LEGAL MATTERS CORNER

MIRIAM

GILLICUDDY ANSWERS YOUR LEGAL QUERIES

My dad died recently died leaving behind a large enough estate. My siblings and I know that his intention was to leave everything to his wife (our mum) but we cannot find the will. Our mum is still alive and my siblings and I have agreed that we want our dads entire estate to go to our mum. If there is no will, will our portion of the estate go to our next of kin or is it possible to not accept our inheritance or do we have to accept our share of the estate and then give it back to our mum?

It would first be necessary to ascertain if the deceased person had a valid will. A valid will has to meet a number of formal requirements as set out in the Succession Act 1965. There is no centralised database of wills in Ireland so a search of the deceased personal files or papers may be needed as well as contacting any solicitor they may have dealt with in the past. If a thorough search yields no results, the person may have died intestate (without a valid will). Under Irish succession law when a person dies leaving a spouse and children, the estate is divided to two thirds to the surviving spouse and one third equally among the children. If one of the children has died that share goes to his/her children. A beneficiary is not compelled to accept a gift. If a child of the deceased decides that they want to refuse their inheritance they can do so by a formal deed of a disclaimer. A disclaimer (sometimes referred to as renouncing the inheritance) can be prepared by a solicitor and is signed by the beneficiary.

The disclaimer must be absolute and unconditional; a beneficiary cannot accept their inheritance and then disclaim it and once disclaimed the beneficiary will have no control or right over the gift so they cannot decide to whom it should be gifted to. If all children disclaim correctly then each portion will fall back into the intestate estate and the surviving spouse (your mother) becomes entitled to it. A disclaimer is a very useful way of making a family arrangement that works best for the family using relevant tax thresholds. This will prevent any potential tax liability from arising for the children as they will be treated as though they never inherited it at all. Spouses and civil partners are not liable for Capital Acquisitions Tax (CAT) on inheritances from each other.

Law Quip: The last will and testament of Edith S of Walsall included £50,000 to each of her children, Roger, Helen and Patricia. Their inheritance was not to be spent on ‘slow horses and fast women and only a very small amount on booze’.

Tralee businesswoman Jacqueline Higgins has been shortlisted for the prestigious Family Businesswoman of the Year category at the IMAGE PwC Businesswoman of the Year Awards 2026.

The family-run business has been serving communities across Kerry for more than 40 years and has grown into one of the county’s best-known waste and recycling companies. Gilroy’s Green Energy Achieves Major ISO Certification Milestone

Gilroys Green Energy has reached a significant milestone after being awarded three internationally recognised ISO certifications following an independent assessment by Qualitas Veritas and accreditation by CDL Group Ltd. The Ardfert-based company achieved certification across key areas including quality management, environmental responsibility and health and safety standards. The certifications apply to the full scope of Gilroy’s Green Energy operations, including the supply, installation and commissioning of energy upgrades

for both residential and commercial properties.

The company specialises in solar PV systems, heat pumps and battery storage solutions and has continued to grow its reputation across Kerry and beyond in the renewable energy sector.

Owner Martin Gilroy said the achievement reflects the company’s strong commitment to customers and high working standards.

“This is a proud moment for our entire team,” he said. “Achieving triple ISO certification demonstrates the standards we set for ourselves

every day in terms of quality, safety and environmental responsibility. Customers are placing huge trust in us when investing in energy upgrades for their homes and businesses, and these certifications give added reassurance that all work is carried out to the very highest standards.”

Mr Gilroy added that the company remains focused on delivering reliable, future-focused energy solutions for customers throughout Kerry and the wider region.

“We are passionate about helping homes and businesses

reduce energy costs and improve sustainability while delivering professional service from start to finish,” he said

Kerry and Donegal Supporters Are Being Locked Out” ...Senator Kennelly

Concerns over pay-per-view coverage of Championship football have intensified ahead of Kerry’s highly anticipated clash with Donegal GAA at Fitzgerald Stadium on Saturday, May 23, with Senator Mike Kennelly strongly criticising current broadcasting arrangements. Speaking in the Seanad this week, Senator Kennelly described the growing use of subscription streaming services for major GAA fixtures as “a disgrace”, arguing that many loyal supporters are being excluded from watching games involving their county teams. He said older supporters, people

living in rural areas, hospital patients and those without access to smart devices or reliable broadband are particularly affected.

“The very people who built the GAA are now being excluded from watching it,” Senator Kennelly said. He praised the strong attendances seen across the Championship so far this season, including almost 33,000 supporters in Killarney last weekend, saying Gaelic football had experienced a major resurgence in public interest.

However, he questioned why some high-profile matches are increasingly moving behind paywalls despite the

sport’s deep community roots. Kennelly called on the Minister for Sport to examine the current broadcasting model and ensure key Championship fixtures remain accessible to supporters throughout

Ireland. Attention now turns to next weekend’s Kerry versus Donegal showdown in Killarney, which is expected to attract another huge crowd as both counties continue their All-Ireland ambitions.

Bon Secours Tralee Partners With Kerry Camogie

Bon Secours Hospital Tralee has been announced as the new official health partner of Kerry Camogie following the signing of a new Memorandum of Understanding between both organisations. The partnership will see Kerry Camogie elite players gain access to a range of specialist medical and performance services, including advanced body composition analysis, diagnostic testing and medical assessment supports. The agreement was signed by Bon Secours Hospital Tralee CEO TJ O’Connor and Kerry Camogie Chairperson Anne-Marie Russell, with both parties expressing hopes of building a long-term relationship focused on athlete wellbeing and

performance.

Speaking after the signing, TJ O’Connor said the hospital was proud to support elite female athletes in Kerry and looked forward to bringing its expertise in sports health and diagnostics to Kerry Camogie.

He noted that the hospital has already built strong experience through partnerships with Kerry GAA, Kerry LGFA, Kerry FC and Tralee Warriors.

Anne-Marie Russell described the partnership as a major boost for the association, saying player welfare and athlete development remain central to Kerry Camogie’s ambitions.

She said access to first-class medical

and performance supports would help players continue competing at the highest level while ensuring their health and wellbeing are prioritised. Both organisations said the

agreement reflects a shared commitment to supporting women’s sport and developing elite sporting talent throughout Kerry in the years ahead.

Free Library Book Bags For Kerry Children

Norma Foley has announced the launch of the My Little Library Initiative 2026, inviting children across Kerry who are preparing to start primary school to collect a free book bag from their local library. The initiative is aimed at children completing the Government-funded ECCE pre-school programme and encourages families to build strong connections with their local library while supporting children as they make the transition to primary school.

From May 8, families throughout Kerry can visit their nearest library branch to collect the free My Little

Library bag, which will remain available throughout the summer months.

Each bag contains a selection of books and resources designed to help children with important milestones such as starting school, making friends and understanding emotions. Information for parents about supporting children during the transition to school and library services is also included.

The initiative has proven hugely successful since launching in 2022, with more than 20,000 children nationwide receiving book bags

and joining libraries last year alone, including over 1,000 children in Kerry.

Minister Foley encouraged families to take part and highlighted the importance of reading from an early age.

“The books are available in both English and Irish, so there really is something for everyone,” she said. The programme is funded by the Department of Children, Disability and Equality and delivered through local libraries in partnership with the Local Government Management Agency.

Families are also encouraged to join their local library and avail of a special My Little Library card wallet for children.

CSG Honours MTU Accounting Students at Tralee Awards Presentation

Recognising young talent and encouraging future careers in the region was at the heart of a special awards presentation hosted by CSG Accountants & Advisors at its Tralee offices recently.

Students and staff from Munster Technological University attended the annual CSG Accounting Awards, which celebrate academic excellence among third-year students studying on MTU’s Bachelor of Business (Hons) in Accounting programme.

This year’s award recipients were Wiktoria Grzesiak, Liam Sheehan and Hannah Mitchell, who were recognised for their exceptional results and commitment within the Accounting stream.

Speaking during the presentation, CSG Partner – Practice Development, Úna McShane, said supporting education and local

students remains an important priority for the firm.

“Investing in education is one of the most valuable ways a business can support its local community, and we are delighted to encourage students as they take the next steps in their professional journey here in Kerry,” she said.

She also emphasised the importance of acknowledging achievement at an early stage in a student’s career.

“Recognition like this helps to build confidence and ambition, while encouraging young people to believe in the opportunities available to them as future professionals,” she added.

CSG has a long-standing connection with MTU through graduate recruitment and professional training programmes, with many members of its current team having previously

the university. The continued partnership highlights the strong relationship between education and business in Kerry, helping to support local talent, career opportunities and the future growth of the region.

Boxing Meets Art In Unique Tralee Exhibition

A powerful new youth art exhibition exploring the connection between boxing, creativity and self-expression will officially open in Tralee during Traveller Pride Week.

“Things That Matter – A Paint Punch Exhibition” launches at 5pm on Thursday, May 28, at the KCYS Youth Centre on Denny Street and will feature artwork created by young people from Tralee and Listowel.

The exhibition grew from a unique project where boxing gloves were used to punch paint onto large wooden boards, creating

the foundation for nine striking artworks. The pieces were later refined through conversation, storytelling and detailed brushwork, allowing the young artists to express themes of identity, strength and imagination.

Developed by artist Frank McCarthy in partnership with Kerry ETB Local Creative Youth Partnership and The Gaff community venue, the initiative highlights how sport and creativity can combine to support wellbeing and youth expression. Organisers say the project is especially significant for young

Rockies Bound For Derry Féile Finals

Austin Stacks GAA Club U-15 boys are preparing for a major national adventure after qualifying for the Division 1 finals of the John West Féile Peile na nÓg 2026 in Derry this June.

The young Rockies secured their place at the national finals following two hard-fought victories over Milltown/Castlemaine and Kilcummin during the Kerry Féile competition.

The prestigious Féile Peile na nÓg tournament brings together underage Gaelic football teams from across Ireland, along with clubs from the UK, USA and beyond, making it one of the highlights of the GAA juvenile calendar.

Chamber Roadwork updates ahead of Food Festival weekend

“Following our meeting with Kerry County Council this morning, we wanted to share a brief update on the ongoing public realm works in the town centre.

Additional signage will be installed ahead of the Food Festival weekend to support accessibility and visitor movement throughout the town, including around the Garda Station, Post Office and routes toward the Island of Geese. Some barriers around the planters will also be repositioned to improve pedestrian flow.

Paving works at The Brogue are progressing well this week and that section is expected to be substantially reopened next week, with only limited barriers remaining in place while the paving cures before vehicular access resumes. Current works on Rock Street continue to progress with drainage and footpath installation, with

future phases moving toward Gas Terrace, Bridge Lane and Bilbooley Lane. These areas will ultimately see upgraded paving, lighting, restored parking and improved public spaces. The project remains on schedule for completion in Q2 2027. While works of this scale naturally bring some disruption, Tralee town centre remains fully open, welcoming and vibrant. Businesses are open as normal and there is a fantastic atmosphere building ahead of the Food Festival weekend. We encourage everyone to get into town, support local businesses and enjoy everything the town centre has to offer over the weekend. We will continue to engage closely with Kerry County Council and keep members updated as works progress.”

Castlegregory Students Win National Environmental Award

Students from Meán Scoil Nua an Leith Triúigh , Castlegregory , are celebrating major success after being named Overall Senior Winners at the Young Environmentalist Awards 2026 held at the RDS in Dublin. The school’s environmental group, MSLT Go Wild, also won the Senior Biodiversity Award for a project centred on protecting the vulnerable Ringed Plover bird species along the West Kerry coastline.

The students focused on raising awareness about the dangers facing the coastal bird during breeding season while encouraging practical conservation efforts to help safeguard nesting habitats in the Maharees and surrounding areas. The award-winning initiative involved close collaboration between students, teachers and environmental organisations, with

strong local support playing a key role in the project’s success. Martha Farrell of the Maharees Conservation Association praised the students for their creativity, teamwork and commitment, saying they quickly understood the importance of protecting the Ringed Plover and highlighting the growing pressures facing the species. Support was also provided by organisations and individuals including Munster Technological University, Analog Devices, the PHAROS Project, the National Parks and Wildlife Service and the Irish Wildlife Trust Kerry branch.

Principal Karen Blennerhassett said the school community was immensely proud of the students’ achievement and described it as a reflection of their dedication and environmental awareness.

The school also celebrated success for a second student group, Shore Line Shapers, who received a Highly
Commended Award for their EcoArt presentation.

THERAPY CORNER

Ask the KP therapy team

“How can massage and stretching together help my body recover, improve flexibility, and prepare me to return safely to regular exercise?”

"Massage and stretching work powerfully together to support muscle recovery, improve movement, and prepare the body for a safe return to regular exercise. Massage helps increase blood circulation, delivering oxygen and nutrients to tired or tight muscles while assisting in the removal of metabolic waste.

This enhanced oxygenation promotes tissue repair, reduces soreness, and restores the natural glide between muscle fibers, fascia, and surrounding tissues. By releasing tension and breaking down adhesions, massage can improve flexibility and reduce restrictions that may limit movement.

Stretching complements massage by lengthening muscles, improving elasticity, and restoring balanced range of motion throughout the body. When muscles are gently stretched after being softened through massage, they respond more effectively, allowing deeper release and better functional mobility. Together, these therapies can reduce stiffness, improve posture, and lower the risk of injury when resuming physical activity.

For individuals returning to exercise after inactivity, injury, or fatigue, combining massage and stretching offers a holistic approach to rebuilding strength and mobility.
