LEGAL MATTERS CORNER MIRIAM MC GILLICUDDY ANSWERS YOUR LEGAL QUERIES Sarah and Ryan have been in an intimate relationship for 7 years and Sarah moved into Ryan’s house 6 years ago. For first 6 years of the relationship, they were both very happy, Ryan’s business was booming, and he encouraged Sarah to give up her job in the local salon when she moved into his house, he said this would give her more time to maintain the upkeep of the house and he was able to financially provide for them both. Ryan treated Sarah to a luxurious lifestyle, designer bags and frequent holidays. Sarah felt she had become a housewife without been officially given the title, so she mentioned the idea of marriage to Ryan a year ago, and he was disgusted, he said he would never marry her. Sarah was hurt they had shared six years of each other lives together and he never intended on marrying her. Following on from this the relationship began to break down and Ryan expected Sarah to jump to his demands continuously, he started taking ‘solo’ trips away, no more nice gestures and Sarah became miserable. She moved out of the house with no where to go and no Income. Ryan said he always knew Sarah would eventually leave him and that’s why he never married her to avoid sharing his assets in a divorce and demanded she gave back all the gifts he gave her.

In Ireland once upon a time, marriage was a given for most couples.

However, times have changed, many couples are cohabiting and choosing not to get married for countless reasons, thus many people have found themselves in Sarah’s position. The Civil Partnership and Certain Rights & Obligations of Cohabitants Act, 2010 was introduced to establish rights for people who are not married and are financially dependent on their partner when the relationship breaks down.

Cohabitants can apply under a Presumptive Redress Scheme. Orders

which can be made include a property adjustment order, a compensating maintenance order and pension adjustment orders for the financially weaker cohabitant. To exercise rights under the 2010 act, Sarah must satisfy the courts that she is a qualifying Cohabitant.

How can one satisfy they are a Cohabitant: • To be considered a Cohabitant one must be one of two adults of either sex, in an intimate and committed relationship with another who they are living with full time and is not within the degrees prohibited by marriage.

This essentially examines the nature of the relationship.

How can one be considered a qualifying Cohabitant: • If the couples share a child, they must have been cohabiting for 2 years continuously. If the couple do not share any children, they must have been cohabiting for 5 years continuously. The courts will look for a determining event such as the birth of a child or purchase of a house.

Although from the face of it, it would appear Sarah is a cohabitant and has lived with Ryan the past 5 years. She must be able to prove to the court the relationship was intimate, and she was financially dependent on Ryan at the termination of their relationship, this can be difficult. The court, in making redress for a financially dependent cohabitant will have regard to the financial circumstances, needs and obligations of each qualified cohabitant. The rights and entitlements of spouses/former spouses/children of either cohabitant.

The contributions each of the cohabitants made to the welfare of the other including to the income, earning capacity or property and financial resources, any contribution made by either in looking after the home, any physical or mental disability of either, the conduct of each of the cohabitants, if that conduct is such that in the opinion of the court it would in all the circumstances of the case be unjust to disregard it.

A night to remember(tonight) Padraig by his best friend Liam!

A popular sports reporter and administrator from Killarney, who passed away following a brief illness in October, will be remembered at a special concert dedicated to his contribution to the local community.

Pádraig Harnett, who was originally from Upper Park Road but was married in Currans, was a great friend and work colleague of multiinstrumentalist Liam O’Connor who is staging the concert along with his very talented family.

He will be joined for the occasion by his daughter Saoirse and sons Oisin and Cillian.

The event will be held in The Fáilte Hotel in Killarney on Friday, February 3 and all proceeds will to to the Football for All initiative at Killarney Celtic FC, a club with which Pádraig had a life-long involvement.

Celtic’s Football for All project caters for children with varying needs and it ensures inclusivity and participation for everybody.

Admission on the night will be €10.

The late Pádraig Harnett (pictured, below , with Liam O’Connor) carved out a solid career as a freelance sports reporter, contributing to local radio and print and social media on a number of sports including soccer, basketball, cycling and rallying and his position as PRO with a number of clubs kept him in the know and

In this weeks column we talk to Laura about Intra-Oral Tissue Release.

Hi Laura, can you explain a Little more about what Intra-Oral Tissue Release is?

Are you embarrased because your jaw clicks when you eat? Do you feel pain while you eat? Or maybe you suffer from pain in your neck, bad headaches or even migraines?

Have you tried to take painkillers but they did not work as you expected.

In every source of pain there is always a common pattern of movements that we use and repeat over and over again without being aware that they are the root of our pain or discomfort.

The muscle that hold the most tension in our bodies is called ‘Masseter’. We have two of these and they are located at the sides of our jaw. This muscle opens and closes our jaw, allowing us to talk, chew or yawn.

There are various techniques that Neuomucular Therapists can perform to relieve the pain in this area. In the picture attached Kevin is using an Intra-Oral Tissue Release technique. This technique is suitable not just to relieve the pain, but it is also suitable to treat headaches, migraines, vertigo, changes of sensation in ears, impaired hearing and jaw joint noises.

Fenit Village set to enjoy more reliable water supply Uisce Éireann, working in partnership with Kerry County Council, is replacing approximately 3km of old damaged water mains in Fenit, Co Kerry that were prone to frequent bursts and leakage which caused water supply disruptions for customers in the area.

The works, which will be carried out

by Ward and Burke Construction, will take place in Fenit Village from early February and will be completed by the end of June.

Commenting on the project, Steven Blennerhassett of Uisce Éireann said: “This watermains replacement work is part of a significant investment by Uisce Éireann to upgrade the water network in Kerry and we would like to thank customers in advance for their cooperation and patience while we complete this essential project.

In late 2022, we also replaced just over 1km of old water mains in Kilfenora, Fenit. With another 3km of water mains now to be replaced,

the people of Fenit will have a more reliable water supply for years to come.

Steven added: “The replacement of these old pipes will have a positive impact on the daily lives of the local community. Operational and maintenance costs will also be reduced as the network operation will require less maintenance. To facilitate the safe delivery of the works, there will be some shortterm local road closures and traffic management in place during the works. The community will be notified of this in advance and alternative routes will be clearly signposted. Local and emergency access will be maintained at all times.

The section of works will take

place in Fenit Village between the R558 from its junction with Talaught Road by Bay Beach, to Wild Water Adventures. Works will also take place on the following local roads: Talaught Lane, Island View,

Castleview and the Main Road from its junction with R558 to its junction with Island Road before continuing southbound towards Fenit Strand.

Confirmation of over €2 million in funding for Kerry walking and cycling infrastructure projects Minister for Education and Kerry T.D Norma Foley welcomes confirmation of €2,350,000 in funding for 26 walking and infrastructure projects in Kerry.

This substantial investment will provide for the development of segregated cycle lanes and widened footpaths, new walking and cycling bridges, and new pedestrian crossings.

Some of the major projects receiving funding include the Rock Road Killarney (€778,000), the Listowel Greenway Link (€700,000) and the Canal to Town Centre, Tralee (€100,000).

Funding is also provided to allow eight schools in Kerry to join the Safe Routes to School Programme providing infrastructure and facilities

for safer cycling and walking routes.

The eight schools receiving funding are:• Moyderwell Mercy Primary School €65,000• Mercy Secondary School, Mounthawk, Tralee €45,000• Sacred Heart Primary School, Castle Street Upper, Tralee € 40,000• Presentation Secondary School, Ballymullen,Tralee €35,000•Scoil Mhuire na mBriathre (CBS Primary), Tralee €15,000•Fossa National School, Killarney €5,000• Intermediate School, Killorglin €5,000• Scoil Mhuire B, Killorglin €5,000 Minister Foley said: I welcome confirmation of this significant funding which will enhance and develop walking and cycling infrastructure across the county. Tralee Save the Green 100 Year anniversary meet this Sunday In June, 1922, Tralee Urban District Council

decided to purchase The Green in Tralee.

The purpose was to build some houses for the townspeople and also to provide an open recreation area. The deeds were lodged in the Deeds Office in Dublin on February 5th 1923 at 12.35pm. In 1923 there were 118 acres, there are 35 acres presently in 2023. Tralee Save The Green Committee, which was founded in 1969, will assemble at the Denny St. Gates on this Sunday, February 5th at 12 noon to mark the event. All are welcome to mark the centenary.

Over €1 million for Dingle harbour Minister for Education Norma Foley TD welcomes confirmation of €1,350,000 in capital funding for Dingle Harbour through the Fishery Harbour and Coastal Infrastructure Development Programme.This programme provides strategic investment in harbour infrastructure to attract increased landings into Ireland of sustainably caught fish, driving the development of the seafood processing sector and the blue economy in coastal communities.

Manor West Hotel Leisure Club launches five Sports Scholarship

The team at Manor West Hotel Leisure Club are launching five Sports Scholarships for competitive athletes. The Sport Scholarships are for those involved in sport from across multiple disciplines, in either team or individual categories any sport participant is applicable once you are over 18 years of age.

The Sports Scholarship includes Full Gym Membership to the Manor West Hotel Leisure Centre.

The leisure club has a state of the art sports performance room, cardio fitness gym and our zero gravity fitness studio which has recently been remodelled for high intensity training classes. The Leisure Club also features an 18-metre pool with two lanes, underwater loungers, swan jets, Jacuzzi, Steam Room, Sauna and Therapy Pool.

Isabella from Dromclough N.S named Senior County Winner in National Art Finals Isabella McEnry, a 5th Class pupil from Dromclough National School was presented with her Senior Category County Winner’s plaques for her entry in the ‘Someone Like Me’ art competition. The presentation was made at the first in-person national final to take place for two years which saw representatives from 50 primary schools across the country gather at Dublin City Hall.

The fully accessible event was also livestreamed on the Someone Like Me website so classmates, family members and friends could join in remotely. The competition,

which is supported by the National Disability Authority, attracted over 2,700 entries from primary school pupils and their teachers right across Ireland – The prestigious competition which is now in its seventh year is a national celebration of the things that unite children of all abilities, helping to nurture more positive attitudes towards persons with disabilities.

Open For Farm Support Workers In Kerry FRS Farm Relief is hoping to secure an additional 20 farm workers in Kerry this spring to join their workforce supporting the farming community throughout the county.

They are offering interested workers a potential package of over €6,000 for those who provide farm support for the next three months.

Workers will be provided with guaranteed pay based on hours worked with opportunities to earn extra. Other benefits include localised work built around their geographical location, a commitment to help team members

progress their skills and career, an online app to easily manage their working schedule and pay, matching the work and farm to their skills and preferences, additional training and dedicated local point of contact.

FRS are particularly keen to hear from workers with previous farming experience, including milking.

Among the type of tasks those who join the FRS Farm Relief team of farm workers can expect to undertake, depending on their skillsets and preferences, will include milking; operation of farming machinery such as tractors, loaders,

quads and other machinery; calving duties including calf rearing as well as general farm work such as feeding, bedding and herding. This recruitment campaign comes as FRS Farm Relief notes there will be a strong demand for additional farm labour throughout the spring season.

TALKING SPORT WITH THE TRALEE ADVERTISER KERINS O’RAHILLYS 10K Run : A fine bright spring morning brought the crowds to Strand Road on Sunday to participate in the 5/10k run in honour of the late Tom Begley.

There was a great atmosphere as the 300+ people gathered before the 11.00 o’clock start, with many families present to savour the occasion.We would like to thank everyone who took part, to Bomber and David for presenting the medals and the hard working committee who helped to make this such an enjoyable event.

Seniors: David Moran announced his intercounty retirement on Monday last, bringing the curtain down on a fifteen year Kerry career that ended with 3 Celtic crosses. David made 53 championship appearances for Kerry scoring 1-23 whilst racking up 58 league appearances and amassing 3-41 in total.He played in 9 Munster senior finals culminating in a 100% win record.

David was highly lauded by a myriad of journalists & commentators following the announcement, with a recurring theme highlighting his high fielding, resilience to come back from two cruciate injuries, plus his exemplary conduct on the field of play. We wish David the best of luck in his future endeavours and look forward to seeing him in the blue and white of Strand Road over the coming years.

Ballymac Minors Austin Stacks v Ballymac Our Minor team played in the first round of the Tralee/St Brendan’s Board District league versus Austin Stacks in our first game of the new season in Connolly Park in ideal January conditions on Sunday.

It was Austin Stack who just about got over the line with a final score Austin Stacks 1-09 Ballymac 1-07. Well done to our boys for the effort and application shown.

Kerry Hoteliers Urge Government to Retain 9% Tourism VAT Kerry hoteliers have welcomed comments this week by Minister for Tourism Catherine Martin, TD, that she will continue to seek a further extension of the 9% VAT rate for the tourism and hospitality sector in Ireland.

The tourism VAT rate, which is due to expire at the end February, is currently under review by the cabinet. In light of the growing economic challenges facing the sector, local hoteliers are urging the Government to retain the existing 9% rate to safeguard tourism livelihoods and secure the long-term, sustainable development of Irish tourism.

With a full recovery in tourism now likely to be delayed until 2026, an increase in the VAT rate to 13.5% is the last thing that should be contemplated
