the Majestic course in Mallow with St Brendan’s Killarney and St Michael’s Listowel chasing a Top 9 finish which will qualify them for the National finals in Clonmel in two weeks.

The National Matchplay qualifiers get underway in Newmarket from May 9th, on Saturday Tralee hosts the Munster Scotch Foursomes where 11 of the 29 entries will be pairs from Tralee and Deerpark. The Bob Casey gets underway on Tuesday May 17th in Tralee.

TRALEE GOLF CLUB: In the MC 3 Men’s Competition the overall winner was Gerard Power on 41 points with Kieran Dinan Junior the overall runner-up on 40 points. Michael Barrett was third on 40 points going down on the count-back of the last 9 holes.

The Best Gross went to Anton O’Callaghan with the Division 1-4 winners being Jim O’Donovan, Brian O’Loughlin, Ross Dowling and Willie McDonald.

The Front 9 went to Philip O’Sullivan and the Back 9 to Bobby O’Keeffe. In the Ladies Section the MC3 Competition sponsored by the Oyster Tavern was won by Katrina Mehigan on 40 points followed by Sophie Moynihan and Eilish O’Loughlin.

The Division 1-4 prizes went to Ella Moynihan, Karen Gearon, Noran Shanahan and Bernie O’Loughlin with the Front 9 to Eleanor O’Dowd and the Back 9 to Brid Halloran. The 9-Hole competition was won by Anne McGlynn. In the Ladies Singles the winner was Siobhan Stack with Paula Mangan in second and Pearl McGillicuddy in third. There was also action in the Seniors with a 12 Hole competition that was won by John R Collins with Philip O’Sullivan in second and Michael Devaney in 3rd. The 9 Hole 80+ winner was Padraig Corcoran.
