LEGAL MATTERS CORNER MIRIAM MC GILLICUDDY ANSWERS YOUR LEGAL QUERIES Donna lives separate and apart from her former partner and father of her child. His name was registered as the surname on her child’s birth certificate. As she has further children with her new partner, she wishes her child’s name changed to a double-barrelled name a combination of her surname Lynch and her expartners surname Tobin so that the child whose name is Lea will be known as Lea Tobin Lynch. Her former partner and father of the child is agreeable to this as it will make it easier for the child at school and she will have a name link with her other siblings as well.

It is difficult to change details on a birth certificate once registered. If a mother has registered as the mother on the birth certificate and the father is not on the birth certificate and goes on afterwards by virtue of agreement or court order the child’s surname can be changed at that stage to an amalgam of both surnames (double barrelled) or either the surname of the father or the mother by agreement. If a father subsequently marries the mother, it may be possible to change the surname. It is effectively a reregistration bringing in the father’s details where he was not on the birth certificate. The other scenario is where the parents marry after the birth, they can then apply to register the details and change the surname at the same time.

Otherwise, the only way to change the child’s surname is with a Deed Poll. This is a formal document recording a name change. It will usually be recognised by state and other organisations once it is enrolled in the central office of the High Court. If the Deed Poll is being completed or a minor the parents both must consent to the Deed Poll. Usually, it is the mother who will do the Deed Poll and the father consents, but it could also be the other way round. The Deed is done up recording the fact that the child who previously was the name on the birth certificate now wants to go by the new name incorporating both surnames. This is witnessed by a person usually a solicitor who swears an affidavit that they witnessed the signatures of the father and mother on the Deed Poll. The Deed Polls must be very exact and precise with all detail correct to be enrolled in the central office.

The parties need to confirm that they are agreeable to the enrolment which will be on the public record as well. Once a child is over 18 years, they can apply for a Deed Poll themselves.

This is often done also if a child wants to change their gender and would also like to change their first name to a suitable name for their gender change. All in all, in Ireland it would appear that people change their name by Deed Poll or of the minors they are guardians of for practical reasons unlike the United Kingdom where many people change their name to more dramatic, celebrity names.

Laughter lines/ Marionette lines I`m starting to notice more lines around my mouth and lower half of my face, what can I do to treat this?

Filler products containing hyaluronic acid are used to soften fine lines and wrinkles that appear when we age. Hyaluronic acid stores deplete in our body as we get older and the bone underlying the skin tends to resorb(reduce).However, this can be replaced by administration of a filler to replace volume lost around the cheekbones and soften the lines that appear around the nasiolabial folds(sides of nose and mouth).

Tributes pour in after the passing of Michael Hennebery Our dear friend & mentor Michael Hennebery has died. Michael was a wonderful character and one of life’s true gentleman. Michael was a wonderful neighbour down through the years. We soldiered together on Ashe Street for over thirty years.

Michael opened his premises on Ashe Street in December 1965. Originally it traded as a grocery shop. Michael had been a manager at Lipton’s grocers before making the decision to go out on his own. Hennebery’s has been an institution ever since.

He will be sorely missed by all who knew him. Our condolences to his entire family and to his many friends and loyal customers down through the years. May his gentle soul rest in peace. R.I.P Mike...Baileys Corner “He was such a wonderful gentleman. May he Rest in Peace.

The first FSG Emerald Award for Sustainability in the world goes to The Rose Hotel, Tralee The Rose Hotel is the first hotel in the world to achieve the coveted Emerald Status Award by environmental educational company Fifty Shades Greener.

Odran Lucey, the hotel’s Green Manager and Executive Head Chef has been a force of nature when it comes to leading The Rose Hotel on their sustainable journey.

Odran also became the first level 6 qualified Green Manager in the world in 2022, allowing him to be acknowledged for the environmental management skills he had gained through the Fifty Shades Greener qualification.

To achieve the Emerald Award, The Rose Hotel have been measuring and reducing their energy and water use and waste production, they have also measured their carbon emissions, completed many actions to reduce their pressure on these resources and created an Environmental Policy and Action Plan to commit themselves to future reduction. They have now proven their continued efforts with a reduction of their overall carbon footprint since they achieved a Silver Award at the beginning of 2022.

Now in 2023, they have successfully brought down their carbon footprint

by an impressive 32%.

“We are absolutely thrilled to have received the Emerald Award, this is the accolade we had been striving to achieve. This award could only be achieved with a great team effort, it is easy to get distracted with day to day business but the Emerald Award was a great focus on our sustainability journey, and we got there. The Rose Hotel have reduced the carbon footprint, something we hear about so often in the media, by 31%, this reduction is amazing.

To be the first hotel in the world to be awarded the coveted Emerald Status Award by FSG is a great honour”. Chinese New Year in Tralee Promises to be a Big One

Happy New Year from everyone here at the Tralee Chamber Alliance. 2022 was a roller coaster ride. Lifted restrictions saw a return to live events and we kicked off with a fantastic St Patrick’s Day Parade followed by a spectacular homecoming for Sam Maguire.

We were thrilled to welcome back the International Rose of Tralee Festival and Christmas gained an extra special glow in the Island of Geese with the new Christmas Market whipping up enough festive cheer to melt even the North Pole. A sensational fireworks display on New Year’s Eve provided the perfect ending to 2022 but there’s one more celebration to come. The Chinese New Year is just around the corner.

Anjie Baily, who co-ordinated Tralee’s inaugural Chinese New Year Festival in 2020 is looking forward to pulling out all the stops again this year.

“We are expecting a wonderfully colourful mix of culture and tradition and food, dance and music.”

Chinese New Year celebrates the beginning of a new year on the traditional Chinese calendar, often referred to as the Spring Festival in mainland China. This event will see a series of immersive and exciting activities, including a display of cheongsam (traditional Chinese dress) by some student nurses from MTU, Lions and Dragon Dances in the town centre and a Taste of Asia food market, including a demonstration in dumplingmaking.

“Dumplings were served at Chinese New Year as a celebration-food because they contained a meat filling which was a real treat as meat was scarce. They were shaped into little balls to represent nuggets of gold, something to bring good

fortune and luck.” Anjie tells me.

The celebrations will commence in Tralee town centre on Saturday January 28 from 1pm to 5pm and will include a special Chinesethemed family day so if you ever wanted to know more about acupuncture, traditional Chinese herbal medicine or what your animal sign is in the Chinese horoscope,

Irish Guide Dogs for the Blind - Valentine’s Dance in Meadowlands Hotel Irish Guide Dogs for the Blind (IGDB) Tralee Branch is delighted to announce that their ‘Puppy Love’ Valentine’s Dance fundraiser will take place on Friday 10th February in The Meadowlands Hotel, Tralee.

It’s an opportunity to enjoy a fantastic night of music, dancing and more while supporting the charity. With live music by Nitelife it promises to be a fun night, with great prizes to be won and special guests to meet.

The last thing anyone wants to happen on their skiing holiday is to have aches, pains or old injuries holding you back.

In KP Therapy we offer a full body Neuromuscular NCT. Here we will do a full body assessment checking your range of motion, strength and possible postural imbalances.

Through hands on therapy and exercise rehab we can improve any areas that need it. As there is such a demand placed on your lower limbs and especially your balance while you ski or snowboard, these will be the areas we will focus on the most.

TALKING SPORT WITH THE TRALEE ADVERTISER TRALEE PARNELLS HURLING AND CAMOGIE CLUB Academy Training Our academy hurling teams were back in action last Saturday with indoor sessions at the MTU sports arena. These sessions are aimed at boys born between 2010 and 2019 who have never played before and want to try out hurling. The U7 session is also open to girls born between 2017 and 2019. Operation Transformation Our Operation Transformation program got under way last week with over 70 participants signing up. There was a great turnout on Wednesday evening for the first circuits session at Cuman Iosaf where Diarmuid put everybody through their paces. Despite a wet Sunday morning everybody enjoyed the walking session on the new Fenit Greenway.

Every Step Counts The every Steps Challenge got under way last week. We ask all members and friends of the club to join and help us hit that 4000 KM total to be in with a chance of winning a prize for the club. To register download the “My Life” app, go to “Challenges” and select “Munster GAA - Every Step Counts” and then select “Tralee Parnells Hurling & Camogie Club”. If you have any trouble in signing up please contact Caroline on 085 7762896. Join our Operation Transformation group walk/run on Sunday Morning as a great way to clock up those steps and have a friendly chat along the way.

Club Social The club will hold a social and awards night on Saturday the 11th of February 2023 at the Rose Hotel, Tralee. The club invites all Parnells Hurling & Camogie supporters to our social to mark the 10 year anniversary of the club with special guests, our All Ireland Féile winners and their families. JOHN MITCHELS CLUB NOTES Annual AGM We held our Annual AGM last Saturday Above in Ballyseedy complex, in a well-attended meeting Chairperson Brid McElligott welcomed everyone to the annual review of club activities in 2022.Our President Ted Fitzgerald spoke about the huge amount of work that it takes to run a club in this day and age.

Brid said we all looked forward to getting back into playing action and wished all teams , club members and supporters’ success in 2023.

Irish Life Steps Challenge returns!!!

The Steps Challenge started on January 11th and runs till February 15th. We had fantastic numbers on the first night and would like to thank all who took part. We will reconvene again on Thursday evening at 7pm sharp. The club will be entered into a draw to win O’Neill’s vouchers once we collectively hit 4000km in steps. You must download the Irish Life app, and register for John Mitchels Kerry as outlined below.

AUSTIN STACKS CLUB AGM: A sizeable membership at our Senior Club AGM, held on Sunday last (15th Jan), saw most of our current ‘Top Table’ continue for the coming season. A brilliant Report by Club Secretary, Siobhán Power, was circulated

to members as they arrived. Club Chairman, Shane Lynch’s comprehensive address outlined the main events of 2022 and gave a detailed perspective on what’s lined up for the coming season.

Orlaith Griffin takes over as Children’s Officer while Carmel O’Neill moves to the Irish Language and Culture position.

And then towards the end of the Meeting there was widespread welcome for Aidan O’Connor who was formally elected Club President in succession to the late Brendan Dowling. Aidan was, and still is, synonymous with the C Team which he continues to manage and he was also Club Chairman for a five year period (2011-2015) in between Ger Reidy and Liam Lynch. .

WELL DONE: to Rathmore and Fossa on their respective Intermediate and Junior All Ireland wins last Sunday. It’s the fifth year now, since the competitions were revamped in 2004, that Kerry Clubs have won both Finals in the same year.

UNDER 7 FOOTBALL: Boys born in 2016/17/18 began their new season at 10am on Sunday last in the Mercy Mounthawk Gym. PEIL FAOI 9: All boys born in 2014/15 arrived full of enthusiasm to their new season’s Gaelic football activity. Next Sunday’s session will commence at 11am in the Mercy Mounthawk Gym. Everyone welcome!

UNDER 11 FOOTBALL: Last Sunday’s workout was ‘brill’...great skills, style and enthusiasm were very evident and good coaching took place. All boys born in 2012/13 will continue their football training on The Green CBS Astro on Sunday NEXT at 11am. Bring a friend or two or three next Sunday.

PEIL FAOI 13: ‘The ball is in and the game is on...!’ The U13 ‘23 season is well and truly in full swing! ! On Friday last the boys started 2023 with their first night of real action up at the Kerry Sports Academy, Munster Technological University, Dromtacker, Tralee.

Ireland Lights Up The rain cleared just in time for the first of our ‘Ireland Lights Up’ walks in conjunction with Operation Transformation. On Tuesday had 62 walkers with a great mix of ages.

Thanks to all those who helped with the refreshments on return. We look forward to 7 more weeks of group walking Registration starts at 6pm setting off from St Pats Clubhouse at 6.30pm sharp, don’t forget to sign in and wear your HIGH VIS jacket.

The route for this year is starting at St Pats Clubhouse V92RH98, by the canal to the marina and back again. It is a free event and refreshments afterward. No Age limit and Buggies are welcome.
